    With DeSantis Reeling, What About Tim Scott?

    Last Sunday, I argued that despite his stagnation in the polls, for Republicans (and non-Republicans) who would prefer that Donald Trump not be renominated for the presidency, Gov. Ron DeSantis of Florida remains pretty much the only possible alternative.Naturally the week that followed was the worst yet for DeSantis, beginning with a campaign staff purge that featured a Nazi-symbol subplot and ending with the candidate doing damage control for his suggestion that Robert F. Kennedy Jr. might run his Food and Drug Administration.The worst news for DeSantis, though, was new polls out of Iowa showing Senator Tim Scott of South Carolina creeping up on him, with around 10 percent support, to the governor’s roughly 15 percent.One of my arguments a week ago was that no other Republican, Scott included, had yet shown any capacity to build the support that even a stagnant DeSantis enjoys. But if the governor falls into a sustained battle for second place, he’s probably finished, and Trump can probably just cruise.Unless that battle results in a DeSantis collapse and a chance for someone else to go up against the front-runner. After all, why should DeSantis be the only non-Trump hope just because he seemed potent early on? Why not, well, Tim Scott?Say this for Scott: He has an obvious asset that DeSantis is missing, a fundamental good cheer that Americans favor in their presidents. Say this as well: He has the profile of a potent general-election candidate, an African American and youthful-seeming generic Republican to set against Joe Biden’s senescence. Say this, finally: Scott sits in the sweet spot for the Republican donor class, as a George W. Bush-style conservative untouched by the rabble-rousing and edgelord memes of Trump-era populism.But all of these strengths are connected to primary-campaign weaknesses. To beat Trump, you eventually need around half the Republican electorate to vote for you (depending on the wrinkles of delegate allocation). And there’s no indication that half of Republican primary voters want to return to pre-2016 conservatism, that they would favor a generic-Republican alternative to Trump’s crush-your-enemies style or that they especially value winsomeness and optimism, as opposed to a style suited to a pessimistic mood.The reason that DeSantis seemed like the best hope against Trump was a record and persona that seemed to meet Republican voters where they are. His success was built after Trump’s election, on issues that mattered to current G.O.P. voters, not those of 30 years ago. He could claim to be better at the pugilistic style than Trump — with more to show for his battles substantively and more political success as well. On certain issues, Covid policy especially, he could claim to represent the views of Trump’s supporters better than Trump himself. And with DeSantis’s war on Disney, nobody would confuse him for a creature of the donor class.All this set up a plausible strategy for pulling some Trump voters to DeSantis’s side by casting himself as the fulfiller of Trump’s promise — more competent, more politically able, bolder, younger and better suited to the times.This strategy was working five months ago, and now it’s failing. But its failure doesn’t reveal an alternative pitch, and certainly Scott doesn’t appear to have one. Indeed, as The Bulwark’s Jonathan Last points out, Scott isn’t really casting himself as a Trump alternative; he’s mostly been “positioning himself as an attractive running mate for Trump, should the Almighty not intervene” and remove the former president from the race.So for him to surpass DeSantis and become Trump’s main adversary could be what Last describes as a “catastrophic success.” It might lead to a weird sacrificial-lamb campaign, in which Scott contents himself with the quarter of the primary electorate that currently supports him in head-to-head polling against Trump. Or it could push him to come up with a pitch to be Trump’s successor. But it’s hard to see what would make that pitch stronger than the one that isn’t currently working for DeSantis.After all, the governor has a substantial record of policy victories; Scott has rather fewer. DeSantis has been successful in a contested political environment; Scott is a safe-seat senator. DeSantis was arguably as important a Republican as Trump during the crucial months of the Covid era; Scott was insignificant. DeSantis has struggled to expand his policy pitch beyond Covid and anti-wokeness; Scott doesn’t even have that kind of base to build on.For DeSantis to defeat Trump would make sense in light of the G.O.P. landscape as we know it. For Scott to win would require a total re-evaluation of what we think we know about Republicans today.Such re-evaluations happen, or else Trump himself wouldn’t have been president. Success creates unexpected conditions; if Scott surpasses DeSantis, he will have the chance to make the most of them.But for now, his climb in the polls looks like a modest victory for his own campaign and a bigger one for Trump’s.The Times is committed to publishing a diversity of letters to the editor.     For Republican Candidates, Iowa G.O.P. Dinner Is a Hands-Off Trump Event

    Almost every one of the former president’s 13 rivals who attended declined to go after the primary’s front-runner. He did not return the favor.Candidate after candidate at an Iowa Republican dinner on Friday avoided so much as mentioning the dominant front-runner in the race, former President Donald J. Trump.But when Mr. Trump took the stage after more than two hours of speeches by his lower-polling rivals, it took him less than three minutes to unleash his first direct attack of the night on his leading challenger, Gov. Ron DeSantis of Florida.Mr. Trump not only suggested that Mr. DeSantis was an “establishment globalist” but called him “DeSanctis,” which in Mr. Trump’s argot is short for the demeaning nickname DeSanctimonious and is so well-known that most attendees clearly got the reference. “I wouldn’t take a chance on that one,” Mr. Trump joked.The crowd of more than 1,200, which had warmly welcomed Mr. DeSantis when he spoke earlier, laughed and applauded throughout Mr. Trump’s riffs.In contrast, Mr. DeSantis hadn’t mentioned the former president at all. The one speaker who did criticize Mr. Trump, former Representative Will Hurd of Texas — who is so far from contention that he’s not even attempting to qualify for the first Republican debate next month — was booed off the stage.The dinner served as yet another reminder of Mr. Trump’s hold over Republican voters, despite his loss in 2020, the party’s struggles in the 2022 midterms and the weighty criminal charges he faces.Gov. Ron DeSantis of Florida is running a distant second in the polls, well behind the former president.Jordan Gale for The New York TimesHosted by the Republican Party of Iowa, the event brought together 13 candidates for the nomination, from Mr. Trump to challengers like Mr. DeSantis, Sen. Tim Scott of South Carolina and former Gov. Nikki Haley of South Carolina. Also appearing were former Vice President Mike Pence, the entrepreneur Vivek Ramaswamy and long shots such as the media commentator Larry Elder, who, in keeping with the general theme of the evening, referred to himself as a “Trump clone.”Each candidate spoke for 10 minutes to attendees at an event center in Des Moines, with Mr. Trump the last to appear. Organizers had said they would cut off the microphone of anyone who went over the time limit.They proved as good as their word when the evening’s second speaker, former Gov. Asa Hutchinson of Arkansas, breached the 10-minute mark and had to deliver the final words of his speech to a dead microphone with the country song “Only in America” playing loudly over him. (Mr. Hutchinson is polling at around 1 percent.)As the race takes shape five months ahead of the crucial Iowa caucuses, Mr. Trump is surging ahead of a fractured field of rivals who are largely reluctant to criticize him, cowed by his fiercely loyal base.But Mr. Trump’s legal troubles could still provide an opening for one of his rivals. The former president has now been indicted twice, and major new charges were added to one of those cases on Thursday. He also is expected to face two additional criminal cases. So far, however, the charges against him have seemed to coalesce Republican voters around his candidacy At the dinner, only Mr. Hurd, a former C.I.A. officer, dared to mention the charges, and he also contradicted Mr. Trump’s false assertion that he had won the 2020 election.“One of the things we need in our elected leaders is for them to tell the truth, even if it’s unpopular,” Mr. Hurd said. “Donald Trump is not running to make America great again. Donald Trump is not running for president to represent the people that voted for him in 2016 or 2020. Donald Trump us running to stay out of prison.”The vast majority of the crowd did not agree. Boos rang out, and some attendees clattered their silverware to drown him out, a stark illustration of the risks of going after the former president.“Thank you, Will,” said the next speaker, Mayor Francis Suarez of Miami. “You just made it very easy for me.”Still, some voters said they had appreciated Mr. Hurd’s willingness to walk into the lion’s den.“I honestly think that it took a lot of courage to say what he said about Trump at the end of there,” said Caden Mohr, 19, an educator from Eagle Grove, Iowa, who is leaning toward supporting Mr. Trump.But beyond that tense moment, even veiled references to Mr. Trump were rare.In one instance, Mr. Pence, who served as Mr. Trump’s vice president but fell out with him — and his base — over the Jan. 6 storming of the Capitol, warned voters to “resist the politics of personality and the siren song of populism unmoored from conservative values.”Gov. Kim Reynolds, a Republican who received a standing ovation when her name was mentioned by another speaker for the first time. Mr. Trump has also skipped events held by influential evangelical Christian leaders.Mr. DeSantis, in particular, has sought to capture the state’s evangelical voting bloc, running to Mr. Trump’s right on social issues and hitting him on his past support for gay rights. After fund-raising struggles and staff layoffs, Mr. DeSantis chose to begin a “reset” of his campaign with an Iowa bus tour this week.“We’re doing all 99 counties in Iowa,” Mr. DeSantis told the crowd, which gave him a deafening standing ovation as he concluded his remarks. “You’ve got to go meet the folks, so you’ll see me everywhere.”But Mr. Trump continues to hold a commanding lead in Iowa polls. A recent survey by Fox Business showed him leading the field with 46 percent of the vote, followed by Mr. DeSantis at 16 percent and Mr. Scott at 11. This week, Mr. DeSantis and Mr. Scott tussled over how the history of slavery is taught in Florida schools, as Mr. Scott seeks to supplant Mr. DeSantis as the leading alternative to the former president.Sen. Doug Burgum of North Dakota, the pastor Ryan Binkley and the businessman Perry Johnson.The crowd’s attention clearly drifted depending on the speaker.When Mr. Johnson mounted the stage an hour into the dinner, dozens of attendees left their tables, presumably to visit the bar or use the bathroom.One of the biggest standing ovations of the night was saved for Mr. Ramaswamy, a wealthy political newcomer who is campaigning aggressively in the early nominating states and on Friday promised that he stands for “revolution,” not reform.Teresa and David Hoover, a married couple from Marshalltown, Iowa, emerged captivated by Mr. Ramaswamy, saying he had a unique message for reaching future generations.“When we talk to our kids and our grandkids, he’s right on the money — they’re lost,” Ms. Hoover, 65, said. “They need to know what it means to be Americans again.”After the speeches, the campaigns hosted guests in hospitality suites.In Mr. DeSantis’s suite, staffers for his super PAC set up pyramids of cans of Bud Light, a company the governor has attacked for a marketing campaign that featured a transgender social media influencer.The beers weren’t for drinking.     New Trump Charges Highlight Long-Running Questions About Obstruction

    The accusation that former President Donald J. Trump wanted security camera footage deleted at Mar-a-Lago added to a pattern of concerns about his attempts to stymie prosecutors.When Robert S. Mueller III, the first special counsel to investigate Donald J. Trump, concluded his investigation into the ties between Mr. Trump’s 2016 campaign and Russia, his report raised questions about whether Mr. Trump had obstructed his inquiry.Justice Department officials and legal experts were divided about whether there was enough evidence to show Mr. Trump broke the law, and his attorney general — chosen in part because he was skeptical of the investigation — cleared him of wrongdoing.Four years after Mr. Mueller’s report was released, Jack Smith, the second special counsel to investigate Mr. Trump, added new charges on Thursday to an indictment over his handling of classified documents, setting out evidence of a particularly blatant act of obstruction.The indictment says that just days after the Justice Department demanded security footage from Mar-a-Lago, his residence and private club in Florida, Mr. Trump told the property manager there that he wanted security camera footage deleted. If proved, it would be a clearer example of criminality than what Mr. Mueller found, according to Andrew Goldstein, the lead investigator on Mr. Mueller’s obstruction investigation.“Demanding that evidence be destroyed is the most basic form of obstruction and is easy for a jury to understand,” said Mr. Goldstein, who is now a white-collar defense lawyer at the firm Cooley.“It is more straightforwardly criminal than the obstructive acts we detailed in the Mueller report,” he said. “And if proven, it makes it easier to show that Trump had criminal intent for the rest of the conduct described in the indictment.”The accusation about Mr. Trump’s desire to have evidence destroyed adds another chapter to what observers of his career say is a long pattern of gamesmanship on his part with prosecutors, regulators and others who have the ability to impose penalties on his conduct.And it demonstrates how Mr. Trump viewed the conclusion of the Mueller investigation as a vindication of his behavior, which became increasingly emboldened — particularly in regards to the Justice Department — throughout the rest of his presidency, a pattern that appears to have continued despite having lost the protections of the office when he was defeated in the election.In his memoir of his years in the White House, John R. Bolton, who served as Mr. Trump’s third national security adviser, described Mr. Trump’s approach as “obstruction as a way of life.”In the hours after the new charges became public, Mr. Trump, whose advisers have been blunt that he must win the election to overcome his legal challenges, highlighted the stakes for him of the 2024 election.He suggested in an interview with a right-wing news site that if he is elected, he will use the powers of the presidency to insulate himself from legal accountability on the documents case and the other inquiry being conducted by Mr. Smith into Mr. Trump’s efforts to retain power after his 2020 election loss.Jack Smith, the second special counsel to investigate Mr. Trump, added new charges on Thursday.Kenny Holston/The New York Times“I wouldn’t keep him,” Mr. Trump told Breitbart, the news site, in response to a question about whether he would fire Mr. Smith. “Jack Smith? Why would I keep him?”The new charges show how even in the face of Justice Department scrutiny into whether he still had classified documents in his possession, Mr. Trump has continued to try to find ways to upend its investigation.In June of last year, in the midst of its efforts to retrieve classified material Mr. Trump had taken from the White House upon leaving office, the Justice Department served a grand jury subpoena on Mr. Trump’s organization for surveillance footage from Mar-a-Lago that would show how boxes of the documents had been handled, especially around a storage room where many of them had been stashed.Shortly after the Trump Organization received the subpoena, the revised indictment said, the former president called Mar-a-Lago’s property manager and head of maintenance, Carlos De Oliveira. The two men spoke for 24 minutes, prosecutors say.Two days later, Mr. De Oliveira and another defendant in the case, Mr. Trump’s valet, Walt Nauta, “went to the security guard booth where surveillance video is displayed on monitors, walked with a flashlight through the tunnel where the storage room was located, and observed and pointed out surveillance cameras.”Days later, Mr. De Oliveira had a private conversation with the Mar-a-Lago employee in charge of the surveillance footage. The conversation was supposed to “remain between the two of them,” according to the charging document.Mr. De Oliveira told the employee that “‘the boss’ wanted the server deleted,” the indictment said.The employee in charge of the footage said “that he would not know how to do that, and that he did not believe that he would have the rights to do that.”But Mr. De Oliveira continued to push, asking, “What are we going to do?” (The Trump Organization ultimately turned over security footage, but, as The New York Times reported in May, investigators became suspicious about whether someone in Mr. Trump’s orbit tried to limit the amount of footage given to the government.)The indictment says that after the Justice Department demanded security footage from Mar-a-Lago, Mr. Trump told the property manager there that he wanted security camera footage deleted.Saul Martinez for The New York TimesThe updated indictment also demonstrates how Mr. Trump, in the aftermath of the search of Mar-a-Lago last August, turned to an issue that he obsessed about in the White House: loyalty.“Someone just wants to make sure Carlos is good,” the indictment quoted Mr. Nauta as saying about Mr. De Oliveira to another Trump employee.That employee told Mr. Nauta that Mr. De Oliveira was “loyal” and “would not do anything to affect his relationship with Mr. Trump.”Shortly after that exchange, Mr. Trump called Mr. De Oliveira and said that he would get him a lawyer, the indictment said. Legal fees for Mr. De Oliveira, Mr. Nauta and other Trump employees who have become witnesses or defendants in the documents case are being paid by a political action committee affiliated with Mr. Trump.Mr. Trump’s desire for loyalty echoed behavior that Mr. Mueller captured in his report, which laid out how Mr. Trump asked the former F.B.I. director, James B. Comey, for his loyalty just days after taking office. Mr. Comey continued to pursue an investigation into ties between Mr. Trump’s campaign and Russia and was fired in Mr. Trump’s fifth month in office. Mr. Mueller was appointed as special counsel in the aftermath of Mr. Comey’s dismissal.Mr. Mueller’s investigation ultimately identified nearly a dozen acts Mr. Trump took that could be seen as obstruction of justice. One of the most damning related to how Mr. Trump pressured his White House counsel, Donald F. McGahn II, to create a fake document rebutting statements he gave to Mr. Mueller’s office. Mr. McGahn refused to go along with what Mr. Trump wanted.Another example related to Mr. Trump’s powers as president. During Mr. Mueller’s investigation, several of his allies and associates — including Michael Flynn and Paul Manafort — were indicted by the Justice Department in cases that could have produced damaging testimony about Mr. Trump and his campaign. As the prosecutions of the men went forward, Mr. Trump publicly dangled the idea of issuing pardons. In the final weeks of Mr. Trump’s presidency, he pardoned them.The former special counsel Robert S. Mueller at a hearing in 2019. Mr. Mueller’s investigation identified nearly a dozen acts Mr. Trump took that could be seen as obstruction of justice.Doug Mills/The New York Times“There are all sorts of ways to obstruct an investigation, but not every one has an equal impact,” said Brandon Van Grack, a former prosecutor on Mr. Mueller’s team. “Hiding and lying are damaging, but prosecutors can often still get at the truth. Destruction is often looked at seriously because it’s permanent. It’s permanently deleting or destroying” evidence in the case.Steven Cheung, a spokesman for Mr. Trump, assailed the investigations into the former president’s conduct, saying “the weaponized justice system along with their Democrat allies have failed at every turn because they are on the wrong side of the facts. History will judge them harshly.”Over many decades before reaching the White House, Mr. Trump engaged in gamesmanship with prosecutors, regulators and officials who had authority in aspects of the industries in which he operated. He lived in a New York City where corruption touched aspects of the political and government establishments and the real-estate construction businesses, and he came to believe that everything could be worked out through some kind of deal, associates and former employees said.He courted officials who had prosecutorial jurisdiction in New York City, including Rudolph W. Giuliani, then the U.S. attorney in the Southern District of New York, and Robert Morgenthau, the district attorney in Manhattan. Faced with massive amounts of civil litigation, his impulse, former employees said, was to find lawyers who knew the judge.In April 2018, an aspect of the Russian investigation spun off into a separate one into Michael D. Cohen, a lawyer for the Trump Organization who also served as a fixer for Mr. Trump and knew many of his secrets. After Mr. Cohen’s hotel, apartment and office were searched by the F.B.I. that month, Mr. Trump called Mr. Cohen with a message: stay strong.He then predicted on Twitter that Mr. Cohen would never “flip” on him. Mr. Cohen eventually did provide prosecutors with information about Mr. Trump’s hush-money payments before the 2016 election to a porn star who said she had a sexual liaison with him. He later said that Mr. Trump spoke in “code” to avoid plainly communicating his desires.Mr. Bolton, Mr. Trump’s former national security adviser, wrote in his book, “The Room Where It Happened,” that Mr. Trump repeatedly sought to interfere with law enforcement and other official actions involving foreign leaders.During an investigation into Halkbank, a state-financed institution based in Turkey that was facing an investigation by U.S. officials for a scheme to evade sanctions on Iran, Mr. Trump told the country’s leader that he would “take care of things,” Mr. Bolton wrote.In a brief interview on Friday, Mr. Bolton pointed to a specific aspect of Mr. Trump’s view of how the rules apply to him: his use of government power for his personal and political benefit while in office.He cited Mr. Trump’s efforts to solicit damaging information about the Bidens from Ukraine as he withheld military aid to that country. “It shows as president he had fundamental difficulty distinguishing himself from the government,” Mr. Bolton said. “And it’s also why he couldn’t understand why government officials weren’t personally loyal to him.” More

    John Fetterman, Hoodie and All, Is Adjusting to Life in the Senate

    In an interview with The New York Times, the Pennsylvania senator spoke about the dysfunction in Congress, his health challenges and why he hasn’t traded his loungewear for a business suit.It has been an unusual first six months in Congress for Senator John Fetterman, the 6-foot-8, tattooed Democrat from Pennsylvania, who moved to Washington in January after suffering a near-fatal stroke on the campaign trail last year and going on to win one of the most competitive seats in the midterm elections.Mr. Fetterman arrived on Capitol Hill, signature hoodie and all, as a figure of fascination. For months, though, he kept colleagues and reporters at an arm’s length as he labored to cope with auditory processing issues that are a side effect of his stroke and a debilitating bout of depression that he now says prompted him to consider harming himself.He was treated for clinical depression at Walter Reed National Military Medical Center earlier this year, and his six-week stay there placed him at the center of a national conversation about mental health, a role he wasn’t always certain he wanted to fill.But in recent weeks, Mr. Fetterman has been adjusting to a more normal life for a lawmaker. Using a tablet that transcribes voice to text, he has started taking questions from reporters in the hallways, a staple of a senator’s life in Washington, and has begun inviting reporters into his office for informal off-the-record chats. He won approval last week of his first legislative proposal, an amendment to the annual military policy bill, which he wrote with Senator Ted Cruz, Republican of Texas, to ban the sale of strategic petroleum reserves to foreign adversaries.Mr. Fetterman questioned the chairman of the Federal Reserve during a hearing last month.T.J. What is your overall impression of how the place functions?There’s a fixation on a lot of dumb shit. Bad performance art is really what it gets down to. The debt ceiling — there should have been no drama with any of that. The fact that we’re playing with something like that is antithetical to the stability of our democracy. It really is. Everything is turning into a culture war. Not everything has to be a think piece, you know.Does all of that political posturing make you cynical about Washington?Everyone here is cynical, of course. But we can fight for things that are meaningful. That we should have no hungry. Hanger. Hangry. Hanger. Hangry.[Chuckles.]Fox News will go crazy if that makes your story.We’re fighting for women’s reproductive freedom, making sure we have resources and support our unions. I’m going to fight for what’s really important.You’ve introduced legislation to expand access to contraception, with more than a dozen Democratic co-sponsors. Is there any Republican support for that in the Senate?It’s going to be very hard. Somebody needs to tell Republicans, like in a memo, “You won on abortion. You won. Why not have a serious conversation about birth control? That’s less abortions and unwanted children.” I wish we could have an honest conversation with conservatives and Republicans that birth control is the answer for both sides. But there wouldn’t be 60 votes in the Senate for that. I still really want to keep pushing it. You’ll be seeing a lot of President Biden. Are you at all concerned about his age?I’m not concerned about his age. And even if I was, who cares? There’s nothing you can do about his age. I’ve spent enough time around him. He’s sharp, he’s aware, he is absolutely up to the task. I’ll be doing whatever his campaign asks of me. I know Pennsylvania, I’ve won Pennsylvania. I’ll be helping with whatever he asks.Is it difficult to keep talking about your own struggles with mental health, or do you enjoy the responsibility of that new role?It’s a burden, but a privilege, too, to talk about it. It’s also an opportunity to be very bipartisan. Red or blue, if you have depression, get help, please. Don’t ever, ever, ever harm yourself. Do not leave behind a blueprint of that.In my own situation, in my very lowest, I started thinking about that. And I realized that if I do harm myself, I will leave behind for my children a blueprint that, if something happens with you, that’s the answer. I can’t do that to anyone.Even before you checked yourself into Walter Reed for treatment for depression, you were a figure of fascination on Capitol Hill.     Why Ron DeSantis Isn’t Beating Donald Trump

    As he flails to reverse a polling decline that is beginning to resemble a rockslide, Gov. Ron DeSantis must be feeling a little clueless about why his political fortunes are crumbling so quickly. Attacking wokeness and bullying transgender people seemed to work so well in Florida, so why aren’t national Republicans in awe of the divisions he’s deepened? Making repeated appearances with racial provocateurs never stopped him from getting elected as governor, so why did he have to fire a young aide who inserted Nazi imagery into his own video promoting Mr. DeSantis’s presidential campaign?But the political bubble inhabited by Mr. DeSantis is so thick — symbolized by the hugely expensive private-plane flights that are draining his campaign of cash, since he and his wife, Casey, won’t sit with regular people in a commercial cabin — that he has been unable or unwilling to understand the brushoff he has received from donors and potential voters and make the changes he needs to become competitive with Donald Trump in the Republican primaries.For years, Mr. DeSantis has created an entire political persona out of a singular crusade against wokeness, frightening teachers and professors away from classroom discussions of race, defending a school curriculum that said there were benefits to slavery, claiming (falsely) that his anti-vaccine crusade worked and engaging in a pointless battle with his state’s best-known private employer over school discussion of sexual orientation and gender identity. He had the support of the Florida Legislature and state Republican officials in most of his efforts and presumably believed that an image of a more effective and engaged Trump would help him beat the real thing.But it’s not working. A Monmouth University poll published on Tuesday showed Mr. Trump with a 20-point lead over Mr. DeSantis in a head-to-head match, and the advantage grew to more than 30 points when all the other candidates were thrown in. Major donors have started to sour on him, and The Times reported on Thursday that they are disappointed with his performance and the management of his campaign, which he says he will somehow reboot.“DeSantis has not made any headway,” wrote the poll’s director, Patrick Murray. “The arguments that he’d be a stronger candidate and a more effective president than Trump have both fallen flat.”The most obvious fault in his strategy is that you can’t beat Donald Trump if you don’t even criticize him, and Mr. DeSantis has said little about the multiple indictments piling up against the former president or about his character. Granted, there are downsides to a full-frontal attack on Mr. Trump at this point, as other Republicans have become aware, and Mr. DeSantis still needs to establish some kind of identity first. But he can’t become an alt-Trump without drawing a sharp contrast and holding Mr. Trump to account for at least a few of his many flaws. There are graveyards in Iowa and New Hampshire full of candidates who tried to ignore the leader through sheer force of personality, and even if he had one of those, Mr. DeSantis hasn’t demonstrated the skills to use it. Both men will speak Friday night at the Lincoln Dinner in Des Moines, and if Mr. DeSantis leaves his rival unscathed, it’s hard to imagine how he goes the distance.The deeper problem, though, is that Mr. DeSantis is peddling the wrong message. Only 1 percent of voters think that wokeness and transgender issues are the country’s top problem, according to an April Fox News poll — essentially a repudiation of the governor’s entire brand. Race issues and vaccines are also low on the list.Lakshya Jain, who helps lead the website Split Ticket, which is doing some really interesting political analysis and modeling, said Mr. DeSantis misinterpreted what Florida voters were saying when they re-elected him by a 19-point margin in 2022.“The economy was doing well in Florida, and Democrats didn’t put up a good candidate in Charlie Crist,” Mr. Jain told me. “I’m not sure the majority of Florida voters really cared what he was saying on wokeness. It’s not really an issue people vote on.”The economy, naturally, is what people care most about, but Mr. DeSantis hasn’t said much about his plans to fight inflation (which is already coming down) or create more jobs (which is happening every month without his help). Clearly aware of the problem, he announced on Thursday that he would unfurl a Declaration of Economic Independence in a major speech in New Hampshire on Monday (a phrase as trite and tone-deaf as the name of his Never Back Down super PAC).That appears to be the first fruit of his campaign reboot, but there are good reasons he doesn’t like to stray from his rigid agenda, as demonstrated by his occasionally disastrous footsteps into foreign policy. Bashing Bidenomics means he’ll immediately have to come up with an excuse for why inflation is so much higher in Florida than the nation as a whole. Though the national inflation rate in May was 4 percent compared with a year earlier, it was 9 percent in the Miami-Ft. Lauderdale-West Palm Beach area for the same period and 7.3 percent in the Tampa-St. Petersburg-Clearwater area.The primary reason for that is the state’s housing shortage, an issue that Mr. DeSantis largely ignored during his first term and has only belatedly taken a few small steps to address. When the issue inevitably comes up on the campaign trail, you can bet that Mr. DeSantis will find some way of blaming it on President Biden. That way he can quickly pivot to his preferred agenda of rewriting Black history, questioning science and encouraging gun ownership.He really can’t help himself; just this week he said he might hire the noted anti-vaccine nut Robert F. Kennedy Jr. to work at the Food and Drug Administration or the Centers for Disease Control and Prevention. Then he got into an online fight with Representative Byron Donalds, Florida’s only Black Republican member of Congress, over the state’s astonishingly wrong curriculum on slavery, and a DeSantis spokesman called Mr. Donalds a “supposed conservative.”Great way to expand your base.     How Is Tim Scott Spending Millions in Campaign Money? It’s a Mystery.

    Most of the money spent by the senator’s presidential campaign has gone to newly formed companies whose addresses are Staples stores in suburban strip malls.Senator Tim Scott of South Carolina has more political money than most of his Republican presidential rivals, and he has not been shy about spending it.Where that money is ultimately going, however, is a mystery.Mr. Scott entered the 2024 race with a war chest of $22 million, and his campaign raised $5.8 million from April through June. In that same time, he laid out about $6.6 million, a significant clip — but most of it cannot be traced to an actual vendor.Instead, roughly $5.3 million went to two shadowy entities: newly formed limited liability companies with no online presence and no record of other federal election work, whose addresses are Staples stores in suburban strip malls. Their minimal business records show they were set up by the same person in the months before Mr. Scott entered the race.Masking the companies, groups and people ultimately paid by campaigns — effectively obscuring large amounts of spending behind businesses and convoluted consulting arrangements — has become common, as political candidates and organizations test the limits of campaign finance law.Federal law requires campaigns to disclose their spending, including itemized details of their vendors, as a safeguard against corruption and in the interest of transparency. But as in many aspects of campaign finance law, campaigns have found workarounds, and the body that oversees such regulations, the Federal Election Commission, is perpetually hamstrung by partisan deadlock.Mr. Scott with voters in Iowa on Thursday. He is aiming to become the clear Republican alternative to Donald J. Trump in the party’s presidential primary race.Jordan Gale for The New York TimesCampaign finance experts said that among increasingly brazen moves by political candidates, Mr. Scott’s new financial disclosures stood out as exhibit A.“This practice completely undermines the federal campaign finance disclosure requirements,” said Paul S. Ryan, a campaign finance expert. “The public has a right to know how political committees are spending donor dollars.”Matt Gorman, a senior communications adviser for the Scott campaign, said: “These are independent companies we contract with to provide services to the campaign including managing multiple consultants. Payments to those companies are disclosed like all others on our F.E.C. report.”The F.E.C. has allowed committees to not itemize subvendor payments when those payments are an extension of the original vendor’s work. But in recent years, this interpretation of the law has widened into a gaping loophole that campaigns are exploiting. Experts say it is illegal for campaigns to pay campaign staff members through limited liability companies, or for vendors to serve merely as conduits to hide the ultimate recipient of campaign money.In recent years, the F.E.C., whose six commissioners are deadlocked between the parties three to three, has essentially allowed campaigns to get away with minimal disclosures.A spokeswoman for the commission declined to comment.Indeed, while the use of limited liability companies by Mr. Scott’s campaign is striking in its scale, it is not unique among Republican presidential candidates.The campaign of Gov. Ron DeSantis of Florida made two payments last quarter, totaling more than $480,000, for “travel” to a company in Athens, Ga. The company was set up around the time he entered the race, and lists Paul Kilgore — a Republican political operative — as a manager.Neither Mr. Kilgore nor the DeSantis campaign responded to requests for comment.Former President Donald J. Trump’s 2020 campaign was the subject of litigation over its use of limited liability companies run by campaign staff and family members that were allegedly conduits for hundreds of millions of dollars of spending. His campaign defended the practice, saying the intermediary companies were acting as the primary vendors.“The idea of disclosing payments in this way defeats the whole purpose of campaign finance disclosure law,” said Saurav Ghosh, a former F.E.C. lawyer and the director of federal campaign finance reform for the Campaign Legal Center, a nonprofit campaign ethics group that sued the F.E.C. over the 2020 Trump campaign’s actions.He added, “It’s been a problem for a while, but like most that go on unaddressed, it has a tendency to get worse, and I think this one is getting worse.”According to F.E.C. filings last week, the Scott campaign made $4.3 million in payments from April 1 to June 30 to a company called Meeting Street Services L.L.C. The money included $2.8 million for “placed media” and more for digital fund-raising, strategy and video production.Meeting Street Services has no online presence, and has not been paid by any other campaign, records show. Its listed address, in North Charleston, S.C., is a Staples store. Records show that the company was set up in Delaware in August 2022, and its incorporation documents list only one name — Barry M. Benjamin — as an authorized representative.According to business records in South Carolina, the company is managed by AMZ Holdings L.L.C., a company set up in May 2021 and based at the same Staples store in North Charleston. AMZ’s Delaware incorporation documents were also signed by Mr. Benjamin.Mr. Scott’s campaign did not provide information about Mr. Benjamin or further details about the companies. Efforts to independently determine Mr. Benjamin’s identity were unsuccessful.There are several notable absences in the campaign’s second-quarter filing, including Targeted Victory, a major political fund-raising firm that has said it works for the campaign, and FP1 Strategies, a political advertising firm, which was also reportedly brought on by the campaign. Several people from the two firms who are working for the campaign also do not appear in the disclosure.Mr. Scott’s use of Meeting Street Services L.L.C. predates his entry into the presidential race. In the last four months of 2022, his Senate campaign paid the company more than $4.5 million, filings show, for television ads, digital fund-raising and other consulting.And his presidential campaign reported an additional $1 million spent with Meeting Street Services in the first quarter of this year, even though his campaign had not officially begun.The Scott campaign also made more than $940,000 in payments last quarter to Advanced Planning and Logistics, a limited liability company set up in December 2022 — again, by Mr. Benjamin — and whose listed address is a Staples store in Fairfax, Va. The company received multiple payments for air travel and event production. Again, Mr. Scott’s campaign was the only campaign that paid the company.In 2020, the Trump campaign reported paying hundreds of millions of dollars to two companies, one set up by a former campaign manager and the other by campaign officials. Neither the campaign nor the companies themselves reported specifically what the money was being spent on.The Campaign Legal Center filed a complaint to the F.E.C., accusing the Trump campaign of using the companies as “conduits” to conceal other vendors. The commission’s general counsel recommended that the F.E.C. find that the campaign had broken the law by misreporting payments, and begin an investigation into the Trump campaign’s relationships with vendors and subvendors.But the commission deadlocked last year in a vote on the matter, which meant no action could be taken. The Campaign Legal Center sued the commission, but a federal judge — while expressing sympathy for the desire of transparency — dismissed the case late last year, saying that the commissioners had discretion.“It is a lot easier to follow the money when you have a paper trail,” the judge opened his opinion.The Campaign Legal Center has appealed.Kitty Bennett More

    How Did We Do? A Review of 2022 Before Our First Poll of 2023.

As you read them, think about whether you think this pollster’s results were good or bad or whatever adjective you’d like.Poll: D+6; result: D+2.4Poll: R+4; result R+1.5Poll: D+5, result D+4.9Poll: R+5; result R+7.5Poll: EVEN; result D+0.8Poll: D+3, result D+1All right, what did you think?I hope you thought they were at least good, because this is a sample of about half of our final New York Times/Siena College polls in 2022. On average, the final Times/Siena polls differed from the actual results by 1.9 percentage points — the most accurate our polls have ever been. Believe it or not, they’re the most accurate results by any pollster with at least 10 final survey results in the FiveThirtyEight database dating to 1998. We were already an A+ pollster by its measure, but now we’ve been deemed the best pollster in the country.My hope is that most of you thought those poll results were good, but I’d guess you didn’t think they were incredible. They’re not perfect, after all. And I can imagine many reasonable standards by which these polls might not be considered especially accurate. They certainly weren’t objective truth, which we might usually think of as the standard for Times journalism.Even so, this level of accuracy is about as good as it can get in political polling. We may never be this accurate again. There may be room to debate whether “great for political polling” is the same as “great,” but if you’re judging polls against perfection it may be worth scaling back your expectations. Even perfectly designed surveys will not yield perfect results.Nonetheless, we try to be perfect anyway. With the data from 2022 in and final, we’ve been poring over the data — including our experiment in Wisconsin — to identify opportunities for improvement. I must admit this has been a less urgent (and more pleasant!) experience than similar exercises after prior election cycles, which have felt more like an “autopsy” or “post-mortem” than a routine doctor’s visit.Still, I did make sure to get our polls in for their biennial checkup ahead of our first national survey of the cycle, which is in the field as I type. More on that later, but for today here’s the good news and some bad news from our dive into last year’s polling.Good newsOur polls were right for the right reasons. With one interesting exception (which we’ll discuss later), they nailed the composition of the electorate, the geographic breakdown of the results and the apparent results by subgroup.The raw data was quite a bit cleaner, for lack of a better word, than it was in 2020. Back then, the statistical adjustments we made to ensure a representative sample made a big difference; without them, our polls would have been far worse. This time, the final results were only about a point different from our raw data. It’s hard to tell whether that’s because of refinements to our sampling or because survey respondents have become more representative in the wake of the pandemic or with Donald J. Trump off the ballot, but it’s a nice change either way.The big Wisconsin mail experiment — where we paid voters up to $25 dollars to take a mail survey — didn’t reveal anything especially alarming about our typical Times/Siena polls. There was no evidence to support many of our deepest fears, like the idea that polls only reach voters who are high in social trust. There was no sign of the MAGA base abstaining from polling, either. On many measures — gun ownership, evangelical Christianity, vaccination status — the Times/Siena poll looked more conservative than the mail poll.OK, now the bad newsThe Wisconsin study didn’t offer easy answers to the problems in polling. Yes, it’s good news that the problems aren’t as bad as we feared, but we went to the doctor’s office for a reason — the state of polling isn’t completely healthy, and we’re looking to get better. We may have ruled out many worst-case diagnoses, but a clearer diagnosis and a prescription would have been nice.The Wisconsin study did offer ambiguous evidence that Times/Siena phone respondents lean a bit farther to the left than the respondents to the mail survey. I say ambiguous partly because the Times/Siena telephone survey isn’t large enough to be sure, and partly because it doesn’t show up in the top-line numbers. But if you account for the extra tools at the disposal of the Times/Siena survey (like ensuring the right number of absentee vs. mail voters), the mail data does lean more conservative — enough to feel justified in going to the doctor.This modest tilt toward the left appears mostly explained by two factors I’ve written about before. One: The less politically engaged voters lured by a financial incentive appear to be ever so slightly more conservative than highly engaged voters. Two: People who provide their telephone numbers when they register to vote are ever so slightly more Democratic than those who do not, and they respond to surveys at disproportionate rates as well. It’s not clear whether these issues would be so problematic in other states where there’s additional information on the partisanship of a voter compared with Wisconsin.We did get lucky in one big case: Kansas’ Third District. Our respondents there wound up being far too liberal, yet our overall result was mostly saved by grossly underestimating the vigor of the Democratic turnout. In a higher-turnout election in 2024 — when there’s far less room for turnout to surprise — we wouldn’t be so lucky.Mr. Trump wasn’t on the ballot. That’s not exactly bad news, but it might be in 2024 if his presence in some way increases the risk of survey error by energizing Democrats to take polls while dissuading the already less engaged and irregular conservatives who only turn out and vote for him.What we’ve changed/what we’re changingWe’ll make a number of fairly modest and arcane changes to our Wisconsin and state polls, reflecting a series of modest and arcane lessons from the Wisconsin study. But so far none of these insights have yielded fundamental changes to our surveys heading into 2024. That said, there are a few larger tweaks worth mentioning:When deciding whether someone is likely to vote, we will rely even less on whether voters say they’ll vote, and more on their demographics and whether they’ve actually voted in the past. This is the third cycle in four — with the exception being 2018 — when we would have been better off largely ignoring whether voters say they will vote in favor of estimates based on their demographics and voting record. We won’t ignore what voters tell us, but we will look at it that much more skeptically when estimating how likely someone is to vote.We’re reordering our questionnaires to let us look at and potentially use respondents who drop out of a survey early. This isn’t usually an issue for us — our state and district polls have never taken longer than eight minutes or so to complete — but about 15 percent of respondents who made it to the major political questions on our longer national polls and the Wisconsin study later decided to stop taking the survey. Not surprisingly, they’re the kind of low-interest voters we need the most.When it comes to Republican primary polling, we might adjust our sample — or weight it — using a new category: home value. In our two national polls with the Republican primary ballot last year, home value was an exceptionally strong predictor of support or opposition to Mr. Trump, even after controlling for education.Overall, Mr. Trump had a lead of 60 percent to 17 percent among people whose homes were worth less than $200,000, based on L2 data, while Ron DeSantis led, 47-24, among respondents whose homes were worth more than $500,000.I don’t think these changes will make very much of a difference, but we’re putting it to the test in the Republican primary now.There’s one last change to mention, one with no effect on the qualify of our polls: For candidates who receive less than 1 percent of the vote but over 0.5 percent, we will record them as less than 1 percent ( More

No Labels, a nonpartisan political group, is talking about running a third-party unity ticket next year if Joe Biden and Donald Trump are the nominees.
