    Trump’s Latino Support Was More Widespread Than Thought, Report Finds

    While Latinos played a major role in Democratic victories last year, Donald Trump’s outreach to them proved successful in states around the country, not just in certain geographic areas.Even as Latino voters played a meaningful role in tipping the Senate and the presidency to the Democrats last year, former President Donald J. Trump succeeded in peeling away significant amounts of Latino support, and not just in conservative-leaning geographic areas, according to a post-mortem analysis of the election that was released on Friday.Conducted by the Democratically aligned research firm Equis Labs, the report found that certain demographics within the Latino electorate had proved increasingly willing to embrace Mr. Trump as the 2020 campaign went on, including conservative Latinas and those with a relatively low level of political engagement.Using data from Equis Labs’ polls in a number of swing states, as well as focus groups, the study found that within those groups, there was a shift toward Mr. Trump across the country, not solely in areas like Miami or the Rio Grande Valley of Texas, where the growth in Mr. Trump’s Latino support has been widely reported.“In 2020, a segment of Latino voters demonstrated that they are more ‘swing’ than commonly assumed,” the report stated.Ultimately, Mr. Trump outperformed his 2016 showing among Latino voters, earning the support of about one in three nationwide, even as Joseph R. Biden Jr. won those voters by a roughly two-to-one margin over all, according to exit polls.All told, close to 17 million Latino voters turned out in the general election, according to a separate analysis published in January by the U.C.L.A. Latino Policy & Politics Initiative. That represented an uptick of more than 30 percent from 2016 — and the highest level of Latino participation in history.With the coronavirus pandemic and the related economic downturn taking center stage on the campaign trail, Equis Labs found that many Latino voters — particularly conservatives — had focused more heavily on economic issues than they had four years earlier. This helped Mr. Trump by putting the spotlight on an issue that was seen as one of his strong suits and by drawing some attention away from his anti-immigrant language.In focus groups, Equis Labs’ interviewers noticed that Mr. Trump’s history as a businessman was seen as a positive attribute by many Latino voters, who viewed him as well positioned to guide the economy through the pandemic-driven recession. Partly as a result, the analysis found, many conservative Latino voters who had been hanging back at the start of the campaign came around to supporting him.Driving up turnout among low-propensity voters — something that Senator Bernie Sanders had sought to do during his campaign for the Democratic nomination — did not necessarily translate into gains for Democrats in the general election, the study found. People who were likely to vote generally grew more negative on Mr. Trump’s job performance over the course of 2020, but among those who reported being less likely to participate in the election, his job approval rose.This finding is likely to fuel hand-wringing among Democratic strategists who worried that Mr. Biden had not done enough to court skeptical Latino voters ahead of November.The movement toward Mr. Trump appeared mostly “to be among those with the lowest partisan formation,” the analysts wrote. “We know enough to say these look like true swing voters. Neither party should assume that a Hispanic voter who cast a ballot for Trump in 2020 is locked in as a Republican going forward. Nor can we assume this shift was exclusive to Trump and will revert back on its own.”Chuck Coughlin, a Republican pollster in Arizona, said he was unsurprised by the results of the Equis Labs report, given what he said had been a concerted effort by the Trump campaign to win Latino support.“You saw it in the rallies out here,” he said. “They did a rally down in Yuma. They did a rally at the Honeywell plant out here. All of those featured Hispanic small-business owners. They were working that crowd.”He said the Trump campaign’s messaging on economic and social issues had resonated for many Latino voters, particularly older ones. “They’re pro-business, they’re pro-gun, they don’t like higher taxes, they don’t trust the government,” he said. “It’s the same constituency that you see among Anglo Trump voters.”While the report didn’t closely analyze voters by their nations of origin, it did demonstrate that Mr. Trump’s relative success among Latino voters compared with four years earlier was not limited to areas with large populations of Cuban-Americans, Venezuelan-Americans and other demographics that have typically trended more conservative.Carmen Peláez, a playwright and filmmaker in Miami who helped lead the campaign group Cubanos con Biden, said that after the election, many observers had sought to ascribe Mr. Trump’s improvement among Florida Latinos to a shift among Cuban-Americans in the southern part of the state.The findings from Equis Labs validated her experience last year, she said, which showed that Latinos of all nationalities had been targeted online with advertisements and messages that scared them away from Democrats.“People love blaming the Cubans, but you can’t just blame the Cubans,” she said. “There is a cancer in our community, and it’s disinformation, and it’s hitting all of us.”Ms. Peláez said Democrats had habitually taken Latino voters for granted by mistakenly assuming that they knew those voters’ political habits and attitudes. Cuban-Americans, for example, are often painted with a broad brush as conservative.“It was assumed all Latinos would be pro-immigration or they were taken for granted because they were assumed to be a lost vote,” she said. “There’s never a lost vote if you are really willing to engage.     The Fate of Biden’s Agenda Hangs in the Balance

    And it isn’t all about the filibuster.Every 10 years, after the collection of census data, states are required to redraw the boundaries of their congressional districts to ensure that they remain equal in population.The process — as readers of this newspaper know — is vulnerable to gerrymandering, in which districts are redrawn to give favored parties, office holders or constituencies an advantage in elections.At the moment, Democrats control the House by a slim 219-211 majority, with five seats vacant. The loss of just five seats in 2022 would flip control to the Republican Party, which would then be empowered to block President Biden’s agenda.Both geographically and politically, the deck is stacked against Democrats, forcing the party and its leader to adjust election strategies every 10 years.This time around, states with Republican governors and Republican legislative majorities contain more than twice as many congressional districts as states under full Democratic control.Further compounding Democratic difficulties, Jowei Chen and Jonathan Rodden, political scientists at the University of Michigan and Stanford, write in the 2013 paper “Unintentional Gerrymandering”:In many urbanized states, Democrats are highly clustered in dense central city areas, while Republicans are scattered more evenly through the suburban, exurban, and rural periphery.As a result, according to Chen and Rodden, “when districting plans are completed, Democrats tend to be inefficiently packed in homogeneous districts.”Despite winning the White House and the Senate, Democrats suffered a major setback in 2020 as their plans to wrest control of one or both branches of key state legislatures fell short. Democrats failed to take control of the statehouses in Pennsylvania, Michigan, Iowa and Texas, and of both branches in North Carolina — all states with large congressional delegations.Still, there is hope.First and foremost, Democrats have become competitive in many of the high-growth areas that benefit from redistricting; they have done so by pulling ahead of Republicans among voters with college degrees, who make up a disproportionate share of these prosperous communities.In addition, a total of 18 states have switched from partisan to independent redistricting. And finally, Republican attempts at voter suppression have proven at times to backfire, prompting higher turnout among minorities and increased Democratic Party mobilization.“One might be tempted to think that seat gains largely driven by economic prosperity favor Republicans while seat losses are found in impoverished and declining Democratic areas,” SoRelle Wyckoff Gaynor and James G. Gimpel, political scientists at the University of Maryland, write in their Feb. 21 article “Reapportioning the U.S. Congress: The shifting geography of political influence.”In practice, Gaynor and Gimpel argue, Democrats have “adapted most impressively to compete and win in the newly emergent districts in Florida and the Far West,” narrowly eking out victories for control of Congress.As states await census data to guide redistricting, there is one wild card in the mix: the possible enactment of voting rights reform, HR 1 or the For the People Act of 2021 — the measure that passed the House on March 3 on a 220-210 vote, but faces the threat of a filibuster in the Senate.I asked Nicholas Stephanopoulos, a law professor at Harvard whose specialties include election law, about the bill. He emailed me to say thatThe voting legislation currently before Congress would revolutionize the redistricting process if it passed. It would require all states to use truly independent commissions, effective immediately. Separate from this structural reform, the bill would also include quantitative partisan bias thresholds that maps wouldn’t be allowed to exceed. These thresholds would have real teeth.At the same time, Stephanopoulos continued, the legislation would put the brakes on voter suppression laws:The bill affirmatively requires a series of participation-enhancing policies for congressional elections: automatic voter registration, same-day voter registration, at least 15 days of early voting, expanded mail-in voting, restrictions on voter purges, restrictions on photo ID requirements, etc.David Lublin, a political scientist at American University, similarly described the transformative potential of HR1 in an email:The proposed legislation before Congress could have a huge effect in two ways. First, by putting in place a new trigger for the Voting Rights Act, Section 5 would become operative again and the Biden administration could use it to block discriminatory maps as well as an array of laws designed to suppress voting.Second, Lublin continued, by preventingmembers of either party from using district boundaries to entrench their advantage through redistricting. Even though Republicans would undoubtedly benefit from the geographic concentration of Democrats and racial redistricting, it would prevent egregious abuses.In the case of Republican voter suppression laws, Nicholas Valentino and Fabian G. Neuner, political scientists at Michigan and Arizona State Universities, found in their February 2016 paper “Why the Sky Didn’t Fall: Mobilizing Anger in Reaction to Voter ID Laws” thatSurprisingly, empirical evidence for significant demobilization, either in the aggregate or among Democrats specifically, has thus far failed to materialize. We suspect strong emotional reactions to the public debate about these laws may mobilize Democrats, counterbalancing the disenfranchising effect.In an email, Neuner cautioned that “our research is about short-term evocations of anger that may spur mobilization and it is not clear how long such anger can be sustained.”Black voters have proven exceptionally determined in the face of electoral adversity, including Supreme Court rulings weakening the Voting Rights Act of 1965 and voter suppression legislation.Kyle Raze, a graduate student in economics at the University of Oregon, studied turnout patterns in the wake of the 2013 Supreme Court ruling in Shelby County v. Holder. The court declared Section 5 of the 1965 Voting Rights Act, which required jurisdictions with a history of discrimination to get preclearance from the Justice Department for any change in election law, unconstitutional. Shelby opened the door to the enactment of voter suppression measures.Raze, in his February 2021 paper, “Voting Rights and the Resilience of Black Turnout,” writes thatDespite well-founded fears to the contrary, the Shelby decision does not appear to have widened the turnout gap between Black and White voters in previously covered states.Instead, Raze foundan accumulating body of evidence that suggests that voters mobilize in response to increases in the cost of voting when those increases are perceived as threats to the franchise.While 2020 census data is not yet complete, it will determine the specific allocation of House seats to each state. Justin Levitt, a law professor at Loyola Marymount University, provided The Times with estimates of the number of House seats over which each party will exercise redistricting control. Levitt wrote in an email:It looks like Democrats will control 73 congressional seats this cycle, Republicans will control 188, and 167 will be under split partisan control, plus 7 in states with one district.These numbers represent a considerable improvement for Democrats compared with a decade ago, Levitt observes, when the party “controlled 44 seats, with Republicans controlling 213.”The Gaynor-Gimpel article I discussed earlier describes the shape of old and new districts in past decennial redistricting.     Georgia Law Kicks Off Partisan Battle Over Voting Rights

    Civil rights groups quickly challenged a new law placing restrictions on voting, while President Biden denounced it as “Jim Crow.” Republicans in other states are determined to follow suit with their own measures.The fight over voting rights is emerging as one of the defining conflicts of the Biden era, and Georgia fired the opening shot with a set of new restrictions underscoring the political, legal and financial clashes that will influence whether Republicans retake Congress and the White House.President Biden on Friday called Georgia’s new law an “attack on the Constitution” and said the Justice Department was “taking a look” at Republican voting efforts in the state, without offering any specifics.“This is Jim Crow in the 21st century, it must end,” Mr. Biden said, a day after Gov. Brian Kemp signed the bill into law. “I will take my case to the American people — including Republicans who joined the broadest coalition of voters ever in this past election to put country before party.“If you have the best ideas, you have nothing to hide. Let the people vote.”Civil rights groups immediately challenged the Georgia law in federal court, backed by prominent Democratic voting rights lawyers. Several Black leaders described the legal skirmishes to come as an existential fight for representation, saying the law clearly puts a target on Black and brown voters. Protests against voting restrictions unfolded this week in state capitols like Austin, Texas, and Atlanta, and more lawsuits are expected.In more than 24 states, Republican-led legislatures are advancing bills in a broad political effort that is the most aggressive attack on the right to vote since the civil rights movement of the 1960s. It follows months of Republican efforts to tarnish Mr. Biden’s presidential victory, which scores of high-level G.O.P. officials still refuse to acknowledge as legitimate.Democrats, who have limited power in many state capitols, are looking to Mr. Biden and congressional Democrats for a new federal law to protect voting. Many in the party see the fight over voting as not just a moral cause but also a political one, given their narrow margins of victory in presidential and Senate elections in Georgia, Arizona and other battlegrounds.Georgia’s sweeping new provisions, passed by a Republican-controlled Legislature, represent the most substantive overhaul of a battleground state’s voting system since last November’s election. It would impose stricter voter identification requirements for absentee balloting, limit drop boxes and forbid giving water and snacks to voters waiting in line.But in a state where former President Donald J. Trump tried to persuade Republican election officials to reverse his loss, the measure went even further: It shifts the power and oversight of elections to the Legislature by stripping the secretary of state from chairing the state Board of Elections and authorizing the Legislature to name members to the board. It further empowers the state Board of Elections to have sweeping jurisdiction over county elections boards, including the authority to suspend officials.Mr. Biden on Friday called Georgia’s new voting restrictions “un-American,” and sought to tie them to the Democrats’ push in Washington to enact the federal voting rights bill, which the House passed this month. The measure would put in place a raft of requirements intended to protect voting rights, including weakening restrictive state identification requirements, expanding early and mail-in voting and restoring voting rights to former felons.The president said the new Georgia law was expressly what the House bill was designed to prevent. Mr. Kemp, upon signing the bill into law, said it would “make it easier to vote and harder to cheat,” even though the state’s own Republican election officials found no substantive evidence of fraud.Mr. Kemp on Friday pushed back at Mr. Biden’s criticism, saying, “There is nothing ‘Jim Crow’ about requiring a photo or state-issued ID to vote by absentee ballot.”“President Biden, the left and the national media are determined to destroy the sanctity and security of the ballot box,” Mr. Kemp said. “As secretary of state, I consistently led the fight to protect Georgia elections against power-hungry, partisan activists.”Jessica Anderson, the executive director of Heritage Action for America, the political arm of the conservative Heritage Foundation, said Georgia would serve as a model for other Republican-run states.“The country was watching closely what Georgia would do,” Ms. Anderson said in an interview. “The fact that they were able to get these reforms through sets the tone and puts Georgia in a leadership role for other states.”The Justice Department was aware of Georgia’s voting law, a spokeswoman said on Friday, but provided no further comment. A White House official said the president, in his comments, was assuming this was an issue the department would review.The department’s civil rights division would most likely have lawyers investigate whether to file an independent lawsuit, said Tom Perez, the former labor secretary who also previously ran the department’s Civil Rights Division during the Obama administration. It could also take part in the case that was filed by civil rights groups by filing a so-called statement of interest or moving to intervene as the plaintiff, he said.But this is a precarious time for the federal protections in place. In 2013, the Supreme Court gutted one of the core provisions of the Voting Rights Act, clearing the runway for much of the current legislation aimed at restricting voting. The remaining protection, in Section 2 of the act, is facing a new challenge before the Supreme Court, with arguments heard last month.The debate is also spilling over into the corporate arena. Activists across the country have been chastising companies they see as silent on the issue of voting rights. In Georgia on Friday, numerous civil rights groups and faith leaders issued a call to boycott some of the standard-bearers of the Georgia business community — including Coca-Cola — until they took action against the effort to restrict voting access.The early battle lines are increasingly centering on two key states that flipped from Republican to Democratic in 2020, Arizona and Georgia. How can anyone say voter suppression?”In Arizona, Republican lawmakers have advanced legislation that would drop voters who skip consecutive election cycles from the permanent early voting list. Wisconsin Democrats, confident in Mr. Evers’s veto, are eager to have a voting rights fight be front and center ahead of the 2022 elections, said State Senator Kelda Roys, a Democrat.“People hate the idea that their right to vote is under attack,” Ms. Roys said. “The freedom to vote is just popular.     Democrats Begin Push for Biggest Expansion of Voting Since 1960s

    Democrats characterized the far-reaching elections overhaul as the civil rights battle of modern times. Republicans called it a power grab that would put their party at a permanent disadvantage.Democrats began pushing on Wednesday for the most substantial expansion of voting rights in a half-century, laying the groundwork in the Senate for what would be a fundamental change to the ways voters get to the polls and elections are run.At a contentious hearing on Capitol Hill, Democratic leaders made a passionate case for a bill that would mandate automatic voter registration nationwide, expand early and mail-in voting, end gerrymandering that skews congressional districts for maximum partisan advantage and curb the influence of money in politics.The effort is taking shape as Republicans have introduced more than 250 bills to restrict voting in 43 states and have continued to spread false accusations of fraud and impropriety in the 2020 election. It comes just months after those claims, spread by President Donald J. Trump as he sought to cling to power, fueled a deadly riot at the Capitol on Jan. 6 that showed how deeply his party had come to believe in the myth of a stolen election.Republicans were unapologetic in their opposition to the measure, with some openly arguing that if Democrats succeeded in making it easier for Americans to vote and in enacting the other changes in the bill, it would most likely place their party permanently in the minority.“Any American who thinks that the fight for a full and fair democracy is over is sadly and sorely mistaken,” said Senator Chuck Schumer, Democrat of New York and the majority leader. “Today, in the 21st century, there is a concerted, nationwide effort to limit the rights of citizens to vote and to truly have a voice in their own government.”Mr. Schumer’s rare appearance at a committee meeting underscored the stakes, not just for the election process but for his party’s own political future. He called the proposed voting rollbacks in dozens of states — including Georgia, Iowa and Arizona — an “existential threat to our democracy” reminiscent of the Jim Crow segregationist laws of the past.He chanted “Shame! Shame! Shame!” at Republicans who were promoting them.It was the start of an uphill battle by Senate Democrats, who have characterized what they call the For the People Act as the civil rights imperative of modern times, to overcome divisions in their own ranks and steer around Republican opposition to shepherd it into law. Doing so may require them to change Senate rules to eliminate the filibuster, once used by segregationists to block civil rights measures in the 1960s.Republicans signaled they were ready to fight. Conceding that allowing more people to vote would probably hurt their candidates, they denounced the legislation, passed by the House this month, as a power grab by Democrats intent on federalizing elections to give themselves a permanent political advantage. Senator Ted Cruz of Texas said the bill aimed to register millions of unauthorized immigrants, though that would remain unlawful under the measure.The clash laid bare just how sharply the two parties have diverged on the issue of voting rights, which attracted bipartisan support for years after the civil rights movement but more recently has become a bitter partisan battleground. At times, Republicans and Democrats appeared to be wrestling with irreconcilably different views of the problems plaguing the election system.Senator Roy Blunt of Missouri, the top Republican on the Senate Rules Committee, which convened the hearing, said states were taking appropriate steps to restore public confidence after 2020 by imposing laws that require voters to show identification before voting and limiting so-called ballot harvesting, where others collect voters’ completed absentee ballots and submit them to election officials. He said that if Democrats were allowed to rush through changes on the national level, “chaos will reign in the next election and voters will have less confidence than they currently do.”The suggestion piqued Senator Amy Klobuchar, Democrat of Minnesota and the committee chairwoman, who shot back that it was the current elections system — an uneven patchwork of state laws and evolving voting rules — that had caused “chaos” at polling places.“Chaos is what we’ve seen in the last years — five-hour or six-hour lines in states like Arizona to vote. Chaos is purging names of longtime voters from a voter list so they can’t go vote in states like Georgia,” she said. “What this bill tries to do is to simply make it easier for people to vote and take the best practices that what we’ve seen across the country, and put it into law as we are allowed to do under the Constitution.”With Republicans unified against them, Democrats’ best hope for enacting the legislation increasingly appears to be to try to leverage its voting protections — to justify triggering the Senate’s so-called nuclear option: the elimination of the filibuster rule requiring 60 votes, rather than a simple majority, to advance most bills.Even that may be a prohibitively heavy lift, though, at least in the bill’s current form. Liberal activists who are spending tens of millions of dollars promoting it insist that the package must move as one bill. But Senator Joe Manchin III, a centrist West Virginia Democrat whose support they would need both to change the filibuster rules and to push through the elections bill, said on Wednesday that he would not support it in its current form.Speaking to reporters in the Capitol, Mr. Manchin said he feared that pushing through partisan changes would create more “division” that the country could not afford after the Jan. 6 attack, and instead suggested narrowing the bill.Voters waited in line to cast ballots in the 2020 election in Suwanee, Ga.Nicole Craine for The New York Times“There’s so much good in there, and so many things I think all of us should be able to be united around voting rights, but it should be limited to the voting rights,” he said. “We’re going to have a piece of legislation that might divide us even further on a partisan basis. That shouldn’t happen.”But it is unclear whether even major changes could win Republican support in the Senate. As written, the more than 800-page bill, which passed the House 220 to 210 mostly along party lines, is the most ambitious elections overhaul in generations, chock-full of provisions that experts say would drive up turnout, particularly among minorities who tend to vote Democratic. Many of them are anathema to Republicans.Its voting provisions alone would create minimum standards for states, neutering voter ID laws, restoring voting rights to former felons, and putting in place requirements like automatic voter registration and no-excuse mail-in balloting. Many of the restrictive laws proposed by Republicans in the states would move in the opposite direction.The bill would also require states to use independent commissions to draw nonpartisan congressional districts, a change that would weaken the advantages of Republicans who control the majority of state legislatures currently in charge of drawing those maps.     We See the Left. We See the Right. Can Anyone See the ‘Exhausted Majority’?

    Does Joe Biden’s victory in 2020 represent the last gasp of an exhausted moderate tradition or does a potentially powerful center lie dormant in our embattled political system?Morris Fiorina, a political scientist at Stanford, argues in a series of essays and a book, “Unstable Majorities,” that it is the structure of the two-party system that prevents the center — the moderate majority of American voters — from asserting their dominion over national politics:Given multiple dimensions of political conflict — economic, cultural, international — it is simply impossible for two internally homogeneous parties to represent the variety of viewpoints present in a large heterogeneous democracy.Inevitably, Fiorina writes,Each party bundles issue positions in a way that conflicts with the views of many citizens — most commonly citizens who are economic conservatives and culturally liberal, or economically liberal and culturally conservative, but also internationalist or isolationist-leaning positions layered on top of other divisions.Fiorina is addressing one of the most important questions in America today: Is there a viable center and can such a center be mobilized to enact widely backed legislative goals with bipartisan support?This issue is the subject of intense dispute among strategists, scholars and pollsters.In Fiorina’s view, polarization has been concentrated among “the political class: officeseekers, party officials, donors, activists, partisan media commentators. These are the people who blabber on TV /vent on Facebook/vilify on Twitter/etc.”This process effectively leaves out “the general public (a.k.a. normal people)” who are “inattentive, uncertain, ambivalent, uninvolved politically, concerned with bread-and-butter issues.”In support of his position, Fiorina has marshaled data showing that there are large numbers of voters who say that neither party reflects their views; that many of the most polarizing issues — including gay rights, gender equality, abortion and racial equality — rank 19 to 52 points below voters’ top priorities, which are the economy, health care, jobs and Medicare; and that the share of voters who describe themselves as moderate has remained constant since 1974.In addition, Fiorina cites two studies.The first, “A Not So Divided America,” conducted by the Center on Policy Attitudes and the School of Public Policy at the University of Maryland for a centrist group, Voice of the People. It found that if you compare “the views of people who live in red Congressional districts or states to those of people who live in blue Congressional districts or states,” on “only 3.6 percent of the questions — 14 out of 388 — did a majority or plurality of those living in red congressional districts/states take a position opposed to that of a majority or plurality of those living in blue districts/states.”Of those 14, according to the Voice of the People study, 11 concerned “ ‘hot-button’ topics that are famously controversial — gay and lesbian issues, abortion and Second Amendment issues relating to gun ownership.”The second study, “Hidden Tribes,” was conducted for “More In Common,” another group that supports centrist policies.According to the study,In talking to everyday Americans, we have found a large segment of the population whose voices are rarely heard above the shouts of the partisan tribes. These are people who believe that Americans have more in common than that which divides them. They believe that compromise is necessary in politics, as in other parts of life, and want to see the country come together and solve its problems.In practice, the study found that polarization is driven in large part by the left flank of the Democratic Party and the right flank of the Republican Party, which together make up roughly a third of the electorate.The remaining two thirds areconsiderably more ideologically flexible than members of other groups. While members of the ‘wing’ groups (on both the left and the right) tend to hold strong and consistent views across a range of political issues, those in the Exhausted Majority tend to deviate significantly in their views from issue to issue.Not only that,the wing groups, which often dominate the national conversation, are in fact in considerable isolation in their views on certain topics. For instance, 82 percent of Americans agree that hate speech is a problem in America today, and 80 percent also view political correctness as an issue. By contrast, only 30 percent of Progressive Activists believe political correctness is a problem.Fiorina has many allies and many critics in the academic community.Those in general agreement include Jeannie Suk Gersen, a law professor at Harvard and a contributing writer to The New Yorker, who wrote in an email:The fact that Joe Biden was the Democratic nominee and won the presidency in 2020, when there were many great candidates left of him, is evidence that a political center is not only viable but desired by the public.For a centrist candidate, Gersen argued, “the main principle is compromise rather than all or nothing.” In the case of abortion, for example, the principle of compromise recognizes thatthe majority of Americans favor keeping abortion legal, but also favor some limits on abortion. Retaining a core right of abortion that respects both autonomy of adult individuals to make reproductive decisions and the value of potential fetal life is the approach that will seem acceptable to the majority of Americans and consistent with the Constitution.John Shattuck, a professor at the Fletcher School of Law and Diplomacy at Tufts, notes that surveys and reports he has overseen affirm the strong presence of a middle ground in American politics:Polarization is pushed by the political extremes. The great majority of Americans, however, are not at the extremes and common ground exists among them on seemingly polarized issues.Instead, Shattuck wrote in an email, “Americans are fed up with polarization.” His data shows that71 percent believe Americans “have more in common with each other than many people think,” including 78 percent of Republicans, 74 percent of Democrats and 66 percent of Independents.There is, Shattuck argues, a powerful consensus on rights and freedoms that underpins American democracy:Bipartisan majorities consider the following to be “essential rights important to being an American today”: ‘“clean air and water” (93 percent); “a quality education” (92 percent); “affordable health care” (89 percent); and the “right to a job” (85 percent). These high levels of demand for economic and social rights are similar to the support for more traditional civil liberties and civil rights like rights of free speech (94 percent), privacy (94 percent) and equal opportunity (93 percent).There is another aspect to the debate.In most countries, Thomas Carothers and Andrew O’Donohue, both of the Carnegie Endowment for International Peace, write in their 2019 essay. “How Americans Were Driven to Extremes”:Polarization grows out of one primary identity division — usually either ethnic, religious, or ideological. In Kenya, for instance, polarization feeds off fierce competition between ethnic groups. In India, it reflects the divide between secular and Hindu nationalist visions of the country. But in the United States, all three kinds of division are involved.As a result:This powerful alignment of ideology, race, and religion with partisanship renders America’s divisions unusually encompassing and profound. It is hard to find another example of polarization in the world that fuses all three major types of identity divisions in a similar way.Bill McInturff, a founder of the Republican polling firm Public Opinion Strategies, cast doubt in an email on the prospects for a new centrism:I am not sanguine about a national campaign that tries to find a middle ground on major cultural issues as being viable. We are in a “no compromise” era and that’s not changing any time soon.Similarly, Richard Florida, a professor at the University of Toronto’s School of Cities, wrote in an email:Could Joe Biden end up being the last centrist Democrat in the way that George W. Bush might have turned out to be the last centrist Republican? I was never a fan of W, but looking back, you can see how the party was shifting away from the center inexorably toward the cultural and economic populism Trump catalyzed. I wonder if we look back a decade from now if Biden turns out to be the last of a kind. Is the future one where Republicans look more like Trump, and the Democrats tilt away from Biden’s center toward the more culturally progressive wing, one which might drive more centrist voters away?Surveys conducted by the Pew Research Center provide scant optimism for proponents of less divisive politics.In a postelection report, Michael Dimock, Pew’s president, and Richard Wike, its director of global research, wrote that among both Biden and Trump voters, roughly 80 percentsaid their differences with the other side were about core American values, and roughly nine-in-ten — again in both camps — worried that a victory by the other would lead to “lasting harm” to the United States.From 1994 to 2019, Pew tracked the percentage point difference between Republican and Democratic responses to 10 policy positions, including “the economic system in this country unfairly favors powerful interests,” “the growing number of newcomers from other countries threatens traditional American customs and values,” and “white people benefit from advantages in society that Black people don’t have.” More

    Pushing false theories on the virus, the vaccine and the Jan. 6 attack on the Capitol, Mr. Johnson, the Republican senator from Wisconsin, has absorbed his party’s transformation under Donald Trump.BROOKFIELD, Wis. — Senator Ron Johnson incited widespread outrage when he said recently that he would have been more afraid of the rioters who rampaged the Capitol on Jan. 6 had they been members of Black Lives Matter and antifa.But his revealing and incendiary comment, which quickly prompted accusations of racism, came as no surprise to those who have followed Mr. Johnson’s career in Washington or back home in Wisconsin. He has become the Republican Party’s foremost amplifier of conspiracy theories and disinformation now that Donald Trump himself is banned from social media and largely avoiding appearances on cable television.Mr. Johnson is an all-access purveyor of misinformation on serious issues such as the pandemic and the legitimacy of American democracy, as well as invoking the etymology of Greenland as a way to downplay the effects of climate change.In recent months, Mr. Johnson has sown doubts about President Biden’s victory, argued that the Jan. 6 attack on the Capitol was not an armed insurrection, promoted discredited Covid-19 treatments, said he saw no need to get the coronavirus vaccine himself and claimed that the United States could have ended the pandemic a year ago with the development of a generic drug if the government had wanted that to happen.Last year, he spent months as chairman of the Senate Homeland Security Committee seeking evidence that Mr. Biden had tried to pressure Ukrainian officials to aid his son Hunter, which an Intelligence Community report released on Monday said was misinformation that was spread by Russia to help Mr. Trump’s re-election.Mr. Johnson has sown doubts about President Biden’s victory, argued that the attack on the Capitol was not an armed insurrection and promoted discredited Covid-19 treatments.Anna Moneymaker for The New York TimesMr. Johnson has also become the leading Republican proponent of a revisionist effort to deny the motives and violence of the mob that breached the Capitol. At a Senate hearing to examine the events of that day, Mr. Johnson read into the record an account from a far-right website attributing the violence to “agents-provocateurs” and “fake Trump protesters.” On Saturday, he told a conference of conservative political organizers in Wisconsin that “there was no violence on the Senate side, in terms of the chamber.” In fact, Trump supporters stormed the chamber shortly after senators were evacuated.His continuing assault on the truth, often under the guise of simply “asking questions” about established facts, is helping to diminish confidence in American institutions at a perilous moment, when the health and economic well-being of the nation relies heavily on mass vaccinations, and when faith in democracy is shaken by right-wing falsehoods about voting.Republicans are 27 percentage points less likely than Democrats to say they plan to get, or have already received, a vaccine, a Pew Research Center study released this month found. In an interview, Mr. Johnson repeatedly refused to say that vaccines were safe or to encourage people to get them, resorting instead to insinuations — “there’s still so much we don’t know about all of this” — that undermine efforts to defeat the pandemic.The drumbeat of distortions, false theories and lies reminds some Wisconsin Republicans of a figure from the state’s past who also rarely let facts get in the way of his agenda: Senator Joseph McCarthy, whose witch hunt for communists in and out of government in the 1950s ruined lives and bitterly divided the country.“Wisconsin voters love mavericks, they really love mavericks — you go way back to Joe McCarthy,” said Jim Sensenbrenner, a long-serving Republican congressman from the Milwaukee suburbs who retired in January. “They do love people who rattle the cage an awful lot and bring up topics that maybe people don’t want to talk about.”For Democrats, who have never forgotten Mr. Johnson’s defeat of the liberal darling Russ Feingold in 2010, and again in a 2016 rematch, regaining the Senate seat in 2022 is a top priority. Though he has yet to announce whether he would be seeking a third term, Mr. Johnson recently said that the fury that Democrats had directed his way had made him want to stay in the fight. Still, he has raised just $590,000 in the past two years — a paltry sum for an incumbent senator.Mr. Johnson’s most recent provocation came on March 12, when he contrasted Black Lives Matter protesters to the Trump supporters “who love this country” and stormed the Capitol, the carnage resulting in 140 injured police officers and more than 300 arrests by federal authorities. During an interview with a right-wing radio host, Joe Pagliarulo, Mr. Johnson said: “Joe, this will get me in trouble. Had the tables been turned and President Trump won the election and those were tens of thousands of Black Lives Matter and antifa protesters, I might have been a little concerned.”Research on the protests against racial injustice over the summer showed that they were largely nonviolent.In the interview with The Times, Mr. Johnson rejected comparisons to McCarthy. And he insisted he had no racist intent in making his argument.Like former President Donald J. I don’t know any Trump supporter who would have done what the rioters did.”On Sunday, Senator Roy Blunt, Republican of Missouri, denounced Mr. Johnson’s distortion of the events of Jan. 6. “We don’t need to try and explain away or come up with alternative versions,” he said on the NBC program “Meet the Press.” “We all saw what happened.”Mr. Johnson, in the Times interview, also faulted the federal government for what he called its “tunnel vision” pursuit of a Covid-19 vaccine while not more deeply studying treatments such as hydroxychloroquine — the anti-malarial drug promoted by Mr. Trump that the Food and Drug Administration says is not effective against the virus. That strategy, he said, cost “tens of thousands of lives.”Conspiracy theories and a defiant disregard of facts were a fringe but growing element of the Republican Party when Mr. Johnson entered politics in 2010 — notably in the vice-presidential candidacy of Sarah Palin two years earlier. But under Mr. Trump, the fringe became the mainstream. On several occasions, he declared that climate change was not man-made but instead caused by “sun spots” and said excess carbon dioxide in the atmosphere “helps the trees grow.” He also offered a false history of Greenland to dismiss the effects of global warming.“You know, there’s a reason Greenland was called Greenland,” Mr. Johnson told WKOW-TV in Madison back then. “It was actually green at one point in time. And it’s been, you know, since, it’s a whole lot whiter now so we’ve experienced climate change throughout geologic time.”In the interview on Thursday, Mr. Johnson was still misinformed about the etymology of Greenland, which got its name from the explorer Erik the Red’s attempt to lure settlers to the ice-covered island.“I could be wrong there, but that’s always been my assumption that, at some point in time, those early explorers saw green,” Mr. Johnson said. “I have no idea.”Just as Mr. Trump would later use Fox News to build a national political persona, Mr. Johnson did so on Wisconsin’s wide network of conservative talk-radio shows. His political rise would not have been possible without support from Charlie Sykes, then an influential radio host in Milwaukee who once read an entire 20-minute speech by Mr. Johnson on the air.Mr. Sykes, who since 2016 has been a harsh critic of Trump-era Republicans, said last week of Mr. Johnson: “I don’t know how he went from being a chamber of commerce guy to somebody who sounds like he reads the Gateway Pundit every day. Dr. Fauci, he added, is “not a god.”In the interview, the senator said it was not his responsibility to to use his public prominence to encourage Americans to get vaccinated.“I don’t have all the information to say, ‘Do this,’” Mr. Johnson said.His false theories about the virus and the vaccine are reminiscent of other misinformation that Mr. Johnson has amplified. During a 2014 appearance on Newsmax TV, he warned of Islamic State militants infecting themselves with the Ebola virus and then traveling to the United States. In 2015, he introduced legislation directing the federal government to protect itself against the threat of an electromagnetic pulse, a conspiracy theory that has long lived on the far right of American politics.Last year’s monthslong investigation by Mr. Johnson’s Homeland Security committee into the Bidens and Ukraine concluded with the G.O.P. majority report finding no wrongdoing by the former vice president. An Intelligence Community assessment declassified and released on Monday concluded that Russia had spread misinformation about Hunter Biden to damage his father’s campaign and to help Mr. Trump win re-election.Mr. Johnson, who was not named in the assessment, was adamant that his work was not directly, or unwittingly, influenced by Russians.“Read the report — show me where there’s any Russian disinformation,” he said. “Anybody who thinks I spread disinformation is uninformed because I haven’t.”For weeks after the November election, Mr. Johnson refused to acknowledge Mr. Biden as the winner while echoing Mr. Trump’s false statements about rampant fraud. We ended that practice.”— Alejandro Mayorkas, secretary of homeland security, in a congressional hearing on Wednesday.This is misleading. The practice of expelling unaccompanied children ended thanks to a court ruling before Mr. Biden took office, though his administration declined to resume expulsions when an appeals court decided it could do so.Citing the threat of the coronavirus and using a public health emergency law known as Title 42, the Trump administration announced last March that it would send back to their home countries people who illegally crossed the southwestern border, rather than detaining and processing them.In mid-November, a federal judge ruled that the administration could not expel unaccompanied children. But Mr. Klain is wrong that the backlog is because the previous administration drastically downsized monthly bed capacity.When the Obama administration faced its own surge of migrant children, the refugee agency increased its monthly bed capacity to about 8,000 beds in the 2015 fiscal year from about 2,000 in the 2011 fiscal year, according to a Government Accountability Office report. Under the Trump administration, monthly bed capacity fell to about 7,000 in October 2017, but grew to over 16,000 by December 2018. By Mr. Trump’s last full month in office, in December 2020, monthly bed capacity was at 13,000 — hardly a “record low.”The issue, however, is that shelters could no longer operate at a full occupancy rate during a pandemic. Both senators were partly accurate in their descriptions of Mr. Biden’s policies.It is true that Mr. Biden has proposed a pathway for citizenship for the undocumented immigrants currently residing in the United States and revoked the previous administration’s policy that required asylum seekers to remain in Mexico as they awaited decisions on their cases.But Mr. Cotton is wrong that Mr. Biden promised “free health care” for undocumented immigrants. A spokesman for Mr. Cotton said the senator was referring to the 2020 campaign, when Mr. Biden raised his hand after Democratic presidential candidates were asked during a 2019 debate whether their health care plans would allow unauthorized immigrants to have access to such care. But there was no mention of “free” health care. Under Mr. Biden’s plan, those immigrants could buy health care plans including a proposed public option on exchanges set up by the Affordable Care Act.Mr. Cornyn’s reference to Title 42 was also inaccurate. Though the Biden administration has decided not to expel unaccompanied children, despite a court ruling allowing the practice, it has continued Title 42 expulsions of most border crossers. In fact, out of the more than 100,000 encounters at the southwestern border in February, 72,000 led to expulsions.What Was Said“When I talked to the doctor to see when they’re being tested for Covid, when they get out, more than 10 percent are testing positive, while you’re being stored together. Bob Fenton, the acting administrator of the Federal Emergency Management Agency, said during a congressional hearing a day later that migrants were testing positive at a rate of “less than 6 percent” across the entire border. That is a lower positivity rate than currently in Texas (9 percent), Arizona (11 percent) and New Mexico (8 percent), but higher than in California (3 percent).There are different coronavirus protocols in place for different migrant populations, but the notion that migrants are spreading the virus unchecked is hyperbolic.Asylum seekers with pending cases who returned to Mexico under the Trump-era program must test negative before entering the United States. Those who test positive with mild or no symptoms are required to quarantine for 10 days, while those who show severe symptoms must seek treatment in Mexico, according to the State Department.For migrants who are not immediately sent away and processed by border officials, the Department of Homeland Security relies on community organizations for testing and reimburses the costs, according to the department. Those who test positive while in Border Control custody are immediately isolated. Unaccompanied children specifically are tested at facilities operated by the Department of Health and Human Services.Mr. Mayorkas, in the congressional hearing on Wednesday, acknowledged that the system was not foolproof.“There were times earlier when individuals were apprehended and we sought to expel them and we were unable to expel them and we were compelled to release them and we did not have the opportunity to test them,” he said. “We are doing the best we can to ensure that the policy is executed 100 percent of the time.”Lawmakers omitted context in describing border crossing trends.What Was Said“You can’t help but notice that the administration changes and there’s a surge.”— Senator Bill Cassidy, Republican of Louisiana, on Sunday in an interview on Fox News.“We began seeing the increase in unaccompanied minors going back to last April 2020. And this was during the Trump administration.”— Representative Veronica Escobar, Democrat of Texas, on Sunday in an interview on CNN.Mr. Cassidy is ignoring that encounters with migrants at the border have been ticking up for months before Mr. Biden took office, while Ms. Escobar is downplaying that the increases accelerated in February.“It’s both. We have been seeing an increase in overall encounters at the border since April of 2020, and there was a bigger increase than we’ve seen in the past few months in February,” said Jessica Bolter, a policy analyst at the nonpartisan Migration Policy Institute.Border Patrol agents encountered unaccompanied children at the southwestern border 741 times in April 2020, the lowest monthly level in a decade. That number did gradually increase over the last few months of Mr. Trump’s presidency. But in February, Border Patrol agents recorded more than 9,400 encounters with unaccompanied children, a 61 percent increase since January, a 170 percent increase from February 2020 and the highest number since May 2019.The exact impact of Mr. Biden’s policies or election on border crossings is difficult to gauge, as migration flows are driven by myriad factors and there has been only one full month of data under Mr. Biden.“The push factors are at the highest they’ve been at quite some time,” said Mr. Reichlin-Melnick, ticking off political corruption, instability, poverty and violence in Honduras, Guatemala and El Salvador. The economic toll of the pandemic and two hurricanes that battered the region toward the end of last year further exacerbated difficult conditions.Conversely, better economic opportunities and the chance to reunite with family have pulled migrants to the United States, and immigration policy can act as an extra tug.Rescinding the Remain in Mexico policy, halting the construction of a border wall, and ending agreements allowing the United States to return asylum seekers to Central American countries “have motivated people to try to enter illegally now,” asserted Jessica M.     House Renews Landmark Domestic Violence Bill, but Obstacles Wait in Senate

    The House vote was bipartisan, but many Republicans object to new gun restrictions on domestic abusers that could complicate Senate passage.The House moved on Wednesday to renew the Violence Against Women Act, adding firearm restrictions for convicted domestic abusers and other new provisions to a landmark law that has helped combat domestic violence, sexual assault and stalking but expired in 2019.President Biden, who wrote the law into existence as a senator in 1994, has made strengthening it one of his top domestic priorities during his time in office, and Wednesday’s vote was the first significant step toward putting it back into effect after lapsing under President Donald J. Trump. The law’s renewal has taken on added urgency amid alarming increases in domestic violence during the coronavirus pandemic.The House’s 244-to-172 vote was bipartisan, with 29 Republicans joining united Democrats to approve the bill. But substantial conservative opposition to a measure that has enjoyed broad backing from both parties in the past foreshadowed a more difficult path ahead in the Senate, where Democrats control just 50 of the 60 votes necessary for passage.In a statement after the vote, Mr. Biden urged the Senate to “bring a strong bipartisan coalition together” to send him a bill to sign into law as soon as possible.“Growing evidence shows that Covid-19 has only exacerbated the threat of intimate partner violence, creating a pandemic within a pandemic for countless women at risk for abuse,” he said. “This should not be a Democratic or Republican issue — it’s about standing up against the abuse of power and preventing violence.”Much of the House’s proposed update to the Violence Against Women Act, commonly known as VAWA, is noncontroversial. It would build on a patchwork of programs like violence prevention and housing assistance for abuse victims, reaffirm legal protections for victims and their families, and more aggressively target resources to minority communities.In an effort to expand the law’s reach, however, Democrats have also included provisions tightening access to firearms by people convicted of a violent crime or subject to a court order, and expanding protections for gay, bisexual and transgender people. In an attempt to cut into high rates of domestic violence against Native American women, their bill would grant tribal courts new authority to prosecute non-Indians for sex trafficking, sexual violence and stalking.“This bill opens the door of the armor of the federal government and its protection of women who continue to lose their life and men,” said Representative Sheila Jackson Lee, Democrat of Texas and one of its principal authors. “Yes, it is a culturally sensitive initiative that protects immigrant women, it protects Native Americans, it protects poor women.”But what Democrats characterized as equitable expansions of the law meant to meet the needs of a changing nation have prompted intense backlash among conservative Republicans, who have eagerly jumped into ideological battles with Democrats again and again in recent weeks.In sometimes fiery debate on the House floor on Wednesday, several conservatives accused the majority of using a law meant to protect women as a Trojan horse for a “far-left political agenda” on gun control and gay and transgender rights while holding hostage a clean reauthorization of the bill.“The most egregious provisions of this bill push leftist gender ideology at the expense of important protections for women’s privacy and safety,” said Representative Debbie Lesko, Republican of Arizona, who recounted her own experience with domestic violence. “If this bill is enacted, these shelters under penalty of federal law would be required to take in men and shelter them with women, putting vulnerable women at risk.”Ms. Lesko appeared to be referring to provisions barring groups that receive funds under VAWA from discriminating based on gender identity that were enshrined in law in 2013 and merely reiterated in the new bill. Its proponents say they have caused no widespread safety or privacy issues. One new aspect of the bill would require the Bureau of Prisons to consider the safety of transgender prisoners when giving housing assignments.Republicans were just as angry over the proposed closing of the so-called boyfriend loophole. While existing federal law forbids people convicted of domestic violence against a current or former spouse to buy or own a firearm, the new legislation would extend the prohibition to those convicted of abusing, assaulting or stalking a dating partner, or to those under a court restraining order.Representative Marjorie Taylor Greene, Republican of Georgia, pushed unsuccessfully for amendments that would allow the government to fund firearm training and self-defense classes for women.“If you want to protect women, make sure women are gun owners and know how to defend themselves,” she said. “That’s the greatest defense for women.”Representative Elise Stefanik, Republican of New York, offered an alternative proposal on Wednesday that would have reauthorized the law without changes for a single year to allow time for more bipartisan negotiation. It failed 177 to 249.Democrats and some Republicans did adopt an amendment by Representatives Jackie Speier, Democrat of California, and John Katko, Republican of New York, that appends what would be the first federal law to specifically address “revenge porn.” Forty-five states and the District of Columbia have put their own such laws in place in recent years, but advocates of a federal statute say they are inconsistent.The disagreements were many of the same ones that led the law to expire two years ago. House Democrats first passed a similar version of the bill to the one adopted on Wednesday in 2019 with modest support from across the aisle, but the Republican-controlled Senate declined to take it up for a vote amid an intense lobbying campaign by the N.R.A. to oppose the gun provisions.This time Democrats control the upper chamber and have vowed to hold a vote. Still, they will need at least 10 Republicans to join them to send a bill to Mr. Biden and will have to placate the minority party over many of the contentious new measures in the weeks ahead.Senate Republicans, led by Joni Ernst of Iowa, are preparing their own alternative to try to force compromises. Ms. Ernst, who has spoken about her own experience of sexual assault, told reporters this week that her colleagues objected chiefly to the gun provisions included in the House-passed measure, but she suggested their bill would eliminate other unwanted liberal proposals, too.Mr. Biden, who has called VAWA his “proudest legislative accomplishment,” enthusiastically backed the House bill and has not indicated what, if any, changes he would embrace. He won the presidency last fall in part based on the commanding support of women.The law was considered a watershed when it was written in the early 1990s. It addressed several issues that federal lawmakers had not tackled in a single piece of legislation, including keeping confidential the addresses of abused people and recognizing orders of protection across jurisdictions. Before the law was enacted, a state court order of protection in one state could not be enforced in another state.Though the law authorizing VAWA programs expired, Congress has continued to fund many of them in the meantime.Mr. Biden has already tried to make good on campaign promises to strengthen efforts to prevent domestic violence. His $1.9 trillion stimulus bill allocated $49 million for groups that aid survivors of domestic abuse, as well as housing assistance for people fleeing abuse, sexual violence and human trafficking.Katie Benner More
