Trump, 13 months ago, the former president commanded near-total fealty from his party. His conservative defenders were ardent and numerous, and Republican votes to convict him — for pressuring Ukraine to help him smear Joseph R. Biden Jr. — were virtually nonexistent.In his second trial, Mr. Trump, no longer president, received less ferocious Republican support. His apologists were sparser in number and seemed to lack enthusiasm. Far fewer conservatives defended the substance of his actions, instead dwelling on technical complaints while skirting the issue of his guilt on the charge of inciting the Jan. 6 riot at the Capitol.And this time, seven Republican senators voted with Democrats to convict Mr. Trump — the most bipartisan rebuke ever delivered in an impeachment process. Several others, including Mitch McConnell, the minority leader, intimated that Mr. Trump might deserve to face criminal prosecution.Mr. McConnell, speaking from the Senate floor after the vote, denounced Mr. Trump’s “unconscionable behavior” and held him responsible for having given “inspiration to lawlessness and violence.”Yet Mr. McConnell had joined with the great majority of Republicans just minutes earlier to find Mr. Trump not guilty, leaving the chamber well short of the two-thirds majority needed to convict the former president. The vote stands as a pivotal moment for the party Mr. Trump molded into a cult of personality, one likely to leave a deep blemish in the historical record. Even offline and off camera at his Palm Beach estate, and offering only a feeble impeachment defense through his legal team in Washington, the former president continues to command unmatched admiration from conservative voters.Indeed, in a statement celebrating the Senate vote on Saturday, Mr. Trump declared that his political movement “has only just begun.”The determination of so many Republican lawmakers to discard the mountain of evidence against Mr. Trump — including the revelation that he had sided with the rioters in a heated conversation with the House minority leader, Kevin McCarthy — reflects how thoroughly the party has come to be defined by one man, and how divorced it now appears to be from any deeper set of policy aspirations and ethical or social principles.After campaigning last year on a message of law and order, most Republican lawmakers decided not to apply those standards to a former commander in chief who made common cause with an organized mob. A party that often proclaimed that “Blue lives matter” balked at punishing a politician whose enraged supporters had assaulted the Capitol Police. A generation’s worth of rhetoric about personal responsibility appeared to founder against the perceived imperative of accommodating Mr. Trump.Lanhee Chen, a Hoover Institution scholar and policy adviser to a number of prominent Republican officials, said the G.O.P. would need to redefine itself as a governing party with ambitions beyond fealty to a single leader.“When the conservative movement, when the Republican Party, have been successful, it’s been as a party of ideas,” Mr. Chen said, lamenting that much of the party was still taking a Trump-first approach.“Many Republicans are more focused on talking about him than about what’s next,” he said. “And that’s a very dangerous place to be.”In recent weeks, the party has been so submerged in internal conflict, and so captive to its fear of Mr. Trump, that it has delivered only a halting and partial critique of Mr. Biden’s signature initiatives, including his request that Congress spend $1.9 trillion to fight the coronavirus pandemic and revive the economy. Mr. Trump’s tenure as an agent of political chaos is almost certainly not over. The former president and his advisers have already made it plain that they intend to use the 2022 midterm elections as an opportunity to reward allies and mete out revenge to those who crossed Mr. Trump. Mr. McConnell has told associates that he intends to wage a national battle in 2022 against far-right candidates and to defend incumbents targeted by Mr. Trump.But by declining to convict Mr. Trump on Saturday, Mr. McConnell invited skepticism about how willing he might be to wage open war against Mr. Trump on the campaign trail.House Speaker Nancy Pelosi ridiculed Mr. McConnell for his ambivalent position after his floor speech, calling his remarks “disingenuous” and speculating that he had delivered them for the benefit of his financial backers who dislike Mr. Trump.The vote by Republicans to acquit Mr. Trump, she said in a statement, was among the “most dishonorable acts in our nation’s history.”Only a few senior Republicans have gone so far as to say that it is time for Mr. Trump to lose his lordly status in the party altogether. Representative Liz Cheney of Wyoming, the highest-ranking House Republican to support impeachment, said in a recent television interview that Mr. Trump “does not have a role as a leader of our party going forward.”Several of the Republican senators who voted for conviction on Saturday thundered against Mr. Trump after he was acquitted, in terms that echoed Ms. Cheney’s explanation last month of her own vote to impeach him.“By what he did and did not do, President Trump violated his oath of office to preserve, protect and defend the Constitution of the United States,” said Senator Richard Burr of North Carolina, a senior lawmaker who is close to Mr. McConnell.But the lineup of Republicans who voted for conviction was, on its own, a statement on Mr. Trump’s political grip on the G.O.P. Only Senator Lisa Murkowski of Alaska is up for re-election next year, and she has survived grueling attacks from the right before.The remainder of the group included two lawmakers who are retiring — Mr. Burr and Senator Pat Toomey of Pennsylvania — and three more who just won new terms in November and will not face voters again until the second half of the decade.More typical of the Republican response was that of Senator Bill Hagerty of Tennessee, a Trump loyalist serving his first term. The trial, he said on Saturday, was merely “a political performance” aimed at undermining a “successful” chief executive.In Washington, a quiet majority of Republican officials appears to be embracing the kind of wishful thinking that guided them throughout Mr. Trump’s first campaign in 2016, and then through much of his presidency, insisting that he would soon be marginalized by his own outrageous conduct or that he would lack the discipline to make himself a durable political leader.Several seemed to be looking to the criminal justice system as a means of sidelining Mr. Trump. Senator Thom Tillis of North Carolina, who voted for acquittal, noted in a statement, “No president is above the law or immune from criminal prosecution, and that includes former President Trump.”Prosecution may not be a far-fetched scenario, given that Mr. Trump is facing multiple investigations by the local authorities in Georgia and New York into his political and business dealings.But passing the buck has seldom paid off for Mr. Trump’s adversaries, who learned repeatedly that the only sure way to rein him in was to beat him and his legislative proxies at the ballot box. That task has fallen almost entirely to Democrats, who captured the House in 2018 to put a check on Mr. Trump and then ejected him from the White House in November.Still, Senator Kevin Cramer of North Dakota, a longtime Trump ally who has been critical of the former president since the November election, told reporters in the Capitol on Friday that he believed Mr. Trump would be weakened by the impeachment trial, even if the Senate opted not to convict him. It has been willingly adopted by millions of his followers, as well as by a majority of Republican members of Congress — 145 to 108 — and by thousands of Republican state and local officials, all of whom have found it expedient to capitulate to the fantastical claim that the election was stolen by the Democratic Party, its officeholders, operatives and supporters.Trump’s sprawling conspiracy theory is “being reborn as the new normal of the Republican Party,” Justin Ling wrote in Foreign Policy on Jan. 6.A Dec 30 NPR/Ipsos poll found that “recent misinformation, including false claims related to Covid-19 and QAnon, are gaining a foothold among some Americans.”According to the survey, nearly a fifth of American adults, 17 percent, believe that “a group of Satan-worshiping elites who run a child sex ring are trying to control our politics.” Almost a third “believe that voter fraud helped Joe Biden win the 2020 election.” Even more, 39 percent, agree that “there is a deep state working to undermine President Trump.”The spread of these beliefs has wrought havoc — as demonstrated by the Jan. 6 assault on Congress, as well as by the overwhelming support Republicans continue to offer to the former president.Well before the election, on Aug. 22, 2020, my news-side colleagues Matthew Rosenberg and Maggie Haberman described the rising strength of conspiracists in Republican ranks in “The Republican Embrace of QAnon Goes Far Beyond Trump”:A small but growing number of Republicans — including a heavily favored Republican congressional candidate in Georgia — are donning the QAnon mantle, ushering its adherents in from the troll-infested fringes of the internet and potentially transforming the wild conspiracy theory into an offline political movement, with supporters running for Congress and flexing their political muscle at the state and local levels.Conspiracy theorists are by definition irrational, contradictory and inconsistent. Polarization, the Covid-19 pandemic and the specter of economic collapse have engendered suspicion. Many on the right see “liberal elites” pulling strings behind closed doors, and paranoia flourishes.According to Joseph E. Uscinski and Joseph M. Parent, professors of political science at the University of Miami and Notre Dame, conspiracy theorists do not “hold coherent, constrained policy positions.” In a forthcoming paper, “Who Supports QAnon? A Case Study in Political Extremism,” Uscinski explores what he identifies as some of the characteristics of the QAnon movement: “Support for QAnon is born more of antisocial personality traits and a predisposition toward conspiracy thinking than traditional political identities and motivations,” he writes, before going on to argue thatWhile QAnon supporters are “extreme,” they are not so in the ideological sense. Rather, QAnon support is best explained by conspiratorial worldviews and a predisposition toward other nonnormative behavior.Uscinski found a substantial 0.413 correlation between those who support or sympathize with QAnon and “dark” personality traits, leading him to conclude that “the type of extremity that undergirds such support has less to do with traditional, left/right political concerns and more to do with extreme, antisocial psychological orientations and behavioral patterns.”The illogic of conspiracy theorists is clear in the findings of a 2012 research paper, “Dead and Alive: Beliefs in Contradictory Conspiracy Theories,” by Karen M. Douglas and Robbie M. Sutton, members of the psychology department at the University of Kent, and Michael J. Wood, a former Kent colleague. The authors found that a large percentage of people drawn to conspiracy thinking are willing to endorse “mutually incompatible conspiracy theories.”In one study, for example, “the more participants believed that Osama Bin Laden was already dead when U.S. Special Forces raided his compound in Pakistan, the more they believed he is still alive.” In another study, “the more participants believed that Princess Diana faked her own death, the more they believed that she was murdered.” For those who hold such beliefs, the authors wrote, “the specifics of a conspiracy theory do not matter as much as the fact that it is a conspiracy theory at all.”Douglas, in an email, wrote that “people are attracted to conspiracy theories when important psychological needs are not being met.” She identified three such needs: “the need for knowledge and certainty”; the “existential need” to “to feel safe and secure” when “powerless and scared”; and, among those high in narcissism, the “need to feel unique compared to others.”Uscinski and two collaborators, in their 2016 paper, “What Drives Conspiratorial Beliefs? The Role of Informational Cues and Predispositions,” describe how they identify likely conspiracy believers by asking respondents whether they agree or disagree with the following statements:“Events like wars, the recession, and the outcomes of elections are controlled by small groups of people who are working in secret against the rest of us”; “Much of our lives are being controlled by plots hatched in secret places”; “Even though we live in a democracy, a few people will always run things anyway”; “The people who really ‘run’ the country, are not known to the voters.”Believers in conspiracies will often automatically dismiss factual claims disputing their beliefs. Jovan Byford, a senior lecturer in psychology at the Open University in England, makes the case thatConspiracy theories seduce not so much through the power of argument, but through the intensity of the passions that they stir. Underpinning conspiracy theories are feelings of resentment, indignation and disenchantment about the world. They are stories about good and evil, as much as about what is true.Byford continues:Lack of evidence of a conspiracy, or positive proof against its existence, is taken by believers as evidence of the craftiness of those behind the plot, and their ability to dupe the public.There are five common ingredients to conspiracy theories, according to Jan-Willem van Prooijen and Mark van Vugt, professors of psychology at the Vrije Universiteit Amsterdam, in their paper “Conspiracy Theories: Evolved Functions and Psychological Mechanisms.”First, they write,Conspiracy theories make an assumption of how people, objects, or events are causally interconnected. Put differently, a conspiracy theory always involves a hypothesized pattern. Second, conspiracy theories stipulate that the plans of alleged conspirators are deliberate. Conspiracy theories thus ascribe intentionality to the actions of conspirators, implying agency. Third, a conspiracy theory always involves a coalition, or group, of actors working in conjunction. An act of one individual, a lone wolf, does not fit the definition of a conspiracy theory. Fourth, conspiracy theories always contain an element of threat such that the alleged goals of the conspirators are harmful or deceptive. Fifth, and finally, a conspiracy theory always carries an element of secrecy and is therefore often difficult to invalidate.Van Prooijen elaborated on his analysis in an email:Conspiracy theories are a powerful tool to demonize opposing groups, and in extreme cases can make people believe that violence is necessary. In this case (Jan. 6), the crowd clearly believed that the elections were stolen from their leader, and this belief incited them to fight for what they believed was a just cause. Most likely the conspiracy theories make them perceive themselves as a sort of “freedom fighter.”Van Prooijen sees conspiracy thinking as deeply rooted in the evolutionary past.Our theory is that conspiracy theories evolved among ancestral humans to prepare for, and hence protect against, potentially hostile groups. What we saw here, I think was an evolutionary mismatch: some mental faculties evolved to cope effectively with an ancestral environment, yet we now live in a different, modern environment where these same mechanisms can lead to detrimental outcomes. In an ancestral world with regular tribal warfare and coalitional conflict, in many situations it could have been rational and even lifesaving to respond with violence to the threat of a different group conspiring against one’s own group. Now in our modern world these mechanisms may sometimes misfire, and lead people to use violence toward the very democratic institutions that were designed to help and protect them.Why, I asked, are Trump supporters particularly receptive to conspiracies? Van Prooijen replied:For one, the Trump movement can be seen as populist, meaning that this movement espouses a worldview that sees society as a struggle between ‘the corrupt elites’ versus the people. This in and of itself predisposes people to conspiracy thinking. But there are also other factors. For instance, the Trump movement appears heavily fear-based, is highly nationalistic, and endorses relatively simple solutions for complex problems. All of these factors are known to feed into conspiracy thinking.The events of Jan. 6, van Prooijen continued,underscore that conspiracy theories are not some “innocent” form of belief that people may have. They can inspire radical action, and indeed, a movement like QAnon can be a genuine liability for public safety. Voltaire once said: “Those who can make you believe absurdities, can make you commit atrocities” — and he was right.Credit…Damon Winter/The New York TimesIn their 2014 book “American Conspiracy Theories,” Uscinski and Parent argue that “Conspiracy Theories Are For Losers.” They write:Conspiracy theories are essentially alarm systems and coping mechanisms to help deal with foreign threat and domestic power centers. Thus, they tend to resonate when groups are suffering from loss, weakness or disunity.To illustrate how the out-of-power are drawn to conspiracy theories, the authors tracked patterns during periods of Republican and Democratic control of the presidency:During Republican administrations, conspiracy theories targeting the right and capitalists averaged 34 percent of the conspiratorial allegations per year, while conspiracy theories targeting the left and communists averaged only 11 percent. During Democratic administrations, mutatis mutandis, conspiracy theories aimed at the right and capitalists dropped 25 points to 9 percent while conspiracy theories aimed at the left and communists more than doubled to 27 percent.The “loser” thesis received strong backing from an August 2020 working paper, “Are Conspiracy Theories for Losers? The Effect of Losing an Election on Conspiratorial Thinking,” by Joanne Miller, Christina E. Farhart and Kyle Saunders, political scientists at the University of Delaware, Carleton College and Colorado State University.They make the parallel argument thatPeople are more likely to endorse conspiracy theories that make their political rivals look bad when they are on the losing side of politics than when they are on the winning side, regardless of ideology/partisanship.In an email, Miller compared polling from 2004, when John Kerry lost to George W. Bush, to polls after the 2020 election, when Trump lost to Biden:A 2004 a Post-ABC poll that found that 49 percent of Kerry supporters but only 14 percent of Bush supporters thought that the vote wasn’t counted accurately. But this year, a much larger percentage of Trump voters believe election fraud conspiracy theories than voters on the losing side in previous years. A January 2021 Pew poll found that approximately 75 percent of Trump voters believe that Trump definitely or probably won the election.Over the long haul, Miller wrote, “I find very little correlation between conspiratorial thinking and party identification or political ideology.” But, she quickly added. “the past four years are an outlier in this regard.”Throughout his presidency, Miller wrote,former President Trump pretty much governed as a “loser.” He continued to insist that he would’ve won the popular vote in 2016 had it not been for widespread election fraud. So it’s not surprising, given Trump’s rhetoric, that Republicans during the Trump presidency were more likely to endorse conspiracy theories than we’d have expected them to, given that they were on the winning side.The psychological predispositions that contribute to a susceptibility to conspiracy thinking are complex, as Joshua Hart, a professor of psychology at Union College, and his student, Molly Graether, found in their 2018 paper “Something’s Going on Here: Psychological Predictors of Belief in Conspiracy Theories.”Hart and Graether contend that “conspiracy theorists are more likely to believe that the world is a dangerous place full of bad people,” who “find it difficult to trust others” and who “view the world as a dangerous and uncontrollable.”Perhaps more interesting, Hart and Graether argue that conspiracy theorists are more likely “to perceive profundity in nonsensical but superficially meaningful ideas,” a concept they cite as being described by academics in the field as “b.s. receptivity.”To test for this tendency, psychologists ask participants to rank the “meaningfulness” of such incoherent and ludicrous sentences and phrases as “the future elucidates irrational facts for the seeking person,” “your movement transforms universal observations,” “the who silence infinite phenomena” and “the invisible is beyond all new immutability.” The scale is called “Mean perceived meaningfulness of b.s. sentences and genuinely meaningful sentences,” and can be found here.Adam M. Enders, a political scientist at the University of Louisville, argued in an email that:There are several characteristics of QAnon acolytes that distinguish them from everyone else, even people who believe in some other conspiracy theories: they are more likely to share false information online, they’re more accepting of political violence in various circumstances.In addition, Enders writes,QAnon followers are, in a sense, extremists both politically (e.g., wanting to overthrow the U.S. government) and psychologically (e.g., exhibiting many antisocial personality traits).Polarization, in Enders’s view, when joined with conspiracy thinking, produces a toxic mix:As polarization increases, tensions between political parties and other groups rise, and people are more willing to construct and believe in fantastical ideas that either malign out-groups (e.g., “Democrats are Satan-worshipping pedophiles”) or bolster the in-group (e.g., ‘we only lost because you cheated’). Conspiracy theories, in turn, raise the temperature of polarization and make it more difficult for people from different partisan and ideological camps to have fact-based discussions about political matters, even those that are in critical need of immediate attention.Conspiracy thinking has become a major internal, problem for the Republican Party, which is reflected by the current turmoil in party ranks over two newly elected congresswomen, Marjorie Taylor Greene of Georgia and Lauren Boebert of Colorado, QAnon sympathizers with long records of florid, antagonistic conspiratorial accusations.There is some evidence that the Republican establishment has begun to recognize the dangers posed by the presence in that party of so many who are preoccupied — obsessed is not too strong a word — with denying the incontrovertible truth of Trump’s loss and Biden’s win in the 2020 election.Even Mitch McConnell, perhaps the most cunning and nefarious member of the Republican establishment, has come to see the liability of the sheer number of supposedly reputable members of the United States Senate caving in to patent falsehoods, warning colleagues earlier this week of the threat to their political survival posed by the “loony lies and conspiracy theories” voiced by allies of QAnon in the House of Representatives.“Somebody who’s suggested that perhaps no airplane hit the Pentagon on 9/11, that horrifying school shootings were pre-staged, and that the Clintons crashed JFK Jr.’s airplane is not living in reality,” McConnell declared. “This has nothing to do with the challenges facing American families or the robust debates on substance that can strengthen our party.”McConnell has a history of bending with the wind, accommodating the extremists in his party, including Trump and Trump’s allies, and he voted in support of the claim that Trump’s second impeachment trial is unconstitutional. Trump’s policies and dislodge his loyalists from positions on boards and civil-service jobs, it has hesitated on a related choice: whether to remove two inspectors general appointed by Mr. Trump under a storm of partisan controversy.At issue is whether the new administration will keep Eric Soskin, who was confirmed as the Transportation Department’s inspector general in December, and Brian D. Miller, a former Trump White House lawyer who was named earlier in 2020 to hunt for abuses in pandemic spending.Both were confirmed over intense Democratic opposition after Mr. Trump fired or demoted a number of inspectors general last year, saying he had been treated “very unfairly” by them.By ousting or sidelining inspectors general who were seen as investigating his administration aggressively, Mr. Trump set off a partisan backlash that undercut a tradition under which nearly all inspectors general since Congress created the independent anti-corruption watchdog positions in 1978 were confirmed unanimously or by voice vote without recorded opposition.The Biden team wants to repair what it sees as damage to the government wrought by Mr. Trump through his many violations of norms. It also wants to restore and reinforce those norms, according to people briefed on its internal deliberations about inspectors general dating back to the campaign and transition.But in the case of inspectors general like Mr. Soskin, those two goals are seen as conflicting, those people said. To remove him would itself be another violation of the norm of respecting such officials’ independence and not firing them without a specific cause, like misconduct.“It’s very possible — and it would be a real mistake — for the Biden people to remove those I.G.’s because they were appointed by Trump,” said Danielle Brian, the executive director of the Project on Government Oversight, a government watchdog group. “That would be essentially exacerbating the problems he created in the first place.”Ms. Brian in December was one of the few outside observers to call attention to a little-noticed push by Senator Mitch McConnell of Kentucky, then the majority leader, to get Mr. Soskin confirmed as the Transportation Department inspector general. The 48-to-47 vote to confirm Mr. Soskin made him the first such official to take office on a purely party-line clash.The office Mr. Soskin now controls has been investigating whether Mr. Trump’s Transportation secretary, Elaine Chao, improperly steered grants to Kentucky as her husband, Mr. McConnell, was seeking re-election there. During the lame-duck session, Mr. McConnell used his power to prioritize getting Mr. Soskin confirmed over four other inspector general nominees who had been waiting for floor votes longer, raising the question of why he was trying to ensure that a Republican appointee would control that post even after Mr. Biden took office.“Hmm why would Majority Leader McConnell be pushing this nomination for Dept of Transportation IG today?” Ms. Brian wrote on Twitter on Dec. 18, a day after he filed a so-called cloture motion to end debate and hold an up-or-down vote on Mr. Soskin. “Perhaps it has something to do with the allegation of wrongdoing that office is reportedly handling against his wife, the Sec of Transportation?”Elaine Chao, then the transportation secretary, and her husband, Senator Mitch McConnell, in the Capitol last month.Credit…Stefani Reynolds for The New York TimesMr. McConnell had on the same day also filed a cloture motion for a second inspector nominee, but not enough Republicans were in town when the clotures votes were held on Dec. 19 to constitute a majority, and both votes to end debate failed. He then successfully tried again for Mr. Soskin on Dec. 21 and got him confirmed, while abandoning the other nominee without explanation.Earlier in the year, only one Democrat voted to confirm Mr. Miller, who had worked in the Trump White House, with others rejecting him on the grounds that he was seen as too close to the Trump administration to aggressively hunt for waste or fraud in pandemic spending during an election year.Amid competing priorities, the Biden team appears not to have reached any decision about what, if anything, to do about Mr. Soskin and Mr. Miller. In a statement, a White House spokesman, Michael Gwin, extolled the general virtue of keeping politics away from such positions.“President Biden believes strongly in the role of inspectors general in keeping government honest and protecting taxpayer dollars, and he’s committed to protecting their independent role in his administration,” Mr. Gwin said in a statement. “Any politicization of the inspector general community is highly inappropriate and has no place in government.”Scrutiny of Mr. Miller has stemmed partially from the fact that he produced scant public sign of activity in his first eight months on the job.But his office delivered a report to Congress on Monday describing some investigative work, including developing 69 leads about suspected fraud that were referred to law-enforcement partners and opening five new preliminary investigations. A person familiar with his office said he had hired 34 staff members by the end of January.“I try to be bipartisan and nonpartisan — certainly as an inspector general and in everything that I do,” Mr. Miller said in an interview.During Mr. Soskin’s confirmation hearing last summer, he also pledged to do his job impartially. Through a spokesman, he declined to comment about the status of the Chao-McConnell investigation.A spokesman for Mr. McConnell, while not directly responding to a question about whether he prioritized Mr. Soskin because of that inquiry, pointed to a 2019 statement in which Mr. McConnell had made no apology for using his position “to advance Kentucky’s priorities” after Politico reported on arrangements under Ms. Chao favoring grants to Kentucky.At a time when the Senate is narrowly divided and the Biden team is trying to get major legislation passed, ousting Mr. Soskin would most likely anger other Republicans as well — particularly Senator Charles E. Grassley of Iowa, a champion of inspectors general.Mr. Grassley scolded Mr. Trump last year over his failure to articulate a concrete reason for his removal of one such official, Michael Atkinson, who had sought to bring to Congress’s attention the whistle-blower complaint that led to Mr. Trump’s first impeachment. He also chastised President Barack Obama in 2009 for initially giving little explanation for removing the AmeriCorps inspector general.“It’s hard to imagine how President Biden could have a good reason to fire an I.G. who’s only been on the job less than a month,” Mr. Grassley said in a statement. “If he chooses to fire any I.G., he’d better have a darn good reason to do it, and he’d better notify Congress well in advance, as the law requires. If he doesn’t, he’ll get the same earful from me that Presidents Obama and Trump got.”Mr. Trump nominated Mr. Soskin in May, around the time he was moving against numerous independent inspectors general. The purge included firing some Senate-confirmed officials on the vague basis that he purportedly lacked confidence in them. He also appointed outsiders to serve as new acting heads of offices whose top positions were vacant — layering over the career deputy inspectors general who had been temporarily in control.Mr. Biden sharply criticized the purge at the time during a Yahoo News town hall and pledged to act differently.Some of the targeted officials had attracted Mr. Trump’s personal ire, such as Mr. Atkinson. Others were leading investigations that threatened Trump allies and other Republicans; he removed Steve A. Linick as the State Department’s watchdog, for example, at the request of Secretary of State Mike Pompeo, who was facing several potentially damaging investigations. (A subordinate to Mr. Pompeo later did accuse Mr. Linick of specific misconduct, but an inspector general council investigated and found that the evidence refuted his accusations.)Filling the Transportation Department inspector general post last year had political sensitivities for both Mr. Trump and Mr. McConnell, then the two most powerful Republicans in Washington. In 2019, Politico reported that the department’s longtime inspector general, Calvin L. Scovel III, was overseeing an investigation into whether the department under Ms. Chao was improperly favoring grants to Kentucky as her husband sought re-election there.In January 2020, Mr. Scovel retired for health reasons, and his deputy, Mitch Behm, took over as acting head. But in May, Mr. Trump installed a different acting head: Howard Elliott, a political appointee known as Skip who, in an unorthodox arrangement, remained subordinate to Ms. Chao. Mr. Trump also nominated Mr. Soskin, then a Justice Department lawyer, for the role.Under Mr. Elliott’s tenure, the election came and went, and the office issued no report about grants to Kentucky. Mr. McConnell won re-election, but Mr. Trump lost, meaning political appointees like Mr. Elliott were set to leave by the inauguration. Had Mr. McConnell not pushed Mr. Soskin through, the office would have reverted to Mr. Behm’s control until Mr. Biden nominated and the Senate confirmed a new inspector general.Still, Jack Goldsmith, a Harvard Law School professor who co-wrote a book proposing post-Trump reforms to government, said that no matter how well Mr. Biden might couch a justification to remove such an inspector general, it would further damage the notion that presidents ought not remove them without cause.“If Biden refrains from firing Senate-confirmed but disfavored inspectors general, that will buck up the norm of independence,” Mr. Goldsmith said. “The ostensible norm is not an actual norm if it doesn’t constrain the president in painful ways.”AdvertisementContinue reading the main story More

The Senate exists to require deliberation and cooperation,” McConnell declared. “James Madison said the Senate’s job was to provide a ‘complicated check’ against ‘improper acts of legislation.’ We ensure that laws earn enough buy-in to receive the lasting consent of the governed. We stop bad ideas, improve good ideas and keep laws from swinging wildly with every election.”He went on: “More than any other feature, it is the Senate’s 60-vote threshold to end debate on legislation that achieves this.”It’s hard to take any of this seriously. None of McConnell’s stated concern for the “lasting consent of the governed” was on display when Senate Republicans, under his leadership, tried to repeal the Affordable Care Act by majority vote. Nor was there any interest in “deliberation and cooperation” when Republicans wanted a new round of corporate and upper-income tax cuts.If anything, the filibuster stymies that deliberation and cooperation by destroying the will to legislate at all. It makes bipartisanship less likely by erasing any incentive to build novel coalitions for particular issues. If, under the filibuster, there’s no difference between 51 votes for immigration reform and 56 votes (or even 59), then what’s the point of even trying? Why reach out to the other side if there’s almost no way you’ll reach the threshold to take action? And on the other side, why tinker with legislation if you know it’s not going to pass? When there’s no reason to do otherwise, why not act as a rigid, unyielding partisan?It’s obvious that McConnell’s commitment to the filibuster is instrumental. The filibuster on executive branch nominations of appointees and federal judges was sacred — he condemned the Democrats’ use of the “nuclear option” to get rid of it in 2013 — until President Trump needed Neil Gorsuch on the Supreme Court and then it was bye-bye to the filibuster for Supreme Court nominees that McConnell’s predecessor as Senate majority leader, Harry Reid, had left intact. If the reconciliation process didn’t exist, and Republicans needed 60 votes for upper-income tax cuts, there’s almost no doubt McConnell would have killed the legislative filibuster in 2017, for the sake of his party’s signature priority.I’m not actually that interested in McConnell’s hypocrisy. I’m interested in his history. To make his case for the indispensable importance of the legislative filibuster, McConnell has essentially rewritten the history of the Senate. He has to create a new narrative to serve his current interests.The truth is that the filibuster was an accident; an extra-constitutional innovation that lay dormant for a generation after its unintentional creation during the Jefferson administration. For most of the Senate’s history after the Civil War, filibusters were rare, deployed as the Southern weapon of choice against civil rights legislation, and an occasional tool of partisan obstruction.Far from necessary, the filibuster is extraneous. Everything it is said to encourage — debate, deliberation, consensus building — is already accomplished by the structure of the chamber itself, insofar as it happens at all.In the form it takes today, the filibuster doesn’t make the Senate work the way the framers intended. Instead, it makes the Senate a nearly insurmountable obstacle to most legislative business. And that, in turn, has made Congress inert and dysfunctional to the point of disrupting the constitutional balance of power. Legislation that deserves a debate never reaches the floor; coalitions that could form never get off the ground.In quoting Madison, McConnell frames the filibuster as part of our constitutional inheritance. It is not. The filibuster isn’t in the Constitution. The Senate, like the House of Representatives, was meant to run on majority rule.Remember, the framers had direct experience with supermajority government. Under the Articles of Confederation, each state had equal representation and it took a two-thirds vote of the states for Congress to exercise its enumerated powers. Without the consent of nine states (out of 13), Congress could not enter treaties, appropriate funds or borrow money. And the bar to amendment, unanimity, was even higher. The articles were such a disaster that, rather than try to amend them, a group of influential elites decided to scrap them altogether.For a taste of this frustration, read Alexander Hamilton in Federalist no. 22, which contains a fierce condemnation of supermajority rule as it was under the articles:The necessity of unanimity in public bodies, or of something approaching toward it, has been founded upon a supposition that it would contribute to security. But its real operation is to embarrass the administration, to destroy the energy of the government, and to substitute the pleasure, caprice, or artifices of an insignificant, turbulent, or corrupt junto, to the regular deliberations and decisions of a respectable majority.Hamilton is especially angry with the effect of the supermajority requirement on governance.In those emergencies of a nation, in which the goodness or badness, the weakness or strength of its government, is of the greatest importance, there is commonly a necessity for action. The public business must, in some way or other, go forward. If a pertinacious minority can control the opinion of a majority, respecting the best mode of conducting it, the majority, in order that something may be done, must conform to the views of the minority; and thus the sense of the smaller number will overrule that of the greater, and give a tone to the national proceedings. Hence, tedious delays; continual negotiation and intrigue; contemptible compromises of the public good.Delegates to the constitutional convention considered and rejected supermajority requirements for navigation acts (concerning ships and shipping), regulation of interstate commerce and the raising of armies. Majorities would have the final say everywhere except for treaties, amendments and conviction in an impeachment trial.To make the Senate slow-moving and deliberative, the framers would not raise barriers to action so much as they would insulate the body from short-term democratic accountability. That meant indirect election by state legislatures, staggered terms of six years and a small membership of two senators per state. And at ratification, that is where the Senate stood: a self-consciously aristocratic body meant to check the House of Representatives and oversee the executive branch, confirming its appointments and ratifying its foreign agreements.The filibuster doesn’t enter the picture until years later, as an accident of parliamentary bookkeeping. In 1806, on the advice of Vice President Aaron Burr (who thought it redundant), the Senate dropped the “previous question” — a motion to end debate and bring an item up for immediate vote — from its rules. Without a motion to call the previous question, however, an individual senator could, in theory, hold the floor indefinitely.It took 31 years for someone to actually do it. The first known filibuster took place in 1837, when several Whig senators tried unsuccessfully to block a Democratic bill to reverse an 1834 censure of President Andrew Jackson and expunge it from the congressional record. Even then, the filibuster was not widely used until the second half of the 19th century, as the parties, and thus the Senate, grew more polarized along party lines.The filibuster as we understand it developed in the 20th century. In 1917, President Woodrow Wilson called on Senate Democrats to reform the filibuster as a war measure after Republicans successfully filibustered a bill to arm merchant ships. Democrats obliged and created a “cloture” rule to end debate with a two-thirds vote of the chamber. In 1975, the Senate reduced that threshold from two-thirds to three-fifths, or 60 votes in a 100-member body.Throughout this time, filibusters were uncommon. It was perfectly possible for the Senate to debate, deliberate and come to consensus without the supermajority requirement McConnell and the Republican caucus have imposed on virtually all legislation since 2009.The point of comparison for the Senate as McConnell has shaped it is the middle of the 20th century, when a conservative coalition of Republicans and Dixiecrats made the chamber a graveyard of liberal legislation and social reform. Consensus didn’t matter. Power did. And it wasn’t until liberals wrested power from this coalition — in the House as well as the Senate — that they could take the initiative and begin work on an otherwise popular agenda.There is no question the Senate is supposed to be slow, even sluggish. But it’s not supposed to be an endless bottleneck. The framers wanted stability in government, not stagnation. What we have now, with the filibuster intact, is a Senate that can barely move.This isn’t just a problem for President Biden and the Democratic Party; it’s a problem for the entire constitutional order. Our system is built around Congress; Congress makes laws, Congress holds the purse strings, Congress hands out mandates, Congress checks the president and makes sure the judiciary stays in its lane.When Congress doesn’t act, other actors take up the slack. The story of our democracy these last 10 years is, in part, the story of how a listless, sclerotic Senate broke Congress and pushed the other branches to govern in its stead, with the president and the courts making as much policy as they can without congressional input, with all the capriciousness, whiplash and uncertainty that can come from that.If you don’t like presidents governing through executive order, then you should want an active, energetic Congress that embraces its constitutional mandate to rule over the whole country and direct its government. Trump to the Senate for trial, thrusting his fate into the hands of 50 Republican senators who for now appear reluctant to convict him.On a day marked more by ceremony than substance, nine House impeachment managers crossed the Capitol to inform the Senate that they were ready to prosecute Mr. Trump for “incitement of insurrection,” a bipartisan charge approved after the former president stirred up a violent mob that stormed the Capitol. But with some of the outrage wrought by the Jan. 6 rampage already dissipating, few Republicans appeared ready to repudiate a leader who maintains broad sway over their party by joining Democrats in convicting him.Senators planned to put off the heart of the trial until Feb. 9. That move will allow President Biden time to win confirmation of crucial cabinet officials and buy breathing room for Republicans to weigh their stances in what amounts to a referendum on their own futures and that of their party as much as on Mr. Trump.Unlike Mr. Trump’s last impeachment, when his party quickly rallied behind him, several Republicans, including Senator Mitch McConnell of Kentucky, the minority leader, have signaled they are open to convicting the former president after his mendacious campaign to overturn his election loss turned deadly. That would allow the Senate to take a second vote to bar him from ever holding office again. But at least at the trial’s outset, their numbers fell well short of the 17 Republicans needed to join Democrats to secure a conviction.A survey by The New York Times on the eve of the trial found that 27 Republican senators had expressed opposition to charging Mr. Trump or otherwise holding him accountable by impeachment. Sixteen Republicans indicated they were undecided, and seven had no response. Most of those opposed increasingly fell back on process-based objections, rather than defending Mr. Trump.“Why are we doing this?” said Senator Ron Johnson, Republican of Wisconsin. “I can’t think of something more divisive and unhealing than doing an impeachment trial when the president is already gone. It’s just vindictive. It’s ridiculous.”Lawmakers in both parties cautioned that Republicans’ mood could quickly shift in the weeks ahead, if more evidence broke into public view about Mr. Trump’s actions or he provoked them further with his defiant threats of retribution.Already, unflattering new details were surfacing about Mr. Trump’s broader campaign to use his power stay in office at any cost. The Justice Department’s inspector general opened an investigation on Monday into whether current or former officials had tried to use their positions inappropriately to help Mr. Trump overturn the election outcome. The inquiry appeared to be a response to a report in The Times on efforts by a senior Justice Department official working with Mr. Trump to push top law enforcement officials to falsely and publicly use fraud investigations to cast doubt on the election outcome.Although Donald J. Mr. Trump is the only president to have been impeached twice, and the trial will be the first in which the Senate has considered convicting a former president.With few Republicans ready to defend Mr. Trump’s actions, many have turned to arguing that the process itself is flawed because the Constitution does not explicitly say ex-presidents can be tried. Republicans have invited Jonathan Turley, a George Washington University law professor, to expound on the argument at Republicans’ luncheon on Tuesday, and some were bracing for Senator Rand Paul, Republican of Kentucky, to try to force a vote to toss out the case for that reason during Tuesday’s session. Such a vote would fail, but could provide an early gauge of Republicans’ views on the trial.“We will listen to it, but I still have concerns about the constitutionality of this, and the precedent it sets in trying to convict a private citizen,” said Senator Joni Ernst, Republican of Iowa.She added: “He exhibited poor leadership, I think we all agree with that. But it was these people that came into the Capitol, they did it knowingly. So they bear the responsibility.”Irked by senators flocking to procedural claims that the trial was unconstitutional or unfair, Democrats warned Republicans that they could not hide from a substantive verdict.“There seems to be some hope that Republicans could oppose the former president’s impeachment on process grounds, rather than grappling with his awful conduct,” said Senator Chuck Schumer of New York, the majority leader. “Let me be perfectly clear: This is not going to fly.”Mr. Biden, who has been reluctant to comment on the proceeding, told CNN on Monday that the trial “has to happen,” even if will complicate his legislative agenda. But he cast doubt on whether the enough Republicans would vote to convict to sustain the charge.That Republicans were going to such lengths to avoid discussing Mr. Trump’s actions underscored how precarious their political situation was. Few contest that Mr. Trump bears at least some responsibility for the most violent attack on the seat of American government since the War of 1812, and many privately blame him for costing them control of the House, Senate and White House. Here’s a look at what happened and at the ongoing fallout:As this video shows, poor planning and a restive crowd encouraged by Mr. Trump set the stage for the riot.A two hour period was crucial to turning the rally into the riot.Several Trump administration officials, including cabinet members Betsy DeVos and Elaine Chao, announced that they were stepping down as a result of the riot.Federal prosecutors have charged more than 70 people, including some who appeared in viral photos and videos of the riot. Officials expect to eventually charge hundreds of others.The House voted to impeach the president on charges of “inciting an insurrection” that led to the rampage by his supporters.Mr. McConnell, who steered the president to acquittal a year ago, has largely left senators to navigate the proceeding on their own this time. He has made clear through advisers and calls with colleagues that he personally views Mr. Trump’s conduct as impeachable and sees the process as a possible way to purge him from the party and rebuild before the 2022 midterm elections. But he has not committed to voting to convict.At least a half-dozen or so Republicans appear ready to join him if he does, but dozens of others appear to be unwilling to break from four years of alliance with Mr. Trump.Carrying a slim blue envelope on Monday, the House managers, led by Representative Jamie Raskin of Maryland, walked the impeachment article through a Capitol where memories of the siege were still fresh. They started in the House chamber, where lawmakers had ducked for cover and donned gas masks as rioters tried to force their way in; past Speaker Nancy Pelosi’s office suite, which was ransacked; through the Rotunda, where officers fired tear gas as they lost control over the throng; and into the well of the Senate chamber, where invaders wearing pro-Trump gear congregated, taking photos on the dais from which the vice president and senators had been forced to evacuate minutes before.House Impeachment Managers Rep. Senators were expected to formally agree to a schedule for the coming weeks and swear an impeachment oath dating to the 18th century to do “impartial justice.”Mr. Trump’s new defense lawyer, Butch Bowers, was said to be trying to line up at least one additional lawyer to join him, according to people familiar with the planning. But it does not explicitly give guidance on who should oversee the proceeding for others, including former presidents. Mr. Schumer said Chief Justice Roberts was uninterested in reprising a time-consuming role that would insert him and the Supreme Court into the political fight over Mr. Trump.The role was largely ceremonial in the first impeachment trial of Mr. Trump a year ago. But as the presiding officer, Mr. Leahy, Democrat of Vermont, could issue rulings on key questions around the admissibility of evidence and whether a trial of a former president is even allowed under the Constitution. He will also retain a vote himself.The job could also have gone to Vice President Kamala Harris, in her capacity as president of the Senate. But there were clear drawbacks for Ms. Harris in overseeing a proceeding that is all but certain to be regarded by some as an effort by Democrats to use their newfound power to punish the leader of the rival political party.Mr. Leahy’s presence on the dais could open Democrats to similar charges from the right, particularly if he issues a contentious ruling, but officials said there was no clear alternative without the chief justice. Ten Republicans praised Mr. Biden as a “wonderful man,” “God-fearing and kind,” “a genuine patriot” with “boundless energy and undeniable charm.”Even Senator Mitch McConnell, Republican of Kentucky, shared the love, recounting tales of legislative wrangling and shared stages, including one at a University of Louisville center founded by the Senate minority leader.“You have been a real friend, you have been a trusted partner and it has been an honor to serve with you,” he said. “We are all going to miss you.”Four years later, Mr. Biden’s old stamping grounds has become a far less collegial and productive place. Just days after Mr. Biden called for unity in his inaugural address, the Senate is already locked in a stalemate, with leaders of the two parties unable to agree on basic rules of operation.“I look back with nostalgia to how we used to work together,” said Harry Reid, the former Democratic majority leader who retired from the Senate the same year that Mr. Biden left Washington, musing on the Congress of the 1970s and 1980s. “Now the Senate does nothing.”Much has been made of Mr. Biden’s extensive experience in government, a central part of his pitch to voters during the presidential campaign. When Mr. Biden talks about bipartisanship now, a fair number of Democrats in Washington quietly roll their eyes.In the Senate, more than a quarter of the seats have changed parties in the past four years — including five of the Republicans who praised Mr. Biden at that 2016 event. Many of the new members are products of the deeply polarized Trump era and have never served in a more functional Senate.Some of Mr. Biden’s closest aides believe the attack on the Capitol broke the fever within the Republican Party, creating space for its elected officials to work across the aisle. Yet, there are plenty of signs that former President Donald J. Trump’s influence on his party may linger.While the former president’s approval rating dropped sharply among Republicans after the attack, Trumpism remains embedded in the firmament of the party. Plenty of Republican state officials, local leaders and voters still believe Mr. Trump’s baseless claims of election fraud and view Mr. Biden as illegitimate. They’re threatening primary challenges against Republicans who work with Mr. Biden, complicating the political calculus for members of Congress, including several up for re-election next year, like Senators Rob Portman of Ohio and Lisa Murkowski of Alaska, who might be inclined to cut some legislative deals.Already, Mr. Biden’s proposed $1.9 trillion pandemic relief plan has received a skeptical response from Republicans, including several centrists who helped craft the economic package that passed late last year. Senator Roy Blunt of Missouri, chairman of the Senate Republican Policy Committee, called the proposal a “non-starter.”“We just passed a program with over $900 billion in it,” Senator Mitt Romney, Republican of Utah, told reporters shortly after the inauguration. “I’m not looking for a new program in the immediate future.”And then, there’s the issue of Mr. Biden’s own party. After four years of Mr. Trump, many Democrats are unwilling to compromise on their agenda. A vocal portion of the party is pushing to pass Mr. Biden’s rescue package through a budget resolution that would allow the legislation to clear the Senate with just 51 votes, instead of the usual 60 votes.Mr. Reid is urging Mr. Biden not to waste much time trying to win over his former Republican colleagues. Biden Jr. was sworn in as the new president, a Republican senator put up a roadblock on Tuesday to one of his cabinet nominees, helping deny Mr. Biden the Day 1 confirmation of national security officials that other incoming presidents have taken for granted for decades. And Senator Chuck Schumer, the New York Democrat who is set to become majority leader, found himself in difficult negotiations with Senator Mitch McConnell, the Kentucky Republican and incoming minority leader, over plans for running an evenly split Senate.On top of those hardly trifling issues, the looming impeachment trial of President Trump presents an extraordinary complication for a party that would no doubt prefer to focus on a bold Democratic agenda out of the gate. However it is eventually structured, the trial is certain to sap time, energy and momentum from the opening days of the new Democratic era in Washington.“It does put a wrinkle in the road,” conceded Christopher J. Dodd, a former Democratic senator from Connecticut and a close adviser to Mr. Biden. “I know Joe is disappointed that it will take some time. But the fact of the matter is, what occurred that day was of such significance that to ignore it or treat it in a casual way would only be an invitation for it to happen again.”The Republican resistance comes as Mr. Biden has made clear that he wants to work with both parties to achieve his legislative ambitions and still sees an opportunity for bipartisan consensus in a Senate that has become much more polarized since he left in 2009 after 36 years.Mr. Schumer is set to become majority leader by the narrowest possible margin on Wednesday afternoon after the inauguration of Mr. Biden and Vice President-elect Kamala Harris and the seating of three new Democratic senators, setting the margin at 50 to 50 with Ms. Harris empowered to cast tiebreaking votes.Dismissing concerns about the implications of the Senate trial for the Biden agenda, Mr. Schumer and his colleagues have said they can manage to do two things at once, conducting the proceeding while advancing Mr. Biden’s nominees and his other priorities.But the Senate has struggled in recent years to do even one thing at once, and experience has shown that presidential impeachments consume a lot of oxygen.Still, Democrats say they have no choice and few reservations about plunging ahead with a trial they see as a crucial element of a national reckoning after the violent Jan. 6 assault on the Capitol and attempt to disrupt the counting of the presidential Electoral College ballots.“We have to send a very strong message that it is unacceptable for a president of the United States to incite a violent mob for the purposes of overturning a democratic election,” said Senator Chris Van Hollen, Democrat of Maryland. “I think we can make clear that this conduct has to be held accountable while we can work to open a new chapter.”Mr. Schumer, Mr. Van Hollen and other Democrats insist that the trial of Mr. Trump for inciting the attack can be conducted quickly if Republicans cooperate. In a memo to Republican colleagues and in talks with Mr. Schumer, Mr. McConnell said he wanted Democrats to agree not to weaken the filibuster in exchange for his cooperation in cutting a deal that would let Senate committees get down to business.That created a dilemma for Mr. Schumer, who, along with Democratic activists, wants to hold out the idea of eliminating the 60-vote threshold for advancing legislation — which in recent years has allowed the minority party to block most major initiatives — if Republicans uniformly line up against Mr. Biden’s agenda. The Democratic leader’s office urged Mr. McConnell to drop his demand and instead implement a plan developed 20 years ago, when the Senate was evenly divided and the two parties split committees down the middle.“Leader Schumer expressed that the fairest, most reasonable and easiest path forward is to adopt the 2001 bipartisan agreement without extraneous changes from either side,” said Justin Goodman, a spokesman for Mr. Schumer.Regardless of how the negotiations go, Mr. McConnell made it clear Tuesday that Republicans had no intention of clearing the way for Democrats’ most cherished progressive priorities.“Certainly November’s elections did not hand any side a mandate for sweeping ideological change,” he said. “Americans elected a closely divided Senate, a closely divided House and a presidential candidate who said he’d represent everyone.”Mr. Biden’s push to have the Senate confirm some of his key nominees as soon as he took the oath Wednesday encountered an obstacle when Senator Josh Hawley, the Missouri Republican who led the challenge to the Electoral College vote, said he would block quick confirmation of Mr. Biden’s secretary of homeland security nominee, Alejandro N. Mayorkas, over immigration concerns.“Mr. Mayorkas has not adequately explained how he will enforce federal law and secure the southern border given President-elect Biden’s promise to roll back major enforcement and security measures,” Mr. Hawley said.His move infuriated Democrats, many of whom blame Mr. Hawley for the Jan. 6 riot that prompted the heightened security concerns that they say require the position to be filled immediately.“I think it really would be disgraceful, and shameful, but unfortunately, Senator Hawley is marching to his own drummer,” said Senator Richard Blumenthal, Democrat of Connecticut, about the delay.The contours of the impeachment trial remain unclear, and even the start date is unknown since Speaker Nancy Pelosi has not yet presented the Senate with the sole charge.
