    Biden, Congress and the Eroding Separation of Powers

    A curious constitutional drama unfolded in the nation’s capital last week. Having failed to pass a moratorium on evictions, members of Congress took to the steps of the U.S. Capitol to demand that President Biden impose one.For his part, Mr. Biden strode into the White House briefing room and suggested that the prerogative to make policy on the issue lay with Congress.Soon enough, though, Mr. Biden relented, and Democrats celebrated. As policy, it was a progressive victory. Constitutionally, it was both troubling and bizarre.The issue was not simply whether the moratorium was constitutional, though the federal courts have questioned the statutory authority the Centers for Disease Control and Prevention claimed. The underlying constitutional derangement pertained to the way members of Congress and the president were eager to endorse each other’s authority without exercising their own.Democrats might protest that they had no choice but to turn to the White House because Republicans would not support a legislative moratorium. That may be, but the framers would have expected the defense of legislative power to take precedence over a policy dispute.The framers assumed that each branch of government would maintain the separation of powers by jealously guarding its authority from encroachments by the others. The evictions episode was less tug of war than hot potato: Congress wanted the president to use executive authority, and the president wanted the legislature to legislate.Democrats are not the only ones refusing to defend legislative authority. Republicans denigrating the House investigation into the insurrection of Jan. 6 — a physical assault on one branch of government incited by another — are unwilling even to defend the institution bodily.The acid test of separation of powers is whether members of Congress are willing to assert their authority against a president of their own party. Democrats failed that on evictions, just as Republicans did by handing off authority to Donald Trump. Given this bipartisan consensus for presidential authority, it may be time to acknowledge reality: The concept of the separation of powers — which depends on members of Congress unifying to protect legislative power — has collapsed in the United States. We have become a de facto parliamentary system in which competing parties battle for executive power. The problem is that we have acquired all the vices of such a system but none of its virtues.A parliamentary system typically has the effects of discouraging demagogues and ensuring competence, by seasoning leaders on the journey from the backbenches to the ones at the front. By contrast, three presidents who served before Joe Biden — George W. Bush, Barack Obama and Mr. Trump — arrived in the White House as either newcomers or latecomers to national office. Parliamentary systems also feature vigorous debates with real consequences. Governments rise and fall on the basis of their legislative agendas. Debates in Congress are largely stagecraft, with actual governing being relegated to a vast executive branch empowered to turn vague laws into detailed policy.The primary vice of parliamentary systems is their incompatibility with the separation of powers. James Madison felt this separation was so important that the lack of it was “the very definition of tyranny,” even if concentrated powers were exercised benignly. Montesquieu warned that when executive and legislative power are mixed, “there is no liberty, because one can fear that the same monarch or senate that makes tyrannical laws will execute them tyrannically.”The separation of powers should not be romanticized. The only president to rise fully above party was the first one, and George Washington took office before parties solidified. But even after that, the fact that presidents and members of Congress were elected by different means, with different institutional loyalties, still enabled them to curb each other’s abuses.There are almost no curbs now. One might say elections control presidents, but Mr. Trump’s efforts to undo the 2020 presidential contest, which culminated in Jan. 6, showed that check is fragile. In addition, a single official who can marshal the direct power of his or supporters may be particularly dangerous, as Mr. Trump’s incitement leading up to and on Jan. 6 also demonstrated.These are palpable risks today. Between elections, presidents essentially run American government. Republicans and Democrats in Congress play the auxiliary part of either supporting or opposing whoever occupies the White House. Congress generally cedes the initiative on legislation to the executive branch, reserving for itself the role of merely reacting to the president.This obsession with the presidency also crowds out other advantages the separation of powers should provide. Legislators are chosen geographically in the United States, which ought to mean they reflect not only local interests but also the nuances of diverse views about national politics. Instead, many elections at all levels are proxies for national issues that are increasingly seen as civilizational battles. When Americans vote for members of Congress today, they are largely voting for parties that increasingly operate in lock step. In 2020, 16 out of 435 congressional districts voted for different parties for the White House and House of Representatives. That is less than 4 percent of congressional districts, down from as much as 40 percent in the 1970s and 1980s.Also lost in the collapse of geographic representation is Madison’s definition of the representative’s role: to “refine and enlarge the public views.” That presumes both acquaintance with those views and the judgment required to align them with the public’s true interest.Legislative debates now rotate around the president, often because the presidency is seen as an instrument for defending or capturing a legislative majority. That is characteristic of a parliamentary system. But because one is either for or against the president, a system that orbits the White House strips legislators of their ability to exercise independent judgment from issue to issue.If legislative issues are simply symbols of presidential fortunes, we should expect partisan gridlock: Alliances will solidify around the presidency or the majority rather than shifting from issue to issue. Democrats and Republicans may be able to push a president slightly in one direction or another, or block him or her altogether, but the presidency remains the center of attention. The bipartisan infrastructure deal, for example, originated in negotiations not between members of Congress but between them and the White House.Finally, by empowering all three branches of government to check one another, the separation of powers forces the nation to look at issues from different angles: the immediate and parochial perspectives of representatives, the national view of presidents and the constitutional outlook of the courts.The problems with abandoning the separation of powers may be difficult to see if one supports the current president, but it should not take much imagination to contemplate why you wouldn’t like having the bulk of national powers being exercised by a president with whom you disagree. Presidents now sit atop vast administrative apparatuses. They could easily abuse this power, such as by rewarding friends and punishing adversaries. The point for Montesquieu and Madison was not whether they actually did, but whether they could. And the ability to abuse power often leads to the abuse itself.The deliberate adoption of a parliamentary system would still entail these risks. But it might at least have conferred some of that system’s benefits. As it stands — with Congress unwilling to unite against even a physical assault incited by the president — we have maintained the empty shell of the separation of powers around the core of a partisan system. The result is a system capable of abusing citizens but not governing them.     J.D. Vance Converted to Trumpism. Will Ohio Republicans Buy It?

    As the “Hillbilly Elegy” author runs for Senate in Ohio, he has walked back previous criticism of Donald Trump and reversed arguments that the white working class bears responsibility for its problems.Before he was a celebrity supporter of Donald J. Trump’s, J.D. Vance was one of his most celebrated critics.“Hillbilly Elegy,” Mr. Vance’s searing 2016 memoir of growing up poor in Ohio and Kentucky, offered perplexed and alarmed Democrats, and not a few Republicans, an explanation for Mr. Trump’s appeal to an angry core of white, working-class Americans.A conservative author, venture capitalist and graduate of Yale Law School, Mr. Vance presented himself as a teller of hard truths, writing personally about the toll of drugs and violence, a bias against education, and a dependence on welfare. Rather than blaming outsiders, he scolded his community. “There is a lack of agency here — a feeling that you have little control over your life and a willingness to blame everyone but yourself,” he wrote.In interviews, he called Mr. Trump “cultural heroin” and a demagogue leading “the white working class to a very dark place.”Today, as Mr. Vance pursues the Republican nomination for an open Senate seat in Ohio, he has performed a whiplash-inducing conversion to Trumpism, in which he no longer emphasizes that white working-class problems are self-inflicted. Adopting the grievances of the former president, he denounces “elites and the ruling class” for “robbing us blind,” as he said in his announcement speech last month.Now championing the hard-right messages that animate the Make America Great Again base, Mr. Vance has deleted inconvenient tweets, renounced his old views about immigration and trade, and gone from a regular guest on CNN to a regular on “Tucker Carlson,” echoing the Fox News host’s racially charged insults of immigrants as “dirty.”When working-class Americans “dare to complain about the southern border,” Mr. Vance said on Mr. Carlson’s show last month, “or about jobs getting shipped overseas, what do they get called? They get called racists, they get called bigots, xenophobes or idiots.”“I love that,” Mr. Carlson replied.Whether Ohio Republicans do, too, is the big question for Mr. Vance — who will crucially benefit from a $10 million super PAC funded by the tech billionaire Peter Thiel, a Trump supporter who once employed Mr. Vance.His G.O.P. rivals in the state have had a field day. Josh Mandel, a former treasurer of Ohio who is the early front-runner in the five-candidate field, called Mr. Vance a “RINO just like Romney and Liz Cheney,” referring to the Utah senator and the Wyoming congresswoman who voted to impeach Mr. Trump for inciting the Capitol riot.Liberals and some conservatives have also dismissed Mr. Vance for cynical opportunism. One Never Trump conservative, Tom Nichols, wrote of “the moral collapse of J.D. Vance” in The Atlantic.Mr. Vance, a conservative author and venture capitalist, in 2017. He is running in the Republican primary to fill a Senate seat being vacated by Rob Portman.Drew Angerer/Getty ImagesMr. Vance’s adherence to some of the most extreme views of Trump supporters shows how the former president, despite losing the White House and Congress for his party, retains the support of fanatically loyal voters, who echo his resentments and disinformation and force most Republican candidates to bend a knee.Yet Mr. Vance’s flip-flops over policy and over Mr. Trump’s demagogic style may not prove disqualifying with Ohio primary-goers when they vote next spring, according to strategists. Although Mr. Vance’s U-turn might strike some as too convenient in an era when voters quickly sniff out inauthenticity, it is also true that his political arc resembles that of many Republicans who voted grudgingly for Mr. Trump in 2016, but after four years cemented their support. (Mr. Vance has said he voted third-party in 2016.)“Will he be able to overcome his past comments on Trump and square that with the G.O.P. base? Maybe,” said Michael Hartley, a Republican strategist in Ohio who is not working for any of the Senate candidates. He added that Mr. Vance had the lived experience to address policies that lift working-class people “in a way that others cannot.”Mr. Vance, 37, who lives with his wife and two young sons in Cincinnati, has carefully seeded the ground for his candidacy, appearing frequently on podcasts and news shows with far-right influencers of the Trump base, including Steve Bannon and Sebastian Gorka.In interviews, speeches and on social media, he has become a culture warrior. He threatened to make Big Tech “pay” for putting conservatives “in Facebook jail,” and he mocked Gen. Mark A. Milley, the chairman of the Joint Chiefs of Staff, after the four-star general said he sought to understand “white rage” in the wake of the assault on the Capitol.To Mr. Vance, it is a “big lie” that Jan. 6 was “this big insurrection,” he told Mr. Bannon.In “Hillbilly Elegy,” Mr. Vance credited members of the elite with fewer divorces, longer lives and higher church attendance, adding ruefully, “These people are beating us at our own damned game.” But that was not his message at a recent conservative gathering where he blamed a breakdown in the American family on “the childless left.’’Mr. Carlson, Fox’s highest-rated host, all but endorsed Mr. Vance during the candidate’s appearance last month. Mr. Vance also has the backing of Representative Jim Banks of Indiana, a rising conservative leader in the House. And Charlie Kirk, the founder of the right-wing student group Turning Point USA, who has ties to the Trump family, has endorsed the “Hillbilly Elegy” author.“He has been consistent in being able to diagnose the anxieties of Trump’s base economically almost better than anyone else,” Mr. Kirk said in an interview. Although Mr. Vance once mocked Mr. Trump’s position that a southwest border wall would bring back “all of these steel mill jobs,” today he supports the “America First” agenda that reducing legal immigration will increase blue-collar wages, a link that many economists dispute. “Why let in a large number of desperate newcomers when many of our biggest cities look like this?” Mr. Vance said recently on Twitter over a picture of a homeless encampment in Washington.Mr. Vance’s flip-flops over policy and over Mr. Trump’s demagogic style may not prove disqualifying with Ohio primarygoers when they vote next spring.Jeffrey Dean/Associated PressMr. Trump has met with all five major declared Ohio Republican Senate candidates — who are seeking the open seat of the retiring Senator Rob Portman — but has not signaled a preference. He is not likely to do so any time soon, according to a person briefed on his thinking. Among Democrats, Representative Tim Ryan has the field nearly to himself. Ohio, once a battleground state, has trended rightward in the Trump era.Mr. Vance declined to be interviewed for this article. But an examination of his embrace of Trumpism through the ample record of his writings and remarks, as well as interviews with people close to him, show that it happened the way a Hemingway character famously described how he went bankrupt: “Gradually, and then suddenly.”The year 2018 appears to have been the turning point. That January, Mr. Vance considered a Senate bid in Ohio but ultimately decided not to run, citing family matters, after news reports brought to light his earlier hostile criticism of Mr. Trump.Later that year, the furious opposition on the left to the Supreme Court nomination of Brett M. Kavanaugh was a milestone in Mr. Vance’s political shift. Mr. Vance’s wife, Usha, whom he met in law school, had clerked for Justice Kavanaugh. “Trump’s popularity in the Vance household went up substantially during the Kavanaugh fight,” Mr. Vance told a conservative group in 2019.Although Mr. Vance has said that he came to agree with Mr. Trump’s policies on China and immigration, the most important factor in his conversion, he told Mr. Gorka in March, was a “gut” identification with Mr. Trump’s rhetorical war on America’s “elites.”“I was like, ‘Man, you know, when Trump says the elites are fundamentally corrupt, they don’t care about the country that has made them who they are, he was actually telling the truth,’” Mr. Vance said.(His adoption of Trump-style populism did not inhibit him from flying to the Hamptons last month for a fund-raiser with Republican captains of industry, as reported by Politico.)Mr. Vance’s former employer, Peter Thiel, is supporting him with a $10 million super PAC in the Senate race.Doug Mills/The New York TimesFinally, the influence of Mr. Thiel, a founder of PayPal, whom Mr. Vance has called a “mentor to me,” appears to have been decisive in Mr. Vance’s embrace of Trumpism.An outspoken and somewhat rare conservative in Silicon Valley, Mr. Thiel addressed the 2016 Republican convention and advised the Trump transition team. He is a fierce critic of China and global trade and a supporter of restrictionist immigration policies, and Mr. Vance has moved toward all those positions. Mr. Thiel, who did not respond to an interview request, is also paying for a super PAC for another protege, Blake Masters, in a Senate race in Arizona.In March, Mr. Thiel brokered a meeting between Mr. Vance and Mr. Trump at Mar-a-Lago, the former president’s resort in Florida. Mr. Vance made amends for his earlier criticism and asked Mr. Trump to keep an open mind, according to people briefed on the meeting. If Mr. Trump were going to attack Mr. Vance — as he has other Republican 2022 candidates around the country whom he perceives to be disloyal — he probably would have done so already.For now, the former president’s appetite for revenge in Ohio seems to be sated by attacking Representative Anthony Gonzalez, a Republican who voted for impeachment in January. Mr. Trump held a rally in the state in June to back a primary challenger to Mr. Gonzalez. Mr. Vance was on hand, sharing a photo on Twitter to show his support for Mr. Trump. More

    Trump’s Repeating Donation Tactics Led to Millions in Refunds Into 2021

    Donald Trump and the Republican Party returned $12.8 million to donors in the first half of the year, a sign that their aggressive fund-raising tactics ensnared many unwitting contributors.The aggressive fund-raising tactics that former President Donald J. Trump deployed late in last year’s presidential campaign have continued to spur an avalanche of refunds into 2021, with Mr. Trump, the Republican Party and their shared accounts returning $12.8 million to donors in the first six months of the year, newly released federal records show.The refunds were some of the biggest outlays that Mr. Trump made in 2021 as he has built up his $102 million political war chest — and amounted to roughly 20 percent of the $56 million he and his committees raised online so far this year.Trailing in the polls and facing a cash crunch last September, Mr. Trump’s political operation began opting online donors into automatic recurring contributions by prechecking a box on its digital donation forms to take a withdrawal every week. Donors would have to notice the box and uncheck it to opt out of the donation. A second prechecked box took out another donation, known as a “money bomb.”The Trump team then obscured that fact by burying the fine print beneath multiple lines of bold and capitalized text, a New York Times investigation earlier this year found.The maneuver spiked revenues in the short term — allowing Mr. Trump to spend money before the election — and then caused a cascade of fraud complaints to credit cards and demands for refunds from supporters. The refunded donations amounted to an unwitting interest-free loan from Mr. Trump’s supporters in the weeks when he most needed it.New Federal Election Commission records from WinRed, the Republican donation-processing site, show the full scale of the financial impact. All told, more than $135 million was refunded to donors by Mr. Trump, the Republican National Committee and their shared accounts in the 2020 cycle through June 2021 — including roughly $60 million after Election Day.“It’s pretty clear that the Trump campaign was engaging in deceptive tactics,” said Peter Loge, the director of the Project on Ethics in Political Communication at George Washington University. “If you have to return that much money you are doing something either very wrong or very unethical.”The Trump campaign has previously defended its online practices, with Jason Miller, a spokesman, saying that only 0.87 percent of transactions were subjected to formal credit card disputes last year, which would be about 200,000 transactions. Mr. Miller did not respond to questions this week about the Trump refunds.An example of the prechecked recurring donation boxes Mr. Trump used in 2020.Of the refunds issued this year, $8.1 million came from Mr. Trump’s shared account with the R.N.C., the records show. An additional $2.2 million came from his re-election committee and $2.5 million was issued by the party itself. The party stopped operating in tandem with Mr. Trump earlier this year but still owed refunds from 2020; most of its returned donations came in January and February.The Times investigation had previously found that the Trump operation along with the party had refunded more than 10 percent of the $1.2 billion it had raised online through the end of 2020. President Biden’s equivalent committees refunded 2.2 percent of what had been raised online last year on ActBlue, the Democratic donation-processing site, records show.The Federal Election Commission has since unanimously recommended that Congress prohibit campaigns from prechecking boxes for recurring donations, and legislation to do so has been introduced in both the House and Senate. The state attorneys general in New York, Connecticut, Minnesota and Maryland have also opened investigations into WinRed and ActBlue’s practices.WinRed has sued in federal court to stop the investigation by saying that federal law pre-empts any state investigation. Last week, the attorneys general sought to dismiss the WinRed suit, arguing in a court filing that consumer-protection laws gave them jurisdiction.The prechecked recurring box has become increasingly widespread among Republicans using WinRed, including burying the disclosure under extraneous text; Democrats have moved to stop using such boxes entirely.The two Republican senators who lost the January runoffs in Georgia, Kelly Loeffler and David Perdue, used prechecked boxes to lead donors into weekly withdrawals, resulting in a rash of refunds. Ms. Loeffler and Mr. Perdue combined to refund $10.4 million from Nov. 24 through the end of June 2021 — out of a total of $68.5 million raised online during that time.The Democrats who defeated them, Senators Jon Ossoff and Raphael Warnock, raised tens of millions of dollars more online — and refunded less than one-fifth as much, around $2 million, during the same period.Overall, WinRed issued refunds that totaled 12.7 percent of what it raised the first six months of the year; ActBlue’s refunds were 3.3 percent of what it collected.The disparity was even more stark in January of this year, when refunds were surging for Mr. Trump and Georgia Senate Republicans. That month, refunds issued by WinRed equaled nearly 28 percent of what the platform collected in contributions, records show. There was even one day when WinRed issued more in refunds than it reported receiving in contributions.WinRed said there was simply a greater volume of refunds immediately after elections, and noted that refunds had slowed in recent months. In the first quarter of 2021, records show that refunds issued on WinRed equaled nearly 20 percent of what was raised; that figured dipped to 5.7 percent in the second quarter.Mr. Trump’s new political action committee, Save America, continues to precheck its “money bomb” and recurring donation box, taking out fresh donations monthly. In addition to the $12.8 million refunded by Mr. Trump’s 2020 re-election campaign and party committees tied to it, his new PAC issued nearly $800,000 in refunds in the first six months of the year, 3.75 percent of what it raised.ActBlue, which previously allowed campaigns wide latitude to opt donors into repeating contributions, has clamped down on the tactic. In July, the site implemented new rules essentially forbidding political candidates and groups from prechecking a recurring box unless the link to the donation page explicitly says there will be repeating withdrawals.Digital experts said that many donors do not notice the extra contributions for many months, if at all. Some decide pursuing refunds is too onerous or complex. Older contributors are seen as especially vulnerable to such aggressive digital tactics, campaign strategists say.For Republicans, prechecking is something some strategists defend as a useful tool to shrink the traditional Democratic advantage of online fund-raising.The three main Republican Party committees — one devoted to the House, one to the Senate and the R.N.C. — nearly matched the parallel Democratic groups in online fund-raising, collecting $68.8 million compared with $70.8 million for the Democrats in the first six months of 2021.At the same time, those Republican Party groups issued more than $5 million in additional WinRed refunds compared with the Democratic groups — 11.2 percent of what they raised online compared with 3.7 percent, records show.Rachel Shorey More

    Don’t Be Fooled By Mitch McConnell’s Sudden Bout of Bipartisanship

    Are we entering a new era of bipartisanship? On the surface, the news from Washington seems remarkably encouraging. The Senate is close to passing a $1 trillion bipartisan infrastructure bill, with $550 billion in new spending on everything from transit to highways to broadband to climate change mitigation. Political insiders are hailing the bill as a breakthrough, with the Senate poised, at last, to overcome the partisan gridlock that has ground its legislative machinery to a halt. Many thought that President Biden’s belief that he could get Republican votes was naïve, but he delivered. In a surprise, even the Senate minority leader, Mitch McConnell, voted to move the compromise to a vote.Of course, this is the same Mitch McConnell who said of Mr. Biden, “100 percent of our focus is on stopping this new administration.” The same Mr. McConnell who made sure Donald Trump’s impeachment did not result in conviction, who filibustered the bipartisan plan for a commission to investigate the Jan. 6 violent insurrection until it died, who kept all of his Republican senators in line against the American Rescue Plan early in the Biden presidency. And the same Mr. McConnell who said that he would not confirm a Biden nominee to the Supreme Court if Republicans recaptured the Senate in 2022.So why the reversal on infrastructure? Why dare the brickbats of Donald Trump after the former president bashed the effort and tried to kill it? Mr. McConnell has one overriding goal: regaining a majority in the Senate in 2022. Republicans must defend 20 of the 34 Senate seats up for grabs next year; there are open seats in Ohio, Pennsylvania and North Carolina; and Senator Ron Johnson, if he runs again, could easily lose his seat in Wisconsin. Attempting to block a popular infrastructure bill that later gets enacted by Democrats alone would give them all the credit. Republicans would be left with the lame defense of crowing about projects they had voted against and tried to block, something that did not work at all with the popular American Rescue Plan.You don’t have to be a Machiavellian to understand another reason Mr. McConnell was willing to hand Mr. Biden a victory on infrastructure: By looking reasonable on this popular plan, claiming a mantle of the kind of bipartisanship that pleases Democrats like Joe Manchin and Kyrsten Sinema and that mollifies suburban moderate Republicans in key states, Mr. McConnell can more easily rally his troops behind their goal of obstruction and delay for every other important Democratic priority, including the blockbuster reconciliation bill, as well as voting rights and election reform.For Mr. Biden, this bill is a political victory; the fact that he worked across party lines distinguishes him from his Republican predecessor, which should give the president a powerful appeal among independents and moderate Republicans. But for congressional Democrats, despite the true achievement of persuading 10 Republicans to sign on to an ambitious infrastructure plan, the road ahead is bumpy, winding and complicated.If this bill is signed into law, the Democrats will still need to face hard reality: This will be their last major bipartisan piece of legislation.Of course, there may be other issues below the partisan radar, like criminal justice reform and mental health reform, that can secure significant Republican support. But thanks to Mr. McConnell, everything else will face a wall of obstruction. Since the midterms will take all the focus off policymaking in Congress, the Democrats need to achieve democracy reforms and move on with the rest of their agenda using reconciliation. (The Senate majority leader, Chuck Schumer, will also be navigating another confrontation over the debt ceiling, but he might be able to include eliminating the ceiling within reconciliation, taking it off the table as a hostage once and for all.)The two key words are discipline and filibuster. Overcoming Mr. McConnell’s obstruction will require all 50 Senate Democrats to stick together, to swallow hard with necessary compromises — and of course, the same is true for House Democrats, who cannot afford to lose the votes of even four of their members. To achieve anything else will require a change in the Senate rules. It does not have to be elimination of the filibuster, or what Senator Manchin would define as a “weakening” of the rule. It will require a way to put the burden on Mr. McConnell and the minority instead of where it is now, entirely on Mr. Schumer and the majority.Norman J.     Biden’s Honeymoon Is Over, and He Knows It

    The first seven months of the Biden presidency have been easy compared with what’s coming down the pike.Key provisions of Covid relief legislation came to an end on Aug. 1, with more set to follow — including a cessation of moratoriums on evictions and mortgage foreclosures, termination of extended unemployment benefits (which carried $300-a-week supplemental payments) and a stop to enhanced food stamp subsidies and student loan forbearance.The prospect of millions of families forced from their homes as Covid variants infect growing numbers of people provoked frenzied attempts by the White House and congressional Democrats to take emergency steps to halt or ameliorate the potential chaos and a possible tragedy of national proportions.On Tuesday, the Centers for Disease Control and Prevention ordered a 60-day freeze on evictions — although the order faces possible rejection by the courts.“Any call for a moratorium, based on the Supreme Court’s recent decision, is likely to face obstacles,” Biden told reporters, adding that the “bulk of the constitutional scholarship says that it’s not likely to pass constitutional muster.”In a June report, the Census Bureau found that 1,401,801 people 18 and older living in rental housing were “very likely” to be evicted and 2,248,120 were “somewhat likely.” In addition, 345,556 people were “very likely” to lose their homes through mortgage foreclosure, and 746,030 were “somewhat likely” to face foreclosure and the loss of their homes. The combined total was 4.7 million adults.The eviction crisis has come at a time when an additional series of potentially damaging developments have come to the fore.The rate of inflation has been rising at its fastest pace in over a decade — to 5.4 percent in June, from 1.4 percent in January when Biden took office, with no end in sight. The number of homicides grew by 25 percent from 2019 to 2020, and the 2021 rate, 6.2 homicides per 100,000 residents, is on track to become, according to The Washington Post, “the highest recorded in the United States in more than 20 years.”The number of illegal border crossings has more than doubled during Biden’s seven months in office, raising the potential for immigration to become a central campaign issue once again, both next year and in 2024.U.S. Customs and Border Protection reported that in June of this year the enforcement agency “encountered 188,829 persons attempting entry along the Southwest Border,” a 142 percent increase from the 78,000 in January 2021 when Biden assumed the presidency.As the 2022 and 2024 elections get closer, Biden is in a race to keep public attention on policies and initiatives favorable to the Democratic Party and its candidates against the continuing threat that inflation, crime, urban disorder and illegal immigration — all issues that favor the Republican Party — take center stage.The danger for Biden if crime and immigration become a primary focus of public attention is clear in polling data. The RealClearPolitics average of the eight most recent polls shows Biden’s favorability at plus 7.5 points (51.1 positive and 43.6 negative) and that the public generally approves of his handling of the Covid pandemic, of jobs, of the economy and of the environment.Regarding Biden’s handling of crime and immigration, however, the numbers go negative. In the July 17-20 Economist/YouGov Poll, 38 percent of voters approved of his handling of crime, and 45 percent disapproved. In the Economist/YouGov poll taken a week later, Biden’s numbers on immigration were worse: 35 approving, 50 disapproving.The Biden administration has initiated a set of programs designed to “stem the flow of guns into the hands of those responsible for violence” — the centerpiece of its anti-crime program — but the Economist/YouGov poll found in its July 24-27 survey that 30 percent of voters approve of Biden’s handling of gun issues while 48 percent disapproveWhat does this all portend? Bruce Cain, a political scientist at Stanford, replied by email to my inquiry:The Biden administration has done a good job so far avoiding hard-to-defend, controversial positions on Republican hot button issues. That is really all they need to do. It is more likely that Covid and economic conditions will matter more in determining the Democratic Party’s fate in November.Cain argues thatthe best defense for the Democrats is to go on the offense in 2022 and remind voters about who Trump is and what the Republican Party has become. The resistance to supporting vaccination among Trumpist Republican officials could hurt the party’s national image substantially in 2022 if the unvaccinated are to blame for our inability to put this issue behind us.Sean Westwood, a political scientist at Dartmouth, has a very different take. In an email he wrote:The Democrats have lost a great deal of credibility when it comes to crime and policing by thoughtlessly adopting slogans like ‘defund the police’ without considering what the phrase means, how policies based on the idea might lead to surges in crime, or how the slogan might backfire in the face of rising crime and lawlessness.Biden, Westwood continued,was smart to distance himself from these factions, but many of those he needs in Congress and in state houses have been much less careful. Without a serious repositioning on criminal justice policies, the Democrats face the midterms with a gaping self-inflicted wound.Biden received a lift last week in keeping a bread-and-butter agenda front and center from an unexpected source, Mitch McConnell, the Senate minority leader. McConnell abandoned his Dr. No stance toward all things Democratic and joined 16 fellow Republicans in support of a key motion to take up a $1 trillion infrastructure spending bill. If enacted into law, the measure would legitimize Biden’s claim that he is capable of restoring a semblance of bipartisanship in the nation’s capital.McConnell has not fully explained his political reasoning, but his tactical shift suggests that he thinks the wind remains at Biden’s back, making the Republican strategy of destruction a much riskier proposition, at least for the moment.Early indicators suggest that in some ways Biden has yet to face the kind of voter opposition that characterized the administrations of his predecessors from both parties at this stage in their presidencies.Matt Grossmann, a political scientist at Michigan State, tweeted on Aug. 2:Still no sign of strong grassroots or conservative media opposition focused on Biden or congressional agenda At this point in Obama admin, it was clear August congressional recess would be full of boisterous town halls. Infrastructure doesn’t get base animated.Similarly, G. Elliott Morris, a data journalist for The Economist, wrote on Aug. 1 that there is a long-term “trend by which the people react in a thermostatic manner against the party in power,” with the public mood shifting to the right during Democratic presidencies and to the left during Republican presidencies.So far during the Biden presidency, Morris wrote, the expected tilt toward conservatism has not materialized:Where we go from here is a big question. As stated, the thermostatic model would predict a reversion in 2021 in the conservative direction. But the issue remains open; the public has not appeared very thermostatic on, say, immigration policy over the last year, and their demand for public spending is still very high.The trickiest issues facing the Biden administration are crime and urban disorder because these are issues that play to the advantage of conservatives, who have demonstrated expertise in weaponizing them.The June 29-July 6 USA Today/Ipsos poll found that “concerns about crime and gun violence have surged to the top of issues that worry Americans” and, in an ominous note for the Biden administration,Crime and public safety is the issue on which the Republican Party now holds its strongest advantage. By 32 percent to 24 percent, those polled said the G.O.P. was better at handling crime.There is considerable disagreement over the optimal strategy for Democrats to adopt when addressing crime — along with widespread concern over the party’s credibility on the issue itself.Rebecca Goldstein, a law professor at the University of California, Berkeley, emailed to say that she believes “the Biden Administration has correctly read the political winds by doubling the amount they are requesting for police hiring grants in 2022 compared to the 2021 appropriation, and also requesting eight-figure sums for police training and body-worn cameras.”These initiatives, Goldstein continued, are “not the outcome that any of last summer’s activists would have wanted. But the Biden Administration has realized that some of those proposals, particularly defunding or abolishing police agencies, were politically dead on arrival.”The crucial question, in Goldstein’s view, iswhether the administration will be able to convincingly advertise its support for police, and for police oversight and reform, while neither alienating some of the activists who mobilized to help Biden win in 2020 and might be put off from putting in the same sweat equity in 2022 or 2024, nor succumbing to the longstanding critique from the right that Democrats are “soft on crime.” This is a tightrope that even the most skilled politician might not be able to walk.Stanley Feldman, a political scientist at Stony Brook University, argued in an email that trying to engage voters on crime and other issues that have worked to the advantage of the Republican Party in the past is a fool’s errand:The Democratic Party has been losing voters who want economic benefits from the federal government but who are supporting Republican candidates because of their conservative positions on social and cultural issues. Biden can’t win back voters by engaging on these issues. Any positions he takes will raise the salience of these issues and that’s not helpful for him.Crime and policing, Feldman noted,are largely local concerns. Immigration is a potential minefield so the best he can do is to try to keep it from becoming a major media story. Given his limited options, any attempt to address these concerns would just give Republicans an opportunity to portray him in an unfavorable light. Providing concrete economic benefits to people while reducing the volume on social/cultural issues is the best way forward in 2022 and 2024.Aaron Chalfin, a professor of criminology at the University of Pennsylvania, agrees that engaging the debate over crime is inherently risky for Democrats:In my view, the political liabilities for the Democrats are probably fairly substantial. The surge in violence is rapid and has reversed 20 years of progress in just 18 short months. While I think the cause of the violence has little to do with Democratic political priorities at the national level, it seems likely that the Democrats will be held to account given the rhetoric around “Defund” that is associated with the left wing of the party.Lawrence Sherman, director of the Cambridge Center for Evidence-Based Policing at the University of Cambridge, agrees that “the greatest threat to Biden on policing and disorder comes from the left,” but he differs from some of his colleagues in arguing that Biden should take the issues of crime and urban dysfunction head on.Sherman contends that public anxieties over crime are just one part of a larger, more comprehensive “fear of chaos.” In that more expansive context, Sherman continued, Biden has strengthened his credentials as an adversary of disorder through his workon Covid and the economy, for which his competence grows more impressive daily in comparison to Trump’s. Climate change will also become a bigger issue (favoring Biden) for the swing vote, with smoke, heat and floods proving more scary than an unprecedented spike in murders. In a politics of fear, the targets of fear become identified with different candidates, and Biden’s fears now seem paramount: Covid, Climate and Chaos.Trump’s actions leading up to and during the Jan. 6 assault on the Capitol by Trump loyalists seeking to disrupt the vote count have opened the door for Biden to take the initiative on law and order and, in doing so, to counter the image of the Democratic Party as soft on crime, Sherman argued:“After what Trump did on Jan. 6, Biden has been able to stress his own historic support for the police as emblematic of his opposition to chaos,” Sherman wrote in an email:The “defund the police” movement probably did help to lose Dem seats in the House in 2020, and may increasingly be blamed for the huge spike in violent crime. But as long as Biden remains strong in his position that policing “works” to prevent crime, and that it is essential to saving Black lives, he will attract the suburban swing vote.Biden should take the initiative, Sherman argues, with “a major policing initiative,” and that initiative should stress “hot spots policing,” the focusing of police resources on small sections of urban areas, “under 5 percent of land in most cities,” while “pulling way back on stop and frisk everywhere else, especially suburban traffic stops, like the late Sandra Bland.”Biden goes into battle with one crucial advantage: He, his appointees and his advisers have more experience in the trenches of elections, legislative fights and bureaucratic maneuvering than the top personnel of any recent administration.On the other hand, if what his voters need is equality — that is, resource redistribution — experienced advisers may not be enough.Mart Trasberg and Hector Bahamonde, of Wake Forest University and the Universidad de O’Higgins in Chile, authors of “Inclusive institutions, unequal outcomes: Democracy, state capacity, and income inequality,” pointed out in an email that redistribution is exceptionally hard to achieve in an advanced democracy like the one in operation in the United States:The increase in inequality through market processes puts pressure on fiscal policy, making it difficult to increase redistribution via taxes and transfers. With increasing foreign investment flows and more developed financial sectors, domestic and international corporate and financial elites become stronger actors in domestic politics. Given that these changes are slow-moving and incremental, disorganized voters are not able to vote for a higher taxation of income-concentrating elites. Of course, other mechanisms are likely at play: political elites trick voters to vote on identity issues that do not concern socio-economic redistribution.In the end, much of the dynamism that powers today’s political competition comes back to — or down to — racial and cultural conflict. Can Biden find a redistributive workaround — and protect voting rights at the same time?     Democratic Insider and a Republican Backed by Trump Win Ohio House Races

    The victories by Shontel Brown, a Democrat supported by the national establishment, and Mike Carey, a Republican endorsed by Donald Trump, provided a lift to the leadership of both parties.A Democratic candidate backed by the party establishment and a Republican endorsed by former President Donald J. Trump won two primary races for open House seats in Ohio on Tuesday, an assertion of dominance for the leadership of both political parties as they face questions over unity in their ranks.In a Democratic primary in northern Ohio, Shontel Brown, who vowed to be “a partner” with the Biden administration and Speaker Nancy Pelosi, prevailed over Nina Turner, a party outsider who openly rejected the idea that Democrats are more effective through conciliation and compromise. Late Tuesday, Ms. Brown was leading by over five percentage points, and Ms. Turner conceded the race. And in a Republican primary near Columbus, Mike Carey, a newcomer to elected office who was largely unknown before being endorsed by Mr. Trump, easily beat out 11 rivals, many of them with much longer records in Ohio politics.Between the two races, the Democratic fight for the deep-blue 11th District around Cleveland and Akron was the most closely watched as a national bellwether. Prominent Democratic politicians and money from national interest groups cascaded into the district over the past several weeks, leaving a trail of ill will and weariness in their wake. Though Ms. Turner was helped on the ground by hundreds of organizers and volunteers from left-leaning organizations and outspent Ms. Brown in the early phase of the race, it was not enough in the end to overcome the onslaught of advertising against her, or the unified wall of resistance to her candidacy from pillars of the Democratic establishment.“I am going to work hard to ensure that something like this never happens to a progressive candidate again,” Ms. Turner said in her concession speech. “We didn’t lose this race. Evil money manipulated and maligned this election.” Ms. Brown, 45, a county Democratic Party chair, was endorsed by an array of local, state and federal officials who prided themselves on their ties to leadership in Washington. That coalition rallied against Ms. Turner, an unapologetically sharp-tongued progressive activist and former state senator who campaigned as a disrupter of the political status quo.Nina Turner was backed by several progressives in Congress, including Senator Bernie Sanders and Representative Alexandria Ocasio-Cortez.Maddie McGarvey for The New York TimesThe race was not as much emblematic of a liberal-moderate divide among Democrats as it was a clash between an insider who rose fast in local party circles and an agitator who thrived on alienating party leaders by questioning their commitment to liberal ideals. Both candidates were solidly liberal in their views on a range of issues, including legalizing marijuana and making college more affordable or free in some cases. Outside political groups from different corners of the Democratic coalition invested heavily in the race. Backing Ms. Turner were left-wing environmental interests supporting the Green New Deal; the political group founded by Senator Bernie Sanders that she once ran, Our Revolution; and two progressive groups, the Working Families Party and Justice Democrats.Supporting Ms. Brown were more institutional players and politicians like the political committee of the Congressional Black Caucus; several senior members of the caucus; Representative James E. Clyburn of South Carolina, the Democratic House whip; Hillary Clinton; Jewish Democrats; Cleveland-area Black churches; and, unofficially, Marcia Fudge, who vacated the seat this year to become Mr. Biden’s secretary of housing and urban development and consented to have her mother appear in an ad endorsing Ms. Brown because she had to remain neutral as a government official.Democratic leaders in Washington and groups that are often at odds with the progressive left were worried that a victory by Ms. Turner, who led by double digits in early polls and initially raised more money than Ms. Brown, could presage a new round of intraparty hostilities for Democrats.And the establishment hit back hard — to a degree it had not in previous battles when candidates with the support of the party’s activist left, like Representatives Alexandria Ocasio-Cortez and Jamaal Bowman of New York, took out veteran politicians with little pushback. This time, while Ms. Ocasio-Cortez and other stars of the left campaigned in Ohio for Ms. Turner, prominent members of the Congressional Black Caucus like Mr. Clyburn visited the district and implored people to vote for Ms. Brown as someone who was respectful and willing to work with other Democrats — an implicit criticism of Ms. Turner’s more confrontational style. Many criticized her openly, like Representative Bennie Thompson of Mississippi, who referred to Ms. Turner as “a single solitary know-it-all.”Advertising attacking Ms. Turner’s professionalism and character was ubiquitous in the district during the final days of the campaign. One ad from the centrist group Third Way compared Ms. Turner’s political style and tone to Mr. Trump’s, and replayed an on-camera moment she has struggled to live down throughout the campaign in which she made a crude analogy to the choice between Mr. Biden, whom she did not support, and Mr. Trump.Matt Bennett, an executive vice president at Third Way, said Ms. Brown’s victory represented a resounding defeat of “the candidate ordained by the far left” by everyday Democrats.“These voters went overwhelmingly for Joe Biden in the 2020 primary, and they want their member of Congress to work with him and Speaker Pelosi on a mainstream Democratic agenda. They are not interested in bomb-throwers,” Mr. Bennett added.Ms. Turner’s allies did not read much into her defeat as a sign that the progressive movement was struggling to connect with voters. Joseph Geevarghese, the executive director of Our Revolution, which sent hundreds of volunteers into the district, said progressives needed to “invest more in building the organizing infrastructure we need to reach every voter.” “I think there’s more people who are aligned with our values,” he added, “and the question is organizing and motivating them to turn out.”Mike Carey, an energy lobbyist, campaigning in Grove City, Ohio, last month. Late Tuesday, Mr. Carey was leading his nearest opponents by more than 20 percentage points.Mr. Trump’s credibility as the gatekeeper for the Republican Party had been dented somewhat after the candidate he endorsed in a special House election in Texas lost last week. In that race, a state representative, Jake Ellzey, beat Susan Wright, the widow of the former congressman who held the seat until he died in February after battling lung cancer and being hospitalized for Covid-19. “Great Republican win for Mike Carey,” Mr. Trump said in a statement on Tuesday night. “Big numbers! Thank you to Ohio and all of our wonderful American patriots.”Last week, the pro-Trump group Make America Great Again Action made a last-minute purchase of nearly $350,000 in text messages, digital ads and television commercials in support of Mr. Carey. Throughout the race, Mr. Carey pointed to a singular selling point as he campaigned: the Trump seal of approval. More

    Just Because Trump Is Ridiculous, It Doesn’t Mean He Isn’t Dangerous

    It may well be that “real” authoritarians don’t actually lose elections. But at this point in time, we can safely say that there’s no question that Donald Trump was determined to overturn the 2020 presidential election and end American constitutional government in order to stay in office.According to my colleague Katie Benner, reporting for The Times, Trump repeatedly pressured the Justice Department to “just say the election was corrupt” and “leave the rest to me” so that “he and his allies in Congress could use the assertion to try to overturn the results,” as indicated in notes taken by Richard Donoghue, who was then the acting deputy attorney general.As with the entire effort to overturn the results of the election, Trump’s behavior was as clumsy as it was in earnest. He truly wanted the Justice Department to give him a pretext for some kind of (presumably drastic) action, but the most he could do in pursuit of this goal was to complain to top officials on the phone. “The conversations often included complaints about unfounded voter fraud conspiracy theories,” Benner notes, “and admonishments that department leaders had failed to fight hard enough for Mr. Trump, the officials said.”But a haphazard attempt is still an attempt. That Trump is an absurd figure does not mean we should treat his drives and desires as unthreatening. This was true when he was in office, and it is true now, while he is still trying to “stop the steal.”The plot that began the night of the election when Trump demanded that the states stop counting ballots — “We want all voting to stop” — has not actually come to an end. It is continuing, pushed forward by the former president and his allies in and out of government. And the current narrative behind the plot — that Trump is the rightful president, that Biden stole the election and that the Jan. 6 insurrection was a righteous rebellion against Democratic fraud and subversion — has all but migrated into the Republican Party mainstream.For a clear picture of the former president’s influence on the Republican Party, look no further than the effort to investigate the attack on the Capitol. Republican leaders in the House and Senate opposed and then killed a bipartisan Sept. 11-style commission to study the events of Jan. 6, on the grounds that it would be a “purely political exercise,” as Mitch McConnell, the Senate minority leader, put it.When, in response, House Democrats announced a select committee to investigate the attack (under the direct control of Speaker Nancy Pelosi), House Republican leaders were furious. “This select committee is likely to pursue a partisan agenda to politicize the Jan. 6 attack instead of conducting a good faith investigative effort into the actions leading up to and the security failures of the 6th,” Steve Scalise, the House minority whip, said.Kevin McCarthy, the House minority leader, was given a chance to appoint Republican representatives to the select committee. He chose members known for their total devotion to Trump, like Representatives Jim Jordan of Ohio and Jim Banks of Indiana, who both refused to certify the election results in January and signed a brief to the Supreme Court asking the justices to overturn the presidential results. Pelosi removed Jordan and Banks from the commission, bringing on another round of outrage and partisan blowback.In short, Republican leaders have refused to commit to an actual investigation of the storming of the Capitol. The reason is simple: Trump has made cooperation grounds for expulsion from the party. The virtual pariah status of Representatives Liz Cheney and Adam Kinzinger — the two Republican members Pelosi named to the commission — is proof enough.But events in Washington are not the only evidence of how Trump’s obsessions have become the obsessions of much of the Republican Party. Republican voters themselves are all-in on the former president’s message. Fifty-three percent of Republicans view Trump as the true president, according to a Reuters/Ipsos poll conducted in May, and about half of Republicans believe the Capitol attack was the work of left-wing activists “trying to make Trump look bad,” according to a Reuters/Ipsos poll in March.At the state level, Republican lawmakers and conservative activists are fighting to engineer a pretext for “stop the steal” ahead of the 2022 and 2024 elections. In Arizona, this has taken the form of an “audit” of the 2020 vote organized by the state Republican Party.It would be easy to dismiss the Arizona audit as a joke, a parade of clownish incompetence not unlike the efforts of Trump in the aftermath of the election. According to The Associated Press, the company hired to conduct the audit had no prior experience with elections, broke rules for handling ballots and took nearly twice the allotted time to complete the process.What’s more, its owner has supported the former president’s efforts to spread false conspiracy theories about the election. Trump, for his part, has endorsed the audit, praising its organizers in a speech in Arizona last week. “We’re gathered here in Phoenix to show our support for election integrity and for the brave and unyielding conservative warriors in the Arizona State Senate,” he said.The audit has encouraged other Republicans in other 2020 battleground states to attempt similar shenanigans, part of a national strategy to delegitimize last year’s election results. As Jane Mayer recently described in great detail in The New Yorker, there is a network of conservative groups spending millions to promote “election integrity” and bolster Republican efforts to change state election laws.It is not hard to see the endgame here, especially if Trump makes another bid for the White House after capturing the Republican nomination for a third time. Not an after-the-fact fight to “stop the steal,” but a pre-emptive attempt to make sure the election can’t be “stolen” — that is, won — by his opponent.The American political system is barreling toward another crisis. Of course there’s no guarantee that the crisis will happen. But the current complacency coming from much of the political establishment does not leave one confident that we’ll avoid it.The Times is committed to publishing a diversity of letters to the editor.
