    Trump’s wild threats put press freedom in the crosshairs in second term

    Donald Trump could have an easier time limiting press freedom in his second term in the White House after a campaign marked by virulent rhetoric towards journalists and calls for punishing television networks and prosecuting journalists and their sources, legal scholars and journalism advocacy groups warn.Aside from worries about Trump’s demonization of the press inciting violence against journalists, free press advocates appear to be most alarmed by Trump’s call for the US Federal Communications Commission (FCC) to revoke TV networks’ broadcast licenses and talk of jailing journalists who refuse to reveal anonymous sources.Still, despite a conservative majority on the supreme court and likely Republican control of the House and Senate, those same people also say that America’s robust first amendment protections and a legislative proposal and technology to protect sources mean that a diminished press under Trump is not a certainty.“My big-picture concern is that Trump is going to do exactly what he has been telling us that he wants to do, which is that he is going to punish his critics,” said Heidi Kitrosser, a Northwestern University law professor.Kitrosser added: “He is going to punish people who dissent from his approach to things, people who criticize him and also, perhaps more importantly, investigative journalists and their sources who are not offering opinions but are exposing facts that he finds embarrassing or inconvenient.”Trump has long said journalists deliver “fake news” and are the “enemy of the people”, but since leaving office in 2021 he has used more violent language. At a 2022 rally in Texas, Trump suggested that the threat of rape in prison could compel a journalist to reveal their sources.“When this person realizes that he is going to be the bride of another prisoner shortly, he will say, ‘I’d very much like to tell you exactly who that was,’” Trump said.At a recent campaign rally, Trump also said that given where the press was located at the event, if someone were to try to assassinate him, the person “would have to shoot through the fake news, and I don’t mind that so much”.Kash Patel, who could be appointed as acting attorney general or head of the CIA, frequently talks of the “deep state” and told the far-right Trump ally Steve Bannon in a podcast interview: “We will go out and find the conspirators, not just in government but in the media … We’re going to come after you.”Trevor Timm, executive director of the Freedom of the Press Foundation, said it was “entirely possible that [Trump] is just bloviating”.In his earlier campaigns and first term in office, Trump “was on the campaign trail calling them names and riling up crowds, but he was not actively saying, ‘I want to throw them in jail,’” Timm said.Trump also posted on Twitter during his first term about revoking broadcasters’ licenses when they put out “fake news”.After the tweets, Ajit Pai, then the FCC chair appointed by Trump, said: “I believe in the first amendment.”View image in fullscreen“Under the law, the FCC does not have the authority to revoke a license of a broadcast station based on a particular newscast,” Pai explained.But Trump and his supporters talked more about revoking the licenses during his second run for the White House. CNN reported in October that Trump had over the last two years said at least 15 times that the government should take such actions.After a 60 Minutes interview in October that contained an answer from Kamala Harris about the war in Gaza that differed from her response in a trailer for the interview, Trump called CBS a “threat to democracy” and said its license should be revoked.An FCC commissioner appointed by Trump recently also said that NBC could lose its license for having Harris appear on Saturday Night Live before the election and not giving equal time to Trump.Another Trump-appointed FCC commissioner said it “would not be inappropriate for the commission” to investigate the complaint about the 60 Minutes interview.“That is even more disturbing, because it means that it’s not just Trump wildly spewing off the cuff. It means that two of the five current FCC chairs might be amenable to this argument,” Timm said.Still, it is unlikely that the FCC would be able to revoke a broadcaster’s license before the end of Trump’s term, according to Andrew Jay Schwartzman, senior counselor for the Benton Institute for Broadband and Society.skip past newsletter promotionafter newsletter promotionThe commission only revokes a license when a broadcaster goes off the air, Schwartzman said. The government agency could then take back the spectrum licensed to the station in case someone else would like to use it.The commission could deny a license renewal, but none are up for renewal until June 2028, and the commission would not be able to even decide to hold a hearing on a renewal before the end of Trump’s second term in office, Schwartzman said.As to cracking down on whistleblowers and journalists, Trump could use the Espionage Act, which allows the government to pursue people who share information with journalists related to national security, Kitrosser said.Barack Obama was also aggressive in his use of the law to prosecute whistleblowers during his presidency.Kitrosser said she was “very, very disturbed” by Obama’s crackdown on media sources.But the difference between the Obama administration’s effort and Trump’s call for prosecuting journalists and sources who leak information is that Trump has repeatedly said: “He does not think that criticism of him, criticism of judges that he appoints, criticism of his policies … should be protected,” Kitrosser said. “Not to protect national security, but to protect himself, and I think that is really the fundamental difference between Obama and Trump.”The Trump administration will probably have an easier time pursuing sources than journalists.“I think courts will be more receptive to the argument that the first amendment bars media prosecutions of journalists under the Espionage Act than they have been receptive to those claims by media sources,” Kitrosser said.To protect sources, journalists could also start to rely more on encryption communication tools like Signal in a second Trump term. The Freedom of the Press Foundation has urged journalists to start using such technology.The organization is also lobbying for the passage of the Press Act, which would prohibit the federal government from compelling journalists to disclose certain protected information, except in limited circumstances such as to prevent terrorism or imminent violence, and from spying on journalists through their technology providers.The House passed the bill unanimously. Three Republican senators have also sponsored the legislation, but it has stalled in committee because of a small group of Republicans, including Senator Tom Cotton of Arkansas, who argued the bill would “open a floodgate of leaks damaging to law enforcement and our nation’s security”.“Too many journalists are little more than leftwing activists who are, at best, ambivalent about America and who are cavalier about our security and the truth,” Cotton wrote in a statement explaining his opposition.Timm, of the Press Foundation, said he was unsure whether the Senate would pass the legislation before Joe Biden leaves office.“The Democrats in the lame duck session are really going to have to prioritize it because when the Senate changes hands and the White House changes hands, there is probably little to no chance that this bill would pass,” Timm said. “It’s now or never for protecting journalists’ rights.” More

    More recently, Trump sued ABC News and George Stephanopoulos for defamation over the way the anchor characterized the verdict in E Jean Carroll’s sexual misconduct case against him. Each of those cases is wending its way through the courts.There is nothing to suggest that Trump would soften his approach in a second term. If anything, we can expect even more aggression.Consider what one of Trump’s most loyal lieutenants, Kash Patel, has said.“We’re going to come after the people in the media who lied about American citizens, who helped Joe Biden rig presidential elections,” Patel threatened during a podcast with Steve Bannon. “Whether it’s criminally or civilly, we’ll figure that out.”Patel, a former federal prosecutor who was Trump’s counterterrorism adviser on the national security council, has been mentioned as Trump’s pick for FBI director or attorney general.It’s this kind of rhetoric, combined with Trump’s past behavior, that caused one Washington-based science writer to express his concerns in a piece titled “Will Journalism Be a Crime in a Second Trump Administration?”Environmental journalists “are used to worrying about things that are endangered”, wrote Joseph A Davis in the journal of the Society of Environmental Journalists.“So we think it’s time to add press freedom and democracy to the endangered list.”View image in fullscreenIn addition, consider Project 2025. The blueprint for a second term from Trump’s allies is a press-rights nightmare.Under Project 2025, seizing journalists’ emails and phone records would get easier. The editorial independence of Voice of America would be sharply curtailed; in fact, the global organization might be shut down altogether. Former officials who talk to reporters would be punished. Funding for NPR, PBS and public broadcasting would dry up.“A pretty grim picture,” was the conclusion of Joshua Benton of Harvard University after analyzing Project 2025 from the perspective of press rights.“The first time around, there was at least a modicum of uncertainty about what a Trump administration would actually do,” Benton wrote in Nieman Lab. “The second time, voters knew better, and they rejected it. The third time? Well, no one can say it’ll come as a surprise.”As for Kamala Harris’s attitude toward press rights, we don’t know a great deal, except that she’s doing things in the normal, pre-Trump way.Her web site’s policy section trumpets her defense of “fundamental freedoms”, stressing reproductive rights and voting rights, but not freedom of the press.In a new report on press freedom and the election, the Committee to Protect Journalists reports that neither presidential candidate responded to their request to pledge clear support for press freedom.The CPJ report found that Trump’s antipathy for journalists has left lasting harm, from the local to the global level, harm that was not adequately repaired during the Biden years.“The hostile media climate fostered during Donald Trump’s presidency has continued to fester, with members of the press confronting challenges – including violence, lawsuits, online harassment, and police attacks – that could shape the global media environment for decades,” according to the report.“The stakes of this election are incredibly high,” the report’s author, Katherine Jacobsen, told me.After Joe Biden passed Harris the torch over the summer, the vice-president came under fire for not quickly sitting down for an interview or doing a press conference.She promised to do an in-depth interview by the end of August – and met her self-imposed deadline.That first was with CNN’s Dana Bash, certainly a mainstream choice. Harris has since fielded questions from members of the National Association of Black Journalists at WHYY, the public radio station in Philadelphia. And she sat down in September to discuss her economic policy plans with MSNBC’s Stephanie Ruhle.View image in fullscreenThere’s little to suggest that she’ll try to portray the press as the enemy of the people or start prosecuting journalists under the Espionage Act. Such prosecution did happen under Trump. (It also did under Barack Obama, though that has been largely forgotten in the chaos of the last eight years.)Trump’s justice department seized the phone and email records of a New York Times reporter, Ali Watkins, and used the Espionage Act to jail a journalistic source, Reality Winner, for leaking a classified document about Russian interference in the 2016 election.Trump’s affinity for autocratic leaders adds another layer of concern.Writing in the Washington Post, the publisher of the New York Times, AG Sulzberger, raised an alarm about whom Trump looks up to.“If Trump follows through on promises to continue [his anti-press] campaign in a second term,” Sulzberger wrote, “his efforts would likely be informed by his open admiration for the ruthlessly effective playbook of authoritarians,” such as the Hungarian leader, Viktor Orbán.Sulzberger, though, also wrote that he had no intention of allowing these concerns to affect his paper’s straight-news coverage: “I disagree with those who have suggested that the risk Trump poses to the free press is so high that news organizations such as mine should cast aside neutrality and directly oppose his reelection.” In its opinion pages, however, the Times’s editorial board has called Trump unfit to lead and strongly endorsed Harris, calling her “the only patriotic choice for president”.It would be heartening to hear Kamala Harris publicly express her support for the essential role of the press in a free society, something to be protected and even celebrated. That may never come to pass.Still, it’s probably reasonable to assume Harris will treat the press as many Oval Office dwellers have in the past, as something of a burr under the presidential saddle.By contrast, Donald Trump poses a clear threat to journalists, to news organizations and to press freedom in the US and around the world.Trust in the media may be low, and American citizens may not be fans of journalists or their work.But they ought to know that just as longstanding reproductive rights have collapsed in recent years, press rights – already reeling – could suffer the same fate.

    At last, Julian Assange is free. But it may have come at a high price for press freedom | Trevor Timm

    Julian Assange is on the verge of being set free after the WikiLeaks founder and US authorities have agreed to a surprising plea deal. While it should be a relief to anyone who cares about press freedom that Assange will not be coming to the US to face trial, the Biden administration should be ashamed at how this case has played out.Assange is flying from the UK to a US territory in the Pacific Ocean to make a brief court appearance today, and soon after, he may officially be a free man in his native Australia.The deal is undoubtedly good for Assange, who has been holed up in Belmarsh prison suffering from serious medical problems for the past five years, and stuck in the Ecuadorian embassy in London for seven years prior to that. It’s good for the Biden administration, which avoids the embarrassment of potentially losing its extradition case in the UK high court, but more importantly avoids the Assange case becoming a polarising issue in the election.But is the deal good for press freedom? Not so much. Don’t get me wrong: there’s no doubt the worst fate was avoided and every journalist breathed a sigh of relief that this result did not occur via a court decision. A plea deal does not create an official precedent that a conviction and appeals court ruling would – something that could have potentially binded other courts to rule against journalists in future cases.But it’s hard not to be shaken by the charge the US justice department forced Assange to plea to in order to get his freedom: a conspiracy to violate the Espionage Act, which according to the law, amounts to “receiving and obtaining” secret documents, and “willfully communicating” them “to persons not entitled to receive them”. (In Assange’s case, that means the public). That is a “crime” that journalists at mainstream outlets all over the US commit virtually every day.A court won’t readily be able to cite DoJ v Assange in future rulings, but that doesn’t mean this guilty plea won’t embolden future federal prosecutors with an axe to grind against the press. They will see this case as a success. And it doesn’t mean the legal arms of news outlets won’t now be worried a case can be brought against their own journalists for ordinary journalistic conduct that was once assuredly protected by the first amendment.Just imagine what an attorney general in a second Trump administration will think, knowing they’ve already got one guilty plea from a publisher under the Espionage Act. Trump, after all, has been out on the campaign trail repeatedly opining about how he would like to see journalists – who he sees as “enemies of the people” – in jail. Why the Biden administration would hand him any ammo is beyond belief.So if the Biden administration is looking for plaudits for ending this case, they should get exactly none. They could have dropped this case three years ago when they took control of the DoJ. Every major civil liberties and human rights group in the country repeatedly implored them to. They could have just dropped the case today, with Assange spending the same amount of time in prison, but they felt the need to again emphasise in court documents that they believe obtaining and publishing secret government documents is a crime.Of course, some will say, “oh, Assange got what he deserved,” or “he’s no journalist, why should I care,” as people do whenever you bring up the inconvenient fact that prosecuting Assange will affect countless other journalists. Assange made himself the permanent enemy of millions of Democratic voters after publishing leaked emails from the DNC and Clinton campaign in the run-up to the 2016 election, and many people can’t see past that. But it’s worth repeating that this case had nothing at all to do with 2016. And whether you think Assange is a “journalist” or not, the DoJ wanted him convicted under the Espionage Act for acts of journalism, which would leave many reporters, including at the Guardian, exposed to the same.Now we can only hope this case is an aberration and not a harbinger of things to come.

    Rightwingers praise free speech at CPAC Hungary – then eject Guardian journalist

    US Republicans and their European allies tore up news headlines and ejected a Guardian journalist from a conference of radical rightwing activists, on the same day that they highlighted the importance of free speech.Speaking at the second annual meeting in Budapest of the US Conservative Political Action Coalition (CPAC), Kari Lake, a failed Republican gubernatorial candidate, said that “truth-tellers and peacemakers” were being destroyed by “fake news”.“It’s always opposite day in the media: if they’re telling what you’re doing is bad, it’s probably good,” said Lake before tearing up a sheaf of printed articles about the conference aimed at cementing radical rightwing ties across the Atlantic.Despite being a former TV news anchor, Lake made hostility towards the press a central theme in her unsuccessful 2022 election campaign, which included an advert in which she smashed TVs and pledged to “take a sledgehammer to the mainstream media’s lies and propaganda”.Addressing CPAC, she said her childhood ambition was to be a journalist, but that during the Covid pandemic she had realized that “some of the news wasn’t true”.Lake was one of the most high-profile Republicans in the midterm elections to embrace Donald Trump’s lie about voter fraud. She lost her bid to become the governor of Arizona but refused to concede and continued making false claims of electoral wrongdoing.The CPAC audience also watched a recorded message from Donald Trump in which the former president said conservatives were “fighting against barbarians” and listed freedom of speech as one of the cardinal virtues of the far right.“We believe in tradition, the rule of law, freedom of speech and a God-given dignity of every human life. These are ideas that bind together our movement,” Trump said.Not long afterwards, a Guardian journalist was ejected from the conference, during an interview with Rick Santorum.The former Republican senator was praising Hungary’s parental leave policies, when one of the conference organisers grabbed him by the arm and pulled him away mid-sentence.A security guard then led the reporter to the exit.Meanwhile, speakers including the Newsweek comment editor, Josh Hammer, were preparing for a panel on “Free Speech”.CPAC later described the reporter’s registration for the conference as a “system error”.The International Press Institute (IPI) denounced the Guardian’s ejection from the event as a “shameless move” and an “attack on media freedom”.Enmity towards the media has been a constant theme at CPAC’s Hungarian iteration. Last year the organizers refused entry to journalists from all US media outlets, including Vice, Vox, Rolling Stone, the New Yorker and the Associated Press.This year, most independent journalists were refused accreditation for the event, held in a country where the IPI has said media freedom “remains suffocated”.     Biden calls family of reporter detained in Russia and charged with espionage

    Joe Biden spoke to the parents of Wall Street Journal reporter Evan Gershkovich on Tuesday, nearly two weeks after the Moscow-based journalist was detained in Russia and charged with espionage.The president made the call as he flew to Belfast to start a four-day trip to Northern Ireland and Ireland. The call happened one day after the Biden administration formally declared the reporter had been “wrongfully detained”.The designation elevates Gershkovich’s case for the US government and means that a particular state department office will take the lead on seeking his release.Before departing Washington on Tuesday, Biden again condemned the journalist’s detention. Both the US government and Wall Street Journal have vehemently denied the Russian accusation that Gershkovich is a spy.“We’re making it real clear that it’s totally illegal what’s happening, and we declared it so,” Biden said. “It changes the dynamic.”The White House press secretary, Karine Jean-Pierre, told reporters after the call that Biden “felt it was really important to connect with Evan’s family, his parents”. She said that Gershkovich, 31, has been “top of mind” for the president.The White House’s national security council spokesperson, John Kirby, said that the Russian government has yet to grant US consular access to Gershkovich.“It’s not for lack of trying,” Kirby said, adding that the state department has been seeking access “ever since the moment we found out that he was detained”.Russian authorities arrested Gershkovich in Ekaterinburg, Russia’s fourth-largest city, on 29 March. He is the first US correspondent since the cold war to be detained in Russia for alleged spying.In their own statement Tuesday, Gershkovich’s family members issued a statement thanking Biden for the call and saying they had “a hole in [their] hearts … that won’t be filled” until the journalist’s return.“We are encouraged that the state department has officially designated Evan as wrongfully detained,” the Gershkovich family’s statement said. “We appreciate President Biden’s call to us today, assuring us that the US government is doing everything in its power to bring him home as quickly as possible.“In addition to being a distinguished journalist, Evan is a beloved son and brother.     Twitter insisted on Friday that the company “manually reviewed” every account it suspended last night, ranging from prominent journalists from the New York Times, CNN and Washington Post, and a number of popular liberal commentators.Ella Irwin, Twitter’s head of trust and safety, made the claim in an email to Reuters, stating the manual review was on “any and all accounts” it said violated its new privacy policy by posting links to a Twitter account called ElonJet, which tracked Elon Musk‘s private jet using information in the public domain.Musk, formerly the world’s richest man, who bought the social media platform for $44bn earlier this year, accused the journalists of posting “assassination coordinates” by publicizing the ElonJet account, which was suspended earlier.“Criticizing me all day long is totally fine, but doxxing my real-time location and endangering my family is not,” Musk tweeted.He did clarify how he thought they had done so. And he hung up on a Twitter Spaces audio chat after clashing with some of the journalists he banned.
