The first major election since the Supreme Court overturned Roe v. Wade saw abortion rights on the ballot in a record number of states. The outcomes of these initiatives suggest that when Kansas voters in August 2022 rejected a proposed constitutional amendment declaring there is no state right to abortion, it was not a fluke.

Indeed, results following the close of polls on Nov. 8 revealed that voters in Kentucky had followed suit and rejected a similar constitutional amendment. And in three other states — California, Michigan and Vermont — voters approved constitutional amendments to safeguard abortion access as part of a broader protection of personal reproductive autonomy, including contraception. In Vermont, the margin of victory was sweeping: 77.2% to 22.8%, with 95% of votes in.

In Montana, where restrictive abortion laws already prohibit post-viability abortions – that is, those after 24 weeks of pregnancy – voters rejected a referendum that threatened doctors with criminal penalties of up to 20 years in prison if they did not try to sustain the life of a fetus “born alive” after an abortion.

All told, the outcome of the initiatives underscores the crucial role of state law after the Supreme Court’s Dobbs ruling returned the issue of abortion access back to “the people” and the states.

Abortion on the ballot and the campaign trail

But abortion was also “on the ballot” indirectly – in key state and federal elections in which abortion appeared to have been a campaign issue.

In Pennsylvania, Democrat Josh Shapiro, the state’s Attorney General, won the race for governor over Republican Doug Mastriano, and Democrat John Fetterman defeated Dr. Mehmet Oz for the available U.S. Senate seat. Access to abortion care and protecting abortion rights were key themes in Shapiro’s campaign, while Mastriano stressed culture war issues. Commentary and exit polling suggest that abortion was a motivating issue among Pennsylvania voters – especially younger voters.

In New York, where Governor Kathy Hochul defeated Republican challenger Lee Zeldin, the Democrat incumbent billed herself as “the reason why abortion is protected in New York” and stressed a governor’s “immense” power to affect abortion rights.

Exit polls indicate 60% of voters nationwide – up 9% since 2020 – believe that abortion should be legal in all or most cases.

A majority – 60% – of voters expressed anger at the Supreme Court over the Dobbs ruling and indicated that they trusted the Democratic Party more than the Republican Party on the issue by a margin of 52% to 42%. These sentiments played out in the election results. For example, in New Hampshire, Democrat Maggie Hassan held onto her Senate seat against a Republican challenger, Don Bolduc, who called the Dobbs ruling a reason to “rejoice.” And 35% of New Hampshire voters said abortion was their top issue, behind only inflation at 36%. Polls also show a gender gap, with more women than men reporting abortion as their top issue.

More state battles over abortion?

Ballot initiatives are likely to continue into the 2024 presidential election given voters’ response on Tuesday.

The midterm elections point toward protecting access to abortion, more so than preelection polls suggested they would.

As of this writing, the House and Senate hang in the balance, yet federal bills that would protect or restrict access to abortion were already unlikely to become laws given that the Supreme Court has indicated states should decide their own laws. This means state laws remain on the front line, and the midterm election was just a “hold the line” moment.

Most states have not yet had legislative sessions or elections, and most candidacies were declared before Dobbs was decided. The midterm elections didn’t make the landscape worse for access to care – indeed, the right to abortion care was expanded, or least protected in some places. But the high variability of state laws will mean that conflicts continue both among states, and between states and the federal government.

(There are no term limits, and incumbents are often returned, so there is substantial continuity in the membership). House seats are broadly proportional to population, so California has lots of seats but Montana only a few.The upper chamber, the Senate, has 100 seats; two for each state, however populous. In every even-numbered year, roughly one-third of senators are elected for a six-year term. Legislation has to pass both chambers to become law. Senators have some additional responsibilities compared with their colleagues in the House; chiefly these have to do with confirming (or not) presidential appointments.Governors are not part of Congress. Their impact is mostly local to their own state, but because they can affect electoral law or practice, they can affect future federal elections.Going into the election the Democratic party of the president, Joe Biden, controlled both chambers of Congress, but by very narrow margins. And the loser is … Donald J Trump. The identity of the winners of America’s midterm elections was not clear the morning after the night before – even at lunchtime on Wednesday the TV anchors could not tell their audiences whether Democrats or Republicans would be in control of the House of Representatives or Senate – but there was no such ambiguity over the fate of the man who continues to loom over US politics, even two years after his removal from the White House. Trump took a beating.True to form, the former president had wanted this election to be all about him. His rallies, nominally staged to boost support for Republican candidates in whichever state he had landed in, were instead intensely focused on himself. At an outdoor event in Latrobe, Pennsylvania on Saturday night, for example, he spoke only fleetingly of the men running for governor or senator, devoting most of his two-hour speech either to relitigating the past – insisting, against all evidence, that the 2020 election was stolen from him – or hinting at a glorious future, talking up his prospects for retaking the presidency in 2024.When he projected charts on to the giant screens, the graphics did not make a case for why Democrats deserved to lose their majorities in Congress, still less offer policy remedies for how the Republicans would combat inflation or crime. No, they showed a series of opinion polls, each one confirming how Trump remained the Republican faithful’s favourite, miles in front of any would-be rival.As things turned out, the ex-president’s trademark narcissism was not so wide of the mark. In a way, the 2022 midterms were indeed all about him – just not in the way he had hoped.Trump, like so many others, had assumed Tuesday would see a red wave rolling across America, sweeping Democrats out of both houses of Congress, toppling blue citadels in the most unexpected places: in the final weekend, there was sufficient panic in the highest reaches of the Democratic party that both Joe Biden and Hillary Clinton were dispatched to New York, one of the bluest states in the union, to shore up a governor who was suddenly thought to be in a tight race. (In fact, she won easily.)Trump was poised to claim credit for a famous victory and to enjoy the fruits of it. He looked forward to a decisive Republican takeover of the House, one that would see the Democrat-led investigation into the attempted insurrection of 6 January 2021 abandoned, its place taken instead by multiple probes into the affairs of the Biden family. As one seasoned Democrat put it to me this week, “He’ll expect the House to operate as his law firm.” But even if his party does eke out an eventual congressional win, there was no Republican tsunami. “Definitely not a Republican wave, that’s for darn sure,” admitted senator and tireless Trump sycophant Lindsey Graham.That’s a surprise, and not only because it upended the Washington conventional wisdom. Heavy midterm defeat for the party of a first-term, incumbent president is seen as the norm, a pendulum effect all but governed by the laws of nature. Barack Obama lost 63 House seats in 2010, just as Bill Clinton lost 52 in 1994. Trump himself lost 40 in 2018. Yet Democratic losses this time will be much fewer, even at a time of great economic hardship and low poll ratings for the Democratic president. How was Biden able to buck that historical trend? The answer lies, in part, with Trump.The former president inserted himself into multiple contests, endorsing candidates at the primaries stage when parties choose their standard-bearers. The Trump seal of approval proved decisive in several, but just look at how those Trump favourites fared. True, the memoirist and venture capitalist JD Vance won in now solidly red Ohio, but in swing states Trumpers performed badly. An election denier who had been present at the 6 January Capitol Hill riot was trounced in the race to be Pennsylvania governor, while TV doctor Mehmet Oz, another Trump pick, was defeated in the Senate race by Democrat John Fetterman – even though the latter faced persistent questions about his ability to serve following a severe stroke in the summer.Perhaps most revealing of the Trump effect was Georgia. Two Republican officials who became nationally known when they resisted Trump pressure to overturn the 2020 presidential count in their state were comfortably re-elected. But Herschel Walker, handpicked by Trump to run for the senate in Georgia, was in a photo finish for that all-important seat, one set to be decided by a run-off next month. Meanwhile, a Trumper in New Hampshire was soundly beaten, while another, Kari Lake, seemed to be trailing in what should have been a winnable contest in Arizona.As Wednesday morning came, a pattern seemed to be emerging. Even Fox News reporters were quoting Republican sources telling them: “If it wasn’t clear before, it should be now. We have a Trump problem.” Trump’s endorsement hurt Republicans in midterms – aside from JD VanceRead moreIt wasn’t just Trump’s talent for picking duff candidates in states Republicans had to win (and will need to win again in 2024). It was the transformation he has wrought in the Republican party itself. A majority of GOP candidates had cast doubt on or outright denied the legitimacy of the 2020 election. That enabled Democrats, starting with Biden himself, to argue that, whatever grievances voters had with the party’s handling of the economy, they had to vote Democrat to save democracy.Bad poll numbers had some wondering if that was a mistaken message, given voters’ preoccupation with rising prices, but it seems to have paid dividends. Along with reproductive rights, imperilled by the supreme court’s summer ruling ending constitutional protection for abortion, the threat to democracy galvanised blue turnout, seemingly turning a red wave into a red ripple. Blame, or credit, for that comes entirely down to Trump, who made election denial a Republican article of faith.All this affects Trump’s prospects for 2024, not least because his most obvious rival for the Republican nomination, Florida governor Ron DeSantis, had such a good night. DeSantis was re-elected in his own state by a landslide, racking up big numbers in historically Democratic counties. At that Saturday rally in Pennsylvania, Trump had mocked the governor, calling him “Ron DeSanctimonious” (not one of his better hostile nicknames). The contrast between the two is no longer flattering to Trump, a point made robustly by one senior Republican: “The one guy [Trump] attacked before election day was DeSantis – the clear winner. Meanwhile, all his guys are shitting the bed.” In Ohio, strikingly, JD Vance did not even mention the former president in his victory speech.Cold, hard logic suggests Republicans should step away from Trump, a man who has now presided over three consecutive defeats in 2018, 2020 and 2022 (four if you include the two Georgia senate runoffs in January 2021). But it won’t be simple. For one thing, Trump’s defenders can argue that they do better when his name is on the ballot than when it is not – and it is true that Republicans did gain congressional seats in 2016 and 2020. But in some ways that underlines the problem. Because in a year when Trump himself is not a candidate, like 2022, his absence weakens hardcore Trump devotees’ desire to turn out, while his looming presence on the scene repels the floating voters who decide elections. Put another way, the Republicans’ problem is not simply Trump the man. It is that they have become Trump’s party.All of this is sweet balm for Democrats, who can now crack open the popcorn and enjoy the spectacle of Republicans fighting each other. But that too has implications for 2024. One clear winner from these midterms is Joe Biden, who presided over a better than expected performance for his party. That will reduce the pressure on him to make way for a fresher candidate for next time. Some Democrats anticipated that the thundercloud of defeat they expected on Tuesday would have one silver lining: Biden, who is showing his 80 years, would feel compelled to announce that he would not seek re-election. Those voices have now been stilled, at least for now.In part, Biden can thank his 2020 antagonist for that. The flaws of the 45th president helped put the 46th in the White House – and now the predecessor may have done his successor another favour. Several races on the ballot this fall will have profound consequences for American democracy. In some states, Republican candidates who doubt the 2020 election results, or in some cases actively worked to overturn them, are running for positions in which they would have tremendous influence over how votes are cast and counted. If these candidates win, there is deep concern they could use their offices to spread baseless information about election fraud and try to prevent the rightful winners of elections from being seated.In total, 291 Republicans – a majority of the party’s nominees this cycle – have questioned the outcome of the 2020 presidential election, according to a Washington Post tally.What are the US midterm elections and who’s running?Read moreUp and down the ballot, election deniers are running for offices that could play a critical role in future elections.They’re running to be governors, who play a role in enacting election rules. He was the “point person” for the Trump campaign in Pennsylvania as lawyers put together fake slates of electors for Trump, according to emails obtained by the New York Times. He also organized an event with Rudy Giuliani after the 2020 election in which speakers spread misinformation about the election. He hired buses and offered rides to the US Capitol on January 6 and was there himself. He has supported the idea of decertifying the presidential race in Pennsylvania, a key battleground state, which is not possible.If elected, Mastriano would wield considerable power over elections in Pennsylvania. The state is one of a handful where the secretary of state, the chief election official, is appointed by the governor. Mastriano has said he has already picked someone, but hasn’t said who. The Philadelphia Inquirer has speculated he could pick Toni Shuppe, an activist who has spread voting misinformation and false theories linked to the QAnon movement. Mastriano has also said he would decertify election equipment and cause all voters in the state to reregister to vote.Mark FinchemFinchem, a member of Arizona’s state house of representatives, is the Republican nominee for Arizona secretary of state, which would make him Arizona’s chief election official. Finchem, a member of the Oath Keepers, was at the US Capitol on January 6. He introduced a resolution this year to decertify the election. In 2020, he was one of several lawmakers who signed a joint resolution asking Congress to reject electors for Joe Biden.He has said, falsely, that Joe Biden did not win the election in Arizona in 2020. “It strains credibility,” he told Time magazine in September of Biden’s victory. “Isn’t it interesting that I can’t find anyone who will admit that they voted for Joe Biden?” When a reporter asked him whether it was possible that people he didn’t know voted for Biden, Finchem said: “In a fantasy world, anything’s possible.”Kari LakeA former news anchor with no prior political experience, Lake made doubting the 2020 election a centerpiece of her successful bid to win Arizona’s GOP nomination for governor.If she wins the governor’s race, Lake would be one of the statewide officials charged with certifying the results of the presidential election. She has called the 2020 election “corrupt and stolen” and said she would not have certified it. She joined an unsuccessful lawsuit to require ballots in Arizona to be counted by hand, which experts say is unreliable and costly. She has backed ending mail-in voting, which is widely used in Arizona.Abraham “Abe” HamadehThe Republican candidate for Arizona attorney general, Hamadeh has never held elected office and is making his first attempt to win a seat. Hamadeh, a former prosecutor, said he would not have signed off on Arizona’s election results, which showed Joe Biden won. Hamadeh, who is endorsed by Trump, has called the 2020 election “rotten, rigged and corrupt” and said if he won, he would “prosecute the election fraud of 2020 and secure the 2024 election so when Donald Trump runs and wins again in 2024, everyone will know it’s legitimate”.Blake MastersMasters, the Republican candidate for US Senate in Arizona, is endorsed by Trump and has received major financial backing from his former boss the tech billionaire Peter Thiel. Early in his race, Masters posted a video saying: “I think Trump won in 2020.” He also said he would have objected to certifying the 2020 election results during the primary, as other Republican senators did on January 6.Since winning his primary, he has sought to soften his views on the topic. He removed language from his campaign website that claimed the election was stolen. During a debate, he pointed to media coverage and big tech going against Trump instead of outright saying the election was stolen. But he has strongly stated the election was stolen to certain audiences, telling Fox News that he still believes Trump won. And Trump himself called Masters after a debate against the Democratic senator Mark Kelly, with Trump telling Masters he had “got to go stronger” on election fraud claims to win in November.His rhetoric on elections has remained heated during the general election. When Trump came to Arizona in October, Hamadeh told the crowd he would “lock up some people and put handcuffs on them”, but then, during a debate with his opponent, Democrat Kris Mayes, he would not say exactly who should be locked up or for what.Andy BiggsUpdate: Biggs won re-election against the Democrat Javier Ramos, confirmed on Wednesday.Arizona’s Biggs was one of 147 Republicans in Congress who voted against certifying the election results, but his involvement in January 6 went further than that. Ali Alexander, who helped organize the “Stop the Steal” protests, has said that Biggs helped him formulate strategy, according to Rolling Stone. Biggs is also said to have requested a pardon for his actions around January 6.Anthony KernAs an Arizona state representative in 2020, Kern was present at the Capitol on 6 January. He also briefly participated in a widely panned review of the 2020 election in Maricopa county that provided fodder for more baseless claims but ultimately affirmed Biden’s victory. He also signed on to a letter requesting that Pence delay the count of the electoral vote. Trump endorsed Kern in November 2021, saying Kern “supported decertifying” the election results.Jim MarchantMarchant is the Republican nominee for secretary of state in Nevada. He is linked to the QAnon movement; he has said he was pushed to run for the position by Trump allies and a prominent QAnon influencer. He leads a coalition of far-right candidates seeking to be secretary of state in key battleground states.He lost a 2020 congressional race by more than 16,000 votes, but nonetheless challenged the result by alleging fraud. He has since traveled around the state pressuring counties to get rid of electronic voting equipment and instead only hand-count paper ballots. Such a switch would be unreliable – humans are worse at counting large quantities of things than machines – as well as costly, and take a long time, experts say. He has falsely said voting equipment is “easy” to hack and said that Nevadans’ votes haven’t counted for decades. He has claimed there is a global “cabal” that runs elections in Nevada and elsewhere.Kristina KaramoUpdate: Karamo lost to the Democrat Jocelyn Benson, confirmed on Wednesday.Karamo, the GOP nominee for secretary of state in Michigan, became nationally known after the 2020 election when she claimed she witnessed wrongdoing as ballots were being counted in Detroit. The allegations were debunked, but Karamo, a community college professor who has never held elected office, went on to rise in conservative circles.
