    Hold the Victory Party for Senate Democrats

    The recent notion that Democrats will hold the Senate might be wrong. Here’s why some Democratic strategists are nervous.It has recently become conventional wisdom that Democrats have a pretty good chance of clinging to the Senate — despite a national political environment that has looked dire for their party throughout most of this year.I’ve written about this a fair bit myself. And even Mitch McConnell, the once and possibly future Senate majority leader, has taken to complaining lately that Republicans have a “candidate quality” problem.McConnell’s deputies use other words in private that cannot be printed here — a reflection, in part, of the tensions between his camp and the network around Senator Rick Scott of Florida, who is officially running the G.O.P.’s Senate campaign efforts. In the view of McConnell’s team, it should be Scott’s responsibility to clear the field of fringe candidates who can’t win general elections, and he failed to do so in many of the biggest Senate races. Adding to those tensions is the fact that Donald Trump has openly feuded with McConnell and threatened to muscle him out of the role of Senate leader in favor of Scott.So when McConnell complains about “candidate quality,” he’s also taking a shot at his own rival, Scott.With those caveats out of the way, let me say this: Republicans might very well do better than the pundits expect. And that is keeping some Democratic strategists up at night.This is true for two main reasons: a flood of outside money that is about to hit the airwaves on Republicans’ behalf, and polling that indicates that the political environment remains a problem for Democratic candidates, despite their party’s recent string of accomplishments.First, the moneySenate Democrats have been able to outspend and out-fund-raise Republicans so far this year.That’s partly a function of incumbency. G.O.P. candidates have spent the bulk of their money and energy attacking one another and vying for Trump’s favor, and Democrats have well-established email lists and national infrastructure to support them.With the primaries wrapping up, however, that’s about to change in a big way. Outside groups are tooling up tens of millions of dollars in ad spending on behalf of Republican candidates, according to public reports. And television advertising still matters a great deal with the older voters who traditionally dominate midterm elections.There’s the Senate Leadership Fund, a group close to McConnell, which has announced $141 million in advertising reservations. That compares with just $106 million announced by Senate Majority PAC, the counterpart on the Democratic side.Already, the leadership fund has ramped up its spending in key states, adding more than $9 million in spending in Georgia, $20 million in Ohio and at least $1 million in Pennsylvania.Another group affiliated with McConnell, One Nation, lifted its spending by nearly $2.6 million in Georgia, $1.24 million in Wisconsin and a little over a quarter-million dollars in Nevada.Outside conservative groups are flush with cash, too, with the Senate Leadership Fund reporting $104 million on hand as of late June. In contrast, the liberal Senate Majority PAC is wheezing a bit, reporting just $72 million cash on hand as of late July.Raising money outside the official campaign apparatus has frequently been an advantage for Republicans, who tend to have a much easier time enticing single megadonors to cut large checks. Democrats have plenty of megadonors of their own, of course. But liberal funders are often pulled in multiple directions, driven by causes like climate change, women’s rights or L.G.B.T.Q. issues rather than electoral politics.Whether Republicans will see their usual monetary advantage is more in question this time. In the past, Republicans have relied on individual billionaires like Sheldon Adelson and the Koch brothers to bankroll super PACs and other kinds of groups. But Adelson died in 2021, and his wife, Miriam, has not indicated the same level of interest in financing politics. The Koch brothers have loudly declared that they are no longer as engaged in donating to political campaigns and would prefer to work on issues like criminal justice reform. More

    To Fight Election Falsehoods, Social Media Companies Ready a Familiar Playbook

    The election dashboards are back online, the fact-checking teams have reassembled, and warnings about misleading content are cluttering news feeds once again.As the United States marches toward another election season, social media companies are steeling themselves for a deluge of political misinformation. Those companies, including TikTok and Facebook, are trumpeting a series of election tools and strategies that look similar to their approaches in previous years.Disinformation watchdogs warn that while many of these programs are useful — especially efforts to push credible information in multiple languages — the tactics proved insufficient in previous years and may not be enough to combat the wave of falsehoods pushed this election season.Here are the anti-misinformation plans for Facebook, TikTok, Twitter and YouTube.FacebookFacebook’s approach this year will be “largely consistent with the policies and safeguards” from 2020, Nick Clegg, president of global affairs for Meta, Facebook’s parent company, wrote in a blog post last week.Posts rated false or partly false by one of Facebook’s 10 American fact-checking partners will get one of several warning labels, which can force users to click past a banner reading “false information” before they can see the content. In a change from 2020, those labels will be used in a more “targeted and strategic way” for posts discussing the integrity of the midterm elections, Mr. Clegg wrote, after users complained that they were “over-used.”Warning labels prevent users from immediately seeing or sharing false content.Provided by FacebookFacebook will also expand its efforts to address harassment and threats aimed at election officials and poll workers. Mark Zuckerberg, Facebook’s chief executive, took a personal interest in safeguarding elections.But Meta, Facebook’s parent company, has changed its focus since the 2020 election. Mr. Zuckerberg is now more focused instead on building the metaverse and tackling stiff competition from TikTok. It also introduced an election information portal, which provides voter information like how to register, six weeks earlier than it did in 2020.Even so, there are already clear signs that misinformation has thrived on the platform throughout the primaries.“TikTok is going to be a massive vector for disinformation this cycle,” Mr. Lehrich said, adding that the platform’s short video and audio clips are harder to moderate, enabling “massive amounts of disinformation to go undetected and spread virally.”TikTok said its moderation efforts would focus on stopping creators who are paid for posting political content in violation of the company’s rules. TikTok has never allowed paid political posts or political advertising. But the company said that some users were circumventing or ignoring those policies during the 2020 election. A representative from the company said TikTok would start approaching talent management agencies directly to outline their rules.Disinformation watchdogs have criticized the company for a lack of transparency over the origins of its videos and the effectiveness of its moderation practices. Experts have called for more tools to analyze the platform and its content — the kind of access that other companies provide.“The consensus is that it’s a five-alarm fire,” said Zeve Sanderson, the founding executive director at New York University’s Center for Social Media and Politics. “We don’t have a good understanding of what’s going on there,” he added.Last month, Vanessa Pappas, TikTok’s chief operating officer, said the company would begin sharing some data with “selected researchers” this year.TwitterIn a blog post outlining its plans for the midterm elections, the company said it would reactivate its Civic Integrity Policy — a set of rules adopted in 2018 that the company uses ahead of elections around the world. Under the policy, warning labels, similar to those used by Facebook, will once again be added to false or misleading tweets about elections, voting, or election integrity, often pointing users to accurate information or additional context. Tweets that receive the labels are not recommended or distributed by the company’s algorithms. The company can also remove false or misleading tweets entirely.Those labels were redesigned last year, resulting in 17 percent more clicks for additional information, the company said. Interactions, like replies and retweets, fell on tweets that used the modified labels.In Twitter’s tests, the redesigned warning labels increased click-through rates for additional context by 17 percent.Provided by TwitterThe strategy reflects Twitter’s attempts to limit false content without always resorting to removing tweets and banning users.The approach may help the company navigate difficult freedom of speech issues, which have dogged social media companies as they try to limit the spread of misinformation. Elon Musk, the Tesla executive, made freedom of speech a central criticism during his attempts to buy the company earlier this year.YouTubeUnlike the other major online platforms, YouTube has not released its own election misinformation plan for 2022 and has typically stayed quiet about its election misinformation strategy.“YouTube is nowhere to be found still,” Mr. Sanderson said. “That sort of aligns with their general P.R. strategy, which just seems to be: Don’t say anything and no one will notice.”Google, YouTube’s parent company, published a blog post in March emphasizing their efforts to surface authoritative content through the streamer’s recommendation engine and remove videos that mislead voters. In another post aimed at creators, Google details how channels can receive “strikes” for sharing certain kinds of misinformation and, after three strikes within a 90-day period, the channel will be terminated.The video streaming giant has played a major role in distributing political misinformation, giving an early home to conspiracy theorists like Alex Jones, who was later banned from the site. It has taken a stronger stance against medical misinformation, stating last September that it would remove all videos and accounts sharing vaccine misinformation. The company ultimately banned some prominent conservative personalities.More than 80 fact checkers at independent organizations around the world signed a letter in January warning YouTube that its platform is being “weaponized” to promote voter fraud conspiracy theories and other election misinformation.In a statement, Ivy Choi, a YouTube spokeswoman, said its election team had been meeting for months to prepare for the midterms and added that its recommendation engine is “continuously and prominently surfacing midterms-related content from authoritative news sources and limiting the spread of harmful midterms-related misinformation.” More

    An Unusual $1.6 Billion Donation Bolsters Conservatives

    WASHINGTON — A new conservative nonprofit group scored a $1.6 billion windfall last year via a little-known donor — an extraordinary sum that could give Republicans and their causes a huge financial boost ahead of the midterms, and for years to come.The source of the money was Barre Seid, an electronics manufacturing mogul, and the donation is among the largest — if not the largest — single contributions ever made to a politically focused nonprofit. The beneficiary is a new political group controlled by Leonard A. Leo, an activist who has used his connections to Republican donors and politicians to help engineer the conservative dominance of the Supreme Court and to finance battles over abortion rights, voting rules and climate change policy.This windfall will help cement Mr. Leo’s status as a kingmaker in conservative big money politics. It could also give conservatives an advantage in a type of difficult-to-trace spending that shapes elections and political fights.The cash infusion was arranged through an unusual series of transactions that appear to have avoided tax liabilities. It originated with Mr. Seid, a longtime conservative donor who made a fortune as the chairman and chief executive of an electrical device manufacturing company in Chicago now known as Tripp Lite.Rather than merely giving cash, Mr. Seid donated 100 percent of the shares of Tripp Lite to Mr. Leo’s nonprofit group before the company was sold to an Irish conglomerate for $1.65 billion, according to tax records provided to The New York Times, corporate filings and a person with knowledge of the matter.The nonprofit, called the Marble Freedom Trust, then received all of the proceeds from the sale, in a transaction that appears to have been structured to allow the nonprofit group and Mr. Seid to avoid paying taxes on the proceeds.For perspective, the $1.6 billion that the Marble trust reaped from the sale is slightly more than the total of $1.5 billion spent in 2020 by 15 of the most politically active nonprofit organizations that generally align with Democrats, according to an analysis by The Times. That spending, which Democrats embraced to aid the campaigns of Joseph R. Biden Jr. and his allies in Congress, dwarfed the roughly $900 million spent by a comparable sample of 15 of the most politically active groups aligned with the Republican Party.The Marble Freedom Trust could help conservatives level the playing field — if not surpass the left — in such nonprofit spending, which is commonly referred to as dark money because the groups involved can raise and spend unlimited sums on politics while revealing little about where they got the money or how they spent it.In a statement, Mr. Leo cited some of the left’s biggest donors and an advisory firm that helps manage the nonprofit groups they fund.“It’s high time for the conservative movement to be among the ranks of George Soros, Hansjörg Wyss, Arabella Advisors and other left-wing philanthropists, going toe-to-toe in the fight to defend our constitution and its ideals,” Mr. Leo said. Tripp Lite is a private company that is not subject to corporate disclosure rules for public companies. On its tax filing, Marble indicated that the $1.6 billion came from the “sale of gifted company and subsidiaries,” but indicated that it withheld identifying information “to protect donor confidentiality.”And Eaton, the publicly traded Irish company that bought Tripp Lite, does not refer to Marble in statements related to the sale.The person with knowledge of the matter said that the Tripp Lite shares were donated to Marble months before the deal with Eaton was announced in January 2021. The sale was completed in March 2021.Katy Brasser, a spokeswoman for Eaton, said in a statement, “We have no additional information to share regarding the acquisition that was announced last year.”Ray D. Madoff, a professor of tax law at Boston College who is the director of the school’s Forum on Philanthropy and the Public Good, said the structure of the transaction was most likely legal but did appear to allow a donor to avoid federal tax obligations from the sale of the company.Here is how it works: Marble Freedom Trust is registered under a section of the tax code — 501(c)4 — for organizations that focus primarily on what the Internal Revenue Service calls “social welfare” and as a result are exempt from paying taxes. Such groups are allowed to engage in political advocacy, but their supporters are not entitled to deduct donations from their income taxes.     The Political Warheads Just Keep Exploding

    Gail Collins: Welcome back from your trip to Greenland, Bret. Dying to hear your impressions. Was it beautiful? Was it … melting?Bret Stephens: Greenland is a bit like a James Joyce novel: formidable and largely impenetrable. And the ice is definitely melting up there — which I’ll get to in the long feature I’m writing about the trip.Gail: Been looking forward to that since you left.Bret: But we’ve missed so much since our last conversation! The Joe Biden comeback. The Mar-a-Lago blowback. The Liz Cheney takedown. Where should we start?Gail: Let’s begin with Biden. I’ll admit that the Inflation Reduction Act was perhaps not the perfect name for his bill, but what a moment for his presidency! First time the country’s ever taken a big, serious step toward combating global warming. And for once, I can imagine future generations looking back on what we’ve done and cheering.Bret: I agree that the bill is misnamed. It probably would have been better called the West Virginia Special Perks Act, after all the goodies Joe Manchin stuffed into it for his home state, or the Elon Musk Additional Enrichment Act, given all the tax rebates for buying electric vehicles. On top of that, I doubt that history will look back on the legislation as some kind of turning point in addressing climate change, given that China emits more than twice the carbon dioxide that the United States does.But Biden — or maybe I should say Chuck Schumer — has certainly rallied his party and given it a sense of accomplishment before the midterms. On the other hand, there’s the raid on Mar-a-Lago, which struck me as really, really ill-advised. Tell me I’m wrong.Gail: Well, I sorta hated that it created so many headlines during a week when Biden should have been getting all the attention for his accomplishments. And I know Donald Trump is getting a lot of sympathy from his fans. But, hey, if he’s been sitting on top of secret documents, possibly including some having to do with, um, nuclear weaponry, I want the country to know about it.Bret: We obviously have to withhold judgment till we know more, but color me skeptical on the claim about nuclear weaponry.Gail: Understood. But while I am not yet quite prepared to envision our former president somehow selling our secrets to foreign governments, in this case it’s not so totally inconceivable that you wouldn’t want the feds to move quickly.Bret: Gail, do you remember the line from “Raising Arizona,” when Nicolas Cage says to Holly Hunter, “There’s what’s right and there’s what’s right, and never the twain shall meet”? That seems like a pretty good description of Merrick Garland’s predicament.Gail: Love it when you do those quotes.Bret: On one hand, Trump continued to prevaricate and resist repeated requests to return the documents, in flagrant disregard for the rule of law. On the other, as a result of the search he’s consolidated support among Republicans who seemed to be drifting away just a few weeks ago. He’s turned the media spotlight away from Biden and back to himself. He’s created a new field of theories and conspiracies about what the government was really after.In short, Garland gave Trump precisely what he wanted. And if the Justice Department can’t show that Trump was hiding something truly sensitive or explosive — like, proof that he was in direct personal contact with the Oath Keepers before Jan. 6 — I fear Garland’s going to emerge the loser from this encounter.Gail: When in doubt, my all-purpose rule in understanding things Trump is to follow the stupendous Maggie Haberman, one of our great White House correspondents. Her analysis covers several possible explanations for the document-piling, all of them based on general stupidity. Maybe he wanted them as extremely high-end mementos. Maybe it’s his habit of hoarding papers. Or just his cosmic view of the world, that “everything he touches belongs to him,” as a lawyer Maggie talked to put it.Bret: With Trump, the line between the shambolic and the sinister is often blurred. His entire being is like Inspector Clouseau doing an impression of Jack Nicholson in “The Shining,” or maybe vice versa.Gail: But whatever the motive, we can’t allow him to set this kind of precedent for handling presidential documents.Bret: I’m all for returning government documents to their rightful place, but if this helps return Trump to the White House I’d say it’s a bad bargain.Gail: We’ll see what happens next.     How a Storied Phrase Became a Partisan Battleground

    A touchstone of political and social discourse, the nearly 100-year-old phrase “the American dream,” is being repurposed — critics say distorted — particularly by Republicans of color.Juan Ciscomani, a Republican who washed cars to help his Mexican immigrant father pay the bills and is now running for Congress in Arizona, has been leaning on a simple three-word phrase throughout his campaign — “the American dream.”To him, the American dream, a nearly 100-year-old idea weighted with meaning and memory, has become something not so much to aspire to but to defend from attack.President Biden and House Speaker Nancy Pelosi are, he says in one ad, “destroying the American dream” with “a border crisis, soaring inflation and schools that don’t teach the good things about America.”For decades, politicians have used the phrase “the American dream” to describe a promise of economic opportunity and upward mobility, of prosperity through hard work. It has been a promise so powerful that it drew immigrants from around the world, who went on to fulfill it generation after generation. Political figures in both parties employed the phrase to promote both their own policies and their own biographies.Now, a new crop of Republican candidates and elected officials are using the phrase in a different way, invoking the same promise but arguing in speeches, ads and mailings that the American dream is dying or in danger, threatened by what they see as rampant crime, unchecked illegal immigration, burdensome government regulations and liberal social policies. Many of these Republicans are people of color — including immigrants and the children of immigrants, for whom the phrase first popularized in 1931 has a deep resonance.To politicians of old, “the American dream” was a supremely optimistic rhetorical device, albeit one that often obscured the economic and racial barriers that made achieving it impossible for many. To the Republican candidates embracing it today, the phrase has taken on an ominous and more pessimistic tone, echoing the party’s leader, former President Donald J. But historians and other scholars warn that some Republicans are distorting a defining American idea and turning it into an exclusionary political message.“The Republican Party is using it as a dog whistle,” said Christina Greer, an associate professor of political science at Fordham University. “They are saying here is the potential of what you can have, if we can exclude others from ‘stealing it’ from you.”Republicans dispute that their references to “the American dream” promote exclusion and say they are using the phrase the same way politicians have used it for decades — to signal hope and opportunity. “I think the left is far more pessimistic than Republicans are about the American dream,” said Representative Yvette Herrell, a New Mexico Republican who is Cherokee and the third Native American woman ever elected to Congress.But this latest iteration of the dream has become a rhetorical catchall for Republicans’ policy positions.Barbara Kirkmeyer, a Republican state lawmaker in Colorado running in a heated House race, embraces the American dream as the theme of her personal story. Ms. Kirkmeyer grew up on a dairy farm, the sixth of seven children in a family that often struggled. She paid her way through college by raising and selling a herd of eight milk cows, yearlings and heifer calves.The American dream, Ms. Kirkmeyer said, was not only about economic opportunity but freedom, connecting the words with Republican opposition to Covid-related mask mandates. “I don’t see the mandates as part of the American dream,” she said. “People felt that was an infringement on their rights and personal dreams.”The earliest mention in print of the words “American dream” appears to have been in a 1930 ad for a $13.50 marked-down bed spring from an American mattress company.Historians and economists, however, credit the writer James Truslow Adams with popularizing the phrase in his best seller published a year later in 1931, “The Epic of America.” His Depression-era definition was a “dream of a land in which life should be better and richer and fuller for everyone.” To Mr. Adams, it was part of a liberal vision in which government was seen as a force to fight big business. His symbol of the American dream at the time was the Library of Congress.For decades, politicians have used the phrase the American dream to describe a promise of economic opportunity and upward mobility, of prosperity through hard work. But with the chances of owning a home diminishing after the 2008 economic crash, Democrats and Republicans once more sought to redefine it. Now, much of the phrase’s progressive history has been lost, as Republicans argue that big government is the enemy.“That has been the real shift,” said Sarah Churchwell, the author of a 2018 book, “Behold, America: The Entangled History of ‘America First’ and ‘the American Dream.’”The roots of this more conservative vision of the American dream can be traced to Ronald Reagan, who often invoked the phrase and also used it in his appeals to Latino voters, extolling family, religion and an opposition to government handouts. It was a strategy later followed by George W. Bush.“It married conservative values with economic opportunity: ‘We recognize you for your contribution to America and we will give you the opportunity to get ahead if you are willing to do the work,’” said Lionel Sosa, a retired media consultant in San Antonio who is a Republican and who created ads for Mr. Reagan and Mr. Bush.Republicans still use the American dream in the way Mr. Reagan and Mr. Bush did, underscoring a strong work ethic, Christian values and entrepreneurialism. But many Hispanic Republicans now add a harder edge — stressing that they came to the country legally, decrying “open borders” and calling for the completion of the U.S.-Mexico border wall.“In all the time we worked on it, we didn’t say anything having to do with building a wall,” Mr. Sosa said of the past messaging aimed at Hispanic Republicans. “There was no message that you have to be here legally or that if you are not here legally, we don’t want you here.”The politicization of the phrase comes as studies show the American public has become more pessimistic about achieving the American dream. Historians say that in recent years Republicans have been using the phrase far more frequently than Democrats in ads and speeches. While more than a dozen Republican candidates across the country cite the phrase in their TV ads this midterm season, only four Democrats have done so, according to AdImpact.One of the Democratic candidates who has relied on the theme in his ads is Shri Thanedar, an Indian American state lawmaker in Michigan and the Democratic nominee for a House seat. “We have ceded that ground to Republicans and other corporate politicians,” Mr. Thanedar said, referring to areluctance by some Democrats to emphasize the phrase.To Gabe Vasquez, a Democratic congressional candidate in Albuquerque, N.M., the American dream is about ensuring that the economic ladder “is there for everybody and that everyone can climb with you.”Ramsay de Give for The New York TimesGabe Vasquez, a Democrat who is facing Ms. Herrell in New Mexico in the fall, has also embraced the phrase. He tells supporters that his late grandfather — Javier Bañuelos, who taught himself to fix broken televisions with an old manual and eventually opened his own repair shop — made it possible for him to run for Congress. The American dream is not about buying a house, but ensuring that the economic ladder “is there for everybody and that everyone can climb with you,” he said.Yet even Democrats find themselves speaking of the dream as pessimistically as Republicans. Just as Republicans blame Democrats for destroying the American dream, Democrats believe the fault lies with Republicans. They say Republicans are making it harder to obtain by attacking the social safety net and blocking efforts to raise the minimum wage, and that they have co-opted the symbols of patriotism — including words like patriot — and turned them into partisan weapons.“That American dream,” Mr. Vasquez said, “is becoming a hallucination.” More

    The Florida Primary for Governor is Mostly About Ron DeSantis

    Democrats would love to defeat Gov. Ron DeSantis of Florida in November. But first they must nominate a challenger who can win in a state where they seem to perpetually fall short.HOLLYWOOD, Fla. — On the first day of early voting in Broward County, Florida’s Democratic mecca, Jared Brown, a 41-year-old lawyer who until recently had never attended a Democratic Party meeting, drove to the polls in suburban Hollywood, slipped on a party T-shirt and grabbed a clipboard to go knock on voters’ doors.He was motivated by anger.Anger at Republicans in general — for appointing conservative judges, redirecting money from public schools and governing in a way that struck him as “authoritarian” — and anger at one Republican in particular: Gov. Ron DeSantis, whose polarizing persona has come to suck up all of the state’s political oxygen.“It’s too offensive,” Mr. Brown said of the culture wars stoked by the governor and state lawmakers. “If you don’t fight them now,” he added, “it’s just not going to get any better.”Going into Tuesday’s primary election, Florida Democrats like Mr. Brown are angry, especially at the ascendant Mr. DeSantis and the way he seems to them to act like someone who already has his eye on the White House.
