    Texas Voting Bill Nears Passage as Republicans Advance It

    The bill, which includes some of the strictest voting measures in the country, would head to the desk of Gov. Greg Abbott if it passes. He is expected to sign it into law.The Republican-controlled Texas House of Representatives is poised to take up a bill on Sunday that would impose a raft of new voting restrictions in the state, moving a step closer to the expected full passage of what would be among the most far-reaching laws in Republicans’ nationwide drive to overhaul elections systems and limit voting.The bill, which passed the State Senate early Sunday, would tighten what are already some of the country’s strictest voting laws, and it would specifically target balloting methods that were employed for the first time last year by Harris County, home to Houston. In addition to banning drive-through voting and 24-hour voting, which were used by nearly 140,000 voters in Harris County during the 2020 election, the bill would prohibit election officials from sending absentee ballots to all voters, regardless of whether they had requested them; ban using tents, garages, mobile units or any temporary structure as a polling location; further limit who could vote absentee; and add new identification requirements for voting by mail. Partisan poll watchers would also have more access and autonomy under the bill’s provisions, and election officials could be more harshly punished if they make mistakes or otherwise run afoul of election codes and laws. The bill, which was hashed out in a closed-door panel of lawmakers over the past week as the spring legislative session neared its conclusion on Monday, was rushed to the State Senate floor late Saturday in a legislative power play orchestrated by Republican lawmakers and Lt. Gov. Dan Patrick. Suspending rules that require a bill to be public for 24 hours before a final vote, they set off hours of debate before the Senate passed the bill just after 6 a.m. on Sunday by an 18-to-13 vote. Democrats denounced the dark-of-night legislative maneuver on a measure that Senator Borris L. Miles, a Democrat from Houston, said people in his largely Black and Latino district called “Jim Crow 2.0.”“They do ask me, every time I’m in the neighborhood, is this 2021 or is this 1961?” Mr. Miles said on the Senate floor. “And why are we allowing people to roll back the hands of time?”The House, which did not move to suspend the 24-hour rule, is set to convene at 1 p.m. local time, and will debate the bill before voting on it. No further changes to the legislation can be made. Gov. Greg Abbott, a Republican, is widely expected to sign the bill. Texas is one of several Republican-led states — including Iowa, Georgia and Florida — that have moved since the 2020 presidential contest to pass new laws governing elections and restricting voting. Trump’s lies about a stolen election, and the party’s worries about a changing electorate that could threaten the G.O.P.’s longtime grip on power in places like Texas, the second-biggest state in the country.In a statement on Saturday, President Biden called the proposed law, along with similar measures in Georgia and Florida, “an assault on democracy” that disproportionately targeted “Black and Brown Americans.” He called on lawmakers to address the issue by passing Democratic voting bills that are pending in Congress. “It’s wrong and un-American,” Mr. Biden said. “In the 21st century, we should be making it easier, not harder, for every eligible voter to vote.”Republican state lawmakers have often cited voters’ worries about election fraud — fears stoked by Mr. Trump, other Republicans and the conservative media — to justify new voting restrictions, despite the fact that there has been no evidence of widespread fraud in recent American elections.And in their election push, Republicans have powered past the objections of Democrats, voting rights groups and major corporations. Companies like American Airlines, Dell Technologies and Microsoft spoke out against the Texas legislation soon after the bill was introduced, but the pressure has been largely ineffective so far.The final 67-page bill, known as S.B. 7, proved to be an amalgamation of two omnibus voting bills that had worked their way through the state’s Legislature. won Texas easily — Mr. Trump carried the state by more than 630,000 votes and the party maintained control of both chambers of the Legislature — turnout soared in cities and densely populated suburbs, which are growing increasingly Democratic. In Harris County, one of the biggest counties in the country, turnout jumped by nearly 10 percent.Republicans’ initial version of the bill put those densely populated counties squarely in the cross hairs, seeking to ban measures put in place during the 2020 election that helped turnout hit record numbers. The initial bill banned drive-through voting, a new method used by 127,000 voters in Harris County, as well as 24-hour voting, which was held for a single day in the county and was used by roughly 10,000 voters.While those provisions were left out of an earlier version of the bill as it made its way through the Legislature, they were reinstated in the final version of the bill, though the bill does allow for early voting to begin as early as 6 a.m. and continue until as late as 9 p.m. on weekdays. It also maintains at least two weekend days of early voting. More than any other state, Texas has also gone to great lengths to grant more autonomy and authority to partisan poll watchers. The observers have been a cornerstone of American voting for years, viewed as a watchdog for election officials, but their role has grown increasingly contentious, especially in Texas. Republican poll watchers have been egged on in particular by Mr. Trump, who implored them to go to major cities across the country and hunt for nonexistent voter fraud.Across Texas during the 2020 election, there was an increase in anecdotal complaints of aggressive poll watchers, often on the Republican side, harassing both voters of color and election officials.The new bill would make it a crime to refuse to admit the observers to voting sites or to block their ability to fully watch the process. It says poll watchers must be able to “sit or stand [conveniently] near enough to see and hear the election officers.”It would also make it easier for partisan poll watchers to successfully pursue legal action if they argue that they were wrongfully refused or obstructed.In addition, the bill would limit who can vote absentee by mail in Texas, which does not have universal, no-excuse absentee voting. The bill states that those with a disability may vote absentee, but a voter with “an illness, injury or disability that does not prevent the voter from appearing at the polling place on election day” may not do so.Amid the new restrictions are multiple provisions that provide greater transparency into election administration. Counties must now provide video surveillance of ballot-counting facilities, and they must eventually make those videos available to the public. Discussions with voting equipment vendors must also be available to the public.During the debate before Sunday’s vote in the State Senate, Senator Royce West, a Democrat from Dallas, raised concerns that a provision barring voting before 1 p.m. on Sundays would limit “souls to the polls” organizing efforts that are popular with Black churches. Mr. Hughes said that clause was intended to allow poll workers to go to church.Mr. West noted that a separate bill passed by the Legislature will allow the sale of beer and wine starting at 10 a.m., two hours earlier than current law permits.“We’re going to be able to buy beer at 10 o’clock in the morning, but we can’t vote until one o’clock,” Mr. West said.Austin Ramzy and Anna Schaverien contributed reporting.     ‘It’s easy to dismiss Black women’s lives’: Texas drags feet on maternal mortality crisis

    When medical staff prepped Shawn Thierry for an emergency C-section, she knew something was very wrong. After an epidural, excruciating pain ran through her legs. Soon, she could barely breathe.“I felt like my heart was going to jump out of my chest and that I might die,” she said.She screamed for her doctor to put her under anesthesia – which happened to be the solution. The epidural, Thierry later found out, was given too high in her spine, causing a paralysis that inched toward her heart.“I was an attorney who had full private healthcare coverage and I almost died,” said Thierry, of the birth of her daughter in 2012. “I cannot imagine what the outcome would be for the thousands of other African American women without health insurance.”Years later, as a member of the Texas House, Thierry was “stunned” to learn of the state’s maternal mortality crisis.The US has the highest maternal death rate among similarly developed countries and is the only industrialized nation where such deaths are rising. But according to data from the federal Centers for Disease Control and Prevention, in Texas the maternal mortality rate is above the US average, at 18.5 deaths per 100,000 live births.Black women in the state are “disproportionately” affected, accounting for 11% of live births but 31% of maternal deaths. Wide racial and ethnic disparities exist nationally too.I was shocked that black mothers like myself are three times more likely to die than our white counterparts“I was shocked that black mothers like myself are three times more likely to die than our white counterparts,” said Thierry. “And no one in the legislature was really talking about it.”She has repeatedly filed legislation to combat the glaring problem. Her proposals included racial bias training for medical professionals and a bill to fix a “severe” maternal health data backlog by creating a centralized registry.They did not advance in 2019, or in the current legislative session which ends this weekend. Focused on restricting abortion rights, the male- and Republican-dominated state legislature has dragged its feet on maternal mortality.Health advocates were cautiously optimistic that in 2021 Texas lawmakers would at least usher through a proposal to extend Medicaid care to a year after birth.Lawmakers did take action. A proposal was sent to Governor Greg Abbott on Friday. But it stopped short of providing the full Medicaid expansion.‘A large racial disparity’A state maternal mortality and morbidity review committee found that out of pregnancy related deaths in Texas in 2013, about a third occurred 43 days to a year after the end of pregnancy. It also discovered that nearly 90% of such deaths were preventable. Among the leading underlying causes of death with the highest chance of preventability were infection, hemorrhage, preeclampsia and cardiovascular conditions.“It was really striking,” said Dr Amy Raines-Milenkov, a University of North Texas Health Science Center professor and member of the review committee. “We found that most of these deaths could have been prevented but the system is just not set up to prevent them. And we found a large racial disparity, which is a reflection of how we in society value women, especially African American women.”Since 2016, the committee’s No1 recommendation to help save lives has been to extend Medicaid coverage postpartum for low-income mothers to a year. Currently, Texas kicks new moms off Medicaid after 60 days, leading to delayed and less preventative care. The American Medical Association and the American College of Obstetricians and Gynecologists support longer postpartum care.“So many health problems can develop in this really sensitive time period, so it is critical that new moms have that full year of extended coverage,” said Raines-Milenkov. “To think new mothers can identify problems, get timely appointments and follow up with their doctors within just two months of having a baby is unrealistic. Anything less than 12 months is really insufficient.”The Biden administration recently initiated incentives for states to expand postpartum coverage to 12 months. Illinois was the first to have its extension approved and other states including Florida and Virginia hope to implement measures soon.Toni Rose, a Dallas representative, joined Thierry in filing HB 133, to do just that in Texas. The Republican-dominated House passed the bill with rare bipartisan approval and nearly 70 groups, from the Texas Medical Association to the rightwing Texas Public Policy Foundation, expressed support.When it comes to saving the lives of Texas mothers, ‘splitting the difference’ is not appropriateHowever, the ultra-conservative Texas Senate – which ushered through extremist anti-abortion bills in March – did not pass the bill until the final minutes of its session. Even then, the legislation was not what was proposed. Without explanation, Republican Lois Kolkhorst of Brenham reduced the year of coverage to six months.Rose called the legislation a “victory” but said it still “falls short”. Thierry expressed dismay.“The data is clear that women are still at risk of maternal mortalities and pregnancy related complications for up to one year postpartum,” she said. “While the six months negotiated by the Texas Senate is better than the status quo, many new mothers will still be deprived of quality healthcare at a time when they are most vulnerable.“Given that this is an issue in which I have both personal and professional experience, I am disappointed. When it comes to saving the lives of Texas mothers, ‘splitting the difference’ is not appropriate.”Marsha Jones, executive director of the Afiya Center, a Dallas group that supports Black women with reproductive healthcare, said the lack of substantial progress was partly a reflection of the legislature’s misplaced priorities and lack of diversity.The Texas legislature is comprised mostly of white males: 61% of lawmakers in the House and Senate are white, even though white Texans make up just 41% of the population. Women are vastly outnumbered by men.“Black women are dying at an alarming rate for reasons that could be prevented and our state leaders cut down the main proposal that a state-appointed committee recommended to help them – why would that even happen?” said Jones. “I think it’s because it’s so easy to dismiss Black women’s lives.”The legislature expended time and energy on restricting abortion access, including passing one of the most extreme bans in the country, which allows any citizen to sue an abortion provider, as well as a “trigger” bill that bans the procedure in the event Roe v Wade, the 1973 ruling which safeguards the right to abortion, is overturned by the US supreme court.Both measures were “top legislative priorities” for the Senate leader, Lt Gov Dan Patrick, who did not make maternal mortality a listed priority.“It seems the only time we want to stand up and care about a life is when it’s in the womb,” Rose told Republicans on the House floor in May.‘Women are obviously choosing a life’In an ideological quest to punish abortion affiliates, Republicans have decimated the Texas reproductive health safety net by blocking low-income Medicaid patients from receiving life-saving preventative care at Planned Parenthood, a move resulting in reduced access to contraception and increased rates of Medicaid births, according to the Texas Policy Evaluation Project.A recent study in the medical journal Contraception showed a correlation between high maternal mortality rates and states that pass abortion barriers.“We have a maternal health crisis and conservative legislators once again made anti-choice bills a priority,” said Thierry. “They fail to realize all the women threatened by maternal deaths are obviously choosing life – they shouldn’t have to do so in exchange for their own.”Lawmakers made no significant gains for Medicaid in general. Texas is home to the highest number of uninsured residents in the US as well as the highest percentage of uninsured women of childbearing age, but it has declined to expand Medicaid under the Affordable Care Act and Republicans blocked legislative efforts to help extend healthcare coverage for the working poor.Texas has one of the steepest Medicaid eligibility requirements in the US. Of 1.4 million Texans who would benefit from expanded Medicaid, 75% are people of color.“Once again, we are kicking the can down the road with many of these solutions,” said Thierry. “It’s absolutely imperative we continue to work on reducing maternal mortality. report pointed to the vast sweep of Republicans’ nationwide effort to restrict voting.As of May 14, lawmakers had passed 22 new laws in 14 states to make the process of voting more difficult, according to the report by the Brennan Center for Justice, a research institute.In last year’s election, while Republicans won Texas easily — Mr. Trump carried the state by more than 630,000 votes and the party maintained control of both chambers of the Legislature — turnout soared in cities and densely populated suburbs, which are growing increasingly Democratic. In Harris County, one of the biggest counties in the country, turnout jumped by nearly 10 percent.Republicans’ initial version of the bill put those densely populated counties squarely in the cross hairs, seeking to ban measures put in place during the 2020 election that helped turnout hit record numbers. The initial bill banned drive-through voting, a new method used by 127,000 voters in Harris County, as well as 24-hour voting, which was held for a single day in the county and was used by roughly 10,000 voters.While those provisions were left out of an earlier version of the bill as it made its way through the Legislature, they were reinstated in the final version of the bill, though the bill does allow for early voting to begin as early as 6 a.m. and stay open as late as 9 p.m. on weekdays. It also maintains at least two weekend days of early voting. More than any other state, Texas has also gone to great lengths to grant more autonomy and authority to partisan poll watchers. The observers have been a cornerstone of American voting for years, viewed as a watchdog for election officials, but their role has grown increasingly contentious, especially in Texas. Republican poll watchers have been egged on in particular by Mr. Trump, who implored them to go to major cities across the country and hunt for nonexistent voter fraud.Across Texas during the 2020 election, there was an increase in anecdotal complaints of aggressive poll watchers, often on the Republican side, harassing both voters of color and election officials.The new bill would make it a crime to refuse to admit the observers to voting sites or to block their ability to fully watch the process. It says poll watchers must be able to “sit or stand [conveniently] near enough to see and hear the election officers.”It would also make it easier for partisan poll watchers to successfully pursue legal action if they argue that they were wrongfully refused or obstructed.In addition, the bill would limit who can vote absentee by mail in Texas, which does not have universal no-excuse absentee voting. The bill states that those with a disability may vote absentee, but a voter with “an illness, injury or disability that does not prevent the voter from appearing at the polling place on election day” may not vote absentee.Amid the new restrictions are multiple provisions that provide greater transparency into election administration. Counties must now provide video surveillance of ballot-counting facilities, and they must eventually make those videos available to the public.     ‘Wrong and un-American’: Biden blasts Texas Republicans’ SB7 voting bill

    Joe Biden has condemned as “wrong and un-American” a Texas state bill set to pass into law which the president said “attacks the sacred right to vote”, particularly among minorities.The bill, known as SB7, clamps down on measures such as drive-through voting and voting on Sundays. It would also empower partisan poll-watchers. Greg Abbott, the Republican governor of Texas, has said he will sign it. Democrats have said they will challenge it in court.The bill follows moves in other Republican-controlled states which sponsors insist merely seek to guard against voter fraud but which are seen by most analysts to be aimed at restricting voting by sections of the population which tend to vote Democratic.According to the New York-based Brennan Center for Justice, nearly 400 such bills have been filed this year across the US, in 14 states.Biden has already blasted such measures, for instance calling laws in Georgia “Jim Crow in the 21st century”, a reference to the system of racist segregation which remained in place for 100 years after the civil war.As in other states, major corporations have warned Texas that SB7 could harm democracy and the economy.     Three years after becoming the Democrats’ breakout star in Texas and a year after a short-lived presidential run, Beto O’Rourke is weighing a campaign for governor.But amid considerable noise about the intentions of the actor Matthew McConaughey, whose political affiliations are unknown but whose ambitions are coming into focus, O’Rourke is staying quiet.     ‘We’re gonna win the second half’: the Texas Democrat eyeing 2022 victory

    No football team ever lost a game, says Mike Collier. The players just ran out of time.In 2018, Collier tried to unseat the Republican incumbent, Dan Patrick, as Texas’s lieutenant governor, arguably the most powerful role in state government. He watched poll numbers trend closer and closer – until Patrick bested him by just under five points.But Collier – a Democrat – isn’t jaded enough to turn his back on what he thinks is a winnable fight. And to him, the game’s just getting started.“We came out of the first half down by a field goal,” he told the Guardian. “Now, we’re gonna go win the second half.”When Collier was a teenager, his family moved to a small town just north of Austin. Although he decried how racism pervaded (and still pervades) much of America, he’s nostalgic for the days when Texans were at least bound by civility and preparing for the future.“The Texas that I remember then was progressive,” Collier says. “But it was a Texas-progressive, in the sense that, you know, people could do their own thing.“They could be free.”An accountant, auditor and energy expert by trade, Collier is more sports analogist and goofball than political insider. His endearing drawl sounds like a habit rather than an act, and he seems happiest poking fun at his 27-year-old son or telling dad jokes.But, as he sets his sights on next year’s lieutenant governor race, Collier isn’t kidding around.“A Democrat beats Dan Patrick, and suddenly everybody behaves differently, particularly if that Democrat brings to it our Texas values – which I do – as a Democrat, and we roll up our sleeves and start solving problems honestly,” he says.“I think it’ll change everything.”He’s not wrong.As the second most populous state, Texas accounts for 38 electoral college votes and just added two more congressional seats after last year’s census. It’s home to one of the most powerful constituencies in the union, a bloc that’s handed Republicans control over every lever of state government – at least for now.But Texas’s demography is trending younger and more diverse, generating buzz over a potential uptick in more liberal voters. A Collier victory could represent the first ripple in a blue wave that Democrats have been promising for years now.That, in turn, would transform federal politics.Next year’s election could also lead to the ousting of a conservative firebrand whose political reign has further aligned Texas with xenophobia, conspiracy theories and Trumpism. Patrick, once an outsider himself, has spent years deeply entrenched in the highest rungs of state government, pushing its politics past even his own Tea Party inclinations.After chairing Donald Trump’s Texas campaigns, Patrick has already been endorsed by the former president ahead of 2022. Trump’s support earlier this month was a much-needed boost for the beleaguered state executive, whose approval ratings plummeted to a measly 35% in April, according to the Texas Politics Project.But while Patrick was focused on Trump, Collier worked hard to elect Joe Biden last year. He endorsed Biden early in the primary season, then took on a series of duties – including a senior adviser role – to help his campaign.Collier remembers watching Biden’s launch video in 2019, during a terrible day at an energy conference. The minutes-long clip described a battle for the soul of the nation, with footage of neo-Nazis marching through Charlottesville.“Tears came to my eyes,” Collier says. “I said, ‘this is exactly what’s happening in my America.’”Much like Biden, Collier readily admits that he’s old, has white hair and wears Ray-Bans – pure coincidence, he says. And much like Trump, Patrick is the consummate showman, with an eclectic life story that’s seen biblical highs and lows.Patrick, né Goeb, went from popular sportscaster to bankrupt businessman, then eventually garnered a following as a middle-aged talkshow host. But by the mid-2000s, he settled on a career in public service, eventually ascending to the lieutenant governorship after several terms in the state senate.Now, he relies on his flair for the dramatic – used in another life to get through an on-air vasectomy – to push his conservative agenda.Patrick proudly frequents Fox News segments, where he makes sensationalized claims about the US-Mexico border and spews vitriol about immigrants, one in six of all Texans. In the early days of the coronavirus pandemic, he raised eyebrows after making clear that he valued a healthy economy over human life – even his own.“No one reached out to me and said, ‘As a senior citizen, are you willing to take a chance on your survival in exchange for keeping the America that all America loves for your children and grandchildren?’” he told the Fox News host Tucker Carlson. “And if that’s the exchange, I’m all in.”At times, the bellicose Patrick appears to be waging war against himself. After eight students and two teachers were massacred in a mass shooting at Santa Fe high school outside of Houston in 2018, he personally offered to donate up to 10 metal detectors for the district.But this year, that empathy ran dry when he pushed the legislature to allow Texans to carry a gun with no permit, a policy opposed by the majority of voters.“Our politics reflects the point of view of a very, very small minority of Texans,” Collier says, and Patrick “panders over there to a small crowd that don’t represent our values”.Collier’s vision of Texas is much different. He imagines a state that leads the charge against a global climate crisis, where kids line up to get into the public schools instead of trying to find any way out of them.He knows that too many young, Black men are languishing behind bars. And he doesn’t think hospital closures in Texas’s rural communities should force pregnant people to drive an hour and a half just to find an OB-GYN.“We’re a wealthy nation. We’re a wealthy state.     The actor Matthew McConaughey appears to be seriously considering entering politics, according to a report on Sunday which said the Dallas Buyer’s Club star has been “quietly making calls to influential people in Texas political circles” as he mulls a run for governor.McConaughey, 51, was born in Uvalde, Texas, and lives in Austin, the state capital, with his wife and children. Last year he published an autobiography of sorts and in March he told a Texas podcast running for governor was “a true consideration”.“I’m looking into now again, what is my leadership role?” he said. “Because I do think I have some things to teach and share, and what is my role? What’s my category in my next chapter of life that I’m going into?”Brendan Steinhauser, an Austin-based Republican strategist, told Politico, which reported the McConaughey calls, he was “a little more surprised that people aren’t taking him more seriously, honestly.“Celebrity in this country counts for a lot … it’s not like some C-list actor no one likes. The reality TV star Caitlyn Jenner is in the early – if faltering – stages of a run in California, as Republicans seek to recall Gavin Newsom.The Republican governor of Texas, Greg Abbott, will seek a third term next year. He remains a formidable figure, despite controversy over his handling of a winter storm earlier this year which crippled the power grid, left 125 Texans dead and made state Republicans a national laughing stock.Reagan, Schwarzenegger, Trump and Jenner ran as Republicans. Ventura was the candidate of the Reform Party, his victory a major shock.McConaughey’s views are mostly a mystery. Karl Rove, a senior adviser to the last governor of Texas to become president, George W Bush, told Politico he found a McConaughey run “improbable, but not out of the question” and said “the question is: Would he run as a Republican? A Democrat? Independent? And where is he on the political scale?“He says he has a funny phrase about being a hardcore centrist, but what party would he run under?”Democratic hopes of turning Texas blue – or at least purple, away from its baked-in ruby red Republicanism – have continually come up short.In 2018, Beto O’Rourke, a congressman, made national headlines but failed to eject Ted Cruz from the US Senate. In 2020 the state’s other Republican senator, John Cornyn, also survived a much-hyped challenge.Earlier this month a long slate of Democratic candidates in a race for an open US House seat effectively cancelled each other out, two Republicans making the runoff.O’Rourke failed to parlay his fame into a successful presidential run and has yet to say if he will seek to challenge Abbott. Julián Castro, a former mayor of San Antonio, US housing secretary and candidate for the Democratic nomination, could also run.McConaughey’s star status is proving a considerable lure for progressives but many fear a run as an independent.
