    Lisa Murkowski Bets Big on the Center in Alaska

    ANCHORAGE — Sitting in a darkened exhibition room at the Anchorage Museum on a recent Tuesday morning, Senator Lisa Murkowski of Alaska conceded that she might lose her campaign for a fourth full term in Congress, where she is one of a tiny and dwindling group of Republicans still willing to buck her party.“I may be the last man standing. I may not be re-elected,” she said in an interview after an event here, just days after breaking with the G.O.P. to support confirming Judge Ketanji Brown Jackson, President Biden’s Supreme Court nominee and the first Black woman to serve there. “It may be that Alaskans say, ‘Nope, we want to go with an absolute, down-the-line, always, always, 100-percent, never-question, rubber-stamp Republican.’“And if they say that that’s the way that Alaska has gone — kind of the same direction that so many other parts of the country have gone — I have to accept that,” Ms. Murkowski continued. “But I’m going to give them the option.”In a year when control of Congress is at stake and the Republican Party is dominated by the reactionary right, Ms. Murkowski is attempting something almost unheard-of: running for re-election as a proud G.O.P. moderate willing to defy party orthodoxy.For Ms. Murkowski, 64, it amounts to a high-stakes bet that voters in the famously independent state of Alaska will reward a Republican centrist at a time of extreme partisanship.She has good reasons to hope they will. Though it leans conservative, Alaska is a fiercely individualistic state where the majority of voters do not align with either major political party. And under a new set of election rules engineered by her allies, Ms. Murkowski does not have to worry about a head-to-head contest with a more conservative opponent. Instead, she will compete in an Aug. 16 primary open to candidates of any political stripe, followed by a general election in which voters will rank the top four to emerge from the primary to determine a winner.Despite her penchant for defecting from the party line, Ms. Murkowski also has powerful help from the Republican establishment; Senator Mitch McConnell’s leadership political action committee announced last week that it had reserved $7.4 million worth of advertising in Alaska to support her candidacy.So she has embarked on a re-election campaign that is also an effort to salvage a version of the Republican Party that hardly exists anymore in Congress, as seasoned pragmatists retire or are chased out by right-wing hard-liners competing to take their places.“The easy thing would have been to just say, 20 years is good and honorable in the United States Senate. It’s time to, as I always say, it’s time to get my season ski pass at Alyeska and really get my money’s worth,” Ms. Murkowski said, referring to the nearby ski resort. “But there is a different sense of obligation that I am feeling now as a lawmaker.”Still, Ms. Murkowski, the daughter of a former Alaska senator and governor, faces a tough race. Her vote last year to convict former President Donald J. Many liberals have been angered by Ms. Murkowski’s opposition to sweeping climate change policies, as well as her support in 2017 for the $1.5 trillion Republican tax law that also allowed drilling in the Arctic National Wildlife Refuge.So Ms. Murkowski has been reminding voters of her flair for pursuing bipartisan initiatives, such as the $1 trillion infrastructure law that is expected to send more than $1 billion to her state, and promoting her strong relationships with Democrats. At an Arctic policy event in the Dena’ina Civic and Convention Center, she appeared with Senator Joe Manchin III, the centrist West Virginia Democrat, who was wearing an “I’m on Team Lisa” button and proclaimed, “I’m endorsing her 1,000 percent.”All of it is fodder for her staunchest opponents. Ms. Tshibaka, a Trump-endorsed former commissioner in the Alaska Department of Administration, has worked to paint Ms. Murkowski as a liberal and to rally the state’s conservative base against her. She is trying to capitalize on longstanding antipathy for the senator on the right, which was incensed when she voted in 2017 to preserve the Affordable Care Act and by her opposition in 2018 to Justice Brett M. Kavanaugh’s confirmation.“It’s time for a change. We feel forgotten,” Ms. Tshibaka told supporters at the opening of her Anchorage campaign office this month. “We feel unheard, and we don’t feel like these votes and decisions represent us.”Standing atop a desk, she urged them to “rank the red,” meaning to place her as their top choice without ranking any other candidate on the ballot.“We feel unheard, and we don’t feel like these votes and decisions represent us,” said Kelly Tshibaka, Ms. Murkowski’s leading challenger.Ash Adams for The New York TimesMs. Tshibaka, whose campaign did not respond to requests for an interview, told the crowd of supporters how Ms. Murkowski’s father, Frank, named his daughter to finish out his term as senator once he became governor in 2002, deriding what she called the “Murkowski monarchy.”Supporters grabbed slices of pizza and picked up bumper stickers, as well as decals that showed Ms. Murkowski embracing President Biden.“Nothing surprises me at this point. I don’t understand why she makes the decisions she makes,” said April Orth, 56, who called Ms. Murkowski’s vote to confirm Judge Jackson “an injustice to the people of the United States of America.”Ms. Tshibaka emphasized her conservative credentials and support from Mr. Trump, regaling the crowd with stories about her visit to the former president’s Mar-a-Lago resort in Palm Beach, Fla., for a campaign event. (The February event cost her campaign $14,477.10 for facility rental and catering, according to her latest campaign filing.)Joaquita Martin, 55, a paralegal, called Mr. Trump’s support “an incredibly powerful endorsement” of Ms. Tshibaka, adding that “I identify as a conservative, and Murkowski can call herself Republican all day long, but if that’s the definition of Republican, I’m out. That’s not me.”Ms. Murkowski’s decision to seek another term did not come lightly. She has not shied away from that distinction; she speaks openly of her disdain for Mr. Trump and his influence on her party. She has also supported Deb Haaland, Mr. Biden’s interior secretary and the first Native American to serve in the post, and boasted of her lead role in negotiating the infrastructure law.It has made for some unpleasant moments, she and her family say.“On one hand, had she chosen not to run, I would have been completely supportive because it’s just been like, ‘Damn girl, this has been a long haul,’” said Anne Gore, Ms. Murkowski’s cousin. “But on the other hand, you’re like, ‘Oh, sweet mother of Jesus, God on a bicycle — thank God you’re running’ because, you know, we can’t lose any more moderates.”While Ms. Murkowski has never secured more than 50 percent of the vote in a general election, this year she could stand to benefit from the new election rules, which advantage candidates with the broadest appeal in a state where most voters are unaffiliated.“I don’t think it changes their behavior, but it rewards behavior that is in line with the sentiment of all Alaskans, rather than the partisan few,” said Scott Kendall, a former legal counsel to Ms. Murkowski who remains involved with a super PAC supporting her re-election and championed the new rules.Mr. Kendall said his push for the statewide changes was independent from the senator’s campaign, arguing that his goal was “treating every Alaska voter the same and giving them the same amount of power.”There is little question that it has made for a friendlier landscape for Ms. Murkowski and appeals to the middle. At least one candidate, the libertarian Sean Thorne, jumped into the race because of the potential to prevail in a broad primary.For now, Ms. Murkowski is focusing on the basic needs of her state.Earlier this month, she stood, beaming, before about 1,200 local, tribal and community leaders who had flown across the state for a symposium explaining how Alaska stood to gain from the infrastructure law, which she singled out as perhaps her proudest accomplishment.“This is going to be an Alaska that is better cared for than ever before and an Alaska with a higher quality of life, whether you’re here in Anchorage or whether you’re in a remote village,” she declared. She mingled through the buzzing crowd, introducing herself as Lisa and embracing longtime friends.Ms. Murkowski’s campaign is focusing on the basic needs of her state and trumpeting the bipartisan infrastructure legislation that was passed last year.Ash Adams for The New York TimesTribal leaders talked about how the law would give them a chance to connect communities with broadband and ensure they had clean drinking water. A Kwethluk city employee waited to give the senator a handout describing a port project, while another village official asked for help with a broken washateria, first built in 1975, that had left them without running water since Christmas. And then there were the constituents who wanted a brief word about Ms. Murkowski’s work in Washington.Deventia Townsend, 62, a retired Army veteran and registered Democrat, had come to the forum with his wife, Charlene, to see if they could get help with some home repairs. But when he saw Ms. Murkowski, he stopped her to express his gratitude for her vote for Judge Jackson.“She has so much courage,” Mr. Townsend said of the senator. “She votes from her heart.”Later, at a pizza party at a local bar to benefit her campaign, Ms. Murkowski talked to supporters about her friendship with Mr. Manchin and long-gone titans of the Senate in both parties, name-dropping former Senator Daniel Inouye of Hawaii and quoting former Senator Ted Stevens of Alaska as she recalled a bygone era when camaraderie and common purpose tempered partisanship on Capitol Hill.Perhaps her own candidacy could prove there was still hope for that kind of politics.“You’ve got to demonstrate that there are other possibilities, that there is a different reality — and maybe it won’t work,” Ms. Murkowski said in the interview. “Maybe I am just completely politically naïve, and this ship has sailed.     Overhaul of Electoral Count Act Will Pass, Manchin Says

    Senators working to overhaul the law said recent revelations about former President Donald J. Trump’s efforts to overturn the 2020 election made their work even more crucial.WASHINGTON — Two senators working on an overhaul of the little-known law that former President Donald J. Trump and his allies tried to use to overturn the 2020 election pledged on Sunday that their legislation would pass the Senate, saying that recent revelations about the plot made their work even more important.In a joint interview on CNN’s “State of the Union,” Senators Joe Manchin III, Democrat of West Virginia, and Lisa Murkowski, Republican of Alaska, said their efforts to rewrite the Electoral Count Act of 1887 were gaining broader support in the Senate, with as many as 20 senators taking part in the discussions.“Absolutely, it will pass,” Mr. Manchin said of an overhaul of the law, which dictates how Congress formalizes elections.He said efforts by Mr. Trump and his allies to exploit “ambiguity” in the law were “what caused the insurrection” — the Jan. 6, 2021, attack on the Capitol. That misreading of the statute led to a plan by Mr. Trump and his allies to amass a crowd outside the Capitol to try to pressure Congress and Vice President Mike Pence, who presided over Congress’s official count of electoral votes, to overturn the results of the election.Ms. Murkowski said the rewrite could be expanded to include other protections for democracy, such as a crackdown on threats and harassment against election workers.“We want to make sure that if you are going to be an election worker,” Ms. Murkowski said, “you don’t feel intimidated or threatened or harassed.”A bipartisan group of at least 15 senators — which includes Mr. Manchin and Ms. Murkowski and is led by Senator Susan Collins, Republican of Maine — recently began discussions with another group that features top Democrats who have studied the issue for months. That group includes Senator Angus King, independent of Maine; Senator Amy Klobuchar, Democrat of Minnesota; and Senator Richard J. Durbin, Democrat of Illinois.Mr. King’s group last week released draft legislative text for a rewrite of the Electoral Count Act that would address deficiencies exposed by Mr. Trump’s plan. The bill would clarify that the vice president has no power to reject a state’s electors and ensure that state legislatures cannot appoint electors after Election Day in an effort to overturn their state’s election results.It would also give states additional time to complete legitimate recounts and litigation; provide limited judicial review to ensure that the electors appointed by a state reflect the popular vote results in the state; enumerate specific and narrow grounds for objections to electors or electoral votes; raise the thresholds for Congress to consider objections; and make it harder to sustain objections without broad support by both chambers of Congress.In an interview with The New York Times, Mr. King called his group’s draft “very nonpartisan” and said it included the input of conservative and liberal legal scholars.“Hopefully we can join forces and get a good bill,” Mr. King said of Ms. Collins’s group.The latest push to clarify the law follows a series of revelations about a campaign by Mr. Trump and his allies to try to overturn the 2020 election, including the surfacing of memos that show the roots of the attempts to use so-called alternate electors to keep Mr. Trump in power and the former president’s exploration of proposals to seize voting machines.On Friday, Mr. Pence offered his most forceful rebuke of Mr. Trump’s plan, saying the former president was “wrong” to insist that Mr. Pence had the legal authority to overturn the results of the election. Those comments came on the same day the Republican National Committee voted to censure two members of the party, Representatives Liz Cheney of Wyoming and Adam Kinzinger of Illinois, in a resolution that described the events of Jan. 6 as “legitimate political discourse.”Ms. Cheney and Mr. Kinzinger are the only Republican members of the special House committee investigating the Jan. 6 attack, which left more than 150 police officers injured and resulted in several deaths.The resolution drew criticism from some congressional Republicans on Sunday.Representative Michael McCaul, Republican of Texas, said on ABC’s “This Week” that he did “not agree with that statement — if it’s applying to those who committed criminal offenses and violence to overtake our shrine of democracy.”In an interview on NBC’s “Meet the Press,” Marc Short, Mr. Pence’s former chief of staff, said that “from my front-row seat, I did not see a lot of legitimate political discourse.”Mr. Short blamed Mr. Trump’s push to overturn the election on “many bad advisers who were basically snake-oil salesmen, giving him really random and novel ideas as to what the vice president could do.”He described being taken to a secure room in the Capitol with Mr. Pence on Jan. 6 as rioters stormed the building, some chanting, “Hang Mike Pence.” He said Mr. Trump and Mr. Pence did not talk that day.Mr. Short and another top Pence aide, Greg Jacob, recently testified before the committee, a step Mr. Pence’s advisers have hoped would stop the committee from issuing a subpoena for Mr. Pence. The first is a composition effect. In 2020, many low-paid workers were laid off. This raises the average, in the same way the average height in a room rises when the shortest person leaves. The composition effect went the opposite way in 2021, as low-paid workers were rehired.The other is a pandemic price effect. Many prices, most notably gasoline, were depressed when the world economy shut down because of the pandemic.     Are New Voting Bill Talks for Real or for Show?

    Senators involved in the negotiations underway say the discussions are serious and substantive, but some Democrats remain wary.WASHINGTON — Senator Richard Blumenthal, Democrat of Connecticut, was finally closing in on a hard-fought agreement with Republicans on a gun safety measure, following a string of horrific shootings in 2019, when the talks suddenly collapsed.New plans in the House to impeach President Donald J. Trump meant that Republicans were no longer in the mood to compromise with Democrats on anything, and the emerging accord went the way of so many seemingly promising ones on Capitol Hill in recent years, stymied by Republicans who said they were willing to accept some sort of deal — just not that one.“The world has become so polarized that our Republican colleagues come so very close to closing a deal, but then they begin staring down the abyss of their base and they recoil,” said Mr. Blumenthal, who attributed the Republican recalcitrance to fear of a political backlash for any cooperation with Democrats.The same has been true for other politically charged issues where efforts at compromise have ended up going nowhere in Congress. Republicans initially seemed willing to engage on legislation addressing immigration and police misconduct, for example, only to abruptly pull back, blaming Democrats for what they called unreasonable demands or a refusal to take hard steps that might anger their liberal supporters.So as a rump group of senators in both parties has recently ramped up discussions aimed at reaching a compromise on voting legislation, leading Democrats who saw their far broader voting rights package stall in the Senate last week have been wary.They worry that the emerging legislation could be a distraction from the pressing issue their bill was meant to address — Republican voter-suppression efforts at the state level — and amount to little more than cover for Republicans who want to appear interested in protecting election integrity despite uniformly opposing Democrats’ voting rights bill.They have taken note that Senator Mitch McConnell, the Kentucky Republican and minority leader, has blessed the effort — a telltale sign, say Democrats who have learned to be endlessly suspicious of his motives, that it might go nowhere.The Democratic fear is that once the moment passes and attention shifts away from election law to spending issues and now a contentious Supreme Court nomination, the talks will fizzle and Democrats will be left with nothing to show for their voting rights drive, even as the 2022 midterms loom and the 2024 election is just over the horizon.But leaders of the talks that now include at least 16 senators divided between Republicans and Democrats say they are substantive, gaining momentum and could produce legislation that might prevent another Jan. 6-style confrontation by focusing on fixing the deficiencies in the 135-year-old Electoral Count Act.They point to the bipartisan infrastructure measure that many of the same lawmakers were able to produce last year as their model for negotiations, and as proof that compromise is still possible.“I’m encouraged by the fact that almost every day, someone calls me and asks to join our group,” said Senator Susan Collins, the centrist Republican from Maine and a leader of the compromise effort. We made our best guess.Sign up here to get On Politics in your inbox on Tuesdays and Thursdays.Given that this is the last On Politics newsletter before Christmas, and of 2021 for that matter, it seems like a good time to take stock and reflect on what a wish list might be for the nation’s leaders.Today, Democrats control both the White House and Congress. But the party’s hold on power is so slim — the 50-50 split in the Senate means that Vice President Kamala Harris must break tied votes — that the entire Biden agenda is dependent on every single Democrat’s falling into line. And they aren’t all doing so.History bodes poorly for the party of the president in a first midterm election, and many Democrats are bracing for a rout in 2022. Here is what we think the nation’s leaders are looking for in the New Year:President Biden: He won the Democratic nomination after making two early bets in the primary that paid off big: that he would be seen as the most electable Democrat and that Black voters would be a loyal base. Both bets paid off. Similarly, Biden made an early two-pronged bet about the midterms: that a surging economy and a waning threat from the coronavirus would deliver victory to the Democrats.Right now, neither is happening.The omicron variant is bringing rising caseloads and fresh fears despite the widespread availability of vaccines. Meanwhile, monthly economic reports tell the story of the fastest inflation in decades, the kind of in-your-face figures that can swamp other positive economic indicators like the unemployment rate.Wish list: a stronger economy, shrinking inflation and a disappearing virus.Mitch McConnell: The Senate Republican leader has an excellent shot at returning to the majority in 2023 — after only two years in the minority. But while the overall political landscape appears rosy for the Republicans, McConnell’s party must navigate a series of primary races next spring and summer that he and his allies worry could result in extreme and unelectable nominees.Former President Donald J. Trump is an added X-factor. He has provided early endorsements for candidates who are not exactly prototypical McConnell recruits, including in North Carolina, Georgia and Pennsylvania, where the first Trump endorsee already dropped out. These days, Trump has even taken to insulting McConnell by name.Wish list: mainstream nominees in swing states for 2022; a toning down of Trump’s attacks. (The latter is probably more pipe dream than wish.)Chuck Schumer and Nancy Pelosi: The Senate majority leader and House speaker want mostly the same thing: to successfully negotiate passage of an enormous social policy bill, the Build Back Better Act, that would remake the social safety net and environmental policy.But there is precious little maneuvering room when you need the votes of liberal firebrands as well as the most conservative members of the caucus, like Senator Joe Manchin of West Virginia.Schumer has literally no votes to spare, which means every Democratically aligned senator holds de facto veto power. He also needs all 50 of those senators to stay healthy and present, not just for the Build Back Better bill but also other priorities like confirming judges and an attempt to pass voting-rights legislation.Wish list: Democratic health and unity; passage of the Build Back Better Act.Joe Manchin: The Senate’s most conservative and consequential Democrat recently declared on Fox News — yes, Fox News — that he was a no on the Build Back Better Act. It sent the White House scrambling and delivered a potentially fatal setback to the party’s signature legislation.Wish list: If Democrats knew for sure, it would already be in the bill.Kevin McCarthy: The House Republican leader has already started to be cast as the next speaker — presuming his party retakes the chamber — but his ascent would depend on more than just a Republican majority in 2022. Mr. McCarthy had to abandon his speakership ambitions in 2015. To succeed in 2023, he faces what Politico recently described as a “vexing speaker math problem”: a cohort of members yearning for an alternative, including some floating Trump himself. That may be far-fetched. But it is a sign of how hard it would be for McCarthy to navigate a majority as narrow as the one Pelosi has.Wish list: winning a big enough G.O.P. majority in 2022 to lead and run the House.Kamala Harris: The history-making vice president has faced a rash of negative media coverage in her first year and discovered, as Mark Z. Barabak of The Los Angeles Times put it, that the “vice presidency is an inherently subordinate position and one that sits ripe for ridicule.” Some of her most senior communications advisers are departing, and 2022 offers the chance at a reset, especially given the uncertainty — despite the White House’s public proclamations otherwise — that Biden will seek re-election in 2024, the year he will turn 82.Wish list: greater staff stability and a more positive portrayal in the press.Donald J. Trump: The former president may be off social media, but he has not receded from the political scene. He has been issuing statements from his new PAC at Twitterlike speed, endorsing a raft of candidates and continuing to raise money online by the bucketload, all while he is under investigation in New York for his business practices.He is talking out loud about running for president again.     McConnell to Manchin: We’d Love to Have You, Joe

    Senator Mitch McConnell, the Republican leader, says Democratic outrage over Senator Joe Manchin’s opposition to sweeping policy bills shows he is not welcome in his party any longer.WASHINGTON — Senator Mitch McConnell is extending an open invitation to Senator Joe Manchin III — come on over to our side.Mr. McConnell, the Kentucky Republican and minority leader, said on Tuesday that he was astonished by the angry response that Mr. Manchin of West Virginia elicited from the White House and his fellow Democrats with his Sunday bombshell that he would oppose President Biden’s signature domestic policy bill.The Senate, Mr. McConnell noted, is an institution where the most important vote is the next one, leaving the Republican leader perplexed as to what drove Democrats to impugn Mr. Manchin’s integrity by accusing him of reneging on commitments to the president.“Why in the world would they want to call him a liar and try to hotbox him and embarrass him?” Mr. McConnell, who is just one Senate seat away from regaining the majority leader title, asked in an interview. “I think the message is, ‘We don’t want you around.’ Obviously that is up to Joe Manchin, but he is clearly not welcome on that side of the aisle.”It is hardly a secret, Mr. McConnell said, that he has wooed Mr. Manchin for years, only to have Mr. Manchin, a lifelong Democrat, resist. And Mr. Manchin this week said he “hoped” there was still a place for him in the party.Despite his break with Mr. Biden over the sprawling safety net and climate change bill, Mr. Manchin would not be an exact fit for the Republican Party. He is closer to Republicans than Democrats on some flashpoint cultural issues like guns and abortion. But he has a more expansive view than most Republicans of the role of government in social and economic policy. And in both of former President Donald J. Trump’s impeachment trials, Mr. Manchin voted to convict.But Mr. McConnell seemed to see the clash over the spending measure as potentially providing a new opening for a party switch that would both restore him as majority leader and shift the ground in Washington. And he is also not against stirring up trouble for Democrats however and whenever he can.“Obviously we would love to have him on our team,” said Mr. McConnell. “I think he’d be more comfortable.”Mr. McConnell’s appeal to Mr. Manchin came as the Republican leader celebrated the year coming to a close without Democrats advancing two of their most ambitious priorities: legislation to bolster voting rights and the sprawling domestic policy bill that Mr. McConnell characterized as part of a “socialist surge that has captured the other side.”Considering how Republicans began 2021 — in the minority in Congress, a newly elected Democrat poised to move into the White House and a public worn down by a pandemic and alarmed by an assault on the Capitol — Mr. McConnell and his colleagues say they have had a successful year. In some respects, it was all the things they did not do that may have served them best.They did not maneuver themselves into shutting down the government as they have in the past — despite demands from the right that they never work with Mr. Biden. And they did not allow the government to default, with Mr. McConnell providing Democrats a circuitous path to raising the debt ceiling. Either could have created a backlash for Republicans.“We had a good deal of drama,” Mr. McConnell said about the high-wire act over the debt ceiling, “but in the end, we got the job done.”As Democrats spent months trying to hammer out the huge policy bill among themselves, Republicans were relegated to the sidelines. Mr. McConnell said Democrats’ inability to come together on it so far reflected a misreading of the 2020 elections, when voters gave them the White House but bare majorities in both the Senate and the House.“They did not have a mandate to do anything close to what they tried to do,” said Mr. McConnell, suggesting that progressive “ideology overcame their judgment.”The decision by Mr. McConnell and other Republicans to help Democrats write and pass a separate, $1 trillion public works bill was, Mr. McConnell said, a smart one, even though Republican supporters of the measure took heat from others in the party, notably Mr. Trump.Mr. McConnell said that applying pressure to keep the policy bill separate from the infrastructure measure denied Democratic leaders leverage over Mr. Manchin, who helped negotiate the infrastructure measure, while delivering a bipartisan bill that met legitimate needs. He said that Mr. Trump and other Republican critics had been proven wrong.“I think it was a much smarter play to support the infrastructure bill,” he said. “I think it was, A, good for the country, and B, smart for us politically.”Democrats have not given up on either the social policy bill or winning over Mr. Manchin, meaning Mr. McConnell and Senate Republicans will have to maintain their campaign against the legislation into the new year. Senator Chuck Schumer, the New York Democrat and majority leader, also intends to press forward with voting rights measures fiercely opposed by Mr. McConnell and is threatening to try to change Senate rules if Republicans try to filibuster it again.Democrats say Mr. McConnell is being complicit in allowing some states to impose new voting restrictions meant to target voters of color, a charge he rejects, saying that the impact of the new laws is being exaggerated. He said he was relying on Senator Kyrsten Sinema, the Arizona Democrat who recently reaffirmed her opposition to changing filibuster rules, to hold steady.“Kyrsten Sinema has been quite unequivocal that she is not going to break the Senate and eliminate the legislative filibuster,” he said. “Thank goodness for that.”One area where Mr. Biden and Senate Democrats have posted some victories is on judicial confirmations, with 40 judges being seated in the president’s first year, a number well in excess of other recent presidents. It is a subject of special interest to Mr. McConnell, since he spent the Trump era pushing conservative judges through the Senate.“Look, there’s some advantages to having the White House,” he said. “I’m not surprised, but the three Supreme Court justices and the 54 circuit judges we did are still there and I think will be good for the country for a long time to come.”Mr. McConnell said he believed his party’s performance this year and the struggles of the Democrats were setting Republicans up for a strong midterm election next year and his potential return to running the Senate no matter what party Mr. Manchin is in. Despite Mr. Trump’s efforts to encourage candidates he favors in key Senate races, Mr. McConnell said he was intent on avoiding the type of primary contests that in the past have hurt Republicans by saddling them with primary winners who falter in general elections.“I feel good about how we handled ourselves this year and I feel good about how the American public is reacting to what they are trying to do,” he said of the Democrats. “I believe it will be an excellent environment for us.” More

    Joe Manchin Is Wondering What Happened to His White House Christmas Card

    Gail Collins: Bret, this is our last conversation of the year. I’ve had a lot of fun disagreeing over the past 12 months. Mentioning that partly because it’s hard to imagine a whole lot of people saying, “Remember all the great times we had in 2021.”Bret Stephens: I had such high hopes for the year, Gail. Melania and Donald would slink quietly out of the White House, she in couture, he in ignominy. The vaccines would conquer the pandemic. Joe Biden would preside competently and serenely over a country looking for respite after four years of craziness. Relations with the rest of the world would improve. Republicans would wake up from their fever dreams and become a serious party again, or at least hang their heads in shame after the sacking of the Capitol on Jan. 6.Alas not. 2021 turned out to be even worse than 2020, and I’m struggling to see why 2022 will be any better. Care to cheer me up?Gail: OK, here’s a theory. Most of the things that were terrible about 2021 were reflections of a world that’s changing hyperfast because of new technology.Bret: The assault on the Capitol was more Genghis than Google. Sorry, go on ….Gail: Crazy people find it very, very easy to get in touch and swap paranoid fantasies. Mean people can gossip on sites that the targets of their ire can visit easily. (Always thinking about those teenage girls reading reviews of their clothes/figures/hair). Special events are dwindling — no point in going out to the movies if you can stream the latest attractions at home.Bret: Very true. Social media freezes us all in a kind of permanent middle school presided over by a mean girl named Veronica.Gail: None of this will go away, but I’m hoping that as we get more skilled in living with the good side of the web, things will balance out. Sane people will confer on how to make the world better. Families will automatically set places at holiday dinners for loved ones who can Zoom in from the other side of the country. And those who are consigned to their beds by illness or old age can have fantastic adventures via virtual reality headsets.Bret: That’s a bit too “Brave New World” for me, Gail. My hope for 2022 is that millions more Americans will realize that the worst thing they can do with their lives is to spend them working or socializing online. People should be dedigitizing — if that’s a word — disconnecting virtually and reconnecting physically. They should leave bigger cities in favor of places where nature is more accessible, homes are more affordable, neighbors are more approachable, careers are less cutthroat, the point of life isn’t the next promotion, weekends are actual weekends, people shop at real stores and read real books and have dinner with real people. Sitting around and doing nothing should be seen as a perfectly respectable use of time.Gail: Well, I’m not going to argue with you about the glories of doing nothing. But I can’t relate to your vision of finding meaningful life by ditching the big cities. Reminds me of growing up in an era of suburban explosion where the new neighborhoods had about as much diversity as a raft of albino waterfowl.Bret: Very insensitive to albino waterfowl, Gail.Gail: But maybe we’re both right — if the pandemic ever fades, the future could hold lots of urban-rural options and folks will get to pick.Bret: Well, that’s the meta-hope. The more specific hope is that we’ll finally lick the pandemic, Democrats will stop screwing up and the country won’t get handed back to Donald — “They’re Jewish people that run The New York Times” — Trump.Gail: I’m obviously not going to argue that the Democrats are doing a terrific job at present. But their situation — that 50-50 Senate, the pandemic-riddled economy — is pretty impossible. Don’t think any president could have delivered much in this mess. Not Reagan or Lyndon Johnson or maybe even F.D.R.Bret: Hmmm. Reagan had a Democratic-controlled House for his whole presidency. Biden could be doing better.Gail: Different kind of political parties back then. Trump’s turned the whole scene into something from “Attack of the Killer Bees.”Bret: Point taken.Gail: And oh my God, Joe Manchin. I’ll refrain from doing an hourlong rant, but this is a man whose state uses up way more government money than its people pay in taxes. Who wants to kill climate change legislation while he’s living off the millions he made in the coal business.Bret: And I’ll refrain from reminding you that I’ve been saying for months there was no way Manchin was going to vote for Biden’s legislation. I’ll also refrain from gloating.Gail: What I’d love to see is an election next year that gives Biden an actual, real, not-Manchin-dependent Democratic Congress so he could be tested on how he could deliver in a semi-sane world. Any chance, do you think?Bret: Very unlikely. Midterm elections historically go against the party holding the presidency. Republicans have the built-in advantage of being able to gerrymander more districts than Democrats. Biden’s poll numbers are terrible, and I don’t think he has the kind of political charisma to turn things around. And people are scared and angry, particularly about rising prices.Gail: Biden actually has a lot he can point to with pride, particularly in the war on the coronavirus. Still, I can’t say I disagree with you. Sigh.Bret: The only silver lining, as far as Democrats are concerned, is that Republicans always reach for the self-destruct button whenever they have control of Congress, particularly when it comes to the House. Donald’s Footstool, a.k.a. Kevin McCarthy, is not a compelling G.O.P. figurehead if he becomes speaker.Gail: If the Republicans have to rely on Kevin McCarthy’s charisma, that is certainly good news for the Democrats.Bret: Turning to another subject, Gail, Covid cases are skyrocketing again. What’s your prescription for doing things differently?Gail: The rules won’t change — get the shots, three of them, wear the damned masks and don’t patronize places that cater to crowds of people unless there’s a vaccination check at the door.Bret: Agreed. But keep schools open no matter what. It’s bad enough having a public-health crisis without having to add mental-health and learning crises on top of it.Gail: I’m fine with barring the unvaccinated from public places, including work, unless they’re prepared to start every day with a coronavirus test. And of course we’ve got to do battle against the right-wing ranters who try to get attention as anti-mask crusaders.That’s your party they’re coming from — any ideas on how to make them behave?Bret: Former party, Gail, former party. Roy Moore’s Senate candidacy was the last straw for me.Gail: Bret, weren’t you going to try to reform Republicanism from within? Not that we wouldn’t welcome you into the Democratic fold. I’ll bet Nancy Pelosi would be happy to hold a celebration, once parties are permitted again.Bret: I’m sure Madam Speaker would gladly send me a half-eaten box of crackers and a banana peel so I could slip on it.Truth is, I’m happy as an independent: It’s like getting to order à la carte, whereas everyone else is stuck with a bento box of things that don’t actually go together. Why do Republicans have to be in favor of more economic freedom but less social freedom? Why do so many Democrats favor something closer to the opposite? And why can’t ideologues of both the left and right wrap their heads around the Emerson line about a foolish consistency being the hobgoblin of little minds?Gail: I believe we’ve marched into a major disagreement. It’s true both parties are flawed, although I’d certainly argue that one has turned into Flaw City. But going independent is the worst possible response.Bret: Say more ….Gail: The only way you make a party better is by working from within. In New York, the primaries decide who the elected officials are going to be. Voting for an independent third-party candidate is worse than a waste. Registering as an independent is like telling a charitable fund-raiser that you want to help by sending good thoughts.Bret: Totally disagree! The more independents there are, the more Democrats and Republicans need to fight for their votes rather than take entire constituencies for granted, to bend toward the political center rather than toward the fringe, to pay attention to the personal quality of their candidates rather than insisting that they pass ideological purity tests, to accept nuance and compromise. We’ve become way too partisan as a country, and reducing the hold each party has on its own side is a good thing. I’d even say “independents of the world, unite,” but that would kinda defeat the purpose.Gail: I dunno, Bret. Nothing more irritating than that plague-on-both-your-houses posing. I say pick a side and work to improve it in 2022.Bret: To which I’d reply that each side should work harder to earn a vote, not assume they already own it.A final note before we say goodbye to this lousy year.     Why Joe Biden Needs More Than Accomplishments to Be a Success

    No president since Ronald Reagan has achieved a more ambitious domestic legislative agenda in his first year than Joe Biden. With a razor-thin congressional majority — far smaller than that of Barack Obama — President Biden has delivered two enormous spending bills, with another, the Build Back Better act, likely on its way. Elements of these bills will have a lasting effect on the economy into the next decade; they also push the country to the left.Every president since Reagan has tacked to the rightward winds set in motion by the conservative movement. Even Mr. Obama’s stimulus bill and the Affordable Care Act owed as much to conservative nostrums about the market and runaway spending as they did to liberal notions of fairness and equality. Mr. Biden has had to accommodate the demands of Senators Joe Manchin and Kyrsten Sinema, but their intransigence has not had nearly the constraining effect that the voices of austerity and market fetishism had on Bill Clinton or Mr. Obama.Yet over the past several months, Mr. Biden’s presidency has been dogged by a sense of failure. Critics, friendly and not so friendly, point to what he has not delivered — voting rights, immigration reform, a $15 federal minimum wage, labor law reform and a path to freedom from personal debt and fossil fuels. Democrats fear that Mr. Biden’s plummeting approval ratings and the party’s losses in the November elections indicate that the Republicans will take back Congress in the midterms.No president, however, achieves his entire agenda. And presidents have suffered first-term losses greater than those currently anticipated for 2022.The real cause of the unease about Mr. Biden lies elsewhere. There is a sense that however large his spending bills may be, they come nowhere near to solving the problems they are meant to address. There is also a sense that however much in control of the federal government progressives may be, the right is still calling the shots.The first point is inarguable, especially when it comes to climate change and inequality. The second point is questionable, but it can find confirmation in everything from a conservative Supreme Court supermajority to the right’s ability to unleash one debilitating culture war after another — and in the growing fear that Republicans will ride back into the halls of power and slam the doors of democracy behind them, maybe forever.There’s a sense of stuckness, in other words, that no amount of social spending or policy innovation can seem to dislodge. The question is: Why?A prisoner of great expectationsThough it came out in 1993, Stephen Skowronek’s “The Politics Presidents Make” helps us understand how Mr. Biden has become a prisoner of great expectations.American politics is punctuated by the rise and fall of political orders or regimes. In each regime, one party, whether in power or not, dominates the field. Its ideas and interests define the landscape, forcing the opposition to accept its terms. Dwight Eisenhower may have been a Republican, but he often spoke in the cadences of the New Deal. Mr. Clinton voiced Reaganite hosannas to the market.Regimes persist across decades. The Jeffersonian regime lasted from 1800 to 1828; the Jacksonian regime, from 1828 to 1860; the Republican regime, from 1860 to 1932; the New Deal order, from 1932 to 1980.Reagan’s market regime of deference to the white and the wealthy has outlasted two Democratic presidencies and may survive a third. We see its presence in high returns to the rich and low wages for work, continents of the economy cordoned off from democratic control and resegregated neighborhoods and schools. Corporations are viewed, by liberals, as more advanced reformers of structural racism than parties and laws, and tech billionaires are seen as saviors of the planet.Eventually, however, regimes grow brittle. Their ideology no longer speaks to the questions of the day; important interests lose pride of place; the opposition refuses to accept the leading party and its values.Every president presides over a regime that is either resilient or vulnerable. That is his situation. When Eisenhower was elected, the New Deal was strong; when Jimmy Carter was elected, it was weak. Every president is affiliated or opposed to the regime. That is his story. James Knox Polk sought to extend the slavocracy, Abraham Lincoln to end it. The situation and the story are the keys to the president’s power — or powerlessness.When the president is aligned with a strong regime, he has considerable authority, as Lyndon Johnson realized when he expanded the New Deal with the Great Society. When the president is opposed to a strong regime, he has less authority, as Mr. Obama recognized when he tried to get a public option in the Affordable Care Act. When the president is aligned with a weak regime, he has the least authority, as everyone from John Adams to Mr. Carter was forced to confront. When the president is opposed to a weak regime, he has the greatest authority, as Thomas Jefferson, Andrew Jackson, Lincoln, Roosevelt and Reagan discovered. These presidents, whom Mr. Skowronek calls reconstructive, can reorder the political universe.All presidents are transformative actors. With each speech and every action, they make or unmake the regime. Sometimes, they do both at the same time: Johnson reportedly declared that with the passage of the Civil Rights Act of 1964, the Democrats had lost the South for a generation, thereby setting the stage for the unraveling of the New Deal.What distinguishes reconstructive presidents from other presidents, even the most transformative like Johnson, is that their words and deeds have a binding effect on their successors from both parties. They create the language that all serious contestants for power must speak. They construct political institutions and social realities that cannot be easily dismantled. They build coalitions that provide lasting support to the regime. Alexander Hamilton thought every president would “reverse and undo what has been done by a predecessor.” Reconstructive presidents do that — in fact, they reverse and undo the work of many predecessors — but they also ensure that their heirs cannot.Politics is not physics. A president opposed to the established order may seek to topple it, only to discover that it is too resilient or that his troops are too feeble and lacking in fight. Where we are in political time — whether we are in a reconstructive moment, ripe for reordering, or not — cannot be known in advance. The weakness or strength of a regime, and of the opposition to the regime, is revealed in the contest against it.What is certain is that the president is both creature and creator of the political world around him. Therein lies Mr. Biden’s predicament.The language of reconstructionHeading into the 2020 Democratic primaries, many people thought we might be in a reconstructive moment. I was one of them. There was a popular insurgency from the left, heralding the coming of a new New Deal. It culminated in the Nevada caucus, where people of color and young voters — an emergent multiracial working class — put Bernie Sanders over the top, ready to move the political order to the left.There also were signs that the Reagan regime was vulnerable. Donald Trump’s candidacy in 2016 suggested that conservative orthodoxies of slashing Social Security and Medicare and waging imperial warfare no longer compelled voters. Mr. Trump’s presidency revealed a congressional G.O.P. that could not unite around a program beyond tax cuts and right-wing judges.As a candidate, Mr. Biden rejected the transformation Mr. Sanders promised and assured wealthy donors that “nothing would fundamentally change” on his watch. Yet there were signs, after he won the nomination and into the early months of his administration, of a new, “transformational” Mr. Biden who wanted to be the next F.D.R. The combination of the Covid economy, with its shocking inequalities and market failures, and a summer of fire and flood seemed to authorize a left-leaning politics of permanent cash supports to workers and families, increased taxes on the rich to fund radical expansions of health care, elder care and child care, and comprehensive investments in green energy and infrastructure, with high-paying union jobs.Most important, the package cohered. Instead of a laundry list of gripes and grievances, it featured the consistent items of an alternative ideology and ascendant set of social interests. It promised to replace a sclerotic order that threatens to bury us all with a new order of common life. This was that rare moment when the most partisan of claims can sound like a reasonable defense of the whole.Yet while Mr. Biden has delivered nearly $3 trillion in spending, with another $1.5 trillion to $2 trillion likely to pass, he has not created a new order. In addition to a transformation of the economy, such an order would require a spate of democracy reforms — the elimination of the filibuster and curbing of partisan gerrymandering, the addition of new states to the union, and national protection of voting rights and electoral procedures — as well as labor law reforms, enabling workers to form unions.What makes such reforms reconstructive rather than a wish list of good works is that they shift the relations of power and interest, making other regime-building projects possible. Today’s progressive agenda is hobbled less by a lack of popular support than by the outsize leverage conservatives possess — in the Senate, which privileges white voters in sparsely populated, often rural states; in the federal structure of our government, which enables states to make it difficult for Black Americans to vote; and in the courts, whose right-wing composition has been shaped by two Republican presidents elected by a minority of the voters. No progressive agenda can be enacted and maintained unless these deformations are addressed.The only way to overcome anti-democratic forces is by seeding democracy throughout society, empowering workers to take collective action in the workplace and the polity, and by securing democracy at the level of the state. That is what the great emblems of a reconstructive presidency — the 14th Amendment, which granted Black Americans citizenship, or the Wagner Act, which liberated workers from the tyranny of employers — are meant to do. They give popular energy institutional form, turning temporary measures of an insurgent majority into long-term transformations of policy and practice.It’s not clear that Mr. Biden wants such a reconstruction. And even if he did, it’s not clear that he could deliver it.What is stopping Biden?The forces arrayed against a reconstruction are many.The first is the Republican Party. Here the party has benefited less from the “authoritarian” turn of Mr. Trump than from the fact that the Trump presidency was so constrained. As Mr. Skowronek argues, “Nothing exposes a hollow consensus faster than the exercise of presidential power.” At critical moments, exercising power was precisely what Mr. Trump was not able to do.Confronting the free fall of the New Deal, Mr. Carter unleashed a stunning strike of neoliberal and neoconservative measures: deregulation of entire industries; appointment of the anti-labor Paul Volcker to the Fed; a military buildup; and renewed confrontation with the Soviet Union. These defied his party’s orthodoxies and unraveled its coalition. Reagan ended the New Deal regime, but Mr. Carter prepared the way.For all his talk of opposition to the Republican pooh-bahs, Mr. Trump delivered what they wanted most — tax cuts, deregulation and judges — and suffered defeat when he tried to break out of their vise. Republicans repeatedly denied him funds to support his immigration plans. They overrode his veto of their military spending bill, something Congress had not been able to do in the Carter, Reagan, Clinton, George W. Bush and Obama administrations. Mr. Trump’s own administration defied his Russia policy. This combination of weakness and deference to the G.O.P. helped keep the Republicans — and the Reagan regime — together.The second obstacle is the Democratic Party. There’s a reason party elites, led by Mr. Obama, swiftly closed ranks, when the time came, behind Mr. Biden and against Mr. Sanders. They wanted continuity, not rupture.Likewise a portion of the base. Many Democrats are older, with long memories and strong fears of what happens when liberals turn left (they lose). Newer recruits, who gave Mr. Biden the edge in some key districts, usually in the suburbs, are what the Princeton historian Matt Karp calls “Halliburton Democrats,” wealthy defectors from the Republican Party.“A regime is only as vulnerable as the political forces challenging it are robust,” writes Mr. Skowronek. That robustness is yet to be demonstrated. Despite the clarity of the path the Democrats must take if they hope to topple the Reagan order, it’s not clear the party wants to take it.The third obstacle to a Biden reconstruction is what Mr. Skowronek calls the “institutional thickening” of American politics. Since the founding era, the American political system has acquired a global economy, with the dollar as the world’s currency; a government bureaucracy and imperial military; a dense ecology of media technologies; and armies of party activists. While these forces offer the modern president resources that Jefferson never had, they also empower the modern-day equivalents of Jefferson’s opponents to resist a reconstruction. Should Mr. Biden attempt one, could he master the masters of social media? Mr. Trump tried and was banned from Twitter.The real institutions that get in the way of Mr. Biden and the Democrats, however, are not these latter-day additions of modernity but the most ancient features of the American state.The power of Senators Manchin and Sinema is an artifact of the constitutional design of the Senate and the narrowness of the Democratic majority, which itself reflects the fact that the institution was created to defend slave states rather than popular majorities. Their power is augmented by the centuries-old filibuster, which has forced Mr. Biden to jam many programs into one vaguely named reconciliation bill. That prevents him from picking off individual Republicans for pieces of legislation they might support (as he did with the infrastructure bill).Should the Republicans take the House in 2022, it will probably not be because of Tucker Carlson but because of gerrymandering. Should the Republicans take back the White House in 2024, it will probably be because of some combination of the Electoral College and the control that our federalist system grants to states over their electoral procedures.A polarized electorate divided into red and blue states is not novel; it was a hallmark of the last Gilded Age, which put the brakes on the possibility of a presidential reconstruction for decades. As the political scientist E.E. Schattschneider argued, the division of the country into the Republican North and Democratic South made the entire polity “extremely conservative because one-party politics tends strongly to vest political power in the hands of people who already have economic power.”How do we move past Reagan?Every reconstructive president must confront vestiges of the old regime. The slavocracy evaded Lincoln’s grasp by seceding; the Supreme Court repeatedly thwarted F.D.R. Yet they persisted. How?What each of these presidents had at their back was an independent social movement. Behind Lincoln marched the largest democratic mass movement for abolition in modern history. Alongside F.D.R. stood the unions. Each of these movements had their own institutions. Each of them was disruptive, upending the leadership and orthodoxies of the existing parties. Each of them was prepared to do battle against the old regime. And battle they did.Social movements deliver votes to friendly politicians and stiffen their backs. More important, they take political arguments out of legislative halls and press them in private spaces of power. They suspend our delicate treaties of social peace, creating turbulence in hierarchical institutions like the workplace and the family. Institutions like these need the submission of subordinate to superior. By withholding their cooperation, subordinates can stop the everyday work of society. They exercise a kind of power that presidents do not possess but that they can use. That is why, after Lincoln’s election, Frederick Douglass called the abolitionist masses “the power behind the throne.”An independent social movement is what Mr. Biden does not have.
