    Speaker Fight Reveals a Divided and Disoriented House Republican Majority

    In failing to coalesce around Kevin McCarthy for speaker, Republicans showcased divisions that portend real difficulties in governing.WASHINGTON — House Republicans began their new majority rule on Tuesday with a chaotic and historic debacle, an embarrassing failure to rally around a leader that showcased the difficulties they will face in performing even the basics of governing and their lack of a unifying agenda.Handed narrow control of the House by voters in November, Republicans squandered the opening hours of the new Congress they could have used to dispel concerns about their capabilities. Instead, they feuded in a disorderly display over who among them should be speaker as the most extreme elements of the new majority repeatedly rejected Representative Kevin McCarthy of California.Despite Mr. McCarthy’s prominent role in fund-raising and delivering the House to Republicans and his backing among most in the party ranks, about 20 Republicans refused to support him and for the first time in a century forced repeated rounds of voting for the speakership. After three flailing attempts at electing a speaker, Republicans abruptly called for the House to be adjourned until noon Wednesday as they scrambled for a way out of their leadership morass. The stalemate meant the usually routine organization of the new House did not occur and its members were not sworn in, nor could any legislation be considered.The paralysis underscored the dilemma facing House Republicans: No matter the concessions made to some of those on the far right, they simply will not relent and join their colleagues even if it is for the greater good of their party, and perhaps the nation. They consider themselves conservative purists who cannot be placated unless all their demands are met — and maybe not even then. Their agenda is mostly to defund, disrupt and dismantle government, not to participate in it.It means that whoever emerges from the messy leadership fight will face deep-seated resistance when trying to shepherd spending bills and other measures that are fundamental to governance. Tuesday’s spectacle reflected that House Republicans have grown more skilled at legislative sabotage than legislative success, leaving the difficult business of getting things done to others.“The rebels just don’t like McCarthy, and they seem to not be able to find a way to like him,” said John Feehery, a longtime Republican strategist and former top House aide. “They lack a legislative maturity to understand it can’t be personal. Archconservatives drove out John A. Boehner in 2015, denied Mr. McCarthy the votes needed to succeed Mr. Boehner at the time and complained about the stewardship of the compromise consensus choice of Paul D. Ryan. But Tuesday’s attack was their most aggressive yet, a nationally televised implosion that showcased the intransigence and unwillingness to compromise of a segment of House Republicans in what should have been a moment of triumph.

    Even Representative Marjorie Taylor Greene of Georgia, typically a Republican firebrand eager to stir turmoil, castigated those holding out on Mr. McCarthy because of how it reflected on the party’s image.“If the base only understood that 19 Republicans voting against McCarthy are playing Russian roulette with our hard-earned Republican majority right now,” Ms. Greene said on Twitter. “This is the worst thing that could possibly happen.”Democrats were enjoying the tumult to a degree but also recognized the problems it could mean down the road. Representative Mike Quigley, a senior Democrat from Illinois, said the speaker fight was the culmination of a growing Republican ethos of “taking their ball and going home” if they fail to get what they demand.Other Democrats watched in amazement as they saw Republicans open their reign with a clash that would leave whoever was eventually chosen badly undermined and the party’s strength diluted from the start.“What a weakened position they have put themselves in,” marveled Representative Rosa DeLauro, a senior Democrat from Connecticut.The uproar in the House was in marked contrast to the opening day of the Senate, where seven new members were sworn in and senators then quietly adjourned for three weeks.     McCarthy’s Bid for Speaker Remains in Peril Even After Key Concessions

    Representative Kevin McCarthy, Republican of California, is struggling to break through a wall of entrenched opposition from hard-right lawmakers even after agreeing to weaken his leadership power.WASHINGTON — Representative Kevin McCarthy’s bid to become speaker remained in peril on Monday as he toiled to break through the entrenched opposition of hard-right lawmakers and unite his fractious majority, with just hours to go before Republicans assume control of the House of Representatives.The refusal of ultraconservative lawmakers to embrace Mr. McCarthy, Republican of California, even after he made a key concession that would weaken his power in the top post, threatened a tumultuous start to G.O.P. rule in the House. The standoff underscored Mr. McCarthy’s precarious position within his conference and all but guaranteed that even if he eked out a victory, he would be a diminished figure beholden to an empowered right flank.In a vote planned for around midday on Tuesday, when the new Congress convenes, Mr. McCarthy would need to win a majority of those present and voting — 218 if every member of the House were to attend and cast a vote. But despite a grueling weekslong lobbying effort, he appeared short of the near-unanimity he would need within his ranks to prevail.A group of five Republicans has publicly vowed to vote against him, and more are quietly opposed or on the fence. Republicans are poised to control 222 seats and Democrats are all but certain to oppose him en masse, so Mr. McCarthy could afford to lose only a handful of members of his party.With little time left before the vote, Mr. McCarthy worked into the evening in the Capitol on Monday to try to lock down the votes, and some allies projected optimism that he could yet close the gap.“I think we can get there,” Representative Jim Jordan of Ohio told reporters as he left a meeting in Mr. McCarthy’s office Monday night.The haggling continued even after Mr. McCarthy had tried over the weekend to win over the hard-liners with a major concession, by agreeing to a rule that would allow a snap vote at any time to oust the speaker.Lawmakers opposing him had listed the change as one of their top demands, and Mr. McCarthy had earlier refused to swallow it, regarding it as tantamount to signing the death warrant for his speakership in advance. But in recent days, he signaled that he would accept it if the threshold for calling such a vote were five lawmakers rather than a single member.That was evidently not enough to sway the five rebels opposing him, and more dissenters emerged on Sunday night, after Mr. McCarthy announced the concession in a conference call with House Republicans.With the holdouts unwilling to bend, Mr. McCarthy could not tell lawmakers and members-elect during the call that he had secured the votes for speaker. Mr. McCarthy could only say that he still had time before the vote on Tuesday, according to two people familiar with the discussion who insisted on anonymity to describe it.A New Congress Takes ShapeAfter the 2022 midterm elections, Democrats maintained control of the Senate while Republicans flipped the House.George Santos: The Republican congressman-elect from New York, who is under scrutiny for lies about his background, is set to be sworn in even as records, colleagues and friends divulge more about his past.Elise Stefanik: The New York congresswoman’s climb to MAGA stardom is a case study in the collapse of the old Republican establishment, but her rise may also be a cautionary tale.Retirements: While each legislative session always brings a round of retirements, the departure of experienced politicians this year is set to reverberate even more starkly in a divided Congress.Roughly two hours later, a separate group of nine conservative lawmakers — most of whom had previously expressed skepticism about Mr. McCarthy’s bid for speaker — derided his efforts to appease their flank of the party as “almost impossibly late to address continued deficiencies.” The group included Representatives Scott Perry of Pennsylvania, the chairman of the Freedom Caucus, and Chip Roy of Texas.“The times call for radical departure from the status quo — not a continuation of past and ongoing Republican failures,” the group said in a statement. “For someone with a 14-year presence in senior House Republican leadership, Mr. McCarthy bears squarely the burden to correct the dysfunction he now explicitly admits across that long tenure.”The pile-on continued later on Monday, when the Club for Growth, the conservative anti-tax group, effectively threatened to punish Republicans who embraced a McCarthy speakership. The group announced that it would downgrade its public ratings of lawmakers who voted for any candidate who refused to return to the House rules in place in 2015, which allowed for the snap vote of no-confidence that drove out Speaker John A. Boehner, Republican of Ohio.The group also demanded that the next speaker bar the leading House Republican super PAC from spending money in open party primaries. That demand reflected a top grievance of conservative hard-liners in the House who are irate that Mr. McCarthy has used the committee to back more mainstream candidates.Mr. McCarthy has pledged to fight for the speakership on the House floor until the very end, even if it requires lawmakers to vote more than once, a prospect that now appears to be a distinct possibility. If he were to fail to win a majority on Tuesday, members would take successive votes until someone — Mr. McCarthy or a different nominee — secured enough supporters to prevail.Mr. McCarthy promised Representative Marjorie Taylor Greene a spot on the coveted Oversight Committee.Anna Rose Layden for The New York TimesThat could prompt chaos not seen on the House floor in a century. Every speaker since 1923 has been able to clinch the gavel after just one vote.Asked on Monday evening how many ballots it would take for Mr. McCarthy to prevail, Mr. Jordan replied, “We’ll see tomorrow.”He brushed off the threat of a messy floor fight that might take multiple ballots to resolve, telling reporters, “I think America will survive.”No viable candidate has yet stepped forward to challenge Mr. McCarthy, and it was not clear who would be able to draw enough support if he proved unable to do so. Potential alternatives who could emerge if he fails to secure enough votes include Representative Steve Scalise of Louisiana, his No. 2; Mr. Jordan, a onetime rival who has strong support among the powerful ultraconservative faction; and Representative Patrick T. McHenry of North Carolina, one of his close advisers.Laboring to avoid a scene and cement the speakership, Mr. McCarthy has made a number of concessions over the past few months in attempts to lock up votes of far-right members.He unveiled a package of rules on Sunday night governing how the House operates that included several demands issued by members of the Freedom Caucus, such as the adoption of the so-called Holman rule, which allows lawmakers to use spending bills to defund specific programs and fire federal officials or reduce their pay.The proposed rules would also end proxy voting and remote committee hearings, practices Democrats began in response to the pandemic, and create a new select subcommittee under the Judiciary Committee focused on the “weaponization” of the federal government.The package could also hamstring the Office of Congressional Ethics, which undertakes bipartisan inquires about lawmakers’ conduct and makes recommendations for discipline to the Ethics Committee. One proposed change would impose term limits for board members, which would result in the removal of all but one Democrat as the panel considers whether to begin an inquiry into certain Republican congressmen over their conduct related to the Jan. 6, 2021, attack on the Capitol.Another proposal would mandate that the office hire investigators within the first 30 days of a new Congress, a requirement some ethics experts fear could leave the office understaffed for lengthy periods if hires are not made within that time frame.Mr. McCarthy has also called for a “Church-style investigation” into past abuses of power by the Federal Bureau of Investigation and the Central Intelligence Agency. It is a reference to the select committee established in 1975, informally known by the name of the senator who led it, Frank Church of Idaho, that looked into abuses by American intelligence agencies.He toughened his language in response to hard-right demands to oust Alejandro N. Mayorkas, the homeland security secretary, calling on him to resign or face potential impeachment proceedings. He promised Representative Marjorie Taylor Greene of Georgia, who was stripped of her committee assignments for making a series of violent and conspiratorial social media posts before she was elected, a spot on the coveted Oversight Committee.Mr. McCarthy threatened to investigate the House select committee looking into the Jan. 6 attack, promising to hold public hearings scrutinizing the security breakdowns that occurred. Last month, he publicly encouraged his members to vote against the lame-duck spending bill to fund the government.It is unclear whether any single offering from Mr. McCarthy at this point would be enough to win over some lawmakers.During the call on Sunday, Representative-elect Mike Lawler of New York, who has announced his support for Mr. McCarthy, pointedly asked Representative Matt Gaetz of Florida, a ringleader of the opposition, whether he would vote for Mr. McCarthy if the leader agreed to lower the threshold for a vote to oust the speaker to just one member of Congress. But he was nominated by a lopsided majority of his conference and has remained the only broadly supported candidate for the post.The threat that some of Mr. McCarthy’s allies have dangled — that moderate Republicans could band together with Democrats to elect a Democratic speaker should he fail — is highly improbable.But the landscape could quickly change should Mr. McCarthy falter on Tuesday, when the new Congress convenes and lawmakers vote to elect a new speaker. House precedent requires that lawmakers continue voting on ballot after ballot if no one is able to win the gavel.     What a Failed Speaker Vote Means for Kevin McCarthy and Republicans

    Opening day in the House of Representatives is typically marked by the usual pageantry and the fleeting promise that this Congress will work better than the last. That hope could be immediately dashed this year if the House fails to elect a speaker on the first ballot and descends into a floor fight unprecedented in modern times.A small band of Republican misfits have vowed to vote against Kevin McCarthy, the party’s nominee for speaker. With a razor-thin majority, just five Republicans voting against him could deny Mr. McCarthy the gavel. This would be no small event. The House last failed to elect a speaker on the first ballot in 1923, and it’s only happened once since the Civil War.Electing a speaker is a responsibility given the House by the Constitution. Allowing the process to unravel into chaos would diminish the entire body and destroy Americans’ confidence in the new Congress. Mr. McCarthy still has time to reach an agreement with his critics, and he should do all within reason to secure the speakership on the first vote. Otherwise, a self-serving power play by a small group of Republicans threatens to make a mockery of the institution and further cement the notion that the party is not prepared to lead.A failed vote would badly weaken Mr. McCarthy or whoever the new speaker will be. The House is a majoritarian institution, and a speaker’s power is ultimately derived from the ability to produce the 218 votes needed to do business. If Republicans are unable to muster the votes for a speaker, it will make very clear from the outset they cannot be counted on to fulfill the body’s basic responsibilities, such as funding the government or preventing a credit default by lifting the debt ceiling, both of which will be required later this year.Should Mr. McCarthy come up short on the first ballot, it could take several more votes — and days — until we have a new speaker. But no matter who ultimately emerges as the top House Republican, the prolonged spectacle would leave the Republican majority hopelessly damaged from the start, along with the institution of the House itself.The Constitution requires that the House elect a speaker, and the vote takes priority over all other business. Nothing else can be done until the question is resolved. The House votes on a speaker before it formally adopts the set of rules governing the body. The incoming members of Congress won’t even be sworn in until after they choose a speaker.Without House rules in place, the body operates on precedent and basic parliamentary procedure. The precedent holds that a person must have a majority of those present and voting to be elected speaker. Those absent or voting “present” are not counted in the total, and thus can lower the number needed to win a majority. Even when things run smoothly, it is a time-consuming process. Over more than an hour, all 435 members are called alphabetically, and each shouts the name of their choice.While members are not bound to vote for a nominated person — or even for a member of the House, for that matter — the Congressional Research Service found that from 1945 to 1995, not a single member voted for anyone other than their party’s nominee. However, as our politics has become more fractured, a smattering of members have protested the party’s nominee by voting for someone else.None of these recent protest votes have derailed the election of a speaker, however — while a failed vote Tuesday would bring the House into a state of uncertainty no member has seen in their lifetime.The House cannot function until a speaker is elected and sworn in. Thus, the immediate order of business would be to simply vote again. The last time the first vote failed, 100 years ago, it required nine ballots over three days to name a speaker. In 1856, the speakership wasn’t resolved until the 133rd ballot.After a failed vote, the procedural options for both Mr. McCarthy and his detractors would be quite limited. Before another roll call vote, the House may entertain nominating speeches, whereby any member can rise and speak in favor of a candidate. While nominations are typically brief, this process may present an opportunity for Mr. McCarthy’s allies to make the case for his speakership. Lengthy nominating speeches could also be used to buy time while members work to reach an agreement in real time on the House floor. But the process could also unleash a circus on the floor, with Republican detractors using the opportunity to question Mr. McCarthy’s fitness for the job.Lawmakers could decide to change the process whereby a speaker is elected. Twice the House has voted to allow a speaker to be elected by a plurality rather than a majority vote. Both instances predated the Civil War and came only after weeks or, as in 1856, months of deadlock.The House could also move to adjourn, whether to a date or a certain time. Republicans may want to stop the voting to hold a meeting and attempt to resolve the matter privately. But, like everything in the House, adjourning requires a majority, which could prove difficult. House Democrats are unlikely to want to aid Mr. McCarthy, while those Republicans blocking him may not want the balloting to stop.In the event of a stalemate, Mr. McCarthy could face an important strategic question: Keep members on the floor voting while he seeks to cut a deal, or invite an even more unpredictable closed-door meeting of his conference? He may find that the best way out is through — by continuing to vote in a test of wills with people who are defying the choice of their conference.In the House, if you have a majority of the votes, you can do anything you want. If you don’t, you can’t do much of anything. It is easy to imagine several rounds of voting taking place in succession before someone wins or members relent and adjourn.Mr. McCarthy won an overwhelming vote within the House Republican conference to be the next speaker. Those opposing him know they are badly outnumbered, but they simply don’t care. Representative Andy Biggs has offered himself as a token opposition candidate. Though he has been fund-raising aggressively off his bid, Mr. Biggs has no chance to become speaker; if Mr. McCarthy fails, it will be a different Republican who takes the gavel. But the agitators’ objective isn’t to win the speakership for one of their own; it is to weaken Mr. McCarthy or whoever emerges as the next speaker of the House. The embarrassment indeed may be the point.The dissident members believe a weak speaker would make them more powerful.     Adam Schiff: Don’t Forget That Many Republicans in Congress Enabled Trump’s Big Lie

    On Dec. 27, 2020, more than six weeks after losing re-election, an infuriated President Donald Trump telephoned his acting attorney general, Jeffrey Rosen. Mr. Trump’s former attorney general, Bill Barr, had announced his resignation less than two weeks earlier, after telling the president that the claims of election fraud Mr. Trump had been trumpeting were — as Mr. Barr later bluntly put it in testimony — “bullshit” and publicly affirming that there was no fraud on a scale that would affect the outcome of the election.With Mr. Rosen’s deputy, Richard Donoghue, also on the line, Mr. Trump launched into the same tired, disproved and discredited allegations he had propagated so often at rallies, during news conferences and on social media. None of it was true, and Mr. Donoghue told him so. According to Mr. Donoghue, Mr. Trump, exasperated that his own handpicked top appointees at the Justice Department would not affirm his baseless allegations, responded: “Just say that the election was corrupt and leave the rest to me and the Republican congressmen.”It was a remarkable statement, even for a president who had serially abused the powers of his office. Having been told by the very department that had investigated his claims of fraud that they were untrue, Mr. Trump told the acting attorney general and his deputy to lie about it and said he would take it from there.That Mr. Trump was willing to lie so baldly about a matter at the heart of our democracy — whether the American people can rely on elections to ensure the peaceful transfer of power — now seems self-evident, even unremarkable, when we consider the violent attack on the Capitol he incited days later. But Americans shouldn’t lose sight of how this behavior indicts the former president, and not just the former president but the Republican members of Congress whom he knew would go along with his big lie.The report released Thursday from the Jan. 6 committee, on which I served, makes abundantly clear that there were multiple lines of effort to overturn the 2020 election. Some involved attempts to pressure state legislatures to declare the loser to be the winner. Others involved a fake electors plot, pressure on the vice president to violate his constitutional duty and efforts to force an elections official to “find” thousands of votes that didn’t exist. It was only when all of these other efforts failed that the president resorted to inciting mob violence to try to stop the transfer of power.But one line of effort to overturn the election is given scant attention, and that involved the willingness of so many members of Congress to vote to overturn it. Even after Capitol Police and Metropolitan Police put down the insurrection at great cost to themselves, the majority of Republicans in the House picked up right where they left off, still voting to overturn the results in important states.At one of our Jan. 6 committee hearings, the committee vice chair Liz Cheney, a Republican, called out her colleagues in Congress for their duplicity in the most searing terms: “There will come a day when Donald Trump is gone, but your dishonor will remain.”With our work on the committee largely concluded, it will now fall to the Justice Department to ensure a form of accountability that Congress is not empowered to provide, and to vindicate the rule of law in a manner beyond our reach: through prosecution. Multiple laws were violated in the course of a broad attempt to overturn the election, and not just by the foot soldiers who broke into the Capitol building that day and brutally assaulted police officers, but also by those who incited them, encouraged them and, when it was all over, gave them aid and comfort. Bringing a former president to justice who even now calls for the “termination” of our Constitution is a perilous endeavor. Not doing so is far more dangerous.There is a growing disdain for the law and for our country’s institutions, and a frightening acceptance of the use of violence to resolve political disputes. Mr. Trump’s big lie has been one of the most powerful instigators of political violence, since it persuaded millions of people that the election they lost must have been rigged or fraudulent. If people can be convinced of that, what is left but violence to decide who should govern? The attack on the Capitol was an all too foreseeable consequence of Mr. Trump’s relentless effort to alienate the people from their government and from the most important foundation of governance: their right to vote.Even the Constitution cannot protect us if the people sworn to uphold it do not give meaning to their oath of office, if that oath is not informed by ideas of right and wrong, and if people are unwilling to accept the basic truth of things. None of it will be enough.But if we allow ourselves to be guided by facts — not factions — and if we choose our representatives based on their allegiance to the law and to the Constitution, then we should have every confidence that our proud legacy of self-government will go on. It is our hope that this report will make a small contribution to that effort. Our country has never before faced the kind of threat we documented. May it never again.Adam B.     Jan. 6 Panel Accuses Trump of Insurrection and Refers Him to Justice Dept.

    WASHINGTON — The House committee investigating the Jan. 6 attack on the Capitol accused former President Donald J. Trump on Monday of inciting insurrection, conspiracy to defraud the United States, obstruction of an act of Congress and one other federal crime as it referred him to the Justice Department for potential prosecution.The action, the first time in American history that Congress has referred a former president for criminal prosecution, is the coda to the committee’s 18-month investigation into Mr. Trump’s effort to overturn the 2020 election that culminated in a violent mob of the former president’s supporters laying siege to the Capitol.The criminal referrals were a major escalation for a congressional investigation that is the most significant in a generation. The panel named five other Trump allies — Mark Meadows, his final chief of staff, and the lawyers Rudolph W. Giuliani, John Eastman, Jeffrey Clark and Kenneth Chesebro — as potential co-conspirators with Mr. Trump in actions the committee said warranted Justice Department investigation. The charges, including a fourth for Mr. Trump of conspiracy to make a false statement, would carry prison sentences, some of them lengthy, if federal prosecutors chose to pursue them.The committee’s referrals do not carry legal weight or compel any action by the Justice Department, which is conducting its own investigation into Jan. 6 and the actions of Mr. Trump and his allies leading up to the attack. But the referrals sent a powerful signal that a bipartisan committee of Congress believes the former president committed crimes.A Justice Department spokesman declined to comment on the referrals.Mr. Trump attacked the committee as “highly partisan” ahead of a final meeting the panel held on Monday to release an executive summary of its final report on the Capitol attack and to vote on referring the former president to the Justice Department.“It’s a kangaroo court,” Mr. Trump said Monday on “The Dan Bongino Show.” “The people aren’t going to stand for it.” He elaborated on that theme in a post on Truth Social, his social media network, after the meeting.“These folks don’t get it that when they come after me, people who love freedom rally around me. It strengthens me,” he said, adding that he “told everyone to go home” on Jan. 6, but leaving out his hours of inaction before that while a mob of his supporters rampaged through the Capitol.Republicans, who have vowed to investigate the committee after they take control of the House in January, mounted a modest response. Representative Elise Stefanik of New York, the No. 3 House Republican, was one of the few to react with a statement, accusing the committee of staging a “partisan charade.” She promised that Republicans “will hold House Democrats accountable for their illegitimate abuse of power.”The executive summary, a 154-page narrative of Mr. Trump’s relentless drive to remain in power after he lost the 2020 election by seven million votes, identifies co-conspirators who aided Mr. Trump. But it singles out the former president as the primary cause of the mob violence.“That evidence has led to an overriding and straightforward conclusion: The central cause of Jan. 6 was one man, former President Donald Trump, who many others followed,” the summary stated. “None of the events of Jan. 6 would have happened without him.”Understand the Events on Jan. 6Timeline: On Jan. 6, 2021, 64 days after Election Day 2020, a mob of supporters of President Donald J. President Biden has indicated his intent to run in 2024, and Mr. Trump announced his re-election campaign last month.The summary laid out step by step how Mr. Trump sought to cling to power, much as the committee did during its televised hearings in the summer. First, the summary said, Mr. Trump lied about widespread fraud, despite being told his claims were false. He then organized false slates of electors in states won by Mr. Biden as he pressured state officials, the Justice Department and Vice President Mike Pence to overturn the election. Finally, he amassed a mob of his supporters to march on the Capitol, where they engaged in hours of bloody violence while Mr. Trump did nothing to call them off.“Even key individuals who worked closely with President Trump to try to overturn the 2020 election on Jan. 6 ultimately admitted that they lacked actual evidence sufficient to change the election result, and they admitted that what they were attempting was unlawful,” the committee wrote.“Every president in our history has defended this orderly transfer of authority, except one,” said Representative Liz Cheney, Republican of Wyoming.Haiyun Jiang/The New York TimesThe panel also referred four Republican members of Congress to the House Ethics Committee — including the man seeking to become the next speaker, Representative Kevin McCarthy of California — because of their refusal to comply with the panel’s subpoenas.Mr. McCarthy’s office did not respond to a request for comment.The other Republicans referred were Representatives Jim Jordan of Ohio, Scott Perry of Pennsylvania and Andy Biggs of Arizona.A spokesman for Mr. Jordan, Russell Dye, said in a statement that the referral was “just another partisan and political stunt.” A spokesman for Mr. Perry, Jay Ostrich, said the committee was engaged in “more games from a petulant and soon-to-be kangaroo court.’’Mr. Biggs said in a tweet that the referral was the committee’s “final political stunt” and that he looked forward to “reviewing their documents, publishing their lies and setting the record straight” in the next Congress.In its summary, the committee did not entirely resolve disputed accounts of what happened inside the presidential S.U.V. when Mr. Trump was told by his Secret Service agents that they could not take him to the Capitol to join the crowd on Jan. 6. Cassidy Hutchinson, a former White House aide, testified under oath to the committee in public last summer that Anthony M. Ornato, a White House deputy chief of staff, told her that Mr. Trump grew so angry that he lunged at his Secret Service agent and tried to grab the steering wheel. The Secret Service denied that account anonymously.The summary said only that the “committee has now obtained evidence from several sources about a ‘furious interaction’” that occurred in the S.U.V. “The vast majority of witnesses who have testified to the select committee about this topic, including multiple members of the Secret Service, a member of the Metropolitan Police and national security officials in the White House, described President Trump’s behavior as ‘irate,’ ‘furious,’ ‘insistent,’ ‘profane’ and ‘heated.’”The committee’s summary also concluded that there was no nefarious reason for why the National Guard was delayed for hours in responding to violence of Jan. 6.“Although evidence identifies a likely miscommunication between members of the civilian leadership in the Department of Defense impacting the timing of deployment, the committee has found no evidence that the Department of Defense intentionally delayed deployment of the National Guard,” the committee wrote. “The select committee recognizes that some at the department had genuine concerns, counseling caution, that President Trump might give an illegal order to use the military in support of his efforts to overturn the election.”In its summary, the panel asked the Justice Department to investigate whether anyone had interfered with or obstructed the panel’s investigation, including whether any lawyers paid for by groups connected to Mr. Trump “may have advised clients to provide false or misleading testimony to the committee.”Among the committee’s findings, revealed at its meeting on Monday, was that lawmakers became concerned that lawyers who were paid by Trump associates may have tried to interfere with the panel’s investigation. The panel also learned that a client was offered potential employment that would make her “financially very comfortable” as the date of her testimony approached. But then offers were withdrawn or did not materialize as reports of the content of her testimony circulated, the committee said.The committee also chastised certain witnesses that it said had not been forthright with investigators. It said it had “significant concerns about the credibility” of the testimony of Mr. Ornato.The committee also said Kayleigh McEnany, one of Mr. Trump’s former press secretaries, and Ivanka Trump, the president’s elder daughter, had been less than forthcoming.The summary demonstrated, as the committee’s hearings did, how despite being told repeatedly that his claims of election fraud were false, Mr. Trump kept up the lies.Bill Stepien, a former White House political director, told the committee how he and others would investigate the claims, find them to be false, and report back to the president. “It’s an easier job to be telling the president about, you know, wild allegations,” Mr. Stepien said. “It’s a harder job to be telling him on the back end that, yeah, that wasn’t true.”The summary also contained evidence that certain White House aides had grown concerned about the potential for violence on Jan. 6 and urged Mr. Trump to make a pre-emptive statement calling for peace. No such statement was made.Hope Hicks, a former White House communications director, said she suggested “several times” on Jan. 4 and 5 that Mr. Trump “publicly state that Jan. 6 must remain peaceful, and that he had refused her advice to do so,” the panel wrote.The panel played new video from Ms. Hicks, who described a conversation with Mr. Trump.“I was becoming increasingly concerned that we were damaging his legacy,” Ms. Hicks said she told the president.Mr. Trump’s response? “Nobody will care about my legacy if I lose, so that won’t matter. The only thing that matters is winning,” she recalled him saying.Supporters of Mr. Trump confronting Capitol Police officers outside the Senate chamber on Jan. 6, 2021.Erin Schaff/The New York TimesWhile the executive summary of the report focused heavily on Mr. Trump, it did conclude some findings about law enforcement failures, a topic not previously addressed at the panel’s hearings. “No analysis recognized the full scale and extent of the threat to the Capitol on Jan. 6,” the committee wrote, although the “intelligence community and law enforcement agencies did successfully detect the planning for potential violence on Jan. 6, including planning specifically by the Proud Boys and Oath Keeper militia groups who ultimately led the attack on the Capitol.”Over the past year and a half, the committee interviewed more than 1,000 witnesses, obtained more than one million documents, issued more than 100 subpoenas and held hearings that drew millions of viewers.The House created the Jan. 6 committee after Senate Republicans used a filibuster to defeat a proposal to create an independent commission to investigate the attack.The committee — made up of seven Democrats and two Republicans — consistently broke new ground for a congressional investigation. Staffed with more than a dozen former federal prosecutors, the panel set a new production standard for how to hold a congressional hearing.     Why Kevin McCarthy Is Struggling to Get Republicans in Line

    Only a few weeks remain for the would-be House speaker to rally enough support to take power.The most fascinating election of 2023 is not happening in a presidential battleground like Arizona or Pennsylvania. It’s taking place in Washington, D.C., where Representative Kevin McCarthy of California is laboring mightily to become speaker of the House — a job he has long coveted.When the full House votes for speaker on Jan. 3, McCarthy will need the backing of a majority of all members. And with the party’s narrow hold on power, even a small number of Republican defections could imperil his bid. The uncertainty over McCarthy’s fate is roiling the G.O.P. while helping Democrats who want to portray Republicans as dysfunctional and hopelessly in thrall to extremists.Most of the action is taking place behind closed doors. But McCarthy’s allies and a rump faction of ultraconservative lawmakers have been dueling one another through the Beltway news media as January approaches, giving us glimpses of the jockeying and negotiations. The battle for speaker is taking place as Democrats try to push through a critical year-end spending bill that House Republicans almost universally oppose.The past week has brought a few developments — many of them baffling even to Capitol Hill insiders. On Friday, seven conservative hard-liners issued a lengthy list of demands to the would-be speaker, mostly involving obscure procedural rules. On Tuesday, a group of nearly 50 moderates aligned with McCarthy said they would oppose some of those ideas. Then on Wednesday, news broke that a different group of five anti-McCarthy members led by Representative Andy Biggs of Arizona had made a pact to vote as a bloc, one way or another. If they stick together, those five are enough to deny McCarthy his gavel, and it is not clear how he gets them to yes.But it’s also not clear that Republicans have another viable option. To reinforce that point, McCarthy’s allies have begun distributing buttons saying “O.K.” — as in “Only Kevin.”Annie Karni, a congressional correspondent for The New York Times, has been tracking the race closely. Here is our conversation, edited lightly for length and clarity:How large a faction are the McCarthy holdouts? Is it just the die-hards like Biggs and three or four others that some are calling the Never Kevins?Let me just start by saying that no one has any idea if McCarthy is going to pull this out. Reporters are asking Republicans. Republicans are asking reporters. The smartest people watching this closely are unwilling to make predictions at this point. McCarthy is playing it all very close to the vest. He’s not including other members of his leadership team in his deliberations or his calculations.As for your question, publicly, the Never Kevins are a small bunch: At least four people have said they are hard nos.But 31 House Republicans voted “no” on nominating McCarthy for the position back in November. How many of them were simply doing so to make a point but are ultimately for him? How many are still at “no” but keeping it to themselves, at least for now? McCarthy doesn’t necessarily know the entire list of people he has to win over.Has McCarthy won back any of the 31?That’s hard to answer, since it was a secret ballot and we don’t know who those 31 Republicans were. But it’s not a great sign for him that in the same vote, Representative Steve Scalise of Louisiana had unanimous support in his race to become the No. 2 House Republican next year. In other words, for these people, it isn’t an attack on the leadership. This is an attack on McCarthy.But it also might not mean that much. For context, all this turmoil is in line with how this phase of the process has played out in the past, for lawmakers who eventually won the speakership. Paul Ryan lost 43 votes in the secret ballot phase in 2015. Nancy Pelosi, in 2018, lost 32 votes. They both eventually emerged victorious and became speaker.What do the die-hards want? Is this just “blackmail,” as former Speaker Newt Gingrich wrote this week? Do they have some kind of ideal outcome in mind?This is what makes it extra tough for McCarthy. He has to contend with something that no Democrat has had to face: a sizable group that was sent to Congress explicitly to obstruct. Some of the people he is attempting to bargain with don’t seem to have a price. They’re not motivated by legislating as much as they are about shrinking the federal government, or upending it completely.That being said, the real sticking point is what’s known in congressional jargon as the “motion to vacate,” a term we try to avoid using in news stories because it’s meaningless to most readers. What it would do is change the rules to allow any member to force a snap floor vote to get rid of the speaker at any time. The holdouts want McCarthy to commit to allowing a vote like that. So far, that’s been a nonstarter for him; he understandably views the prospect as handing his enemies a loaded political weapon.Bottom line: It seems like McCarthy is dealing with some chaos agents, which makes his process a lot more difficult than it was for Pelosi in 2018. Back then, she also had to negotiate her way to the speakership, but she was dealing with a caucus made up of members with specific demands that she could address.The alternative to McCarthy is unlikely to be his current opponent, Biggs. The Beltway chatter is that if McCarthy fails to get the necessary votes on the House floor, someone of more stature than Biggs, like Scalise or Representative Patrick McHenry of North Carolina, could potentially get drafted into becoming a speaker candidate.You reported this week, with Maggie Haberman and Catie Edmondson, that Donald Trump had been making calls to House members to ask them to support McCarthy. What were you able to learn about the arguments he had been making, and how that was resonating?Yes, we reported that Trump had been calling members who are ambivalent, at best, about McCarthy serving as speaker.Trump is not that gung-ho about McCarthy, we understand, although some of the top people around him are very pro-McCarthy. Nonetheless, Trump has been calling Republican lawmakers because he doesn’t see a viable alternative and believes McCarthy is better for him than an improbable scenario where the job goes to a moderate who can draw some Democratic votes.Trump’s thinking is in line with how a lot of people are viewing this: OK, so you don’t love Kevin McCarthy. But what’s the real alternative? Regarding Trump and McCarthy, their relationship over the course of the past few years has had its ups and downs, but usually lands back at cordial. Friendly. Not particularly close. But not bad.Also, it’s good to remember that Trump officially endorsed McCarthy’s bid for speaker. So it’s in his interest, in terms of his personal scorecard of wins and losses, to have his endorsee pull this out.One more dynamic worth a fleeting mention: Trump is making calls for McCarthy, and yet one of Trump’s biggest allies in Congress, Representative Matt Gaetz of Florida, is one of the most vocal obstacles to McCarthy’s bid. Why can’t Trump get Gaetz to cease and desist? Trump has yet to make a big public campaign on McCarthy’s behalf that would resonate with constituents of these members and put more pressure on them.So many of the concessions McCarthy has made thus far are about arcane issues, like funding formulas. But he has also welcomed into the fold far-right figures like Representatives Marjorie Taylor Greene of Georgia and Paul Gosar of Arizona and promised to restore their committee assignments. Has that bargain been worth it, from his perspective?Definitely. McCarthy wants to be speaker. He’s known as an aggressive fund-raiser, an affable people person, and generally a go-along-to-get-along guy. He’s not an ideologue, which means that he’s less scary to some Democrats than, say, Representative Jim Jordan of Ohio. But it also means he’s not bothered by making compromises for these far-right members, if it means getting where he wants.Greene has been publicly vouching for McCarthy. It’s funny — before the midterm elections, when there were questions about what could happen to thwart McCarthy’s plans to become speaker, it seemed like Greene or Trump could pose the biggest problems for him. If Trump, for instance, turned on him, the thinking was that Trump’s influence on the far right of the Republican Party would cost McCarthy critical votes.But here we are, with Trump and Greene on Team McCarthy.
