    Mike Pence Keeps Trying to Make Mike Pence Happen

    It’s difficult to find a Republican strategist who will say the former vice president has a real chance in a 2024 matchup against his former boss. But he’s clearly laying the groundwork.My colleague Michael Bender wrote this week about the deepening rivalry between Donald Trump and Mike Pence, onetime partners and political allies.The two men became estranged after Pence declined to support Trump’s effort to overturn the 2020 election results on Jan. 6, 2021. That same day, the mild-mannered Indianan hid from a mob chanting “Hang Mike Pence” as it stormed the Capitol after being egged on by the president.This week, they made dueling appearances in Washington and things did not go well for Pence. He drew a small, polite crowd at a gathering of the Young America’s Foundation while Trump basked in a raucous reception at the America First Policy Summit. (For those unfamiliar with these institutions, both represent emerging power centers of the new, Trumpified G.O.P. establishment.)The split-screen speeches showed that Trump, as Bender notes, is still the big dog in the Republican Party.“The two appearances also underscored the wide gap in enthusiasm among Republicans between Mr. Trump and any other potential primary rival in 2024,” Bender wrote.In a New York Times/Siena College poll of Republican voters this month, just 6 percent said they would vote for Pence if he were to run for president two years from now, compared with 49 percent who said they would stick with Trump. Unscientific straw polls of young Republican activists have found Pence faring even worse in hypothetical primaries.To put the matter plainly: It is difficult to find a Republican strategist who will tell you that Pence has a real chance in a 2024 matchup against his former boss.Rick Tyler, a former presidential campaign adviser to Senator Ted Cruz of Texas, said that Pence had the best chance of nudging Republican voters away from Trump.The former vice president was being careful and “savvy,” Tyler said, in balancing the need to distance himself from Trump’s worst conduct while paying respect to his administration’s conservative policy achievements.But it was unclear, he acknowledged, whether Republican primary voters might see things the same way.Donald Trump, Post-PresidencyThe former president remains a potent force in Republican politics.Losing Support: Nearly half of G.O.P. voters prefer someone other than Donald J. Pence’s nostalgic paeans to broad-shouldered, Ronald Reagan-style conservatism do not seem to be what G.O.P. voters are looking for in their elected leaders. They want fire and brimstone, not low-energy sermons.And while Trump’s successful 2016 campaign did offer a dose of the usual aspirational optimism that voters like to hear, it focused much more on a list of enemies: the “deep state,” the Republican establishment, Mexican asylum seekers, Muslims, Washington politicians, a metaphorical “swamp” that included Democrats and the mainstream media.One mistake political pundits often make about voters — and I’m sure I’m guilty of this myself on occasion — is that they tend to overemphasize the extent to which most Americans are attracted to policy ideas and coherent ideologies, rather than to charismatic personalities.And nobody has ever accused Mike Pence of having a charismatic personality.‘He wasn’t channeling anyone’s rage’It’s sometimes forgotten that before Pence rose to national prominence, he hosted a conservative radio talk show in Indiana.When I was an editor at Politico, during the 2016 campaign we sent a reporter, Darren Samuelsohn, to Indianapolis to dig up old episodes of the show in search of the “real Mike Pence.”Over some late nights and with the help of plenty of caffeine, Samuelsohn plowed through hours of cassette recordings, listening for insights about what was clearly a formative experience for the future vice president. (For Gen Z readers: Cassettes are an ancient form of audio technology that preceded compact discs, MP3 files and Spotify.)What we found was revealing in its own way: Pence was pretty much the opposite of a radio shock jock. As a Tea Party stalwart during an earlier era of anti-insider fervor, he criticized many of the same enemies that Trump would later target. But he did it with Midwestern politeness, in a dulcet baritone that was nothing like the Rush Limbaughs or the Howard Sterns of that era.“Pence’s show had a casually indignant air to it,” Samuelsohn wrote in his analysis. “He wasn’t channeling anyone’s rage. His banter was easygoing as he implored his listeners to dial 800-603-MIKE, ending the week with ‘Open Phone Friday.’ He came out of commercial breaks to a ‘Mike Pence!’ jingle and musical interludes from the likes of Hootie & the Blowfish and a bouncing keyboard version of ‘Great Balls of Fire.’”Gov. Ebenhack/Associated PressA battle of personalitiesIt’s easy to see this Mike Pence in today’s quixotic pre-2024 maneuvering.When he criticizes his onetime ally and superior, he does so only obliquely — never by name, and only with carefully manicured phrases like “Some people may choose to focus on the past, but elections are about the future,” as he put it in this week’s speech.Hmm! What person could he have possibly been referring to here?Pence has also authorized his closest aides, Marc Short and Greg Jacob, to cooperate with the House committee investigating Jan. 6 as it amasses evidence of Trump’s actions surrounding the riot. But Pence himself has not spoken in any detail about his ordeal that day, reinforcing the impression among many Republican insiders that he is afraid of openly crossing swords with Trump.Contrast that with Gov. Ron DeSantis of Florida, who is younger, angrier and savvier about glomming onto hot-button issues on the right. DeSantis seems to be the flavor of the month, and 25 percent of 2024 Republican primary voters picked him in that same Times/Siena poll, well north of Pence.As a governor, DeSantis benefits from a platform that allows him to take actions that appeal to Republican activists and plugged-in voters, who have responded enthusiastically to his battles with Disney, teachers and his state’s wilting Democratic Party over L.G.B.T.Q. rights. And he has picked his moments to criticize Trump’s record in office — maneuvering to the right of the former president on the coronavirus pandemic and on cultural issues that have revved up the G.O.P. base, such as critical race theory.DeSantis might not ultimately be what Republicans are looking for in their next banner carrier, either. Florida strategists and former aides often describe him as thin-skinned and plodding on his feet, with a humorless stump style. And it’s difficult to envision anyone out-brawling Trump in an open 2024 Republican primary.But DeSantis was, by all accounts, a serious student at Yale even while juggling the punishing demands of being a varsity college athlete. He has a sterling military record, as far as we know. He is whip-smart and skilled at both political combat and tapping into Republican voters’ deep skepticism about the news media. There’s a chance that he will improve just enough, and Trump’s standing in the Republican Party will degrade just enough, to put him in the pole position heading into 2024.And who knows: Maybe some other person will come along and fire up conservative Iowans and New Hampshirites in the frigid January air.But Mike Pence?     2016 Campaign Looms Large as Justice Dept. Pursues Jan. 6 Inquiry

    Top officials at the department and the F.B.I. appear intent on avoiding any errors that could taint the current investigation or provide ammunition for a backlash.As the Justice Department investigation into the attack on the Capitol grinds ever closer to former President Donald J. Trump, it has prompted persistent — and cautionary — reminders of the backlash caused by inquiries into Mr. Trump and Hillary Clinton during the 2016 presidential campaign.Attorney General Merrick B. Garland is intent on avoiding even the slightest errors, which could taint the current investigation, provide Mr. Trump’s defenders with reasons to claim the inquiry was driven by animus, or undo his effort to rehabilitate the department’s reputation after the political warfare of the Trump years.Mr. Garland never seriously considered focusing on Mr. Trump from the outset, as investigators had done earlier with Mr. Trump and with Mrs. Clinton during her email investigation, people close to him say.As a result, his investigators have taken a more methodical approach, carefully climbing up the chain of personnel behind the 2020 plan to name fake slates of Trump electors in battleground states that had been won by Joseph R.     These Republican Governors Are Delivering Results, and Many Voters Like Them for It

    Republican flamethrowers and culture warriors like Donald Trump and Representatives Matt Gaetz and Marjorie Taylor Greene typically draw an outsize amount of media attention.Americans may conclude from this that there is a striking, and perhaps unfortunate, relationship between extremism and political success.But Republicans aren’t hoping for a red wave in the midterms only because norm-thrashing or scandal sells. The truth is much more banal — yet also important for parties to internalize and better for politics generally: In states across the country, Republican governors are delivering real results for people they are physically more proximate to than federal officials.Now, it’s true that the party that controls the presidency nearly always gets whipped in midterm elections, and inflation would be a huge drag on any party in power. And it’s also true that among those governors are culture warriors like Gov. Ron DeSantis of Florida and Gov. Greg Abbott of Texas.But people too often overlook the idea that actual results, especially ones related to pocketbook issues, can often be as important as rhetoric. Looked at that way, lots of Republicans — some with high public profiles, and some who fly below the radar — are excelling.Start with the simplest measure: popularity. Across the country, 13 of the 15 most popular governors are Republicans. That list does not just include red states. In fact, blue-state Republican governors like Phil Scott of Vermont, Charlie Baker of Massachusetts and Larry Hogan of Maryland are among the most popular.There are many reasons that G.O.P. governors seem to be succeeding. It’s true that governors can’t take credit for everything. Sometimes they just get lucky. But they do make policy choices, and particularly those made by governors since the start of Covid have made a difference.For example, take a look at the most recent Bureau of Labor Statistics data on unemployment. In the 10 states with the lowest rates as of June, eight were led by Republican governors. Several governors who don’t make frequent appearances in national news stand out, like Pete Ricketts of Nebraska, Chris Sununu of New Hampshire, Spencer Cox of Utah and Phil Scott of Vermont. Their states have unemployment rates under 2.5 percent, and of the 20 states with the lowest unemployment rates, just four are led by Democrats.States with Republican governors have also excelled in economic recovery since the start of the pandemic. Standouts in this measure include Mr. Abbott and Doug Ducey of Arizona.These results reflect many things — some states have grown and others have shrunk, for example — but are at least in part a result of policy choices made by their elected leaders since the start of the pandemic. For example, governors like Kristi Noem in South Dakota often rejected lockdowns and economic closures.Republican governors were also far more likely to get children back to in-person school, despite intense criticism.Covid policy doesn’t explain everything. Fiscal governance has also made a difference. The Cato Institute’s Fiscal Report Card on America’s governors for 2020 (the most recent edition available), which grades them on tax and spending records, gives high marks to many Republicans. Nearly all of the top-ranked states in this report have Republican governors, like Kim Reynolds of Iowa or Mr. Ricketts. (Some Democratic governors also ranked highly, including Steve Sisolak of Nevada and Roy Cooper of North Carolina.) Some have made their mark with employer-attracting tax cuts; others with spending controls; others with a mixture.Most states mandate a balanced budget, so taxing and spending policies are important for fiscal stability. Low taxes tend to attract and keep employers and employees. Restrained budgets help ensure that taxes can be kept low, without sacrificing bond ratings, which may matter if debt-financed spending is needed in a crisis or to try to stimulate businesses to hire more.Asa Hutchinson of Arkansas has cut taxes for individuals, reduced the number of tax brackets and cut the corporate income tax rate. Mr. Sununu has restrained spending, vetoed a payroll tax proposal and cut business taxes. Brian Kemp of Georgia, by contrast, actually paused some tax cuts that had been scheduled — and focused almost exclusively on spending restraint, issuing a directive for state agencies to generate budget cuts and keeping 2020 general fund growth to a tiny 1 percent.Even in blue Vermont, Mr. Scott has constrained general fund spending — despite being an odd duck out among governors in that he is not constrained by a balanced-budget amendment — to rise by an annual average of just 2.4 percent between 2017 and 2020, and he has also cut taxes. He signed a bill to ensure that the federal tax reform instituted under Mr. Trump and limiting state and local tax deductions wouldn’t result in Vermonters getting hammered. He has also cut individual income tax rates, reduced the number of tax brackets and resisted new payroll taxes in favor of voluntary paid leave plans for private-sector employers.Republicans who have a big impact on the day-to-day lives of many Americans — unlike, say, Representative Kevin McCarthy or certainly Mr. Trump, and in terms of the quality of state economies, the local job market and education — are delivering. In our federalist system, a lot of power still sits with states and not the federal government and determines much about citizens’ lives.This is a big reason that Republicans are well-positioned heading into the midterms. It should be a warning to Joe Biden and Democrats — and to some of the culture warriors. Cable-news combat over whatever the outrage of the day is may deliver politicians the spotlight.     The Fake Electors Scheme, Explained

    The plan to reverse the outcome of the 2020 election by creating slates of electors pledged to Donald Trump in states he had lost was expansive, long-running and often confusing.The brazen plan to create false slates of electors pledged to former President Donald J. Trump in seven swing states that were actually won by Joseph R. Biden Jr. was arguably the longest-running and most expansive of the multiple efforts by Mr. Trump and his allies to overturn the results of the 2020 election.It was also one of the most confusing, involving a sprawling cast of pro-Trump lawyers, state Republican officials and White House aides in an effort that began before some states had even finished counting their ballots. It culminated in the campaign to pressure Vice President Mike Pence to use the false slates to subvert congressional certification of the outcome on Jan. 6, 2021 — and in the violent attack on the Capitol that unfolded as he refused to do so.The scheme had a vague historical precedent and was rooted, at least in theory, in a post-Reconstruction Era law designed to address how to handle disputed elections. But it was deemed illegal by Mr. Trump’s own White House Counsel’s Office. Even some of the lawyers who helped come up with the idea referred to it as fake and acknowledged that it was of dubious legality, according to a cache of email messages brought to light by The New York Times.The fake electors tactic caught the attention of state law enforcement officials around the beginning of this year, and soon became a focus of the inquiry being conducted by the House select committee investigating the events of Jan. 6.The plan has also figured prominently in an investigation that an Atlanta-area prosecutor is conducting into Mr. Trump’s alleged election meddling. And it is at the heart of the Justice Department’s own wide-ranging Jan. 6 inquiry.Here is a look at the plan: where it came from; how it was meant to work; the various inquiries it has now become a part of; and the ways in which it could serve to implicate Mr. Trump in criminal activity.Vice President Richard M. Nixon.The results of the vote count in Hawaii remained in dispute — by about 100 ballots — even as a crucial deadline for the Electoral College to meet and cast its votes drew near. A recount was underway but it did not appear as though it would be completed by the time the Electoral College was expected to convene, on Dec. 19, 1960.(The winner of the popular vote in nearly all of the states is allocated all of that state’s electors, which are apportioned based on population. Maine and Nebraska are the exceptions; they allocate their electors based on the winners in congressional districts.     Can Democrats Avoid a Midterm Wipeout?

You can sign up here to receive it on Wednesdays.It is one of the most enduring trends in American politics that the president’s party tends to fare poorly during midterm elections. And in 2022, that trend was supposed to reassert itself with a vengeance: As inflation climbs at its fastest pace in four decades, Joe Biden’s approval rating has plunged to the lowest of any elected president at this point in his presidency since the end of World War II, according to FiveThirtyEight.But despite those grim conditions, the midterms could be surprisingly competitive: In a July poll conducted by The New York Times and Siena College, 41 percent of registered voters said they preferred Democrats to control Congress, compared with 40 percent who preferred Republicans.Here’s what people are saying about the state of the races, whether Democrats stand a chance of keeping one or both of their majorities in Congress, and what could change the forecast between now and November.Why the races look closer than expectedIf the Times/Siena polling made one thing clear, it’s that voters are not pleased with the way the country is being run. Even as the unemployment rate hovers around a 50-year low, Americans are deeply anxious about the economy: Just 10 percent of registered voters rated it as “good” or “excellent.” More broadly, political malaise seems the order of the day: A majority of respondents said the nation was too divided to solve its challenges, and just 13 percent said the country was heading in the right direction.But there are a few factors insulating Democrats from all this negative sentiment.As The Times’s chief political analyst, Nate Cohn, explains, recent news is actually helping Democrats in some ways: This summer, the Supreme Court has handed the right significant victories on abortion, climate policy, religious rights and gun laws, galvanizing voters who lean Democratic on those issues and shifting the national political discourse away from the Republican Party’s preferred turf of immigration, crime and school curriculums. Recent mass shootings have also played a role in this shift.In the past several years, the Republican Party has made inroads with less affluent, less educated voters while shedding support among higher-income, higher-educated voters. As a result, the electoral playing field has become less tilted toward Republicans, according to Nicholas Stephanopoulos, a law professor at Harvard who focuses on redistricting and demographic trends. While “the conventional wisdom has it that Democrats are disadvantaged in redistricting because of their inefficient over-concentration in cities,” he told Thomas B. Edsall, a contributing writer for Times Opinion, “the Trump era seems to have changed the country’s political geography in ways that are beneficial to Democrats.”Republicans are also reconfiguring their relationship with Donald Trump, whose grip on the party isn’t as strong as it once was, particularly as the fallout from the House Jan. 6 investigation compounds. According to the Times/Siena College poll, nearly half of Republican primary voters would prefer someone other than Trump for president in 2024. As Jake Lahut reports for Insider, that fault line has created potential pitfalls for Trump-backed Senate candidates, like Mehmet Oz in Pennsylvania and Herschel Walker in Georgia, who have won their primaries but have struggled to break away in general election matchups against their Democratic opponents.The odds: According to Nate Silver of FiveThirtyEight, Republicans have roughly the same chance of reclaiming a Senate majority as Democrats do of retaining theirs. In the House, though, Republicans are still heavily favored. Why? House candidates are both more numerous and more anonymous than Senate candidates, Silver explains, so voters’ feelings about the national political environment tend to be determinative.As The Times’s David Leonhardt wrote this month, “If Democrats keep the Senate without the House, they still would not be able to pass legislation without Republican support.” But, he added: “Senate control nonetheless matters. It would allow President Biden to appoint judges, Cabinet secretaries and other top officials without any Republican support, because only the Senate needs to confirm nominees.”The abortion factorBecause the Supreme Court returned the power to regulate abortions to the states last month, abortion will be a live issue this midterm season in a way it hasn’t been for many decades. Five states will have ballot measures asking voters whether to amend their constitutions to either enshrine or proscribe the right to abortion. And in other states, the issue has raised the stakes in competitive races for the legislature and the governor’s mansion.There are two ways abortion’s centrality could help Democrats in November, Ed Kilgore argues in New York magazine. “The first and most obvious is that it could keep in the Democratic ranks a significant number of suburban swing voters who voted for the Donkey Party in 2018 and 2020 but who might swing back to the G.O.P. without Trump totally dominating the landscape and with economic issues in the forefront,” he writes. “The second possible effect is to boost the turnout rates of certain pro-Democratic groups of voters who often skip non-presidential elections.”Mainstream Democrats have historically treated abortion as a divisive issue best left on the periphery of their campaign strategy. (Biden himself did not utter the word “abortion” until more than a year into his presidency.) But this election season, some Democrats are actively campaigning on the issue, wagering that the Supreme Court’s abrogation of the constitutional right to abortion could prompt a backlash from voters. In Georgia, for example, Stacey Abrams, the state’s Democratic nominee for governor, has started making direct appeals to swing voters and portraying her opponent, the incumbent governor, Brian Kemp, as the mind behind one of the nation’s most extreme abortion laws, which bans abortion after the sixth week of pregnancy.Similarly, Senator Maggie Hassan, a Democrat who is up for re-election in “notoriously swingy” New Hampshire, has leaned into the issue. “I will fight and never back down,” she said in a June television ad raising the possibility of a national abortion ban. “Protecting our personal freedoms isn’t just what’s right for New Hampshire. It’s what makes us New Hampshire.”Whether this strategy will end up redounding to the Democrats’ benefit remains an open question. Since the court overruled Roe v. Wade, most polls have shown approximately a three-point shift in the Democrats’ direction on the generic ballot, which asks whether voters would prefer Democrats or Republicans to control Congress, compared with surveys by the same pollsters before the decision came down.But some are skeptical that the shift will endure through November or prove significant enough to turn the electoral tide. “Does it have an effect? Absolutely,” Chuck Rocha, a Democratic strategist, told The Times. “Does it fundamentally change the landscape?
