    Fox News is having another one of its moments.The network’s internal fissures were on public display this week as host after host, at times seemingly in dialogue with one another, either defended or threw rhetorical spitballs at different candidates in Pennsylvania’s ghost-pepper-hot Republican primary races.It was a reminder of how the battle for hearts and minds within the G.O.P. is playing out across the conservative news media, an ever-evolving ecosystem that has grown only more complex since Donald Trump’s famous glide down that golden escalator. And it was a sharp illustration of how Fox News grants extraordinary latitude to its biggest stars — with each prime-time show often operating as its own private fief.Thursday night alone was pretty wild, with Sean Hannity pumping up Dr. Mehmet Oz, Trump’s choice for Senate, and talking down Kathy Barnette, a conservative media commentator whose late surge in the May 17 primary has alarmed Republican Party insiders and thrilled the rambunctious G.O.P. grass-roots in Pennsylvania.An hour later, Laura Ingraham was defending Barnette against what she called “smears.”To viewers, it presented the illusion of a real-time debate between warring factions of what remains the nation’s most powerful cable news channel. Fox News did not offer an on-the-record comment by publication time.“This is the closest thing to a head-to-head competition we’ve seen between two Fox hosts in quite some time,” said Matt Gertz, a senior fellow at Media Matters for America, a nonprofit group aligned with the Democratic Party that monitors conservative news outlets.“When you’re watching at home, it appears seamless,” said Greta Van Susteren, a former Fox News host, who said that Ingraham probably hadn’t watched Hannity while preparing for her show. “But when I was at Fox, we all had our own real estate, and nobody ever told me what to say or do.”And it’s not just Fox. Andrew Cuomo of New York, became clear.Tucker Carlson of Fox News helped slingshot J.D. Vance into the G.O.P. nomination for a Senate seat in Ohio, for instance, helping him gain a following and honing his pitch to voters — and, perhaps most important, to Trump. According to a New York Times analysis of “Tucker Carlson Tonight” transcripts, Vance has appeared as Carlson’s guest on the program nine times so far this year. He appeared 13 times in 2021, five times in 2020 and six times in 2019.For his part, Hannity has appeared at Trump rallies and even offered his private advice to Trump while he was in office, according to a trove of text messages published by CNN.     The dominance of right-wing ideas in France’s presidential election campaign follows years of cultural wars waged successfully by conservatives on television, in social media and in think tanks.PARIS — With just days to go before the first round of France’s presidential election, President Emmanuel Macron is still the odds-on favorite to make it through the political juggernaut and win a second term. But even if he does succeed, and before a single ballot is cast, another clear winner has already emerged from the race.The French right.Despite a late surge by Jean-Luc Mélenchon, the leading left-wing candidate, virtually the entire French campaign has been fought on the right and far right, whose candidates dominate the polls and whose themes and talking points — issues of national identity, immigration and Islam — have dominated the political debate. The far right has even become the champion of pocketbook issues, traditionally the left’s turf.Mr. Macron himself has pivoted to the right so consistently to confront the challenge that there is even discussion now of whether he should be regarded as a center-right president, though he emerged from a government run by the now-moribund Socialists in 2017.In a tightening race, the candidate he is most likely to face in a runoff two weeks from Sunday’s initial voting is Marine Le Pen, the far-right leader of the National Rally, according to polls. His YouTube campaign-launching video, riddled with cultural references, drew millions of viewers.Mr. Llorca said that Mr. Zemmour had successfully waged a “battle of the cool” designed to “play down the radical content” of his ideas without ever changing their substance. He has been helped by a network of internet users who defuse with humor the violence of his extremist ideas. On Facebook and Instagram, accounts followed by tens of thousands of people frequently post lighthearted memes about Mr. Zemmour.Mr. Zemmour has received support from far-right YouTube influencers mocking everything from feminism to veganism to trade unions. Biden Jr.’s daughter, Ashley, received a call from a man offering help. Striking a friendly tone, the man said that he had found a diary that he believed belonged to Ms. Biden and that he wanted to return it to her.Ms. Biden had in fact kept a diary the previous year as she recovered from addiction and had stored it and some other belongings at a friend’s home in Florida where she had been living until a few months earlier. The diary’s highly personal contents, if publicly disclosed, could prove an embarrassment or a distraction to her father at a critical moment in the campaign.She agreed with the caller to send someone to retrieve the diary the next day.But Ms. Biden was not dealing with a good Samaritan.The man on the other end of the phone worked for Project Veritas, a conservative group that had become a favorite of President Donald J. Trump, according to interviews with people familiar with the sequence of events. From a conference room at the group’s headquarters in Westchester County, N.Y., surrounded by other top members of the group, the caller was seeking to trick Ms. Biden into confirming the authenticity of the diary, which Project Veritas was about to purchase from two intermediaries for $40,000.The caller did not identify himself as being affiliated with Project Veritas, according to accounts from two people with knowledge of the conversation. By the end of the call, several of the group’s operatives who had either listened in, heard recordings of the call or been told of it believed that Ms. Biden had said more than enough to confirm that it was hers.The new details of Project Veritas’s effort to establish that the diary was Ms. Biden’s are elements of a still-emerging story about how Trump supporters and a group known for its undercover sting operations worked to expose personal information about the Biden family at a crucial stage of the 2020 campaign.Drawn from interviews, court filings and other documents, the new information adds further texture to what is known about an episode that has led to a criminal investigation of Project Veritas by federal prosecutors who have suggested they have evidence that the group was complicit in stealing Ms. Biden’s property and in transporting stolen goods across state lines.And by showing that Project Veritas employed deception rather than traditional journalistic techniques in the way it approached Ms. Biden — the caller identified himself with a fake name — the new accounts could further complicate the organization’s assertions in court filings that it should be treated as a publisher and granted First Amendment protections. Project Veritas regularly carries out undercover stings, surveillance operations and ambush interviews, mostly against liberal groups and journalists.At the same time, new information about the case suggests that the effort to make the diary public reached deeper into Mr. Trump’s circle than previously known.A month before the call to Ms. Biden, the diary had been passed around a Trump fund-raiser in Florida at the home of a donor who helped steer the diary to Project Veritas and was later nominated by Mr. Trump to the National Cancer Advisory Board. Among those attending the event was Donald Trump Jr., though it is not clear if he examined it.Federal prosecutors have been investigating how Project Veritas obtained the diary, and last fall carried out searches at the homes of three of the group’s operatives, including that of its founder, James O’Keefe. In court filings, prosecutors have suggested that the organization was complicit in the theft of some of Ms. Biden’s other belongings, which interviews show the group obtained as it was seeking to confirm the diary’s authenticity.Project Veritas — which is suing The New York Times for defamation in an unrelated case — has denied any wrongdoing or knowledge that the belongings had been stolen. It has portrayed itself as a media organization that is being unfairly investigated for simply doing journalism and has assailed the Justice Department and the F.B.I. for their handling of the case.Prosecutors have signaled that they view the circumstances very differently, all but dismissing in one court filing the group’s defense that it was acting as a news organization, saying that “there is no First Amendment protection for the theft and interstate transport of stolen property.”In response to a request to Project Veritas for comment, Mr. O’Keefe sent an email criticizing The Times. “Imagine writing so thoroughly divergent from reality and so mendacious with innuendo that there is literally no utterance that won’t make it worse,” he said.Spokesmen for the F.B.I. and for federal prosecutors overseeing the case in the Southern District of New York declined to comment, as did Roberta Kaplan, a lawyer for Ms. Biden.Project Veritas portrayed itself as a media organization that is being unfairly investigated, and has assailed the Justice Department and the F.B.I. for their handling of the case.Stefani Reynolds for The New York TimesThe Times has previously reported that the story of Project Veritas’s involvement with the diary began in the months leading up to Election Day.In July 2020, a single mother of two moved into the rented home of a former boyfriend in Delray Beach, Fla. Shortly after moving into the rental, Ms. Harris learned that Ms. Biden — also a friend of the former boyfriend — had been staying at the home earlier that year during the pandemic.Ms. Biden had moved back to the Philadelphia area in June 2020, around the time her father clinched the Democratic Party’s nomination for president. She stored a couple of bags of her belongings at the rental house along with her diary, and she told her friend, who was leasing the home, that she planned to return to retrieve her things in the fall.In August, Ms. Harris reached out to Robert Kurlander, a friend who had been sentenced to 40 months in prison in the 1990s on a federal fraud charge and had expressed anti-Biden sentiments online, to say she had found the diary. The two believed they could sell it, allowing Ms. Harris to help pay for the lawyers representing her in the custody dispute.New details from interviews and documents have further fleshed out what happened next. Mr. Kurlander contacted Elizabeth Fago, the Trump donor who would host the fund-raiser attended by Donald Trump Jr. When first told of the diary, Ms. Fago said she thought it would help Mr. Trump’s chances of winning the election, according to two people familiar with the matter.Richard G. Lubin, a lawyer for Ms. Fago, declined to comment.On Sept. 3, Ms. Fago’s daughter alerted Project Veritas about the diary through its tip line.Three days later, Ms. Harris and Mr. Kurlander — with the diary in hand — attended the fund-raiser attended by Donald Trump Jr. at Ms. Fago’s house in Jupiter, Fla., to see whether the president’s re-election campaign might be interested in it. While there, Mr. Kurlander showed others the diary. It is unclear who saw it.After the criminal investigation into Project Veritas became public last fall, a prominent Republican lawyer who was lobbying on behalf of the organization and Mr. O’Keefe briefed a group of congressional Republicans on the case, to urge them to try to persuade the Justice Department to back off the investigation because the group did nothing wrong, according to a person briefed on the matter.President Donald J. But shortly thereafter Mr. Paoletta, who had served as Vice President Mike Pence’s top lawyer in the White House, called back the congressional Republicans to say he was unsure whether the account about Donald Trump Jr.’s reaction was accurate.Lobbying filings show that Mr. Paoletta was paid $50,000 during the last two months of last year to inform members of Congress about the F.B.I. raid on Mr. O’Keefe. Mr. Paoletta and a lawyer for Donald Trump Jr. did not respond to messages seeking comment.Once Project Veritas learned about the diary in early September, the group sought to acquire it. About a week after the fund-raiser, Ms. Harris and Mr. Kurlander flew to New York with the diary. The pair met with several Project Veritas operatives at a hotel on Manhattan’s West Side.The two sides began negotiating an agreement, but no final deal was struck at that stage and Ms. Harris and Mr. Kurlander returned to Florida. In response to questions about what Project Veritas may have asked him to do to help authenticate the diary, Mr. Kurlander, through his lawyer, Jonathan Kaplan, declined to comment.But Project Veritas had to confront tricky questions: Was the diary really Ashley Biden’s, and not a fake or a setup? How could Project Veritas, best known for its undercover sting operations, be sure it was not a victim of its own deceptive tactics?To authenticate the diary, one of Mr. O’Keefe’s top lieutenants, Spencer Meads, was dispatched to Florida to do more investigative work.What happened next is a matter of dispute and one of the major issues in the investigation. Project Veritas has said in court filings that its operatives obtained additional items belonging to Ms. Biden that their “sources” had described as “abandoned,” suggesting that it had no knowledge of any theft and that it had gotten access to Ms. Biden’s belongings in the same way that journalists receive information.“The sources arranged to meet the Project Veritas journalist in Florida soon thereafter to give the journalist additional abandoned items,” lawyers for the group wrote in a federal court filing.Project Veritas’s lawyers had long instructed its operatives that encouraging or incentivizing sources to steal documents or items could ensnare the group in a crime. In a memo to Mr. O’Keefe in 2017, one of the group’s lawyers concluded: “Under controlling precedent, PV enjoys substantial legal protections to report and disclose material that may have been illegally obtained provided it played no part in obtaining it.”But at least one of the “sources” told others that a Project Veritas operative had asked them whether they could retrieve more items from the home that could help show that the diary belonged to Ms. Biden, according to a person with knowledge of the exchange. Additional items were then taken out of the home and given to the operative, one of the sources has told others.In response to assertions from Project Veritas that it had done nothing wrong and that its role in the case was protected by the First Amendment, prosecutors accused the group in court filings of making unsworn statements that are either “false or misleading and are directly contradicted by the evidence.” They also stated that even a legitimate news organization would have no First Amendment defense for acquiring material through theft or another crime.“Put simply, even members of the news media ‘may not with impunity break and enter an office or dwelling to gather news,’” prosecutors said.Without citing specific evidence, prosecutors directly challenged one argument from Project Veritas in particular: the group’s “repeated claim that they had ‘no involvement’ in how the victim’s property was ‘acquired.’”The plan for Ms. Biden to have a friend retrieve the diary from the person who called her in early October fell through. And the accounts that Project Veritas has laid out in court papers and to the local police in Florida about how it obtained the diary and dealt with it in the final weeks leave open questions about how the events played out.The F.B.I. obtained a search warrant and raided the home of James O’Keefe, the founder of Project Veritas.Cooper Neill for The New York TimesProject Veritas told a federal judge that on Oct. 12, Mr. O’Keefe sent an email telling his team that he had made the decision not to publish a story about the diary, adding, “We have no doubt the document is real” but that reactions to its publication would be “characterized as a cheap shot.” The date provided by Mr. O’Keefe for the email was shortly after the call to Ms. Biden.But four days after Mr. O’Keefe told his staff that it would not publish the diary, a top lawyer for Project Veritas told Mr. Biden’s campaign that it had the diary and wanted to interview Mr. Biden on camera about it, The Times reported in December.Less than a week after that, Project Veritas finalized a deal with Mr. Kurlander and Ms. Harris to buy the rights to publish the diary for $40,000, wired them the money and signaled that the group planned to soon publish it, according a person with knowledge of the case.In the end, Project Veritas chose not to publish. Instead, an obscure right-wing website published the diary in late October, but it got little attention before the election. Mr. O’Keefe was furious, and some within Project Veritas thought that one of its own operatives, frustrated with the group’s unwillingness to publish the diary, had leaked it.Project Veritas decided to have one of its operatives take the diary and Ms. Biden’s other belongings back to Florida.According to a Delray Beach Police Department report, a lawyer showed up at the department and gave the items to an officer. The lawyer, according to police body camera footage, said the items were “possibly stolen.”The police alerted the F.B.I., which had an agent retrieve Ms. Biden’s diary and other belongings. Almost a year later, the F.B.I. approached Ms. Harris and Mr. Kurlander.About two weeks later, F.B.I. agents obtained search warrants to raid the homes of Mr. O’Keefe and two of his operatives: Mr. Meads and Eric Cochran, both of whom left the organization after the diary project.     First Amendment Scholars Want to See the Media Lose These Cases

    Some legal experts say it is time to draw a sharp line between protected speech and harmful disinformation.The lawyers and First Amendment scholars who have made it their life’s work to defend the well-established but newly threatened constitutional protections for journalists don’t usually root for the media to lose in court.But that’s what is happening with a series of recent defamation lawsuits against right-wing outlets that legal experts say could be the most significant libel litigation in recent memory.The suits, which are being argued in several state and federal courts, accuse Project Veritas, Fox News, The Gateway Pundit, One America News and others of intentionally promoting and profiting from false claims of voter fraud during the 2020 election, and of smearing innocent civil servants and businesses in the process.If the outlets prevail, these experts say, the results will call into question more than a half-century of precedent that created a clear legal framework for establishing when news organizations can be held liable for publishing something that’s not true.Libel cases are difficult to prove in the United States. Among other things, public figures have to show that someone has published what the Supreme Court has called a “calculated falsehood” or acted with reckless disregard for the truth.But numerous First Amendment lawyers said they thought the odds were strong that at least one of these outlets would suffer a rare loss at trial, given the extensive and well-documented evidence against them.That “may well turn out to be a good thing,” said Lee Levine, a veteran First Amendment lawyer who has defended some of the biggest media outlets in the country in libel cases.The high legal bar to prove defamation had become an increasingly sore subject well before the 2020 election, mainly but not exclusively among conservatives, prompting calls to reconsider the broad legal immunity that has shielded journalists since the landmark 1964 Supreme Court decision New York Times v. Sullivan. Critics include politicians like former President Donald J. Trump and Sarah Palin, who lost a defamation suit against The Times last month and has asked for a new trial, as well as two Supreme Court justices, Clarence Thomas and Neil M. Gorsuch.Mr. Levine said a finding of liability in the cases making their way through the courts could demonstrate that the bar set by the Sullivan case did what it was supposed to: make it possible to punish the intentional or extremely reckless dissemination of false information while protecting the press from lawsuits over inadvertent errors.“If nothing else,” Mr. Levine added, “it would effectively rebut the recent contentions that the Sullivan regime doesn’t work as intended.”The Sullivan case, which legal scholars consider as seminal to the First Amendment as Brown v. Board of Education of Topeka was to civil rights, established the “actual malice” standard for defamation. It requires that a suing public figure prove a person or media outlet knew what it said was false or acted with “reckless disregard” for the high probability that it was wrong.Calls to weaken that precedent drew considerable resistance from advocates for press freedom. But many of them have come to see the threat of a defamation suit — a tactic often used by the powerful to retaliate against and mute unwelcome criticism — as an essential tool in the battle against disinformation.Increasingly, many First Amendment lawyers see the courts as one of the last viable paths to deter the spread of political disinformation and help prevent repeats of dangerous situations — from another Jan. 6-style riot to the more isolated threats against local officials that grew out of Mr. Trump’s false insistence that the election was stolen from him.“I think we are at a time in U.S. history and world history of losing any ability as a civilization to distinguish between truth and falsity,” said Rodney Smolla, a lawyer representing Dominion Voting Systems, a technology company suing Fox News and several individuals who promoted conspiracy theories about the last election, including Rudolph W. Giuliani and Sidney Powell.“And one of the few legal avenues in which civilized countries have attempted to distinguish between truth and falsity is defamation law,” said Mr. Smolla, who believes the Sullivan decision is sound law. A judge in Delaware, where the Dominion suit was filed, denied Fox’s motion to dismiss the case in December, and it is now in the discovery phase.As a defense, Fox and others invoke the First Amendment and Sullivan, arguing that their reporting on the 2020 election and its aftermath is legally indistinguishable from the kind of basic, just-the-facts journalism that news organizations have always produced. Fox has portrayed itself as a neutral observer, saying it did not endorse claims about hacked voting machines and systemic voter fraud but instead offered a platform for others to make statements that were unquestionably newsworthy.As Fox News mounts its defense in the Dominion case and in a lawsuit by another voting systems company, Smartmatic, the network’s lawyers have argued that core to the First Amendment is the ability to report on all newsworthy statements — even false ones — without having to assume responsibility for them.“The public had a right to know, and Fox had a right to cover,” its lawyers wrote. As for inviting guests who made fallacious claims and spun wild stories, the network — quoting the Sullivan decision — argued that “giving them a forum to make even groundless claims is part and parcel of the ‘uninhibited, robust and wide-open’ debate on matters of public concern.’”Last week, a federal judge ruled that the Smartmatic case against Fox could go forward, writing that at this point, “plaintiffs have pleaded facts sufficient to allow a jury to infer that Fox News acted with actual malice.”The broadness of the First Amendment has produced strange bedfellows in free speech cases. Typically, across the political spectrum there is a recognition that the cost of allowing unrestrained discourse in a free society includes getting things wrong sometimes. When a public interest group in Washington State sued Fox in 2020, alleging it “willfully and maliciously engaged in a campaign of deception and omission” about the coronavirus, many First Amendment scholars were critical on the grounds that being irresponsible is not the same as acting with actual malice. That lawsuit was dismissed.But many aren’t on Fox’s side this time. If the network prevails, some said, the argument that the actual malice standard is too onerous and needs to be reconsidered could be bolstered.“If Fox wins on these grounds, then really they will have moved the needle too far,” said George Freeman, executive director of the Media Law Resource Center and a former lawyer for The New York Times. News organizations, he added, have a responsibility when they publish something that they suspect could be false to do so neutrally and not appear to be endorsing it.Fox is arguing that its anchors did query and rebut the most outrageous allegations.Paul Clement, a lawyer defending Fox in the Smartmatic case, said one of the issues was whether requiring news outlets to treat their subjects in a skeptical way, even if their journalists doubt that someone is being truthful, was consistent with the First Amendment.“If you’re superskeptical, you’re covered, but if you express sympathy, then somehow you’re not?” Mr. Clement said. “To me, that seems fundamentally problematic and antithetical to First Amendment values.”One America News also faces a lawsuit accusing it of deliberately promoting and profiting from false claims of voter fraud. It has not yet responded to the suit.The New York TimesPerhaps the boldest in claiming that they were merely reporting on important events and so are protected by the First Amendment are Project Veritas and its founder, James O’Keefe. They are being sued for publishing and amplifying the claims of a postal worker in Erie, Pa., who implicated his boss in a plot to backdate mail-in ballots and help elect President Biden. An investigation found no evidence to support those claims.In legal briefs, lawyers for Mr. O’Keefe and Project Veritas have called their work “the stuff responsible journalism is made of” and claimed that the case would put “news-gathering itself on trial.” To bolster their argument, they cite examples of how Project Veritas worked in ways that would seem consistent with professional news reporting, including reaching out to the accused postal supervisor for comment twice. A lawyer representing Mr. O’Keefe had no comment.The lawsuit, however, paints a different picture from the “scrupulous” reporting that Project Veritas lawyers described. It recounts how, after the election, the outlet published multiple articles about someone it identified as a whistle-blower, Richard Hopkins, who came forward with accusations that the local postmaster, Robert Weisenbach, was a “Trump hater” and had ordered employees to backdate mail-in ballots to help Mr. Biden.But the lawsuit claims that Mr. Hopkins changed his recollection of events when postal inspectors questioned him, admitting that he did not know whether Mr. Weisenbach had directed anyone to backdate ballots. As for whether Mr. Weisenbach was really the “Trump hater” Mr. Hopkins made him out to be, Mr. Weisenbach said he had voted for Mr. Trump.In the complaint, Mr. Weisenbach’s lawyers argued that what Project Veritas had done “was not investigative journalism.” Rather, they said, “it was targeted character assassination” aimed at undermining public faith in democracy.“It has no place in our country,” the complaint added.Protect Democracy, a nonpartisan advocacy group representing Mr. Weisenbach, is also assisting two public employees in Georgia who were falsely accused of orchestrating voter fraud. The pair, a mother and daughter, are suing The Gateway Pundit and One America News over articles that accused them of helping fake a water main break at a Fulton County ballot counting center and then telling everyone to go home so they could add suitcases full of illegal ballots to Mr. Biden’s totals.OAN has not yet responded to the suit.     How Billionaires Are Shaping France’s Presidential Campaign

    In a nation with strict political finance laws, control over the news media has provided an avenue for the very rich to influence elections, this one more than ever.PARIS — The face of President Emmanuel Macron’s possibly fiercest rival in France’s coming election is not on any campaign poster. He has not given a single speech. His name will not be on the ballot.He is not a candidate at all, but the man often described as France’s Rupert Murdoch: Vincent Bolloré, the billionaire whose conservative media empire has complicated Mr. Macron’s carefully plotted path to re-election by propelling the far-right candidacy of Éric Zemmour, the biggest star of Mr. Bolloré’s Fox-style news network, CNews.With the first round of France’s presidential election just a month away, polls show Mr. Macron as the favorite. But it is Mr. Zemmour who has set the themes of the race with the openly anti-immigrant and anti-Muslim views he had put forth each evening on television for the past couple of years.“Bolloré’s channels have largely created Zemmour,” François Hollande, France’s former president, said in an interview. But Mr. Zemmour’s emergence is just the latest example of the power of France’s media tycoons, Mr. Bolloré most prominent among them, to shape political fortunes. It has been the hidden drama behind the 2022 elections, with some of the media billionaires angling strongly against Mr. Macron, and others in support of him.On one side are Mr. Bolloré and his media group, Vivendi; on the other are billionaires regarded as Mr. Macron’s allies, including Bernard Arnault, the head of the LVMH luxury empire.The political reach of media tycoons has become enough of a concern that the French Senate has opened an inquiry. In hearings broadcast live in January and February, they all denied any political motive. Mr. Bolloré said his interests were “purely economic.” Mr. Arnault said his investments in the news media were akin to “patronage.”But there is little doubt that their media holdings give them leverage that France’s campaign finance laws would otherwise deny them. In France, political TV ads are not allowed in the six months before an election. Corporate donations to candidates are banned.Personal gifts to a campaign are limited to 4,600 euros, or about $5,000. In this election cycle, presidential candidates cannot spend more than €16.9 million each, or about $18.5 million, on their campaigns for the first round; the two finalists are then limited to a total of €22.5 million each, or about $24.7 million. By comparison, when he was a presidential candidate, Joseph R. He is regarded as an ally of Mr. Macron.Christophe Archambault/Agence France-Presse — Getty Images“Why do you think that these French capitalists whose names you know buy Le Monde, Les Echos, Le Parisien?” Jean-Michel Baylet, whose family has owned a powerful group of newspapers in southwest France for generations, said in an interview, mentioning some of the country’s biggest newspapers.“They’re buying influence,” said Mr. Baylet, a former minister of territorial cohesion, who himself has been accused of using his media outlets to advance a parallel career in politics — a charge he denies.The control of media by industrialists, whose core businesses depend on government contracts in construction or defense, amounts to “a conflict of interests,” said Aurélie Filippetti, who oversaw the media sector as a minister of culture.Armed with media properties, businessmen enjoy leverage over politicians.“Politicians are always afraid that newspapers will fall into unfriendly hands,” said Claude Perdriel, the main shareholder of Challenges, a weekly magazine, who said that he made sure to sell his previous outlets, including the magazine L’Obs, to other businessmen who shared his left-leaning politics.For Mr. Macron, that is what happened when early this year Jérôme Béglé, who is a frequent guest on CNews, took over the Journal du Dimanche, a Sunday newspaper once so pro-Macron that it was called the “Pravda” of the government.     Much of Smartmatic Case Against Fox News Can Proceed, Judge Rules

    The $2.7 billion defamation lawsuit against Fox News by the election technology company Smartmatic can move forward, a New York judge ruled on Tuesday. But the judge tossed out Smartmatic’s defamation claims against the Fox News host Jeanine Pirro and a network guest, Sidney Powell.Smartmatic sued Rupert Murdoch’s cable news networks last year, along with several Fox hosts and guests. The lawsuit accused them of damaging the company by promoting a false narrative about the 2020 election: that Smartmatic and other voting systems companies tried to rig the race against President Donald J. Trump. Smartmatic later expanded its legal battle against disinformation to the right-wing media outlets Newsmax and One America News Network.On Tuesday, Justice David B. Cohen of State Supreme Court in Manhattan said in a 61-page ruling that, “at a minimum, Fox News turned a blind eye to a litany of outrageous claims about plaintiffs, unprecedented in the history of American elections, so inherently improbable that it evinced a reckless disregard for the truth.”He added, “At this nascent stage of the litigation, this court finds that plaintiffs have pleaded facts sufficient to allow a jury to infer that Fox News acted with actual malice.”He also declined to dismiss Smartmatic claims against Maria Bartiromo, the Fox Business star, and Lou Dobbs, whose Fox Business show was a frequent clearinghouse for baseless theories of electoral fraud in the weeks after Mr. Trump’s defeat. Fox canceled Mr. Dobbs’s program last year, one day after Smartmatic sued.Citing a legal technicality, Justice Cohen dismissed most of Smartmatic’s defamation claims against Rudolph W. Giuliani, who, appearing on Fox News as a legal representative for Mr. Trump, said the technology company had “tried-and-true methods for fixing elections,” among other false assertions. Even so, Justice Cohen said there was “substantial” evidence that Mr. Giuliani “acted with actual malice insofar as he evinced a reckless disregard for the truth” and ruled that Smartmatic could try again. The judge allowed another part of Smartmatic’s defamation case against Mr. Giuliani to go forward.Fox News vowed a swift appeal.“While we are gratified that Judge Cohen dismissed Smartmatic’s claims against Jeanine Pirro at this early stage, we still plan to appeal the ruling immediately,” the network said in a statement. The network added that it would “continue to litigate these baseless claims by filing a counterclaim for fees and costs” under New York’s anti-SLAPP (strategic lawsuit against public participation) statute, which is meant to quickly set aside lawsuits that may be intended to chill free speech.Fox News said it would do so “to prevent the full-blown assault on the First Amendment which stands in stark contrast to the highest tradition of American journalism.”In dismissing the claim against Ms. Pirro, Justice Cohen said that while she had asserted on her show that Democrats “stole votes,” she had not specifically blamed Smartmatic’s software.A spokesman for Smartmatic did not reply to a request for comment.Fox News is also battling a related $1.6 billion defamation lawsuit from Dominion Voting Systems, which has accused the channel of advancing lies that devastated its reputation and business.     How to Keep the Rising Tide of Fake News From Drowning Our Democracy

    The same information revolution that brought us Netflix, podcasts and the knowledge of the world in our smartphone-gripping hands has also undermined American democracy. There can be no doubt that virally spread political disinformation and delusional invective about stolen, rigged elections are threatening the foundation of our Republic. It’s going to take both legal and political change to bolster that foundation, and it might not be enough.Today we live in an era of “cheap speech.” Eugene Volokh, a First Amendment scholar at U.C.L.A., coined the term in 1995 to refer to a new period marked by changes in communications technology that would allow readers, viewers and listeners to receive speech from a practically infinite variety of sources unmediated by traditional media institutions, like newspapers, that had served as curators and gatekeepers. Professor Volokh was correct back in 1995 that the amount of speech flowing to us in formats like video would move from a trickle to a flood.What Professor Volokh did not foresee in his largely optimistic prognostication was that our information environment would become increasingly “cheap” in a second sense of the word, favoring speech of little value over speech that is more valuable to voters.It is expensive to produce quality journalism but cheap to produce polarizing political “takes” and easily shareable disinformation. The economic model for local newspapers and news gathering has collapsed over the past two decades; from 2000 to 2018, journalists lost jobs faster than coal miners.While some false claims spread inadvertently, the greater problem is not this misinformation but deliberately spread disinformation, which can be both politically and financially profitable. Feeding people reassuring lies on social media or cable television that provide simple answers to complex social and economic problems increases demand for more soothing falsities, creating a vicious cycle. False information about Covid-19 vaccines meant to undermine confidence in government or the Biden presidency has had deadly consequences.The rise of cheap speech poses special dangers for American democracy and for faith and confidence in American elections. To put the matter bluntly, if we had the polarized politics of today but the information technology of the 1950s, we almost certainly would not have seen the insurrection of Jan. 6, 2021, at the United States Capitol. Millions of Republican voters would probably not have believed the false claims that the 2020 election was stolen from former President Donald Trump and demanded from state legislatures new restrictive voting rules and fake election “audits” to counter phantom voter fraud.According to reporting in The Times, President Donald Trump took to Twitter more than 400 times in the almost three weeks after Nov. 3, 2020, to attack the legitimacy of the election, often making false claims that it had been stolen or rigged to millions and millions of people. In an earlier era, the three major television networks, The Times and local newspaper and television stations would most likely have been more active in mediating and curtailing the rhetoric of a president spewing dangerous nonsense. Over at Facebook, in the days after the 2020 election, politically oriented “groups” became rife with stolen-election talk and plans to “stop the steal.” Cheap speech lowered the costs for like-minded conspiracy theorists to find one another, to convert people to believing the false claims and to organize for dangerous political action at the U.S. Capitol.A democracy cannot function without “losers’ consent,” the idea that those on the wrong side of an election face disappointment but agree that there was a fair vote count. Those who believe the last election was stolen will have fewer compunctions about attempting to steal the next one. They are more likely to threaten election officials, triggering an exodus of competent election officials. They are more likely to see the current government as illegitimate and to refuse to follow government guidance on public health, the environment and other issues crucial to health and safety. They are comparatively likely to see violence as a means of resolving political grievances.But cheap speech has already done damage to our democracy and has the potential to do even more. The demise of local newspapers — and their replacement in some cases with partisan or even foreign sources of information masquerading as legitimate journalism — fosters a loss of voter competence, as voters have a harder time getting objective information about candidates’ records and positions. Cheap speech also decreases officeholder accountability; studies show that corruption rises when journalists are not there to hold politicians accountable. And as technology makes it easier to spread “deep fakes” — false video or audio clips showing politicians or others saying or doing things they did not in fact say or do — voters will increasingly come to mistrust everything they see and hear, even when it is true.The rise of anonymous speech facilitated by the information revolution, particularly on social media, increases the opportunities for foreign interference to influence American electoral choices, as we saw with Russian efforts in the 2016 and 2020 elections. Domestic copycats have followed suit: In the 2017 Doug Jones-Roy Moore U.S. Senate race in Alabama, Mr. Jones’s supporters — acting without his knowledge — posed on social media as Russian bots and Baptist alcohol abolitionists supporting Roy Moore in an effort to depress moderate Republican support for Mr. Moore. Mr. Jones, a Democrat, narrowly won that election, though we cannot say that the disinformation campaign swung the result.The cheap speech environment increases polarization and the risk of demagogy by individual candidates. Representative Marjorie Taylor Greene of Georgia, who before entering Congress embraced dangerous QAnon conspiracy theories and supported the execution of Democratic politicians, need not depend upon party leaders for funding; by being outrageous, she can go right to social media to cheaply raise funds for her campaigns and political activities.We now live in an era of high partisanship but weak political parties, which can no longer serve as the moderating influence on extremists within their ranks. Cheap speech accelerates this trend.We cannot — and would not want to — go back to a time when media gatekeepers deprived voters of valuable information. Cheap speech helped fuel Black Lives Matters protests and the racial justice movement both before and after the murder of George Floyd, and virally spread videos of police misconduct can help catalyze meaningful change. But the cheap speech era requires new legal tools to shore up our democracy.Among the legal changes that could help are an updating of campaign finance laws to cover what is now mostly unregulated political advertising disseminated over the internet, labeling deep fakes as “altered” to help voters separate fact from fiction and a tightening of the ban on foreign campaign expenditures. Congress should also make it a crime to lie about when, where and how people vote. A Trump supporter has been charged with targeting voters in 2016 with false messages suggesting that they could vote by text or social media post, but it is not clear if existing law makes such conduct illegal. We also need new laws aimed at limiting microtargeting, the use by campaigns or interest groups of intrusive data collected by social media companies to send political ads, including some misleading ones, sometimes to vulnerable populations.Unfortunately, the current Supreme Court would very likely view many of these proposed legal changes as violating the First Amendment’s free speech guarantees. Much of the court’s jurisprudence depends upon faith in an outmoded “marketplace of ideas” metaphor, which assumes that the truth will emerge through counterspeech. If that was ever true in the past, it is not true in the cheap speech era. Today, the clearest danger to American democracy is not government censorship but the loss of voter confidence and competence that arises from the sea of disinformation and vitriol.What’s worse, some justices on the court who otherwise fashion themselves as free speech libertarians have lately espoused positions that could exacerbate our problems. Justice Clarence Thomas, for example, has indicated that he would most likely treat social media companies like telephone companies and allow states to pass laws requiring them not to deplatform politicians who violate the companies’ terms of use (as Facebook and Twitter did to Mr. Trump), even those who constantly spread election disinformation and encourage political violence. Justice Thomas and Justice Neil Gorsuch have also signaled an interest in loosening up libel laws, as Mr. Trump has urged, making it harder for legitimate journalists to expose or criticize the actions of politicians.Even if Congress adopted all the changes I have proposed and the Supreme Court upheld them — two quite unlikely propositions — it would hardly be enough to sustain American democracy in the cheap speech era. For example, the First Amendment would surely bar a law that would require social media companies to remove demagogic candidates who undermine election integrity from social media platforms; we would not want a government bureaucrat (under the control of a partisan president) to make such a call. But such speech is among the greatest dangers we face today.That’s why efforts to deal with the costs of cheap speech require political action as well. As consumers and voters, we need to pressure social media companies and other platforms to protect our democracy by taking strong steps, including deplatforming political figures in extreme circumstances, when they consistently undermine election integrity and foment or threaten violence. Twitter’s recent decision to no longer remove false speech about the integrity of the 2020 election is a step in the wrong direction. And if the social media companies are unresponsive to consumer pressure or become too powerful in controlling the political speech environment, the solution is to use antitrust laws to create more competition.Society needs to figure out ways to subsidize real investigative journalism efforts, especially locally, like the excellent journalism of The Texas Tribune and The Nevada Independent, two relatively new news-gathering organizations that depend on donors and a nonprofit model.Journalistic bodies should use accreditation methods to send signals to voters and social media companies about which content is reliable and which is counterfeit. Over time and with a lot of effort, we can reestablish greater faith in real journalism, at least for a significant part of the population.The most important steps to counter cheap speech are the hardest to take. We need to rebuild civil society to strengthen reliable intermediaries and institutions that engage in truth telling. As a starting point, think of all the institutions Mr. Trump tried to undermine: the free press, the opposition party, his own party, the judiciary and the F.B.I., to name just a few. And we need an educational effort — including among older Americans, who are actually the most likely to spread political misinformation — to inculcate the values of truth, respect for science and the rule of law.This is easier said than done. It will require an all-hands-on-deck mobilization and not just the government: civics groups, bar and professional associations, religious institutions, labor unions and businesses all have a role to play.The future of American democracy in the cheap speech era is hardly ensured. We don’t have all the solutions and can’t even foresee political problems that will come with the next technological shift. But legal and political action taken now has the best chance of giving voters the tools to make competent decisions and reject election lies that will continue to spew forth on every platform that can be built to threaten the foundation of our democracy.Richard L.
