    Andrew Giuliani Considers a Run for N.Y. Governor

    Mr. Giuliani, 35, has never been elected to public office, and his most prominent government job was as a public liaison assistant and special assistant to the president for the Trump White House.ALBANY, N.Y. — In less than two weeks, at least three potential Republican candidates interested in possibly challenging Gov. Andrew M. Cuomo next year will convene in the state capital to lobby many of the party’s county chairs for their support.All three are known to New York voters: Representative Lee Zeldin of Long Island is one of the state’s staunchest conservative leaders, and was an ardent supporter of former President Donald J. Trump; Rob Astorino was the party’s 2014 nominee for governor.The third is also known, but is far less of a known quantity: Andrew Giuliani.In a brief interview on Wednesday, Mr. Giuliani, 35, confirmed that he was “strongly considering” a run, adding that he planned to make a firm decision “by the end of the month.” State Republican officials confirmed that Mr. Giuliani would be attending the Republican county leaders’ meeting in Albany.Mr. Giuliani would face a steep climb. He has never been elected to public office, and his most prominent government job was as a public liaison assistant and special assistant to the president for the Trump White House.His main selling point would likely be his connection to Mr. Trump and to his father, the former New York City Mayor Rudolph W. Giuliani, whose reputation in New York and beyond has greatly suffered in recent years.The elder Mr. Giuliani, Mr. Trump’s former personal lawyer, was a central player in a failed legal effort by the former president to overturn the 2020 election. He now faces a defamation lawsuit filed by Dominion Voting Systems, which has accused him of carrying out “a viral disinformation campaign” to suggest that Dominion, one of the biggest voting machine manufacturers in the country, plotted to flip votes to President Biden.The Giuliani connection to Trump could prove poisonous in New York, where Mr. Trump’s popularity is in the low 30s, where Republicans haven’t won a statewide election since 2002, and where Democrats outnumber Republicans by more than two to one.Still, Mr. Giuliani and other potential Republican candidates have had their hopes buoyed by Mr. Cuomo’s swarm of recent scandals, including multiple accusations of sexual harassment against the governor, as well as a federal investigation into his handling of the state’s nursing homes.The sexual harassment allegations made by current and former employees of Mr. Cuomo, as well as accounts by a series of other women who have described uncomfortable interactions with the governor, have led most of the state’s Democratic leaders to call for Mr. Cuomo’s resignation.The allegations against Mr. Cuomo, 63, are also the subject of a pair of investigations, including one overseen by the state attorney general, Letitia James, and a second authorized by the State Assembly.The combination of the controversies has resulted in double-digit declines in Mr. Cuomo’s approval ratings in several polls, with support for a fourth term seeming particularly precarious.Mr. Giuliani’s possible interest in the state’s highest office was first reported by The Washington Examiner.The prospect of a Giuliani vs. Cuomo matchup would likely tantalize New York and national political observers, considering the current relationship between Rudolph Giuliani and Mr. Trump, who often sparred with Mr. Cuomo last year during the early days of the coronavirus pandemic.Adding to the intrigue is the decades-long connections between the elder Mr. Giuliani and Mr. Cuomo, a third-term Democrat whose father, Mario M.     Politicians Behaving Badly

    At least Tom Reed knows how to face up to his mistakes.As the investigation continues into the allegations of sexual misconduct by New York Gov. Andrew Cuomo — about whom tales of bad behavior are piling up like soiled wet wipes at a rib joint — a vaguely similar scandal has taken down one of his aspiring rivals.Sunday evening, Republican Representative Tom Reed, who had been contemplating a challenge to Mr. Cuomo in 2022, announced that he would instead be retiring from public office at the end of his congressional term. This change of heart occurred just a few days after accusations surfaced that Mr. Reed sexually harassed a young woman on a political trip four years ago.While on an ice-fishing retreat to Minnesota in January 2017, the then-45-year-old congressman got sloshed at a group dinner at a pub one night and groped a 25-year-old lobbyist, according to her account. Among other offenses, he is said to have unhooked the woman’s bra through her blouse and slid his hand up her thigh. Nicolette Davis, the woman in question, was on her first big schmoozing trip and was anxious for things to go smoothly. Horrified, she texted a co-worker, “A drunk congressman is rubbing my back.” And later, “HELP HELP.” Ms. Davis ultimately asked the person sitting on her other side to intervene, at which point the encroaching lawmaker was gently led from the pub.Ms. Davis, who later left lobbying to join the Army, deserves major kudos for sharing her story — though it is disheartening that it took four years for her to feel comfortable enough to do so. Immediately after her close encounter with Mr. Reed, she told colleagues what had happened but declined to file an official complaint. “I was afraid I would become ‘that girl’ who made a mess of things for a member, and that no one would ever want to associate with me,” she told The Washington Post, which first reported the accusations.When Ms. Davis’s accusations broke last Friday, Mr. Reed fired off a short, vague statement saying her account was “not accurate.” But by Sunday, he had reversed course. In a longer, more detailed statement, the lawmaker stopped short of confirming Ms. Davis’s account but said that, at the time of the trip, he was struggling with alcoholism and that he accepted “full responsibility” for his piggishness. “This is in no way an excuse for anything I’ve done,” he wrote. “Consistent with my recovery, I publicly take ownership of my past actions, offer this amends and humbly apologize again to Ms. Davis, my wife and kids, loved ones, and to all of you.” He further vowed “to help those wrestling with addiction.”Clearly, the congressman’s behavior was gross and unacceptable. But in dealing with the fallout like an accountable grown-up, he now has the chance to redeem himself — possibly even serving as an example to other officials.There is a sharp irony to Mr. Reed’s fall. A centrist Republican, he was first elected to Congress in 2010, in a special election to replace Democrat Eric Massa, who had resigned while the House ethics committee was investigating allegations that he had sexually harassed a junior male aide. Fast-forward to the Cuomo scandal: Mr. Reed was among the early voices calling for the governor to step down. Later, he was among those in favor of impeachment.Thus New York politics has given us a reality-TV-worthy spectacle of a Republican lawmaker, elected to replace a Democrat accused of sexual harassment, leaving politics under his own sexual harassment cloud, thereby upsetting his plans to take on a Democratic governor beset by multiple accusations of sexual harassment.Got it?Obviously, elected officials behaving like entitled jerks is not a New York-specific problem, or even a politics-specific problem. Too many men in positions of power have come to believe that the rules of decent society do not apply to them, that they have a right to treat those around them like playthings.In many ways, politicians are tailor-made for this kind of stupidity. It generally takes a fair amount of self-regard to elbow one’s way up the political ladder. Upon attaining a certain stature, politicians get treated like mini regents, surrounded by aides whose livelihoods depend on them and supplicants seeking to curry their favor. They get invited on TV. Voters and reporters show up at their events. Power and celebrity — even low-level political celebrity — act like drugs, warping officials’ sense of self and of reality.If you want to dig into the science, there are all kinds of fascinating avenues to explore about how politicians may be affected by the things like the winner effect, in which it’s posited that success changes people’s brain chemistry in ways that cause them to behave more selfishly or aggressively. One 2018 study by scientists at the University of Cambridge found that merely the perception of having bested another man gives guys a testosterone boost, along with “an inflated sense of their own value as a sexual prospect.”None of which excuses the spectacle of powerful men behaving badly, to which we are still frequently subjected, even in the age of #MeToo.With this in mind, Mr. Reed deserves at least a sliver of credit for putting on his big-boy pants and owning up to the pain and damage he caused. He has expressed straight-up contrition rather than spout one of those dodgy, I’m-sorry-if-she-misinterpreted-my-actions nonapologies of which politicians are so fond. He did not paint himself as the “real” victim or — even more vile — attempt to smear and discredit his accuser. While this may not seem especially praiseworthy, such basic decency is still too rare.Until voters consistently demand at least this much from their elected officials, entitled jerkiness will remain a bipartisan problem.The Times is committed to publishing a diversity of letters to the editor. Senator Mitch McConnell, Republican of Kentucky, turned to the man who had engineered his defeat and offered a brief concession and congratulations.With that, Charles Ellis Schumer, 70, the Brooklyn-raised son of an exterminator and a homemaker, became the first New Yorker ever to lead the United States Senate.“Jan. 6 was the best of times,” Mr. Schumer said in a recent interview in his office, where he cracked open a Diet Coke. “And it was the worst of times.”His dream job has come with huge challenges and a practically nonexistent margin for error. Mr. Schumer rose to power on the strength of his skills as a party messenger and relentless campaign strategist, not his talent as a legislative tactician.Now it falls to him to maneuver President Biden’s ambitious agenda through a polarized, 50-50 Senate without one vote to spare, navigating between the progressive and moderate factions in his party in the face of a Republican opposition that is more determined than ever.Mr. Schumer passed his first test over the weekend, squeezing Mr. Biden’s sweeping $1.9 trillion stimulus measure through the Senate along party lines — an effort that nearly fell apart as Senator Joe Manchin III, Democrat of West Virginia and a crucial moderate, balked at the 11th hour. But Mr. Schumer faces formidable hurdles in keeping together his ideologically diverse caucus, which includes conservative Democrats and a self-described democratic socialist. His staff has imposed some rules for him when appearing in public: “No singing. No dancing. No hats.”“I love to sing. I love to dance,” he says, “and I’m lousy at both.”The effusive personality has helped him develop personal bonds with lawmakers of every ideological stripe. When he campaigned for the Senate in 1998, he described himself as an “angry centrist” who was “tough on crime.”His critics have long portrayed him as too cozy with Wall Street, and a review of his Senate record by The New York Times in 2008 showed that he repeatedly took steps to protect industry players from government oversight and tougher rules.But as his party has moved to the left, Mr. Schumer has aligned himself more closely with its progressive wing. In addition to backing a clean-energy jobs initiative that is part of the infrastructure plan, he has been among the leading voices calling on Mr. Biden to cancel up to $50,000 in student debt.“The world changes, and you have to change with it,” Mr. Schumer said. “Income inequality is much worse. Climate change is much more dangerous.”His ability to work both wings of his party was on display on Friday, when Mr. Schumer spent hours in painstaking negotiations with Mr. Manchin, who wanted to scale back unemployment payments, a core liberal priority in the stimulus bill. But then he was invited to join the Harvard Young Democrats, whose backing for Eugene McCarthy was part of an antiwar movement that swept the nation and ultimately prompted President Lyndon B. A ragtag group of students and other assorted nobodies toppled the most powerful man in the world? It is a major reason that, in a year when his party lost 13 seats in the House, it was able to recapture the Senate, albeit by the thinnest of margins.Ms. Warren recalled Mr. Schumer “hammering” her in 2011 until she agreed to run. He has had dozens of similar meetings over the years.As John Hickenlooper, the former Colorado governor, pursued the Democratic presidential nomination last year, Mr. Schumer was pestering him from the sidelines to consider a Senate run. He waited until a few days after Mr. Hickenlooper had left the presidential race, summoned the Coloradan and his wife for a meeting that lasted five hours and made his case. Mr. Hickenlooper ran and won, picking up a crucial Senate seat for Democrats.Mr. Schumer has had his share of disappointments, too. He wanted badly for Stacey Abrams, the former Georgia House minority leader, to challenge the Republican Kelly Loeffler for her Senate seat, but Ms. Abrams had her sights set on another office and instead urged him to choose the Rev. Raphael Warnock, a progressive Black pastor.It took about four months of cajoling by Mr. Schumer, but Mr. Warnock eventually agreed. Cuomo, its scope may be far broader than first anticipated.The team, which will be hired by Letitia James, the New York State attorney general, will have far-reaching subpoena powers to request troves of documents and compel witnesses, including the governor, to testify under oath.The independent inquiry may also scrutinize not just the sexual harassment accusations made by two former aides last week, but potential claims from other women as well.In the end, which is likely to be months from now, the investigators will be required to produce a final report, the results of which could be politically devastating for Mr. Cuomo.“The end game is that a report that found him culpable would bring pressure to bear on him personally, on his regime, on the Legislature to act,” said Nina Pirrotti, a lawyer who specializes in employment law and sexual harassment cases. “But I don’t exactly know how it will play out.”Mr. Cuomo, a third-term Democrat, is navigating one of the most precarious and uncertain periods of his more than 10 years in office, just months after he had emerged as a national leader early in the coronavirus pandemic.The governor is facing a federal probe into his administration’s decision to withhold data on nursing home deaths, a scandal that has led to calls for impeachment and has spurred state legislators to seriously consider curbing the emergency powers they granted him at the beginning of the pandemic.But the harassment accusations could be even more damaging for a governor who has prided himself on advancing protections for women in the workplace.The first accusation came from Lindsey Boylan, who used to work for his administration. Ms. Boylan published an essay on Wednesday that detailed a series of unsettling encounters she said she had with Mr. Cuomo, including an instance when she said he gave her an unsolicited kiss on the lips.Then, on Saturday, The New York Times published an article about Charlotte Bennett, a 25-year-old former entry-level staffer in the governor’s office who accused him of asking invasive questions, including whether she was monogamous and had sex with older men. She said she interpreted the remarks as sexual advances.Mr. Cuomo’s office denied Ms. Boylan’s allegations at the time. On Sunday, following Ms. Bennett’s account, Mr. Cuomo issued a statement in which he denied propositioning or touching anyone inappropriately, but apologized for workplace comments that he said “have been misinterpreted as an unwanted flirtation.”On Monday, following a public back-and-forth over who would conduct the investigation, Ms. James received the governor’s authorization to open an inquiry under a section of state law that allows her office to “inquire into matters concerning the public peace, public safety and public justice.”The claims from both women are now at the center of that investigation, the contours of which are still materializing but could prod deeply into the inner workings of the governor’s office and how sexual misconduct allegations are handled there.Mr. Cuomo’s office has indicated that the governor’s office would “voluntarily cooperate fully” and that it had instructed all state employees to do so as well.Investigators will ultimately produce a public report, which is bound to include a summary and analysis of their findings, maybe even recommendations. Experts said the civil inquiry could look at whether Mr. Cuomo violated the state’s human rights laws and Title VII of the Civil Rights Act, a federal law that protects against harassment because of a person’s sex.“These women do have the option, potentially, to bring claims against their employer, the State of New York, for Governor Cuomo’s conduct,” Ms. Pirrotti said, adding that the facts in the report could help victims recover economic and emotional distress damages.As investigators corroborate details, she said the inquiry could “widen and widen” to include other sexual harassment claims that might surface during the investigation. On Monday, a third woman, Anna Ruch, came forward and said that she was “confused and shocked and embarrassed” when Mr. Cuomo asked to kiss her at a wedding reception.In a referral letter on Monday to the attorney general, Beth Garvey, a special counsel and senior adviser to the governor, said the inquiry would broadly look into “allegations of and circumstances surrounding sexual harassment claims made against the governor.”Ms. James, a Democrat, said her office would oversee “a rigorous and independent investigation” but would hire a law firm to spearhead it, a move that many saw as an attempt to avoid any appearance that politics would influence the investigation. Trump, but also alienated some voters with her divisive stances and rhetoric.“I’m honored to have won this race,” Ms. Tenney said in a statement. “It was a hard-fought campaign and I thank Anthony Brindisi for his service. Now that every legal vote has been counted, it’s time for the results to be certified.”Since the courts intervened late last year, the contest has been defined by ever-changing, razor-thin margins and a convoluted judicial process that exposed egregious flaws in the way election officials handled and counted ballots. For weeks, a judge was tasked with deciding the fate of more than 1,000 ballots challenged by both campaigns, leaving the seat empty when the new Congress was seated in January.Even so, the saga may not be over: The Brindisi campaign has argued that several hundred ballots that were rejected should have been counted and it has signaled that it could appeal the election results. Mr. Brindisi could also seek recourse in the House of Representatives, which has the power to order a new election or recount in the race, and potentially unseat Ms. Tenney.“I am shocked and surprised by this decision because of the countless errors and discrepancies that have occurred throughout this initial count,” Mr. Brindisi said in a statement. “I believe a full audit and hand recount is the only way to resolve this race. With the margin so thin, the ever-changing tally, and the countless errors that have occurred arriving at today’s final number we can’t afford to wonder here. We have to get it right.”The election in the 22nd District, which stretches from the southeastern shores of Lake Ontario to the northern Pennsylvania border, was a rematch between the candidates and one of the most expensive contests in the nation.Ms. Tenney was vying to reclaim her seat from Mr. Brindisi, who upset her in 2018, when he won by fewer than 4,500 votes in a district where Republicans outnumber Democrats. When the polls closed on Nov. 3, Ms. Tenney had a seemingly insurmountable 28,422-vote lead based on the in-person vote. But as tens of thousands of mail-in ballots poured in, her lead dwindled to 12 votes.That lead expanded and contracted, swinging in favor of one candidate or the other at various points, as the state judge overseeing the case waded through weeks of arguments from the campaigns over how different challenged ballots should be counted.That’s when the mishaps and errors began to emerge, threatening the legitimacy of the results and forcing an increasingly exasperated judge to order county boards of elections to revise their tallies and fix certain errors.In one case, county officials discovered a batch of dozens of uncounted ballots weeks after the election. In another instance, it was revealed that officials in Oneida County did not process the applications of more than 2,400 voters, making them ineligible to vote on Election Day. Then there was the “StickyGate” scandal, in which election officials could not determine whether a batch of disputed ballots had been counted because of Post-it notes that had mysteriously fallen off the ballots.Indeed, Justice Scott J. DelConte of the New York State Supreme Court wrote in his ruling on Friday that the “record in this election reflects that both candidates suffered the effects of systemic violations of state and federal election laws.”But he asserted that “every single valid vote that was cast in New York’s 22nd Congressional District has been accounted for, and counted.”The final tally, Justice DelConte said, showed Ms. Tenney had received 156,098 votes to Mr. Brindisi’s 155,989 votes.Justice DelConte said he did not have the authority to order a recount, arguing that the House of Representatives held ultimate authority over the seat and that Mr. Brindisi could seek to challenge the results in the House, where Democrats hold a majority.A new state law in New York that requires recounts in races where the margin is 0.5 percent or less went into effect this year, but it does not apply to the race in the 22nd District because the election was conducted last year.Even so, Mr. Brindisi’s lawyers have argued against certifying the results until his pending appeals were resolved and they sought a recount, noting the margin in the race was below the 0.5 percent threshold.AdvertisementContinue reading the main story More
