    A ‘gut punch’: Trump’s alleged sexual assault victims and their advocates on his win

    When Donald Trump was elected to a second term last week, women who say he sexually assaulted them, and other victims of sexual abuse, voiced disappointment that a man repeatedly accused of sexual misconduct could once again become president, with one of them describing this win as a “gut punch”.More than two dozen women have made such claims against Trump, including E Jean Carroll, who was awarded nearly $90m total in two civil trials after jurors found that Trump sexually abused and defamed her. She said on X: “I tried to tell you.”Several survivors of sexual assault interviewed by the Guardian, as well as advocates for persons who have suffered abuse, said they were not surprised by Trump’s win. They felt it was another example of how sexual abuse is not taken seriously, or pointed to the fact that powerful people who perpetrate abuse seem to be able to avoid repercussions.Stacey Williams, who said she met Trump through Jeffrey Epstein about three decades ago, and told the Guardian that the now president-elect groped her at Trump Tower in 1993 in what seemed to be a “twisted game” with the late sex predator, is among the many processing election results.“I think what we were all hoping was that [the] truth would come through and the stories would affect people’s vote once they had [them] in front of them.”But, she said: “Disinformation won this election at the end of the day, and if we don’t figure out an answer for that, I don’t have a lot of hope for this country.”Emails to Trump’s camp did not receive an immediate response. Trump has previously denied all allegations of misconduct.Williams said that she was in Pennsylvania canvassing for five days. “Some of the women would say: ‘Will you please tell my husband your story?” she recalled.One woman even brought Williams into the house, so she could tell the woman’s brother her account. Williams did and “I saw him just kind of like, sink.” To her, the reaction suggested that he had not heard this account before.“I didn’t get the impression he even knew that Trump was an offender.“I had never wanted to tell my story, I knew it was going to be sort of a big media firestorm and blow up – that’s a lot to take on, let alone all the backlash and the misogyny,” she also said. “I was bracing myself for that, but it was worth it if I could get my message out there.“None of it mattered. All he had to do was say: ‘Eh, she’s lying,’” Williams said, prompting his followers to take the same tack. “Everyone’s like: ‘OK, let’s move on.’ That’s a lot to stomach.”Among the women who have come forward with allegations against Trump is Amy Dorris, a former model, who told the Guardian that he sexually assaulted her at the US Open tennis tournament in 1997. Dorris alleged that Trump forced his tongue down her throat, groped her body and kept her in a grip from which she could not escape, in an incident that made her feel “sick” and “violated”.Two other prominent accusers include Natasha Stoynoff and Jessica Leeds, who testified in court for Carroll’s civil proceedings against Trump. Stoynoff said that Trump assaulted her in a room at Mar-a-Lago about 20 years ago, when People magazine had sent her there to interview him about his first year of marriage to his third wife, Melania Trump.Leeds came forward in 2016 claiming that Trump grabbed her breasts and tried to put his hand up her skirt when they were seated next to each other on an airplane in the 1970s. At a campaign rally, Trump responded by saying: “Believe me, she would not be my first choice. That I can tell you,” and a campaign spokesperson said her allegation was “fiction”.Marissa Hoechstetter, who successfully pushed for New York’s watershed Adult Survivors Act, among other extensive advocacy, following her abuse at the hands of a now convicted obstetrician, said Trump’s win underscored that many people don’t see sexual violence as a problem.“It reaffirms that sexual violence is tolerated and it’s not disqualifying,” Hoechstetter said. “I don’t think it’s whether or not we proved that he did these things – I feel like it was [proved] – we’ve proved that people still don’t care.”“I’m not shocked by it; it’s a good reminder for us all that sexual violence is not an issue that people are willing to make big decisions on. His win doesn’t take away survivors’ advocacy efforts, but “it negates all of the work that went into trying to hold him accountable in a court of law,” potentially deterring accusers from coming forward if they see that nothing will happen – especially given the immense personal toll that comes with speaking out.Erica Vladimer, co-founder of the Sexual Harassment Working Group, said she wasn’t surprised that Trump won despite his reported behavior towards women. (The Sexual Harassment Working Group is comprised of former New York city and state legislative staffers who have experienced harassment, abuse, and retaliation by officials, and seeks to change laws and policies to protect workers.)“I have never been under this illusion that the fact that Trump is a serial sexual harasser and a sexual abuser was top of mind for most voters – that it was a priority when it came to who they were going to vote for as president,” Vladimer said. “And yet, that does not make this gut punch any easier to stomach.”“Until our institutions, the people who hold that power, are willing to say this is not OK, I think we’re going to see men like Trump continue to amass power and enable this permission structure that has really been there for a long time,” Vladimer said.Trump’s second win prompted questions about why a president’s character does not appear to matter to voters – as well as about the character of those he surrounds himself with. The Florida Republican congressman Matt Gaetz, who has been investigated for alleged sexual misconduct and trafficking, is Trump’s attorney general pick. Gaetz denies any wrongdoing.Weeks before the 2016 election, a hot mic recording from the Access Hollywood television show emerged. In this recording, Trump boasted that he could sexually assault women due to his fame, saying: “Just kiss. I don’t even wait. And when you’re a star, they let you do it. You can do anything … Grab ’em by the pussy. You can do anything.”Following Trump’s win, the phrase “your body, my choice” – which had circulated in far-right circles for several years – gained momentum on social media. The Institute for Strategic Dialogue (ISD), a thinktank that studies extremism, identified “a 4,600% increase in mentions of the terms ‘your body, my choice’ and ‘get back in the kitchen’ on X”.Gloria Allred, who in her decades as an attorney has advocated for survivors, including five Trump accusers, said: “a theme of the former president’s recent campaign appeared to be male chauvinism” and referred to the American Psychological Association guidance that recognizes “traditional masculinity is psychologically harmful” to men and boys.But, “I believe that women and girls will also suffer from this version of toxic masculinity, and they are endangered by it. Evidence of this is now seen online where some young men seem comfortable saying ‘your body, my choice’, which could be the mantra of rapists, sexual harassers and child molesters,” Allred said in a statement.“I wonder how these young men would feel if other men decided that they had a right to rape, beat or abuse the bodies of the young men’s mothers, sisters, aunts or grandmothers,” Allred’s statement continued. “My guess is that when these young men get older and have daughters they will regret their words.”Mariann Wang, an attorney whose practice focuses on survivors who has also represented Trump accusers, said his win was “devastating”.“It is an expression, yet again, that millions of people do not prioritize the safety of their mothers, their sisters, their daughters or their friends,” she said in a statement.“That said, I’ve also seen the enormous courage and power of so many women willing to keep fighting for their rights and for equality all these years,” Wang said. “And as devastating as this is, I know all those women and men who support them will keep fighting.” More

      How can the candidate with most votes lose? The US electoral college explained

      Even though the United States touts its status as one of the world’s leading democracies, its citizens do not get to directly choose the president. That task is reserved for the electoral college – the convoluted way in which Americans have selected their president since the 18th century.Contrary to its name, the electoral college is more a process than a body. Every four years, in the December following an election, its members – politicians and largely unknown party loyalists – meet in all 50 states on the same day and cast their votes for president. Then they essentially disappear.In recent years there has been growing criticism of the electoral college, accelerated by the fact that two Republican presidents – George W Bush in 2000 and Donald Trump in 2016 – have been elected president while losing the popular vote. But there’s no sign that US elections will change any time soon.Here’s everything you need to knowWhat exactly is the electoral college?Article II of the US constitution lays out the process by which a president is elected.Each state has a number of electors that’s equal to the total number of representatives and senators it has in Congress. Washington DC gets three electoral votes. In total, there are 538 electors. A candidate needs the votes of 270 of them, a simple majority, to win.The constitution says that state legislatures can choose how they want to award their electors. All but two states have long chosen to use a winner-take-all system – the winner of the popular vote in their state gets all of the electoral votes.To complicate matters further, two states, Maine and Nebraska, award their electors differently. In both states, two electoral college votes are allocated to the statewide winner. Each state then awards its remaining electors – two in Maine and three in Nebraska – to the winner in each of the state’s congressional districts.Why does the US have an electoral college?When the founding fathers gathered in Philadelphia to draft the US constitution in 1787, they had a lot of trouble figuring out a system for choosing a chief executive. Initially, they proposed a plan that would have Congress choose the president. But that led to concerns that the executive branch, designed to be independent from Congress, would be subject to it.A contingent of the delegates also favored electing the president through a direct popular vote. But the idea never got broad support and was shut down repeatedly during the convention, the historian Alexander Keyssar wrote in his book Why do we still have the electoral college.There were a number of reasons the idea was not widely popular. First, the convention had adopted the racist three-fifths compromise in which slaves were counted as three-fifths of a person for population purposes. This was a win for the southern states, in which slaves made up a sizable chunk of the population. A popular vote system would have disadvantaged the southern states because they had fewer people who could vote.There were also concerns about giving too much power to larger states and that voters would be unable to learn about the candidates from different states, according to Keyssar. It was a debate driven more about pragmatics than about political rights, he writes.Towards the end of the convention, a committee of 11 delegates was appointed to deal with unresolved matters and one of them was how to select the president. They proposed a version of what we have now come to understand as the electoral college.“This brief nativity story makes clear that the presidential election system enshrined in the Constitution embodied a web of compromises, spawned by months of debate among men who disagreed with one another and were uncertain about the best way to proceed,” Keyssar wrote. “It was, in effect, a consensus second choice, made acceptable, in part, by the remarkably complex details of the electoral process, details that themselves constituted compromises among, or gestures toward, particular constituencies and convictions.”What is a swing state?States that either presidential candidate has a good shot at winning are often called “swing states”.In the 2024 election, there are seven swing states: Pennsylvania (19 electoral votes), Wisconsin (10 electoral votes), Michigan (15 electoral votes), Georgia (16 electoral votes), North Carolina (16 electoral votes), Arizona (11 electoral votes), and Nevada (six electoral votes). Whichever candidate wins the election must carry some combination of those states, which is why the candidates will spend the majority of their time and resources there. Joe Biden carried all of those states bar North Carolina in the 2020 election.The idea of a swing state can also change over time because of changing demographics. Until recently, for example, Ohio and Florida were considered swing states, but they are now considered pretty solidly Republican. Michigan was considered a pretty solid Democratic stronghold until Donald Trump won it in 2016.Does the electoral college allow for minority rule?There have been five elections in US history – in 1824, 1876, 1888, 2000 and 2016 – in which the candidate who became the president did not win the popular vote. This has led to wider recognition of imbalances in the system and a push from some to abolish the electoral college altogether.The loudest criticism is that it’s a system that dilutes the influence of a presidential vote depending on where one lives. A single elector in California represents more than 726,000 people. In Wyoming, an elector represents a little more than 194,000 people.Another critique is that the system allows a tiny number of Americans to determine the outcome of the presidential election. In 2020, about 44,000 votes between Wisconsin, Georgia and Arizona allowed Biden to win the electoral college. Such a slim margin is extraordinary in an election that 154.6 million people voted in.In 2016, about 80,000 combined votes gave Trump his winning margins in key swing states.Do electors have to vote for a specific candidate?State political parties choose people to serve as electors who they believe are party stalwarts and will not go rogue and cast a vote for anyone other than the party’s nominee. Still, electors have occasionally cast their votes for someone else. In 2016, for example, there were seven electors who voted for candidates other than the ones they were pledged to. That was the first time there was a faithless elector since 1972, according to the National Conference of State Legislatures.Many states have laws that require electors to vote for the candidate they are pledged to. In 1952, the US supreme court said that states could compel electors to vote for the party’s nominee. And in 2020, the court said that states could penalize electors who don’t vote for the candidate they’re pledged to.How has the electoral college remained in place for so long?Since almost immediately after the electoral college was enacted, there have been efforts to change it. “There were constitutional amendments that were being promoted within a little more than a decade after the constitution was ratified,” Keyssar said. “There have been probably 1,000 or more constitutional amendments to change it or get rid of it filed since 1800. Some of them have some close.” (There were more than 700 efforts as recently as 2019, according to the Congressional Research Service.)When the idea of a national popular vote was proposed in 1816, Keyssar said, southern states objected. Slaves continued to give them power in the electoral college, but could not vote. “They would lose that extra bonus they got on behalf of their slaves,” he said.After the civil war, African Americans were legally entitled to vote, but southern states continued to suppress them from casting ballots. A national popular vote would have diminished their influence on the overall outcome, so they continued to support the electoral college system.The country did get close to abolishing the electoral college once, in the late 1960s. In 1968, George Wallace, the southern segregationist governor, almost threw the system into chaos by nearly getting enough votes to deny any candidate a majority in the electoral college. The US House passed the proposed amendment 339 to 70. But the measure stalled in the Senate, where senators representing southern states filibustered.That led to continued objections to a national popular vote so that southern white people could continue to wield power, according to the Washington Post. President Jimmy Carter eventually endorsed the proposal, but it failed to get enough votes in the Senate in 1979 (Joe Biden was one of the senators who voted against it).“It’s not like we are suddenly discovering this system really doesn’t work,” Keyssar said.Is there any chance of getting rid of the electoral college now?The most prominent effort to get rid of the electoral college today is the National Popular Vote Interstate Compact. The idea is to get states to agree to award their electors to the winner of the national popular vote, regardless of the outcome in their specific state. The compact would take effect when states having a total of 270 electoral votes – enough to determine the winner of the election – join.So far 16 states and Washington DC – a total of 205 electoral votes – have joined the effort.But the path ahead for the project is uncertain. Nearly all of the states that haven’t joined have either a Republican governor or legislature. And legal observers have questioned whether such an arrangement is constitutional – something that would probably be quickly put to the US supreme court. More

      US still unprepared for Russian election interference, Robert Mueller says

      The US is still not prepared for inevitable Russian attacks on its elections, the former special counsel Robert Mueller, who investigated Russian interference in 2016 and links between Donald Trump and Moscow, warns in a new book.“It is … evident that Americans have not learned the lessons of Russia’s attack on our democracy in 2016,” Mueller writes in a preface to Interference: The Inside Story of Trump, Russia and the Mueller Investigation by Aaron Zebley, James Quarles and Andrew Goldstein, prosecutors who worked for Mueller from 2017 to 2019.Mueller continues: “As we detailed in our report, the evidence was clear that the Russian government engaged in multiple, systematic attacks designed to undermine our democracy and favor one candidate over the other.”That candidate was Trump, the Republican who beat the Democrat, Hillary Clinton, for the White House.“We were not prepared then,” Mueller writes, “and, despite many efforts of dedicated people across the government, we are not prepared now. This threat deserves the attention of every American. Russia attacked us before and will do so again.”Interference will be published in the US next week. The Guardian obtained a copy.Zebley, Quarles and Goldstein tell the story of the Mueller investigation, from its beginnings in May 2017 after Trump fired the FBI director, James Comey, to its conclusion in March 2019 with moves by William Barr, Trump’s second attorney general, to obscure and dismiss Mueller’s findings.Mueller did not establish collusion between Trump and Moscow but did initiate criminal proceedings against three Russian entities and 34 people, with those convicted including a Trump campaign manager, Paul Manafort, who was jailed. Mueller also laid out 10 instances of possible obstruction of justice by Trump. Though he did not indict Trump, citing justice department policy regarding sitting presidents, Mueller said he was not clearing him either.Mueller now says Zebley, Quarles and Goldstein “care deeply about the rule of law and know the importance of making decisions with integrity and humility”, adding: “These qualities matter most when some refuse to play by the rules, and others are urging you to respond in kind.”View image in fullscreenThe FBI director from 2001 to 2013, Mueller was 72 and widely admired for his rectitude when he was made special counsel. His former prosecutors describe a White House meeting preceding that appointment. In an atmosphere of high tension, Mueller made his entry “via a warren of passages beneath the Eisenhower Executive Office Building”, thereby avoiding the press. Trump, who wanted Mueller to return as FBI director, “did most of the talking” but though he praised Mueller richly, Mueller declined the offer. As the authors write, Trump “would later claim that Bob came to the meeting asking to be FBI director”, and that Trump “turned him down”.“This was false,” the prosecutors write.Soon after the White House interview, the New York Times reported memos kept by Comey about Trump’s request to shut down an investigation of Michael Flynn, the national security adviser who resigned after lying about contacts with the Russian ambassador. Soon after that, Mueller was appointed special counsel.Trump escaped punishment arising from Mueller’s work but did lose the White House in 2020, when he was beaten by Joe Biden. Zebley, Quarles and Goldstein’s book arrives as another election looms, with Trump in a tight race with the vice-president, Kamala Harris, and shortly after US authorities outlined how pro-Trump influencers were paid large sums by Russia. In 2016, October brought both Trump’s Access Hollywood scandal, in which he was recorded bragging about sexual assault, and the release by WikiLeaks of Democratic emails hacked by Russia.In Interference, Zebley, Quarles and Goldstein tell how the Mueller team came to its conclusion that Russia boosted Trump in 2016. They also detail attempts to interview Trump that were blocked by his attorneys, Rudy Giuliani among them. Describing how the former New York mayor betrayed a promise to keep an April 2018 meeting confidential, speaking openly if inaccurately to the press, the authors say Mueller “decided he would never again meet or speak with Giuliani – and he never did. For Bob it was a matter of trust.”More than six years on, Giuliani faces criminal charges arising from his work to overturn Trump’s 2020 defeat, as well as costly civil proceedings. Trump also faces civil penalties and criminal charges, having been convicted on 34 counts in New York over hush-money payments made before the 2016 election.Though Zebley, Quarles and Goldstein focus on the Russia investigation, in doing so they voice dismay regarding the US supreme court, to which Trump appointed three rightwing justices and which has this year twice cast his criminal cases into doubt.The authors describe how Mueller’s team decided not to subpoena Trump for in-person testimony, given delays one Trump attorney said would result from inevitable “war” on the matter. Looking ahead, the authors consider new supreme court opinions that will shape such face-offs in future.Fischer v United States, the authors say, narrows the scope of the obstruction of justice statute “that was the focus of volume II of our report”. More dramatically, in Trump v United States, the court held “that a president has absolute immunity from criminal prosecution when carrying out ‘core’ constitutional functions … and has ‘presumptive’ immunity for all ‘official actions’”.Though the court ruled a president was not immune for “unofficial actions”, Zebley, Quarles and Goldstein warn that it nonetheless “sharply limited the areas of presidential conduct that can be subject to criminal investigation – permitting a president to use his or her power in wholly corrupt ways without the possibility of prosecution”. Darroch’s position became untenable after Boris Johnson, then involved in the Tory leadership contest to succeed Theresa May, failed to give the ambassador his unequivocal backing.Darroch, who remains a respected figure in diplomatic circles on both sides of the Atlantic, says Trump is now “a less formidable campaigner” than in 2016, “down on energy, more liable to become confused, with a mind cluttered with grievances. Urging Harris to be “laser-focused” on voters in the key swing states of Michigan, Pennsylvania and Wisconsin won by Biden in 2020, Darroch warns that they may drift back to Trump unless Harris is able to offer “some crisply worded, specific, targeted policies to bring jobs and hope back to these blighted neighbourhoods”.The second error is that Harris appears to be hiding from the media, repeating a mistake made by Hillary Clinton. “Back in 2016, Trump was ever-present. He would accept any and every invitation. He would even, unbidden, phone the morning news shows to offer his views on the day’s issues.       Report reveals secret US inquiry into alleged 2016 Egyptian $10m gift to Trump

      A spokesperson for Donald Trump blamed “Deep State Trump-haters and bad faith actors” for a bombshell report on Friday about a secret criminal investigation into whether Abdel Fatah al-Sisi, the authoritarian ruler of Egypt, sought to give the former president $10m during his victorious 2016 White House run.“The investigation referenced found no wrongdoing and was closed,” Steven Cheung told the Washington Post, which published the report on Friday.“None of the allegations or insinuations being reported on have any basis in fact. The Washington Post is consistently played for suckers by Deep State Trump-haters and bad faith actors peddling hoaxes and shams.”The deep state conspiracy theory holds that a permanent, shadow government of agents, operatives and bureaucrats exists to thwart Trump. One of the theory’s chief propagators, Steve Bannon, has said it is “for nut cases”. Nonetheless, it remains popular on the US right and among Trump’s aides.Bannon was Trump’s campaign chair in 2016. According to the Post, five days before Trump’s inauguration in January 2017, an organisation linked to Egyptian intelligence services withdrew $10m from a Cairo bank.“Inside the state-run National Bank of Egypt,” the Post said, “employees were soon busy placing bundles of $100 bills into two large bags.”Four men “carried away the bags, which US officials later described in sealed court filings as weighing a combined 200 pounds and containing what was then a sizable share of Egypt’s reserve of US currency”.According to the Post, US federal investigators learned of the withdrawal in 2019, by which time they had spent two years investigating CIA intelligence that indicated Sisi sought to give Trump $10m.Such a contribution would potentially have violated federal law regarding foreign donations.This year, in a New York state case concerning hush-money payments to the adult film star Stormy Daniels, Trump was convicted on 34 criminal charges of falsifying business records.According to the Post, US investigators who discovered the $10m Cairo withdrawal “also sought to learn if money from Sisi might have factored into Trump’s decision in the final days of his run for the White House to inject his campaign with $10m of his own money”.Eight years on, with Trump running for president again, the Post report landed in the aftermath of the bribery conviction of Robert Menendez, a Democratic senator from New Jersey who took gold bars and cash from Egyptian sources.Menendez faces a maximum sentence of 222 years.While in office, Trump repeatedly praised Sisi, over objections from US politicians concerned about the Egyptian’s authoritarian rule.skip past newsletter promotionafter newsletter promotionAs described by the Post, the US investigation which uncovered the Cairo withdrawal was questioned by William Barr, Trump’s second attorney general.       American psyche: a new series exploring the angst at the heart of the American election
      It was the day of the full solar eclipse on the outskirts of Fort Worth last April, and Crystal Mason was trying, just for a second, to relax.She was barefoot, her feet curled up on a big leather La-Z-Boy sofa, eating two of the turkey sandwiches she had prepared for lunch for her family. Her granddaughter Courtney was turning five that weekend, and Mason was getting everything in place for a princess-themed party.Mason, 49, had every reason to celebrate. Just a few weeks earlier, a Texas appeals court had thrown out her five-year prison sentence for voter fraud. Mason had been fighting the charge ever since 2017, when she was arrested for trying to cast a provisional ballot while ineligible to vote. She has always said she did not know she could not vote and would not have tried to cast a ballot had she known.Mason had been convicted and sentenced to five years in prison in 2018.Her case touched a national nerve and became widely understood as an egregious punishment for what could easily be explained as a mistake. As Donald Trump claimed massive voter fraud in the 2016 election, Mason’s case was seen as part of a broader Republican effort to intimidate people from voting. And while Trump escalated claims of fraud through the 2020 election and its aftermath, Mason’s case stood out as a clear example of what an indiscriminate crackdown on voter fraud looks like.View image in fullscreenSince Mason’s arrest, efforts to prosecute voter fraud have only escalated. Tarrant county, where Mason lives, launched its own voter fraud taskforce. Several Republican-led states have created units to investigate and pursue voter fraud charges. One of those units, in Florida, has filed dozens of cases, almost all of which have been against people like Mason, who have prior felony convictions and were confused about their eligibility. In the initial wave of 20 people who were arrested, 14 were Black. One of them was arrested at gunpoint.“I’m certain these prosecutions of individuals with felony convictions instill fear, which I believe is the intended outcome,” said Dawn Harrington, the executive director of the Free Hearts organization, who works to restore voting rights to people with felony convictions. In Tennessee, where Harrington works, she’s seen prosecutions in at least five counties (the Tennessee Bureau of Investigation announced 11 arrests for voter fraud last week, but offered few details on what happened). Taken in context of a historical legacy of voter suppression, Harrington said she believed high-profile prosecutions “serve as stark warnings, showing severe consequences for attempting to vote”.Since being convicted, Mason has remained out of prison on an appeal bond for several years, trying to get her life back on track. She’s lost multiple jobs and had trouble getting new ones because of the bad publicity from her case, and nearly lost her home to foreclosure. The last few years of waiting had felt like having “one foot in, one foot out”, she said. Her kids and her mother said that some nights she would come home and cry.So when she got news of the acquittal in March, Mason, who was getting dinner at a drive-through at the time, broke down crying. It was a moment of vindication – and a sign that she could move on with her life.Then the district attorney announced he was appealing the case.‘I’m the sole breadwinner in my family. I don’t want to go back to prison’People with felony convictions make ripe targets for politicians wanting to send a message about voter fraud.Since the Jim Crow era, states have barred former felons from voting, a practice that kept many African Americans from the polls even after they were constitutionally granted the right to vote.Today, 48 states continue this practice, though the rules vary widely by state. Several – like California, Colorado and New York – allow anyone to vote when they complete their prison sentence, while others require completion of probation and parole. Some states, like Mississippi and Tennessee, permanently bar those convicted of certain crimes from ever voting, while others require repayment of all fines, fees and restitution before someone can vote again.It’s a legacy that continues to have broad implications. As of 2022, an estimated 4.4 million people – 2% of the adult eligible population – couldn’t vote because of a felony conviction, according to a 2022 analysis by the Sentencing Project, a criminal-justice non-profit. Around 5% of voting-age African Americans can’t vote because of a felony conviction – a rate more than three times higher than other Americans.The vast majority of people who can’t vote because of a felony – about 75% – are not in prison – but they are an easy target for perceived voter fraud. Since they are branded criminals, there’s little public sympathy for their cases; those charged often have little interest in speaking out publicly.A single prosecution can also have a big ripple effect. Those who are trying to put their criminal history behind them know that a single misstep can land them back in trouble, so they aren’t willing to take that risk.Since Mason was arrested, there have been a few more high-profile prosecutions of people with felony convictions. In 2021, Texas authorities arrested Hervis Rogers, a Houston man who gained national attention for waiting seven hours in line to vote. The case was eventually thrown out on appeal, but Rogers, who is Black, has since said he will never vote again.View image in fullscreenIn 2022, Pamela Moses, a Black woman in Tennessee, was sentenced to six years in prison for trying to vote while on probation for a felony. Her conviction was later overturned after the Guardian published government documents that were not disclosed to her defense.Perhaps no state has deployed this strategy more aggressively than Florida. In 2022, the state governor, Ron DeSantis, created the office of election crimes and security, a first-of-its-kind agency to crack down on election fraud, which is exceedingly rare. That summer, DeSantis held a televised press conference announcing the arrests of more than 20 people for illegally voting. The press conference announcing the arrest was a spectacle – DeSantis appeared at in a courtroom, flanked by uniformed law enforcement officers. All of the people charged had prior murder or sexual offenses, which made them permanently ineligible to vote in Florida.But after DeSantis’s press conference, it became clear that nearly everyone charged was confused about their eligibility. Florida had made it easier for people with many felony convictions to vote in 2019, and the people the state was targeting appeared to not understand that the change didn’t apply to them. All had received voter registration cards from the state, a sign they took to mean they were eligible to vote.View image in fullscreenBlair Bowie, an attorney at the Campaign Legal Center, specializes in assisting people with felony convictions get their voting rights back. One of the states where she works is Alabama, where a recent change in the law has increased the number of people with felonies who can vote. But Bowie said she had been in contact with people in Alabama who were newly re-enfranchised but had heard about the Florida prosecutions and were wary of trying to register to vote.After initially expressing interest in getting their rights back, some of the people she had spoken to told her it wasn’t worth it.“I’m the sole breadwinner in my family. I can’t do this,” they told her. “I don’t want to go back to prison.”‘You can hardly talk to Crystal without her trying to sign someone up to vote’Mason wasn’t especially political in 2016: she voted because her mother was nagging her to. Until recently, she compared voting to taking a shower after playing outside before you go to bed. “It’s just something you’re supposed to do.”When she showed up at her polling station in 2016, a church near her home, election workers couldn’t find her name on the list of registered voters, so they offered her a chance to vote with a provisional ballot, intended for exactly that kind of circumstance.If a voter shows up at the polls and there’s a question about their eligibility, they can cast a provisional vote that is only counted if officials later confirm the voter is eligible to cast a ballot. Mason filled out the affidavit that went along with the ballot, taking care to ensure that all of the information exactly matched what was on her driver’s license.The poll workers had no reason to question her eligibility – they were her neighbors and knew who she was. They knew that she wasn’t lying about her identity and presented a valid Texas driver’s license.It was only after she left that Jarrod Streibich, a high school teenager volunteering in his first election, said he remembered that Mason had recently returned home from federal prison for a tax felony.Texas, like several other states, doesn’t allow someone to vote until they have entirely finished their criminal sentence, including probation or parole. Streibich alerted the head poll worker, Karl Diederich, who lived across the street from Mason. Diederich, who was involved with the local Republican party, wasn’t sure whom to call, but he would later contact the local district attorney.Mason was one of about 4,000 people in Tarrant county who cast a provisional ballot in 2016. Several months later, she would become the only one to be indicted for it. In February 2017, she was placed in handcuffs at the federal courthouse in downtown Dallas during a routine check-in with her supervised release officer.View image in fullscreenSince she was arrested for voter fraud, Mason said she went from being someone who didn’t want to talk about politics to starting an organization focused on combating voter suppression.In 2022, she opened a rally for Beto O’Rourke, who was running for governor. Texas lawmakers passed a law designed to make it harder for someone like Mason to be prosecuted for voter fraud. Four of her children and several other family members are volunteer deputy voter registrars in Texas and are eligible to sign people up to vote.“You can hardly talk to Crystal Mason for five minutes without her trying to sign someone up to vote,” Alison Grinter, one of her attorneys, said in March.But there was never really any doubt that Crystal Mason’s case was about much more than Crystal Mason. Prosecutors said it themselves at her trial.“The voting system in America is second to none. It is sacred to Americans, and she has violated the sanctity of this process,” Matthew Smid, the prosecutor during Mason’s case, said during sentencing at her trial. “We respectfully request that this court send a message to illegal voters that if you’re going to violate the sanctity of this system, it will not be tolerated and [you] will pay the consequences.”That language set off alarm bells for Kim Cole, another of Mason’s lawyers. Voter fraud in the US is extremely rare; many cases of illegal voting often involve people who simply were confused about their eligibility to vote. During the Jim Crow era, lawmakers often invoked the need to preserve the purity of the ballot box to justify racist restrictions on voting.“It’s not even subtle,” Cole said. “I think it did intimidate people.”‘There’s no way I would have ever taken a plea’It would have been easy enough for Mason to make the case go away. Before she went to trial in 2018, prosecutors offered her the chance to plead guilty and receive 10 years of probation. Many in her position accept these kinds of offers; it’s part of why prosecutors often target people with felony convictions – those who are charged are willing to plead guilty quickly, giving prosecutors a conviction they can tout.But Mason believed she hadn’t done anything wrong. And since she was already on supervised release, she risked going back to federal prison if she pleaded guilty to the voting crime. “There’s no way I would have ever taken a plea,” she said. “If I’m pleading, that means I’m leaving my kids. And I could never – me being a mom – I could never just leave my kids.”So on 28 March 2018, Mason and her entire family showed up at the criminal courthouse in downtown Fort Worth. Mason’s lawyer had assured her that it would be an “open and closed” case and so Mason had only taken one day off from her new job (she had lost her old one when she was arrested).View image in fullscreenThe trial started off pretty well. The first witness was Kenneth Mays, a supervisor in the supervised release office. He testified that no one had told Mason she couldn’t vote.But when Diederich and Streibich took the stand, things went south. Diederich, a navy veteran who had recently returned from Afghanistan, testified that he had instructed Mason to read a lengthy disclaimer on the provisional affidavit before she filled it out. Buried in the long paragraph is language requiring anyone filling out the form to affirm that if they have been convicted of a felony, they have completed “all of my punishment, including any term of incarceration, parole, and supervision”.Diederich testified that he couldn’t say for sure whether Mason read the warning, but that it appeared that she did and he wouldn’t have let her vote if he didn’t think she had. Streibich, just a few weeks from leaving for the air force academy, testified that he saw Mason going over the form with her finger.When Mason took the stand, it hardly seemed to matter what she said. She said she had never even seen Diederich at the polls and never read the affidavit. Had anyone told her she wasn’t eligible, she said, she wouldn’t have voted. “Why would I dare jeopardize losing a good job, saving my house, and leaving my kids again and missing my son from graduating from high school this year as well as going to college on a football scholarship? I wouldn’t dare do that,” she said.But Smid, the prosecutor, focused on undermining her credibility. Who should the judge believe? Diederich, the navy veteran, and Streibich, who was committed to military service, or Mason, who had old convictions for tax fraud and perjury? He dismissed the idea she wouldn’t commit a crime because she wanted to support her family. “You were not thinking about them when you defrauded the United States government of $4.2m, were you?” Smid said. (Mason, a former tax preparer, was originally convicted in 2012 on charges related to inflating tax refunds for clients and was ordered to pay $4.2m in restitution.)Gonzalez convicted her and sentenced her to five years in prison. Mason was in disbelief.News outlets started to pick up on the case. Her conviction came after another woman in Tarrant county, a legal non-citizen, had been sentenced to seven years in prison for also mistakenly voting. Around the same time, there was a white justice of the peace in the same county who pleaded guilty to forging signatures on a ballot but was sentenced to probation and no prison time.The disparity between the sentences for the two women of color and a white elected official highlighted the blunt racial disparities that seemed to be at play. Still, Mason didn’t really want to speak out about the case. “My motto has always been ‘my business is not show business’,” she said. That, and she wanted to keep her job.View image in fullscreenThat all changed a few months later. Because Mason was still on supervised release while she had been convicted of the state crime, she was sent back to federal prison for an additional 10 months.This was an especially difficult time for Mason. When she had gotten out of prison the first time, she had vowed never to go back and had pledged to take care of her family.Calling her the breadwinner doesn’t quite capture what she means to her family. She has three children of her own, and raised four of her brother’s children. She also has nine grandchildren. Until fairly recently, they all lived with her in her big house.Her 25-year-old niece, Jasmine Jones, compared her to the cornerstone of a building. Without her, she said, everything would crumble. Her son Sanford, whom she calls Bobo, agreed. “She’s the boss of the company,” he said. “She provides all of the kids with the things they need.”When she went back to federal prison at the end of 2018, she trained Taylor, her daughter, on how to manage the family’s finances. At the time, Taylor had not even ever paid a phone bill. Her teenage son left college during his freshman year on a football scholarship, returning home to help with the finances. The family almost lost their big house on the outskirts of Fort Worth – the one she and her ex-husband purchased more than a decade ago to be a home base for their family – to foreclosure.“They don’t know the strain it took on our family,” Taylor said on the afternoon of the eclipse, keeping an eye on her three-year-old son, Karter, who was running around nearby.Back in federal prison, Mason started reflecting on her case. She knew the judge who convicted and sentenced her was elected by voters, and she began to understand the power of one vote – and why someone would want to limit hers.She decided that she would start an organization and speak out about her case, seeking to educate people who had felony convictions about their right to vote. “I wasn’t able to register people to vote, but I was able to speak and tell people and share my story,” she said. “I had my kids and family registering people to vote.”After she left prison, she started an organization called Crystal Mason The Fight. She and her children go to fairs and other events to register people to vote. Recently, Mason said, she was at an Autozone. She began speaking with the man who was helping her and asked him if he was registered to vote. He said he wasn’t because he had a felony conviction seven or eight years ago. Mason said he was surprised to learn there was a possibility that he could vote again if he was done with his sentence.“We need to be educated from state to state,” Mason said. “That’s what I want to do – I want to outreach and reach out to people that are eligible to vote and let them know they have that right to vote.”‘My heart is heavy’The district attorney’s decision to appeal Mason’s case in April was an odd one.In 2020, the second court of criminal appeals had given prosecutors a major victory when it upheld Mason’s conviction.       Donald Trump has been found guilty of all 34 counts of falsifying business records in a criminal hush-money scheme to influence the outcome of the 2016 election.The verdict came after a jury deliberated for less than 12 hours in the unprecedented first criminal trial against a US president, current or former. It marks a perilous political moment for Trump, the presumptive nominee for the Republican nomination, whose poll numbers have remained unchanged throughout the trial but could tank at any moment.Trump was convicted by a jury of 12 New Yorkers of felony falsification of business records, which makes it a crime for a person to make or cause false entries in records with the intent to commit a second crime. He will be sentenced on 11 July at 10am ET.“This was a rigged trial by a conflicted judge who was corrupt,” Trump said at the courthouse after the verdict was read. “This was a rigged trial, a disgrace.”Joe Biden’s campaign hit back in an email sent soon after the verdict.“In New York today, we saw that no one is above the law. Convicted felon or not, Trump will be the Republican nominee for president.””In Trump’s case, the Manhattan district attorney’s office alleged Trump falsely recorded the reimbursements he made to his former lawyer Michael Cohen, who paid the adult film star Stormy Daniels $130,000 for her silence about her affair with Trump, as “legal expenses”.The prosecution alleged the falsifications were made to conceal Trump’s violation of New York state election law, which makes it a crime to promote the election of any person to office through unlawful means.Prosecutors argued in part that those unlawful means were the $130,000 payment to Daniels, which was in effect an illegal campaign contribution, because it was done solely for the benefit of his 2016 campaign and exceeded the $2,700 individual contribution cap.The Manhattan district attorney’s office called 20 witnesses who, over the course of four weeks, gave evidence of how Trump plotted with the tabloid mogul David Pecker and Cohen to bury accounts of affairs with Daniels and the Playboy model Karen McDougal.The witnesses – some friendly to Trump, others openly hostile – said Trump’s worry over the Daniels story intensified after the October 2016 release of the infamous Access Hollywood tape, in which Trump was caught on a hot mic bragging about sexual assault.The recording featured Trump boasting about being able to grab women “by the pussy” without their consent because he was famous. Trial witnesses testified the Trump campaign worried that his efforts to dismiss the tape as “locker room talk” would fail if more boorish behavior came to light.When the Daniels story threatened to become widely known weeks before the 2016 election, Cohen moved into action and paid Daniels $130,000 to buy the exclusive rights to her story – in order to suppress its publication.After the 2016 election, prosecutors argued, Cohen worked out an illicit repayment plan in which he would be paid $420,000, an inflated sum that “grossed up” for tax reasons the $130,000 and other items Cohen billed.The trial saw prosecutors elicit testimony from Cohen, Daniels and a parade of Trump’s confidants and employees, as they sought to establish that Trump concealed the alleged payoff scheme in an effort to ensure he would not lose support from female voters.Cohen proved to be perhaps the most legally consequential witness for the prosecution, as he recounted how he used a home equity loan to raise the $130,000 he then wired to Daniels’ lawyer through a shell company. Cohen did so in the belief that Trump would reimburse him, he testified.In January 2017, Cohen said, he discussed with Trump and the former Trump Organization chief financial officer Allen Weisselberg about being repaid for the $130,000, an overdue bonus and other expenses he incurred doing work that benefited the Trump 2016 campaign.Cohen produced 11 invoices seeking payment pursuant to a legal “retainer” that did not exist, according to Cohen, which led to 11 checks being cut to Cohen and the Trump Organization recording 12 entries for “legal expense” on its general ledger – totaling 34 instances of alleged falsifications.Cohen, who was the final witness for the prosecution, said that Trump was furious when he learned that Daniels was on the verge of going public – not least because Cohen had previously worked with Daniels’ lawyer Keith Davidson, in 2011, to remove the affair story from a gossip website.“Just take care of it,” Cohen recalled Trump saying. “This was a disaster, a fucking disaster. Women will hate me.”“Would you have made that payment to Stormy Daniels without getting a sign-off from Mr Trump?” prosecutor Susan Hoffinger asked Cohen.“No, because everything required Mr Trump’s sign-off. And on top of that, I wanted the money back,” Cohen said.Cohen said that he filed bogus invoices for legal services to cover up the reimbursements, and repeatedly said that Trump was the force behind the Daniels plot. He carried out the payoff “to ensure that the story would not come out, would not affect Mr Trump’s chances of becoming president of the United States”.In a watershed moment, Cohen told jurors these repayments started not long after an 8 February 2017 meeting with Trump in the Oval Office, where they talked about money. Weisselberg had previously pleaded guilty to tax crimes, for which he was also jailed.Cohen submitted $35,000 invoices for each month, listing the bill as for legal services. He said it was actually for “the reimbursement, to me, of the hush-money fee along with [another expense] and the bonus”.Hoffinger went through every invoice and pay document and asked Cohen whether it was for legal services – or false. Cohen repeatedly said that the descriptions of invoices and payments in emails and business documents were, in fact, false.“What I was doing was at the direction of and benefit of Mr Trump,” Cohen said at one point, among the many times he directly implicated Trump. “Everything required Mr Trump’s sign-off.”Daniels provided stunning testimony that undermined Trump’s denials that they had sex following a celebrity golf event in Lake Tahoe nearly two decades ago. After rejecting Trump’s invitation to dinner, Daniels decided to go at the advice of a colleague, who said: “It’ll make a great story.”Daniels said that she went to Trump’s hotel room, and they decided to chat before grabbing something to eat. He asked over and over about her work as an adult film actor, repeatedly asking her questions such as: “What about testing? Do you worry about STDs?” Had she been tested?“Yes, of course, and I volunteered it as well,” Daniels said. “He asked me, oh, well, have you ever had a bad test? I said: ‘Nope, I can show you my entire record.’”Trump started to show photos to Daniels at one point, including one of Melania, about which she commented that his wife was “very beautiful” – but allegedly added she should not worry about Melania because “we don’t even sleep in the same room”.They spoke about Trump’s show, The Apprentice, and Daniels remarked there would be no way she would make it on TV given her line of work.“You remind me of my daughter, she is smart and blonde and beautiful and people underestimate her as well,” Daniels remembered Trump saying.Daniels excused herself for the restroom, which was through a bedroom. When she came out, Trump was on the bed, in his underwear and a T-shirt.“At first I was just startled, like a jump scare,” Daniels said. “I just thought: oh my God, what did I misread to get here? The intention is pretty clear if someone’s stripped down to their underwear and on the bed.”Daniels tried to leave but he stood between her and the door, albeit “not in a threatening manner”, she said.“He said, I thought we were getting somewhere. I thought you were serious about what you wanted, if you want to get out of that trailer park … ” Daniels testified. “I was offended, because I never lived in a trailer park.” Daniels said they had sex.The description of the hotel room encounter was uncomfortable and cringe-inducing testimony, one of the prosecutors suggested in closing arguments.       A New York court has heard evidence of how Donald Trump’s long and tumultuous journey to secure the Republican nomination – and later the presidency – was aided by a US tabloid known for printing gory pictures of murder scenes and questionable journalistic ethics.Testimony from David Pecker revealed how the former publisher of the National Enquirer had pledged to be Trump’s “eyes and ears” during his 2016 presidential campaign.Prosecutors say an alleged “catch-and-kill” scheme saw the National Enquirer catching a potentially damaging story by buying the rights to it and then killing it through agreements that prevent the paid person from telling the story to anyone else. Jeb Bush led across most polls in June 2015 and was attracting millions of dollars in donations.That month, the Enquirer printed unfounded claims about Bush, claiming he had a cocaine habit in the 1980s.In late August Trump penned an article for the National Enquirer outlining why he was “the ONLY choice for President” and by autumn, Bush was lagging far behind in the polls.By then, Trump’s closest challenger was another political outsider, Ben Carson, a soft-spoken retired paediatric neurosurgeon who also had no background in politics. In October, Carson was polling near neck and neck with Trump, and pulling in large amounts in fundraising.That month, the Enquirer published a front-page story: “Ben Carson butchered my brain!” The article claimed that Carson had left a sponge in a person’s brain during a procedure. Trump picked up on the story, mentioning the claim in campaign speeches.Cruz labelled the unfounded claims “kooky” and tore into Trump, calling him an “amoral pathological liar”, and a “braggadocious, arrogant buffoon”. Within hours though, Cruz was out of the race and Trump’s path to the Republican nomination was clear.View image in fullscreenAs the Republican party broadly swung behind Trump’s candidacy, the Enquirer turned its attention to his Democratic opponent, Hillary Clinton.Headlines ranged from the simple (“Corrupt!”), to the ridiculous (Hillary’s hitman tells all!”). The magazine attacked Clinton’s health, said she was “going to jail” and continually labelled her corrupt. It alleged, without any reliable evidence, that she used racist language and that she “blackmailed and intimated” prosecutors, claims that are entirely unsubstantiated.By election day, Clinton had appeared on the Enquirer’s front page at least 15 times in a five-month period.In its first edition published after Trump’s shock victory, the Enquirer plastered the incoming president on its front page and outlined a supposed checklist of his most important policy priorities.Above the headline “My first 100 days!”, the magazine apparently couldn’t resist a final insult to anyone who doubted the incoming president: “We told you so!” More
