    How Democrats Want to Put Republicans on the Defensive on Abortion

    While conservatives control the courts and key states, the public tends to lean in favor of abortion rights. Democratic leaders are trying to translate that sentiment into victories for the party.In politics, sometimes you need to lose in order to win.Wednesday’s planned vote on the Women’s Health Protection Act, Senate Democrats’ bill to codify Roe v. Wade, will fail. Democrats are unlikely to persuade any Republicans to cross party lines, and Senator Joe Manchin, Democrat of West Virginia, also opposes abortion, in keeping with the politics of a state Donald Trump won by 39 percentage points in 2020.So why is Senator Chuck Schumer, the majority leader, holding a doomed vote?It’s what’s known in Washington as a “message vote” or a “show vote.” My colleague Annie Karni puts it plainly in her piece today: The move is meant to force Republicans to take a vote that could hurt them in November. Now that the Supreme Court appears poised to overturn Roe, Democrats believe there’s a political opportunity.Which, of course, there is. Democrats are hoping to anchor Republicans to an impending court decision that is well outside the American mainstream.They plan to spend the rest of the campaign season telling voters that if they want to protect the right to abortion — let alone contraception and same-sex marriage — they should expand Democrats’ Senate majority. It’s an argument they believe will appeal to suburban college-educated women, a key swing demographic, among others.Until the leak of the draft opinion on Roe, Democratic strategists I’d spoken with in private had been skeptical that abortion would move many voters in November. That’s changing rapidly.In the Virginia governor’s race last year, for instance, Glenn Youngkin, the eventual Republican winner, appeared to pay no price for his views on reproductive rights even though Terry McAuliffe’s campaign spent several million dollars on abortion-themed television ads. Back then, many voters just didn’t believe that Republicans would really ban abortion.At one point, McAuliffe even said he would encourage companies to move their operations to Virginia to escape restrictive abortion laws in states like Texas, a move that caused Youngkin’s campaign to consider running ads condemning those comments.“Youngkin’s abortion quotes would lose him that election if it were held today, I think,” said Brian Stryker, a Democratic pollster who worked on the Virginia governor’s race. “The court changed all that by making this issue way more real to people.”Of course, how Democrats try to seize the advantage will matter. They can’t just call this vote on Wednesday, pump out some press releases and expect to carry the day. But the answers depend heavily on how the questions are worded. The public often shows conflicting impulses: Americans approve of Roe by large margins, but also approve of restrictions that seem to conflict with it.From Opinion: A Challenge to Roe v. I have a moral obligation to stand up for the rights of the women of the state I represent.A Pew Research Center poll taken before the Roe leak is instructive. It found that 19 percent of adults said abortion should always be legal. Just 8 percent said it should always be illegal, with no exceptions. Most Americans are somewhere in between those two poles, though a healthy national majority of about 60 percent say it should be legal in most cases.Republicans would like to force Democrats into that 19 percent corner. Democrats would like to push Republicans into that 8 percent cul-de-sac. And so would each side’s activist community, even though voters tend to see the issue in shades of gray.“Voters are not looking for a change in the status quo on either side,” said Molly Murphy, a Democratic pollster who advises House and Senate candidates. But, she added, the nuances in the polls reflect the fact that voters struggle to decide when, and under what circumstances, it is appropriate to end a pregnancy.What is making the abortion issue especially potent now that Roe is likely to be overturned, Murphy said, is that “Republicans now need to defend where their line is.”Regional distinctions are also important. When you break down public opinion on abortion by state, as Nate Cohn recently did, you find large differences between culturally liberal states like Nevada and New Hampshire, where more than 60 percent of the public says abortion should be mostly legal, and culturally middle-of-the-road Georgia, where that number shrinks to 49 percent.Where Democrats are on firmer groundAnother way to gauge the politics of an issue is to ask: Who wants to talk about it, and who doesn’t?Abortion rights seem like a clear political winner for Senator Maggie Hassan of New Hampshire, a Democrat who is defending her seat against several little-known Republican challengers. Hassan did seven interviews the day after Politico published the Roe leak.The favorite candidate of the state’s G.O.P. establishment is Chuck Morse, a state senator who describes himself as “pro-life.” Morse pushed a ban on late-term abortions last year that did not include exceptions for rape or incest. It also required all women to take an ultrasound exam before terminating a pregnancy.Morse issued a statement last week highlighting his role in passing legislation that “settled the law in New Hampshire that permits abortions in the first six months.” Through a spokesman, his campaign has said it prefers to talk about the economy, inflation and immigration.Awkwardness for RepublicansIn other key Senate contests, Republican candidates are scrambling to defend or explain their past comments.In a statement last week, Adam Laxalt, the likely Republican challenger to Senator Catherine Cortez Masto, Democrat of Nevada, praised the draft ruling but noted that abortion is already legal in Nevada, “so no matter the court’s ultimate decision on Roe, it is currently settled law in our state.”“He can’t play it both ways. He’s already come out and said he would overturn it,” Cortez Masto said in a brief interview. “He’s already said it was a ‘historic victory.’”In Ohio, J.D. Vance, the G.O.P. nominee, has said that women should bring pregnancies to term “even though the circumstances of that child’s birth are somehow inconvenient or a problem to the society,” referring to rape and incest. Vance does, however, support exceptions to spare the life of the pregnant woman.Blake Masters, a Republican candidate for Senate in Arizona, has said that Griswold v. Connecticut, the 1965 Supreme Court case that barred state bans on contraception and established the federal right to privacy, was “wrongly decided.”Masters clarified in a statement that he did not support “any ban on contraception, and that extends to I.U.D.s,” or intrauterine devices, which some abortion opponents view as abortifacients.For both sides, precision mattersRepublicans would much rather talk about late-term abortions, even though nearly nine in 10 abortions take place within the first 12 weeks of a pregnancy.An interview this month on Fox News with Representative Tim Ryan, Vance’s Democratic opponent in Ohio, offered a telling example of how this could play out.Pressed twice by the Fox host on whether he supported any limits to abortion, Ryan gave an answer that was faithful to standard Democratic talking points.The State of Roe v.     How Chuck Schumer Avoided a Primary Challenge From the Left

    Despite months of speculation, no prominent progressive has so far come forward to challenge the Democratic majority leader, who has worked hard to shore up his left flank.Democrats were floundering, and Senator Chuck Schumer had a lot on his plate.His party couldn’t pass its legislative agenda, it had just suffered major electoral losses, and he had a long list of Biden administration nominees to shepherd through.But despite his busy schedule, Schumer, the majority leader and a Democrat who embodies the party establishment, still took the time for a warm gesture to his native New York’s strong progressive left. Appearing live via video, he showed up at an inauguration celebration in December for the New York City Council’s most prominent incoming left-wing member, Tiffany Cabán, who took the oath of office with the help of Representative Alexandria Ocasio-Cortez.Schumer’s attendance was in some ways just another stop on his always-packed New York itinerary. But the moment also vividly illustrated why — barring some extraordinary development — Schumer has attracted no serious left-wing challenger to his Senate re-election bid as Thursday’s primary filing deadline arrives, despite months of speculation about who might emerge.“He’s been really relational,” said Cabán, who is a favorite of the New York City Democratic Socialists. “He shows up.”Indeed, he is a highly visible presence from Brooklyn to Buffalo, building relationships with elected officials at every level of the ballot and across the Democratic ideological spectrum. But Schumer’s efforts to engage the farthest-left faction of his party have been particularly consequential in New York, a state where several top Democratic officials have lost primaries in recent years.He has often teamed up on local issues with left-wing lawmakers including Ocasio-Cortez and Cabán. (He also recently schmoozed over empanadas at a Cabán office opening, she said on Wednesday.)In the Buffalo mayor’s race, he endorsed the Democratic nominee, a democratic socialist, while other prominent elected officials stayed on the sidelines (the candidate lost, but good will for Schumer remains). And in New York and nationally, he loudly champions progressive priorities including canceling student debt.More broadly, he helped secure significant federal aid for New York, he has an overwhelming fund-raising advantage and polls show that he is popular at home. Challenging him in a pricey statewide race would be a daunting task.Certainly, the Senate majority leader is not an obvious favorite for New York’s left-wing grass-roots. Democrats of all stripes remain frustrated by the pace of progress in the divided Senate, while moderate donors have at times been discomfited by his overtures to the left.But Ocasio-Cortez, who long drew chatter about a possible Senate bid, has said she is running for re-election. Schumer received his party’s backing by acclamation at the Democratic convention. And the clues are coming from an unlikely place: school boards.This year, Wisconsin held some of the earliest school-board elections in the country. Like everything else in American politics, these normally sleepy contests have become sharply polarized — and closely watched.Nationally, Republicans see an opportunity to erode the Democrats’ traditional advantage on education, capitalizing on widespread frustration over schooling during the coronavirus pandemic. Under the banner of “parents’ rights,” they’ve stoked controversies over L.G.B.T.Q. issues and critical race theory, an academic legal concept that has become a loose shorthand for a contentious debate on how schools teach about race.It’s a strategy that complements Republicans’ emphasis on local elections as a means of energizing the base of the party. Last year, Senator Ron Johnson urged Wisconsin voters to “take back our school boards, our county boards, our city councils.”So how did it go? Republicans in Wisconsin invested more than $70,000 in school-board races this year, according to The Milwaukee Journal Sentinel. Rebecca Kleefisch, a former lieutenant governor who is running to oust Gov. Tony Evers, the Democratic incumbent, endorsed a slate of 48 candidates in school board contests. Thirty-four of them won.But the raw numbers can be misleading. Republicans picked up seats in Waukesha County, a longtime G.O.P. stronghold, but failed to make inroads in most contested areas. Scarlett Johnson, a conservative activist who drew national attention for organizing a recall of her local school board last fall, lost her election bid in a suburb north of Milwaukee.In contested Eau Claire, two incumbents backed by Democrats and teachers’ unions, Tim Nordin and Marquell Johnson, were narrowly re-elected with some help from the state party. Both had complained of receiving harassment during the campaign, during which conservative candidates criticized school training materials on how to discuss children’s sexual identities.In an email, Nordin said the results were a repudiation of “false narratives about race and identity.” He added, “Our community saw through dog whistles and rejected barely disguised attacks on our children.”Michael Ford, a professor of public administration at the University of Wisconsin Oshkosh who tracks school board elections, noted that Republican-backed candidates had done well in the suburbs of Milwaukee, though the results elsewhere were more of a wash.“In the last presidential election, there were many conservative-leaning suburban voters who were uncomfortable with Trumpism,” Ford said. Last night’s results could be a sign that education issues are returning those voters to the G.O.P. fold, he said.Wisconsin is one of the most hotly contested battleground states in the nation, and each party will be poring over the outcome of these races for weeks to come. Republicans viewed the elections as a tuneup ahead of November, when they are keen to replace Evers and defend Ron Johnson’s Senate seat. The state party praised last night’s results as “a testament to the strength of the grass-roots Republican operation.”Ben Wikler, the chairman of the Wisconsin Democratic Party, said that Republicans had “fizzled out completely” outside suburban Milwaukee by “making fringe arguments to an evenly divided electorate.”He hailed the results as a good sign for Evers, a former science teacher who has made his handling of education issues central to his re-election pitch.“If the far-right candidates had won, I’d be worried,” Wikler said.Thanks for reading.     Why Rick Scott and Mitch McConnell Are Feuding Over Midterm Elections

    Senator Rick Scott has an 11-point plan to “rescue America.” Senator Mitch McConnell would rather he not.Republican insiders have long worried that they could blow a golden opportunity to retake the Senate this year. And while most are confident that a red wave will still wash enough of their candidates ashore in November to win a majority, some doubt occasionally creeps in.The latest reason: an ongoing disagreement between two of the top Republicans in the Senate, Mitch McConnell, the minority leader, and Rick Scott, the leader of the party’s campaign arm. At issue is the “11-Point Plan to Rescue America” that Scott has presented as a platform for the midterms, and that McConnell has emphatically rejected.And while Scott has said that the plan is just his opinion, developed using his own campaign funds, Democrats have been all too happy to pin its provisions on the Republican Party writ large.They’ve seized on one bullet point in particular, which reads: “All Americans should pay some income tax to have skin in the game, even if a small amount. Currently over half of Americans pay no income tax.” That idea polls badly, according to Morning Consult, though other provisions of Scott’s plan are popular.On Thursday, the Democratic Senatorial Campaign Committee paid for a truck-mounted billboard to troll Senate Republicans during their one-day retreat. “Senate Republicans’ Plan: Raise Your Taxes,” the billboard read.Never mind that McConnell has brushed back Scott, telling reporters at the Capitol last week, “We will not have as part of our agenda a bill that raises taxes on half the American people, and sunsets Social Security and Medicare within five years. That will not be part of a Republican Senate majority agenda. We will focus instead on what the American people are concerned about: inflation, energy, defense, the border and crime.”McConnell also made it clear who was in charge. “If we’re fortunate enough to have the majority next year, I’ll be the majority leader,” he said. “I’ll decide, in consultation with my members, what to put on the floor.”Scott defended himself last week in an opinion piece in The Wall Street Journal, saying his plan had “hit a nerve” with Washington elites, whom he accused of misleading voters about the sustainability of federal deficits and entitlement programs.“Part of the deception is achieved by disconnecting so many Americans from taxation,” he wrote. “It’s a genius political move. And it is bankrupting us.”Scott’s plan has some powerful backers, including the Heritage Foundation, which plans to host him for an event later this month. Here are the four incumbents most at risk.In the House: Republicans and Democrats are seeking to gain an edge through redistricting and gerrymandering, though this year’s map is poised to be surprisingly fairGovernors’ Races: Georgia’s contest will be at the center of the political universe, but there are several important races across the country.Key Issues: Inflation, the pandemic, abortion and voting rights are expected to be among this election cycle’s defining topics.“Conservatives in this country are demanding an ambitious, conservative agenda,” said Kevin Roberts, the president of the Heritage Foundation. “Therefore, it excites us to see members talking that way.”Democrats dust off a playbookScott’s plan is a fortuitous turn of events for Chuck Schumer, the Senate majority leader, Democrats say.“Chuck, I’m sure, is salivating,” said Jim Kessler, a former Schumer aide who is now an executive vice president at Third Way, a center-left think tank.In the first sentence of a letter to his Senate colleagues this week, Schumer wrote, “As Senate Republicans debate their plan to increase taxes on millions of working Americans, Senate Democrats have focused on ways to get rising prices under control to help working families.”Senate Democrats are considering holding hearings, and possibly a series of votes, to highlight Scott’s plan and to force Republicans to take uncomfortable positions on it.It’s a playbook that Schumer has run before. In 1995, as a member of the House representing New York, he used Newt Gingrich’s “Contract with America” to accuse Republicans of trying to force cuts in popular spending programs. Gingrich, who became the speaker of the House in 1995 — either because or despite that plan, depending on whom you ask — has embraced Scott’s platform.“That was probably the first thing that Chuck did that showed him as a national political leader,” recalled Kessler. With Scott’s plan, he said of Schumer, “I’m sure he sees it and says to himself, ‘I’ve taken this apart before.’”Privately, Democrats are realistic about their chances of hanging onto the Senate, and say they must seize the “gift” Scott has given them to force Republicans onto the defensive. On the day of the State of the Union, for instance, Senate Democrats ran an ad accusing McConnell of fighting “for the same wealthy insiders who get rich by keeping prices high.”During their own retreat on Wednesday, Democrats heard a presentation by Geoff Garin, a pollster, that impressed many of the senators present. Garin’s surveys have found that more voters blame the coronavirus pandemic, “China and foreign supply chains” and “large corporations raising prices to increase their profits” than they do President Biden for inflation.“The bottom line here is that Democrats have a very strong case to prosecute on rising costs,” Garin said.Republicans see the attack on Scott as a desperation play in what could be a difficult election for Senate Democrats, who must defend incumbents in Arizona, Georgia, Nevada and New Hampshire while trying to pick up seats in Ohio, Pennsylvania and Wisconsin.“If I were them, I would try to use it, too,” said Justin Sayfie, a Republican consultant who runs an influential Florida political news website. “But they’re going to have to put a lot of money behind it. How much penetration are they going to be able to get with a message about Rick Scott?”Two visions of how to winMcConnell and Scott have a fundamental difference of opinion about how to win the Senate, people who have studied both men say.There’s McConnell, the calculating insider, who is leery of putting forward a political agenda that could open Republicans up to Democrats’ attacks. Republicans have long memories of how, in past election cycles, Democrats have had success in accusing them of wanting to cut popular programs like Medicare and Social Security.“McConnell hates variables,” said Kessler, the former Schumer aide. “He’s like a boxer who likes to cut off the sides of the ring.”In January, when a reporter asked McConnell what his agenda might be if Republicans retake the majority, he replied simply: “That is a very good question. And I’ll let you know when we take it back.”Then there’s Scott, the ambitious outsider, a former businessman whose presidential aspirations are no secret. He’s rankled some of his fellow Republican senators by taking broad swipes at Washington — despite leading the committee in charge of electing more of them.And while they share the same goal of winning back the Senate, aides and allies of both men have sniped at one another through the press, particularly over their relationship with Donald Trump.Scott has cultivated a relationship with the former president — he made sure to send copies of his plan to Mar-a-Lago — while McConnell at times has condemned Trump, who in turn refers to the Senate minority leader as “the Old Crow.” Trump has even tried to recruit Scott as a future majority leader, according to a Politico account.McConnell’s office declined to comment.“There will always be critics, but we don’t waste much time worrying about the opinions of Democrat operatives or anonymous Washington consultants,” said Chris Hartline, the communications director for the National Republican Senatorial Committee, which Scott chairs. Asked what the Heritage Foundation would say to Senate leaders like McConnell, Roberts said, “We’re grateful for their service, and we’re looking forward to them embracing Senator Scott’s plan or coming up with a plan of their own.”What to read The U.S. Census Bureau says the 2020 census seriously undercounted the number of Hispanic, Black and Native American residents, even though its overall population count of 323.2 million was largely accurate, Michael Wines and Maria Cramer report.In February, the Consumer Price Index rose at its fastest pace in 40 years. Along with his wife, Karen, he met with some of the refugees who are living in camps near the border with Poland. As Pence noted on Twitter, more than 2 million Ukrainians have fled the country over the last 12 days, according to U.N. figures.Pence’s trip comes as the former vice president tries to establish himself as a leader of the Republican Party on foreign policy ahead of a possible 2024 run.     Senators involved in the negotiations underway say the discussions are serious and substantive, but some Democrats remain wary.WASHINGTON — Senator Richard Blumenthal, Democrat of Connecticut, was finally closing in on a hard-fought agreement with Republicans on a gun safety measure, following a string of horrific shootings in 2019, when the talks suddenly collapsed.New plans in the House to impeach President Donald J. Trump meant that Republicans were no longer in the mood to compromise with Democrats on anything, and the emerging accord went the way of so many seemingly promising ones on Capitol Hill in recent years, stymied by Republicans who said they were willing to accept some sort of deal — just not that one.“The world has become so polarized that our Republican colleagues come so very close to closing a deal, but then they begin staring down the abyss of their base and they recoil,” said Mr. Blumenthal, who attributed the Republican recalcitrance to fear of a political backlash for any cooperation with Democrats.The same has been true for other politically charged issues where efforts at compromise have ended up going nowhere in Congress. Republicans initially seemed willing to engage on legislation addressing immigration and police misconduct, for example, only to abruptly pull back, blaming Democrats for what they called unreasonable demands or a refusal to take hard steps that might anger their liberal supporters.So as a rump group of senators in both parties has recently ramped up discussions aimed at reaching a compromise on voting legislation, leading Democrats who saw their far broader voting rights package stall in the Senate last week have been wary.They worry that the emerging legislation could be a distraction from the pressing issue their bill was meant to address — Republican voter-suppression efforts at the state level — and amount to little more than cover for Republicans who want to appear interested in protecting election integrity despite uniformly opposing Democrats’ voting rights bill.They have taken note that Senator Mitch McConnell, the Kentucky Republican and minority leader, has blessed the effort — a telltale sign, say Democrats who have learned to be endlessly suspicious of his motives, that it might go nowhere.The Democratic fear is that once the moment passes and attention shifts away from election law to spending issues and now a contentious Supreme Court nomination, the talks will fizzle and Democrats will be left with nothing to show for their voting rights drive, even as the 2022 midterms loom and the 2024 election is just over the horizon.But leaders of the talks that now include at least 16 senators divided between Republicans and Democrats say they are substantive, gaining momentum and could produce legislation that might prevent another Jan. 6-style confrontation by focusing on fixing the deficiencies in the 135-year-old Electoral Count Act.They point to the bipartisan infrastructure measure that many of the same lawmakers were able to produce last year as their model for negotiations, and as proof that compromise is still possible.“I’m encouraged by the fact that almost every day, someone calls me and asks to join our group,” said Senator Susan Collins, the centrist Republican from Maine and a leader of the compromise effort. She characterized its members, who met virtually this week, as ranging from “pretty conservative to pretty liberal.”“This is a serious, committed group of senators from both sides of the aisle,” she said in an interview. “This is not a surface effort.”Aiding the outlook for the talks is the fact that Senator Chuck Schumer, Democrat of New York and the majority leader, is also now encouraging them.     Democrats Face a Dilemma on Voting: Compromise or Keep Pressing?

    With their broad voting rights push nearing a dead end, Democrats must soon decide whether to embrace a far narrower bipartisan effort to protect vote counting and administration.WASHINGTON — With their drive to secure far-reaching voting rights legislation nearing a dead end, Senate Democrats face a decision they had hoped to avoid: Should they embrace a much narrower, bipartisan effort to safeguard the vote-counting process, or continue what increasingly looks like a doomed push to protect access to the ballot box?A growing group of Senate Republicans and centrist Democrats is working on legislation to overhaul the Electoral Count Act, the 19th-century law that former President Donald J. Trump sought to exploit to overturn the 2020 presidential election. That effort is expanding to include other measures aimed at preventing interference in election administration, such as barring the removal of nonpartisan election officials without cause and creating federal penalties for the harassment or intimidation of election officials.Democratic leaders say they regard the effort as a trap — or at least a diversion from the central issue of voter suppression that their legislation aims to address. One is voter suppression — these subtle laws that make it harder for people to vote,” Mr. King said. “The other piece is voting administration, where you get into substituting partisan people for nonpartisan administrators, purging voter election boards, allowing election boards to eliminate polling places and also the whole mechanics of counting.”He added, “There’s a reasonable opportunity here for a bipartisan bill, but my concern is that it will be viewed as a substitute for the Freedom to Vote Act, and that’s just not the case.”Members of both parties are concerned about the counting and certification of ballots after they have been cast. President Biden was emphatic on the point when he emerged Thursday from a fruitless lunch with Senate Democrats, pleading with them to change the filibuster rules around voting.“The state legislative bodies continue to change the law not as to who can vote, but who gets to count the vote, count the vote, count the vote,” he said, his voice rising in anger. “It’s about election subversion.”And some academic experts say protecting election administration and vote counting, at this moment, is actually more critical than battling restrictions on early and absentee voting and ballot drop boxes.“I’ve been saying this for the last year: The No. 1 priority should be ensuring we have a fair vote count,” said Richard L. Hasen, a law professor at the University of California, Irvine, who has drafted his own prescriptions for safeguarding elections after Election Day. “We are in a new level of crisis. I never expected in the contemporary United States that we would have to have legislation around a fair vote count, but we have to have it now.”Senator Mitch McConnell of Kentucky, the Republican leader, has opened the door a crack to changing the Electoral Count Act, which Mr. Trump and his legal advisers speciously claimed gave the vice president the power to unilaterally reject the electors from states deemed contested.“It obviously has some flaws.     Democrats, Voting Rights Are Not the Problem

There is no evidence — none — to support any specific claims on this front. But greater care and transparency about postelection administration would serve us well regardless and could render such claims easier to test and refute in ways that would build public confidence.Some Democrats insist that Republicans are preparing to manipulate the certification process in elections in some states. So far, this mostly looks like Trump supporters running for offices with authority over election administration, which is no crime in a democracy. But requiring accountability and transparency and setting some boundaries on what can happen after an election would help ease these concerns and avert the dangers that Democrats have warned about.And all of us saw just a year ago that Congress’s role in certifying presidential elections could be clarified and rid of opportunities for confusion and mischief.Reforms focused on these themes would be a more productive path than what we’ve seen so far, which are efforts focused mostly on voting itself — on who can cast a ballot, when and by what means.Democrats want fewer constraints and more time for more people to vote in more ways. They say that broader participation is essential to a stronger democracy and that restrictions on some modes of voting amount to suppression. They also assume that higher turnout will help the left win more elections, and some of the practices they want to enshrine (like ballot harvesting, in which other people collect ballots for delivery to polling places), frankly, reek of the corrupt practices that political machines have long employed.Republicans want more safeguards and boundaries around voting. They say that greater security is essential to making sure only eligible people vote and that long voting periods and different methods to cast ballots risk enabling fraud and distorting the meaning of elections. They also assume that lower turnout will help the right win more elections, and some of the restrictions they want to impose (like limiting Sunday voting), frankly, reek of the racist practices long used to deny the vote to Black Americans and other minorities.If we take both parties’ most high-minded arguments at face value, they are worried about problems that barely exist. It is easier than ever to vote: Registration has gotten simpler in recent decades, and most Americans have more time to vote and more ways to do so. Voter turnout is at historic highs, and Black and white voting rates now rise and fall together. These trends long predate the pandemic, and efforts to roll back some state Covid-era accommodations seem unlikely to meaningfully affect turnout.Meanwhile, voter fraud is vanishingly rare. The most thorough database of cases, maintained by one of the staunchest conservative defenders of election integrity, suggests a rate of fraud so low, it could not meaningfully affect outcomes.Even judged by the parties’ more cynical motives, their reform priorities don’t make sense. It is just not true that higher turnout helps Democrats and hurts Republicans. In their 2020 book “The Turnout Myth,” the political scientists Daron R. Shaw and John R. Petrocik review half a century of evidence decisively refuting that common misperception. That’s not to say that turnout doesn’t shape particular election outcomes, but it doesn’t systematically benefit one party or the other.The parties’ emphasis on voting itself also isn’t conducive to bipartisan action, which is essential to public trust. Democrats in Washington should see that using one of the narrowest congressional majorities in American history to nationalize election rules in ways opposed by every Republican official — even if it’s well intentioned — would undermine public confidence in elections. Republicans should recognize that state laws restricting the times and methods of voting over the objections of every elected Democrat will be perceived as an attack on the voting rights of Democrats, even if they aren’t.Each party is telling its supporters not to trust our elections unless its favored bills are passed while implicitly persuading its opponents that those bills are illegitimate and dangerous. The result amounts to an assault on public trust that’s worse than any actual problem with American elections.That is why Democrats and Republicans should turn to narrowly tailored legislation focused on postelection administration. Such a bill could, for instance, limit the ability of state officials to remove local election administrators without cause, and prohibit the harassment of election workers (as happened, for example, in Georgia after the 2020 election). It could mandate a mechanism for postelection audits while requiring a clear standard for rendering election results final.It could provide for uniform transparency procedures and codify the role of election monitors. It could prescribe an oath for all election administrators committing to transparently and impartially obey the law. And it could modernize and simplify the Electoral Count Act of 1887, which still governs Congress’s and the vice president’s roles in certifying presidential elections.Some of these ideas are already included in the Freedom to Vote Act, sponsored by Democratic senators, including Joe Manchin. But that bill also includes extraneous measures (like changes in voter registration and eligibility, campaign finance and redistricting) that render it unacceptable to Republicans. A less sweeping bill focused on addressing some shared concerns about what happens after the people vote would stand a better chance of attracting bipartisan champions.Our debates about election reform this past year have been misdirected in ways that have rendered them more divisive than they have to be.     7 Political Wish Lists for the New Year

    What do the president, vice president, former president and party leaders want in 2022? We made our best guess.Sign up here to get On Politics in your inbox on Tuesdays and Thursdays.Given that this is the last On Politics newsletter before Christmas, and of 2021 for that matter, it seems like a good time to take stock and reflect on what a wish list might be for the nation’s leaders.Today, Democrats control both the White House and Congress. But the party’s hold on power is so slim — the 50-50 split in the Senate means that Vice President Kamala Harris must break tied votes — that the entire Biden agenda is dependent on every single Democrat’s falling into line. And they aren’t all doing so.History bodes poorly for the party of the president in a first midterm election, and many Democrats are bracing for a rout in 2022. Here is what we think the nation’s leaders are looking for in the New Year:President Biden: He won the Democratic nomination after making two early bets in the primary that paid off big: that he would be seen as the most electable Democrat and that Black voters would be a loyal base. Both bets paid off. Similarly, Biden made an early two-pronged bet about the midterms: that a surging economy and a waning threat from the coronavirus would deliver victory to the Democrats.Right now, neither is happening.The omicron variant is bringing rising caseloads and fresh fears despite the widespread availability of vaccines. Meanwhile, monthly economic reports tell the story of the fastest inflation in decades, the kind of in-your-face figures that can swamp other positive economic indicators like the unemployment rate.Wish list: a stronger economy, shrinking inflation and a disappearing virus.Mitch McConnell: The Senate Republican leader has an excellent shot at returning to the majority in 2023 — after only two years in the minority. But while the overall political landscape appears rosy for the Republicans, McConnell’s party must navigate a series of primary races next spring and summer that he and his allies worry could result in extreme and unelectable nominees.Former President Donald J. Trump is an added X-factor. He has provided early endorsements for candidates who are not exactly prototypical McConnell recruits, including in North Carolina, Georgia and Pennsylvania, where the first Trump endorsee already dropped out. These days, Trump has even taken to insulting McConnell by name.Wish list: mainstream nominees in swing states for 2022; a toning down of Trump’s attacks. (The latter is probably more pipe dream than wish.)Chuck Schumer and Nancy Pelosi: The Senate majority leader and House speaker want mostly the same thing: to successfully negotiate passage of an enormous social policy bill, the Build Back Better Act, that would remake the social safety net and environmental policy.But there is precious little maneuvering room when you need the votes of liberal firebrands as well as the most conservative members of the caucus, like Senator Joe Manchin of West Virginia.Schumer has literally no votes to spare, which means every Democratically aligned senator holds de facto veto power. He also needs all 50 of those senators to stay healthy and present, not just for the Build Back Better bill but also other priorities like confirming judges and an attempt to pass voting-rights legislation.Wish list: Democratic health and unity; passage of the Build Back Better Act.Joe Manchin: The Senate’s most conservative and consequential Democrat recently declared on Fox News — yes, Fox News — that he was a no on the Build Back Better Act. It sent the White House scrambling and delivered a potentially fatal setback to the party’s signature legislation.Wish list: If Democrats knew for sure, it would already be in the bill.Kevin McCarthy: The House Republican leader has already started to be cast as the next speaker — presuming his party retakes the chamber — but his ascent would depend on more than just a Republican majority in 2022. Mr. McCarthy had to abandon his speakership ambitions in 2015. To succeed in 2023, he faces what Politico recently described as a “vexing speaker math problem”: a cohort of members yearning for an alternative, including some floating Trump himself. That may be far-fetched. But it is a sign of how hard it would be for McCarthy to navigate a majority as narrow as the one Pelosi has.Wish list: winning a big enough G.O.P. majority in 2022 to lead and run the House.Kamala Harris: The history-making vice president has faced a rash of negative media coverage in her first year and discovered, as Mark Z. Barabak of The Los Angeles Times put it, that the “vice presidency is an inherently subordinate position and one that sits ripe for ridicule.” Some of her most senior communications advisers are departing, and 2022 offers the chance at a reset, especially given the uncertainty — despite the White House’s public proclamations otherwise — that Biden will seek re-election in 2024, the year he will turn 82.Wish list: greater staff stability and a more positive portrayal in the press.Donald J. Trump: The former president may be off social media, but he has not receded from the political scene. He has been issuing statements from his new PAC at Twitterlike speed, endorsing a raft of candidates and continuing to raise money online by the bucketload, all while he is under investigation in New York for his business practices.He is talking out loud about running for president again.
