    The Charges That Were Notably Absent From the Trump Indictment

    An indictment this week did not accuse former President Donald Trump of inciting the mob that attacked the Capitol, but it did show that some close to him knew violence might be coming.There was something noticeably absent when the special counsel, Jack Smith, unsealed an indictment this week charging former President Donald J. Trump with multiple conspiracies to overturn the 2020 election: any count that directly accused Mr. Trump of being responsible for the violence his supporters committed at the Capitol on Jan. 6, 2021.The indictment asserted that as violence erupted that day, Mr. Trump “exploited the disruption,” using it to further his goal of stopping the certification of his loss in the election. But it stopped short of charging him with actually encouraging or inciting the mob that stormed the building, chasing lawmakers from their duties.Still, the charging document, filed in Federal District Court in Washington, made abundantly clear that a group of aides and lawyers surrounding Mr. Trump were highly aware that he was playing with fire by pushing forward with his plan to pressure his vice president, Mike Pence, to throw the election his way during the congressional proceeding on Jan. 6.While some of the aides and lawyers were aghast by what might, and ultimately did, take place, others seemed unconcerned, especially those who were later named as Mr. Trump’s co-conspirators in the case.In one scene described in the indictment, a senior adviser to Mr. Trump warned the lawyer John Eastman just days before the Capitol was attacked that his plan to have Mr. Trump strong-arm Mr. Pence was “going to cause riots in the streets.”According to the indictment, Mr. Eastman “responded that there had previously been points in the nation’s history where violence was necessary to protect the republic.”More than 1,000 people have been charged so far with taking part in the Capitol attack, which caused millions of dollars’ worth of damage and injuries to more than 100 police officers. Among those accused are nearly 350 defendants charged with assaulting the police and 10 members of the Proud Boys and the Oath Keepers militia who were convicted at trial of seditious conspiracy, a crime that requires showing that physical force was used against the government.In December, the House select committee investigating Jan. 6 recommended that the Justice Department charge Mr. Trump with several federal crimes, including inciting insurrection — a count that would have directly placed the blame for the attack on Mr. Trump’s shoulders. But Mr. Smith’s prosecutors did not include that charge in the indictment.Instead, they focused on counts that detailed Mr. Trump’s wide-ranging machinations to remain in power in the weeks leading up to the attack and on how he took his time in issuing a plea for calm to his supporters once the attack was underway.At a news conference announcing the charges, Mr. Smith asserted that the assault on the Capitol was “fueled by lies,” but over the course of its 45 pages, the indictment itself never quite makes that accusation directly against Mr. Trump.And yet the charges did lay out how Mr. Eastman, who is identified in the indictment only as Co-Conspirator 2, and Jeffrey Clark, a loyalist in Mr. Trump’s Justice Department who appears as Co-Conspirator 4, understood and even accepted that violence might result from their plans to subvert the democratic process and keep Mr. Trump in the White House.Three days before the Capitol was attacked, the indictment says, a deputy White House counsel told Mr. Clark that there had been no voting fraud sufficient to change the results of the election and that if Mr. Trump nonetheless maintained his grip on power, there would be “riots in every major city in the United States.”Mr. Clark’s response, according to the indictment, was to bring up a federal law that allows the president to summon the military to quell domestic unrest.“That’s why there’s an Insurrection Act,” he said.For reasons that remain unknown, prosecutors chose not to include in the indictment any evidence from Cassidy Hutchinson, an aide to Mr. Trump’s former chief of staff Mark Meadows. In a gripping testimony last year in front of the House Jan. 6 committee, Ms. Hutchinson described how Mr. Trump, knowing his supporters were armed and threatening violence on Jan. 6, urged them to march to Capitol anyhow — and even sought to join them.Ms. Hutchinson told the panel that Mr. Trump had demanded that security checkpoints be removed outside his rally on the Ellipse, near the White House, even though he had been warned that some in the crowd had been spotted with weapons.“They’re not here to hurt me,” she quoted Mr. Trump as saying.In theory, Mr. Smith’s team could bring new charges against Mr. Trump at almost any time, using accounts like Ms. Hutchinson’s to support an accusation that Mr. Trump played some role in encouraging the violence at the Capitol. The incitement charge recommended by the House committee is written quite broadly, making it a crime to “incite, assist with or participate in” a rebellion or an insurrection against federal laws or government authority.Prosecutors could also try to connect Mr. Trump more directly with the violence through the statements made by scores of rioters charged in the Capitol attack who have said that they were answering Mr. Trump’s call when they traveled to Washington and joined in the assault.“Hey we’re going back to Washington January 6 — Trump has called all patriots,” an Iowa woman named Deborah Sandoval wrote on Facebook on Dec. 21, 2020, two days after Mr. Trump summoned his followers to a “wild” protest in the city. “If the electors don’t elect, we will be forced into civil war.”Still, prosecutors are often wary of bringing incitement charges because they typically involve behavior like speeches or social media posts that the First Amendment protects, within limits.And Mr. Trump’s lawyers have already signaled that he intends to use a First Amendment defense against the charges he is facing.During his speech before the attack, Mr. Trump did at one point tell his followers to march on the Capitol “peacefully,” and, after the building had been stormed, he posted messages on Twitter belatedly asking people in the crowd to “remain peaceful.”But prosecutors say that even though he issued those calls, he did not ask his supporters to leave the Capitol grounds until after 6 p.m. that day. And as he made that request, the indictment said, he continued to repeat his false claims that a “sacred landslide victory” had been “viciously stripped away” from him. More

    Trump Indictment Leaves Alleged Co-Conspirators Facing Tough Choices

    The special counsel’s decision not to charge six people said to have played critical roles in the effort to keep Donald Trump in office seemed to give them a chance to cooperate with prosecutors. Some appear to be unwilling.By the time Jack Smith, the special counsel, was brought in to oversee the investigation of former President Donald J. Trump’s attempts to overturn the 2020 election, the inquiry had already focused for months on a group of lawyers close to Mr. Trump.Many showed up as subjects of interest in a seemingly unending flurry of subpoenas issued by a grand jury sitting in the case. Some were household names, others less familiar. Among them were Rudolph W. Giuliani, John Eastman, Jeffrey Clark, Kenneth Chesebro and Sidney Powell.On Tuesday, most of these same lawyers showed up again — albeit unnamed — as Mr. Trump’s co-conspirators in a federal indictment accusing him of a wide-ranging plot to remain in office despite having lost the election.The appearance of the lawyers at the center of the case suggests how important prosecutors judged them to be to the conspiracy to execute what one federal judge who considered some of the evidence called “a coup in search of a legal theory.”The lawyers’ placement at the heart of the plot while remaining uncharged — for now — raised questions about why Mr. Smith chose to bring the indictment with Mr. Trump as the sole defendant.In complex conspiracy cases, prosecutors often choose to work from the bottom up, charging subordinates with crimes to put pressure on them to cooperate against their superiors. It remains unclear precisely what Mr. Smith may be seeking to accomplish by flipping that script.Some legal experts theorized on Wednesday that by indicting Mr. Trump alone, Mr. Smith might be seeking to streamline and expedite the case ahead of the 2024 election. If the co-conspirators were indicted, that would almost certainly slow down the process, potentially with the other defendants filing motions and seeking to splinter their cases from Mr. Trump’s.“I think it’s a clean indictment to just have Donald Trump as the sole defendant,” said Soumya Dayananda, a former federal prosecutor who served as a senior investigator for the House Jan. 6 committee. “I think it makes it easier to just tell the story of what his corrupt activity was.”Another explanation could be that by indicting Mr. Trump — and leaving open the threat of other charges — Mr. Smith was delivering a message: cooperate against Mr. Trump, or end up indicted like him. By not charging them for now, Mr. Smith could be giving the co-conspirators an incentive to reach a deal with investigators and provide information about the former president.While the threat of prosecution could loom indefinitely, it is possible that the judge overseeing the case might soon ask Mr. Smith’s team to disclose whether it plans to issue a new indictment with additional defendants. And some legal experts expect additional charges to come.“It’s clearly a strategic decision not to charge them so far, because it’s out of the ordinary,” said Joyce Vance, a former U.S. attorney who is now a University of Alabama law professor. “I don’t see an advantage to giving people this culpable a pass.”That said, at least one of the co-conspirators — Mr. Giuliani — and another possible co-conspirator — Boris Epshteyn, a lawyer and strategic adviser close to Mr. Trump — have already sat with prosecutors for extended voluntary interviews. He still has the option of filing charges against any or all of the co-conspirators at more or less any time he chooses.He used that tactic in a separate case against Mr. Trump related to the former president’s mishandling of classified documents, issuing a superseding indictment last week that accused a new defendant — the property manager of Mr. Trump’s private club and residence in Florida — of being part of a conspiracy to obstruct the government’s attempts to retrieve the sensitive materials.Some of the lawyers named as Mr. Trump’s co-conspirators in the indictment filed on Tuesday have effectively acknowledged to being named in the case through their lawyers.In a statement issued Tuesday night, Robert J. Costello, a lawyer for Mr. Giuliani, said it “appears” as if the former New York City mayor were Co-Conspirator 1. The statement also leveled a blistering attack on the indictment — and a defense of Mr. Trump — suggesting that Mr. Giuliani was an unlikely candidate for cooperating against the former president.“Every fact that Mayor Giuliani possesses about this case establishes the good-faith basis President Donald Trump had for the action that he took,” Mr. Costello said.Not long after, Charles Burnham, a lawyer for Mr. Eastman, implicitly admitted his client’s role as Co-Conspirator 2 by issuing a statement “regarding United States v. She was best known during the postelection period for filing four lawsuits in key swing states claiming that a cabal of bad actors — including Chinese software companies, Venezuelan officials and the liberal financier George Soros — conspired to hack into voting machines produced by Dominion Voting Systems and flip votes from Mr. Trump to Mr. Biden.Mr. Clark is a close match to the description of Co-Conspirator 4, who is identified in the charges as a Justice Department official who worked on civil matters and plotted with Mr. Trump to use the department to “open sham election crime investigations” and “influence state legislatures with knowingly false claims of election fraud.”Against the advice of top officials at the Justice Department, Mr. Trump sought to install Mr. Clark, a high-ranking official in the department’s civil division, as the acting attorney general in the waning days of his administration after Mr. Clark agreed to support his claims of election fraud.Sidney Powell was best known during the postelection period for filing four lawsuits in key swing states claiming that a cabal of bad actors conspired to flip votes from Mr. Trump to Mr. Biden.Erin Schaff/The New York TimesMr. Clark also helped draft a letter to Gov. Brian Kemp of Georgia, a Republican, urging him to call the state legislature into a special session to create a slate of false pro-Trump electors even though the state was won by Joseph R. Biden Jr.A batch of documents obtained by The New York Times helped to identify Mr. Chesebro as Co-Conspirator 5, who is described in the indictment as a lawyer who helped to craft and implement “a plan to submit fraudulent slates of presidential electors to obstruct the certification proceeding.”The emails obtained by The Times laid out a detailed picture of how several lawyers, reporting to Mr. Giuliani, carried out the so-called fake elector plot on behalf of Mr. Trump, while keeping many of their actions obscured from the public — and even from other lawyers working for the former president.Several of these emails appeared as evidence in the indictment of Mr. Trump, including some that showed lawyers and the false electors they were seeking to recruit expressing reservations about whether the plan was honest or even legal.“We would just be sending in ‘fake’ electoral votes to Pence so that ‘someone’ in Congress can make an objection when they start counting votes, and start arguing that the ‘fake’ votes should be counted,” a lawyer based in Phoenix who helped organize the pro-Trump electors in Arizona wrote to Mr. Epshteyn on Dec. 8, 2020.In another example, Mr. Chesebro wrote to Mr. Giuliani that two electors in Arizona “are concerned it could appear treasonous.”At one point, the indictment quotes from a redacted message sent by an Arizona lawyer on Dec. 8, 2020, that reads, “I just talked to the gentleman who did that memo, [Co-Conspirator 5]. His idea is basically. …”Jeffrey Clark appears to be a close match to Co-Conspirator 4, who is described in the charges as a Justice Department official who worked on civil matters and plotted with Mr. Trump.Kenny Holston/The New York TimesAn unredacted version of that email obtained by The Times has the name “Ken Cheseboro” in the place of Co-Conspirator 5.The indictment also cites a legal memo dated Nov. 18, 2020, that proposed recruiting a group of Trump supporters who would meet and vote as purported electors for Wisconsin. The court filing describes it as having been drafted by Co-Conspirator 5. That memo, also obtained by The Times, shows it was written by Mr. Chesebro.A separate email, reviewed by The Times, gives a hint that Mr. Epshteyn could be Co-Conspirator 6.The email — bearing a subject line reading, “Attorney for Electors Memo” — was sent on Dec. 7, 2020, to Mr. Giuliani and Mr. Giuliani’s son, Andrew.“Dear Mayor,” it reads. “As discussed, below are the attorneys I would recommend for the memo on choosing electors,” adding the names of lawyers in seven states.Paragraph 57 of the indictment asserts that Co-Conspirator 1, or Mr. Giuliani, spoke with Co-Conspirator 6 about lawyers who “could assist in the fraudulent elector effort in the targeted states.”It also says that Co-Conspirator 6 sent an email to Mr. Giuliani “identifying attorneys in Arizona, Georgia, Michigan, Nevada, New Mexico, Pennsylvania and Wisconsin” — the same seven states mentioned in the email reviewed by The Times.Maggie Haberman More

    Far Right Pushes a Through-the-Looking-Glass Narrative on Jan. 6

    An ecosystem of true believers is promoting a tale of persecution rather than prosecution that has migrated to the heart of presidential politics.Six months since the House committee investigating the Jan. 6, 2021, assault on the Capitol completed its work, a far-right ecosystem of true believers has embraced “J6” as the animating force of their lives.They attend the criminal trials of the more prominent rioters charged in the attack. They gather to pray and sing “The Star-Spangled Banner” on the outer perimeter of the District of Columbia jail, where some two dozen defendants are held. Last week, dozens showed up at an unofficial House hearing convened by a handful of Republican lawmakers to challenge “the fake narrative that an insurrection had occurred on Jan. 6,” as set forth by Jeffrey Clark, a witness at the hearing and a former Justice Department official who worked to undo the results of the 2020 election.The 90-minute event was a through-the-looking-glass alternative to the damning case against former President Donald J. Trump presented last year by the Jan. 6 committee. In the version advanced by five House Republicans who attended the hearing — Matt Gaetz, Paul Gosar, Ralph Norman, Marjorie Taylor Greene and Troy Nehls — as well as conservative lawyers and Capitol riot defendants, Jan. 6 was an elaborate setup to entrap peaceful Trump supporters, followed by a continuing Biden administration campaign to imprison and torment innocent conservatives.Writ large, their loudest-in-the-room tale of persecution rather than prosecution might be dismissed as fringe nonsense had it not migrated so swiftly to the heart of presidential politics. Mr. Trump has pledged to pardon some of the Jan. 6 defendants if he returns to the White House, and his chief challenger for the 2024 Republican nomination, Gov. Ron DeSantis of Florida, has signaled he may do the same.Representatives Matt Gaetz and Lauren Boebert, both Republicans, were among the members of Congress who held a hearing criticizing the Jan. 6 prosecutions.Kenny Holston/The New York TimesMore than half, or 58 percent, of self-described conservatives say that Jan. 6 was an act of “legitimate political discourse” rather than a “violent insurrection,” according to a poll three months ago by The Economist/YouGov.The counternarrative is in part animated by a series of particularly stiff sentences for the Jan. 6 defendants, including one of more than 12 years in prison handed down on Wednesday for a rioter who savagely assaulted a D.C. police officer, Michael Fanone.The audience for the hearing in the Capitol Visitor Center included several of the most avid and successful promoters of the Jan. 6 counternarrative.Among them were Micki Witthoeft, the mother of Ashli Babbitt, the Air Force veteran and QAnon adherent who was fatally shot by a Capitol police officer during the riot and is now heralded as a martyr by the far right; Nicole Reffitt, whose husband, Guy Reffitt, was sentenced to more than seven years in prison for his role in the riot and who now helps organize nightly vigils at the D.C. jail; Tayler Hansen, who has claimed to possess videotaped evidence of antifa elements instigating the violence at the Capitol, but who did not respond to a request from The New York Times to view the footage; and Tommy Tatum of Mississippi, who describes himself as an independent journalist and has inferred from various unidentified characters who appear in his own footage that sophisticated teams of plainclothes federal agents orchestrated the breach of the Capitol.The Jan. 6 deniers range from true believers to flighty opportunists, with fevered arguments among them as to who is which. Mr. Tatum and William Shipley, a lawyer who has represented more than 30 Jan. 6 defendants, have for example accused each other on Twitter of cynical profiteering.Micki Witthoeft, whose daughter, Ashli Babbitt, was fatally shot during the riot, attended the hearing at the Capitol Visitor Center.Kenny Holston/The New York TimesOne generally admired within the group is Julie Kelly, a former Illinois Republican political consultant, cooking class teacher and pandemic lockdown critic who writes for the conservative website American Greatness. Ms. Kelly has asserted that the Biden administration is “on a destructive crusade to exact revenge against supporters of Donald Trump” and has accused Mr. Fanone, who was beaten unconscious by the rioters at the Capitol, of being a “crisis actor.” She was a frequent guest on Tucker Carlson’s prime-time show before Fox fired him in April.Last month, aides to Speaker Kevin McCarthy gave Ms. Kelly and two other conservative writers, John Solomon of Just the News and Joseph M. Hanneman of The Epoch Times, permission to ferret through the Capitol’s voluminous Jan. 6 security footage, the only journalists other than Mr. Carlson to obtain such access.In an interview the day before the House hearing, Ms. Kelly said she was scouring the video in hopes of learning the provenance of the infamous gallows that were seen on the Capitol grounds on Jan. 6. “Did Trump supporters go there and build that? I doubt it,” she said. Ms. Kelly also hopes to learn whether nefarious “agitators” were already inside the Capitol before the breach. She variously termed Jan. 6 “an inside job” and a “fed-surrection.”Ms. Kelly recounted a meeting she and a fellow supporter of Jan. 6 defendants, Cynthia Hughes, had last September with Mr. Trump at his golf club in Bedminster, N.J. She said she told the former president that the defendants felt abandoned by him: “They’re saying to me: ‘We were there for him. Why isn’t he here for us?’” Ms. Hughes informed Mr. Trump that the federal judges he appointed were “among the worst” when it came to the treatment of the riot defendants.Surprised, Mr. Trump replied, “Well, I got recommendations from the Federalist Society.” Ms. Kelly said he then asked, “What do you want me to do?” She replied that he could donate to Ms. Hughes’s organization, the Patriot Freedom Project, which offers financial support to the defendants. Mr. Trump’s Save America PAC subsequently gave $10,000 to the group.Former President Donald J. Trump has pledged to pardon some of the Jan. 6 defendants if he returns to the White House.Doug Mills/The New York TimesOthers in the ecosystem contend that Mr. Trump’s contribution to the cause is manifest by the slings and arrows he has himself suffered since that day. “I call him Jan. Sixth-er Number One,” said Joseph D. McBride, perhaps the most visible of the lawyers representing the defendants. “He’s under the gun. He’s being investigated and indicted.”Mr. McBride’s clients include Richard Barnett, who posed for a photograph with his foot on Speaker Nancy Pelosi’s desk, as well as Ryan Nichols, who exhorted fellow protesters to target elected officials, yelling, “Cut their heads off!”Mr. McBride also represented two Stop the Steal rally organizers subpoenaed by the Jan. 6 committee, Ali Alexander and Alex Bruesewitz. It was Mr. Bruesewitz who introduced Mr. McBride to Donald Trump Jr., which led to several invitations to Mar-a-Lago, Mr. Trump’s club in Palm Beach, Fla.“I’ve lost count at this point,” Mr. McBride said, adding that the club “is a good place to network.”Mr. McBride was also a frequent guest on Mr. Carlson’s show, including the time he claimed that a mysterious man seen at the Capitol on Jan. 6 with his face obscured in red paint was “clearly a law enforcement officer.” Shown evidence later that week by a HuffPost reporter that the man was a well-known habitué of St. Louis Cardinals baseball games, Mr. McBride replied: “If I’m wrong, so be it, bro. I don’t care.”He did acknowledge a certain dubiousness to the claim that the mostly white male conservatives who showed up at the Capitol on Jan. 6 had the judicial deck stacked against them.“Pre-Jan. 6, anytime you heard the term ‘two-tier system of justice,’ it’s Blacks, it’s Latinos, it’s the infringed, it’s the poor, it’s the drug addicted, it’s the marginalized, it’s the L.G.B.T.Q. community,” he said. Mr. McBride and the others are raising “unfortunately a fact of life for over two million Americans who are behind bars,” said Ms. Rahman, who has visited the D.C. jail several times and concurs that its conditions are inhumane, though no worse, she said, than detention facilities in Chicago, Los Angeles and Houston.Still, she said, the privileges afforded the Jan. 6 pretrial detainees in their particular wing — individual cells, a library, contact visits, the ability to participate in podcasts — “are not at all typical.”“But I don’t want to call that special treatment,” Ms. Rahman said. “That’s the floor for what every incarcerated person in America should have a right to expect.”For now, the protagonists of the alternative Jan. 6 narrative are not particularly focused on prison reform. Nor are they willing to give up.As Mr. McBride said: “Do I think we’ll ever get to the bottom of it? We still haven’t solved the J.F.K. assassination.” More

    It’s Time to Prepare for a Possible Trump Indictment

    “We find by unanimous vote that no widespread fraud took place in the Georgia 2020 presidential election that could result in overturning that election.” With those words, a Fulton County special grand jury’s report, part of which was released Thursday, repudiated Donald Trump’s assault on our democracy.The excerpts from the report did not explicitly offer new detail on a potential indictment of Mr. Trump or any other individual. But they suggest that, combined with everything else we know, Mr. Trump may very well be headed for charges in Georgia.We need to prepare for a first in our 246-year history as a nation: The possible criminal prosecution of a former president.If Mr. Trump is charged, it will be difficult and at times even perilous for American democracy — but it is necessary to deter him and others from future attempted coups.Fani Willis, the Fulton County district attorney, may present the case as a simple and streamlined one or in a more sweeping fashion. Success is more likely assured in the simpler approach, but the fact that the redacted report has eight sections suggests a broader approach is conceivable. In either event, we must all prepare ourselves for what could be years of drama, with the pretrial, trial and appeal likely dominating the coming election season.Ms. Willis opened her investigation shortly after Mr. Trump’s Jan. 2, 2021, demand that the Georgia secretary of state, Brad Raffensperger, “find 11,780 votes.” The second impeachment of Mr. Trump and the Jan. 6 committee hearings developed additional evidence about that request for fake votes and Mr. Trump and allies pushing fake electors in Georgia and nationally. There is now abundant evidence suggesting he violated Georgia statutes, like those criminalizing the solicitation of election fraud.The parts of the special grand jury’s report revealed on Thursday only reinforce Mr. Trump’s risk of prosecution. The statement that the grand jurors found “no widespread fraud” in the presidential election eliminates Mr. Trump’s assertion that voter fraud justified his pushing state election officials. We also know that the grand jurors voted defendant by defendant and juror by juror, and set forth their recommendations on indictments and relevant statutes over seven (currently redacted) sections. The likelihood that they did that and cleared everyone is very low. And the fact that the grand jurors felt so strongly about the issues that they insisted on writing the recommendations themselves, as they emphasize, further suggests a grave purpose.Also notable is the grand jury’s recommendation of indictments, “where the evidence is compelling,” for perjury that may have been committed by one or more witnesses. It seems unlikely that Ms. Willis will let that pass.She will now decide the next steps of the case. Her statement that charging decisions were imminent came more than three weeks ago. If she does indict Mr. Trump, the two likely paths that she might take focus on the fake electoral slates and Mr. Trump’s call to Mr. Raffensperger. One is a narrower case that would likely take weeks to try; the other is a broader case that would likely take months.Narrow charges could include the Georgia felonies of solicitation of election fraud in the first degree and related general crimes like conspiracy to commit election fraud, specifically focusing on events and people who have a strong nexus with Georgia. In addition to Mr. Trump, that might include others who had direct contacts with Georgia, like his former chief of staff Mark Meadows and his attorneys John C. Eastman and Rudolph W. Giuliani (who already received a “target” notification from Ms. Willis warning him that he may be charged). Such a case would focus on activities around the execution of the fake electoral slates on Dec. 14, 2020, followed by the conversation with Mr. Raffensperger on Jan. 2, rooting it in Georgia and avoiding events nationally except to the extent absolutely necessary.Or Ms. Willis could charge the case more broadly, adding sweeping state Racketeer Influenced and Corrupt Organizations, or RICO, charges that could still include the impact of the conduct in Georgia but bring in more of a nationwide conspiracy. This would look more like the Jan. 6 investigation, albeit with a strong Georgia flavor. It could additionally include those who appeared to have lesser contact with Georgia but were part of national efforts including the state, like the Trump campaign attorney Kenneth Chesebro and the Justice Department official Jeffrey Clark.A more narrow case might make slightly more sense: Given the extraordinary circumstances around it, Ms. Willis will surely have her hands full. And it will feature a likely lead defendant who has demonstrated his propensity for legal circuses — coming in the midst of a heated political season no less.That said, Ms. Willis has a proven propensity for bringing and winning RICO cases. And as we have learned in our criminal trial work, sometimes juries are more responsive to grander narratives that command their attention — and outrage.Whether it’s simple or broad, if a case is opened, one thing is nearly certain: It’s going to take a while, probably the better part of the next two years, and perhaps longer. We would surely see a flurry of legal filings from Mr. Trump, which while often meritless nevertheless take time. Here the battle would likely be waged around pretrial motions and appeals by Mr. Trump arguing, as he has done in other cases, that he was acting in his official presidential capacity and so is immune.That challenge, though not persuasive at all in our view, will almost certainly delay a trial by months. Other likely sallies are that the case should be removed to federal court (it shouldn’t); that he relied on the advice of counsel in good faith (he didn’t); or that his action was protected by the First Amendment (it wasn’t).Even if the courts work at the relatively rapid pace of other high-profile presidential cases, we would still be talking about months of delay. In both U.S. v. Nixon and Thompson v. Trump, about three months were consumed from the first filing of the cases to the final rejection of presidential arguments by the U.S. Supreme Court. In this case, there would be more issues, which would be likely to require additional time. At the earliest, Ms. Willis would be looking at a trial toward the end of 2023. Even on that aggressive schedule, appeals would not be concluded until the end of 2024 or beyond.Needless to say, this would have a profound impact on the election season. It would feature a national conversation about what it means for a former president to be prosecuted, and it would no doubt have unexpected consequences.Still, the debate is worth having, and the risks are worth taking. The core American idea is that no one is above the law. If there is serious evidence of crimes, then a former president should face the same consequences as anyone else.     Jan. 6 Panel Accuses Trump of Insurrection and Refers Him to Justice Dept.

    WASHINGTON — The House committee investigating the Jan. 6 attack on the Capitol accused former President Donald J. Trump on Monday of inciting insurrection, conspiracy to defraud the United States, obstruction of an act of Congress and one other federal crime as it referred him to the Justice Department for potential prosecution.The action, the first time in American history that Congress has referred a former president for criminal prosecution, is the coda to the committee’s 18-month investigation into Mr. Trump’s effort to overturn the 2020 election that culminated in a violent mob of the former president’s supporters laying siege to the Capitol.The criminal referrals were a major escalation for a congressional investigation that is the most significant in a generation. The panel named five other Trump allies — Mark Meadows, his final chief of staff, and the lawyers Rudolph W. Giuliani, John Eastman, Jeffrey Clark and Kenneth Chesebro — as potential co-conspirators with Mr. Trump in actions the committee said warranted Justice Department investigation. The charges, including a fourth for Mr. Trump of conspiracy to make a false statement, would carry prison sentences, some of them lengthy, if federal prosecutors chose to pursue them.The committee’s referrals do not carry legal weight or compel any action by the Justice Department, which is conducting its own investigation into Jan. 6 and the actions of Mr. Trump and his allies leading up to the attack. But the referrals sent a powerful signal that a bipartisan committee of Congress believes the former president committed crimes.A Justice Department spokesman declined to comment on the referrals.Mr. Trump attacked the committee as “highly partisan” ahead of a final meeting the panel held on Monday to release an executive summary of its final report on the Capitol attack and to vote on referring the former president to the Justice Department.“It’s a kangaroo court,” Mr. Trump said Monday on “The Dan Bongino Show.” “The people aren’t going to stand for it.” He elaborated on that theme in a post on Truth Social, his social media network, after the meeting.“These folks don’t get it that when they come after me, people who love freedom rally around me. It strengthens me,” he said, adding that he “told everyone to go home” on Jan. 6, but leaving out his hours of inaction before that while a mob of his supporters rampaged through the Capitol.Republicans, who have vowed to investigate the committee after they take control of the House in January, mounted a modest response. Representative Elise Stefanik of New York, the No. 3 House Republican, was one of the few to react with a statement, accusing the committee of staging a “partisan charade.” She promised that Republicans “will hold House Democrats accountable for their illegitimate abuse of power.”The executive summary, a 154-page narrative of Mr. Trump’s relentless drive to remain in power after he lost the 2020 election by seven million votes, identifies co-conspirators who aided Mr. Trump. President Biden has indicated his intent to run in 2024, and Mr. Trump announced his re-election campaign last month.The summary laid out step by step how Mr. Trump sought to cling to power, much as the committee did during its televised hearings in the summer. First, the summary said, Mr. Trump lied about widespread fraud, despite being told his claims were false. He then organized false slates of electors in states won by Mr. Biden as he pressured state officials, the Justice Department and Vice President Mike Pence to overturn the election. Finally, he amassed a mob of his supporters to march on the Capitol, where they engaged in hours of bloody violence while Mr. Trump did nothing to call them off.“Even key individuals who worked closely with President Trump to try to overturn the 2020 election on Jan. 6 ultimately admitted that they lacked actual evidence sufficient to change the election result, and they admitted that what they were attempting was unlawful,” the committee wrote.“Every president in our history has defended this orderly transfer of authority, except one,” said Representative Liz Cheney, Republican of Wyoming.Haiyun Jiang/The New York TimesThe panel also referred four Republican members of Congress to the House Ethics Committee — including the man seeking to become the next speaker, Representative Kevin McCarthy of California — because of their refusal to comply with the panel’s subpoenas.Mr. McCarthy’s office did not respond to a request for comment.The other Republicans referred were Representatives Jim Jordan of Ohio, Scott Perry of Pennsylvania and Andy Biggs of Arizona.A spokesman for Mr. Jordan, Russell Dye, said in a statement that the referral was “just another partisan and political stunt.” A spokesman for Mr. Perry, Jay Ostrich, said the committee was engaged in “more games from a petulant and soon-to-be kangaroo court.’’Mr. Biggs said in a tweet that the referral was the committee’s “final political stunt” and that he looked forward to “reviewing their documents, publishing their lies and setting the record straight” in the next Congress.In its summary, the committee did not entirely resolve disputed accounts of what happened inside the presidential S.U.V. when Mr. Trump was told by his Secret Service agents that they could not take him to the Capitol to join the crowd on Jan. 6. Cassidy Hutchinson, a former White House aide, testified under oath to the committee in public last summer that Anthony M. Ornato, a White House deputy chief of staff, told her that Mr. Trump grew so angry that he lunged at his Secret Service agent and tried to grab the steering wheel. The Secret Service denied that account anonymously.The summary said only that the “committee has now obtained evidence from several sources about a ‘furious interaction’” that occurred in the S.U.V. “The vast majority of witnesses who have testified to the select committee about this topic, including multiple members of the Secret Service, a member of the Metropolitan Police and national security officials in the White House, described President Trump’s behavior as ‘irate,’ ‘furious,’ ‘insistent,’ ‘profane’ and ‘heated.’”The committee’s summary also concluded that there was no nefarious reason for why the National Guard was delayed for hours in responding to violence of Jan. 6.“Although evidence identifies a likely miscommunication between members of the civilian leadership in the Department of Defense impacting the timing of deployment, the committee has found no evidence that the Department of Defense intentionally delayed deployment of the National Guard,” the committee wrote. “The select committee recognizes that some at the department had genuine concerns, counseling caution, that President Trump might give an illegal order to use the military in support of his efforts to overturn the election.”In its summary, the panel asked the Justice Department to investigate whether anyone had interfered with or obstructed the panel’s investigation, including whether any lawyers paid for by groups connected to Mr. Trump “may have advised clients to provide false or misleading testimony to the committee.”Among the committee’s findings, revealed at its meeting on Monday, was that lawmakers became concerned that lawyers who were paid by Trump associates may have tried to interfere with the panel’s investigation. The panel also learned that a client was offered potential employment that would make her “financially very comfortable” as the date of her testimony approached. But then offers were withdrawn or did not materialize as reports of the content of her testimony circulated, the committee said.The committee also chastised certain witnesses that it said had not been forthright with investigators. It said it had “significant concerns about the credibility” of the testimony of Mr. Ornato.The committee also said Kayleigh McEnany, one of Mr. Trump’s former press secretaries, and Ivanka Trump, the president’s elder daughter, had been less than forthcoming.The summary demonstrated, as the committee’s hearings did, how despite being told repeatedly that his claims of election fraud were false, Mr. Trump kept up the lies.Bill Stepien, a former White House political director, told the committee how he and others would investigate the claims, find them to be false, and report back to the president. “It’s an easier job to be telling the president about, you know, wild allegations,” Mr. Stepien said. “It’s a harder job to be telling him on the back end that, yeah, that wasn’t true.”The summary also contained evidence that certain White House aides had grown concerned about the potential for violence on Jan. 6 and urged Mr. Trump to make a pre-emptive statement calling for peace. No such statement was made.Hope Hicks, a former White House communications director, said she suggested “several times” on Jan. 4 and 5 that Mr. Trump “publicly state that Jan. 6 must remain peaceful, and that he had refused her advice to do so,” the panel wrote.The panel played new video from Ms. Hicks, who described a conversation with Mr. Trump.“I was becoming increasingly concerned that we were damaging his legacy,” Ms. Hicks said she told the president.Mr. Trump’s response? “Nobody will care about my legacy if I lose, so that won’t matter. The only thing that matters is winning,” she recalled him saying.Supporters of Mr. Trump confronting Capitol Police officers outside the Senate chamber on Jan. 6, 2021.Erin Schaff/The New York TimesWhile the executive summary of the report focused heavily on Mr. Trump, it did conclude some findings about law enforcement failures, a topic not previously addressed at the panel’s hearings. “No analysis recognized the full scale and extent of the threat to the Capitol on Jan. 6,” the committee wrote, although the “intelligence community and law enforcement agencies did successfully detect the planning for potential violence on Jan. 6, including planning specifically by the Proud Boys and Oath Keeper militia groups who ultimately led the attack on the Capitol.”Over the past year and a half, the committee interviewed more than 1,000 witnesses, obtained more than one million documents, issued more than 100 subpoenas and held hearings that drew millions of viewers.The House created the Jan. 6 committee after Senate Republicans used a filibuster to defeat a proposal to create an independent commission to investigate the attack.The committee — made up of seven Democrats and two Republicans — consistently broke new ground for a congressional investigation. Staffed with more than a dozen former federal prosecutors, the panel set a new production standard for how to hold a congressional hearing. It also got significantly ahead of a parallel Justice Department investigation into the events of Jan. 6, with federal prosecutors later interviewing many of the same witnesses Congress had spoken to.In recent weeks, federal prosecutors under the supervision of a special counsel have issued subpoenas to officials in seven states in which the Trump campaign organized electors to falsely certify the election for Mr. Trump despite the voters choosing Mr. Biden.Lawmakers on the panel also believe they played a significant role in elevating the issue of threats to democracy to voters, who rejected many election deniers in the November midterms.In terms of legislative recommendations, the panel has already endorsed overhauling the Electoral Count Act, the law that Mr. Trump and his allies tried to exploit on Jan. 6 in an attempt to cling to power. Lawmakers have also discussed changes to the Insurrection Act and legislation to enforce the 14th Amendment’s prohibition on insurrectionists holding office.     Justice Dept. Examines Emails from Trump Lawyers in Fake Elector Inquiry

    Prosecutors have combed through more than 100,000 documents from John Eastman, Jeffrey Clark and Ken Klukowski, who played roles in the effort to reverse the outcome of the 2020 election.Federal prosecutors have examined more than 100,000 documents seized from the email accounts of three lawyers associated with former President Donald J. Trump in a continuing investigation into the roles they played in a wide-ranging scheme to help Mr. Trump overturn the results of the 2020 election, according to court papers released on Friday.The material came from email accounts belonging to John Eastman, who helped devise and promote a plan to create fake slates of pro-Trump electors in states that were actually won by Joseph R. Biden Jr., and two former Justice Department lawyers, Jeffrey Clark and Ken Klukowski, who have faced scrutiny for their own roles in the fake electors scheme, the papers say.As part of their inquiry, federal investigators in Washington obtained a search warrant for the three men’s email accounts in May and the following month seized their cellphones and other electronic devices. The court papers, unsealed by Beryl A. Howell, the chief judge in Federal District Court in Washington, revealed for the first time the extent of the emails that investigators had obtained.The court papers, which emerged from a behind-the-scenes review of the material for any that might be protected by attorney-client privilege, said little about the contents of the emails. But they noted that each of the men was in contact with a leader of the far-right House Freedom Caucus, Representative Scott Perry, Republican of Pennsylvania, whose own phone was seized in August as part of the investigation into the fake elector scheme.Reviewing seized materials for any that might be privileged is a common step in criminal investigations — especially in sensitive ones targeting lawyers. The effort to send the letter was cut short by Mr. Clark’s superiors.Mr. Klukowski, who briefly served under Mr. Clark at the Justice Department and had earlier worked at the White House budget office, helped Mr. Clark draft the letter to state officials in Georgia. While working at the department, he was also in contact with Mr. Eastman, according to evidence presented by the Jan. 6 House committee.According to the newly unsealed papers, Mr. Klukowski sent Mr. Perry an email eight days after the election with a document attached titled “Electors Clause/The Legislature Option.” The document outlined an argument central to the fake elector scheme — namely, that “the Constitution makes state legislatures the final authority on presidential elections,” the court papers said.Mr. Eastman’s emails to Mr. Perry suggest that the two men traded phone calls in the weeks leading up to Jan. 6. The court papers note that Mr. Clark exchanged several emails with Mr. Perry in February 2021, after the Capitol was stormed, but the descriptions of their contents were redacted.The papers also say that investigators found a draft of Mr. Clark’s autobiography in his emails, tracing his life from “growing up deplorable in Philadelphia” to working in the Justice Department. An outlined portion of the draft provides a “detailed description” of a previously disclosed meeting that Mr. Clark had on Jan. 3, 2021, with Mr. Trump and two top Justice Department officials at which they “discussed Clark’s draft letter” to the officials in Georgia.     F.B.I. Seizure of Scott Perry’s Phone Is Sign of Escalating Election Inquiry

    Representative Scott Perry’s lawyer said he was told he is not a target of the Justice Department’s expanding inquiry into one element of the effort to keep Donald J. Trump in power after his loss in 2020.The F.B.I.’s seizure of Representative Scott Perry’s phone this week was at least the third major action in recent months taken in connection with an escalating federal investigation into efforts by several close allies of former President Donald J. Trump to overturn the 2020 election, according to two people familiar with the matter.The inquiry, which was begun last year by the Justice Department’s inspector general’s office, has already ensnared Jeffrey Clark, a former department official whom Mr. Trump wanted to install atop the agency to help him press his baseless claims of election fraud, and John Eastman, an outside lawyer who advised Mr. Trump on brazen proposals to overturn the vote result.In June, federal agents acting on search warrants from the inspector general’s office seized phones and other electronic devices from Mr. Clark and Mr. Eastman. That same tactic was used on Tuesday to seize the phone of Mr. Perry, a Republican of Pennsylvania.While the inspector general’s office had initial jurisdiction in the probe because Mr. Clark was an employee of the department, there have been signs in recent days that the investigation is increasingly being run by prosecutors from the U.S. attorney’s office in Washington. One of those prosecutors, Thomas P. Windom, is in charge of a broad investigation of a plan by Mr. Trump and his allies to create fake slates of electors to the Electoral College in states that were actually won by Joseph R. Biden Jr.It remains unclear exactly how — or even if — the inquiry into Mr. Perry, Mr. Clark and Mr. Eastman is entwined with the broader investigation. In that inquiry, prosecutors are seeking to determine whether a group of Mr. Trump’s lawyers and several of his allies in state legislatures and state Republican parties broke the law by creating pro-Trump slates of electors in states he did not win and later by using them to disrupt a joint session of Congress on Jan. 6, 2021, where the final results of the election were certified.Mr. Clark, Mr. Eastman and Mr. Perry all played roles in the effort to keep Mr. Trump in office, according to extensive evidence gathered by the Senate Judiciary Committee and the House select committee that is looking into the events of Jan. 6. Brian Kemp of Georgia falsely claiming that the Justice Department had evidence that the vote results in the state might have been marred by fraud. The letter, which was never sent, advised Mr. Kemp, a Republican, to rectify the problem by calling a special session of his state’s General Assembly to create “a separate slate of electors supporting Donald J. Trump.”Mr. Perry was instrumental in pushing Mr. Trump to appoint Mr. Clark as his acting attorney general over the objections of several other top officials at the Justice Department. At one of its presentations, the House committee released text messages in which Mr. Perry repeatedly pressured Mark Meadows, then Mr. Trump’s chief of staff, to reach out to Mr. Clark.The House committee issued a subpoena to Mr. Perry in May, but he declined to comply with it.     The plan to reverse the outcome of the 2020 election by creating slates of electors pledged to Donald Trump in states he had lost was expansive, long-running and often confusing.The brazen plan to create false slates of electors pledged to former President Donald J. Trump in seven swing states that were actually won by Joseph R. Biden Jr. was arguably the longest-running and most expansive of the multiple efforts by Mr. Trump and his allies to overturn the results of the 2020 election.It was also one of the most confusing, involving a sprawling cast of pro-Trump lawyers, state Republican officials and White House aides in an effort that began before some states had even finished counting their ballots. It culminated in the campaign to pressure Vice President Mike Pence to use the false slates to subvert congressional certification of the outcome on Jan. 6, 2021 — and in the violent attack on the Capitol that unfolded as he refused to do so.The scheme had a vague historical precedent and was rooted, at least in theory, in a post-Reconstruction Era law designed to address how to handle disputed elections. But it was deemed illegal by Mr. Trump’s own White House Counsel’s Office. Kennedy and Vice President Richard M. Nixon.The results of the vote count in Hawaii remained in dispute — by about 100 ballots — even as a crucial deadline for the Electoral College to meet and cast its votes drew near.
