    Conservative Case Emerges to Disqualify Trump for Role on Jan. 6

    Two law professors active in the Federalist Society wrote that the original meaning of the 14th Amendment makes Donald Trump ineligible to hold government office.Two prominent conservative law professors have concluded that Donald J. Trump is ineligible to be president under a provision of the Constitution that bars people who have engaged in an insurrection from holding government office. The professors are active members of the Federalist Society, the conservative legal group, and proponents of originalism, the method of interpretation that seeks to determine the Constitution’s original meaning.The professors — William Baude of the University of Chicago and Michael Stokes Paulsen of the University of St. Thomas — studied the question for more than a year and detailed their findings in a long article to be published next year in The University of Pennsylvania Law Review.“When we started out, neither of us was sure what the answer was,” Professor Baude said. “People were talking about this provision of the Constitution. We thought: ‘We’re constitutional scholars, and this is an important constitutional question. We ought to figure out what’s really going on here.’ And the more we dug into it, the more we realized that we had something to add.”He summarized the article’s conclusion: “Donald Trump cannot be president — cannot run for president, cannot become president, cannot hold office — unless two-thirds of Congress decides to grant him amnesty for his conduct on Jan. 6.”A law review article will not, of course, change the reality that Mr. Trump is the Republican front-runner and that voters remain free to assess whether his conduct was blameworthy. But the scope and depth of the article may encourage and undergird lawsuits from other candidates and ordinary voters arguing that the Constitution makes him ineligible for office.“There are many ways that this could become a lawsuit presenting a vital constitutional issue that potentially the Supreme Court would want to hear and decide,” Professor Paulsen said.Mr. Trump has already been indicted twice in federal court, in connection with his efforts to overturn the 2020 election and his retention of classified documents. He is also facing charges relating to hush money payments in New York and may soon be indicted in Georgia in a second election case.Those cases could give rise to prison time or other criminal punishment. The provision examined in the new article concerns a different question: whether Mr. Trump is eligible to hold office.There is, the article said, “abundant evidence” that Mr. Trump engaged in an insurrection, including by setting out to overturn the result of the 2020 presidential election, trying to alter vote counts by fraud and intimidation, encouraging bogus slates of competing electors, pressuring the vice president to violate the Constitution, calling for the march on the Capitol and remaining silent for hours during the attack itself.“It is unquestionably fair to say that Trump ‘engaged in’ the Jan. 6 insurrection through both his actions and his inaction,” the article said.Steven G. Calabresi, a law professor at Northwestern and Yale and a founder of the Federalist Society, called the article “a tour de force.”But James Bopp Jr., who has represented House members whose candidacies were challenged under the provision, said the authors “have adopted a ridiculously broad view” of it, adding that the article’s analysis “is completely anti-historical.”(Mr. Bopp’s clients have had mixed success in cases brought under the provision. A state judge, assuming that the Jan. 6 attacks were an insurrection and that participating in them barred candidates from office, ruled that Representative Marjorie Taylor Greene, Republican of Georgia, had not taken part in or encouraged the attacks after she took an oath to support the Constitution on Jan 3. A federal appeals court ruled against Representative Madison Cawthorn, Republican of North Carolina, on one of his central arguments, but the case was rendered moot by his loss in the 2022 primary.)The provision in question is Section 3 of the 14th Amendment. Adopted after the Civil War, it bars those who had taken an oath “to support the Constitution of the United States” from holding office if they then “shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”Congress can remove the prohibition, the provision says, but only by a two-thirds vote in each House.The new article examined the historical evidence illuminating the meaning of the provision at great length, using the methods of originalism. It drew on, among other things, contemporaneous dictionary definitions, other provisions of the Constitution using similar language, “the especially strong evidence from 1860s Civil War era political and legal usage of nearly the precise same terms” and the early enforcement of the provision.The article concluded that essentially all of that evidence pointed in the same direction: “toward a broad understanding of what constitutes insurrection and rebellion and a remarkably, almost extraordinarily, broad understanding of what types of conduct constitute engaging in, assisting, or giving aid or comfort to such movements.”It added, “The bottom line is that Donald Trump both ‘engaged in’ ‘insurrection or rebellion’ and gave ‘aid or comfort’ to others engaging in such conduct, within the original meaning of those terms as employed in Section 3 of the 14th Amendment.”Though the provision was devised to address the aftermath of the Civil War, it was written in general terms and continues to have force, the article said. Congress granted broad amnesties in 1872 and 1898. But those acts were retrospective, the article said, and did not limit Section 3’s prospective force. (A federal appeals court agreed last year in the case involving Mr. Cawthorn.)The provision’s language is automatic, the article said, establishing a qualification for holding office no different in principle from the Constitution’s requirement that only people who are at least 35 years old are eligible to be president.“Section 3’s disqualification rule may and must be followed — applied, honored, obeyed, enforced, carried out — by anyone whose job it is to figure out whether someone is legally qualified to office,” the authors wrote. That includes election administrators, the article said.Professor Calabresi said those administrators must act. “Trump is ineligible to be on the ballot, and each of the 50 state secretaries of state has an obligation to print ballots without his name on them,” he said, adding that they may be sued for refusing to do so.(Professor Calabresi has occasionally strayed from conservative orthodoxy, leading to an unusual request from the group he helped found. “I have been asked not to talk to any journalist who identifies me as a co-founder of the Federalist Society, even though it is a historical fact,” he said. I noted the request and ignored it.)Some of the evidence the article considered overlapped with what was described in the recent indictment of Mr. Trump accusing him of conspiring to subvert the 2020 election. But that case and Section 3 address “completely separate questions,” Professor Baude said.“The question of should Donald Trump go to jail is entrusted to the criminal process,” he said. “The question of should he be allowed to take the constitutional oath again and be given constitutional power again is not a question given to any jury.” More

    Racing to Stop Trump, Republicans Descend on the Iowa State Fair

    Over decades of presidential campaigns, the Iowa way has been to hop from town to town, taking questions from all comers and genuflecting to the local culinary traditions. Going everywhere and meeting everyone has been the gospel of how to win over voters in the low-turnout midwinter caucuses that kick off the American presidential cycle.Now former President Donald J. Trump is delivering what could be a death blow to the old way.Five months from the 2024 caucuses, Mr. Trump holds a comfortable polling lead in a state he has rarely set foot in. If any of his dozen challengers hope to stop his march to a third straight nomination, they will almost certainly have to halt, or at least slow, him in Iowa after spending the better part of a year making their case. A commanding victory by Mr. Trump could create a sense of inevitability around his candidacy that would be difficult to overcome.As Mr. Trump and nearly all of his Republican rivals converge in the coming days at the Iowa State Fair, the annual celebration of agriculture and stick-borne fried food will serve as the latest stage for a nationalized campaign in which the former president and his three indictments have left the rest of the field starved for attention.“You’ve got to do it in Iowa, otherwise it’s gone, it’s all national media,” said Doug Gross, a Republican strategist who was the party’s nominee for governor of the state in 2002. “The chance to show that he’s vulnerable is gone. A recent New York Times/Siena College poll found that while Mr. Trump held 44 percent of the support among Iowa Republicans — more than double that of his closest rival, Gov. Ron DeSantis of Florida — 47 percent of Mr. Trump’s supporters said they would consider backing another candidate.Mr. DeSantis, for all his bad headlines about staff shake-ups, campaign resets and financial troubles, holds significant structural advantages in Iowa.He has endorsements from a flotilla of Iowa state legislators; a campaign team flush with veterans from the 2016 presidential bid of Senator Ted Cruz of Texas, who beat Mr. Trump in the state; and a super PAC with $100 million to spend. Mr. DeSantis has also said he will visit all 99 counties, a quest that has long revealed a candidate’s willingness to do the grunt work of traveling to Iowa’s sparsely populated rural corners to scrounge for every last vote.Convincing Iowans that they should be searching for a Trump alternative may be Mr. DeSantis’s toughest task.“Trump’s supporters are very vocal, so sometimes being very vocal sounds like there’s a lot of them,” said Tom Shipley, a state senator from southwest Iowa who has endorsed Mr. DeSantis. “That doesn’t necessarily mean that’s the case.”Gov. Former Vice President Mike Pence had just seven.(The number of small donors Mr. DeSantis had in Iowa is not publicly known because his campaign has an arrangement with WinRed, the Republican donor platform, that effectively prevented the disclosure of information about small donors.)Mr. DeSantis’s supporters are quick to point out that the three most recent winners of competitive Iowa caucuses — Mr. Cruz, Rick Santorum in 2012 and Mike Huckabee in 2008 — each came from behind with support from the same demographic: social conservatives. None of the three won the presidential nomination, but all of them used Iowa to propel themselves into what became a one-on-one matchup with the party’s eventual nominee.Operatives and supporters of the non-Trump candidates warn that Iowa caucusgoers are notoriously fickle. Around this point in 2015, Mr. Cruz had just 8 percent support in a poll by The Des Moines Register. Mr. Trump was first at 23 percent and Ben Carson was second, with 18 percent.“It’s a marathon, not a sprint,” said Chris Cournoyer, a Republican state senator from Le Claire who is backing Nikki Haley, who was at 4 percent in the recent Times/Siena poll.What’s different about Iowa this time, according to interviews with more than a dozen state legislators, political operatives and veterans of past caucuses, is that before Republicans consider a broad field of candidates, they are asking themselves a more basic, binary question: Trump or not Trump?Jeanne Dietrich of Omaha, Neb., displayed an autograph from former President Donal J. The longer a large field exists, the harder it will be for Mr. DeSantis or anyone else to consolidate enough support to present a challenge to Mr. Trump.“These people are absolutely going to vote for the former president, and those people are absolutely not going to vote for the former president,” said Eric Woolson, who has been in Iowa politics so long he was part of Joseph R. Biden Jr.’s 1988 presidential campaign before working for a series of Republican presidential hopefuls: George W. Bush, Mr. Huckabee, Michele Bachmann and Scott Walker.Now Mr. Woolson, who owns an organic catnip farm in southern Iowa, serves as the state director for Gov. Doug Burgum of North Dakota, who is polling at 1 percent in Iowa. Mr. Woolson said the first hurdle for 2024 campaigns was sorting out which voters would even consider candidates other than Mr. Trump.“In past elections, voters were keeping an open mind of, ‘Well, maybe I can still vote for this candidate, or maybe this one’s my second choice or whatever,’” he said. “Now there’s just such stark lines that have been drawn.”Those lines are compounded by a political and media environment centered not on Iowa’s local news outlets but on conservative cable and internet shows.Nikki Haley, who lags far behind Mr. DeSantis and Mr. Trump in polls, reported that just 25 Iowans had given her campaign $200 or more through the end of June, according to a report filed to the Federal Election Commission.Haiyun Jiang/The New York TimesFor decades, presidential candidates from both parties have flocked to The Des Moines Register’s state fair soapbox, a centrally located stage that has served as a gathering spot for the political news media and passers-by on their way to the Ferris wheel and the butter cow. It was at the soapbox in 2011 where Mitt Romney responded to a heckler with his infamous quip, “Corporations are people, my friend.”Mr. Trump skipped The Register’s soapbox in 2016 in favor of a far more dramatic appearance — landing at the fair in his helicopter and offering rides to children.This year, only lower-polling candidates — Ms. Haley, Mr. Pence and Vivek Ramaswamy, among others — are scheduled to speak at the soap box. All of the contenders except Mr. Trump will instead sit for interviews at the fairgrounds with Gov. Kim Reynolds of Iowa, a Republican who has pledged to stay neutral but has clashed with Mr. Trump. The scripted nature of those appearances is likely to cut down on the kinds of viral moments that once drove politics at the fair.Mr. Trump does not need to participate in Iowa’s retail politics, his supporters say, because he is already universally known and has been omnipresent on the conservative media airwaves as he fights against his indictments.“Trump can rely on the network that’s out here already,” said Stan Gustafson, a Republican state representative from just south of Des Moines. “It’s already put together.”Yet at least a few Iowa Republicans supporting Mr. Trump say they are looking to the future — just a bit further out than next year’s caucuses. Mr. Gustafson, who has endorsed Mr. Trump, said he was eyeing which candidates he might support in 2028.Tim Kraayenbrink, a state senator who also backs Mr. Trump, said Iowa’s turn in the campaign cycle was a good opportunity to judge which candidates would make a good running mate — as long as it is not Mr. Pence, he clarified.“He’s going to have some quality people to choose from for vice president,” Mr. Kraayenbrink said of Mr. Trump.Andrew Fischer More

    The ‘Never-Again Trumper’ Sham

    Shortly after last year’s midterms, when Republicans failed to take the Senate and eked out only a thin majority in the House, Paul Ryan gave an interview to ABC’s Jonathan Karl in which he described himself as a “Never-Again Trumper.” It’s worth recalling what Ryan and other Republicans said about Donald Trump the first time he ran to see what a sham this feeble self-designation is likely to become.In 2015, Ryan, the House speaker then, denounced Trump’s proposed Muslim ban as “not conservatism,” “not what this party stands for” and “not what this country stands for.” Then-Gov. Mike Pence of Indiana privately complained that Trump was “unacceptable,” according to the G.O.P. strategist Dan Senor, before he accepted the vice-presidential nomination. Ted Cruz called Trump a “sniveling coward” for insulting his wife, Heidi, before declaring that “Donald Trump will not be the nominee.”They all folded — and they all will fold again. Their point of principle wasn’t that Trump had crossed so many moral and ethical lines that they would rather live with a Democrat they could honorably oppose than a Republican they would be forced to dishonorably defend. Their point was simply that Trump couldn’t win. When he did, they become powerless to oppose him.Seven years later, they’ve learned nothing.In his interview with ABC, Ryan said he was “proud of the accomplishments” of the Trump years, citing tax reform, deregulation, criminal-justice reform, and conservative Supreme Court justices and federal judges. So why oppose Trump in 2024? “Because I want to win,” Ryan said, “and we lose with Trump. It was really clear to us in ’18, in ’20 and now in 2022.”The best that can be said about this argument is that it’s a half-clever way for Ryan and the type of “normal Republicans” he represents to salute and absolve themselves at the same time — to claim, in effect, that the conservative policy wins of the Trump years were all their doing, while the Republican electoral defeats were all his.But the analysis is shaky in its premises and dangerous in its implications, at least to Republicans like Ryan. Shaky, because does anyone remember the conservative policy achievements of the Romney-Ryan administration?Trump, the man everyone assumed couldn’t win in 2016, did. He brought millions of voters into the G.O.P. fold, including former Barack Obama and Bernie Sanders supporters. Did his manners and methods repel an even larger share of voters, particularly centrists who in previous years might have voted for Republicans? Probably. But the inescapable fact is that without MAGA voters there would have been no victory in 2016 and none of the conservative victories of which the former speaker is proud. For Ryan to say “we lose with Trump” may or may not be right, but it fails to wrestle with the fact that Republicans can’t win without him.As for the danger of Ryan’s argument, it’s that it fails to come to grips with what really ails the Republican Party.The trouble for Republicans does not lie in the difficulty of holding together a fractious coalition of MAGA and non-MAGA conservatives. That would be politics as usual in any major party. It lies in the depressing combination of MAGA bullies and non-MAGA cowards, with people like Ryan being a prime example of the latter. If there’s anything more contemptible than being a villain, it’s being an accomplice — less guilty than the former, but also less compelling, confident and strong.That’s what became of Ryan’s side of the G.O.P. in the Trump years. Every policy victory they helped achieve was a political victory for Trump and his side of the party. But every Trumpian disgrace was a disgrace for the Ryan side but not for Trump. The 2020 election lies and Jan. 6 and Trump’s blatant obstruction of justice in the documents case may trouble the conscience of Ryan. The MAGA crowd? They’re cool with it.This is why Trump is now cruising toward renomination, much to the chagrin of those conservatives who assumed he would have faded away by now. With the honorable exception of Asa Hutchinson and the intriguing one of Chris Christie, none of Trump’s most notable so-called opponents have actually bothered to oppose him. Vivek Ramaswamy wants to be a younger version of Trump; Ron DeSantis an angrier version. But just as people will prefer a villain to an accomplice, they’ll take the original over the imitation.Even at this point, it may be too late to change the fundamental dynamic of the Republican race, particularly since every fresh criminal indictment strengthens Trump’s political grip and advances his argument that he’s the victim of a deep-state conspiracy.But if the Paul Ryans of the conservative world want to make a compelling case against Trump, it can’t be that he’s unelectable. It’s that he’s irredeemable. It’s that he brought shame to the party of Lincoln; that he violated his oath to the Constitution; that he traduced every value Republicans once claimed to stand for; and that they will not support him if he is the Republican nominee.That may not keep Trump from the nomination or even the presidency.     The 2024 Republican presidential primary is officially underway, and Donald Trump is dominating the field. But this is a very different contest than it was in 2016. Back then, the Republican Party was the party of foreign policy interventionism, free trade and cutting entitlements, and Trump was the insurgent outsider unafraid to buck the consensus. Today, Trump and his views have become the consensus.The primary, then, raises some important questions: How has Donald Trump changed the Republican Party over the past eight years? Is Trumpism an actual set of policy views or just a political aesthetic?     Republicans Chose Their Fate When They Chose to Shield Trump

    It’s not too much to say that the 2024 Republican presidential primary is effectively over. In fact, it’s been over. The earliest you could say it was over was Jan. 7, 2021, when most Republican politicians closed ranks around Donald Trump in the wake of the insurrection. The next earliest date was Feb. 13 of the same year, when the majority of Senate Republicans voted to acquit Trump of all charges in his second impeachment trial, leaving him free to run for office.With Trump now shielded from the immediate political consequences of trying to seize power, it was only a matter of time before he made his third attempt for the Republican presidential nomination. And now, a year out from the next Republican convention, he is the likely nominee — the consensus choice of most Republican voters. No other candidate comes close.According to the most recent New York Times/Siena poll, 54 percent of Republicans nationwide support Trump for the 2024 nomination. The next most popular candidate, Gov. Ron DeSantis of Florida, gets 17 percent support. The next five candidates have either 2 percent or 3 percent support.You might think that Trump’s overwhelming lead is the product of a fragmented field, but that’s not true. If every candidate other than DeSantis left the race, and their votes went to DeSantis, Trump would still win by a nearly two-to-one margin.You can’t even blame the poor performance of DeSantis’s campaign. Has he burned through campaign cash with little to show for it? Yes. Is he tangled up in multiple scandals and controversies, including one in which a (now former) staffer created and shared a video with Nazi imagery? Yes. But even a flawless campaign would flounder against the fact that Trump remains the virtually uncontested leader of the Republican Party.And make no mistake: Trump’s leadership has not been seriously contested by either his rivals or the broader Republican establishment. How else would you describe the decision to defend Trump against any investigation or legal scrutiny that comes his way? Republican elites and conservative media have successfully persuaded enough Republican voters that Trump is the victim of a conspiracy of perfidious liberals and their “deep state” allies.They have done a good job convincing those voters that Trump deserves to be back in office. Add the sweet potatoes and cook, stirring occasionally, until browned all over, 5 to 7 minutes. Transfer the browned sweet potatoes to a plate and set aside.Add the remaining 1 tablespoon olive oil to the pot and set the heat to medium-low. Add the onion and cook, stirring occasionally, until translucent, 4 to 6 minutes.     A Republican 2024 Climate Strategy: More Drilling, Less Clean Energy

    Project 2025, a conservative “battle plan” for the next Republican president, would stop attempts to cut the pollution that is heating the planet and encourage more emissions.During a summer of scorching heat that has broken records and forced Americans to confront the reality of climate change, conservatives are laying the groundwork for future Republican administration that would dismantle efforts to slow global warming.The move is part of a sweeping strategy dubbed Project 2025 that Paul Dans of the Heritage Foundation, the conservative think tank organizing the effort, has called a “battle plan” for the first 180 days of a future Republican presidency.The climate and energy provisions would be among the most severe swings away from current federal policies.The plan calls for shredding regulations to curb greenhouse gas pollution from cars, oil and gas wells and power plants, dismantling almost every clean energy program in the federal government and boosting the production of fossil fuels — the burning of which is the chief cause of planetary warming.The New York Times asked the leading Republican presidential candidates whether they support the Project 2025 strategy but none of the campaigns responded. Still, several of the architects are veterans of the Trump administration, and their recommendations match positions held by former President Donald J. Trump, the current front-runner for the 2024 Republican nomination.The $22 million project also includes personnel lists and a transition strategy in the event a Republican wins the 2024 election. The nearly 1,000-page plan, which would reshape the executive branch to place more power into the president’s hands, outlines changes for nearly every agency across the government.The Heritage Foundation worked on the plan with dozens of conservative groups ranging from the Heartland Institute, which has denied climate science, to the Competitive Enterprise Institute, which says “climate change does not endanger the survival of civilization or the habitability of the planet.”Mr. Dans said the Heritage Foundation delivered the blueprint to every Republican presidential hopeful. An NPR/PBS NewsHour/Marist poll conducted last month found that while 56 percent of respondents called climate change a major threat — including a majority of independents and nearly 90 percent of Democrats — about 70 percent of Republicans said global warming was either a minor threat or no threat at all.Project 2025 does not offer any proposals for curbing the greenhouse gas emissions that are dangerously heating the planet and which scientists have said must be sharply and quickly reduced to avoid the most catastrophic impacts.Asked what the country should do to combat climate change, Diana Furchtgott-Roth, director of the Heritage Foundation’s energy and climate center, said “I really hadn’t thought about it in those terms” and then offered that Americans should use more natural gas.Natural gas produces half the carbon dioxide emissions of coal when burned. But gas facilities frequently leak methane, a greenhouse gas that is much more powerful than carbon dioxide in the short term and has emerged as a growing concern among climate scientists.The blueprint said the next Republican president would help repeal the Inflation Reduction Act, the 2022 law that is offering $370 billion for wind, solar, nuclear, green hydrogen and electric vehicle technology, with most of the new investments taking place in Republican-led states.The plan calls for shuttering a Department of Energy office that has $400 billion in loan authority to help emerging green technologies. It would make it more difficult for solar, wind and other renewable power — the fastest growing energy source in the United States — to be added to the grid. Ash Ponders for The New York TimesThe blueprint throws open the door to drilling inside the pristine Arctic wilderness, promises legal protections for energy companies that kill birds while extracting oil and gas and declares the federal government has an “obligation to develop vast oil and gas and coal resources” on America’s public lands.Notably, it also would restart a quest for something climate denialists have long considered their holy grail: reversal of a 2009 scientific finding at the Environmental Protection Agency that says carbon dioxide emissions are a danger to public health.Erasing that finding, conservatives have long believed, would essentially strip the federal government of the right to regulate greenhouse gas emissions from most sources.In interviews, Mr. Dans and three of the top authors of the report agreed that the climate is changing. But they insisted that scientists are debating the extent to which human activity is responsible.On the contrary, the overwhelming majority of climate scientists around the world agree that the burning of oil, gas and coal since the Industrial Age has led to an increase of the average global temperature of 1.2 degrees Celsius, or 2.2 degrees Fahrenheit.The plan calls on the government to stop trying to make automobiles more fuel efficient and to block states from adopting California’s stringent automobile pollution standards.Ms. Furchtgott-Roth said any measures the United States would take to cut carbon would be undermined by rising emissions in countries like China, currently the planet’s biggest polluter. It would be impossible to convince China, to cut its emissions, she said.Mandy Gunasekara was chief of staff at the E.P.A. during the Trump administration and considers herself the force behind Mr. Trump’s decision to withdraw the United States from the 2015 Paris climate accord. She led the section outlining plans for that agency, and said that regarding whether carbon emissions pose a danger to human health “there’s a misconception that any of the science is a settled issue.”The plan does not offer any proposals for curbing the greenhouse gas emissions that are dangerously heating the planet.Leigh Vogel for The New York TimesBernard L. McNamee is a former Trump administration official who has worked as an adviser to fossil fuel companies as well as for the Texas Public Policy Foundation, which spreads misinformation about climate change. He wrote the section of the strategy covering the Department of Energy, which said the national laboratories have been too focused on climate change and renewable energy. In an interview, Mr. McNamee said he believes the role of the agency is to make sure energy is affordable and reliable.Mr. Dans said a mandate of Project 2025 is to “investigate whether the dimensions of climate change exist and what can actually be done.” As for the influence of burning fossil fuels, he said, “I think the science is still out on that quite frankly.”In actuality, it is not.The top scientists in the United States concluded in an exhaustive study produced during the Trump administration that humans — the cars we drive, the power plants we operate, the forests we destroy — are to blame. “There is no convincing alternative explanation supported by the extent of the observational evidence,” scientists wrote.Climate advocates said the Republican strategy would take the country in the wrong direction even as heat waves, drought and wildfires worsen because of emissions.“This agenda would be laughable if the consequences of it weren’t so dire,” said Christy Goldfuss, chief policy impact officer for the Natural Resources Defense Council, an environmental group.Republicans who have called for their party to accept climate change said they were disappointed by the blueprint and worried about the direction of the party.“I think its out-of-touch Beltway silliness and it’s not meeting Americans where they are,” said Sarah Hunt, president of the Joseph Rainey Center for Public Policy, which works with Republican state officials on energy needs.Firefighters battling the Agua Fire in Soledad Canyon near Agua Dulce, Calif., last month.David Swanson/Agence France-Presse — Getty ImagesShe called efforts to repeal the Inflation Reduction Act, which is pouring money and jobs overwhelmingly into red states, particularly impractical.“Obviously as conservatives we’re concerned about fiscal responsibility, but if you look at what Republican voters think, a lot of Republicans in red states show strong support for provisions of the I.R.A.,” Ms. Hunt said.Representative John Curtis, Republican of Utah, who launched a conservative climate caucus, called it “vital that Republicans engage in supporting good energy and climate policy.”Without directly commenting on the G.O.P. blueprint, Mr. Curtis said “I look forward to seeing the solutions put forward by the various presidential candidates and hope there is a robust debate of ideas to ensure we have reliable, affordable and clean energy.”Benji Backer, executive chairman and founder of the American Conservation Coalition, a group of young Republicans who want climate action, said he felt Project 2025 was wrongheaded.“If they were smart about this issue they would have taken approach that said ‘the Biden administration has done things in a way they don’t agree with but here’s our vision’,” he said. “Instead they remove it from being a priority.”He noted climate change is a real concern among young Republicans.     This Is the Most Frightening Part of the Trump Indictment

    Buried in the federal indictment of Donald Trump on four counts tied to his attempt to overturn the results of the 2020 presidential election is one of the most chilling paragraphs ever written about the plans and intentions of an American president.It concerns a conversation between Patrick Philbin, the deputy White House counsel, and Co-Conspirator 4. On the morning of Jan. 3, 2021, Co-Conspirator 4 accepted the president’s offer to become acting attorney general, a job he ended up never holding. That means Co-Conspirator 4 is almost certainly Jeffrey Clark, whom Trump hoped to install as attorney general because Clark “purportedly agreed to support his claims of election fraud,” as a report in The Times put it.Later that day, Co-Conspirator 4 spoke with Philbin, who told him that “there had not been outcome-determinative fraud in the election and that if the defendant” — President Trump — “remained in office nonetheless, there would be ‘riots in every major city in the United States.’” To which Co-Conspirator 4 is said to have responded, “Well, that’s why there’s an Insurrection Act.”You may recall that Trump considered invoking the Insurrection Act — which enables the use of the military to suppress civil disorder, insurrection or rebellion — to quell the protests that followed the police killing of George Floyd. Trump wanted thousands of troops on the streets of Washington and other cities, and he had repeatedly urged top military and law enforcement officials to confront protesters with force. “That’s how you’re supposed to handle these people,” Trump reportedly said. “Crack their skulls!”We don’t know Trump’s exact plans for what he would have done if his schemes to overturn the election had been successful. We don’t even know if he had a plan. But the fact that he surrounded himself with people like Clark suggests that if Trump had actually stolen power, he might well have tried to use the Insurrection Act to suppress the inevitable protests and resistance, which could have killed hundreds (perhaps even thousands) of Americans in an attempt to secure his otherwise illegitimate hold on power.That this was even contemplated is a testament to Trump’s striking contempt for representative self-government itself, much less the Constitution. With his self-obsession, egoism and fundamental rejection of the democratic idea — that power resides with the people and isn’t imbued in a singular person — Trump’s attempt to subvert the American constitutional order was probably overdetermined. And it’s not hard to imagine a world in which his defeat was a little less decisive and key Republicans were a little more willing to bend to his will. There, in that parallel universe, Jan. 6 might have gone in Trump’s favor, if it was even necessary in the first place.The thin line between Trump’s success and failure is why, despite the protests of conservative media personalities and Republican politicians, this indictment had to happen. There was no other choice. Even if his opponents must ultimately defeat him at the ballot box, it would have been untenable for the legal system to stay quiet in the face of an effort to put an end to the American experiment in republican self-government. Trump is the only president in the history of the United States to try to nullify an election and prevent the peaceful transfer of power. Extraordinary actions demand an extraordinary response.The criminal-legal system is now moving, however slowly, to hold Trump accountable. This is a good thing. But as we mark this development, we should also remember that the former president’s attempt to overthrow our institutions would not have been possible without those institutions themselves.Most people who cast a ballot in the 2016 election voted against Trump for president. But in the American system, not all votes are equal. Instead, the rules of the Electoral College gave a small fraction of voters in a few states decisive say over who would win the White House. The will of a majority of the people as a whole — or at least a majority of those who went to the polls — meant nothing compared with the will of a select few who, for reasons not too distant from chance, could decide the election.Trump won fewer votes, but the system, in its wisdom, said he won his first election anyway. Is it any wonder, then, that in 2020, when a majority of the voting public rejected his bid for power a second time, the former president immediately turned his attention to manipulating that system in order to remain in power? And make no mistake, Trump’s plot hinged on the complexities of the Electoral College.“Following the election, President Trump worked ruthlessly to convert loss into victory, exploiting pressure points and ambiguities in the protracted and complex process, partly constitutional and partly statutory, that we refer to collectively as the Electoral College,” observed the legal scholar Kate Shaw, who is also a contributing Opinion writer to this newspaper, in a 2022 article for The Michigan Law Review. This “baroque and multistep process,” she continued, “afforded Trump a number of postelection opportunities to contest or undermine, in terms framed in law and legal process, the results of an election he had plainly lost.”Rather than try to call out the Army or foment a mob, Trump’s opening gambit in his attempt to overturn the election was to contest our strange and byzantine system for choosing presidents — a system that runs as much on the good faith of the various participants as it does on law and procedure. And so, before Jan. 6, there was the attempt to delay certification of electors, the attempt to find new electors who would vote in Trump’s favor, the attempt to pressure Republican-led state legislatures into seizing the process and deciding their elections for Trump and the attempt to pressure the vice president into throwing the election to the House of Representatives, where statewide Republican delegations would give Trump the victory he couldn’t win himself.But it’s not just that our process for choosing presidents is less resilient than it looks. In addition to its structural flaws, the Electoral College also inculcates a set of political fictions — like the idea that a “red” state is uniformly Republican or that a “blue” one is uniformly Democratic — that can make it easier, for some voters, to believe claims of fraud.There is also the broader problem of the American political system when taken in its entirety. There is the inequality of voting power among citizens I mentioned earlier — some votes are worth much more than others, whether it’s a vote for president, senator or member of the House — and the way that that inequality can encourage some voters to think of themselves as “more equal” and more entitled to power than others.Trump is pathological, and our political system, to say nothing of one of our two major political parties, has enabled his pathology. We do not know how the former president will fare in the courts, and it is still too early to say how he will do in the next election if he stands, for a third time, as the Republican nominee for president.But one thing is clear, if not obvious: If we truly hope to avoid another Jan. 6, or something worse, we have to deal with our undemocratic system as much as we do with the perpetrators of that particular incident. Whatever benefits our unusual rules and procedures are supposed to have are more than outweighed, at this point in our history, by the danger they pose to the entire American experiment.
