    Arizona Democrats Censure Sinema After Filibuster Vote

    Kyrsten Sinema, a first-term Arizona senator, was rebuked by fellow Democrats in her state after her vote on the filibuster helped sink the party’s voting-rights legislation.PHOENIX — A rift between Senator Kyrsten Sinema and fellow Democrats back home in Arizona deepened on Saturday as the state party formally rebuked Ms. Sinema for refusing to change the Senate’s filibuster rules to pass sweeping voting rights legislation.The censure from the party’s executive board was symbolic, but it crystallized a growing sense of anger and frustration among liberal activists and Democratic voters aimed at Ms. Sinema.They accuse Ms. Sinema, a first-term senator, of impeding key parts of President Biden’s agenda, and have vowed to withhold donations and search for a liberal primary challenger when she is up for re-election in two years. Activists have staged protests outside her office and begun a hunger strike to urge Ms. Sinema to support changing the Senate rules to allow voting-rights legislation to pass with a simple majority of the 100 senators rather than the 60 votes required under Senate rules.But she has steadfastly refused, and reiterated her opposition to scrapping the filibuster in a Jan. 13 speech on the Senate floor, arguing that the parliamentary tactic “has been used repeatedly to protect against wild swings in federal policy.”Ms. Sinema said that she supported the Democratic voting-rights legislation, but that she believed doing away with the filibuster would worsen America’s political divisions.The opposition from Ms. Sinema and Senator Joe Manchin III of West Virginia to changing the 60-vote threshold required in the Senate to move major legislation forward has all but doomed the Democrats’ hopes of passing federal voting legislation.The Arizona Democratic chairwoman, Raquel Terán, said on Saturday that the party’s executive board had voted for the censure because of Ms. Sinema’s “failure to do whatever it takes to ensure the health of democracy.”State Representative Raquel Terán during a vote on the Arizona Budget in Phoenix last year.Ross D. Democrats nationally cite a barrage of Republican legislation aimed at the rules for voting, as well as counting and certifying votes as a fundamental threat to American democracy.“The ramifications of failing to pass federal legislation that protects their right to vote are too large and far-reaching,” Ms. Terán said in a statement.Hannah Hurley, a spokeswoman for Ms. Sinema, said in a statement that Ms. Sinema had been consistent about her opposition to changing the filibuster.“Kyrsten has always promised Arizonans she would be an independent voice for the state — not for either political party,” Ms. Hurley said. “She’s delivered for Arizonans and has always been honest about where she stands.”Arizona’s other senator, Mark Kelly, also a Democrat, said last week that he would support weakening the filibuster rules to pass voting rights legislation.Ms. Sinema, a onetime Green Party-affiliated activist, has won praise from Republicans and infuriated Democrats by bucking her own party as a senator who represents a closely divided swing state.In being censured by her own party, she joins a club that includes former Senator John McCain, former Senator Jeff Flake and the state’s sitting Republican governor, Doug Ducey, who have all been censured by the Arizona State Republican Party.Barrett Marson, a Republican political strategist, said that those censures of prominent Arizona Republicans by their own party had little effect, and that he doubted the censure alone would hurt Ms. Sinema’s political fortunes. But, he said Ms. Sinema’s problems go far deeper than the censure vote.“The censure in and of itself means absolutely nothing,” Mr. Marson said. “It’s a feckless move. However, Senator Sinema certainly has a broader problem than just a censure from the party faithful.”Those problems include fierce discontent among Democratic voters, who have signaled that they might prefer a liberal alternative to Ms. Sinema, such as Representative Ruben Gallego, a Phoenix congressman some activists are hoping to draft into a primary.The fund-raising group Emily’s List, a major supporter of Ms. Sinema in her 2018 run for Senate, has also threatened to pull its support, and she has recorded flagging numbers among her Democratic base in recent polls.A new survey of Arizona voters, conducted this month, but not yet released, by OH Predictive Insights, a Phoenix polling and research firm, found a 30-point gulf in support for Arizona’s senators among Democrats. While 74 percent of Democrats said they had favorable views of Mr. Kelly, just 42 percent of Democrats felt the same about Ms. Sinema. At the same time, the survey also found some evidence that Ms. Sinema could be vulnerable among the wider electorate as well. On the whole, by a nine-point margin, voters said they viewed her unfavorably, while they were about evenly split on their opinions of Mr. Kelly. “To be under all this pressure for so long, and she hasn’t wavered — you’ve got to give a little credit for that,” said Mike Noble, the chief of research at OH Predictive Insights. “But she’s not going to be on a lot of people’s Christmas card lists next year.” More

    Emily’s List Presses Kyrsten Sinema Over Filibuster Stance

    The powerful political action committee said the Arizona senator could find herself “standing alone” in 2024 if she refuses to change Senate rules to force through voting rights legislation.WASHINGTON — One of the largest contributors to Senator Kyrsten Sinema’s political rise announced on Tuesday that it would cut off its financial support if the senator continues to refuse to change the Senate’s filibuster rules to allow for passage of far-reaching voting rights legislation.Emily’s List, the largest funder of female Democratic candidates who support abortion rights, made the extraordinary announcement as the Senate barreled toward votes this week on a bill to reverse restrictions on voting passed by a number of Republican-led state legislatures.If, as expected, Republicans block the bill with a filibuster, Democratic leaders plan to try to change the Senate’s rules to overcome the minority party’s opposition. To do that, Democratic leaders would need all 50 members of their caucus on board. But Ms. Sinema, Democrat of Arizona, has said she will not vote to change the rules, making her — along with another holdout from her party, Senator Joe Manchin III of West Virginia — a target of liberal activists’ ire.“Understanding that access to the ballot box and confidence in election results are critical to our work and our country, we have joined with many others to impress upon Senator Sinema the importance of the pending voting rights legislation in the Senate,” Laphonza Butler, the president of Emily’s List, said in a statement. “So far those concerns have not been addressed.”She added, “Right now, Senator Sinema’s decision to reject the voices of allies, partners and constituents who believe the importance of voting rights outweighs that of an arcane process means she will find herself standing alone in the next election.”In a statement on Tuesday night, Ms. Sinema noted that the filibuster “has been used repeatedly to protect against wild swings in federal policy, including in the area of protecting women’s health care.”“Different people of good faith can have honest disagreements about policy and strategy,” she said. “Such honest disagreements are normal, and I respect those who have reached different conclusions on how to achieve our shared goals of addressing voter suppression and election subversion, and making the Senate work better for everyday Americans.”Emily’s List faced growing pressure from liberal activists and its own donors to take a stand ahead of this week’s showdown.     Welcome to the ‘Well, Now What?’ Stage of the Story

    Doug Mills/The New York TimesGail Collins: Bret, I suspect that even some diligent readers roll their eyes and turn the proverbial page when the subject of the filibuster comes up.Bret Stephens: In the thrills department it ranks somewhere between budget reconciliation and a continuing resolution.Gail: Yet here we are. Looks like Joe Biden’s voting rights package is doomed because he can’t get 60 votes in the Senate to break a filibuster. I’m inclined to sigh deeply and then change the subject, but duty prevails.Bret: It’s another depressing sign of Team Biden’s political incompetence. How did they think it was a good idea for the president to go to Georgia to give his blistering speech on voting rights without first checking with Kyrsten Sinema that she’d be willing to modify the filibuster in order to have a chance of passing the bill? And then there was the speech itself, which struck me as … misjudged. Your thoughts?Gail: If you mean, was it poorly delivered — well, after all these years we know that’s the Biden Way. He can rise above, as he did with the speech about the Jan. 6 uprising, but it’s not gonna happen a whole lot.Bret: I meant Biden’s suggestion that anyone who disagreed with him was on the side of Jefferson Davis, George Wallace and Bull Connor. The increasingly casual habit of calling people racist when they disagree with a policy position is the stuff I’ve come to expect from Twitter, not a president who bills himself as a unifier. And again, it’s political malpractice, at least if the aim is to do more than just sound off to impress the progressive base.Gail: I don’t see anything wrong with expressing anger about the way some states operate their elections. Making it very tough to vote by mail. Requiring citizens to register at least 30 days before the actual election, like Mississippi does. Can’t tell me the goal isn’t to restrict the number of voters, particularly new voters who won’t necessarily feel super welcome at the polls.Bret: A lot of the allegedly restrictive voting laws in red states are actually the same or better than they are in some of the blue states. For instance, Georgia has 17 days of early voting. New Jersey has nine. Georgia allows anyone to vote by mail. Absent a pandemic, New York only allows it if you’re out of town or have a prescribed excuse.Even if there are aspects of these laws that could be improved, I don’t see how this adds up to Jim Crow 2.0, as the president seems to think. He’d do better working to fix the Electoral Count Act, or make it a felony — if it isn’t one already — to pressure state officials to meddle with the vote, the way Donald Trump did with Georgia’s Brad Raffensperger when he asked him to “find 11,780 votes.”Gail: Well we are in total agreement about the Electoral Count Act of 1887. Back to Kyrsten Sinema for a minute — nothing is going to induce her to do anything that would threaten the filibuster, also known as the Rule That Makes Senator Sinema Marginally Relevant.Bret: You won’t be surprised to learn that I like the newest Arizona maverick more and more. Everyone hates the filibuster until it’s their turn to be in the Senate minority, at which point it becomes a vital institutional safeguard against the tyranny of the majority. I take it you don’t agree …Gail: Well, I’d like to go back to the days when you could only keep the filibuster going by actually continuing to stand up and talk. Instead of just going home to dinner.That’d be a demonstration of real commitment, rather than just a desire to get points as an independent before the next election in your swing state.Bret: Yeah, but then you’d have to do stuff like watch Ted Cruz filibuster by reading “Green Eggs and Ham” from the well of the Senate, which violates the Eighth Amendment proscription on cruel and unusual punishments, not to mention the U.N.     Why Joe Biden Needs More Than Accomplishments to Be a Success

    No president since Ronald Reagan has achieved a more ambitious domestic legislative agenda in his first year than Joe Biden. With a razor-thin congressional majority — far smaller than that of Barack Obama — President Biden has delivered two enormous spending bills, with another, the Build Back Better act, likely on its way. Elements of these bills will have a lasting effect on the economy into the next decade; they also push the country to the left.Every president since Reagan has tacked to the rightward winds set in motion by the conservative movement. Even Mr. Obama’s stimulus bill and the Affordable Care Act owed as much to conservative nostrums about the market and runaway spending as they did to liberal notions of fairness and equality. Mr. Biden has had to accommodate the demands of Senators Joe Manchin and Kyrsten Sinema, but their intransigence has not had nearly the constraining effect that the voices of austerity and market fetishism had on Bill Clinton or Mr. Obama.Yet over the past several months, Mr. Biden’s presidency has been dogged by a sense of failure. Critics, friendly and not so friendly, point to what he has not delivered — voting rights, immigration reform, a $15 federal minimum wage, labor law reform and a path to freedom from personal debt and fossil fuels. Democrats fear that Mr. Biden’s plummeting approval ratings and the party’s losses in the November elections indicate that the Republicans will take back Congress in the midterms.No president, however, achieves his entire agenda. And presidents have suffered first-term losses greater than those currently anticipated for 2022.The real cause of the unease about Mr. Biden lies elsewhere. There is a sense that however large his spending bills may be, they come nowhere near to solving the problems they are meant to address. There is also a sense that however much in control of the federal government progressives may be, the right is still calling the shots.The first point is inarguable, especially when it comes to climate change and inequality. The second point is questionable, but it can find confirmation in everything from a conservative Supreme Court supermajority to the right’s ability to unleash one debilitating culture war after another — and in the growing fear that Republicans will ride back into the halls of power and slam the doors of democracy behind them, maybe forever.There’s a sense of stuckness, in other words, that no amount of social spending or policy innovation can seem to dislodge. The question is: Why?A prisoner of great expectationsThough it came out in 1993, Stephen Skowronek’s “The Politics Presidents Make” helps us understand how Mr. Biden has become a prisoner of great expectations.American politics is punctuated by the rise and fall of political orders or regimes. In each regime, one party, whether in power or not, dominates the field. Its ideas and interests define the landscape, forcing the opposition to accept its terms. Dwight Eisenhower may have been a Republican, but he often spoke in the cadences of the New Deal. Mr. Clinton voiced Reaganite hosannas to the market.Regimes persist across decades. The Jeffersonian regime lasted from 1800 to 1828; the Jacksonian regime, from 1828 to 1860; the Republican regime, from 1860 to 1932; the New Deal order, from 1932 to 1980.Reagan’s market regime of deference to the white and the wealthy has outlasted two Democratic presidencies and may survive a third. We see its presence in high returns to the rich and low wages for work, continents of the economy cordoned off from democratic control and resegregated neighborhoods and schools. Corporations are viewed, by liberals, as more advanced reformers of structural racism than parties and laws, and tech billionaires are seen as saviors of the planet.Eventually, however, regimes grow brittle. Their ideology no longer speaks to the questions of the day; important interests lose pride of place; the opposition refuses to accept the leading party and its values.Every president presides over a regime that is either resilient or vulnerable. That is his situation. When Eisenhower was elected, the New Deal was strong; when Jimmy Carter was elected, it was weak. Every president is affiliated or opposed to the regime. That is his story. James Knox Polk sought to extend the slavocracy, Abraham Lincoln to end it. The situation and the story are the keys to the president’s power — or powerlessness.When the president is aligned with a strong regime, he has considerable authority, as Lyndon Johnson realized when he expanded the New Deal with the Great Society. When the president is opposed to a strong regime, he has less authority, as Mr. Obama recognized when he tried to get a public option in the Affordable Care Act. When the president is aligned with a weak regime, he has the least authority, as everyone from John Adams to Mr. Carter was forced to confront. When the president is opposed to a weak regime, he has the greatest authority, as Thomas Jefferson, Andrew Jackson, Lincoln, Roosevelt and Reagan discovered. These presidents, whom Mr. Skowronek calls reconstructive, can reorder the political universe.All presidents are transformative actors. With each speech and every action, they make or unmake the regime. Sometimes, they do both at the same time: Johnson reportedly declared that with the passage of the Civil Rights Act of 1964, the Democrats had lost the South for a generation, thereby setting the stage for the unraveling of the New Deal.What distinguishes reconstructive presidents from other presidents, even the most transformative like Johnson, is that their words and deeds have a binding effect on their successors from both parties. They create the language that all serious contestants for power must speak. They construct political institutions and social realities that cannot be easily dismantled. They build coalitions that provide lasting support to the regime. Alexander Hamilton thought every president would “reverse and undo what has been done by a predecessor.” Reconstructive presidents do that — in fact, they reverse and undo the work of many predecessors — but they also ensure that their heirs cannot.Politics is not physics. A president opposed to the established order may seek to topple it, only to discover that it is too resilient or that his troops are too feeble and lacking in fight. Where we are in political time — whether we are in a reconstructive moment, ripe for reordering, or not — cannot be known in advance. The weakness or strength of a regime, and of the opposition to the regime, is revealed in the contest against it.What is certain is that the president is both creature and creator of the political world around him. Therein lies Mr. Biden’s predicament.The language of reconstructionHeading into the 2020 Democratic primaries, many people thought we might be in a reconstructive moment. I was one of them. There was a popular insurgency from the left, heralding the coming of a new New Deal. It culminated in the Nevada caucus, where people of color and young voters — an emergent multiracial working class — put Bernie Sanders over the top, ready to move the political order to the left.There also were signs that the Reagan regime was vulnerable. Donald Trump’s candidacy in 2016 suggested that conservative orthodoxies of slashing Social Security and Medicare and waging imperial warfare no longer compelled voters. Mr. Trump’s presidency revealed a congressional G.O.P. that could not unite around a program beyond tax cuts and right-wing judges.As a candidate, Mr. Biden rejected the transformation Mr. Sanders promised and assured wealthy donors that “nothing would fundamentally change” on his watch. Yet there were signs, after he won the nomination and into the early months of his administration, of a new, “transformational” Mr. Biden who wanted to be the next F.D.R. The combination of the Covid economy, with its shocking inequalities and market failures, and a summer of fire and flood seemed to authorize a left-leaning politics of permanent cash supports to workers and families, increased taxes on the rich to fund radical expansions of health care, elder care and child care, and comprehensive investments in green energy and infrastructure, with high-paying union jobs.Most important, the package cohered. Instead of a laundry list of gripes and grievances, it featured the consistent items of an alternative ideology and ascendant set of social interests. It promised to replace a sclerotic order that threatens to bury us all with a new order of common life. This was that rare moment when the most partisan of claims can sound like a reasonable defense of the whole.Yet while Mr. Biden has delivered nearly $3 trillion in spending, with another $1.5 trillion to $2 trillion likely to pass, he has not created a new order. In addition to a transformation of the economy, such an order would require a spate of democracy reforms — the elimination of the filibuster and curbing of partisan gerrymandering, the addition of new states to the union, and national protection of voting rights and electoral procedures — as well as labor law reforms, enabling workers to form unions.What makes such reforms reconstructive rather than a wish list of good works is that they shift the relations of power and interest, making other regime-building projects possible. Today’s progressive agenda is hobbled less by a lack of popular support than by the outsize leverage conservatives possess — in the Senate, which privileges white voters in sparsely populated, often rural states; in the federal structure of our government, which enables states to make it difficult for Black Americans to vote; and in the courts, whose right-wing composition has been shaped by two Republican presidents elected by a minority of the voters. No progressive agenda can be enacted and maintained unless these deformations are addressed.The only way to overcome anti-democratic forces is by seeding democracy throughout society, empowering workers to take collective action in the workplace and the polity, and by securing democracy at the level of the state. That is what the great emblems of a reconstructive presidency — the 14th Amendment, which granted Black Americans citizenship, or the Wagner Act, which liberated workers from the tyranny of employers — are meant to do. They give popular energy institutional form, turning temporary measures of an insurgent majority into long-term transformations of policy and practice.It’s not clear that Mr. Biden wants such a reconstruction. And even if he did, it’s not clear that he could deliver it.What is stopping Biden?The forces arrayed against a reconstruction are many.The first is the Republican Party. Here the party has benefited less from the “authoritarian” turn of Mr. Trump than from the fact that the Trump presidency was so constrained. As Mr. Skowronek argues, “Nothing exposes a hollow consensus faster than the exercise of presidential power.” At critical moments, exercising power was precisely what Mr. Trump was not able to do.Confronting the free fall of the New Deal, Mr. Carter unleashed a stunning strike of neoliberal and neoconservative measures: deregulation of entire industries; appointment of the anti-labor Paul Volcker to the Fed; a military buildup; and renewed confrontation with the Soviet Union. These defied his party’s orthodoxies and unraveled its coalition. Reagan ended the New Deal regime, but Mr. Carter prepared the way.For all his talk of opposition to the Republican pooh-bahs, Mr. Trump delivered what they wanted most — tax cuts, deregulation and judges — and suffered defeat when he tried to break out of their vise. Republicans repeatedly denied him funds to support his immigration plans. They overrode his veto of their military spending bill, something Congress had not been able to do in the Carter, Reagan, Clinton, George W. Bush and Obama administrations. Mr. Trump’s own administration defied his Russia policy. This combination of weakness and deference to the G.O.P. helped keep the Republicans — and the Reagan regime — together.The second obstacle is the Democratic Party. There’s a reason party elites, led by Mr. Obama, swiftly closed ranks, when the time came, behind Mr. Biden and against Mr. Sanders. They wanted continuity, not rupture.Likewise a portion of the base. Many Democrats are older, with long memories and strong fears of what happens when liberals turn left (they lose). Newer recruits, who gave Mr. Biden the edge in some key districts, usually in the suburbs, are what the Princeton historian Matt Karp calls “Halliburton Democrats,” wealthy defectors from the Republican Party.“A regime is only as vulnerable as the political forces challenging it are robust,” writes Mr. Skowronek. That robustness is yet to be demonstrated. Despite the clarity of the path the Democrats must take if they hope to topple the Reagan order, it’s not clear the party wants to take it.The third obstacle to a Biden reconstruction is what Mr. Skowronek calls the “institutional thickening” of American politics. Since the founding era, the American political system has acquired a global economy, with the dollar as the world’s currency; a government bureaucracy and imperial military; a dense ecology of media technologies; and armies of party activists. While these forces offer the modern president resources that Jefferson never had, they also empower the modern-day equivalents of Jefferson’s opponents to resist a reconstruction. Should Mr. Biden attempt one, could he master the masters of social media? Mr. Trump tried and was banned from Twitter.The real institutions that get in the way of Mr. Biden and the Democrats, however, are not these latter-day additions of modernity but the most ancient features of the American state.The power of Senators Manchin and Sinema is an artifact of the constitutional design of the Senate and the narrowness of the Democratic majority, which itself reflects the fact that the institution was created to defend slave states rather than popular majorities. Their power is augmented by the centuries-old filibuster, which has forced Mr. Biden to jam many programs into one vaguely named reconciliation bill. That prevents him from picking off individual Republicans for pieces of legislation they might support (as he did with the infrastructure bill).Should the Republicans take the House in 2022, it will probably not be because of Tucker Carlson but because of gerrymandering. Should the Republicans take back the White House in 2024, it will probably be because of some combination of the Electoral College and the control that our federalist system grants to states over their electoral procedures.A polarized electorate divided into red and blue states is not novel; it was a hallmark of the last Gilded Age, which put the brakes on the possibility of a presidential reconstruction for decades. As the political scientist E.E. Schattschneider argued, the division of the country into the Republican North and Democratic South made the entire polity “extremely conservative because one-party politics tends strongly to vest political power in the hands of people who already have economic power.”How do we move past Reagan?Every reconstructive president must confront vestiges of the old regime. The slavocracy evaded Lincoln’s grasp by seceding; the Supreme Court repeatedly thwarted F.D.R. Yet they persisted. How?What each of these presidents had at their back was an independent social movement. Behind Lincoln marched the largest democratic mass movement for abolition in modern history. Alongside F.D.R. stood the unions. Each of these movements had their own institutions. Each of them was disruptive, upending the leadership and orthodoxies of the existing parties. Each of them was prepared to do battle against the old regime. And battle they did.Social movements deliver votes to friendly politicians and stiffen their backs. More important, they take political arguments out of legislative halls and press them in private spaces of power. They suspend our delicate treaties of social peace, creating turbulence in hierarchical institutions like the workplace and the family. Institutions like these need the submission of subordinate to superior. By withholding their cooperation, subordinates can stop the everyday work of society. They exercise a kind of power that presidents do not possess but that they can use. That is why, after Lincoln’s election, Frederick Douglass called the abolitionist masses “the power behind the throne.”An independent social movement is what Mr. Biden does not have.     Joe Manchin Got the Voting Bill He Wanted. Time to Pass It.

    Far too many Republicans are players in a cynical pantomime: They say that the new voting restrictions being passed across the nation are designed solely to thwart widespread voting fraud, when the reality is that widespread fraud does not exist and the new restrictions’ purpose is to frustrate and disadvantage voters who lean Democratic — especially minority, young and lower-income voters.Are Democrats going to do a darn thing about it? We’ll soon find out.Republicans in Congress have repeatedly rejected measures to make voting fairer, more accessible and more secure. In state after state, the party has spent this year pushing laws that tighten ballot access — at least for certain groups — and that make the system more vulnerable to partisan meddling.This antidemocratic (and anti-Democratic) agenda began before President Donald Trump, but he supercharged it. Now, the former president and his supporters — who tried unsuccessfully to overturn the last election by lying about fraud and trying to strong-arm state officials and Congress into flipping electoral votes — have continued their crusade against democracy at the state and local levels. In the recall election against Gov. Gavin Newsom of California, Republicans began floating bogus claims of fraud long before the votes were tallied. “Does anybody really believe the California Recall Election isn’t rigged?” Mr. Trump charged Monday, on the eve of Election Day. Urging voters to mistrust the system and to reject the outcome if they dislike it has become standard operating procedure for the G.O.P.On Tuesday, Senate Democrats rolled out a reform bill aimed at curbing the madness. The Freedom to Vote Act, introduced by Minnesota’s Amy Klobuchar, would address longstanding flaws in the electoral system along with some of the Republicans’ recent machinations. It is a compromise proposal of sorts, crafted by a coalition of moderates and progressives after a more sweeping reform bill, the For the People Act, was blocked in June by a Republican filibuster. This slimmed-down package jettisons some of the more controversial elements of the earlier plan. It would not, for instance, restructure the Federal Election Commission or mandate the use of nonpartisan commissions for congressional redistricting. It is nonetheless an ambitious, urgently needed corrective to Republicans’ ongoing assault on the franchise.The package’s provisions range from making Election Day a public holiday to protecting local election officials from partisan interference. Partisan gerrymandering and voter caging, a sketchy method of purging voting rolls, would be banned. Same-day voter registration would be available in all states, as would automatic voter registration systems. A 30-minute wait-time limit would be imposed for in-person voting, and uniform, flexible ID requirements would be established in states that require voter IDs. The list goes on.Federal voting protections wouldn’t just protect voters in red states. Blue and purple states with less liberal standards would have to up their game as well. For instance, neither Connecticut nor New Hampshire currently provides for early in-person voting, nor does New Hampshire have online voter registration. Wisconsin has a strict photo ID law. New York does not have same-day voter registration (though voters have the opportunity to move to change that in November). Federal standards would serve all voters in all states and of all electoral hues.“Put simply, if the new bill is enacted, more citizens will be able to register to vote, vote in person and by mail and have their votes counted,” asserted Marc Elias, one of the Democrats’ top legal champions on voting rights. “And, those of us fighting suppression laws in court will have the tools necessary to achieve fast, consistent victories for voters when states fail to follow the law.”Merits aside, the new bill’s prospects are shaky at best. To avoid death by filibuster, it needs the support of all 50 Democrats plus 10 Republicans. Absent that, Democrats will face a hard choice: Let this crucial legislation die or eliminate the legislative filibuster in order to pass the bill on a party-line vote.This is a better dilemma, at least, than Democrats had to deal with over the summer, when they didn’t even have their entire caucus on board. While 49 Democratic senators supported the For the People Act, one, Joe Manchin of West Virginia, opposed it. As a conservative Democrat representing a deep-red state that Mr. Trump carried by close to 40 points last year, Mr. Manchin’s policy priorities often clash with those of his Democratic colleagues. But while there were some pieces of the For the People Act that made Mr. Manchin uneasy, his primary objection was that it lacked buy-in from Republicans.“The right to vote is fundamental to our American democracy and protecting that right should not be about party or politics,” Mr. Manchin wrote in a June 6 opinion essay in the Charleston Gazette-Mail. “I believe that partisan voting legislation will destroy the already weakening binds of our democracy, and for that reason, I will vote against the For the People Act.”He went on to denounce those who wanted him to help eliminate the filibuster to pass the bill. “The truth is there is a better way,” he insisted, “if we seek to find it together.”Bipartisanship is a big issue for Mr. Manchin — unsurprising, since his job security depends on appealing to voters who typically support the other party. He is correct that, even in today’s Senate, there can be agreement in areas where both parties are committed to making progress. Take the bill to bolster U.S. competitiveness with China that passed in June with strong bipartisan support, or the $1 trillion infrastructure plan that passed with similar bipartisan backing last month.But there are limits to bipartisanship, and the system comes up hard against those limits on the issue of voting rights. Yet Mr. Manchin has continued his search. In June, he put forward an alternative framework for reform that he felt had more bipartisan promise. Key Republicans promptly dismissed it.Meanwhile, their colleagues in the states are seizing the moment. Republican-controlled legislatures already have passed laws restricting ballot access in at least 18 states. Gov. Greg Abbott of Texas recently signed a raft of measures that the head of the Brennan Center for Justice, a think tank in New York, declared “the most extreme of the voting restrictions passed by legislatures this year.”Undeterred, Mr. Manchin, at the behest of Senate leadership, huddled with colleagues to hammer out the revised plan that’s now on the table.Having waited for Mr. Manchin to get behind a bill, the majority leader, Chuck Schumer, is now eager to move forward. He says a vote on the new package could take place within the week.Mr. Schumer has also made clear that he considers this Mr. Manchin’s moment to try to drum up whatever bipartisan support he can. “He has always said that he wants to try and bring Republicans on, and now, with the support of Democrats and this compromise bill — which Senator Manchin had great input into — he can go forward in that regard,” Mr. Schumer said Tuesday.No one expects Mr. Manchin’s gambit to succeed. But if his earnest outreach to Republicans fails, where does the senator go from there? Will he simply shrug and sacrifice voting rights on the altar of bipartisanship? Will he bow to a minority party pursuing antidemocratic measures to advance its partisan fortunes? “The senator continues to work with his bipartisan colleagues to protect the right to vote for every American while also restoring the American people’s faith in our democracy,” responded a spokesperson for Mr. Manchin.Bipartisanship can be a means to an end. But when voting rights are being ratcheted backward by one party, bipartisanship can’t be an excuse for inaction.President Biden is said to be ready to enter the fray. “Chuck, you tell me when you need me to start making phone calls,” he recently urged Mr. Schumer, according to Rolling Stone.Now, Mr. President, is the time to act boldly. Make those calls. Set up those Oval Office chats with Mr. Manchin and any other Democrats who might still need persuading. Bring all the powers of persuasion and the weight of the office to bear on this issue before further damage is done.Having lost the White House and the Senate last year, Republicans appear intent on rigging the game in their favor before the midterms.     As Congress Recesses, Democratic Successes Do Not Include Voting Rights

    Democratic leaders vow to make voting legislation the “first matter of legislative business” in September. But their path remains cluttered with obstacles.WASHINGTON — With deadlines looming ahead of next year’s midterm elections, the Senate adjourned on Wednesday for a monthlong recess with only the slimmest of paths left for passing federal voting rights legislation that Democrats hope can stop a wave of Republican state laws clamping down on ballot access.Before dawn on Wednesday, Senate Republicans blocked last-minute attempts to debate a trio of elections bills, but Democratic leaders vowed that more votes would be the “first matter of legislative business” when they return in mid-September. First up is likely to be a scaled-back version of the party’s far-reaching Senate Bill 1, the For the People Act, or S. 1, that Democrats believe will unite all 50 senators who caucus with them.“Let there be no mistake about what is going on here,” Senator Chuck Schumer, Democrat of New York and the majority leader, said just after 4 a.m. “We have reached a point in this chamber where Republicans appear to oppose any measure — no matter how common sense — to protect voting rights and strengthen our democracy.”But such outrage did little to clarify how the party plans to get around a wall of Republican opposition in the Senate that has blocked progress since June. Nor did it quiet some of the outspoken and well-financed activists demanding that President Biden and his congressional majorities do everything possible — including scrapping the Senate’s planned vacation and its legislative filibuster rule — to get the job done.Pressed by reporters later on Wednesday to outline how exactly Democrats would reverse their fortunes, Mr. Schumer said he was making progress by “showing very clearly to every one of our 50 senators that Republicans won’t join us.”“As I’ve said before, everything is on the table,” Mr. Schumer said.Advocates of voting rights legislation believe fleshing out Republicans’ opposition will help build a rationale for centrist Democratic senators like Joe Manchin III of West Virginia and Kyrsten Sinema of Arizona to reverse course and support either changing the entire filibuster rule or creating an exemption for elections-related changes to pass with a simple majority, rather than 60 votes.“Biden and Senate Democrats need to tell us what their plan to pass S. 1 is,” said Nita Chaudhary, the head of programming at the liberal advocacy group MoveOn, “before it’s too late.”“We have reached a point in this chamber where Republicans appear to oppose any measure — no matter how common sense — to protect voting rights and strengthen our democracy,” said Senator Chuck Schumer, the majority leader.Tom Brenner for The New York TimesThe Census Bureau was expected on Thursday to share detailed demographic data with states, kicking off the final stages of the once-in-a-decade process of redrawing congressional districts. Under the current rules, Republicans plan to press their advantages in control of state redistricting processes to draw new maps that tilt the national playing field toward their own candidates, making it easier to retake control of the House next year.The For the People Act, which passed the House this spring, would end partisan gerrymandering by both parties by forcing states to use independent commissions to draw district boundaries. The bill would also mandate that states set up automatic voter registration, 15 days of early voting and no-excuse mail-in voting. It would require political groups to disclose the identity of their big donors.But Richard L. Hasen, an election law expert at the University of California, Irvine, said Democrats could soon lose their window of opportunity to change the course of the redistricting process and the 2022 election. In time, it could similarly become difficult to stop the effects of new voting laws in more than a dozen Republican states that experts say will make it harder for young people and people of color to vote.“If something passes after states have gone through those processes and the election is underway, it would be much less likely that any congressional requirement could go into effect before the 2024 elections,” Mr. Hasen said of the redistricting process.Still, Democratic leaders insist they are making progress and can pass elections legislation even as they try to sew up two vast infrastructure and social program bills in the fall.Mr. Manchin, the only Democratic senator who does not support the original For the People Act, appears to be on the cusp of endorsing a somewhat narrower alternative that he has spent weeks negotiating with fellow Democrats. The new bill is likely to maintain many of the pillars of the original legislation, but include for the first time a national voter identification requirement and lop off new ethics requirements and a public campaign financing program for senators.Mr. Manchin said this week that he was still trying to win Republican votes for the plan, an unlikely outcome. But his colleagues have another motivation: They believe that Mr. Manchin will be more determined to fight for — and potentially change Senate rules for — a bill he helped write and watched Republicans tank.Senator Joe Manchin III of West Virginia is the only Democratic senator who does not support the original For the People Act, but he appears close to endorsing a narrower alternative.T.J. After hours of debate over Democrats’ separate $3.5 trillion budget blueprint, Mr. Schumer tried to force debates and votes on the original For the People Act, and on narrower bills focused on redistricting and campaign finance disclosure using unanimous consent to waive the normal Senate procedures.Republicans blocked all three, which they said constituted an attempt by Democrats to usurp the states and rewrite election rules for their benefit.“This isn’t going to work,” said Senator Mitch McConnell of Kentucky, the Republican leader. “It isn’t going to work tonight, and it isn’t going to work when we get back.”Republicans have threatened to grind the Senate to a halt if Democrats ax the filibuster rule. Mr. McConnell also suggested that his vote on Tuesday for Mr. Biden’s $1 trillion infrastructure package was in part to show Ms. Sinema and Mr. Manchin — two of its lead architects — that the Senate could still function in a bipartisan way.So far, it has worked.Ms. Sinema told ABC’s “The View” last week that a rules change could backfire and allow Republicans to pass a nationwide ban on mail-in voting when they next control Congress. And in an interview this month, Mr. Manchin appeared to rule out any filibuster exemptions.But Democrats still believe the new state voting laws and Republican efforts to rack up new safely red House seats in the weeks ahead may help move the senators.“They are going to try to use the redistricting process to draw themselves into the majority, not only in the House of Representatives but the state legislatures,” said Eric H. Holder Jr., the former attorney general who leads the National Democratic Redistricting Committee.Mr. Holder said that as long as Congress passed legislation outlawing the practice by the fall, Democrats could probably use the courts to stop the new maps.     Don’t Be Fooled By Mitch McConnell’s Sudden Bout of Bipartisanship

    Are we entering a new era of bipartisanship? On the surface, the news from Washington seems remarkably encouraging. The Senate is close to passing a $1 trillion bipartisan infrastructure bill, with $550 billion in new spending on everything from transit to highways to broadband to climate change mitigation. Political insiders are hailing the bill as a breakthrough, with the Senate poised, at last, to overcome the partisan gridlock that has ground its legislative machinery to a halt. Many thought that President Biden’s belief that he could get Republican votes was naïve, but he delivered. In a surprise, even the Senate minority leader, Mitch McConnell, voted to move the compromise to a vote.Of course, this is the same Mitch McConnell who said of Mr. Biden, “100 percent of our focus is on stopping this new administration.” The same Mr. McConnell who made sure Donald Trump’s impeachment did not result in conviction, who filibustered the bipartisan plan for a commission to investigate the Jan. 6 violent insurrection until it died, who kept all of his Republican senators in line against the American Rescue Plan early in the Biden presidency. And the same Mr. McConnell who said that he would not confirm a Biden nominee to the Supreme Court if Republicans recaptured the Senate in 2022.So why the reversal on infrastructure? Why dare the brickbats of Donald Trump after the former president bashed the effort and tried to kill it? Mr. McConnell has one overriding goal: regaining a majority in the Senate in 2022. Republicans must defend 20 of the 34 Senate seats up for grabs next year; there are open seats in Ohio, Pennsylvania and North Carolina; and Senator Ron Johnson, if he runs again, could easily lose his seat in Wisconsin. Attempting to block a popular infrastructure bill that later gets enacted by Democrats alone would give them all the credit. Republicans would be left with the lame defense of crowing about projects they had voted against and tried to block, something that did not work at all with the popular American Rescue Plan.You don’t have to be a Machiavellian to understand another reason Mr. McConnell was willing to hand Mr. Biden a victory on infrastructure: By looking reasonable on this popular plan, claiming a mantle of the kind of bipartisanship that pleases Democrats like Joe Manchin and Kyrsten Sinema and that mollifies suburban moderate Republicans in key states, Mr. McConnell can more easily rally his troops behind their goal of obstruction and delay for every other important Democratic priority, including the blockbuster reconciliation bill, as well as voting rights and election reform.For Mr. Biden, this bill is a political victory; the fact that he worked across party lines distinguishes him from his Republican predecessor, which should give the president a powerful appeal among independents and moderate Republicans. But for congressional Democrats, despite the true achievement of persuading 10 Republicans to sign on to an ambitious infrastructure plan, the road ahead is bumpy, winding and complicated.If this bill is signed into law, the Democrats will still need to face hard reality: This will be their last major bipartisan piece of legislation.Of course, there may be other issues below the partisan radar, like criminal justice reform and mental health reform, that can secure significant Republican support. But thanks to Mr. McConnell, everything else will face a wall of obstruction. Since the midterms will take all the focus off policymaking in Congress, the Democrats need to achieve democracy reforms and move on with the rest of their agenda using reconciliation. (The Senate majority leader, Chuck Schumer, will also be navigating another confrontation over the debt ceiling, but he might be able to include eliminating the ceiling within reconciliation, taking it off the table as a hostage once and for all.)The two key words are discipline and filibuster. Overcoming Mr. McConnell’s obstruction will require all 50 Senate Democrats to stick together, to swallow hard with necessary compromises — and of course, the same is true for House Democrats, who cannot afford to lose the votes of even four of their members. To achieve anything else will require a change in the Senate rules. It does not have to be elimination of the filibuster, or what Senator Manchin would define as a “weakening” of the rule. It will require a way to put the burden on Mr. McConnell and the minority instead of where it is now, entirely on Mr. Schumer and the majority.Norman J.     Voting Rights Groups Press Biden on Response to GOP Laws

    Dozens of voting rights groups and left-leaning get-out-the-vote organizations said on Tuesday that they were sending a letter to the Biden administration demanding more aggressive action to pass federal voting legislation. The letter also criticizes what the groups perceive as a misguided White House strategy that puts too much emphasis on organizing — the grass-roots work of registering, educating and turning out voters — to combat dozens of new voting restrictions passed by Republicans across the country this year.“Some may think we can overcome these unwarranted barriers to the ballot box by just increasing our organizing efforts,” the letter says. “We write to tell you unequivocally that that is simply not true.”The letter is the latest evidence of growing frustration between voting rights groups and the White House. The organizations and their allies have called for more public urgency from Mr. Biden, while administration officials have been preaching patience, noting that Democrats face long odds in the Senate of passing any federal voting legislation without overhauling the filibuster.While the administration remains committed to finding a way to pass a federal voting law, it has simultaneously been pushing voter registration, education and get-out-the-vote programs. It announced a $25 million investment in organizing efforts last month.But these moves have led to tension with voting rights groups, especially after voting rights advocates said that they had been told by some top Biden allies that it was possible to “out-organize voter suppression.”“Given the scale of the attack, I think it’s not for the president to say that he’s looking for bipartisan solutions when clearly there’s one political party that is actively undermining democracy and minimizing insurrection,” said Andrea Mercado, an executive director of Florida Rising, a progressive group. “Measures like ending the filibuster do need to be taken to protect voting rights.”For its part, the Biden administration has been ramping up its pressure on Congress to find a path forward for a federal voting law. The president met last week with Speaker Nancy Pelosi and Senator Chuck Schumer, the majority leader, to try to map out the next steps, and Democratic senators have been drafting a compromise bill they plan to introduce in the coming weeks.The letter on Tuesday was signed by more than 49 state-level organizations, including the New Georgia Project Action Fund, LUCHA Arizona and Detroit Action, as well as some national organizations like Black Voters Matter Fund. The groups said they had knocked on tens of millions of doors during the 2020 campaign in battleground states like Georgia, Arizona and Florida, playing a key part in the grass-roots organizing efforts that helped elect Mr. Biden and allowed Democrats to take back the Senate.But despite their success last year, the organizations said in their letter, “our organizing capacity is not unlimited.”“We are facing a rising tide of voter suppression unlike anything we have seen,” the letter states. “While grass-roots efforts remain critical to ensuring fair and representative elections, so too is federal legislation to protect and preserve the rights of the constituencies we serve.” More
