    The House committee is looking into efforts by the former president’s outside advisers to create a legal basis for national security agencies to help reverse his defeat in 2020.WASHINGTON — The House Jan. 6 committee is scrutinizing former President Donald J. Trump’s involvement in proposals to seize voting machines after the 2020 election, including efforts to create a legal basis for directing national security agencies to take such an extreme action, according to three people with knowledge of the committee’s activities.It is not clear what evidence the committee is examining as it looks at any role Mr. Trump might have played in encouraging or facilitating the drafting of a so-called national security finding, a type of document more typically used as the basis for a presidential order to an intelligence agency to take covert action. But the committee recently received documents from the Trump White House including what court filings described as a “document containing presidential findings concerning the security of the 2020 election after it occurred and ordering various actions,” along with related notes.A document fitting that description circulated among Mr. Trump’s formal and informal advisers in the weeks following the election. It reflected baseless assertions about foreign interference in American voting systems that had been promoted most prominently by one of his outside lawyers, Sidney Powell.That document, dated Dec. 16, 2020, and titled “Presidential Findings to Preserve Collect and Analyze National Security Information Regarding the 2020 General Election,” was published last month by Politico. It used the groundless assertions about foreign interference in the vote tally to conclude that Mr. Trump had “probable cause” to direct the military to begin seizing voting machines.“We certainly intend to run to ground any evidence bearing on an effort to seize voting machines and to use the apparatus of the federal government to confiscate these machines in the service of the president’s aim to overturn the election,” said Representative Adam B. Schiff, Democrat of California and a member of the committee. “We want to fully flesh out the facts: How close did this come to being operationalized? What kind of pushback did they receive? Who was a part of this particular scheme? We want to answer all those questions.”The New York Times reported on Monday that Mr. Trump was more directly involved than previously known in exploring proposals championed by outside advisers to seize voting machines as he grasped unsuccessfully for evidence of fraud that would help him reverse his defeat in the 2020 election.Those attempts included directing his personal lawyer, Rudolph W. Giuliani, to ask the Department of Homeland Security if it could legally take control of voting machines in key swing states — Kenneth T. Cuccinelli II, the acting deputy secretary, said no — and raising with Attorney General William P. Barr the question of whether the Justice Department could seize the machines, a query that Mr. Barr rejected, according to people familiar with the episodes.Mr. Cuccinelli, who had told Mr. Giuliani that the Homeland Security Department did not have the authority to audit or impound the machines, later encountered Mr. Trump at a meeting on another topic. Mr. Trump again raised with him, in passing, the idea of the department seizing the machines, and Mr. Cuccinelli reiterated that there was no legal authority for doing so, according to a person familiar with the exchange.The outside advisers had earlier pushed a plan under which Mr. Trump would direct the Pentagon to seize the voting machines, an idea that was killed by White House officials and Mr. Giuliani.“It is alarming that the former president apparently seriously contemplated extraordinary and legally not permitted courses of action to seize voting equipment from states and localities,” said Representative Zoe Lofgren, Democrat of California and a member of the committee.The panel for weeks has been studying the actions of Michael T. Flynn, a former national security adviser to Mr. Trump who investigators say was involved in discussions about seizing voting machines, declaring a national emergency and invoking certain national security emergency powers, including during a meeting in the Oval Office on Dec. 18.Mr. Flynn also gave an interview to the right-wing media site Newsmax a day earlier in which he talked about the purported precedent for deploying military troops and declaring martial law to “rerun” the election.At the Dec. 18 meeting, Patrick Byrne, the former chief executive of Overstock.com who funded many of the efforts to challenge the election, said he, Mr. Flynn and Ms. Powell decided they would get into the White House without an appointment “by hook or by crook” to present their plans to Mr. Trump. He said a junior staffer let them in the building, and eventually they got close enough to the Oval Office that Mr. Trump saw them and called them in.Once inside, the group pitched Mr. Trump on their plans for him to sign an executive order for the National Guard to take control of voting machines and for Ms. Powell to be appointed a special counsel overseeing election integrity.“We pointed out that, it being Dec. 18, if he signed the paperwork we had brought with us, we could have the first stage (recounting the Problematic 6 counties) finished before Christmas,” Mr. Byrne wrote of the episode in a book, referring to portions of contested swing states that Mr. Trump had lost.Mr. Byrne wrote that Mr. Flynn had drafted a “beautiful operational plan” that just needed “one signature from the president.” He described various versions of the plan, including an option for the U.S. Marshals to intervene and another for Mr. Trump to “have the National Guard rerun the elections in those six states.”He described White House lawyers and officials as fighting the plans in the meeting, including the White House counsel, Pat A.     New accounts show that the former president was more directly involved than previously known in plans developed by outside advisers to use national security agencies to seek evidence of fraud.Six weeks after Election Day, with his hold on power slipping, President Donald J. Trump directed his lawyer, Rudolph W. Giuliani, to make a remarkable call. Mr. Trump wanted him to ask the Department of Homeland Security if it could legally take control of voting machines in key swing states, three people familiar with the matter said.Mr. Giuliani did so, calling the department’s acting deputy secretary, who said he lacked the authority to audit or impound the machines.Mr. Trump pressed Mr. Giuliani to make that inquiry after rejecting a separate effort by his outside advisers to have the Pentagon take control of the machines. And the outreach to the Department of Homeland Security came not long after Mr. Trump, in an Oval Office meeting with Attorney General William P. Barr, raised the possibility of whether the Justice Department could seize the machines, a previously undisclosed suggestion that Mr. Barr immediately shot down.The new accounts show that Mr. Trump was more directly involved than previously known in exploring proposals to use his national security agencies to seize voting machines as he grasped unsuccessfully for evidence of fraud that would help him reverse his defeat in the 2020 election, according to people familiar with the episodes.The existence of proposals to use at least three federal departments to assist Mr. Trump’s attempt to stay in power has been publicly known. The proposals involving the Defense Department and the Department of Homeland Security were codified by advisers in the form of draft executive orders.But the new accounts provide fresh insight into how the former president considered and to some degree pushed the plans, which would have taken the United States into uncharted territory by using federal authority to seize control of the voting systems run by states on baseless grounds of widespread voting fraud.The people familiar with the matter were briefed on the events by participants or had firsthand knowledge of them.The accounts about the voting machines emerged after a weekend when Mr. Trump declared at a rally in Texas that he might pardon people charged in connection with the storming of the Capitol last Jan. 6 if he were re-elected. In a statement issued after the rally, Mr. Trump also suggested that his vice president, Mike Pence, could have personally “overturned the election” by refusing to count delegates to the Electoral College who had vowed to cast their votes for Joseph R. Biden Jr.The new information helps to flesh out how the draft executive orders to seize voting machines came into existence and points in particular to the key role played by a retired Army colonel named Phil Waldron.According to people familiar with the accounts, Mr. Waldron, shortly after the election, began telling associates that he had found irregularities in vote results that he felt were suggestive of fraud. He then came up with the idea of having a federal agency like the military or the Department of Homeland Security confiscate the machines to preserve evidence.Mr. Waldron first proposed the notion of the Pentagon’s involvement to Mr. Trump’s former national security adviser, Michael T. Flynn, whom he says he served with in the Defense Intelligence Agency.The plans were among an array of options that were placed before Mr. Trump in the tumultuous days and weeks that followed the election, developed by an ad hoc group of lawyers like Sidney Powell and other allies including Mr. Flynn and Mr. Waldron. That group often found itself at odds with Mr. Giuliani and his longtime associate Bernard Kerik, as well as with Mr. Trump’s White House counsel, Pat A. Cipollone, and his team.Around the same time that Mr. Trump brought up the possibility of having the Justice Department seize the voting machines, for example, he also tried to persuade state lawmakers in contested states like Michigan and Pennsylvania to use local law enforcement agencies to take control of them, people familiar with the matter said. The state lawmakers refused to go along with the plan.The meeting with Mr. Barr took place in mid- to late November when Mr. Trump raised the idea of whether the Justice Department could be used to seize machines, according to two people familiar with the matter. Mr. Trump told Mr. Barr that his lawyers had told him that the department had the power to seize machines as evidence of fraud.Mr. Trump mentioned a specific state that had used machines built by Dominion Voting Systems, where his lawyers believed there had been fraud, although it is unclear which state Mr. Trump was referring to.     White House Considers Lifting Rule That Blocked Migrants During Pandemic

    Among the plans under consideration is whether to give migrant families a chance to apply for protections, and to possibly lifting the public health rule for single adults this summer.WASHINGTON — The Biden administration is in the later stages of planning how to phase out a Trump-era public health rule that has allowed border agents to rapidly turn away most migrants who have arrived at the southern border during the pandemic, according to two administration officials. It is possible that in the coming weeks, border officials could start allowing migrant families back into the country, with an eye toward lifting the rule for single adults this summer.The plan, while still not final, is sure to ​complicate an already thorny issue for President Biden and Vice President Kamala Harris, who is visiting the border on Friday as Republicans accuse the administration of being slow to address what they describe as an unrelenting surge of migrants trying to enter the country. Lifting the rule will only exacerbate that.Since the beginning of the pandemic, border agents have turned away migrants nearly 850,000 times under the public health rule, known as Title 42, which immigration and human rights advocates call unnecessary and cruel, particularly for those seeking asylum. Migrant families have been turned away more than 80,000 times since the rule was put in place in March 2020, according to government data.The White House has deflected questions about how much longer the rule will remain in place, saying it is up to the Centers for Disease Control and Prevention, which issued the policy. An agency spokeswoman referred questions about the rule to the White House.Mr. Biden, who has promised a more humane approach to immigration enforcement, decided not to continue the Trump administration’s policy of expelling children who arrived alone at the border. Single adults and many families, however, have continued to be turned away because of the public health rule, whose stated purpose is to prevent the coronavirus from spreading at points of entry or Border Patrol stations. Still, some migrant families have been allowed into the United States because Mexico or their home countries refuse to take them back.Despite the measured approach, lifting the rule — which many public health experts say has little point this late in the pandemic — is likely to sharply increase the flow of migrants, at least in the short term. That would force Mr. Biden to address the issue without compromising his pledge to take a more compassionate approach to enforcing immigration laws.Plans to lift the rule have been under discussion for weeks, but there appears to be a fresh sense of urgency; officials familiar with the evolving plan shared details with The New York Times on the condition of anonymity because they were not authorized to discuss it. Axios earlier reported some of the details.For migrant families, the officials said, one idea under consideration is to put those seeking asylum into one of Immigration and Customs Enforcement’s alternatives to detention. That includes having them wear ankle bracelets as their request makes its way through the immigration system, a process that can take years because of a chronic backlog of cases. The administration has already been doing this for other migrant families this year.The administration is considering placing families who do not make asylum claims in the queue for expedited removal, a process that allows immigration officers to deport people without a hearing, a lawyer or a right of appeal in some cases.One official familiar with the plans said that all the ideas under consideration included health and safety measures to avoid the spread of the virus.Lifting the public health rule for single adults is likely to come later, according to the most recent discussions, possibly by the end of the summer. Single adults have been barred from entering the country more than 262,000 times since the rule went into effect. The administration is still debating where these migrants would go once they enter the country, including whether to place them in expedited removal or in home detention so as to avoid a detention center, as Mr. Biden campaigned against mass incarceration of undocumented immigrants.Representative Henry Cuellar of Texas, a senior Democrat on the House Appropriations Subcommittee on Homeland Security, said border officials had been bracing for an end to the public health rule and other pandemic restrictions, including a ban on nonessential cross-border commercial traffic that was recently extended until July 21.President Biden has promised a more humane approach to immigration enforcement and started to allow children who arrived alone at the border to enter the country.Pete Marovich for The New York Times“That could be, according to them, ‘a perfect storm,’ because all of a sudden all those people will be coming into the U.S.,” Mr. Cuellar said.The Biden administration is trying to avoid just such a storm with a phased-in approach.Another challenge for the administration is that detention centers overseen by Immigration and Customs Enforcement are filling up, holding nearly 27,000 as of Thursday. That is a 90 percent jump compared with the average number of detainees in March, according to government data. If the administration lifts the health rule entirely, it would face the question of where to house the migrants, caught between significantly increasing the number of detained immigrants and releasing everyone to wait for court proceedings.Lifting the public health rule for families, though, will make it hard for the administration to defend keeping it in place for single adults.“This piecemeal approach doesn’t cut it,” said Denise Bell, a researcher for Amnesty International’s refugee and migrant rights program. “How many carve-outs until you have to admit there is no good public health rationale for Title 42?”Lifting the public health rule could lead to some bottlenecks along the border, but it could also ease pressure on the Department of Health and Human Services, which is overseeing the care of unaccompanied migrant children who have been arriving in record numbers.As of Thursday, about 14,500 such children were being held in government shelters, according to internal government data obtained by The Times, as officials try to place them with family members or other sponsors in the United States. Nearly half of the children are staying in emergency shelters where some conditions are far below government standards; the average stay is currently 37 days.“When families were pushed back, sometimes they’d make that extraordinarily difficult choice to send their child ahead, with the hope that as an unaccompanied child migrating alone, they’d have a better chance of being accepted and processed through,” said Wendy Young, the president of a nonprofit, Kids in Need of Defense. “It’s a horrible choice that families have to make, but we did see families doing exactly that.”Without the public health rule, families may again start trying to cross the border together — a better option, Ms. Young said, than being placed in the large emergency shelters overseen by the health and human services department.Ms. Harris, who will travel to El Paso on Friday with Alejandro N. Mayorkas, the homeland security secretary, is leading the administration’s efforts to help improve conditions in Central America, where many of the children are coming from, to deter migration.For weeks, Republicans have pressed Ms. Harris about why she traveled to Central America this month, but not to the American side of the border with Mexico. Her visit comes just days before Mr. Trump goes to the border with a group of Republicans, including Gov. Greg Abbott of Texas, who has pledged to finish Mr. Trump’s border wall in his state after Mr. Biden halted construction. Trump, struggling to find a winning campaign theme, hit on a message that he stressed over and over: The real domestic threat to the United States emanated from the radical left, even though law enforcement authorities had long since concluded it came from the far right.It was a message that was quickly embraced and amplified by his attorney general and his top homeland security officials, who translated it into a shift in criminal justice and national security priorities even as Mr. Trump was beginning to openly stoke the outrage that months later would culminate in the storming of the Capitol by right-wing extremists.Mr. Trump’s efforts to focus his administration on the antifa movement and leftist groups did not stop the Justice Department and the F.B.I. from pursuing cases of right-wing extremism. They broke up a kidnapping plot, for example, targeting Gov. Gretchen Whitmer of Michigan, a Democrat.But the effect of his direction was nonetheless substantial, according to interviews with current and former officials, diverting key portions of the federal law enforcement and domestic security agencies at a time when the threat from the far right was building ominously.In late spring and early summer, as the racial justice demonstrations intensified, Justice Department officials began shifting federal prosecutors and F.B.I. agents from investigations into violent white supremacists to focus on cases involving rioters or anarchists, including those who might be associated with the antifa movement. One Justice Department prosecutor was sufficiently concerned about an excessive focus on antifa that the official went to the department’s independent inspector general, Michael E. Horowitz, telling his office that politics might have played a part.Federal prosecutors and agents felt pressure to uncover a left-wing extremist criminal conspiracy that never materialized, according to two people who worked on Justice Department efforts to counter domestic terrorism. They were told to do so even though the F.B.I., in particular, had increasingly expressed concern about the threat from white supremacists, long the top domestic terrorism threat, and well-organized far-right extremist groups that had allied themselves with the president.White House and Justice Department officials stifled internal efforts to publicly promote concerns about the far-right threat, with aides to Mr. Trump seeking to suppress the phrase “domestic terrorism” in internal discussions, according to a former official at the Department of Homeland Security.Requests for funding to bolster the number of analysts who search social media posts for warnings of potential violent extremism were denied by top homeland security officials, limiting the department’s ability to spot developing threats like the post-Election Day anger among far-right groups over Mr. Trump’s loss.The scale and intensity of the threat developing on the right became stunningly clear on Jan. 6, when news broadcasts and social media were flooded with images of far-right militias, followers of the QAnon conspiracy movement and white supremacists storming the Capitol.Militias and other dangerous elements of the far right saw “an ally in the White House,” said Mary McCord, a former Justice Department official who teaches at Georgetown University and focuses on domestic terrorism. “That has, I think, allowed them to grow and recruit and try to mainstream their opinions, which is why I think you end up seeing what we saw” at the Capitol.Far-right and far-left groups clashing in Portland, Ore., in August. Barr.Mr. Barr had long harbored concerns about protests and violence from the left. Soon after taking office in early 2019, he began a weekly national security briefing by asking the F.B.I. what it was doing to combat antifa, according to two people briefed on the meetings. Officials viewed his sense of the threat as exaggerated. They explained that it was not a terrorist organization, but rather a loose movement without an organization or hierarchy, and tried to correct what they described as misperceptions, according to one of the people.Still, in meetings last year with political appointees in Washington, department investigators felt pressured to find evidence that antifa adherents were conspiring to conduct coordinated terrorist attacks.When F.B.I. intelligence continued to deem white nationalists the leading domestic terrorism threats — part of what the bureau describes as racially or ethnically motivated violent extremists — prosecutors were asked to also consider information from the Department of Homeland Security that antifa and radical leftist anarchists were instead the leading threats, according to a person involved in the conversations.Mr. Barr said in a statement that “there was no ‘prioritization’” of the leftist threat, and that all violence should be condemned.“The F.B.I. already had a robust program to combat violence driven by white supremacy and nationalism,” Mr. Barr said. “I wanted there to be a comparable one for antifa and antifalike groups.”The pressure from Mr. Trump was unrelenting. After Christopher A. Wray, the F.B.I. director, testified to Congress in September that antifa was “more of an ideology or a movement than an organization,” Mr. Trump lashed out at him on Twitter, saying that the F.B.I. protected such “anarchists and thugs” and allowed them “to get away with ‘murder.’”Investigators at the Justice Department and the Department of Homeland Security moved quickly and forcefully to address the violence that erupted amid the summer’s racial justice protests.The demonstrations gave way to looting and rioting, including serious injuries and shootings. Over several chaotic nights in Minneapolis, rioters burned down a corridor of largely immigrant-owned businesses and set a police precinct on fire. Similar scenes played out in other cities.In late August, Michael Reinoehl, a self-professed antifa supporter, shot and killed a pro-Trump protester in Portland, Ore. The president cheered his death at the hands of the federal officers who later tried to apprehend him. “We got him,” he said.But while Mr. Trump and others saw the developments as evidence of a major assault from the left, the picture was actually more complicated.The shooting by Mr. Reinoehl, as the F.B.I. pointed out this month in an internal memo, was the first killing in more than 20 years by what the bureau classifies as an “anarchist violent extremist,” the type of threat Mr. Trump had emphasized.Over the late spring and summer, the F.B.I. opened more than 400 domestic terrorism investigations, including about 40 cases into possible antifa adherents and 40 into the boogaloo, a right-wing movement seeking to start a civil war, along with investigations into white supremacists suspected of menacing protesters, according to F.B.I. data and a former Justice Department official. Still, Justice Department leadership was adamant that terrorism investigators focus on antifa as the demonstrations spread, according to an official who worked on the inquiries.The small cadre of intelligence analysts inside the department’s counterterrorism section were pulled into the effort, writing twice daily reports. National security prosecutors staffed command posts at the F.B.I. to deal with the protests and associated violence and property crimes, and to help protect statues and monuments seen as potential targets.All of this was a strain on the counterterrorism section, which has only a few dozen prosecutors and like other parts of the department was reeling from the coronavirus. A top F.B.I. domestic terrorism chief also expressed concern to Justice Department officials over the summer about the diversion of resources.The counterterrorism section at the time was working with prosecutors and agents around the country on cases involving people affiliated with the Three Percenters, Oath Keepers, other militia members and violent white supremacists. In some parts of the country, agents who had been investigating violent white supremacists pivoted to investigate anarchists and others involved in the rioting, struggling in certain cases to find any conspiracy or other federal charges to bring against them.Around the same time, the F.B.I. was tracking worrisome threats emanating from the far right. Agents in Michigan monitoring members of a violent antigovernment militia called Wolverine Watchmen received intelligence in June that the men planned to recruit more members and kidnap state governors, according to court documents.After six members of the group were charged in October with plotting to abduct Ms. Whitmer, one of Mr. Trump’s most vocal opponents, the president insulted her and reiterated that the left posed the true threat. “She calls me a White Supremacist — while Biden and Democrats refuse to condemn Antifa, Anarchists, Looters and Mobs that burn down Democrat run cities,” Mr. Trump said on Twitter.Dozens of F.B.I. employees and senior managers were sent on temporary assignments to Portland — including the head of the Tampa field office, who was an expert in Islamic terrorism, according to current and former law enforcement officials — where left-leaning protests had intensified since tactical federal teams arrived. Some F.B.I. agents and Justice Department officials expressed concern that the Portland work was a drain on the bureau’s effort to combat what they viewed as the more lethal strains of domestic extremism. The bureau had about 1,000 domestic terrorism cases under investigation at the time, and only several hundred agents in the field assigned to them. The Homeland Security Department even sent agents to Portland who were usually assigned to investigate drug cartels at the border.Mr. Barr also formed a task force run by trusted U.S. attorneys in Texas and New Jersey to prosecute antigovernment extremists. Terrorism prosecutors working on the investigations arising from the summer’s violence were not told beforehand of Mr. Barr’s decision. They questioned the rationale behind the task force because it seemed to duplicate their work and could create confusion, according to two people familiar with their pushback.Ultimately, the federal response to last year’s protests elicited a mixed bag. Federal prosecutors nationwide charged more than 200 people with crimes, including some who self-identified with antifa.But the F.B.I. also charged adherents of the boogaloo, including an Air Force sergeant suspected of murdering a federal officer and trying to kill another in California. Here’s a look at what happened and the ongoing fallout:As this video shows, poor planning and a restive crowd encouraged by President Trump set the stage for the riot.A two hour period was crucial to turning the rally into the riot.Several Trump administration officials, including cabinet members Betsy DeVos and Elaine Chao, announced that they were stepping down as a result of the riot.Federal prosecutors have charged more than 70 people, including some who appeared in viral photos and videos of the riot. Officials expect to eventually charge hundreds of others.The House voted to impeach the president on charges of “inciting an insurrection” that led to the rampage by his supporters.“You could argue the reverse. The fact we were focused on white supremacist extremists in late 2019, early ’20, we missed the antifa stuff coming up,” Mr. Wolf said. “One could always go back and say, ‘You focused on this at the expense of that.’ I would say we focused on things happening in real time.”Mr. Trump said in May that he intended to designate antifa a domestic terrorist organization. National Security Council staff members, including Andrew Veprek, an ally of Stephen Miller who is now at the State Department, asked homeland security officials for evidence to justify such a designation. They sought information about possible ties between antifa and foreign entities; federal law defines domestic terrorism but the statute does not carry any criminal penalties, and designations of terrorist organizations are limited to foreign groups.In fact, the F.B.I. had seen troubling evidence of white supremacists in the United States with foreign ties, including one group that agents believe was being directed by an American living in Russia. The number of warnings about all types of extremists in the second half of last year eventually dwindled, according to current and former officials.“You can read the tea leaves and say domestic terrorism isn’t going to be our priority,” Ms. Neumann said.“The culture absorbs those messages they hear the president speak or tweet,” she said, adding that some White House officials even cautioned against using the phrase “domestic terrorism.”Last spring, Brian Murphy, then the homeland security intelligence chief, requested $14 million to bolster training and increase staff to analyze social media for extremist threats, given that online forums had become a prime recruiting and organizing ground. Mr. Wolf’s deputy, Kenneth T. Cuccinelli II, rejected the request, as well as an appeal for $8 million, officials said.Mr. Cuccinelli said in a statement that requests for additional funding would have come at the expense of other parts of the agency. He added that he had been working to shift resources from other parts of the department to expand training for the intelligence branch.Mr. Murphy had filed a whistle-blower complaint in September that prompted an outcry. Starting with the deadly extremist protest in Charlottesville, Va., in 2017, when Mr. Trump said there were “very fine people on both sides,” he played down any danger posed by extremist groups. And when racial justice protests erupted nationwide last year, his consistent message was that it was the so-called radical left that was to blame for the violence and destruction that had punctuated the demonstrations.Even after the Department of Homeland Security in September 2019 singled out white supremacists as a leading domestic terrorism threat, analysts and intelligence officials said their warnings were watered down, delayed or both.
