    Elon Musk Shares Manipulated Harris Video, in Seeming Violation of X’s Policies

    Elon Musk, the world’s richest man, has waded into one of the thorniest issues facing U.S. politics: deepfake videos.On Friday night, Mr. Musk, the billionaire owner of the social media platform X, reposted an edited campaign video for Vice President Kamala Harris that appears to have been digitally manipulated to change the spot’s voice-over in a deceptive manner.The video mimics Ms. Harris’s voice, but instead of using her words from the original ad, it has the vice president saying that President Biden is senile, that she does not “know the first thing about running the country” and that, as a woman and a person of color, she is the “ultimate diversity hire.”In addition, the clip was edited to remove images of former President Donald J. Trump and his running mate, Senator JD Vance of Ohio, and to add images of Mr. Biden. The original, unaltered ad, which the Harris campaign released on Thursday, is titled “We Choose Freedom.”The version posted on X does not contain a disclaimer, though the account that first uploaded it Friday morning, @MrReaganUSA, noted in its post that the video was a “parody.” When Mr. Musk reposted the video on his own account eight hours later, he made no such disclosure, stating only, “This is amazing,” followed by a laughing emoji.Mr. Musk’s post, which has since been viewed 98 million times, would seem to run afoul of X’s policies, which prohibit sharing “synthetic, manipulated or out-of-context media that may deceive or confuse people and lead to harm.”We are having trouble retrieving the article content.Please enable JavaScript in your browser settings.Thank you for your patience while we verify access.     This Is One Republican Strategy That Isn’t Paying Off

    In 2011, determined to push back the ascendant Democratic coalition that elected America’s first Black president, Republicans capitalized on their control of legislatures and governor’s mansions in 20 states to enact measures designed to suppress minority Democratic voters.Barack Obama’s successful campaign for the presidency in 2008 had provoked fear in Republican ranks that the conservative coalition could no longer maintain its dominance. Getting 52.9 percent of the popular vote, Obama was the first Democratic presidential nominee to break 50 percent in the 32 years since Jimmy Carter won with 50.1 percent, in 1976.Republicans counterattacked, mounting a concerted drive to disenfranchise Democrats, a drive that gained momentum with the June 2013 Supreme Court decision Shelby County v. Holder. The court ruled that Section 5 of the 1965 Voting Rights Act, which required states and jurisdictions with a history of discrimination to obtain preclearance for any change in election law, procedure or regulation, was unconstitutional.Within hours of the Shelby decision, Republicans announced plans both to enforce laws that had been blocked by the federal government and to pass laws designed to prevent Democrats from casting ballots.Greg Abbott, then the attorney general of Texas, was first out of the gate, immediately declaring that the state would revive a voter identification law that had been barred under Section 5: “With today’s decision, the state’s voter ID law will take effect immediately. Photo identification will now be required when voting in elections in Texas.”In a 2019 report, the liberal Brennan Center for Justice found:Overall, 25 states have put in place new restrictions since 2010 — 15 states have more restrictive voter ID laws in place (including six states with strict photo ID requirements), 12 have laws making it harder for citizens to register (and stay registered), 10 made it more difficult to vote early or absentee, and three took action to make it harder to restore voting rights for people with past criminal convictions.All of which raises the question: How effective has the onslaught of state-level legislation been at raising the odds for Republican candidates?The apparent answer: not very.“Contemporary election reforms that are purported to increase or decrease turnout tend to have negligible effects on election outcomes,” Justin Grimmer and Eitan Hersh, political scientists at Stanford and Tufts, write in their June paper, “How Election Rules Affect Who Wins.”“Contrary to heated political rhetoric,” Grimmer and Hersh write, “election policies have small effects on outcomes because they tend to target small shares of the electorate, have a small effect on turnout, and/or affect voters who are relatively balanced in their partisanship.”How about partisan gerrymandering? Did the Shelby decision open the door to disenfranchising political opponents by allowing Republican legislatures to reduce the number of “minority opportunity” congressional and state legislative districts likely to elect Black or Hispanic Democrats — a process known as retrogression?Again: apparently not.Nicholas Stephanopolous of Harvard Law School, Eric McGhee of the Public Policy Institute of California and Christopher Warshaw of George Washington University compared every congressional, State Senate and State House district before and after the lines were redrawn to accommodate population shifts in the 2020 census in their paper “Non-Retrogression Without Law.”“Our primary finding,” they write,is that there was little retrogression in formerly covered states. In sum, the number of minority opportunity districts in these states actually rose slightly. We also show that formerly covered states were largely indistinguishable from formerly uncovered states in terms of retrogression. If anything, states unaffected by Shelby County retrogressed marginally more than did states impacted by the ruling.These two papers raise some intriguing questions.If changes in election laws, especially those affecting voter turnout, have little influence on partisan outcomes, why should the average citizen care about these developments?Conversely, even if the laws have only marginal influence on election outcomes, couldn’t that marginal difference become crucial in very close elections? The contest for attorney general in Arizona in 2022, for example, was won by just over 500 votes out of more than 2.5 million cast.The authors of the two papers cited above, along with other experts in election law, reject out of hand the notion that the often minimal partisan effect of regressive legislation should dampen the continuing effort to make voting easier and more accessible.Richard Hasen, a specialist in election law at U.C.L.A., emailed in response to my inquiry asking for his view of the two papers:Even if it turns out that laws intended to suppress the vote do not have that effect overall and in the aggregate, that would not justify such laws. A state should not have the right to put stumbling blocks in front of eligible voters. Such laws violate the rights and dignity of each voter, and such laws should have to be justified by real, empirically verifiable interests in preserving the integrity of the vote or serving some other key state purpose.Grimmer and Hersh argued in an email that their work should prompt increased public interest in election law:First, there are a lot of reasons legislators, activists, or political parties might want to reform laws that have nothing to do with the change in laws affecting outcomes. For instance, changing laws might improve the functioning of elections and increase trust in the electoral process. We might think some changes to election laws are simply the right thing to do based on our ethical values.In addition, Grimmer and Hersh argue, the minimal effects of changes in the law on election outcomes means that partisans on both sides “will have to win on the merits of their arguments rather than through changing the rules of the game. We think that’s a pretty optimistic story for democratic governance.”Marc Elias, a founding partner of Elias Law Group and a longtime Democratic election lawyer, raised the point that even very small shifts can determine the outcome in extremely close races.Grimmer and Hersh’s reply:In our paper, we concede that on the very rare occasions that an election is decided with a razor thin margin, nearly everything that happened could explain a candidate’s victory — a seasonal flu, a rainstorm, a “hanging chad,” etc. That said, even some of the most hotly contested policies have effects smaller than the margin Mr. Elias quotes from Arizona. For example, in our paper we estimate that the ban on out-of-precinct voting in Arizona only yielded Republicans 177 votes, even though this policy was a major source of dispute in the Brnovich Supreme Court decision. So even if a policy such as that had been implemented in 2022 and everything else remained the same, the Arizona attorney general result would have remained unchanged.In support of their argument, Grimmer and Hersh create a hypothetical case study: “Suppose a state recently held a close election in which 51 percent of voters supported the Democratic candidate and 49 percent of voters supported the Republican candidate.” In response, the Republican legislature enacts a law that “imposes additional requirements to vote” on 4 percent of the electorate containing voters who are 60-40 Democratic. The law will produce a “a 3-percentage point decline in turnout in this group.”If the 51-49 election is run again with this new voter suppression regulation, they continue, “the policy would cause a 0.12 percentage point decline in the overall turnout. And it would cause a 0.011 percentage point decline in the two-party vote share for the Democratic candidate.”The result?50.989 percent of voters would support the Democratic candidate while 49.011 percent of voters would support the Republican candidate. If the state had one million eligible voters, the policy would deter 720 Democratic voters and 480 Republican voters, netting the Republicans a 240-vote shift.Interestingly, if this hypothetical is applied to the Arizona attorney general race I mentioned, the voter suppression law would have changed the Democratic victory into a Republican one by adding a net of 600+ Republican votes.In addition to Hasen, I asked a number of scholars and voting rights proponents to comment on the two papers.There was general agreement, with some caveats, in the case of the Stephanopolous, McGhee and Warshaw paper. The Grimmer-Hersh paper provoked a wider range of reactions.Kevin Morris, a researcher in the democracy program at the Brennan Center, did not fault the Grimmer-Hersh paper, but stressed that “As the authors do not dispute, the impact of partisan outcomes in statewide races is not the only or even primary reason to be concerned about those restrictions.”Grimmer and Hersh are careful to note, Morris continued, that “restrictive voting laws usually disproportionately harm voters of color. Whether or not this has a partisan impact on statewide results, this is a significant harm in and of itself.”Kareem Crayton, senior director for voting and representation at the Brennan Center, argued in an email that the elimination of the preclearance requirements under Section 5 of the Voting Rights Act has placed cumbersome and time-consuming burdens on private lawyers bringing voting rights cases.Preclearance, Crayton wrote, required “a submission outlining the state’s intentions, its underlying data, and supporting documentation,” all of which provided “major sources of foundational evidence for any such lawsuit.”The lack of this crucial information, Crayton continued,has meant that Section 2 plaintiffs must gather much of this material through discovery, a litigation tool that involves far more time and resources than when Section 5 was operational. Alabama’s current illegal congressional map has stood for almost a full election cycle, denying Black voters an equal opportunity to elect candidates of choice. At least part of this unjust delay is due to the extra time needed to build the factual case showing the Section 2 violation.Guy-Uriel Charles, a law professor at Harvard who directs its Charles Hamilton Houston Institute for Race and Justice, argued in an email that “from a democracy perspective,” partisan outcomes are “the wrong way to think about voting rights.”What matters most, in Charles’s view, “is whether voter suppression laws prevent eligible voters — whether those voters are Republicans or Democrats; Black, White, Asian, Native, or Latino; live in the South or the North; poor or rich, college educated or not — from exercising what ought to be a fundamental right.”In addition to Elias, there are others who challenge Grimmer and Hersh’s portrayal of minimal effects on election outcomes resulting from new legislation.Thad Kousser, a political scientist at U.C. San Diego, wrote by email that he sees “two possible caveats to Grimmer and Hersh’s overall message that voter participation reforms have ‘essentially no effect on partisan advantage.’”First, Kousser wrote, “even marginal partisan effects can be consequential in a nail-bitingly close election.” He pointed to an “illustrative example” that Grimmer and Hersh use:a reform that increased turnout by 1.25 percentage points overall — a size similar to the impact of many real-world reforms — would yield a decrease in the Republican candidate’s vote margin of 7,500 votes, out of 487,500 votes cast. Because the authors assume in their example that the state overall is strongly Republican, this would only reduce “the two-party share for the Republican candidate from 78.46 percent to 77.00 percent.” In that example, it would not be large enough to swing the election. But of course, if the state were much more closely contested, those 7,500 votes could change the winner. And if the votes were concentrated in a few legislative districts, they could also play an important role in those outcomes.Second, Kousser wrote:There are some recent reforms that may have significantly larger impacts than those reviewed by Grimmer and Hersh. California’s recent law that shifts most off-cycle local elections onto the same schedule as even-year presidential and gubernatorial elections is proving to have major impacts on the size and composition of the electorates voting for mayors, county supervisors, and school boards.Kousser pointed to a 2022 paper, “Who votes: City election timing and voter composition” — by Zoltan L. Hajnal, Vladimir Kogan and G. Agustin Markarian, political scientists at U.C. San Diego, Ohio State and Loyola University-Chicago — which examined the changed composition of the electorate in California as cities shifted from holding local elections on days separate from federal contests to holding them on the same day, known as “on cycle elections.”When cities shift to on-cycle elections, Hajnal and his two colleagues write, the non-Hispanic white share, previously two-thirds of the vote, “decreases by nearly 10 percentage points” in presidential election years and “by 5.7 points when they are concurrent with midterm elections.”The Latino share increases “from about 18 percent in off-cycle elections to just under 25 percent when these elections are consolidated with presidential contests.” The Asian American “share of the electorate increases by 2.3 percentage points when cities move to the same date as presidential elections,” which may not seem like much “but it’s important to keep in mind that Asian Americans account for only 7.7 percent of the electorate in off-cycle elections, so this represents an increase of 30 percent.”The changed composition of the electorate in on- and off-cycle elections is equally remarkable for young and old voters. The authors found that older voters “account for nearly half of off-cycle voters. But the share of older voters drops almost 22 points in local elections that coincide with presidential elections and 13 points for midterm elections.” The share cast by younger voters, in turn, “almost doubles during presidential elections.”In the case of all these factors — race, ethnicity and age — Hajnal, Kogan and Markarian conclude that “on-cycle elections produce a more representative electorate.”Along similar lines, four political scientists, Michael P. McDonald, Juliana K. Mucci and Daniel A. Smith, all of the University of Florida, and Enrijeta Shino of the University of Alabama, found significant turnout increase in states adopting mail voting.In their June 2023 paper, “Mail Voting and Voter Turnout,” the four write thateven before the 2020 election, we show voter turnout across the states is consistently higher in every general election over the past decade in states with greater shares of overall ballots cast by mail. Drawing on turnout data from the 2012-2020 Current Population Survey and the Cooperative Election Study, we find states with greater usage of mail voting experience higher overall voter turnout.During the 2018 governor’s race in Georgia, between Brian Kemp, the Republican secretary of state, and Stacey Abrams, the Democratic candidate, Kemp gave voice to the precise anxiety of Republicans generally: that they might be swamped by a growing Democratic electorate.An audio recording leaked from an October 2018 fund-raising event caught Kemp as he was warning his supporters:As we were going into the start of early voting with the literally tens of millions of dollars that they are putting behind the get out and vote efforts for their base, a lot of that was absentee ballot requests that had just an unprecedented number of that, which is something that continues to concern us especially if everybody uses and exercises their right to vote, which they absolutely can, and mails those ballots in.Kemp went on to win, but two years later, despite the flood of voting restrictions since 2010, turnout in the 2020 presidential election was the highest in 30 years, according to the U.S. census.What this suggests is that the American electorate is determined to exercise the franchise and is resistant to legislated hindrances — more so than many would expect. This does not bode well for a Republican Party that for the moment has applied its money, energy and strategic skill to reducing Democratic turnout and suppressing Democratic votes.The Times is committed to publishing a diversity of letters to the editor.     Fox Settlement Is a Victory for Dominion. But the Misinformation War Continues.

    False claims about election fraud remain a problem, spreading in various places online, voting and media experts said.There are 787 million reasons to consider Fox News’s settlement of the defamation lawsuit a stunning victory for Dominion Voting Systems. Whether the millions of dollars that Fox is paying to Dominion will put to rest false claims about the 2020 presidential election or help deter misinformation more broadly remains far less clear.In the blinkered information bubbles where the lies about Dominion’s rigging the vote were fabricated and spread, conspiracy theories about the company continue to thrive — at least among those resistant to overwhelming evidence, including new disclosures about Fox News and its most famous hosts that Dominion’s lawsuit revealed.And Dominion is only one part of a broader conspiracy theory that the American electoral system is corrupt. That view, despite all the proof to the contrary, is still cheered on by former President Donald J. Trump, who remains the front-runner for the Republican nomination in 2024.“Part of the strength of that conspiracy theory is that it has so many different strands that yield the conclusion of a rigged election that you could actually destroy one thread or one strand, and you’d still have enough strands to sustain it,” Kathleen Hall Jamieson, director of the Annenberg Public Policy Center at the University of Pennsylvania and a founder of FactCheck.org.The $787.5 million settlement, one of the largest ever for a defamation case, undoubtedly has a punitive effect on Fox, even though it allowed the company to avoid a potentially embarrassing trial. Like the verdicts last year against Alex Jones, the broadcaster who defamed the families of schoolchildren killed in Sandy Hook Elementary School and was ordered to pay them more than $1.4 billion, the outcome showed that lies can be costly for those who spread them.Alex Jones was found liable for defamation after spreading falsehoods about the Sandy Hook school shooting.Kirsten Luce for The New York TimesYet Mr. Jones has continued his broadcasts on Infowars, the conspiratorial news site, while employing legal strategies that could help him evade some of the financial penalty.For researchers who study disinformation, the abrupt end to the lawsuit against Fox dashed hopes that a lengthy trial — with testimony from hosts who repeated accusations against Dominion they knew to be false — would do more to expose the dangerous consequences of pushing falsehoods and conspiracies.Nora Benavidez, senior counsel at Free Press, an advocacy group for digital rights and accountability, was among those expressing disappointment. She said that the settlement — for half of what Dominion originally sought — reflected Fox’s “desire to avoid further damning facts coming out during trial.”“Yet money alone won’t bring us accountability, and it doesn’t correct the ongoing harms Fox News causes to democracy,” she said. “If $787.5 million is the cost to tell a lie, repeatedly, what’s the cost of curing that lie?”Fox was spared extended and potentially damaging testimony. The network did not have to issue an apology on air. Instead, in a carefully crafted statement, Fox acknowledged “the court’s rulings finding certain claims about Dominion to be false” and touted its “continued commitment to the highest journalistic standards.”While the major news networks pivoted to cover the trial’s abrupt end on Tuesday, Fox devoted just six minutes and 22 seconds to the topic across three segments. None of its prime time hosts, including Tucker Carlson, who had once bolstered the voter fraud myths and was named as a defendant in Dominion’s lawsuit, mentioned the case.Instead, Mr. Carlson began his show with a segment about violence in Chicago, airing video clips largely showing Black Chicagoans during a weekend of violence. “This is why we used to shoot looters,” he said. That was followed with an interview with Elon Musk, the entrepreneur and new owner of Twitter.“So what would you be thinking about when you’re watching Tucker Carlson?” Ms. Jamieson said. “Not the Fox settlement, but crime in the cities, interesting interview with Musk. And now our media diet for the day has told you what matters.”None of Fox’s prime time hosts, including Tucker Carlson, mentioned the settlement on air.Rebecca Noble for The New York TimesA similar phenomenon unfolded in other news organizations on the political right in the wake of the settlement. The Gateway Pundit, a site known for pushing voter fraud conspiracy theories, devoted one 55-word story to the settlement on Tuesday, which was not updated.Far more words were expressed in comments left by readers, where nearly 4,000 missives raised fresh conspiracy theories. Among them was a tale that Fox News’s settlement was actually a shrewd maneuver that would help Dominion extract debilitating sums from Fox competitors, including the conservative news networks One America News and Newsmax, which have also been sued by Dominion.In the two hours following the settlement’s announcement, there was a significant spike in references online to the discredited film “2000 Mules,” which spun an elaborate theory of people delivering thousands of ballots in drop boxes, according to Zignal Labs, a company that tracks activity online. The references surged again on Wednesday after a prominent commentator on Twitter, Rogan O’Handley, chided those “cheering over” the settlement. “We know it was rigged,” he wrote.On Telegram, the freewheeling social media app,users claimed without evidence that the deal was a way for Fox to launder money; that the network was in cahoots with Dominion to engineer an election coup; that Dominion was trying to avoid a trial that would expose its corrupt practices; and that the judicial system was controlled by the Mafia.Even if the Dominion victory makes news organizations think twice before reporting lies about election technology vendors in the future, the damage has already been done.Lawrence Norden, the senior director of the elections and government program at the Brennan Center for Justice at New York University, said the settlement would do little to protect election workers who were abused by anonymous conspiracy theorists or voters led astray by false narratives about ballot fraud.“Lies about our elections have really inundated our society, and I don’t think that’s changing,” he said. “Not all of those lies involve the potential for a defamation suit; it’s really the extreme cases where people are going to be able to collect monetary damages.”Legal experts said that the Dominion case against Fox had several important characteristics that set it apart. The voting technology company had compiled evidence suggesting that some Fox hosts had shared the false election fraud narrative with viewers despite privately expressing serious misgivings about the claims. The company had also submitted filings claiming that the election lies repeated by Fox caused Dominion to lose business.In fact, the judiciary has emerged as a bulwark in the fight against false information, and not only in extreme cases focused on defamation, like those involving Fox News or Mr. Jones. Court after court rejected legal challenges to the balloting in 2020 for lack of evidence. This week, an arbitration court ordered Mike Lindell, the chief executive of My Pillow, who claimed among other things that China had rigged the vote, to pay a $5 million reward to a software engineer who debunked the claims as part of a “Prove Mike Wrong” contest.The legal traditions that allowed Dominion’s lawyers to receive the damning emails of Fox executives and anchors and make them part of the public record were essential in proving the allegations were baseless as a matter of record.“Before we give up on the capacity of the system to work to determine what constitutes knowable fact in the moment, we should say the courts have worked well up to this point,” Ms. Jamieson said.Election misinformation will almost certainly remain a problem heading into the 2024 presidential election. Dealing with it will be difficult, but not hopeless, Mr. Norden said. While some hard-core conspiracy theorists may never be convinced of the legitimacy of the vote, many people are simply unfamiliar with the mechanics of American elections and can have more faith in the system if exposed to accurate information.“We know what’s coming, and there’s an opportunity ahead of the next election to build more resilience against that with most of the public,” Mr. Norden said. “I don’t think we’re going to solve this problem through defamation suits alone, but there’s a lot that we can be doing between now and November 2024.” More

    Election Workers Face an Obstacle Course to Reach the Midterms

    WASHINGTON — In Las Cruces, N.M., self-styled fraud investigators have deluged election officials with open-records demands for office email, images of all 130,000 ballots cast in 2020 and digital records that lay out what votes were cast at every polling place.In Tioga County, Pa., fliers hung on doorknobs urge voters to delay going to polling places until minutes before they close, potentially snarling election-night reporting of results.And in Nye County, Nev., where an election denier is overseeing the next election, officials are recruiting volunteers to hand-count thousands of ballots after the county commission did away with electronic voting machines.With just five weeks left until Election Day on Nov. 8, a drumbeat of lawsuits, harassment, calls to change balloting procedures and demands for reams of election records — driven by people who mistrust or outright reject the idea that elections are fair — are adding to pressures on election officials just as work in advance of the vote is peaking.The problems reflect fears for the November vote and concerns that the demands on voting oversight will further deplete an election infrastructure already pushed to the breaking point — with the 2024 presidential election looming beyond the midterms.“The exhaustion is real for election officials,” Lawrence Norden, the senior director of the elections and government program at the Brennan Center for Justice at New York University, said in an interview. He added: “The partisanship and polarization around elections — and election officials themselves — is a strain and a threat to our elections.”Mr. Norden said the pressures on election offices are compounded by a falloff in the federal aid and cybersecurity assistance that poured into the 2020 election. “I’m not so worried for the near term,” he said, “but I am for the long term.”Election workers assisting voters at a polling site in Las Vegas in June.John Locher/Associated PressConsider Lycoming County, Pa., home to the city of Williamsport and some 71,000 predominantly Republican voters. Election critics are in court there, demanding a voluminous record of the county’s 2020 vote. Last month the county board of commissioners approved, then scrapped, a referendum on the November ballot over abolishing electronic voting systems in favor of hand-counting ballots. That referendum, too, had been pushed by election skeptics and deniers. Another records request asked for the names and jobs of the county’s 400 poll workers.“How is the November midterm election the third or fourth thing on my radar?” the county’s director of elections and registration, Forrest K. Lehman, asked. “It should be number one.”The State of the 2022 Midterm ElectionsWith the primaries over, both parties are shifting their focus to the general election on Nov. 8.Standing by Herschel Walker: After a report that the G.O.P. Senate candidate in Georgia paid for a girlfriend’s abortion in 2009, Republicans rallied behind him, fearing that a break with the former football star could hurt the party’s chances to take the Senate.Democrats’ Closing Argument: Buoyed by polls that show the end of Roe v. Now, Democrats are facing potential losses up and down the ballot.Perhaps the most pressing problem nationwide is a barrage of requests for election records, from photocopies of ballots to images of absentee ballot envelopes and applications. The county clerk in Winnebago County, Wis., Sue Ertmer, said she fielded some 120 demands for records in only a couple of weeks last month. “When you get those types of requests, it gets a little hard to get a lot of other things done,” she said. “It’s a little overwhelming.”Amy Cohen, the executive director of the National Association of State Election Directors, said the barrage of records requests had hit red and blue counties alike. “Election officials don’t wake up on Election Day or the day before and decide to put on an election,” she said. “Running an election takes weeks of preparation.”The requests come from a variety of sources, but a number of election officials noted that Mike Lindell, the pillow salesman and purveyor of conspiracy theories about the 2020 vote, has encouraged supporters to submit them. Election deniers offered instructions on filing records requests at a seminar hosted by Mr. Lindell in Springfield, Mo., in August.In a telephone interview, Mr. Lindell said providing information to the public was an important part of the job of election workers. He added that local supporters had sent him digital recreations of the ballot choices of every voter, commonly called cast vote records, from more than a thousand election jurisdictions. Mr. Lindell said the records support his theory that balloting has been manipulated nationwide, although election experts repeatedly have debunked such claims.“That’s why we can’t have machines used in future elections,” he said. “Any election in the United States going forward, we need to get rid of them.”In Doña Ana County, N.M., which includes Las Cruces, the state’s second-largest city, the county elections staff member in charge of processing open records requests quit this year, in part because of the workload, said Amanda López Askin, the county clerk.Voters waiting in line to cast their ballots during the primary election in Las Cruces, N.M., in 2020.Paul Ratje/Reuters“They demand and accuse, and then they leave you with a year’s worth of work,” she said. “In some cases you have to redact information manually, and you have 80,000 pieces of paper” that must be edited to remove protected data.Some of the records requests seem to have been coordinated by nationwide groups of election deniers. In Pennsylvania, lawsuits in two counties seek to force election officials to turn over cast vote records that state officials say are exempt from disclosure. Both suits are being backed by the Thomas More Society, a Chicago-based conservative law firm that also filed suits seeking to overturn President Biden’s 2020 election victory. The demand for documents comes atop a host of other issues that were already plaguing preparations for November.In a reprise of 2020 pre-election tactics, activist groups promoting the baseless notion of widespread voter fraud are trying to invalidate tens of thousands of voter registrations, mostly in Democratic areas. Most of the challenges have failed.Election administrators in a number of states are rushing to adapt to new rules laid down in recent court cases and laws, some of which would impose harsh penalties for making administrative decisions on balloting matters that long had been seen as matters of discretion. Wisconsin officials, for example, have been barred by a court ruling from contacting would-be voters to correct minor mistakes or omissions in absentee ballots; instead, the ballots must be returned.Election offices in many jurisdictions are being threatened with lawsuits by election-denial groups, or simply being threatened by angry constituents. Meetings of election boards and county commissions have become forums for campaigns to abandon electronic voting machines or rehash fraud claims from 2020.In a handful of places, campaigns have succeeded. In sprawling Nye County, Nev., where some 33,000 voters are sprinkled over an area nearly as big as two Vermonts, County Clerk Mark F. Kampf — who has said he believes Donald J. Trump won in 2020 — is soliciting volunteers to hand-count ballots in November. County commissioners voted in March to stop using voting machines made by Dominion Voting Systems, apparently responding to the debunked conspiracy theory that the machines were rigged to favor Mr. Biden in 2020.Mr. Kampf did not respond to repeated requests for an interview.In Tioga County, Pa., the only snag in election plans is the door-to-door campaign by an election-denial group and watchdog, Audit the Vote PA, to persuade voters to line up at polling stations as they are about to close.Voting during the primary election in Lower Gwynedd, Pa., in May.Kriston Jae Bethel for The New York TimesToni Schuppe, identified as the group’s founder, turned down an interview request, and the county elections director, Penny Whipple, declined to speak on the record. Others said the campaign appears to stem from a conspiracy theory that voting machines are rigged to add bogus Democratic votes throughout the day, and that a last-minute fusillade of votes would thwart that scheme.The only real effect, however, would be to delay the reporting of election results, said Mr. Lehman of Lycoming County, which abuts Tioga. “To get a lot of people showing up at 7:45 p.m. in the dark, in the cold of November, and then have delays at all your precincts — that would be a recipe for chaos,” he said.The stress, and the added workload posed by the growing nationwide trend toward voting by mail, are taking a toll. In Kentucky, more than one in five of the state’s 120 county clerks are not seeking re-election in November, and six have quit outright this year, the state’s top election official, Secretary of State Michael Adams, said.Ms. Ertmer, the Winnebago County clerk, said turnover also has been unusually high in Wisconsin, both among county clerks and municipal clerks who perform most election duties. “I’m going to retire next year,” she said. “I would have continued if the atmosphere was different. I love my job, and the people I work with. But enough is enough.”And in Washoe County, Nev., home to Reno, county officials made it official policy to give legal and public relations help to government officials who are harassed or smeared after the registrar of voters, Deanna Spikula, announced her resignation in June.All that said, Mr. Adams, Ms. Ertmer and other officials said they planned to be ready when voting begins. Mr. Adams even expressed guarded optimism that the wave of activity by election deniers had crested: “The My Pillow guy did his thing on me a week ago, and I thought I’d get thousands of records requests,” he said, referring to Mr. Lindell. “But I got very little.”Some officials, like Anthony W. Perlatti, the director of the Cuyahoga County Board of Elections in Ohio, said they had learned lessons in 2020 that will help in 2022.And Nichole Baldwin, the clerk and registrar of voters in tiny White Pine County, Nev., said she was unfazed by the records requests. “They’re all asking for the same thing: cast vote records,” she said. “I have them on a flash drive, and I’m sending them out as they come in. No big deal.”Indeed, the greatest worry for many was the prospect of the unexpected.Kaitlyn Bernarde, the city clerk in Wausau, Wis., said she was reviewing her emergency management plan, with guidelines for handling aggressive voters and rules governing the conduct of observers inside polling places.In April, she said, primary elections in Wausau went swimmingly.     Election Workers Don’t Feel Safe Despite Federal Effort to Combat Threats

    WASHINGTON — “Do you feel safe? You shouldn’t.”In August, 42-year-old Travis Ford of Lincoln, Neb., posted those words on the personal Instagram page of Jena Griswold, the secretary of state and chief election official of Colorado. In a post 10 days later, Mr. Ford told Ms. Griswold that her security detail was unable to protect her, then added:“This world is unpredictable these days … anything can happen to anyone.”Mr. Ford paid dearly for those words. Last week, in U.S. District Court in Lincoln, he pleaded guilty to making a threat with a telecommunications device, a felony that can carry up to two years in prison and a fine of up to $250,000. He did not immediately respond to a request for comment.But a year after Attorney General Merrick B. Garland established the federal Election Threats Task Force, almost no one else has faced punishment. Two other cases are being prosecuted, but Mr. Ford’s guilty plea is the only case the task force has successfully concluded out of more than 1,000 it has evaluated.Public reports of prosecutions by state and local officials are equally sparse, despite an explosion of intimidating and even violent threats against election workers, largely since former President Donald J. Trump began spreading the lie that fraud cost him the 2020 presidential election.Colorado alone has forwarded at least 500 threats against election workers to the task force, Ms. Griswold said.The sluggish pace has sparked consternation among both election workers and their supporters, some of whom say they are souring on the idea of reporting the menacing messages to prosecutors if nothing comes of it.“The reaction usually is ‘Thank you for reporting that; we’ll look into it,’ and there’s no substantive follow-up to understand what they’re doing,” said Meagan Wolfe, the president of the National Association of State Election Directors. Ruby Freeman and Shaye Moss, who are mother and daughter and both election workers in Atlanta, told of being forced into hiding by a barrage of threats in December 2020, after being falsely accused of election fraud by Rudy Giuliani, who was then Mr. Trump’s personal lawyer. Protesters tried to enter a relative’s house in search of the two. Eventually, they quit their positions.That is not the norm, but neither is it uncommon. Ms. Griswold said one Colorado county clerk wears body armor to work, and another conducts business behind bulletproof glass.“In my experience, if someone is telling you over and over how they’re going to hang you, asking you the size of your neck so they can cut the rope right, you have to take the threats really seriously,” she said, citing threats she had received.The city clerk in Milwaukee, Claire Woodall-Vogg, said she had “completely redesigned our office at City Hall for safety reasons” after receiving hundreds of threats, which she said had been forwarded to the task force.An investigation by Reuters in September turned up more than 100 threats of death or violence to election officials in eight battleground states, which at that time had produced four arrests and no convictions.A survey in March by the Brennan Center for Justice found that one in six local election officials have personally experienced threats, and nearly a third said they knew people who had left their jobs at least in part because of safety concerns.Justice Department officials declined to comment on the task force’s progress. The department has said previously that the task force was tracking and logging election-related threats, and had opened dozens of criminal investigations as a result. Each of the 56 F.B.I. field offices has assigned an agent to collect and analyze threat reports, and federal prosecutors have been trained in assessing and investigating threats.The trickle of prosecutions in the wake of those moves is explained in part by federal law, which defines illegal threats extremely narrowly in the name of preserving the constitutional right to free speech.“You need to say something like, ‘I am going to kill you.’ It can’t be ‘Someone ought to kill you,’” said Catherine J. Ross, a professor and expert on First Amendment law at George Washington University. “That’s a very high bar, and intentionally a high bar.”That so-called true threat doctrine classifies even many extreme statements as protected political speech. That rules out charges in a great many cases of threats against election officials — even when the recipients feel terrified for their lives.Joanna Lydgate, founder and chief executive officer of the bipartisan legal watchdog organization States United Democracy Center, said she was encouraged to see results from the task force and understood, “These cases can be challenging to bring, and they take time.”She said: “We definitely hope to see more of this from DOJ, because investigating these threats, building these cases and holding people accountable is critically important, especially as we’re looking toward the midterms.”In Arizona, the office of Secretary of State Katie Hobbs has reported more than 100 threats to the F.B.I. in the last year, said a spokeswoman, C. Murphy Hebert. Ms. Hebert said she was confident that the task force was reviewing those threats, but that could be cold comfort to recipients who have not seen results.“For the folks monitoring and the folks being targeted, a hundred messages saying ‘You should die’ is pretty threatening,” she said. “But based on what we know of the process,” they are not actionable, she said.Protesting supporters of U.S. President Donald J. He said he had reported at least one threat to the F.B.I.But while the bureau has helped clarify how its threat review process works and has met with local clerks, he said, he still does not know whether his report was followed up on.“It does not give a lot of comfort to the people who receive threats,” he said. “I’ve heard some say: ‘Why should I report it? I’m better off just carrying my gun with me and if something happens, at least I can do something to protect myself.’”Other experts say the lack of both action and transparency was undermining the principal goal of the task force — to stop the epidemic of violent threats.“Three prosecutions in a year for a problem that is nationally widespread seems awfully low,” said David J. Becker, a onetime voting rights lawyer at the Justice Department who now directs the nonprofit Center for Election Innovation & Research. “Whether accurate or not, the impression among election officials is that the effort the Department of Justice launched with great fanfare a year ago isn’t getting the job done.”The Brennan Center report in March found that more than half the threats against election officials who were polled had gone unreported, and that a vast majority of threats were forwarded to local law enforcement agencies, not state or federal law enforcement.Four in 10 election officials said they had never heard of the task force. And while the Justice Department has increased outreach to election officials and publicized a hotline that can be used to report complaints, “there is really very little detail about what happens when complaints are made,” said Lawrence Norden, the senior director of the center’s Elections and Government Program.“Election officials rightly feel that public repercussions for these threats are going to be critical to curtailing them,” he said. But, so far, there have been too few court cases to provide any sense that offenders will be held accountable.Until that changes — if it does — election officials need more reassurance that law enforcement has their back, he and others said.“You have a lot more election officials who are exercising their Second Amendment rights than before 2020,” said Mr. Crane, the head of the Colorado clerks association. “It only takes one of these crazy people to show up at your doorstep.” More

    Harassed and Harangued, Poll Workers Now Have a New Form of Defense

    Threatened by extremists and under fire by politicians, election workers now have their own legal defense network. It’s a perk they never expected to need.WASHINGTON — It is perhaps a metaphor for the times that even the volunteer who checked you into the polls in November now has a legal defense committee.The Election Official Legal Defense Network, which made its public debut on Sept. 7, offers to represent more than just poll workers, of course. Formed to counter the waves of political pressure and public bullying that election workers have faced in the last year, the organization pledges free legal services to anyone involved in the voting process, from secretaries of state to local election officials and volunteers.The group already has received inquiries from several election officials, said David J. Becker, the executive director of the nonprofit Center for Election Innovation and Research, which oversees the project. Without getting into details, Mr. Becker said their queries were “related to issues like harassment and intimidation.”The network is the creation of two powerhouses in Republican and Democratic legal circles, Benjamin L. Ginsberg and Bob Bauer. In a Washington Post opinion piece this month, the two — Mr. Ginsberg was a premier G.O.P. lawyer for 38 years and Mr. Bauer was both a Democratic Party lawyer and White House counsel in the Obama administration — wrote that such attacks on people “overseeing the counting and casting of ballots on an independent, nonpartisan basis are destructive to our democracy.”“If such attacks go unaddressed, our system of self-governance will suffer long-term damage,” they said.Mr. Ginsberg, who has broken with his party and become a scathing critic of former President Donald J. Trump’s false claims the 2020 election was stolen from him, and Mr. Bauer are themselves election experts. The two men together chaired the Presidential Commission on Election Administration established by former President Barack Obama in 2013, which called — with limited success — for moderniziing election procedures and equipment to make voting easier and more secure.In an interview, Mr. Bauer said he and Mr. Ginsberg were recruiting lawyers for the Legal Defense Network, hoping to build out an organization “so in any state where this happens, we’re in a position to provide election officials who are under siege with legal support.” Dozens already have signed on to the effort, with many more anticipated to join them soon, Mr. Becker said.The center is nonpartisan, offering to represent election workers of any political bent, whether they work in a red district or a blue one. But as the announcement by Mr. Ginsburg and Mr. Bauer implicitly noted, the problems confronting election workers ballooned only after the 2020 general election, and have come almost entirely from conservative supporters of Mr. Trump and legislators in Republican-controlled states.One third of election workers say they feel unsafe in their jobs, according to a survey released this summer by the Bipartisan Policy Center and the Brennan Center for Justice at New York University. In Colorado, Arizona, Michigan, Georgia and other states, ardent believers in Mr. Trump’s stolen-election lies have threatened state and local election officials and their families with violence and even death.
