    Chancellor Olaf Scholz and his governing coalition emerged battered from the vote for the European Parliament. Whereas President Macron could call a new election for the French Parliament, a new vote in Germany can only happen at the end of a complicated procedure triggered by a parliamentary majority vote of no confidence in the chancellor. That makes snap elections extremely rare in Germany — happening only three times in the 75-year history of the Federal Republic.While the three parties in the coalition government took a beating on the E.U. level, at home they still have a majority of seats in the German Parliament.     Macron’s Early Election Call After EU Vote Is a Huge Gamble

    The president has challenged voters to test the sincerity of their support for the far right in European elections. Were the French letting off steam, or did they really mean it?On the face of it, there is little logic in calling an election from a position of great weakness. But that is what President Emmanuel Macron has done by calling a snap parliamentary election in France on the back of a humiliation by the far right.After the National Rally of Marine Le Pen and her popular protégé Jordan Bardella handed him a crushing defeat on Sunday in elections for the European Parliament, Mr. Macron might have done nothing, reshuffled his government, or simply altered course through stricter controls on immigration and by renouncing contested plans to tighten rules on unemployment benefits.Instead, Mr. Macron, who became president at 39 in 2017 by being a risk taker, chose to gamble that France, having voted one way on Sunday, will vote another in a few weeks.“I am astonished, like almost everyone else,” said Alain Duhamel, the prominent author of “Emmanuel the Bold,” a book about Mr. Macron. “It’s not madness, it’s not despair, but it is a huge risk from an impetuous man who prefers taking the initiative to being subjected to events.”Shock coursed through France on Monday. The stock market plunged.     Calls to Pause Slovakia’s E.U. Election Campaigning Raise Questions

    Calls are growing in Slovakia for political parties to suspend campaigning for the European Union elections, just three weeks away, in the wake of the assassination attempt on the prime minister in the sharply polarized country.The president-elect of Slovakia, Peter Pellegrini, and others say the step is necessary to avoid further inflammatory political discourse, which has escalated further since the shooting that left Prime Minister Robert Fico badly wounded. At least one party, the opposition Progress Slovakia party, said it would immediately suspend its campaign, to help “end the spiral of attacks and blame.”The local news media reported that another party, the Christian Democratic Movement, had also paused campaigning.It is not clear how long such suspensions would last or what that would mean for Slovakia’s participation in the E.U. elections, which happen every five years. Voters across the European Union will elect 720 European Parliament representatives, with polling scheduled to take place in all 27 of the bloc’s members from June 6 to 9. Slovak voters are set to cast their ballots on June 8.Candidates for E.U. elections come mostly from established national parties, so voters tend to be familiar with their agendas. A temporary suspension in campaigning would therefore not necessarily affect Slovakian voters’ ability to decide whom they support, provided that campaigning does resume and that elections are held as planned.Officials at the European Parliament and the European Commission did not respond to requests for comment on the calls to suspend campaigning and whether it could have an impact on the bloc’s voting.National electoral authorities are responsible for handling the voting, and the results are managed locally.     In Hungary, Viktor Orban Remakes an Election to His Liking

    BUDAPEST — During the dark winter of the 2020 coronavirus wave, the Hungarian government set up a website so anxious residents could sign up for the news on the pandemic. For months, the system sent out updates about the virus, testing and where to get vaccinated.But last month, long after the vaccination drive had peaked, the system blasted out a very different type of alert: an email claiming, falsely, that opponents of Prime Minister Viktor Orban were agitating to drag Hungary into the war in Ukraine.“This is cheating,” said Klara Dobrev, a Hungarian member of the European Parliament and one of those accused in the email. “Using public money for obviously party propaganda? This is obviously election fraud.”In more than a decade in power, Mr. Orban has not hesitated to use the levers of government power to erode democratic norms and cement one-party rule. He has rewritten the Constitution, remade the courts and used state-run and privately owned television stations — even school textbooks — to advance his agenda or push misinformation about his rivals.He has always justified his brand of what he calls “illiberal democracy” by pointing out that, like other European leaders, he has won free and fair elections. He put an inflammatory but ultimately symbolic L.G.B.T. referendum up for a vote, a move that is likely to rally his most strident supporters. And he legalized the registration of voters outside of their home districts — a common practice, until now criminal, that is known as “voter tourism.”All of that is playing out in a media echo chamber, since Mr. Orban has cemented control of public television to the point where stories, photos and guests are handpicked to align with his talking points. Many of the largest independent news outlets have been taken over by Mr. Orban’s supporters.The situation is considered so extraordinary that the Organization for Security and Cooperation in Europe, an intergovernmental organization, is sending observers to monitor the elections. Mr. Orban, who is seeking his fourth consecutive term and fifth overall, has become a hero among many American conservatives, who are also locked in their own fights over voting laws and access to the polls.When it comes to election fairness, Hungary now more closely resembles the Soviet era than the free elections that followed the fall of Communism, according to the Swedish nonprofit group V-Dem, which rates countries on a host of democratic indicators.“Election fraud doesn’t start at 7 a.m., when the polls are open,” Ms. Dobrev said. “Election fraud has been going on in Hungary for years.”Signing the PapersIn the tiny village of Kispalad, at the northeastern tip of Hungary along the border with Ukraine, the mayor summoned a local woman to the town hall to sign some papers. It was mid-2014, and the mayor, a member of Mr. Orban’s party, was locked in a tight re-election race.The woman, Jozsefne Sanko, was a seasonal cucumber-picker and would soon be out of work. That made them eligible to vote in Hungarian elections.The mayor’s offer was part of a common tactic in Hungary called voter tourism, which allows nonresidents to register using addresses in Hungary. On Election Day, they cross the border by car, bike or bus, then vote and return home.Until recently, voter tourism was a type of fraud. Ms. Sanko and the mayor received fines in 2020 after what she had done became a local scandal.But Mr. Orban has legalized the practice for the upcoming election. He is popular in these rural villages, but since the government refuses to make historical voter data public, it is impossible to know whether voter tourism has changed the outcome in any of these small districts.Mr. Sanko believes it can. In every election, he said voters arrive from out of the country with lists of names they are expected to vote for. “Now, this is totally legal,” he said.“I can’t remember the last time the stars aligned so well, 19 days before an election,” Mr. Orban declared at a rally this month.Anna Szilagyi/Associated PressVoter tourism also has something of a mail-in equivalent.Hungarian citizens can mail in their ballots, but only if they do not have a residence in the country. That overwhelmingly applies to ethnic Hungarians in neighboring countries like Romania and Serbia, a constituency whose votes Mr. Orban has courted for years.By contrast, roughly 100,000 Hungarian citizens live in the United Kingdom, a more left-leaning voting bloc that includes students and foreign workers. But voters in Britain must travel in person to London or Manchester to cast ballots. Mr. Orban’s government has rejected calls to open more polling places.A Supermajority in Name OnlyTo understand one of the ways Mr. Orban has reshaped democracy, consider this: When his political party, Fidesz, won the last two national elections, it received less than half the votes, yet still secured a two-thirds supermajority in Parliament. The supermajority has allowed Mr. Orban to ram through changes to the Constitution as part of his illiberal agenda.The explanation lies in Hungary’s complex electoral system: The country is divided into 106 districts, each of which elects a member to Parliament, much like members of Congress are seated in the United States. But then another 93 seats are awarded to political parties based on a unique formula.Mr. Orban changed that formula for handing out seats in dramatic fashion to benefit Fidesz. But to counter him, Socialists, Greens, centrists, fiscal hawks and Christian conservatives have united behind the economist Peter Marki-Zay in a long shot bid to beat Mr. Orban, or at least shatter his supermajority since Mr. Marki-Zay has a six-party coalition behind him.Mr. Laszlo, the independent election analyst, estimates that because of the gerrymandered districts and new election rules, the opposition will need to win by as much as six percentage points to unseat Mr. Orban.“There’s a debate among the opposition on whether you should even take part in the election, whether you legitimize it by taking part in it,” said Gergely Karacsony, the mayor of Budapest and a leading opposition politician.Gerrymandering is just one problem for the opposition. Television time is another.Early on a Wednesday morning, less than three weeks before the election, the leader of the opposition party, Mr. Marki-Zay, was given his first and only appearance on Hungary’s largest public television station.“Thanks for allowing the entire opposition five minutes in the past four years to speak,” Mr. Marki-Zay said during his appearance. “That I could not come here until now is likely for the same reason that Viktor Orban is unwilling to partake in a live debate. Opposition parties can’t pay for political advertising on television because it is illegal — even though the public channels regularly put out “public service” announcements that critics say are thinly veiled ads for Mr. Orban or his agenda.Stories that criticize Mr. Orban’s favorite targets — the billionaire George Soros or the European Union, for example — are welcome. Photos of women and children who are refugees, for example, were prohibited, as they might garner sympathy and undermine Mr. Orban’s hard-line anti-immigration stance.“There was an explicit order against this,” said Andras Rostovanyi, who was an editor with the state broadcaster M1 until the end of 2019.In one news meeting, a recording of which was obtained by Radio Free Europe, an editor is heard telling reporters that the station does not support Mr. Orban’s opponents, and anyone who objects to that policy can leave.Mr. Orban with President Vladimir V. Putin.With Russian troops laying siege to civilians in nearby Ukraine, Mr. Orban might have faced pointed questions about his past support of Mr. Putin; instead, he has simply rewritten the narrative.One example is a pro-Orban website and Facebook page “Numbers and Facts,” which links to it. Both post the same content. Every day, they churn out headlines that cheer Mr. Orban.     Roberta Metsola Elected as President of European Parliament

    Roberta Metsola of Malta will succeed David Sassoli, an Italian politician who died last week, at a critical time for the institution.BRUSSELS — The European Parliament elected a new president on Tuesday, with Roberta Metsola, a 43-year-old Maltese deputy, picked to lead the institution as its seeks to gain a more prominent place in the E.U. power structure.Ms. Metsola’s predecessor, David Sassoli, died at age 65 last week, and she was selected by an overwhelming majority over two other candidates, all women.The European Union of 27 nations, one of the world’s most ambitious political experiments, is home to 450 million people. The Parliament is the bloc’s only directly elected institution, and voters have been electing lawmakers to the body since 1979, when the union was much smaller.Despite the holding of European Parliament elections every five years, the European Union has a complicated structure and is often accused of being a murky bureaucratic machine, detached from its citizens and lacking democratic accountability, even as it grows in power.“In the next years, people across Europe will look to our institution for leadership and direction, while others will continue to test the limits of our democratic values and European principles,” Ms. Metsola told lawmakers after being elected. “We must fight back against the anti-E.U. narrative that takes hold so easily and so quickly.”Ms. Metsola, a member of the conservative European People’s Party, the Parliament’s largest political group, has a daunting task in leading the most fragmented chamber in decades as it tackles issues such as curbing carbon emissions, upholding the rule of law and setting out rules for major technology companies.European Parliament in 2020. The three branches often compete with one another for influence, with the Parliament struggling for relevance and usually coming out the weakest.The dance between the E.U. institutions has been unfolding against the backdrop of a larger conundrum: Can the bloc, which has positioned itself as a defender of democracy and which governs many aspects of the lives of Europeans, become more democratic while maintaining its current structure?“The European Union is an unfinished political system,” said Sophie Pornschlegel, a senior policy analyst at the European Policy Center, a Brussels-based think tank. “It’s a question of perspective,” she noted. “If you look at it like an international organization, it is one of the most democratic ones. Obviously, if you compare it to national democracies, it has a democratic deficit.”But according to Ms. Pornschlegel, that comparison would not be fair. “So far, we don’t have the United States of Europe,” she said, referring to a more deeply integrated federal power structure. “It’s much more complicated than that.”The European Parliament can veto legislation, set up budgets, ratify international agreements and has a supervisory role over various institutions. It also has the final say in approving the president of the European Commission.But in December 2019, when the current head of the commission, Ursula von der Leyen, was appointed, national leaders reneged on their promise to nominate a president from candidates proposed by the Parliament’s lawmakers, which was seen as a major blow to the institution’s standing. Lawmakers also cannot dismiss individual commissioners, but can only disband the commission as a whole.The European Commission president, Ursula von der Leyen, second left, was appointed in 2019.Pool photo by Aris OikonomouAnd in an important divergence from national legislatures, the European Parliament does not have the power to initiate laws, which many see as a huge hindrance. “It puts you in a reactive mode,” said Marietje Schaake, a former member of the European Parliament who now teaches at Stanford University. “It is a major flaw in the design of the union.”Alberto Alemanno, a professor of European Union law at the business school HEC Paris, put it more bluntly. “The European Parliament is neither a parliament, because it has no legislative initiative, nor is it European, because its members are elected at the national and not at the European level,” he said.But analysts say that in recent years the Parliament has gained prominence, expressed both through an increased turnout in the 2019 elections and through a series of unusually bold moves.Under Mr. Sassoli, an Italian, the Parliament took the European Commission to court for not using existing rules to cut funding for member countries breaching rule-of-law standards. And in May, lawmakers blocked a high-profile investment agreement between the bloc and China, citing human rights violations and sanctions against Europeans critical of Beijing, including some lawmakers.As the position of the Parliament has evolved, so has the role of its president. “It is no longer the role of a ceremonial figure, like the president of the German republic,” Professor Alemanno said. “The president is somebody who can allow the European Parliament to advance their political goals and defend its prerogatives. But it will depend on their personality, and their political affiliation.”In many ways, Ms. Metsola, a former lawyer, brings novelty to the role. Nearly 60 percent of the legislators are men, and the average age is about 50. And Ms. Metsola is the first president to come from Malta, the bloc’s smallest member nation.But in other ways, Ms. Metsola is a mainstream choice. She belongs to the Parliament’s dominant group, which is also home to the party of Ms. von der Leyen. But she has faced criticism over her socially conservative views, in particular her stance against abortion. She said that once elected, she would push forward “the position of the house” on reproductive rights.Referring to Ms. Metsola’s vote against a resolution condemning Poland’s anti-abortion laws, Alice Kuhnke, a Green candidate for president, said, “All women in the E.U. should rely on the president of the Parliament to fight for us when needed.”“I find it hard to see how she would manage to do that with credibility and strength,” Ms. Kuhnke added, in an interview before Ms. Metsola was confirmed as president.The institution of the Parliament has often been chided for not upholding the principles it preaches. Transparency International, an anticorruption watchdog, said in a recent report that the Parliament’s internal rules were not sufficient to guarantee accountability of lawmakers. Despite the systemic flaws, there are reasons for the Parliament to be optimistic, analysts say. In a recent poll, 63 percent of Europeans said that they would like the body to play a more important role. One proposal would see some lawmakers elected from Pan-European rather than national lists, aiming to bolster the connection with voters across the bloc. But in typical E.U. fashion, it is unclear whether such a change would be ready before the next election, planned for 2024. More

    The Risk of a No-Deal Brexit Remains

    The risk that we will wake up on May 1 to find we have a no-deal Brexit after all has not disappeared. The deadline for the ratification by the European Parliament of the trade deal between the European Union and the United Kingdom was due to be February 28. But Parliament postponed the deadline to April 30. It did this because it felt it could not trust the UK to implement the Trade and Cooperation Agreement (TCA) — as the deal is formally known as — properly and as agreed and ratified. 

    This distrust arose because the implementation of the Ireland and Northern Ireland Protocol of the withdrawal agreement — the treaty that took the UK out of the EU — had been unilaterally changed by the British government. If a party to an international agreement takes it upon itself to unilaterally alter a deal, the whole basis of international agreements with that party disappears.

    The matters in dispute between the UK and the EU — the protocol and COVID-19 vaccines — remain unresolved. The European Union is taking the United Kingdom to court over the protocol, but the court is unlikely to decide anything before the new deadline of April 30.

    In the normal course of events, the TCA between the UK and the EU would be discussed in the relevant committee of the European Parliament, before coming to the plenary session of Parliament for ratification. The next meeting of the Committee on International Trade is due to take place on April 14-15, and the agenda for the meeting has been published. It includes a discussion on the enforcement of trade agreements, the general system of preferences and, significantly, trade-related aspects of the COVID-19 pandemic. It makes no mention of the TCA with the UK.

    Trade-related aspects of the pandemic will inevitably include a discussion on vaccine protectionism, which is a highly contentious issue between the EU and the UK that has poisoned relations and led to bitter commentary in the media. The fact that the committee has not included a discussion of the TCA with the UK on its agenda for what may well be the only meeting it will have before the April deadline is potentially very significant.

    Ratifying the Trade Deal

    The TCA is a 1,246-page document, and its contents, if ratified, will take precedence over EU law. To ratify such an agreement without proper scrutiny in the relevant committees could be seen as a dereliction of the European Parliament’s responsibility of scrutiny. We should not forget the scrutiny that was applied to the much more modest EU trade agreement with Canada. The same goes for the deal with Mercosur states (Argentina, Brazil, Paraguay and Uruguay).

    Furthermore, the TCA would, if ratified, set up a network of committees to oversee its implementation. These will meet in private and their work will diminish the ongoing oversight by the European Parliament of a host of issues affecting all 27 EU member states. The TCA also contains a system of dispute-resolution mechanisms that will quickly be overwhelmed by work. The TCA has many items of unfinished business, on which the European Parliament will want to express a view. It is hard to see how any of this can be done before the end of April.

    The UK government led by Prime Minister Boris Johnson has adopted a deliberately confrontational style in its negotiations with the European Union. The more rows there are, the happier the support base that Johnson is seeking to rally for his Conservative Party. Johnson’s European strategy has always been about electoral politics, not economic performance. This has led to almost complete confusion between the British government and the EU.

    If the European Parliament ratifies the TCA without there having been seen to be a satisfactory outcome to the EU-UK negotiations about the Ireland and Northern Ireland Protocol and over the export of vaccines, it will be a political setback for Parliament and a source of immense satisfaction for Johnson.

    Yet one should never underestimate the role emotion can play in politics. The entire Brexit saga is a story of repeated triumphs of emotion over reason — and the European Parliament is not immune to this ailment. Boris Johnson could be pushing his luck a bit far this time.

Spain’s judiciary has charged that their bid was unconstitutional.The vote on Monday ended a lengthy battle by Mr. Puigdemont and his colleagues to use their protection as elected members of the European assembly to shield them from prosecution in Spain. Now it is up to the Belgian judiciary to rule on whether Mr. Puigdemont should be sent back to the Spanish capital, Madrid, to stand trial.“It is a sad day for the European Parliament,” Mr. Puigdemont said. “We have lost our immunity, but the European Parliament has lost more than that and as a result, European democracy too,” he said, adding that this was “a clear case of political prosecution.”The Spanish government welcomed the vote.“The problems of Catalonia will not be solved in Europe or by Europe. They have to be solved in Spain by bringing all Catalan forces around the table,” said the foreign minister, Arancha González Laya. The Belgian court argued that the Spanish Supreme Court did not have the legal authority to issue an arrest warrant against Mr. Puig, adding that he should be tried in a regional court.Part of Mr. Puigdemont’s former government, however, stayed in Spain and stood trial before the country’s Supreme Court. Nine Catalans received prison sentences after they were convicted of crimes including sedition and misuse of public funds.One former Catalan leader, Oriol Junqueras, was also barred by Spain’s highest court from taking his seat in the European Parliament. It is still reviewing the case of Ioannis Lagos, who was sentenced in Greece last year for his activities with the far-right Golden Dawn party. The Greek government considers Golden Dawn a criminal organization.The Catalan case has divided politicians in Brussels, many of them loathe to set a precedent of lawmakers being tried over political activity.
