    With Manchin Out, Democrats’ Path to Holding the Senate Is Narrow

    While the party will be on defense in every competitive race, Republicans face some messy primaries and a recent history of nominating extreme candidates who have lost key contests.Senator Joe Manchin III said he decided to forgo re-election because he’d accomplished all his goals. But for the Democrats he’s leaving behind in Washington, the work to hold the party’s already slim Senate majority is just beginning.While there are no guarantees in politics, West Virginia is now a virtual lock to flip Republican. The state has become so conservative that only Wyoming delivered a wider Republican margin in the 2020 presidential race. In the immediate aftermath of Mr. Manchin’s announcement, several well-placed Democratic operatives said they couldn’t name a single West Virginian who could take his place on the ballot and be even remotely competitive, particularly if Gov. Jim Justice wins the Republican nomination.“This is a huge impact,” said Ward Baker, a former executive director for the National Republican Senatorial Committee, the group that oversees Senate races. “Manchin not running will save Republicans a ton of money — and it takes a seat off the board early.”The path to holding power was always going to be rocky for the Democrats’ current 51-seat majority, with or without Mr. Manchin.Two incumbents are running for re-election in red states, Montana and Ohio. A third senator, Kyrsten Sinema of Arizona, who was elected as a Democrat but has since switched her party affiliation to independent, has yet to declare her plans — leaving open the prospect of an unusually competitive three-way race. And the party must also defend four Senate seats in four of the most contested presidential battlegrounds: Wisconsin, Nevada, Pennsylvania and Michigan.But Republicans face some potentially divisive primaries and a recent history of nominating extreme candidates who have lost key contests.With West Virginia off the Senate chessboard next year, Democrats must win every race they are defending — and depend on President Biden to win the White House — in order to maintain a majority. In a 50-50 Senate, the vice president casts the tiebreaking vote. But that’s a risky bet considering a plurality of Americans haven’t approved of President Biden since August 2021, according to Gallup polls.The bad news for Senate Democrats is that they are on defense in each of the seven seats that both parties view as most competitive this year. The good news is that in five of those seven, the party has incumbents running for re-election, which has historically been a huge advantage.At least 83 percent of Senate incumbents have won re-election in 18 of the past 21 election cycles, according to OpenSecrets, a nonpartisan group that tracks money in politics. Last year, 100 percent of Senate incumbents were re-elected. “Given Democratic success in 2020 and 2022, it’d be malpractice to write Democrats off at this stage,” said Justin Goodman, a former top aide to Senator Chuck Schumer, the majority leader. “Candidates matter,” he said, as well as the ongoing contrast that Democrats have sought to strike against the “extreme MAGA agenda.”The Democratic incumbents in Montana and Ohio — the top two targets for Republicans with West Virginia off the map — are seeking re-election in states former President Donald J. Trump easily won twice. Both Senator Jon Tester of Montana and Senator Sherrod Brown of Ohio have exceeded expectations before, but never with such an unpopular presidential candidate at the top of the ticket. And unlike most incumbents, whose victories tend to become easier over time, Mr. Tester has always had close races. Mr. Brown’s margins have narrowed.But close victories count just as much as easy ones, and Democrats maintain that the personal brands of both Mr. Brown and Mr. Tester matter more in their states than national political winds.Republicans, who are also facing headwinds because of the unpopularity of Mr. Trump and the party’s role in rolling back abortion rights, are attempting to follow suit. The National Republican Senatorial Committee is putting a heavy emphasis on candidate recruitment this cycle to find contenders who can appeal to both conservatives and moderates in the party.The strategy has already paid off in West Virginia.One of the first calls this year from Senator Steve Daines, a Montana Republican overseeing his party’s Senate races, was to Mr. Justice in West Virginia, believing that the popular governor’s presence in the race would help persuade Mr. Manchin to retire.The second part of Mr. Daines’s strategy in West Virginia was persistently lobbying to secure a Trump endorsement for Mr. Justice, with the aim of not just forcing out Mr. Manchin but also the hope that it would convince him to run for president as an independent. Mr. Trump endorsed Mr. Justice last month.Mr. Manchin, meanwhile, furthered speculation of a potential presidential bid by saying Thursday he planned to gauge “interest in creating a movement to mobilize the middle and bring Americans together.”In 2018, Democrats and Republicans combined spent about $53 million on the West Virginia Senate race. With no competitive race there in 2024, both parties will have tens of millions of dollars to spend on a second tier of battleground races. Last year, candidates, parties and outside groups spent more than $1.3 billion on 36 Senate races, including $737 million in just five states — Arizona, Nevada, Ohio, Pennsylvania, and Wisconsin — that are also on the ballot again next year.“I think Wisconsin and Michigan are about to get a bunch of Republican money they weren’t going to get otherwise,” said Brad Todd, a Republican strategist who has worked on Senate races.The most interesting of the second-tier races may be in Arizona, where the state may have a competitive three-way race — a rarity in American politics. The wild-card is Ms. Sinema.If she runs for a second term, she will most likely face Representative Ruben Gallego, a well-liked progressive Democrat who has already spent $6.2 million on the race this year, and Kari Lake, the firebrand conservative Republican and one of her party’s best-known election deniers who is favored in her party’s primary.A competitive three-way general election would add a riveting dynamic to what could be the most expensive Senate race in the country next year. The state’s Senate contest last year, which pitted Senator Mark Kelly against Blake Masters, the Republican nominee, cost more than $225 million.There is no top-flight Republican challenging Senator Tammy Baldwin in Wisconsin, but the party has been pushing for Eric Hovde, a businessman who ran for Senate in 2012. In Pennsylvania, Republicans have cleared a path for David McCormick with the aim of avoiding a bruising primary and strengthening their bid against Senator Bob Casey, who is seeking a fourth six-year term.Republicans haven’t been as lucky in Michigan or Nevada.In Michigan — the only competitive Senate race without an incumbent — Democrats so far have mostly aligned behind Representative Elissa Slotkin, a former C.I.A. analyst who represents a divided district. Mr. Daines recruited former Representative Mike Rogers, who was chairman of the House Intelligence Committee. But James Craig, a former Detroit police chief, and former Representative Peter Meijer, who lost his seat after voting to impeach Mr. Trump, have also entered the Republican race.The Republican establishment pick in Nevada is Sam Brown, a retired Army captain who lost a Senate primary last year. But he’s facing a primary against Jim Marchant, a Trump loyalist and election denier who lost a race for secretary of state last year. The winner would take on Senator Jacky Rosen, a Democrat who is seeking her second term.With West Virginia scotched, the Democratic Senate map is undeniably constricting. But the party will look to go on the offensive in Florida and Texas. Both states have been reliable Republican strongholds in recent years, but Democrats realistically have no better options to flip a Republican seat this year.In Florida, Senator Rick Scott, the state’s former governor, is seeking a second term. He’s never won an election by more than 1.2 percentage points, and he’s also never run in a presidential election year — when Democrats typically fare better in Florida.But the state lurched to the right last year when Republicans won five statewide races on the ballot by an average of 18.9 percentage points. The leading Democratic challenger in the Florida Senate race this year is former Representative Debbie Mucarsel-Powell, who was unseated from her Miami-based seat after one term.In Texas, Senator Ted Cruz has been a constant target for Democrats — and survived each time. This year, his top challenger appears to be Representative Colin Allred, a Dallas-area Democrat who defeated an incumbent Republican in 2018.“Cruz’s vulnerability means there’s an opportunity there, and Cruz can be beat no matter the presidential result,” said J.B. Poersch, president of the Senate Majority PAC, which has spent more than $140 million in the past four years supporting Democratic Senate candidates.The Democratic Senatorial Campaign Committee has been testing campaign messages in both states, and the party has dedicated communications and research staff in each location.But to win in Florida and Texas, Democrats will need stars to align in a way they did not in West Virginia.“Quite possibly the stupidest thing I’ve ever heard,” Mr. Baker, the former N.R.S.C. director, said of Democratic hopes to take Florida or Texas. “They just lost a Senate seat.     Senate Democrats Outpace Republicans in Fund-Raising in Key States

    The 2024 election map is a challenging one for Democrats — especially in states they need to hold for a majority. But the incumbents made a strong financial showing this quarter.Senate Democrats staring down tough re-election fights can look to one bright spot: sizable fund-raising hauls and cash stockpiles more than a year before Election Day.In states where they are most vulnerable in 2024 — Montana, Ohio, Pennsylvania, West Virginia and Wisconsin — Democratic incumbents have raised more money than they previously have at this stage in earlier cycles, the latest campaign filings show. Saturday was the deadline for campaigns to file spending and fund-raising reports for the three months between April 1 and June 30.Most of the vulnerable incumbent Democratic senators also topped their prospective Republican challengers in fund-raising and will head into the fall with several million dollars in cash on hand.The race for Senate control is in its earliest months, and Republicans are still building campaigns. Yet the Democrats’ relative financial strength in the second quarter of an off year suggests significant energy as the party aims to protect its slim majority next year.The electoral map, however, will be one of the most challenging the party has faced in years. Nearly two dozen Democratic seats are up for re-election in 2024, with eight incumbents seen as vulnerable, while just 10 Republicans face re-election — and all of the G.O.P. incumbents won by comfortable margins in previous cycles.In their Senate re-election bids, Sherrod Brown of Ohio and Jon Tester of Montana both brought in more than $5 million. Mr. Brown had $8.7 million in cash on hand, and Mr. Tester $10.5 million. Senator Tammy Baldwin of Wisconsin raised $3.2 million, the most ever raised in a Wisconsin Senate contest in an off year, according to her campaign.Senator Joe Manchin of West Virginia, a conservative Democrat who has not yet publicly said whether he will run for re-election — and is flirting with a third-party presidential run — raised $1.3 million over the last three months and has more than $10 million in the bank, expanding his cash advantage over Gov. Jim Justice and Representative Alex Mooney, Republicans who have already begun campaigns to unseat him.In Pennsylvania, Senator Bob Casey posted his best fund-raising quarter to date, bringing in more than $4 million for his re-election bid.Republicans have been preparing their own money machines and recruiting candidates in five states with vulnerable Democrats. Republican confidence has also been bolstered by the 2024 Senate map.The Democrats “are trying to use money to defy gravity,” said Stu Sandler, a political consultant and former political director of the National Republican Senatorial Committee. “This is a lopsided map for them,” he added, pointing to former President Donald J. Trump’s 2020 victories in Ohio, Montana and West Virginia — all states Mr. Trump won decisively. And, he said, Republicans have some “very credible favorites” to challenge the incumbents.Democrats view this fund-raising as a crucial show of strength that will fortify their candidates ahead of a difficult 2024 cycle for the party.“Voters and grass-roots supporters are once again supporting battle-tested Senate Democratic candidates in record ways because they recognize the stakes of this election and the importance of stopping Republicans from implementing their toxic agenda,” said Tommy Garcia, spokesman for the Democratic Senatorial Campaign Committee.In Arizona, Representative Ruben Gallego raised more than Senator Kyrsten Sinema, who has changed her party affiliation from Democrat to independent, by two-to-one — the second time this year Mr. Gallego has notched such a ratio. He still trails Ms. Sinema in cash on hand by more than $7 million. Ms. Sinema has not yet announced whether she will run for re-election.Even Democrats in safe Republican territory had strong showings. In Texas, Representative Colin Allred raised $6.2 million in his challenge to Senator Ted Cruz. Mr. Allred, who announced his campaign in May, brought in more money in a shorter period of time than Mr. Cruz, who raised $4.4 million in the last three months. More

    An election bill moving through the Republican-led Legislature would rewrite the rules for a single race: the looming battle against Senator Jon Tester, a Democrat.HELENA, Mont. — Republicans typically cry foul when accused of rewriting election laws to benefit their candidates. But as the Montana Legislature debates a new voting bill, even some G.O.P. lawmakers concede that this one appears designed to help them win elections — more precisely, one very important election.The bill would rewrite the rules for the state’s next U.S. Senate race and only that race. The 2024 fight to oust Senator Jon Tester, a Democrat, is expected to be one of the tightest in the country.The legislation would shift the contest from a traditional election into a “top two” primary system, making it exceedingly difficult for third parties to reach a general election ballot. A Montana Republican and head of the National Republican Senatorial Committee, Mr. Daines is leading the party’s campaign to win control of the Senate in 2024.Brad Molnar, a Republican state senator who opposes the bill, criticized Washington meddling in Montana politics, saying that if national Republicans get involved, “we will lose.” He predicted that the bill would backfire on Republicans if angry Libertarians flock to Democrats. “They will be angry. Why wouldn’t they be? I’m not a libertarian, and I’m angry.”The bill’s sponsor, State Senator Greg Hertz, said he was trying to ensure that Montana’s senator would win with more than 50 percent of the vote and to also tamp down on parties’ interference with third-party candidates.Mr. Hertz said he had designed the bill to apply only to the upcoming Senate race because he saw it as a test run. He expected the Legislature to examine expanding the system to congressional, state legislative and other statewide races in the future.The system would mirror California’s primaries, where all the candidates from all the parties appear on the same ballot, and the top two vote-getters face off in the general election.The bill passed the Montana Senate last week by a narrow margin, with seven Republican senators voting against it. At one point he suggested critical changes that focused the bill on Mr. Tester’s race, according to emails reviewed by The New York Times.“We would like it to apply only to United States Senate races,” Mr. Denowh said in an email sent on March 26 to multiple lawmakers, including Mr. Hertz. “We’d like a sunset in 2025,” he added. It was not clear whom “we” was referring to, and Mr. Denowh declined to answer questions.Mr. Hertz quickly agreed with the changes and asked State Senator Steven J. Fitzpatrick, the House majority leader, who was copied on the email chain, to make the newly reworked proposal “a priority bill.”The sudden changes and swift reintroduction after an initial failure in committee caught Republican lawmakers by surprise.In a text message chain among eight Republican senators, Mr. Fitzpatrick answered lawmakers’ concerns by telling them the bill “came from Daines” and that it was the “brainchild of the Jason Thielman,” according to screenshots of the texts obtained by The New York Times. Mr. Thielman is a longtime Daines aide who is now the executive director of the N.R.S.C.“No wonder I don’t like it,” responded Senator Dan Salomon, a Republican state senator who voted against the bill.When asked about the text messages, Mr. Fitzpatrick said that he had never spoken directly with Mr. Daines about the bill, but that he believed the effort originated with national Republicans.Mr. Daines has not weighed in publicly. Rachel Dumke, a spokeswoman for Mr. Daines’s office, declined to comment.At least two Republican lawmakers in Montana said they had been pressured by Mr. Daines’s office to support the bill. And one Republican state senator received a text message from state Republican Party officials explicitly saying the bill was needed to defeat Mr. Tester. The lawmakers asked for anonymity to disclose private discussions.In an interview, Mr. Hertz said he had been working on election issues since last September, initially exploring adding a runoff election. But he acknowledged that his efforts seemed to gain national interest when he zeroed in on the Senate race.“Yeah, I heard from a lot of people in D.C. at that point in time,” Mr. Hertz said. He added that he hadn’t spoken with Mr. Daines personally but had spoken with Mr. Thielman repeatedly about the status of the bill.A spokesman for the N.R.S.C., Mike Berg, declined to comment on Mr. Thielman’s involvement.“The optics of the situation, I felt, were bad … I want to do it across the board,” said Jason Small, a Republican state senator who voted against the bill.Janie Osborne for The New York TimesMr. Hertz said that he thought the changes would help third parties. “This gives them an opportunity in the primary to win more votes. And if you have enough support, you will end up on the general ballot, and that will give you an opportunity to make your case to the voters of Montana.”A spokeswoman for Gov. Greg Gianforte declined to respond to questions, pointing to the governor’s brief statement at a news conference on Thursday.“A number of other states have tried things like this,” Mr. Gianforte said. “I think it’s kind of an interesting idea, but we won’t take a firm position until we actually see the final legislation.”Some Republican lawmakers who were supportive of the idea of a top-two election system balked when they saw that the proposal had been amended to apply only to the 2024 Senate election.“If we’re going to do a top-two primary, I’m all for it. I think it’s wonderful,” said Jason Small, a Republican state senator who voted against the bill. “The optics of the situation, I felt, were bad if we’re going to just single out one particular race and try it there. I want to do it across the board.”Some Republicans in the statehouse noted that the bill might not have much of an impact on the outcome. They cited a recent study by the election website FiveThirtyEight that found that Mr. Tester was likely to have prevailed in all of his elections even if the Libertarian candidate hadn’t run.The Tester campaign accused Montana Republicans of attempting a power grab.Republicans are “trying to change local election laws to look more like California’s in an attempt to gain political power for themselves,” said Shelbi Dantic, a spokeswoman for Mr. Tester’s re-election campaign.So far, no front-runner has emerged to challenge Mr. Tester in November. Republicans in Helena expect Representative Matt Rosendale, a conservative who voted to overturn the 2020 presidential election, to explore a run. Tim Sheehy, a wealthy businessman and military veteran, is being recruited by some Republicans in Washington to run, as first reported by Axios, though he has not made any formal announcement.As news about the bill spread around the state, Republican lawmakers said they were receiving calls and texts from constituents claiming an unease with the bill. Senator Jeff Welborn, a Republican state senator, noted that the complaints weren’t coming from just Democrats.Mr. Welborn said that he had received multiple text messages, including one from a constituent who said the bill amounted to election interference. “This guy also has Republican candidate signs in his yard,” Mr. Welborn said. “He saw this as a really, really bad look on Montana as a state for trying this one on.”Former Republican leaders in the state have also been vocal in their opposition.“It’s a horrible commentary about how you value the votes of your fellow citizens,” said Marc Racicot, a former Republican governor and former chair of the R.N.C. “They didn’t sign up as guinea pigs.”Republicans in favor of the bill said that they believed it would cut down on the interference by major parties with third-party candidates. The Labor Day kickoff of the general election.To such well-known mileposts of the political calendar, there must be added one more: talking with your family over the holidays about your next big campaign.A Who’s Who of American politics has said recently, when pressed if they would run for federal office in 2024, that they would hash it out with family members during the next two weeks. Democrat or Republican, whether testing a bid for Senate or aspiring to the White House, politicians have deflected, when asked if they’re jumping into a race, by resorting to nearly identical language.“It’ll be a discussion that I have with my family over the holidays,” Senator Jon Tester of Montana told “Meet the Press” when asked if he would seek re-election in 2024 to one of the Democratic Party’s most vulnerable seats.“I will spend the upcoming holidays praying and talking with my wife, family and close friends,” Representative Jim Banks of Indiana, chairman of the Republican Study Committee, said about a possible run for an open Senate seat.And Representative Ruben Gallego of Arizona, when asked on MSNBC if he would mount a 2024 challenge to Senator Kyrsten Sinema, who left the Democratic Party to become an independent, replied, “I’m going to listen to my family over the holidays — I have a big Latino family that’s going to come in over Christmas.”Everyone with a weighty political decision to make, it seems, is waiting for the end of the year to glean the opinions of a spouse, a wise uncle or a quixotic adolescent, solicited over mugs of eggnog or while trimming the tree with carols curated by Alexa. Political family summits are planned during holiday gatherings by President Biden as well as by potential Republican presidential hopefuls including Mike Pence, Nikki Haley and Larry Hogan.     A potential mess in Arizona was an unwelcome surprise for Democrats while they were still savoring their victories in 2022.When Senator Kyrsten Sinema left the Democratic Party last week, she didn’t just momentarily drive up antacid sales on Capitol Hill. She also raised the pressure on three especially vulnerable Democratic senators who are up for re-election in 2024, and are defending seats in states that have turned a shade of deep crimson since they were first elected to Congress.The 2024 map is daunting for Senate Democrats, and it will take all the political dexterity and luck they can muster to keep their 51-ish-seat majority — and then some. Twenty-three of the 33 seats up for grabs are held by Democrats or left-leaning independents. That list includes Montana, Ohio and West Virginia, where Donald Trump won in 2020 by 16, 8 and 29 percentage points.But daunting is not the same thing as impossible. Faced with steep odds in the past, Democrats have managed to find local causes to champion — remember Senator Tammy Baldwin of Wisconsin’s crusade against almond milk? — as they looked for ways to differentiate themselves from the national party. And their incumbents have proved doubters wrong in the past.“From 30,000 feet, it looks brutal, but as you get closer to the ground, I feel more optimistic about it,” said Jim Kessler, vice president for policy at Third Way, a center-left think tank. “If it’s mainstream versus extreme, we have a great shot.”For now, Democratic strategists are still poring over the results of the recent midterm elections, trying to gain a deeper understanding of what moved voters.One consensus viewpoint so far, at least among those I’ve spoken with: Democratic candidates earned just enough credit for trying to address inflation through moves like capping insulin prices to dull Republicans’ advantage on the economy. And they say that while abortion may not matter quite as much in the next election, the issue is not going away in 2024.Another lesson is crystal clear: Trump has become even more toxic to swing voters during his two years in exile. The latest evidence? A USA Today/Suffolk University poll shows Trump losing a hypothetical matchup with President Biden by nearly eight points.On the other hand, there are no signs that any of these three states have grown less difficult for Democrats over the last six years. It’s easy to forget that Barack Obama won Ohio twice, or that Montana had a Democratic governor as recently as 2021. Today, that feels like ancient history.Once Democrats turn to 2024 in earnest, their first and most important task will be ensuring that their incumbents run again. As for Republicans, they are still debating what went wrong this year, with much of the discussion centering on the mechanics of campaigns, like mail voting and ballot harvesting — rather than thornier issues, like abortion. At the same time, as G.O.P. candidates begin declaring their intentions, many are still treading cautiously when it comes to Trump.“Some of the primary noise on their side suggests they haven’t learned too much yet,” said J.B. Poersch, the president of Senate Majority PAC, a group closely associated with Senator Chuck Schumer. “There’s plenty of things for them to be nervous about.”The Democrats’ red-state defendersSo far, of the Democratic incumbents in those three states above, only Senator Sherrod Brown of Ohio has definitively said he’s in. Brown has demonstrated a unique knack for winning working-class voters, even as cultural factors start to outweigh economics. He won his race by nearly seven points in 2018, while Representative Tim Ryan lost to J.D. Vance this year by roughly the same margin — far less than other statewide candidates in Ohio, but hardly encouraging for Democrats.Republicans are lining up to take on Brown, notably State Senator Matt Dolan, who finished third in this year’s Senate primary behind Vance and Josh Mandel — both of whom aggressively courted Trump and his base.Dolan, whose family owns the Cleveland Guardians, is already exploring the boundaries of what constitutes acceptable criticism of Trump. “What we witnessed nationally should convince us the country is ready for substantive candidates, not personalities and election deniers,” he wrote in a recent email to Republican county chairs in Ohio. But he said he would support Trump if he were the nominee.Then there’s Senator Joe Manchin of West Virginia, who sounds intrigued by Sinema’s decision to become an independent. “I don’t know how you get more independent than I am,” Manchin told reporters at the Capitol on Monday. “I look at all of these things, I’ve always looked at all of these things. But I have no intention of doing anything right now.”Like most things Manchin, that answer was neither a yes nor a no. He added, “I’m not a Washington Democrat.”Manchin already has an official Republican challenger: Representative Alex Mooney, who has telegraphed his line of attack in an anti-Manchin ad that ran four months ago. At least two others have shown interest: Attorney General Patrick Morrisey, who ran against Manchin in 2018, and Gov. Jim Justice, who is term-limited.Montana is only slightly less intimidating terrain for Democrats. They lost both House races this year, while Republicans won a supermajority in the State Legislature.Senator Jon Tester of Montana is skilled at finding locally resonant issues to champion.Sarahbeth Maney/The New York TimesSenator Jon Tester has said he will make a decision about running again after the holidays, though he has told reporters he feels “very positively about my chances.” Tester, who heads home to his farm most weekends, is skilled at finding locally resonant issues to champion, such as federal support for rural hospitals or floodplain mapping.Tester allies point to an emerging dynamic on the Republican side that resembles what happened in many primaries in 2022: a race to the right.One possible contender is Representative Matt Rosendale, whom Tester defeated in 2018 and who is staking out a position as one of the holdouts to Representative Kevin McCarthy’s bid to become House speaker. Another is Representative Ryan Zinke, who resigned as Trump’s interior secretary amid a flurry of investigations into his conduct. He will return to Congress early next year after winning by just three points against Monica Tranel, a political novice, despite outspending her by two to one.The rest of the mapAt the moment, Democrats appear to have just two pickup opportunities, and neither looks especially promising: Florida and Texas.And even the seemingly more comfortable seats they hold, like Nevada and Pennsylvania, are not all that comfortable. Nevada was the closest of all the big Senate races this year, with Senator Catherine Cortez Masto winning by fewer than 8,000 votes.In Pennsylvania, Republicans are hoping that David McCormick, who lost narrowly to Dr. Mehmet Oz in the primary this year, will challenge Senator Bob Casey in 2024. Democrats saw McCormick, a former hedge fund executive with deep pockets and roots in Pittsburgh, as the more formidable potential opponent, and subtly tried to help Oz. McCormick is planning to release a book in March, “Superpower in Peril: A Battle Plan to Renew America,” that appears aimed at positioning him more squarely as a China hawk, shoring up a point of vulnerability that hurt him this year.“I’d be shocked at this point if he doesn’t run,” said Josh Novotney, a former aide to Senator Pat Toomey and a partner at SBL Strategies, a lobbying firm in Pennsylvania. But Novotney cautioned that if Trump were the nominee, it could doom Republicans’ chances of defeating Casey. In the 2022 Senate race, Oz was weighed down by Trump and by Doug Mastriano, the Republican nominee for governor, whose hard-line stances on abortion and embrace of election denialism repelled swing voters.Democratic senators are also up for re-election in Michigan and Wisconsin, where their chances look brighter. In 2018, Baldwin crushed her Republican opponent, Leah Vukmir, by nearly 11 points, while in Michigan, Senator Debbie Stabenow cruised to victory over John James, who opted to run for a House seat rather than face Stabenow again. This year, Gov. Gretchen Whitmer won re-election easily, while Democrats took full control of the State Legislature for the first time in 40 years.Sinema’s defection undeniably makes Democrats’ path more complicated. She has not said she is running, though many political observers suspect her decision to switch parties had to do with worries she would lose a Democratic primary. Neither of the two most prominent Democrats weighing a run, Representatives Ruben Gallego and Greg Stanton, has officially entered the race, however.Republicans in Arizona could nominate someone on the far right, such as Sheriff Mark Lamb, or a moderate like Karrin Taylor Robson, a lawyer who lost to Kari Lake in this year’s primary for governor. So although most analysts assume that a three-way race would help Republicans, there are too many variables to draw any firm conclusions — including whether there will even be a three-way race.For now, Democrats are philosophical about the 2024 landscape. “Every election,” Poersch said, “you’re testing: Have the rules changed, or are we playing by the same old rules?”What to readDespite modest improvements for Republicans in 2022, Democrats largely held onto their gains among suburban voters, particularly in battleground states, Trip Gabriel reports.Donald Trump’s family business lost a criminal contempt trial that was held in secret last fall, according to a newly unsealed court document and several people with knowledge of the matter.     How Jan. 6 Gave the 14th Amendment New Life

    Legal scholars say a long-forgotten provision of the Constitution could bar from office anyone who encouraged the Capitol riot.An obscure 19th-century provision of the U.S. Constitution that barred members of the Confederacy from holding political office is back in the national conversation — and some are hoping it can keep Donald J. Trump and his allies off the ballot.After the Civil War, Congress sought to remake the politics of the states they had just defeated on the battlefield. Fearing that the grandees of the Old South would slink back to power, they crafted Section 3 of the 14th Amendment, known as the Disqualification Clause.The provision applied to anyone who had previously taken an oath to support the Constitution and then either “engaged in insurrection or rebellion” against the United States or gave “aid or comfort to the enemies thereof.”The clause, tucked into an amendment better known for extending citizenship to African Americans, was largely an object of academic curiosity until last week. That’s when lawyers representing a group of North Carolina voters filed a novel legal challenge seeking to keep Representative Madison Cawthorn off the ballot this year.Cawthorn is a close ally of Mark Meadows, Trump’s former chief of staff, and has made comments suggesting he supported the Jan. 6 riot at the Capitol. The complaint alleged that his actions trigger the Disqualification Clause, making him ineligible to serve in Congress.Cawthorn has shrugged off the challenge.“Over 245,000 patriots from Western North Carolina elected Congressman Cawthorn to serve them in Washington,” said Luke Ball, a spokesman for Cawthorn. “A dozen activists who are comically misinterpreting and twisting the 14th Amendment for political gain will not distract him from that service.”For now, the challenge is on hold while redistricting litigation in the state plays out. But it’s likely to be just one of many similar actions to come.“Madison Cawthorn was the first, but it’s safe to say he won’t be the last,” Ron Fein, a lawyer for Free Speech for People, the group behind the complaint, said in an interview.An outside-in strategyWin or lose, the Cawthorn case could help investigators in Washington by unlocking new evidence about the North Carolina lawmaker’s activities related to Jan. 6. He might have to sit for a deposition and have to turn over, say, his phone and email records.As the litigation makes its way through the court system, it could also help clear up a few broader questions:Was Jan. 6 an “insurrection,” legally speaking?What does it mean to be “engaged” in insurrection, and what level of involvement triggers the Disqualification Clause?Does Congress need to pass a law or resolution to activate it?“Most people, me included, think it was an insurrection, but neither Congress nor the courts have made that official determination,” said Mark Graber, a legal historian at the University of Maryland.Laurence Tribe, an influential law professor at Harvard University, has held private conversations with several members of Congress on the topic as they puzzle through how statutes written in the 1860s might apply in an entirely new context. And while Tribe’s view is that Jan. 6 was indeed an insurrection, it is by no means obvious how courts will interpret the 14th Amendment without clearer signals from Congress.“You’re dealing with a very murky and open area of constitutional law,” Tribe said in an interview.Even one of the foremost experts on the Disqualification Clause, Gerard Magliocca of Indiana University, called it “vestigial” in a well-timed paper on the subject published in 2020 three weeks before Jan. 6. He has since become an advocate for applying it to disqualify Trump from running for president in 2024.“We have to dust it off,” said Representative Jamie Raskin, a Democrat of Maryland who has consulted with Tribe on the topic. “It hasn’t been used in more than a century.”In fact, it’s been used precisely once since the Reconstruction era — in the 1919 case of Victor L. Berger, a socialist from Wisconsin who was removed from Congress after being accused of harboring pro-German sympathies. Berger was later reinstated when the Supreme Court tossed out his conviction for espionage, on the grounds that the judge harbored an anti-German bias.Fox News weighs inFor now, the Disqualification Clause is getting more attention on Fox News than it is within Congress — driven almost entirely by a single tweet from Marc Elias, the Democratic Party’s top election lawyer, who had predicted the provision might soon arise in litigation.Tucker Carlson, the Fox News opinion host, held a nearly four-minute segment on Elias’s 38-word post.“So, if you don’t want to lose the Congress, just ban the other side from running,” Carlson said sarcastically, going on to compare the idea that Jan. 6 was an insurrection to a belief in U.F.O.s.“This would require establishing that such individuals supported an actual insurrection,” Laura Ingraham, Carlson’s Fox News colleague, said of the Elias tweet a day later. “Good luck with that.”Inside the committee investigating the Jan. 6 riot, however, the Disqualification Clause has not come up in any detail.Some Democratic lawmakers — including Raskin, Senator Tim Kaine of Virginia and a few others — did float the idea a year ago. At the time, they were searching for a way to hold Trump accountable that would require only a simple majority vote in the Senate.But when Democratic legal experts investigated the concept, they determined that the Disqualification Clause was not “self-executing” — that is, Congress would need to pass a law or resolution to use it and clarify how it applies today. One can’t just declare someone an insurrectionist, they decided; Congress has to create the legal infrastructure to try someone and give them due process before taking away their right to hold public office. That made it less attractive as an alternative to impeachment.Depending on what the Jan. 6 panel uncovers, it’s possible to imagine the committee will recommend punishing lawmakers who were somehow involved in the riot.
