She added that the $1.6 billion in damages that Dominion is seeking are “outrageous, unsupported and not rooted in sound financial analysis.” According to court filings, Dominion estimates business losses at hundreds of millions of dollars and values the company at around $1 billion.Dominion’s legal complaint lays out how Fox repeatedly aired conspiracy theories about the company’s purported role in a plot to steal votes from former President Donald J. Trump, and argues that its business has suffered considerably as a result. Those falsehoods — including that Dominion was a pawn of the Venezuelan strongman Hugo Chavez and that its machines were designed with a feature that allowed votes to be flipped from one candidate to another — aired night after night as Fox hosts like Mr. Hannity and Mr. Dobbs allowed guests to make them on their shows, and in some cases vouched for them.Legal experts say the case is one of the most potentially consequential libel suits brought against an American media company in more than a generation, with the potential to deliver a judgment on a falsehood that has damaged the integrity of the country’s democratic system and remains an article of faith among many Trump supporters.Defamation is extremely difficult to prove in a case like this because of the broad constitutional protections that cover the news media. A company like Dominion has to prove either that a media outlet knew what it was publishing or broadcasting was false, or that it acted so hastily it overlooked facts proving that falsity, a legal standard known as demonstrating a “reckless disregard for the truth.”Dominion’s legal strategy, which it has detailed in court filings, hinges on getting testimony and unearthing private communications between Fox employees that prove either such recklessness or knowledge that the statements were false.The case has stirred considerable unease inside Fox all summer, as employees have had to turn over months of emails and text messages to Dominion lawyers and prepare for depositions. Other current and former Fox personalities who have been deposed include Dana Perino, Shepard Smith and Chris Stirewalt, who was part of the team that made the election night projection that Mr. Trump would lose Arizona, and the presidency as a result.This is not the first time that Mr. Hannity has been in the middle of a high-profile defamation suit. In 2018, Fox was sued by the parents of Seth Rich, a former Democratic National Committee staff member whom Mr. Hannity and others at Fox falsely linked to a hacking that resulted in committee emails being published by WikiLeaks. Mr. Rich was murdered in an apparent botched robbery in 2017, though conspiracy theorists tried to blame his death on Democratic operatives.     Much of Smartmatic Case Against Fox News Can Proceed, Judge Rules

    The $2.7 billion defamation lawsuit against Fox News by the election technology company Smartmatic can move forward, a New York judge ruled on Tuesday. But the judge tossed out Smartmatic’s defamation claims against the Fox News host Jeanine Pirro and a network guest, Sidney Powell.Smartmatic sued Rupert Murdoch’s cable news networks last year, along with several Fox hosts and guests. The lawsuit accused them of damaging the company by promoting a false narrative about the 2020 election: that Smartmatic and other voting systems companies tried to rig the race against President Donald J. Trump. Smartmatic later expanded its legal battle against disinformation to the right-wing media outlets Newsmax and One America News Network.On Tuesday, Justice David B. Cohen of State Supreme Court in Manhattan said in a 61-page ruling that, “at a minimum, Fox News turned a blind eye to a litany of outrageous claims about plaintiffs, unprecedented in the history of American elections, so inherently improbable that it evinced a reckless disregard for the truth.”He added, “At this nascent stage of the litigation, this court finds that plaintiffs have pleaded facts sufficient to allow a jury to infer that Fox News acted with actual malice.”He also declined to dismiss Smartmatic claims against Maria Bartiromo, the Fox Business star, and Lou Dobbs, whose Fox Business show was a frequent clearinghouse for baseless theories of electoral fraud in the weeks after Mr. Trump’s defeat. Fox canceled Mr. Dobbs’s program last year, one day after Smartmatic sued.Citing a legal technicality, Justice Cohen dismissed most of Smartmatic’s defamation claims against Rudolph W. Giuliani, who, appearing on Fox News as a legal representative for Mr. Trump, said the technology company had “tried-and-true methods for fixing elections,” among other false assertions. Even so, Justice Cohen said there was “substantial” evidence that Mr. Giuliani “acted with actual malice insofar as he evinced a reckless disregard for the truth” and ruled that Smartmatic could try again. The judge allowed another part of Smartmatic’s defamation case against Mr. Giuliani to go forward.Fox News vowed a swift appeal.“While we are gratified that Judge Cohen dismissed Smartmatic’s claims against Jeanine Pirro at this early stage, we still plan to appeal the ruling immediately,” the network said in a statement. The network added that it would “continue to litigate these baseless claims by filing a counterclaim for fees and costs” under New York’s anti-SLAPP (strategic lawsuit against public participation) statute, which is meant to quickly set aside lawsuits that may be intended to chill free speech.Fox News said it would do so “to prevent the full-blown assault on the First Amendment which stands in stark contrast to the highest tradition of American journalism.”In dismissing the claim against Ms. Pirro, Justice Cohen said that while she had asserted on her show that Democrats “stole votes,” she had not specifically blamed Smartmatic’s software.A spokesman for Smartmatic did not reply to a request for comment.Fox News is also battling a related $1.6 billion defamation lawsuit from Dominion Voting Systems, which has accused the channel of advancing lies that devastated its reputation and business.     Fox News Pushes to Have Defamation Suit Against It Dismissed

    In the months since the election tech company Smartmatic sued Fox News and three of its anchors, the two companies have engaged in a prehearing back-and-forth that continued Monday when Fox filed briefs in support of a previous motion to have the lawsuit dismissed.In its defamation suit, which was filed in New York State Supreme Court on Feb. 4, Smartmatic accused Fox and the anchors Lou Dobbs, Maria Bartiromo and Jeanine Pirro of promoting falsehoods about the company and widespread fraud in the 2020 presidential election.Shortly after the suit was filed, Fox canceled Mr. Dobbs’s program on Fox Business and filed a motion for a dismissal of the suit, arguing that the claims of electoral fraud broadcast on Fox News and Fox Business were newsworthy and handled fairly. Smartmatic replied on April 12, with a brief stating that the three Fox anchors had played along as their guests promoted election-related conspiracy theories.In its latest volley, Fox asserted that its coverage of Smartmatic was part of its overall reporting on a challenge of the election outcome based on claims made by former President Donald J. On Friday, the day after the lawsuit was filed, Fox canceled the nightly Fox Business program hosted by Lou Dobbs, who is named in the suit along with the Fox anchors Maria Bartiromo and Jeanine Pirro.In its 44-page response filed in New York State Supreme Court, Fox argues that the claims of electoral fraud made on its channels by Mr. Trump’s lawyers — including Rudolph W. Giuliani and Sidney Powell, who are also named in the defamation suit — were matters of significant interest to viewers and handled fairly.“This lawsuit strikes at the heart of the news media’s First Amendment mission to inform on matters of public concern,” Fox says in the motion, adding, “An attempt by a sitting president to challenge the result of an election is objectively newsworthy.”Paul D. Clement, a partner in the Washington office of the law firm Kirkland & Ellis who served as solicitor general under President George W. Bush, is leading Fox’s defense. “Smartmatic’s theory is fundamentally incompatible with the reality of the modern news network and deeply rooted principles of free speech law,” Mr. Clement said in a statement.A spokesman for Smartmatic did not immediately reply to a request for comment.“It’s a strong move on their part to try to come out and dismiss the claim,” said Timothy Zick, a professor at William & Mary Law School who specializes in First Amendment law.Mr. Zick said that Fox was making use of the concept of “neutral reportage,” arguing that it could not be sued for defamation while covering the news. “They’re arguing that shields Fox News as an organization for simply reporting on the controversy, which is a matter of public interest,” he said.A key to Fox’s defense is the argument that it cannot be held responsible for statements made on its programs by Mr. Giuliani and Ms. Powell, given their roles as Mr. Trump’s legal representatives.“The public had a right to know, and Fox had a right to cover, that the president and his allies were accusing Smartmatic (and others) of manipulating the election results, regardless of the ultimate truth or accuracy of those allegations,” the motion reads. It also asserts that Smartmatic’s suit does not identify defamatory statements by television hosts employed by Mr. Murdoch’s company.Fox also argues that Smartmatic should be considered a public figure. That argument, which is likely to be contested by the tech company, means that Smartmatic must meet a high bar to prove that it was defamed: demonstrating that the defendants knew their statements were false, or at least had serious doubts about them.Smartmatic’s 276-page lawsuit alleges that Mr. Trump’s lawyers used Fox’s platform, and its sympathetic anchors, to spin conspiracies about the company that damaged its reputation and commercial prospects. Fox News, for instance, paid millions last year to settle a claim from the family of a murdered Democratic National Committee staff member falsely accused by Fox hosts of leaking emails to WikiLeaks.But the use of defamation suits has also raised uneasy questions about how to police a news media that counts on First Amendment protections — even as some conservative outlets advanced Mr. Trump’s lies and eroded public faith in the democratic process.“If you had asked me 15 years, five years ago, whether I would ever have gotten involved in a defamation case, I would have told you no,” said Roberta Kaplan, a lawyer who is representing Mr. Trump’s niece, Mary L. Trump, and the writer E. Jean Carroll in defamation suits against the former president.The defamation suits raise the question of how news organizations should present public figures. Last year, Mr. Trump’s campaign sued multiple news organizations for coverage that the president deemed unfavorable or unfair. The technology billionaire Peter Thiel bankrolled Hulk Hogan’s suit against the gossip blog Gawker that ultimately bankrupted the business.“What’s changed,” Ms. Kaplan said, “and we’ve all seen it happen before our eyes, is the fact that so many people out there, including people in positions of authority, are just willing to say anything, regardless of whether it has any relationship to the truth or not.”Some First Amendment lawyers say that an axiom — the best antidote to bad speech is more speech — may no longer apply in a media landscape where misinformation can flood public discourse via countless channels, from cable news to the Facebook pages of family and friends.“This shouldn’t be the way to govern speech in our country,” Ms. Kaplan said. “It’s not an efficient or productive way to promote truth-telling or quality journalistic standards through litigating in court. But I think it’s gotten to the point where the problem is so bad right now there’s virtually no other way to do it.”Mr. Trump’s rise is an inextricable part of this shift. His popularity boosted the profits and power of the right-wing commentators and media outlets that defended him. In November, when Mr. Trump cast doubt on the outcome of the presidential election despite no credible evidence, it made commercial and editorial sense for his media allies to follow his lead.The Newsmax anchor Greg Kelly refused to accept Joseph R. Biden Jr. as president-elect and was rewarded with a surge in ratings. Fox News was more cautious — the network declared Mr. Biden the next president on Nov. 7 — but some Fox stars, including Mr. Dobbs, Ms. Bartiromo and Ms. Pirro, offered significant airtime to his lawyers, Mr. Giuliani and Ms. Powell, and others who pushed the outlandish election-fraud narrative.In one example cited in the 276-page complaint filed by Smartmatic, Mr. Dobbs’s program broadcast a false claim by Ms. Powell that Hugo Chávez, the former president of Venezuela, had been involved in creating the company’s technology and installed software so that votes could be switched undetected. (Mr. Chávez, who died in 2013, did not have anything to do with Smartmatic.)Smartmatic also cited an episode of “Lou Dobbs Tonight” in which Mr. Giuliani falsely described the election as “stolen” and claimed that hundreds of thousands of “unlawful ballots” had been found. Mr. Dobbs described the election as the end to “a four-and-a-half-year-long effort to overthrow the president of the United States,” and raised the specter of outside interference.“It has the feeling of a cover-up in certain places, you know — putting the servers in foreign countries, private companies,” Mr. Dobbs said.Fox has promised to fight the litigation. “We are proud of our 2020 election coverage and will vigorously defend this meritless lawsuit in court,” the network said in a statement the day before it canceled Mr. Dobbs’s show.Executives in conservative media argue that the Smartmatic lawsuit raises uncomfortable questions about how news organizations should present public figures: Ms. Powell was a conspiracist, but she was also the president’s lawyer. Should a media outlet be allowed to broadcast her claims?“There’s a new standard created out of this that is very dangerous for all the cable channels,” Christopher Ruddy, the owner of Newsmax and a Trump confidant, said in an interview on Saturday. “You have to fact-check everything public figures say, and you could be held libelous for what they say.” Mr. Ruddy contends that Newsmax presented a fair view of the claims about election fraud and voting technology companies.Newsmax personnel, though, were made aware of the potential damage stemming from claims that appeared on their shows. In an extraordinary on-air moment on Tuesday, Mike Lindell, the MyPillow founder and a staunch Trump ally, began attacking Dominion — and was promptly cut off by a Newsmax anchor, Bob Sellers, who read a formal statement that Newsmax had accepted the election results “as legal and final.”Fox executives revealed their own concerns in December, after Smartmatic sent a letter signaling that litigation was imminent. Fox News and Fox Business ran an unusually stilted segment in which an election expert, Edward Perez, debunked conspiracy theories about voter fraud that had recently been aired on the networks. The segment ran on three programs — those hosted by Mr. Dobbs, Ms. Bartiromo and Ms. Pirro. (Newsmax, which also received a letter from Smartmatic, aired its own clarifications.)This fear of liability has rippled into smaller corners of the right-wing media sphere. Mr. Giuliani, who hosts a show on the New York radio station WABC, was caught by surprise on Thursday when his employer aired a disclaimer during his show that distanced itself and its advertisers from Mr. Giuliani’s views.“They got to warn you about me?” Mr. Giuliani asked his listeners, sounding incredulous. “Putting that on without telling me — not the right thing to do. Not the right thing to do at all.”Yochai Benkler, a professor at Harvard Law School who studies disinformation and radicalization in American politics, said that the president’s lies about the election had pushed pro-Trump outlets beyond the relatively lax standards applied to on-air commentators.“The competitive dynamic in the right-wing outrage industry has forced them all over the rails,” Mr. Benkler said. “This is the first set of lawsuits that’s actually going to force them to internalize the cost of the damages they’re inflicting on democracy.”Mr. Benkler called the Smartmatic suit “a useful corrective” — “it’s a tap on the brakes” — but he also urged restraint. “We have to be very cautious in our celebration of these lawsuits, because the history of defamation is certainly one in which people in power try to slap down critics,” he said.Rudolph W. Trump’s most loyal media supporters, abruptly lost his pulpit on Friday when Fox Business canceled his weekday television show, which had become a frequent clearinghouse for baseless theories of electoral fraud in the weeks after Mr. Trump lost the 2020 presidential race.Mr. Dobbs’s decade-long tenure at the network ended with little warning — a guest host filled in for his Friday slot — only a day after the election technology company Smartmatic filed a defamation lawsuit against Rupert Murdoch’s Fox Corporation and Fox News.The suit, which seeks damages of at least $2.7 billion, also named Mr. Dobbs as an individual defendant along with two other Fox anchors, Maria Bartiromo and Jeanine Pirro. Smartmatic specifically cited Mr. Dobbs’s program, which by late last year had become so packed with falsehoods about Mr. Trump’s defeat that Fox Business was forced to run a fact-checking segment debunking some of its own anchor’s assertions.Executives at Fox did not elaborate on Friday about why they had canceled Mr. Dobbs’s program, which was the top-rated show on Fox Business and drew a bigger audience than its competition on CNBC. The network said in a statement that it regularly reviewed its programming lineup.“Plans have been in place to launch new formats as appropriate postelection, including on Fox Business,” the network said. “This is part of those planned changes.”A person familiar with Fox’s decision said the network’s concerns about Mr. Dobbs predated this week’s filing of the Smartmatic lawsuit. But the person, who requested anonymity to describe private personnel matters, conceded that Mr. Dobbs’s extreme and unrepentant endorsements of Mr. Trump’s false election claims had imperiled his position, as did other moments. For instance, on the day of siege at the U.S. Capitol, Mr. Dobbs described protesters as merely “walking between the rope lines.”The cancellation came as lawsuits and legal threats are rippling the landscape of media organizations popular with right-wing viewers. Dominion Voting Systems has sued two lawyers who represented Mr. Trump, Rudolph W. Giuliani and Sydney Powell, over false claims they made on Fox News and other outlets that the company aided President Biden’s victory, and it is considering additional litigation.Mr. Dobbs, 75, rose to fame as a CNN anchor, becoming a mainstay of television business news. He began hosting his Fox program in 2011, lured by the network’s co-founder Roger Ailes, and was watched by a soon-to-be-very influential fan: Mr. Trump, who shared Mr. Dobbs’s right-wing values, particularly the anchor’s hard-line stance against unchecked immigration.The men also shared an interest in questioning President Barack Obama’s birthplace, a canard that helped lead to Mr. Dobbs’s exit from CNN in 2009.At the White House, Mr. Trump came to see Mr. Dobbs’s program as required viewing; his allies learned that an appearance on “Lou Dobbs Tonight” would guarantee attention in the West Wing. The president even patched in the television host during some policy discussions with his White House staff.Mr. Trump, who was barred from Twitter last month, has been circumspect since leaving the White House in what subjects he comments on. But roughly an hour after the news of Mr. Dobbs’s departure broke, the former president issued a statement to The New York Times.“Lou Dobbs is and was great,” Mr. Trump said. “Nobody loves America more than Lou. For now, a rotating group of hosts will replace Mr. Dobbs in his 5 p.m. slot. The anchors Jackie DeAngelis and David Asman will sit in for him next week. (“Lou Dobbs Tonight” repeats at 7 p.m.) The cancellation was reported earlier by The Los Angeles Times.The Smartmatic lawsuit filed on Thursday cited a false claim from a November episode of “Lou Dobbs Tonight”: that Hugo Chávez, the former president of Venezuela, had a hand in the creation of Smartmatic technology, designing it so that the votes it processed could be changed undetected. (Mr. Chávez, who died in 2013, did not have anything to do with Smartmatic.)The Chávez claim was made by Ms. Powell, who worked as a lawyer for Mr. Trump and was a frequent guest on Mr. Dobbs’s program. She was also sued by Smartmatic on Thursday, along with Mr. Giuliani. Mr. Dobbs was also cited in the lawsuit for using the phrase “cyber Pearl Harbor” to describe a supposed vote-fraud conspiracy, borrowing language used by Ms. Powell.There are signs that the other hosts named in the suit, Ms. Bartiromo and Ms. Pirro, may be in a more favorable position with Fox management than Mr. Dobbs.It was clear weeks ago that defamation suits from Smartmatic and Dominion could be imminent. Since then, Ms. Bartiromo was picked to audition for a new 7 p.m. program on Fox News, and Ms. Pirro debuted a new travel program, “Castles USA,” on the Fox Nation streaming service, in which she visits castles around the country.Fox has pledged to fight the Smartmatic litigation, saying in a statement: “We are proud of our 2020 election coverage and will vigorously defend this meritless lawsuit in court.”Don Herzog, who teaches First Amendment and defamation law at the University of Michigan, said it was possible that canceling Mr. Dobbs could aid Fox in its defense of the lawsuit. If Mr. Dobbs had continued to discuss Smartmatic or promote election fraud on his program, the network could have been liable for each new claim, Mr. Herzog said.Fox officials could also argue that the lawsuit made them aware of untruths that Mr. Dobbs had helped spread. (Russian intelligence officers, in fact, had hacked and leaked the emails.)Fox’s decision to settle with the Rich family came just before its marquee hosts, Lou Dobbs and Sean Hannity, were set to be questioned under oath in the case, a potentially embarrassing moment. And Fox paid so much that the network didn’t have to apologize for the May 2017 story on FoxNews.com.But there was one curious provision that Fox insisted on: The settlement had to be kept secret for a month — until after the Nov. 3 election. The exhausted plaintiffs agreed.Why did Fox care about keeping the Rich settlement secret for the final month of the Trump re-election campaign? Why was it important to the company, which calls itself a news organization, that one of the biggest lies of the Trump era remain unresolved for that period? Was Fox afraid that admitting it was wrong would incite the president’s wrath? Did network executives fear backlash from their increasingly radicalized audience, which has been gravitating to other conservative outlets?Fox News and its lawyer, Joe Terry, declined to answer that question when I asked last week. And two people close to the case, who shared details of the settlement with me, were puzzled by that provision, too.The unusual arrangement underscores how deeply entwined Fox has become in the Trump camp’s disinformation efforts and the dangerous paranoia they set off, culminating in the fatal attack on the Capitol 11 days ago. The network parroted lies from Trump and his more sinister allies for years, ultimately amplifying the president’s enormous deceptions about the election’s outcome, further radicalizing many of Mr. Trump’s supporters.The man arrested after rampaging through the Capitol with zip-tie handcuffs had proudly posted to Facebook a photograph with his shotgun and Fox Business on a giant screen in the background. The woman fatally shot as she pushed her way inside the House chamber had engaged Fox contributors dozens of times on Twitter, NPR reported.High profile Fox voices, with occasional exceptions, not only fed the baseless belief that the election had been stolen, but they helped frame Jan. 6 as a decisive day of reckoning, when their audience’s dreams of overturning the election could be realized. And the network’s role in fueling pro-Trump extremism is nothing new: Fox has long been the favorite channel of pro-Trump militants. The man who mailed pipe bombs to CNN in 2018 watched Fox News “religiously,” according to his lawyers’ sentencing memorandum, and believed Mr. Hannity’s claim that Democrats were “encouraging mob violence” against people like him.Eric G. You can see why. Dog bites man is never news. Fox’s vitriol and distortions are simply viewed as part of the landscape now. The cable channel has been a Republican propaganda outlet for decades, and under President Trump’s thumb for years. So while the mainstream media loves to beat itself up — it’s a way, sometimes, of inflating our own importance — we have mostly sought less obvious angles in this winter’s self-examination. The Washington Post’s Margaret Sullivan concluded last week that the mainstream press is “flawed and stuck for too long in outdated conventions,” but “has managed to do its job.” MSNBC’s Mehdi Hasan said the media had “failed” by normalizing Trump.I took my turn last week, writing about how a man I worked with at BuzzFeed played a role in the insurrection. One thoughtful reader, a former engineer at Corning, wrote to me to say she’d been reckoning with a similar sense of complicity. The engineer was on the team that developed the thin, bright glass that made possible the ubiquitous flat screen televisions that rewired politics and our minds. She’s now asking herself whether “this glass made it happen.”When I shared the engineer’s email with some others at the Times, one, Virginia Hughes, a Science editor and longtime colleague, responded: “Everyone wants to blame themselves except the people who actually deserve blame.”And so let me take a break from beating up well-intentioned journalists and even the social media platforms that greedily threw open Pandora’s box for profit.There’s only one multibillion-dollar media corporation that deliberately and aggressively propagated these untruths. The elder Mr. Murdoch has long led Fox, to the extent anyone actually leads it, through a kind of malign negligence, and letting that lie persist seems just his final, lavish gift to Mr. Trump.The company paid handsomely for it, according to Michael Isikoff of Yahoo News, who first reported on the settlement and has covered the case extensively.The Murdoch organization didn’t originate the lie, but it embraced it, and it served an obvious political purpose: deflecting suspicions of Russian involvement in helping the Trump campaign. That’s why the story was so appealing to Fox hosts like Sean Hannity and Lou Dobbs, who kept hyping it for days after it collapsed under the faintest scrutiny. There has never been a shred of credible evidence that Seth Rich had contact with WikiLeaks, and a series of bipartisan investigations found that the D.N.C. had been breached by Russian hackers.The story of Fox’s impact on the fracturing of American society and the notion of truth is too big to capture in a single column. But the story of its impact on one family is singular and devastating. Seth Rich’s brother, Aaron, reflected on it Friday from his home in Denver, where he’s a software engineer. Aaron was still wrestling with the shock, reeling from the worst week of his life, when a friend told him that something was happening on Reddit. A news story had mentioned that Seth was a staff member at the Democratic National Committee. While some of the top comments were simply condolences, the lower part of the page was full of unfounded speculation that the young D.N.C. employee — not the Russians — had been WikiLeaks’ source of the hacked emails. Julian Assange of WikiLeaks encouraged the speculation, but it remained low-level chatter about confusing theories for about 10 months. That’s when Fox claimed that an anonymous federal investigator had linked Seth Rich to the leak.The story took off. It was like “throwing gasoline on a small fire,” Mr. Rich’s brother recalled in a telephone interview from his home in Denver. “Fox blew it out of everyone’s little echo chamber and put it into the mainstream.”The story collapsed immediately, and in spectacular fashion. The former Washington, D.C., police detective whom Fox used as its on-the-record source, Rod Wheeler, repudiated his own quotes claiming ties between Mr. Rich and WikiLeaks and a cover-up, and said in a deposition this fall that the Fox News article had been “prewritten before I even got involved.”“It fell apart within the general public within 24 hours,’’ Aaron Rich recalled, yet “Hannity pushed it for another week.” Finally, Aaron Rich said, he sent Mr. Hannity and his producer an email, and the barrage stopped, but he said he never received an apology from the Fox host.“He never got back to me to say, sorry for ruining your family’s life and pushing something there’s no basis to,” he said. “Apparently, ‘sorry’ is a hard five-letter word for him.”A Fox News spokeswoman, Irena Briganti, declined to comment on Mr. Rich’s request for an apology.Fox also pulled the story down a week after it was published, with an opaque statement that “the article was not initially subjected to the high degree of editorial scrutiny we require for all our reporting.”The damage had been done. The story is still in wide circulation on the right, to the point where Mr. Rich was reluctant to share a photograph of himself and his brother for this story with The New York Times. When I asked him about Rupert Murdoch, he wasn’t sure who he was — “I’m really bad at trivia things.” That’s the genius of the Murdochs’ management of the place: They collect the cash while evading responsibility and letting their hosts work primarily for Mr. Trump.Mr. Rich isn’t party to the settlement with his parents, and he declined to discuss its details. It would offer its services to what would obviously be a growth industry: electronic voting machines. He began building a global company that ultimately provided voting machinery and software for elections from Brazil to Belgium and his native Venezuela. He even acquired an American company, then called Sequoia.Last month, Mr. Mugica initially took it in stride when his company’s name started popping up in grief-addled Trump supporters’ wild conspiracy theories about the election.“Of course I was surprised, but at the same time, it was pretty clear that these people were trying to discredit the election and they were throwing out 25 conspiracy theories in parallel,” he told me in an interview last week from Barbados, where his company has an office. “I thought it was so absurd that it was not going to have legs.”But by Nov. 14, he knew he had a problem. That’s when Rudy Giuliani, serving as the president’s lawyer, suggested that one voting company, Dominion Voting Systems, had a sinister connection to vote counts in “Michigan, Arizona and Georgia and other states.” Mr. Giuliani declared on Twitter that the company “was a front for SMARTMATIC, who was really doing the computing. Look up SMARTMATIC and tweet me what you think?”Soon his company, and a competitor, Dominion — which sells its services to about 1,900 of the county governments that administer elections across America — were at the center of Mr. Giuliani’s and Sidney Powell’s theories, and on the tongues of commentators on Fox News and its farther-right rivals, Newsmax and One America News.“Sidney Powell is out there saying that states like Texas, they turned away from Dominion machines, because really there’s only one reason why you buy a Dominion machine and you buy this Smartmatic software, so you can easily change votes,” the Newsmax host Chris Salcedo said in one typical mash-up on Nov. 18. Maria Bartiromo of Fox Business reported on Nov. 15 that “one source says that the key point to understand is that the Smartmatic system has a backdoor.”The Fox Business host Maria Bartiromo.Credit…Monica Schipper/Getty ImagesHere’s the thing: Smartmatic wasn’t even used in the contested states. The company, now a major global player with over 300 employees, pulled out of the United States in 2007 after a controversy over its founders’ Venezuelan roots, and its only involvement this November was with a contract to help Los Angeles County run its election.In an era of brazen political lies, Mr. Mugica has emerged as an unlikely figure with the power to put the genie back in the bottle. Last week, his lawyer sent scathing letters to the Fox News Channel, Newsmax and OAN demanding that they immediately, forcefully clear his company’s name — and that they retain documents for a planned defamation lawsuit. He has, legal experts say, an unusually strong case. And his new lawyer is J. Erik Connolly, who not coincidentally won the largest settlement in the history of American media defamation in 2017, at least $177 million, for a beef producer whose “lean finely textured beef” was described by ABC News as “pink slime.”Now, Mr. Connolly’s target is a kind of red slime, the stream of preposterous lies coming from the White House and Republican officials around the country.“We’ve gotten to this point where there’s so much falsity that is being spread on certain platforms, and you may need an occasion where you send a message, and that’s what punitive damages can do in a case like this,” Mr. Connolly said.Mr. Mugica isn’t the only potential plaintiff. Dominion Voting Systems has hired another high-powered libel lawyer, Tom Clare, who has threatened legal action against Ms. Powell and the Trump campaign. Mr. Clare said in an emailed statement that “we are moving forward on the basis that she will not retract those false statements and that it will be necessary for Dominion to take aggressive legal action, both against Ms. Powell and the many others who have enabled and amplified her campaign of defamation by spreading damaging falsehoods about Dominion.”These are legal threats any company, even a giant like Fox Corporation, would take seriously. And they could be fatal to the dream of a new “Trump TV,” a giant new media company in the president’s image, and perhaps contributing to his bottom line. Newsmax and OAN would each like to become that, and are both burning money to steal ratings from Fox, executives from both companies have acknowledged. They will need to raise significantly more money, or to sell quickly to investors, to build a Fox-style multibillion-dollar empire. But outstanding litigation with the potential of an enormous verdict will be enough to scare away most buyers.And so Newsmax and OAN appear likely to face the same fate as so many of President Trump’s sycophants, who have watched him lie with impunity and imitated him — only to find that he’s the only one who can really get away with it. Mr. Trump benefits from presidential immunity, but also he has an experienced fabulist’s sense of where the legal red lines are, something his allies often lack. Three of his close aides were convicted of lying, and Michael Cohen served more than a year in prison. (Trump pardoned Michael Flynn and commuted the sentence of Roger Stone.)OAN and Newsmax have been avidly hyping Mr. Trump’s bogus election claims. OAN has even been trying to get to Newsmax’s right, by continuing to reject Joe Biden’s status as president-elect. But their own roles in propagating that lie could destroy their businesses if Mr. Mugica sues.The letters written by lawyers for Smartmatic and Dominion are “extremely powerful,” said Floyd Abrams, one of the country’s most prominent First Amendment lawyers, in an email to The New York Times. “The repeated accusations against both companies are plainly defamatory and surely have done enormous reputational and financial harm to both.”Mr. Abrams noted that “truth is always a defense” and that, failing that, the networks may defend themselves by saying they didn’t know the charges were false, while Ms. Powell may say she was simply describing legal filings.“It is far too early to predict how the cases, if commenced, will end,” he said. “But it is not too early to say that they would be highly dangerous to those sued.”Lawyers said they expected that the right-wing networks, if sued, would argue that Smartmatic and Dominion should be considered “public figures” — which would require the companies to prove that its critics were malicious or wildly reckless, not just wrong.Mr. Connolly said he would argue that Smartmatic was not a public figure, a legal status whose exact meaning varies depending on whether Mr. Mugica files suit in Florida, New York or another state.“They have a very good case,” another First Amendment lawyer who isn’t connected to the litigation, the University of Florida professor Clay Calvert, said of Smartmatic. “If these statements are false and we are taking them as factual statements, that’s why we have defamation law.”Fox News and Fox Business, which have mentioned Dominion 792 times and Smartmatic 118 times between them, according to a search of the service TVEyes, appear to be taking the threat seriously. Over the weekend, they broadcast one of the strangest three-minute segments I’ve ever seen on television, with a disembodied and anonymous voice flatly asking a series of factual questions about Smartmatic of an expert on voting machines, Eddie Perez, who debunks a series of false claims. The segment, which appeared scripted to persuade a very literal-minded judge or jury that the network was being fair, aired over the weekend on the shows hosted by Lou Dobbs, Jeanine Pirro and Maria Bartiromo, where Mr. Giuliani and Ms. Powell had made their most outlandish claims.Newsmax said in an emailed statement that the channel “has never made a claim of impropriety about Smartmatic, its ownership or software” and that the company was merely providing a “forum for public concerns and discussion.” An OAN spokeswoman didn’t respond to an inquiry.I’m reluctant to cheer on a defamation case against news organizations, even networks that appear to be amplifying dangerous lies. Companies and politicians often exploit libel law to threaten and silence journalists, and at the very least subject them to expensive and draining litigation.And defamation cases can also collide with subjects of genuine public interest, as in the most prominent case I’ve been involved in, when a businessman sued me and my colleagues at BuzzFeed News for publishing the Steele Dossier, while acknowledging that it was unverified.
