    Biden Urged to Re-examine Israel Support After Lawsuit Dismissed

    A federal judge on Wednesday dismissed a lawsuit by Palestinian Americans who sought to force the White House to withdraw support for Israel’s bombardment of Gaza, as was widely expected based on constitutional precedent that only the political branches of U.S. government could determine foreign policy.But, unexpectedly, U.S. District Judge Jeffrey White indicated that he would have preferred to have issued the injunction were he not limited by the Constitution, and he implored the Biden administration to “examine the results of their unflagging support” of Israel.The determination came five days after a hearing in Oakland, Calif., in which Judge White allowed the head of a humanitarian group, a medical intern and three Palestinian Americans with relatives in Gaza to tell the court that their loved ones were being slaughtered. They alleged that the U.S. government has underwritten a genocide by backing Israel’s military response to the Oct. 7 attacks by Hamas.“President Biden could, with one phone call, put an end to this,” Laila el-Haddad, a Palestinian activist and author living in Maryland, told the judge.     China Failed to Sway Taiwan’s Election. What Happens Now?

    Beijing loathes the new president, Lai Ching-te. He aims to protect the status quo with caution and American help, but tensions are likely to rise.China’s leader, Xi Jinping, has tied his country’s great power status to a singular promise: unifying the motherland with Taiwan, which the Chinese Communist Party sees as sacred, lost territory. A few weeks ago, Mr. Xi called this a “historical inevitability.”But Taiwan’s election on Saturday, handing the presidency to a party that promotes the island’s separate identity for the third time in a row, confirmed that this boisterous democracy has moved even further away from China and its dream of unification.After a campaign of festival-like rallies, where huge crowds shouted, danced and waved matching flags, Taiwan’s voters ignored China’s warnings that a vote for the Democratic Progressive Party was a vote for war. They made that choice anyway.Lai Ching-te, a former doctor and the current vice president, who Beijing sees as a staunch separatist, will be Taiwan’s next leader. It’s an act of self-governed defiance that proved what many already knew: Beijing’s arm-twisting of Taiwan — economically and with military harassment at sea and in the air — has only strengthened the island’s desire to protect its de facto independence and move beyond China’s giant shadow.“The more hard-line, tougher approach hasn’t worked,” said Susan Shirk, a research professor at the University of California, San Diego, and the author of “Overreach: How China Derailed Its Peaceful Rise.” “That’s the reality of Taiwanese politics.”That evolution, cultural and political, comes with risks. Mr. Lai’s victory forces Mr. Xi to face a lack of progress. And while China’s full response will play out over months or years, China’s Taiwan affairs office said Saturday night that the election cannot change the direction of cross-strait relations, effectively ensuring that the dynamic of brinkmanship and stress will continue and most likely intensify.After his win, Mr. Lai promised to seek a balanced approach to relations with Beijing.Lam Yik Fei for The New York TimesChina and the United States have made Taiwan a test of competing sensitivities and visions. To Beijing, the island is a remnant of its civil war that the United States has no business meddling with. To Washington, it is the first line of defense for global stability, a democracy of 23 million people and the microprocessor factory for the world.The gargantuan stakes add gravity to every word or policy that Mr. Lai or his party might deliver now and after his inauguration in May. With Taiwan’s sense of self and China’s expectations in conflict, Mr. Xi is not expected to sit idly by.Before the election, in editorials and official comments, Chinese officials painted Mr. Lai as a villain, calling him a stubborn “Taiwan independence worker,” a “destroyer of cross-strait peace” and potentially the “creator of a dangerous war.”During the campaign, Mr. Lai, 64, a veteran politician respected by supporters for his quiet determination, said that Taiwan did not need formal independence. In a news conference after his victory, he said he would seek a balanced approach to cross-strait relations including “cooperation with China,” following the path of his predecessor, Tsai Ing-wen.But there is little chance of China changing its opinion.“Lai Ching-te is an impulsive and politically biased figure, so we cannot rule out the possibility that unpredictable and unknown developments may occur during his tenure,” said Zhu Songling, a professor of Taiwan studies at Beijing Union University.“I’m afraid it’s very dangerous,” he added, noting that Mr. Xi’s views on Taiwan were clear. That includes his insistence that force can be used if necessary.China’s top leader, Xi Jinping, and President Biden in California in November. Warnings about Taiwan have become a staple of U.S.-China diplomacy.Doug Mills/The New York TimesWestern scholars of Chinese politics are not much more optimistic.“The next four years will be anything but stable in U.S.-China and cross-strait relations,” said Evan S. Medeiros, a professor of Asian studies at Georgetown University.Like other analysts, he said to expect a familiar suite of pressure tactics.At the very least, China will keep trying to manipulate Taiwan’s politics with disinformation, threats and economic incentives. Chinese officials have also hinted they could target trade, eliminating more tariff concessions.Expanded military drills are another possibility. Chinese fighter jets, drones and ships already encroach on Taiwan almost daily.Beijing has also shown that it will keep prodding Washington to pressure Taiwan and to cut military support. Messages of alarm are becoming a common feature of U.S.-China diplomacy.In Washington, on the eve of Taiwan’s election, Liu Jianchao, the head of the Chinese Communist Party’s international department, met with Secretary of State Antony J. Blinken. The United States said Mr. Blinken “reiterated the importance of maintaining peace and stability across the Taiwan Strait.”Mr. Liu, based on other official statements, most likely warned the United States not to intervene “in the Taiwan region” — a complaint sparked by an announcement that a delegation of former officials would head to Taipei after the election. Such visits have followed past elections. China’s Foreign Ministry condemned “the American side’s brazen chattering.”There are no plans in Washington to go silent, however, or constrain cooperation. Quite the opposite. Last year, the Biden administration announced $345 million in military aid for Taiwan, with weapons drawn from American stockpiles. Bills in Congress would also tighten economic ties to Taiwan, easing tax policy and laying a foundation for economic sanctions against China if it attacks.Taiwanese forces during an anti-landing drill last summer. It could seek to place military logistics equipment on the island — a strategy the Pentagon is introducing throughout the region.It is also an open secret that American military advisers, mostly retired officers, have a growing presence in Taiwan. Some Taiwanese officials call them “English teachers.” Under Mr. Lai, many more could be on the way.“Beijing has been turning a blind eye, so the question is: What size of that presence will cross the Rubicon?” said Wen-ti Sung, a political scientist at the Australian National University’s Taiwan Studies Program. He added: “Hopefully each additional step will not be seen as overtly provocative to elicit or justify a massive Chinese reaction.”War, of course, is not inevitable. It may be less likely right now, when China is busy with a dismal economy and the United States with wars in Europe and the Middle East.Some analysts also hope that Mr. Xi will find a way to claim victory in the election and step back from antagonism. With a third-party candidate, Ko Wen-je, winning 26 percent of the vote with a vague focus on a middle path in China relations, Mr. Lai won with just 40 percent.“It’s in China’s national interest to expand the path of peaceful integration so they won’t have to fight,” Professor Shirk said. “There are a lot of people watching this interaction and Beijing’s reaction — all the investors are watching it too.”In Taiwan, however, there may be little Mr. Xi can do to polish China’s image. In recent surveys, less than 10 percent of Taiwanese respondents considered China trustworthy.“We have seen too many examples of what Xi did to Hong Kong and how he treated his people,” said Cheng Ting-bin, 56, a teacher in Taipei who voted for Mr. Lai.Most Taiwanese see their future elsewhere. Though Taiwan’s official name is the Republic of China, a holdover from when Chinese nationalists fled there, R.O.C. references were hard to find. At Mr. Lai’s rallies, supporters wore shimmering green jackets with “Team Taiwan” written in English across the back.Even the Nationalist Party, known for favoring closer ties with Beijing, emphasized deterrence, the status quo and Taiwanese identity. Its candidate, Hou Yu-ih, spoke with such a strong Taiwanese accent that Mandarin speakers unfamiliar with local inflections had a hard time understanding him.In many ways, the election was less of a referendum on China policy than usual. Cost-of-living issues became more dominant in part because the candidates’ platforms on foreign affairs all aligned with what most people said they wanted: a stronger military, closer ties with the democratic world, and a commitment to the status quo that avoids provoking Beijing but also seeks to tiptoe out of its orbit.“What we want is just to preserve our way of life,” said Alen Hsu, 65, a retiree who said his father had come from China and his son serves in the Taiwanese Air Force.“China,” he added, “simply cannot be trusted.”John Liu More

Trump bound himself tightly to the Israeli right, and President Biden approached the divided nation gingerly, a warm presidential embrace has eased years of tension.Not long ago, Donald J. Trump occupied enormous psychological space in Israel and among American Jews: His face draped skyscrapers alongside Benjamin Netanyahu’s during Israeli elections, and his politics drove a wedge between the Democratic Party and the Jews who have long called it their political home.But it is President Biden’s face that now beams from a billboard over the main highway through Tel Aviv, and Mr. Trump’s criticism of Israel’s leaders that has left even Israeli conservatives stunned.The president is suddenly finding warm embraces for his response to the worst terrorist attack in the Jewish State’s history in the most unlikely places.“This will sound surprising, but by and large, the president has shown tremendous support, unwavering support, for Israel at a critical time,” said Matt Brooks, the longtime head of the Republican Jewish Coalition, a group with close institutional ties to the G.O.P. and to some of its biggest donors. “Can we quibble on aspects of policy differences, over Iran’s complicity, for instance? Sure. But by and large, the American people and the international community have seen a president who has stood shoulder to shoulder with Israel.”No less than Mr. Trump’s hawkish former ambassador to Israel, David M. Friedman, wrote online that while he remained a critic of the Biden administration, “the moral, tactical, diplomatic and military support that it has provided Israel over the past few days has been exceptional.”Mr. Biden’s speech condemning the “evil” perpetrated by Hamas that killed more than 1,200 Israelis, his swift offer of military assistance, and the presence of his secretary of state, Antony Blinken, on Israeli soil have all won remarkable plaudits. A vast billboard in Tel Aviv thanks the president for his response. A video circulating on Israeli social media channels placed Mr. Biden’s speech on the terrorist attacks against clips of Hamas atrocities and Holocaust imagery.The moment amounted to a return to the kind of staunch bipartisan bond between Israel and the United States that had been questioned during the Trump administration, as Republicans allied themselves with the Israeli right and some liberal Democrats called for reducing or imposing conditions on foreign aid and military assistance to Israel.Now, as Mr. Biden finds himself plunged into a wartime relationship with Mr. Netanyahu, his strong support has wiped away those tensions, Israeli analysts and officials said.“His speech was remarkable, very emotional. Please rescue us,’” Mr. Klein said. “That says nothing about Israelis’ support for Biden.”But even some Jewish Republicans openly praised the administration’s response.“Everything he said is extremely positive and the exact things that I would have hoped a president of the United States would say,” said Fred Zeidman, a Texas businessman and major fund-raiser for Nikki Haley, the former South Carolina governor who is running to challenge Mr. Biden in 2024. “There is nothing I’m going to do to be critical of Joe Biden at this point.”After the Hamas attacks, the president told aides he wanted to join a meeting with Jewish leaders who had been scheduled for a White House meeting on antisemitism before the crisis, according to Nathan J. Diament, executive director for public policy for the Orthodox Union Advocacy Center, one of the largest Orthodox Jewish organizations in the country.Mr. Diament, whose members lean more politically conservative than much of the Jewish American population, compared the meeting to another moment 80 years ago, in 1943, when hundreds of rabbis marched to the White House to plead with Franklin D. Roosevelt to save European Jews from the Nazis. Senator Tim Scott, Republican of South Carolina, said the president had “blood on his hands” for unfreezing $6 billion for humanitarian needs in exchange for the release from prison of five Americans now under house arrest until the money is distributed. The National Republican Congressional Committee on Thursday tried to hit vulnerable House Democrats on the same issue.Then the Biden administration and Qatar reached an agreement on Thursday to refreeze those assets.Mr. Trump, the prohibitive front-runner for the Republican presidential nomination, has not helped his cause with Jews in either Israel or the United States. His dinner last November with the performer Kanye West, who had already been denounced for making antisemitic statements, and with Nick Fuentes, an outspoken antisemite and Holocaust denier, had earned the condemnation of some Trump allies. Blinken called a different Middle East leader, Prime Minister Benjamin Netanyahu of Israel.Over 40 minutes, Mr. Blinken gave the Israeli leader a briefing about the significant demands the young crown prince, Mohammed bin Salman, was making for his nation to normalize diplomatic relations with Israel. Mr. Netanyahu had an update on his own demands.The phone call — described by two American officials — was a turn in the Biden administration’s long-shot bid to broker a landmark diplomatic deal between Saudi Arabia and Israel, two historical adversaries who in recent years have been engaged in a discreet courtship in part over their shared distrust of archrival Iran.The White House, which for more than two years has largely been content to sit out the poker game of Middle East diplomacy, has decided to make a bet and push some of its chips in. The United States is now in the midst of complex negotiations among three leaders who have their own reasons for a deal but are making demands that might prove to be too costly. And they simply do not much like or trust each other.Several senior American officials said the chances of a deal could be less than 50 percent, and Mr. Blinken said he had “no illusions” the path to a deal would be quick. Still, a normalization of relations between Saudi Arabia and Israel would be one of the most dramatic events in a continued realignment of the Middle East, and could reap benefits for leaders of both countries, as well as President Biden, who faces re-election next year.It would also make explicit what has been true for a long time: that the government of one of the Arab world’s most influential countries has effectively made its support for a Palestinian independent state a lower priority.For Mr. Netanyahu, Saudi Arabia’s recognition of Israel would be a significant political victory for the embattled leader, whose hard-right coalition government faces fierce domestic opposition.For his part, Prince Mohammed is seeking a strengthened security relationship with the United States, access to more American weapons and U.S. consent for the kingdom to enrich uranium as part of a civilian nuclear program — something that Washington has long resisted.For Mr. Biden, drawing closer to Saudi Arabia carries political risks — he once pledged to make Saudi Arabia a “pariah” — but a diplomatic pact in the Middle East could be a boon ahead of the 2024 election. They also worried about a growing perception that political chaos and legislative paralysis in places like Washington and London — or in Israel, which held five elections in three years before Mr. Netanyahu narrowly managed to form his coalition — was creating a sense around the world that democracies could not deliver results for their people.Mr. Biden’s first Summit for Democracy, in December 2021, featured uplifting language from world leaders and group sessions on issues like media freedom and rule of law in which countries could trade best practices on strengthening their democracies and share advice on countering foreign efforts to manipulate politics and elections.The summit this week will include about 120 countries and will be hosted by Costa Rica, the Netherlands, South Korea and Zambia in addition to the United States.Recent democratic trends can be described as mixed at best. It hasn’t stopped.”That has been clear in some countries. Last month, Mexican lawmakers passed sweeping legislation hobbling the election oversight body that is widely credited with steering the country from decades of one-party rule. Critics say the country’s populist president, Andrés Manuel López Obrador, has shown some troubling autocratic tendencies.In India, opponents of the country’s prime minister, Narendra Modi, have complained for years that he is weakening the democratic tradition of the world’s second-largest country by population by cracking down on critics and religious minorities. The State Department called a March 7 parliamentary vote approving the measure “a dark day” for democracy in Georgia, which U.S. officials have tried to support against the influences of Russia, its neighbor.The tumult over Israel’s democracy has been particularly shocking to U.S. officials and experts who have long seen the country as a paragon of democratic values and an especially bright example in a region long plagued by dictatorship.And the summit this week will notably exclude two members of the North Atlantic Treaty Organization, Hungary and Turkey, whose autocratic political systems have grown no less repressive during Mr. Biden’s tenure.Still, some people who track democratic trends say they are optimistic.“Perhaps the most striking indication of democracy’s forward movement over the last two years has been the election of President Biden, and the election of President Lula in Brazil,” said Sarah Margon, the director of foreign policy at Open Society-U.S.Those events “sent a critical message to people who are looking to defeat autocrats or leaders with autocratic tendencies,” added Ms. Margon, whom Mr. Biden nominated last year to the State Department’s top position for human rights and democracy.
