    Philadelphia’s Progressive District Attorney Fends Off Democratic Challenger

    Larry Krasner, part of a new breed of prosecutors, easily defeated Carlos Vega in Tuesday’s primary in spite of a rise in gun crime.Philadelphia’s district attorney, Larry Krasner, won the Democratic nomination in his re-election campaign on Tuesday, easily fending off a challenge from a former prosecutor who had argued that Mr. Krasner was making the city less safe.Voters were unconvinced by that argument. When The Associated Press called the race late Tuesday night, Mr. Krasner was ahead of his rival, Carlos Vega, by almost 40,000 votes.Throughout his campaign, Mr. Krasner argued that a 40 percent increase in homicides in Philadelphia last year had nothing to do with his progressive policies, pointing to cities with more traditional prosecutors that had experienced similar trends during the coronavirus pandemic.Mr. Krasner does not prosecute some low-level offenses, such as drug possession and prostitution, and has sought more lenient sentences than his predecessors.In a speech to supporters on Tuesday night at a hotel in downtown Philadelphia, Mr. Krasner said he had been re-elected because he had kept his promises, and he claimed a mandate from the voters most affected by serious crime.“We in this movement for criminal justice reform just won a big one,” he said.Mr. Krasner’s convincing victory, achieved in spite of a sharp increase in gun crime in Philadelphia over the past two years, may indicate that the appeal of progressive prosecutors will hold steady for voters even as public safety becomes a more pressing issue.Mr. Krasner acknowledged that in his victory remarks.“We hear all this talk about how somehow progressive prosecution can’t survive,” he said. “That’s not what I see. What I see is that traditional prosecution can’t survive.”Mr. Vega acknowledged his loss in a tweet shortly before midnight on Tuesday, saying, “It looks like tonight we did not get the result we wanted, but even in defeat we have grace & we smile.”He thanked his supporters and expressed his own support for the victims of crimes. A spokesman for his campaign did not respond to multiple requests for comment.As in his first campaign, in which he ran against six other candidates, Mr. Krasner, 60, won significant support from Black voters in the northern and western parts of the city. Those neighborhoods have been the most affected by gun violence, and were places where Mr. Vega, 64, had hoped to make inroads.“Black voters — and not just Black voters — believe that change is necessary and that the direction that Larry Krasner is taking is the right direction,” said State Senator Vincent J. Hughes, who represents several of those neighborhoods. “This is not a close victory. It is an affirmation that we have to go in a different direction in the pursuit of justice.”Enthusiasm for what used to be a low-turnout race remained high. When all the votes are counted, including mail-in ballots, turnout will almost certainly be higher than it was four years ago, when 155,000 people voted in the Democratic primary.Mr. Vega, a longtime homicide prosecutor, was among the first employees whom Mr. Krasner fired after taking over the district attorney’s office in 2018. Mr. Vega argued that the leniency of Mr. Krasner’s policies had led to the increase in crime.Criminologists said there would be no way to prove Mr. Vega’s assertions. David S. Abrams, a professor of law and economics at the University of Pennsylvania who has tracked crime statistics across the country over the past year, said any theory would have to take into account both the rise in homicides and shootings and the overall decline in crime, at least through 2020.“It’s a mystery,” he said. “There are a ton of theories, almost none of which fit all the facts.”Mr. Vega received ample support from the police, whose powerful union poured tens of thousands of dollars into his campaign and tarred Mr. Krasner as soft on crime at every opportunity.Mr. Krasner won office four years ago as part of a new breed of progressive prosecutors. In addition to upholding his campaign pledge not to prosecute low-level crimes, he lowered the number of people in the city’s jail by more than 30 percent.That approach won him approval from voters but also a significant amount of criticism, particularly from former prosecutors and even some of his own employees. Thomas Mandracchia, who worked for Mr. Krasner for about two years, said the district attorney’s insistence on firing so many experienced lawyers had contributed to an office plagued by disorganization. But none of those criticisms appeared to put a dent in Mr. Krasner’s support on Tuesday.In November’s general election, Mr. Krasner will face Charles Peruto Jr., a Republican defense lawyer who has campaigned on a strong message of public safety, saying that it is more important than civil rights.     Rising concerns over crime have led candidates to issue strong appeals for public safety, less than a year after the city was under pressure to defund the police.A shooting in Times Square, a spike in gun violence and a spate of high-profile attacks on subway riders have pushed concerns over crime and public safety to the forefront of the New York City mayor’s race, altering the trajectory of the contest as the June 22 primary approaches.A year after the rise of the “defund the police” movement amid an outcry over racial injustice, the primary will offer one of the first tests of where Democratic voters stand as the country emerges from the pandemic but confronts a rise in gun violence in major cities like New York.The shooting on Saturday in Times Square, the heart of tourism and transit in New York City, injured three bystanders, including a 4-year-old girl, a woman from New Jersey and a Rhode Island tourist who had been hoping to visit the Statue of Liberty.Two of the leading mayoral candidates rushed to the scene.Andrew Yang, the former presidential candidate, held a Sunday morning news conference where he declared that “nothing works in our city without public safety, and for public safety, we need the police.” Eric Adams, the Brooklyn borough president, went to Times Square twice: on Saturday, hours after the shooting, and again the following afternoon.On Monday, Raymond J. McGuire appeared there as well, walking a careful line between calling for stronger policing and discussing how, “as a 6-foot-4, 200-pound Black man in America,” he understands how the police can violate civil rights.The rising concerns over crime have given those candidates a fresh opening to make forceful cases for public safety and the role it plays in New York’s recovery from the pandemic.The moment is also testing whether the most left-wing candidates in the race, whose far-reaching proposals to rein in the power of the New York Police Department reflected widespread protests over racial injustice last year, will resonate in the same way when the city may be at a different kind of inflection point.As of May 2, 132 people have been killed compared with 113 this same time last year, a 17 percent increase, according to Police Department statistics. There have been 416 shooting incidents compared with 227 this time last year, an 83 percent increase.In one sign of just how central matters of public safety are becoming in the race, at least three different candidates plan to discuss the issue on Tuesday. Maya D. Wiley, a former counsel to Mayor Bill de Blasio, is slated to unveil her policing plan; the former federal housing secretary, Shaun Donovan, is expected in the Brownsville neighborhood of Brooklyn, which has been hit especially hard by gun violence over the last year, to discuss “his plans to eliminate the out-of-state gun pipeline”; and Kathryn Garcia, the city’s former sanitation commissioner, intends to roll out a gun violence prevention proposal.“We’re in a very precarious position,” said the Rev. Al Sharpton, the civil rights leader. “People are afraid of the cops and the robbers. We have both of them that we’ve got to deal with. And anyone that cannot come up with a comprehensive plan that threads the needle of both should not be running for mayor.”Mr. Sharpton said he intends to press mayoral candidates on issues of both overpolicing and gun violence at a forum in coming weeks.More than any other candidate in the race, Mr. Adams offers the clearest test of the potency of a message centered on public safety, which he describes as the “prerequisite” to prosperity. Nonetheless, other elected officials also reached for comparisons to the city’s so-called bad old days even as they stressed that they do not believe the current moment is equivalent.“Back in the ‘80s and ‘90s, people that lived here, including myself, you know, we witnessed some pretty nasty stuff,” said Representative Adriano Espaillat, a New York Democrat. “We don’t want to slip back to that. So I think that that’s going to be a major issue with this year’s mayoral race.” Mr. Espaillat is currently neutral after pulling his endorsement from the city comptroller, Scott M. Stringer, following an allegation of sexual misconduct, which Mr. Stringer denies.Diana Ayala, a councilwoman representing East Harlem and the Bronx who also rescinded her support of Mr. Stringer, said the response from the mayoral candidates to addressing crime will determine if she endorses anyone else for mayor.“Citywide, people are alarmed at the numbers of shootings but quite frankly, those numbers have been pretty consistent in my district for the last three and a half years,” Ms. Ayala said. “Every summer, even as we speak, we are planning for what’s to come.”Ms. Wiley, who held a news conference on Sunday to decry gun violence, has already released a plan to combat that issue. Her policing plan, according to her campaign, will include proposals like a civilian police commissioner, and ensuring that “final disciplinary authority for police misconduct” will “be in the hands of a new all-civilian neutral body.”She also supports “cutting at least $1 billion from the N.Y.P.D. budget to fund investments in alternatives to policing,” her campaign says. Mr. Stringer has said he supports reallocating $1.1 billion in police funds over four years — while often saying that he does not want a return to the chaos of the 1970s. Mr. Donovan has pledged to cut $3 billion from the police and corrections budget by the end of his first term and direct the money to underserved neighborhoods; Dianne Morales, a former nonprofit executive, wants to cut $3 billion and reallocate those funds as well.Ms. Morales, the most left-wing candidate in the race, was not available for an interview on Monday, but a spokeswoman, Lauren Liles, said Ms. Morales “stands by her emphasis that we need to move away from the false equivalency between policing and public safety.”Many Democrats have also pointed out that Times Square already has a significant police presence, noting that was not enough to prevent a shooting.Mr. McGuire called for a re-examination of bail reform laws in a way that doesn’t violate people’s civil rights.“There’s a difference between someone being thrown into jail for stealing a bag of potato chips and someone who has repeat arrests for gun possession,” Mr. McGuire said. “People arrested in possession of a loaded, illegal firearm cannot be detained by breakfast and walk out of the courthouse and be home by dinner.” More

Trump, whom she referred to as “a madman in the White House.”But the most serious political threat that emerged for Ms. Bottoms in recent months was a phenomenon she had previously described as the “Covid crime wave.” Like many other American cities, Atlanta is struggling with a spike in violent crime, including a 58 percent increase in homicides last year — the likely result, researchers say, of the pandemic’s strain on at-risk populations, as well as institutions like courts and police departments.The mayor’s inability to get a handle on crime has become the central theme for two challengers — Felicia Moore, the City Council president, and Sharon Gay, a lawyer — who thought they were going to take her on in the November election. “Atlanta has a mayor that is more interested in things that happen outside Atlanta,” Ms. Moore said in a recent statement, referring to Ms. Bottoms’s emerging national stature, including talk that she was rumored to be a possible vice-presidential candidate. “We need a mayor who knows the No. 1 job of any mayor is to keep our city safe.”Ms. Bottoms on Friday pushed back against the idea that she was worried about re-election, saying that she was popular enough to have won without a runoff. But others were not so sure. In Philadelphia, a city suffering from a spike in homicides and gun crime, Larry Krasner, the progressive district attorney, is facing a serious challenge from a candidate, Carlos Vega, who says Mr. Krasner “has not delivered on safety.”In San Francisco, where burglaries were up 46 percent in 2020 and car thefts up 22 percent, according to The San Francisco Chronicle, a similarly progressive prosecutor, Chesa Boudin, is facing a recall effort from critics focused on crime.In St. Louis, where homicides were up 35 percent last year, former Mayor Lyda Krewson decided not to run for a second term after the wearying trials of 2020. The city’s new mayor, Tishaura Jones, is, like Ms. Bottoms, an outspoken advocate for criminal justice reform who now faces the challenge of radically reimagining policing and incarceration while bringing her city’s crime numbers down.In Atlanta, crime has continued raging into 2021. In the first 18 weeks of the year, police statistics show homicides up 57 percent, rapes up 55 percent, aggravated assaults up 36 percent and auto thefts up 31 percent compared with the same period last year.The state’s speaker of the House, David Ralston, a Republican, plans to hold hearings this summer to consider putting state troopers on Atlanta’s streets. Weapons detectors were installed at the entrance of the Lenox Square mall in the upscale Buckhead neighborhood, making shopping feel like a trip to a courthouse. Some Buckhead residents are so fed up they have formed a group to explore whether to secede from the city — a move that would devastate Atlanta’s tax base.A report released in February by the Council on Criminal Justice gave a snapshot of the crime that afflicted American cities in 2020, with many of them suffering a sharp rise in homicides, aggravated assault and gun assaults.But the researchers also noted that the numbers were “well below historical highs” before crime began plummeting nationwide in the 1990s. Instead of criticizing Ms. Bottoms for embracing criminal justice reform, Ms. Moore — who, like Ms. Bottoms, is African-American — essentially agrees that reform and safety are not either-or propositions.“I believe wholeheartedly we can do both,” she said.However, the political problem Ms. Bottoms would have faced demonstrates the enduring peril of being perceived as unable to meet the challenge of rising crime. Critics have blasted her for allowing more than 400 officer vacancies to go unfilled in the Atlanta Police Department, which is supposed to be 2,046 officers strong.Ms. Moore has criticized her for failing to hold a national search for a replacement for former Chief Erika Shields, who stepped down in June in the aftermath of the fatal police shooting of Rayshard Brooks. (This week, Ms. Bottoms gave the interim chief, Rodney Bryant, the permanent role.)Others have lashed into the Bottoms administration for botching the firing of Garrett Rolfe, the white officer who killed Mr. Brooks, a Black man. The administration fired Officer Rolfe the day after the shooting, but this week, the city’s Civil Service Board reinstated him on the grounds that his due process rights had been violated.Such missteps went a long way to explaining why Ms. Bottoms had made herself politically vulnerable, said Clark D. Cunningham, a law professor at Georgia State University.“It’s not because she’s too progressive,” Mr. Cunningham said. “It’s because she’s too incompetent.”Over the years, a number of people who worked with Ms. Bottoms in City Hall said she did not always seem fully engaged in the day-to-day chore of governance. At her Friday news conference, Ms. Bottoms said she had been thinking about not running for re-election as early as her first year in office. “I can’t describe it,” she said of that feeling, “but I wasn’t sure that I would run again.”Opponents of Ms. Bottoms have criticized her for failing to hold a national search for a replacement for Erika Shields, the former police chief.Audra Melton for The New York TimesAt the same time, Ms. Bottoms has displayed a passion for enacting criminal justice reform, a topic she couches in personal terms. On Friday, she made reference, as she often has, to the painful story of her father, the R&B singer Major Lance, who was convicted of selling cocaine when she was a child.The experience inspired her to limit the public disclosure of small-scale marijuana arrest records and eliminate cash bond requirements at the city jail. She hopes to transform the jail itself into a social services hub she calls a “center for equity.”Her Police Department, meanwhile, is engaged in a review of training and policy, with the goal of making the department more community-oriented.Though revamping the department may pay off in the long run, Dean Dabney, a professor of criminology at Georgia State University, said it could increase crime in the short run.“If you switch from tactical policing to community policing, it’s going to take time to reallocate those resources and get those resources doing things the new way,” he said. “During that adjustment period the criminals are going to have the upper hand.”In the weeks before she declared that she would not run again, Ms. Bottoms seemed aware of the way that crime had taken center stage. She has promised to hire 250 police officers in the near future, crack down on nuisance properties, increase enforcement against gangs, and expand the city security camera network.In her news conference, Ms. Bottoms said she would focus, in her remaining months in office, on keeping the city safe. “I’m doing that not because I’m a mayor, but because I’m a mother in this city,” she said. “I want this city to be safe for my family, in the same way that I want it to be safe for everybody else who’s standing in this room.” More

It was one of the most tumultuous years for American cities since the 1960s, with the social and economic disruptions of the coronavirus pandemic as well as racial justice protests that sometimes turned destructive.In November, St. Louis’s mayor at the time, Lyda Krewson, announced she would not pursue a second term. A month later, Mayor Jenny Durkan of Seattle announced she would not run for re-election. Several mayors in smaller cities have also declined to run again, exhausted or demoralized by the ravages of 2020.Two contenders who have been seeking to unseat Ms. Bottoms in the November election have promised to do a better job fighting what Ms. Bottoms has called a “Covid crime wave,” which includes a 58 percent spike in homicides in 2020.But Ms. Bottoms, 51, was expected to mount a formidable defense. She has a loyal ally in President Biden, whom she was early to endorse, and who repaid her loyalty with an appearance at a virtual fund-raiser in March. Ms. Bottoms was mentioned briefly as a potential vice-presidential running mate and said that she later turned down a cabinet-level position in the Biden administration.Ms. Bottoms, who served as a judge and a city councilwoman before being sworn in as mayor in 2018, is also blessed with a voice — measured, compassionate, slightly bruised and steeped in her experience as a Black daughter and Black mother — that seemed uniquely calibrated to address the challenges of the past year.It was in the aftermath of the police killing of George Floyd in Minneapolis that Ms. Bottoms went on live television and became a national star as she spoke directly to protesters. Vogel and Feb. 8, 2021Updated 7:30 p.m. ETWASHINGTON — By the time George Nader pleaded guilty last year to possessing child pornography and sex trafficking a minor, his once strong alliances in President Donald J. Trump’s inner circle had been eroded by his cooperation with the special counsel’s investigation into Mr. Trump’s team and its connections to Russia.So as Mr. Nader sought to fight the charges and reduce his potential prison time, he turned to a lawyer with a deep reservoir of good will with the president and a penchant for taking unpopular, headline-grabbing cases: Alan M. Dershowitz.Mr. Dershowitz told Mr. Nader’s allies that he had reached out to an official in the Trump administration and one in the Israeli government to try to assess whether they would support a plan for Mr. Nader to be freed from United States custody in order to resume a behind-the-scenes role in Middle East peace talks, and whether Mr. Trump might consider commuting his 10-year sentence.Mr. Dershowitz helped craft a proposal — which Mr. Nader’s allies believed he was floating at the White House in the final days of the Trump presidency — for Mr. Nader to immediately “self-deport” after his release from a Virginia jail. Under the plan, Mr. Nader would board a private plane provided by the United Arab Emirates to return to the Gulf state, where he holds citizenship and has served as a close adviser to the powerful crown prince.Given the nature of Mr. Nader’s crimes and his cooperation with the Russia investigation, his bid for clemency was a long shot that did not work out. But Mr. Dershowitz’s willingness to pull a range of levers to try to free him shows why he emerged as a highly sought-after and often influential intermediary as Mr. Trump decided who would benefit from his pardon powers.Many of Mr. Dershowitz’s clients got what they wanted before Mr. Trump left office, an examination by The New York Times found. The lawyer played a role in at least 12 clemency grants, including two pardons, which wipe out convictions, and 10 commutations, which reduce prison sentences, while also helping to win a temporary reprieve from sanctions for an Israeli mining billionaire.His role highlighted how Mr. Trump’s transactional approach to governing created opportunities for allies like Mr. Dershowitz — an 82-year-old self-described “liberal Democrat” who defended the president on television and in his first impeachment trial — to use the perception that they were gatekeepers to cash in, raise their profiles, help their clients or pursue their own agendas.Mr. Dershowitz received dozens of phone calls from people seeking to enlist him in clemency efforts. The cases in which he did assist came through family members of convicts, defense lawyers enlisting him because they thought he could help their court cases as well as their clemency pushes and Orthodox Jewish prisoners’ groups with which he has long worked.In a series of interviews, Mr. Dershowitz — who in a career spanning more than half a century has represented a roster of tabloid-magnet clients accused of heinous acts, including O.J. Simpson and Jeffrey Epstein — cast his defense of Mr. Trump and his clemency efforts as a natural extension of his work defending individual rights against a justice system that could be harsh and unfair. “I’m just not a fixer or an influence peddler,” he said.Mr. Dershowitz said his efforts on behalf of Mr. Nader reflected “a multifaceted approach to these problems. So I don’t separate out diplomacy, legality, courts, executive, Justice Department — they’re all part of what I do.”He said that “the idea that I would ever, ever ingratiate myself to a president in order to be able to advertise myself as a person that could get commutations is just totally false and defamatory.”Among those Mr. Dershowitz sought to help was George Nader, a figure in the special counsel’s Russia investigation who pleaded guilty to possessing child pornography and sex trafficking a minor.Credit…C-SPAN, via Associated PressHe acknowledged, though, that his relationship with Mr. Trump increased interest in his services, and potentially his effectiveness.“Of course I’m not surprised that people would call me because they thought that the president thought well of me,” Mr. Dershowitz said. “If somebody is seeking a pardon from Clinton, you’re not going to go to somebody who is a friend of Jerry Falwell. You’re going to go to somebody who is a Democrat. That’s the way the system works.”He said he had agonized over cases in which he had failed to persuade Mr. Trump, including that of a federal death row inmate he had represented who was executed in December.Still, Mr. Dershowitz had an outsize influence over how Mr. Trump deployed one of the most profound unilateral powers of the presidency, including:Commutations to three people on whose behalf he personally lobbied Mr. Trump after working on their cases with Jewish prisoners’ rights groups. They included two New York real estate investors who had been convicted of defrauding more than 250 investors out of $23 million and a former executive at a kosher meatpacking plant who was convicted in 2009 of bank fraud.Commutations to several people who received long sentences at trial after turning down shorter sentences in plea deals offered by prosecutors, an outcome known as the trial penalty, against which Mr. Dershowitz has long crusaded. A commutation for a New Jersey man who was sentenced in 2013 to 24 years in prison for charges related to a Ponzi-style real estate scheme that caused $200 million in losses. Pardons to two conservative political figures, the author Dinesh D’Souza and the former vice-presidential aide I. Lewis Libby Jr., and a commutation to the former Illinois governor Rod R. Blagojevich. Mr. Dershowitz did not work on their cases, but he recommended clemency grants when Mr. Trump asked his opinion.It is difficult to determine how much money the work brought Mr. Dershowitz.Mr. Dershowitz, an emeritus professor at Harvard Law School who described himself as semiretired, said more than half of his clemency work was pro bono, and most of it was done on behalf of pre-existing clients. When he was paid, it was at an hourly rate in line with the fees charged by senior partners at law firms, Mr. Dershowitz said.In one case, he was paid by the family of Jonathan Braun, whose 10-year sentence for drug smuggling was commuted by Mr. Trump in his final hours in office. But after The Times reported that Mr. Braun had a history of violence and threatening people, Mr. Dershowitz said he donated the fees to charity.Mr. Dershowitz emerged as a favorite of Mr. Trump’s after he publicly criticized the Russia investigation.Credit…Pete Marovich for The New York TimesBut Mr. Dershowitz — who volunteered examples of Mr. Trump seeking his advice while in the next breath protesting that he was “not a Trump supporter” and had no more influence with Mr. Trump than with past presidents — obtained something that his defenders and detractors alike described as especially important to him: renewed political relevance and an increased reputation as a power player, particularly in the Jewish community.Mr. Dershowitz emerged as a favorite of Mr. Trump from his early days in office as a result of his criticism of the investigation being carried out by the special counsel, Robert S. Mueller III.Mr. Dershowitz, an ardent supporter of Israel, was invited to the White House in 2017 for two days of private talks about a Middle East peace plan being assembled by Mr. Trump, his son-in-law Jared Kushner and other officials.Mr. Dershowitz was invited back to the White House last year, when Mr. Trump unveiled the peace plan, and for a Hanukkah party in 2019 where Mr. Trump signed an executive order Mr. Dershowitz had helped draft targeting anti-Semitism on college campuses.The week after the Hanukkah party in 2019, Mr. Dershowitz attended a Christmas Eve dinner at the president’s Mar-a-Lago resort, where he said Mr. Trump lobbied him to join his impeachment legal defense team. Mr. Dershowitz said he decided to join as a matter of principle and noted that he had also consulted with President Bill Clinton’s legal team during his impeachment.Mr. Dershowitz acknowledged taking advantage of his access to push for clemency grants, starting with the invitation to the White House for talks about the Middle East peace plan. He used the opportunity to urge Mr. Trump to grant clemency to Sholom Rubashkin, the kosher meatpacking executive convicted in 2009.Sholom Rubashkin, a former kosher meatpacking executive, was convicted of bank fraud in 2009. Mr. Dershowitz pressed Mr. Trump to commute his 27-year prison sentence. A few months after Mr. Dershowitz made the case to Mr. Trump in the White House, Mr. Rubashkin was free.That outcome emboldened a network of activists and groups supporting prisoners’ rights, social service and clemency, including some associated with Orthodox Jewish leaders.Mr. Dershowitz and a Jewish group with which he has worked closely, the Aleph Institute, were central players in the network. As word spread of their successes, they were inundated with requests from prisoners and their families, including many Orthodox Jews. Late last year, Mr. Trump called Mr. Dershowitz to ask about clemency grants he was advocating on a pro bono basis with the Aleph Institute for Mark A. Shapiro and Irving Stitsky, the New York real estate investors convicted in the $23 million fraud. Mr. Dershowitz cast the cases as emblematic of the trial penalty.Mr. Dershowitz had written op-eds in Newsweek and The Wall Street Journal denouncing the trial penalty and citing unnamed cases. One matched the details of Mr. Shapiro and Mr. Stitsky, who were each sentenced to 85 years in prison after they turned down plea agreements of less than 10 years. Mr. Dershowitz said one or both of the articles had circulated in the White House, and Mr. Trump had asked him about the trial penalty.“He was very interested” in the penalty, Mr. Dershowitz said, and also “the concept of the pardon power being more than just clemency, but being part of the system of checks and balances for excessive legislative or judicial actions.”Mr. Stitsky had no prior relationship with Mr. Trump. But last year, friends of Mr. Stitsky helped retain a Long Island law and lobbying firm, Gerstman Schwartz, that did. One of the firm’s partners had parlayed previous New York public relations work for Mr. Trump into a new Washington lobbying business after he became president.And Mr. Stitsky’s new lawyers also tapped into the pardon-seeking network by working with both Mr. Dershowitz and the Aleph Institute.Mr. Trump commuted the sentences of Mr. Shapiro and Mr. Stitsky.In another case championed by Mr. Dershowitz and the Aleph Institute, Mr. Trump commuted the 20-year sentence of Ronen Nahmani, an Israeli-born Florida man convicted in 2015 of selling synthetic marijuana. The appeal to the White House, which Mr. Dershowitz helped devise, included an assurance that Mr. Nahmani would leave the country and never return — a framework that Mr. Dershowitz said served as a model for Mr. Nader’s case.Mr. Dershowitz at the White House last year, before Prime Minister Benjamin Netanyahu of Israel visited Mr. Trump.Credit…Alyssa Schukar for The New York TimesMr. Dershowitz was enlisted to help Mr. Nader by Joey Allaham, a Syrian-born New York restaurateur and businessman, who paid Mr. Dershowitz to consult on Middle East issues, including working with Mr. Nader.After Mr. Nader was arrested in 2019, Mr. Allaham connected Mr. Dershowitz to Mr. Nader’s criminal defense lawyer, Jonathan S. Jeffress, who paid Mr. Dershowitz at an hourly rate.Mr. Nader’s team grew to include the lobbyist Robert Stryk, who filed a disclosure statement saying he was working to win a presidential commutation, and the lawyer Robin Rathmell, who filed a clemency petition at the Justice Department citing Mr. Nader’s help to the United States in Middle East relations. Mr. Nader’s allies had also used that argument in the early 1990s in an effort to win a reduced sentence when he pleaded guilty to a different child pornography charge.Mr. Dershowitz said he thought it would help Mr. Nader’s current case if the American, Israeli and Emirati governments would vouch for his assistance to the United States in the region, and if Mr. Nader would pledge to leave the country upon his release.Mr. Dershowitz told Mr. Nader’s allies that he made one call last year to a Trump administration official who handled Middle East policy and who was discouraging about the idea. He also called Ron Dermer, the Israeli ambassador to the United States, who was noncommittal. After that, Mr. Dershowitz said, he shifted his efforts on behalf of Mr. Nader to focus almost exclusively on his fight to reduce his sentence in the courts.“That was 99 percent of the effort,” Mr. Dershowitz said, “because the clemency effort directed at commutation was always so uphill considering the nature of the crime that it was never realistic.”Mr. Nader’s allies had a different impression of Mr. Dershowitz’s efforts.“We understood that Mr. Dershowitz was seeking clemency on behalf of Mr. Nader,” Mr. Jeffress said, “and that he was rejected for the sole reason that Mr. Nader had cooperated in the Mueller investigation.”Nicholas Confessore More
