    Why Isn’t Biden Ever on TV?

    Americans are seeing a lot less of the president than they did of his predecessor. That’s partly by design.On a sweltering day last month, President Biden traveled to Somerset, Mass. Appearing on a bulldozed patch of land where a coal-fired power plant recently stood, and where a substation for an offshore wind farm eventually will, Biden delivered what the White House press office billed as remarks on “actions to tackle the climate crisis.” The previous week, Senator Joe Manchin of West Virginia seemingly torpedoed Biden’s ambitious climate package (though Manchin would soon resurrect it). In the meantime, much of the country was suffering from extreme weather: wildfires, floods, record heat. Now Biden, sporting Ray-Bans and forgoing a tie in the blistering heat, looked out at the crowd and the cameras. “Let me be clear,” he declared. “Climate change is an emergency.”Does any of this sound familiar? Can you picture it? Probably not: None of the three major cable news channels carried the speech live. All three network news shows led with stories about record-high temperatures — “the suffocating heat gripping more than 100 million Americans,” as NBC’s Lester Holt described it, only to be one-upped by ABC’s David Muir, who spoke of “heat warnings and advisories for 29 states now, more than 140 million Americans.” But they didn’t cover Biden’s speech until well into their newscasts, and then only for a minute or so; if you had stepped away to adjust your air-conditioner, you might have missed it.The leader of the free world does not have much of a visual presence in it.If you saw any of the president’s speech online, it was most likely the brief segment in which he recalled the oil refineries near his childhood home and said they were “why I and so many damn other people I grew up with have cancer.” Critics, seizing on what they saw as a gaffe, circulated that clip all over social media: “Did Joe Biden just announce he has cancer?” an official Republican National Committee account posted on Twitter. Biden’s defenders said he was referring to the nonmelanoma skin cancers he has had removed in the past. Bill Clinton once prompted a debate about “the meaning of the word ‘is’”; Biden’s speech started one about the semantics of “have.”The lack of substantive coverage of the climate speech itself illustrates an unusual feature of Biden’s presidency: The leader of the free world does not have much of a visual presence in it.No president, of course, could have quite the visual presence of Biden’s predecessor. Donald Trump filled our screens. The cable channels went live for his speeches and cabinet meetings and grip-and-grins with foreign dignitaries — even his walks from the White House to a helicopter — in the entirely justified hope that he would do something newsworthy. Try to pick the indelible image of Trump’s presidency. It’s impossible: There are too many. The white-knuckled squeeze of Emanuel Macron’s hand during an uncomfortably long shake. Standing on the South Lawn reading from a Sharpie-festooned legal pad, denying any “quid pro quo” with Ukraine. Holding up a Bible in front of St. John’s Episcopal Church during the protests over George Floyd’s murder. These images compete with dozens, maybe hundreds, more. Now try to select an image from — much less the indelible image of — Biden’s presidency. You can’t, because there aren’t any. This is partly by design. Biden’s 2020 campaign was founded, in large part, on the promise of a return to normalcy, and it is not normal for Americans to be thinking about their president as relentlessly as they did during the Trump years. “People got tired of listening to and seeing the president,” Martha Joynt Kumar, a scholar of presidential media strategy, told me. “They were exhausted by the end of the Trump administration.”Biden has provided a respite. According to Kumar’s tabulations, he has held about half as many as news conferences and given around a third as many interviews as Trump had at this point in his presidency. It’s not just submitting to fewer questions from the press; he’s in front of cameras less frequently than Trump as well, even spending days with nothing at all on his public schedule. To Republicans, this is proof of Biden’s senescence; to the press, his lack of transparency. But when CNN asked the White House press secretary, Karine Jean-Pierre, what Biden was doing during two days out of view last month, she replied that he had been “very busy dealing with the issues of the American people, and meeting with his staff and senior staff the last two days.”That could well be true. The problem, for Biden, is that his predecessor redefined what’s expected of the president. There has long been a performative component to the role, but Trump made public performance the entire job. The press covered his every appearance not just because his behavior resulted in gaffes but because it set policy. A defining feature of the Trump years was the president publicly fulminating about something, and then administration officials scrambling to cobble together policy proposals that matched his fulminations. To pick one of many instances, in 2018 Trump announced, while venting to reporters about immigration, that he was enlisting the U.S. military to guard the border with Mexico. The White House subsequently clarified that Trump meant he was mobilizing the National Guard, not active-duty military, but when Secretary of Homeland Security Kirstjen Nielsen was produced to explain the plan to reporters, she had no details to offer: “We’ll let you know as soon as we can,” she said. “I’m going to get on phone calls right now.” Biden, somewhat anachronistically, still insists on putting the horse before the cart. After Manchin seemed to sink the administration’s climate agenda last month, Democrats called on the president to formally declare a climate emergency, which would theoretically allow him to circumvent Congress in taking action. But he demurred. Speaking to reporters after the Massachusetts speech — in which he pointedly did not declare a climate emergency — he explained, “I’m running the traps on the totality of the authority I have.” This should be an admirable trait. But Biden’s reticence often registers as an absence. When Democrats criticized him for not being forceful enough in his response to the Supreme Court’s reversal of Roe v. Wade, it wasn’t necessarily because they expected him to do anything; as a matter of law, there was little he could do. But they did want the face of their party to assume a mantle of leadership, demonstrate resolve and help channel their energies. Considering Biden’s limitations — his age, his focus on policy — you might expect to see his young vice president out making the case for the administration. But Kamala Harris has her own problems. In the pair’s absence, Democrats are looking elsewhere. Some get excited whenever Pete Buttigieg, Biden’s secretary of transportation, goes on Fox News to dismantle a few loaded questions, circulating YouTube clips with titles like “Pete Buttigieg HUMILIATES Fox News Host with EPIC Response on Live TV.” Others hail Gov. Gavin Newsom of California as “an effective and fierce fighter,” in the words of the liberal pundit Dean Obeidallah, for running ads in Florida and Texas trolling those states’ Republican governors. A Michigan state senator named Mallory McMorrow raised more than $1 million from donors in 50 states after her speech on the G.O.P.’s treatment of the L.G.B.T.Q. community went viral. On their screens and in their imaginations, Democrats are experiencing a great and public void. Trump and his allies tried to exploit to reverse the 2020 results.“There is nothing more essential to the orderly transfer of power than clear rules for effecting it,” Senator Susan Collins, Republican of Maine and one of the lead authors of a bill to update the 135-year-old Electoral Count Act, said Wednesday as the Senate Rules Committee began its review of the legislation. “I urge my colleagues in the Senate and the House to seize this opportunity to enact the sensible and much-needed reforms before the end of this Congress.”Backers of the legislation, which has significant bipartisan support in the Senate, believe that a Republican takeover of the House in November and the beginning of the 2024 presidential election cycle could make it impossible to make major election law changes in the next Congress. They worry that, unless the outdated statute is changed, the shortcomings exposed by Mr. Trump’s unsuccessful effort to interfere with the counting of electoral votes could allow another effort to subvert the presidential election.“The Electoral Count Act of 1887 just turned out to be more troublesome, potentially, than anybody had thought,” said Senator Roy Blunt of Missouri, the senior Republican on the rules panel. “The language of 1887 is really outdated and vague in so many ways. Both sides of the aisle want to update this act.”But despite the emerging consensus, lawmakers also conceded that some adjustments to the proposed legislation were likely given concerns raised by election law experts.     Maybe Joe Biden Knows Joe Manchin Better Than We Thought

    Gail Collins: Never really thought I’d be leading off with a toast to Joe Manchin, Bret, but troubled times require low expectations.Bret Stephens: You came around!Gail: Joe came around! Or caved, which sounds a little more satisfying. Of course we’ve still got his Senate colleague Kyrsten Sinema and her tax obsessions to worry about. But if it all comes together this week, we’ll get the big Biden program to battle climate change. Will that make you as happy as it would make me, hmm?Bret: Your happiness sounds like it’s an 8 or a 9 on a 10-point scale, and mine is probably around a 5. The Senate just passed a $280 billion bill to support the semiconductor industry under the guise of standing up to China, which is really just a huge giveaway to Intel and other U.S. chip makers. Now we’re dropping another $369 billion, and a lot of that will be in the form of corporate subsidies for companies like Tesla and General Motors. I know Manchin and Larry Summers are saying this will help bring down inflation. But pumping a lot of money into an economy usually has the opposite effect.On the other hand, it’s a whole lot less than the trillions the administration wanted to spend last year, so I’ll take that as a victory. It might keep the nuclear industry alive, which is also vital if we are serious about tackling climate change, and it might also reduce some of the permitting bottlenecks that get in the way of energy infrastructure. And the two bills are solid legislative wins for President Biden, who really, really needed them.Gail: As did all of us who are still Friends of Biden — although I guess we’d prefer not to be called F.O.B.s.Bret: Shame the news arrives the same week we get the second straight quarter of negative economic growth, which is … not a recession?Gail: I prefer to think of it as an, um, a very relaxed financial time.Bret: Not sure how much it would help Biden if he were to say, “Folks, the economy isn’t stalling. It’s relaxing.” Sorry, go on.Gail: And while of course politics is utterly beside the point — who in the world would worry about the entire makeup of Congress? — this legislation has got to help the Democrats come election time. Lots of good reasons we’re in an economic … slump. But you’ve got to be able to deliver a plan for making things better.One of my favorite parts of the bill is the way it clamps down on pharmaceutical companies. Like giving the government power to negotiate on the prices of some drugs covered by Medicare.Bret: Terrible! Price controls inevitably lead to less innovation, fewer incentives to manufacture generics and biosimilars and crazy distortions as pharmaceutical companies jack up the price of some drugs to make up for lost revenue in others. It’s just as bad an idea as rent control and rent stabilization, which is great for some but distorts the overall market and makes the city more expensive.Gail: Hey, we the taxpayers are funding those drugs and we should get assurance that all our money isn’t going to Big Pharma’s profits.Sorry, go on.Bret: I still don’t see the legislation swinging a lot of votes to the Democrats in the midterms. Biden also got his big infrastructure bill passed last year and it didn’t help him one bit politically. The only thing that can save the Democrats now is Donald Trump and his dumb political endorsements.Gail: Anybody you’re thinking of in particular? For instance, that dweeb Blake Masters in Arizona who we talked about recently? The one who now graciously admits he “went too far” when he wrote a youthful essay implicitly criticizing American involvement in World War II. I believe you said if you were voting in Arizona and Masters won the primary, you’d support the — hehehehe — incumbent Democrat, Mark Kelly.Bret: Yes, reluctantly. As David Sedaris might put it, the choice between Democrats and most Republicans these days is like a choice between a day-old baloney sandwich with a sad little pickle on a stale roll versus a plate of rancid chicken served with a sprinkling of anthrax on a bed of broken glass.I’ll take the sandwich.Gail: Got some other big primaries coming up on Tuesday besides Arizona. I’m sure a lot of Missouri Republicans would be happy to see the end of Eric Greitens, a former governor, who now seems to be fading in his run for the Senate. Can’t imagine why, given that he was forced to resign from office in an ethics crisis that included a mind-boggling sex scandal.Bret: The fact that he was the front-runner, at least until recently, really tells you that the G.O.P. has reached its psychotic stage. To recap, Greitens, a former Rhodes Scholar and Navy SEAL, resigned in disgrace as governor four years ago after barely a year in office. Later, his ex-wife alleged in a sworn affidavit, which Greitens disputes, that he knocked her down and confiscated her cellphone, wallet and keys to keep her and their children prisoner in their home. Also, that he was physically violent toward their 3-year-old son.Gail: Which really should have sealed the deal.Bret: More recently, he filmed an ad that was a live-action fantasy of shooting RINOs — “Republicans in Name Only” — that struck many of us as a pretty open invitation to violence. Even Josh Hawley thinks he’s vile, which is like Nikita Khrushchev taking a strong moral exception to Mao Zedong.Gail: Seems like his fading in the polls shouldn’t require a celebration, but we’ll take what we can get.Bret: As for Masters, his candidacy seems to rest on his promotion of so-called replacement theory.Gail: Yes, the idea that Democrats are encouraging immigration so they can create a minority-majority of voters.Bret: It’s almost amusing, since the most significant replacement to happen in Arizona was the one in which white settlers stole sovereign Mexican territory in an unprovoked invasion and dispossessed Native American tribes.Gail: Bless you.Bret: It’s also a master class in political malpractice, since it only alienates Hispanic voters, who are often fairly conservative and increasingly open to voting for Republicans. Are you feeling optimistic?Gail: Have to admit I’m kinda worried that a lot of liberal voters — particularly the younger ones — are just so appalled by the way things have been going with abortion and guns, and so depressed by the state of the economy, that they’ll just sit this one out.Bret: Yeah, but don’t discount the rancid chicken factor. As in, for instance, the Senate race in Georgia, or the governors’ races in Maryland and Pennsylvania.Gail: Well, just to stick with Georgia for a second, it does seem a guy like Herschel Walker, with a really dreadful performance record as a father, should have tried not to build his campaign around being a family-values candidate.Bret: With luck, maybe after a few losses Republican voters will finally get the message that a Trump endorsement in the primary is the political kiss of death in the general election.Then again, it would also help Democrats if someone cured Biden of his habit of saying things that quickly prove totally wrong. The other day he said there wasn’t going to be a recession. Before that, inflation was “temporary.” Last summer, it was that the Taliban wasn’t going to overrun Kabul. You can almost know what’s coming by expecting the opposite of whatever he predicts. That’s why I’m confident he won’t run for a second term. He keeps insisting that he will.Gail: I still don’t see any point in Biden’s announcing he won’t run this early in the calendar. He should wait until the end of the midterm elections. Then we can all turn our attention to the hordes of would-be successors waving their hands.That’ll still give Democrats a year to check out the options. Don’t you think that’s enough?Bret: If you’re the billionaire governor of Illinois, Jay Pritzker, it doesn’t make that much of a difference, since fund-raising isn’t an issue. Pete Buttigieg can’t be feeling as lucky. But either way I think it would be better for Biden to announce before the midterms. Maybe he will even find it liberating to be a president who can really govern for the rest of his term without the burden of a presumptive campaign and all the nagging questions about it. And it will send the message that he has the grace and wisdom to know it’s time to step aside, which is more than can be said for the Chuck Grassleys and Dianne Feinsteins of politics.Gail: Biden’s political clout, wobbly as it is right now, will vanish completely if he embraces lame-duck-hood. Announcing he’s not running by the end of the year seems a good timetable. But of course actually trying to stay in for another race would be a disaster.Bret: Gail, before we go we should probably mention that we’ll be taking the next two weeks off for travel and family. Any parting suggestions or recommendations for our readers till we reconvene?Gail: Stay cool, read something good — I’ve really been enjoying “A Gentleman in Moscow,” by Amor Towles, a novel about a count who’s trapped in his hotel after the Russian Revolution.     I Feel Utterly Hopeless About American Climate Policy

    In a column published in June 2021, I declared the coming year would be a “hinge in history” for American participation in the global effort to address the climate crisis. Having won the White House and control of the House and the Senate, Democrats had cracked open a rare window of political opportunity — their first chance since 2010 to pass major federal legislation to reduce our carbon emissions.But the window wasn’t very big, and it wouldn’t stay open long. President Biden had proposed setting a target of 2030 for the United States to cut carbon emissions to half of 2005 levels. He’d outlined hundreds of billions of dollars of investments in clean energy, public transit, electric vehicle infrastructure, severe weather preparedness and climate-related research and development. Now, in the face of united Republican opposition, and with midterm politicking rapidly approaching, could Democrats seize what I called “the country’s last best political opportunity” to address climate change and pass Biden’s plan?Well, a year has passed, and the answer is in: Nope.When Senator Joe Manchin pulled his support last week for even a significantly scaled-down version of Biden’s climate plan, America’s great window of opportunity all but slammed shut. Manchin’s decision was no surprise — he has been stringing his party along for more than a year — but for me it still packed a wallop.Was I thrown into a spiral of despair about the incapacity of our political system to take on urgent issues? Was I left feeling hopeless about the world’s efforts to avoid climate scientists’ worst-case scenarios? Did I wonder more than once what even was the point of Democrats running the show if they could not secure this plan? Yeah, maybe just a little.It is difficult to overstate the case for a huge federal effort on climate change. It’s popular — most Americans think Congress should address the causes and effects of climate change. And because there are new disasters brought about by a warming planet seemingly every week now, the issue will only grow more urgent. (About 100 million Americans are sweating through severe heat this week.)Biden’s plan also made economic sense: Regardless of whether America participates, a global transition to renewable fuels is already underway. China leads the United States (and the rest of the world) in growth in renewable power generation capacity and in solar panel manufacturing; because the Chinese government is investing heavily in renewables while we are not, we risk falling further behind in industries that will dominate the future.It has also rarely been clearer that our dependence on fossil fuels is doing us no national security favors. Biden was in Saudi Arabia last week when he conceded defeat on the climate bill. He was there to ask one brutal petromonarch for more oil because another brutal petromonarch is using his fossil fuel profits to finance an invasion of a sovereign neighbor. But despite an embarrassing fist bump with the Saudi crown prince, whose country Biden once aimed to sideline as a global “pariah,” the president hasn’t yet secured any guarantees for more oil. That may change at an upcoming meeting of the OPEC+ oil cartel — but shouldn’t we be striving for a future in which we wouldn’t have to bend to such characters because they happen to sit on a lot of dead plants and animals?It’s precisely the strength of the case for federal climate action that has left me feeling so down. Democrats seem headed toward losing their congressional majorities in the midterms, and Biden’s approval ratings are abysmal. It is difficult to imagine the party will get another shot at taking major climate action anytime soon. What will become of climate change as a political issue if Democrats are out in the political wilderness? Are we doomed to another decade of inaction?Climate experts told me not to abandon all hope. Alex Trembath, the deputy director of the Breakthrough Institute, an environmental research group, took issue last year with my characterization of Biden’s plan as a do-or-die moment for the American climate movement.“There isn’t a 12-year deadline or a one-year deadline,” Trembath told me this week. He argued that advocacy that leans on such deadlines is bound to provoke nihilism, and that a better way to talk about climate change is as a long-term issue that we will have to keep dealing with for as long as we live.     Bipartisan Senate Group Strikes Deal to Rewrite Electoral Count Act

    The changes outlined by the senators are intended to prevent a repeat of the effort on Jan. 6, 2021, to overturn the presidential election in Congress.WASHINGTON — A bipartisan group of senators proposed new legislation on Wednesday to modernize the 135-year-old Electoral Count Act, working to overhaul a law that President Donald J. Trump tried to abuse on Jan. 6, 2021, to interfere with Congress’s certification of his election defeat.The legislation aims to guarantee a peaceful transition from one president to the next, after the Jan. 6 attack on the Capitol exposed how the current law could be manipulated to disrupt the process. One measure would make it more difficult for lawmakers to challenge a state’s electoral votes when Congress meets to count them. It would also clarify that the vice president has no discretion over the results, and it would set out the steps to begin a presidential transition.A second bill would increase penalties for threats and intimidation of election officials, seek to improve the Postal Service’s handling of mail-in ballots and renew for five years an independent federal agency that helps states administer and secure federal elections.While passage of the legislation cannot guarantee that a repeat of Jan. 6 will not occur in the future, its authors believe that a rewrite of the antiquated law, particularly the provisions related to the vice president’s role, could discourage such efforts and make it more difficult to disrupt the vote count.Alarmed at the events of Jan. 6 that showed longstanding flaws in the law governing the electoral count process, a bipartisan group of lawmakers led by Senators Susan Collins, Republican of Maine, and Joe Manchin III, Democrat of West Virginia, had been meeting for months to try to agree on the rewrite.“In four of the past six presidential elections, this process has been abused, with members of both parties raising frivolous objections to electoral votes,” Ms. Collins said on Wednesday. “But it took the violent breach of the Capitol on Jan. 6 of 2021 to really shine a spotlight on the urgent need for reform.”In a joint statement, the 16 senators involved in the talks said they had set out to “fix the flaws” of the Electoral Count Act, which they called “archaic and ambiguous.” The statement said the group believed that, in consultation with election law experts, it had “developed legislation that establishes clear guidelines for our system of certifying and counting electoral votes for president and vice president.”Though the authors are one short of the 10 Republican senators needed to guarantee that the electoral count bill could make it past a filibuster and to final passage if all Democrats support it, they said they hoped to round up sufficient backing for a vote later this year.Ms. Collins said she expected the Senate Rules Committee to convene a hearing on the measures before the August recess. Senator Amy Klobuchar, Democrat of Minnesota and the chairwoman of the panel, was consulted in the drafting of the legislation.The bills were announced on the eve of a prime-time hearing by the House committee investigating the events surrounding the Jan. 6 attack, including Mr. Trump’s multilayered effort to invalidate his defeat. They also came as an investigation intensified into efforts by Mr. Trump and his allies to have Georgia’s presidential election results reversed. A Georgia judge has ordered Rudolph W.     Democrats Can Win This Fall if They Make One Key Promise

    Democrats hope to make November’s midterm elections a referendum on Roe v. Wade, the linchpin decision upholding abortion rights, which the Supreme Court is almost certain to strike down this summer. That strategy makes sense. Polls show that roughly two in three Americans oppose overturning Roe and almost 60 percent support passing a bill to set Roe’s protections in a federal law. What’s more, polls showed a rising number of voters listing abortion as their top midterm issue after news of Roe’s imminent demise leaked in the form of a draft court opinion published by Politico.Unfortunately, their current plan is almost sure to fail.After the Democrats came up with just 49 votes to bring a Roe-protecting bill before the Senate on May 11, they promised to keep fighting and, in the words of Senator Amy Klobuchar, “take that fight right to the ballot box” in November. But you can’t make an election into a referendum on an issue if you can’t point to anything winning the election would accomplish. To make the 2022 elections a referendum on Roe, Democrats have to put protecting Roe and abortion rights on the table.Here’s one way to do that: get clear public commitments from every Senate Democrat (and candidate for Senate) not only to vote for the Roe bill in January 2023 but also to change the filibuster rules to ensure that a majority vote would actually pass the bill and send it to the White House for the president’s signature.At present, there are likely 48 Senate Democrats who can make that pledge. Senators Joe Manchin and Kyrsten Sinema are dead set against any changes to the filibuster — a fact you likely know because most of President Biden’s agenda has been bottled up behind their refusal for the past year. Some claim that Senators Manchin and Sinema are just taking the public heat for a number of other Senate Democrats who are also unwilling to change the filibuster rules. That’s highly unlikely. But if any do have misgivings, that’s why the public commitments are so important. Getting a list of holdouts down to a publicly named handful is the first step to persuading them to fall in line.If my math is right and there are 48 Senate Democrats ready to make that pledge, they need two additional Democratic senators in the next Congress. And that is the party’s message that makes the 2022 midterms a referendum on Roe: “Give us the House and two more senators, and we will make Roe law in January 2023.”No ambiguity, no haggling, no living in Senator Manchin’s head for a year. You give us this, and we’ll give you that. That tells voters exactly what will be delivered with a Democratic win. It also defines what constitutes a win: control of the House and two more Senate seats.The campaign message is clear: If you want to protect Roe, give us those majorities. If this is your passion, here’s where to channel that passion. These are the Senate seats we need to hold (in New Hampshire, Arizona, Georgia and Nevada) and here are the ones we need to win (in Pennsylvania and Wisconsin and possibly in Ohio, Florida and North Carolina). With those commitments in hand, one question should be on the lips of every Democratic candidate. Will you make a firm commitment to never vote for a federal law banning abortion nationwide?Few, if any, Republicans would be able to make that pledge. And their evasions wouldn’t just make them look ridiculous; that would put squarely on the table the very real threat that Republicans would enact a nationwide abortion ban as soon as January 2025. That could prove enough to win Senate races in Pennsylvania, Wisconsin and Ohio.In a way, though, this strategy isn’t so much about winning the 2022 midterms or even making Roe into a federal law, although it’s the best way to accomplish both. It’s just an example of how you win elections.Effective campaigns are built on connecting the intense beliefs of the electorate — their hopes and fears — directly to the hard mechanics of political power. You’ve got to connect those wires. If you were testing some new electrical contraption, that’s the first thing you’d do: make sure the energy supply is wired to the engine that makes it run. This is no different. Without tying a specific electoral result to a clear commitment to a specific legislative action after the elections, you’re not connecting those wires.What Democrats would be proposing is a classic small-c conservative solution in the best sense of the word. Codifying Roe would preserve the set of rights and protections that the vast majority of Americans have lived their entire adult lives with and that the overwhelming majority of Americans do not want to change. The threat that the court will strike down such a law is real but overstated. And in any case, refusing to act because of what opponents might do is the definition of political paralysis.So how do Democrats get from here to there?They likely can’t rely on the party’s leaders, at least not at first. But they’re not essential. It’s really up to voters and activists and particularly committed members of Congress. Probably half the Democrats in the Senate would be happy to sign on this dotted line by the end of the day. Those who are up for re-election, even in safe races, will come around quickly.Some senators may resist at first. And that wouldn’t be surprising. Politicians seldom see any advantage to committing themselves in advance or reducing their room for maneuver. It’s always safer to keep your options open and be as general as possible until the final moment. That’s why assembling a clear public list of commitments is critical. Once the list gets down to a handful of hesitaters, the pressure from Democrats nationwide, focused on those members, will be overwhelming. If there are real holdouts, they’ll fold in short order.You don’t need to wait on Nancy Pelosi or Chuck Schumer or President Biden.     Congress Is Paralyzed on Guns. Here’s Why Chris Murphy Is Still Hopeful.

    The Democrat from Connecticut, who has spent his decade in the Senate trying and failing to enact gun safety bills, says his party should make the issue the core of its 2022 midterm message.WASHINGTON — It did not take long after the racist gun massacre in Buffalo for a familiar sense of resignation to set in on Capitol Hill about the chance that Congress would be able to muster the will to act on meaningful legislation to combat gun violence in America.In emotional remarks at the scene of the mass shooting on Tuesday, President Biden made no direct call for Congress to take such action. Afterward, he told reporters that he intended to do so, but was frank about his belief that persuading lawmakers to move would be “very difficult.”Around the same time, top Democrats on Capitol Hill were publicly conceding that their paper-thin majority in the Senate meant there was little they would be able to do to prevent the next tragedy.“We’re kind of stuck where we are, for the time being,” said Senator Richard J. Durbin, Democrat of Illinois and the chairman of the Judiciary Committee, playing down the chance that even a modest bill to strengthen background checks for gun purchases could overcome a Republican blockade.Senator Christopher S. Murphy, Democrat of Connecticut, shares his colleagues’ skepticism that any legislation can move. But he is also concerned that Democrats may squander a chance to turn the issue of gun safety into a rallying cry for the midterm elections.For a decade, the issue of gun violence has defined Mr. Murphy’s career; the 2012 massacre at Sandy Hook Elementary School in Newtown, Conn., took place a month after he won his seat.Mr. Murphy spoke to The New York Times from a Senate cloakroom about the chances for legislative action on guns, what Mr. Biden should do and why he thinks Democrats will lose control of Congress if they don’t make combating gun violence the core of their 2022 appeal to voters.The interview has been lightly edited and condensed for clarity.After the Sandy Hook Elementary School shooting, when 20 young children and six adults were killed, did Democrats and President Barack Obama miss the opportunity to pass meaningful gun safety legislation?There was this popular meme in 2013, which said that if the killing of 20 children didn’t result in any action, nothing will. That’s fundamentally the wrong way to look at how Washington works. There are few epiphanies here. It’s all about political power, and political muscle, and we’re in the process of building our own.The National Rifle Association and the gun lobby was ready for us, and for those parents, in 2013. That’s not true — that’s not why Congress flipped. Ever since then, Democrats are under the illusion that it’s a losing issue for us.It’s one of the most important wedge issues, and if we don’t talk about it, then we’re going to lose.Many are urging Senator Chuck Schumer and Mr. Durbin to bring up a bill to expand background checks. Even if it couldn’t pass, it would force Republicans to defend their opposition to a policy that polls show has broad support. Should they?There are times when show votes help define the parties. I’m not confident this is one of those moments, given the fact that it’s already pretty clear which side Republicans fall on and which side Democrats fall on.My main recommendation is for Democrats to go out and run on this issue, proudly and strongly. My worry is we would have a vote on the Senate floor, but then Democrats would not be willing to go out and talk about that vote in campaigns.The only way we actually change the dynamic on this issue is to make Republicans show we believe this is a winning electoral issue. That’s what we did in 2018. My worry is, we don’t feel the same confidence in this issue as a winning electoral issue in 2022.I don’t know why we don’t learn a lesson from 2018, that when we run strongly on the issue of guns, universal background checks, banning assault weapons, we turn out voters that otherwise would stay home in the midterms. I’ve talked to Senator Schumer about bringing a vote to the Senate floor. I’m not interested in taking a vote on the Senate floor if we don’t talk about it.If legislation can’t pass, what executive actions are you pushing the administration to take?There is still a ton of harmful gray area around the question of who needs to be a licensed gun dealer. There are a lot of folks peddling guns online and at gun shows who are truly in the business of selling guns, and should be required to do background checks. President Obama put out helpful, but not binding, guidance. The administration could put some real meat on the existing statute and define what it means to be in the business of selling guns.Have you pitched that to them?I have. There has been significant interest from the White House in pursuing that line of policy. I don’t know that they have made a commitment or issued any directive to the Justice Department.Do you support eliminating the filibuster in order to pass gun reforms?One hundred percent. The reason we can’t get this done is the rules of the Senate, not because the American people haven’t made a choice.Guns were one of the most important issues for voters in 2018; it ranked second behind health care. When voters came to the polls in 2018 and elected a Democratic majority in the House, it was with the explicit purpose of getting gun legislation passed. The same voters came back and elected a Democratic president. It’s simply the rules of the Senate that stopped the will of the American people from becoming law.Is there anything happening in terms of discussions with Senators Joe Manchin III, Democrat of West Virginia, and Patrick J. Toomey, Republican of Pennsylvania, about trying to revive their bill to tighten background checks?There’s nothing new happening now. Manchin-Toomey doesn’t have 60 votes. I spent much of the last two years trying to find a piece of Manchin-Toomey that could get 60 votes. Ultimately, we couldn’t find a landing place. I’ll continue to try any creative avenue to find an expansion of background checks.Does a weakened National Rifle Association create any opening for Republicans to move off their opposition to gun safety measures?This N.R.A. stamp of approval still really matters to them. Inside a Republican Party that has become bereft of big ideas, they’ve only got one left, which is the destruction of government. Nothing signals that more than the endorsement of the organization that supports people arming themselves against the government. In this era of anti-government fervor, it’s more important than ever.Eventually, we have to figure out a way for Republicans to show how much they hate government other than the N.R.A. endorsement. Maybe I should be rooting for the Club for Growth to be a more effective voice within the Republican Party.Can guns really be a winning issue for Democrats in a year when Republicans are attacking your party over inflation, rising gas prices and not meeting the basic needs of American families?I think voters are emotionally moved by the slaughter of innocents. And I think they find it a little weird when Democrats who claim to care about this don’t actually talk about it.We live in an era where authenticity is the coin of the realm. You just have to show voters who you are. I don’t think there’s any more potent means by which to translate who you are, and what you care about, than this issue. I think when you leave this out when you list your priorities as a candidate, it causes voters to scratch their heads a bit.What grade would you give the Biden administration on this issue?The administration could have moved faster on executive actions and the appointment of a new A.T.F. director. I want them to keep going. There’s still more regulatory and executive action that this administration can take and more things the team can do to use the bully pulpit to make sure this is an election issue.Would you give the administration a grade?No.A number of gun violence prevention organizations have called on Mr. Biden to open a White House Office of Gun Violence Prevention. Do you think that would make a difference?I do. It’s become clear to me we need a specific, driving focus on gun violence. The president is clearly personally committed to this issue, but he’s stretched thin due to myriad international and domestic crises. He would be best served by a high-level senior official who wakes up every day and coordinates the issue.After another mass shooting like the one in Buffalo, do you find yourself becoming resigned to the idea that nothing can be done on gun violence?I’ve studied enough great social change movements to know they often take decades to succeed. It was a full 10 years from the shooting of James Brady to the passage of the Brady handgun bill. I think I am part of one of these great social change movements, and I’m confident that you have to put up with a lot of failures before you’re met with success.I also don’t think democracy can allow for 80 percent of the American people to not get their way, forever. Eventually we will be able to break through. We just have not been able to find that pathway yet.This is an exhausting issue to work on, but I have this very deep sense that I will see my time in public service as a failure if I don’t meet the expectations of those parents in Sandy Hook, and Hartford and Bridgeport. And fear is a powerful motivator. More

    Trump Figures in West Virginia House Race

    The Republican-on-Republican blood feud developing in West Virginia is only over a single House seat, but the outcome of Tuesday’s primary between Representatives David McKinley and Alex Mooney will signal the direction of a potential Republican majority in Congress: Will it be a party of governance or one purely of ideology, driven by former President Donald J. Trump?Redistricting and West Virginia’s shrinking population forced the state’s Republican Legislature to pit Mr. McKinley, a six-term Republican with a pragmatic bent, against Mr. Mooney, who has served four terms marked more by conservative rhetoric than legislative achievements.Mr. McKinley has the backing of much of the state’s power structure, including its governor, Jim Justice, and, in recent days, its Democratic senator, Joe Manchin III. Mr. Mooney, however, may have the endorsement that matters most: Mr. Trump’s — in a state that gave the former president 69 percent of the vote in 2020.Neither candidate could exactly be called a moderate Republican, but Mr. McKinley thought his primary bid would be framed around his technocratic accomplishments, his support for the bipartisan infrastructure bill that was co-written by Mr. Manchin and his attentiveness to a state used to — and still in need of — federal attention.On Thursday, he and Governor Justice were in the state’s northern panhandle, not for a campaign rally but to visit a high-tech metal alloy plant.Mr. Mooney’s campaign does not go for nuance. His is built around one thing: Mr. Trump’s endorsement.The former president sided with Mr. Mooney after Mr. McKinley voted for the infrastructure bill as well as for legislation to create a bipartisan commission to examine the Jan. 6, 2021, attack on the Capitol — legislation that was filibustered by Republicans in the Senate.“Alex is the only candidate in this race that has my complete and total endorsement,” Mr. Trump says in a radio advertisement blanketing the state. The former president goes on to blast Mr. McKinley as a “RINO” — “Republican in name only” — “who supported the fake infrastructure bill that wasted hundreds of billions of dollars on the Green New Deal” and Speaker Nancy Pelosi’s “phony narrative” on Jan. 6 that went “against the interests of West Virginia.”A television advertisement also featuring Mr. Trump tells viewers that Mr. Mooney defended the former president from Ms. Pelosi’s “Jan. 6 witch hunt.”Sensing that any high-minded campaign on accomplishments was simply not going to work, Mr. McKinley has hit back at “Maryland Mooney” as a carpetbagger — he once headed the Maryland Republican Party and ran for office in New Hampshire — who is under investigation by the House Ethics Committee for charges that he improperly used campaign dollars and staff for personal gain.Representative David McKinley has gained the support of Senator Joe Manchin, a Democrat, in the Republican primary.Bill Clark/CQ Roll CallMost remarkably, Mr. McKinley has turned to a Democrat, Mr. Manchin, for his closing argument.“Alex Mooney has proven he’s all about Alex Mooney, but West Virginians know that David McKinley is all about us,” Mr. Manchin says in a McKinley campaign ad. He also calls Mr. Mooney a liar for suggesting that Mr. McKinley supported the far-reaching climate change and social welfare bill that Mr. Manchin killed.All of this is somewhat extraordinary in a state where federal largess has made politicians like the now-deceased Senator Robert C. Byrd and his protégé, Mr. Manchin, folk heroes. But the state has changed in the Trump era, and loyalties have hardened, said Scott Widmeyer, co-founder of the Stubblefield Institute for Civil Political Communications at Shepherd University in Shepherdstown, W.V.“We’ve seen heated political races, but I don’t think anything has been as nasty and down and dirty as this one,” he said. “Republicans are eating their own.”Institute officials invited both candidates to a debate, but only Mr. McKinley accepted. They then suggested that the candidates come separately to town hall meetings. Only Mr. McKinley accepted.Mr. Mooney is the one evincing confidence, however. Mr. McKinley entered the race at a structural advantage. The state’s newly drawn district includes 19 of the 20 counties Mr. McKinley previously represented and only eight of the 17 counties in Mr. Mooney’s current district. Mr. Mooney’s biggest population center, the capital in Charleston, was sent to Representative Carol Miller, the only other West Virginian in the House.But Mr. Trump is popular in every West Virginia county, and on the power of his name, Mr. Mooney has been posting polls from national and local outfits showing him up by double digits ahead of Tuesday’s primary.Understand the 2022 Midterm ElectionsCard 1 of 6Why are these midterms so important?
