    Glenn Youngkin Talks About Virginia. His Base Talks About Donald Trump.

    Republicans in Virginia are saying what their nominee for governor will not: The governor’s race is a proxy for Mr. Trump’s grievances.GLEN ALLEN, Va. — The event was billed as a rally for Virginia conservatives ahead of next month’s election for governor. But it was mostly about Donald J. Trump.Each speaker, addressing the crowd of hundreds just outside the state capital of Richmond, declared the former president the rightful winner of the last presidential election and the assumed winner of the next one. The audience raved when Mr. Trump gave a short address over the phone.But it was the speaker after Mr. Trump who made the pivot from national to local. Amanda Chase, a state senator from Amelia County who has called herself “Trump in heels,” explicitly tied the former president to Glenn Youngkin, the state’s Republican nominee for governor. Supporting one required supporting the other, she said.“People know I’m not politically correct and I’ll say exactly what I’m thinking,” Ms. Chase said. “And if I’m telling you I’m supporting Glenn Youngkin, then you better be supporting Glenn Youngkin, because he’s the real deal.”Terry McAuliffe, the Democratic candidate and a former governor, has sought to tie Mr. Youngkin to the former president, while the Republican candidate has largely tried to keep some distance from Mr. Trump, to avoid alienating the all-important suburban, moderate voters who could decide the race’s outcome. But at the grass-roots level, the messages from Virginia Democrats and Republicans are less distinct.Democrats argue that losing the statewide election on Nov. 2 would be a bad omen for them in the 2022 midterms, and Republicans agree. And while Democrats paint Mr. Youngkin as an acolyte of Mr. Trump who would help pave the way for the former president’s return in 2024, Republicans at the “Take Back Virginia” rally on Wednesday explicitly said the same thing. They were willing to make clear what Mr. Youngkin has carefully avoided.John Fredericks, a conservative radio host who organized the event and calls himself the “Godzilla of truth,” said the Virginia race was the first step in clawing back the political power that Trump voters believe was stolen from them last year. He was one of several speakers who encouraged the audience to become election workers.“Let’s win on Nov. 2 and send a message to America that we have had enough,” Mr. Fredericks told the crowd. “You are the motor. You are the engine. You are the deplorables that, if we turn out on Nov. 2 and vote early and be a poll watcher, you can change the course of history in America.”Lawn signs supporting Glenn Youngkin were available for people to take home, even though he did not attend the event.Carlos Bernate for The New York TimesThe disconnect between the political messages of Mr. Youngkin and his base speaks to the careful line that Republicans have been forced to walk. Although the former president’s approval ratings with moderates and independents remain underwater, which helped President Biden win Virginia by 10 points last year, Mr. Trump is still the most potent driver of enthusiasm and energy among the party’s most loyal voters. In an off-year election where turnout is expected to be significantly decreased from presidential levels, courting that energy is paramount for Virginia Republicans.Mr. Youngkin did not attend the event in Glen Allen, but Ms. Chase spoke with the authority of a campaign surrogate, saying, “I work very closely with the Youngkin campaign.” Mr. Trump, in his telephone address, said, “I hope Glenn gets in there and straightens out Virginia.” At the cash bar, where patrons ordered wine and cocktails over discussions of election integrity, a collection of red signs supporting the Youngkin campaign were available to take home.But Mr. Youngkin came under fire after the Wednesday rally. At issue was a moment early in the event when a speaker had led the crowd in the Pledge of Allegiance using a flag that activists claimed was brought to the Capitol during the riot on Jan. 6. Mr. McAuliffe attacked Mr. Youngkin over the use of that flag in the pledge, and Mr. Youngkin distanced himself from the event.“I wasn’t involved and so I don’t know,” Mr. Youngkin told reporters, referring to the episode. “But if that is the case, then we shouldn’t pledge allegiance to that flag. And, oh, by the way, I’ve been so clear, there is no place for violence — none, none — in America today.”Trump supporters backing Mr. Youngkin have not been too troubled by such disavowals.Last month, Mr. Youngkin said he would have voted to certify the 2020 election results, after previously refusing to answer the question. Mr. Youngkin’s campaign said at the time that he “has repeatedly said that Joe Biden was legitimately elected and that there was no significant fraud in Virginia’s 2020 election.”Speakers at the rally connected Mr. Youngkin to Mr. Trump, who is still the most potent driver of enthusiasm and energy in the Republican Party.Carlos Bernate for The New York TimesThere has been no evidence of widespread fraud in the 2020 election, and multiple state agencies and legislatures have repeatedly disproved Mr. Trump’s claims of a rigged election. However, at the event, attendees said in interviews that they believed Mr. Youngkin stood with them in their efforts to overturn the election and to oppose the Democratic agenda.James Thornton, 47, said he did not follow politics before Mr. Trump’s election and now attends school board meetings to protest the way he said race is taught in schools. And Roxanne Joseph-Barber, 55, was passing out petitions for a forensic audit of Virginia’s 2020 presidential election results.Asked what was the most important thing she wanted campaigns to know about voters like her, Ms. Joseph-Barber paused to collect herself.“The election wasn’t honest, and we know that,” she said. “So why wouldn’t we be mad? Of course we’re mad.”Ms. Chase, who ran for governor against Mr. Youngkin before becoming a vocal supporter of his campaign, made clear in her speech that she did not trust the 2020 election results — and also implied that Mr. Youngkin agreed with her.She boasted about traveling to Arizona, South Dakota and Texas to meet with other state legislators who were interested in finding evidence that the election was stolen. And she said that even though Mr. Youngkin dismissed Mr. Trump’s claims of fraud during his debates with Mr. McAuliffe, voters should still trust that he is on their side.“I know what’s going on, and the Youngkin campaign knows what’s going on,” Ms. Chase told the crowd. In the debates, she added, Mr. Youngkin could not give “the Democrats ammo to use against us, to get the independents to go with Terry McAuliffe.”Peter Peterson, a veteran in his 60s, said that while he planned to vote for Mr. Youngkin in opposition to the Democratic agenda, he had noticed Mr. Youngkin’s hesitancy on what Mr. Peterson called his most important issue: election fraud.“Everyone treats the voting stuff as if it’s a third rail,” Mr. Peterson said. “No one wants to come out and say the vote was stolen.”Mr. Peterson, who traveled about 100 miles from Virginia Beach for the rally, said he preferred a blunt-force political instrument such as Mr. Trump to candidates who deliver polished speeches. At the Glen Allen rally, polish was in short supply.Speakers seemed to one-up each other in expressing their loyalty to Mr. Trump: Some called for the arrest of Mr. Biden. Others compared vaccine mandates to conditions in Nazi Germany or invoked violent periods in American history, including the Civil War and the American Revolution, to describe the stakes of upcoming elections.Jan Morgan, a right-wing commentator and long-shot Senate candidate in Arkansas who spoke at the event, said conservatives should see themselves much like latter-day revolutionary soldiers.“As far as I can tell,” she said, “you still got your shoes.     Virginia Governor's Race: McAuliffe Faces Democratic Apathy

    Though the state is getting bluer, voters’ exhaustion is imperiling the former governor’s comeback attempt against his Republican rival, Glenn Youngkin.RICHMOND, Va. — Terry McAuliffe doesn’t do subtext well.So when Mr. McAuliffe appeared on “Morning Joe” on MSNBC this week, it wasn’t long before the Democrat let slip the biggest challenge he’s facing next month in his bid to reclaim Virginia’s governorship. “People got to understand, Joe, this is about turnout,” he told the show’s co-host, Joe Scarborough.Mr. McAuliffe could be forgiven for effectively reading his stage directions out loud. While he is running against a self-funding, and hazily defined, Republican, polls and interviews show that Mr. McAuliffe is confronting an equally daunting obstacle: Democratic apathy.With former President Donald Trump out of office, congressional Democrats in a bitter standoff and Virginia Democrats having claimed every political prize, Mr. McAuliffe is straining to motivate the liberal voters in his increasingly blue state.At the moment — one that is being watched closely by both parties for clues about the elections next year — he is bumping up against a fatigued electorate.Virginia has elections every year, because its state campaigns are in odd-numbered years while its federal elections are, as everywhere, in even years. But voters here are drained from the Trump administration’s round-the-clock drama, which they felt more acutely because of their proximity to Washington, where the local news is also national news.Then there is the 19-month fog of Covid-19, which has not only disrupted jobs, schools and daily life but also diverted attention from state politics — which had already been dimmed by the decline of local news outlets and eclipsed by national political news.“A lot of folks are dealing with so many other things, I’m not sure that the broader community knows this is taking place, or that it’s rising to the level of importance,” said Sean Miller, who runs the Boys & Girls Club in a largely Black part of Richmond and who gave Mr. McAuliffe a tour of his center this week.Mr. McAuliffe’s former education secretary, Anne Holton — the daughter of one former governor and the wife of another — was more succinct.“People are a little exhausted,” Ms. Holton said after a round-table discussion about education in Alexandria. Still, she predicted “very high turnout.”Mr. McAuliffe, in his well-caffeinated way, is doing all he can to sound the alarm.He is stepping up his appearances on national cable news programs and summoning the biggest names in his party to cross the Potomac. Former President Barack Obama is coming to Virginia later this month, President Biden is expected soon after, and a parade of other surrogates, including Vice President Kamala Harris, are also on the way.The once and potentially future governor, who by state law could not run for re-election after his term ended in 2018, is also trying to rouse complacent Democrats by amping up his rhetoric against his Republican rival, Glenn Youngkin.Just as Gov. Gavin Newsom of California did before his larger-than-expected recall victory last month, Mr. McAuliffe is calling Democrats to the barricades by warning that Mr. Youngkin would build a liberal house of horrors in Virginia: Texas’ abortion laws, Florida’s Covid policies and, most ominous of all, Mr. Trump’s rebirth.“We cannot let Trump off the mat — his comeback is not starting in Virginia,” Mr. McAuliffe told reporters outside Fairfax County’s main early-voting site on Wednesday. Then he paused for just a moment before adding, “Only if Democrats get out and vote.”Democratic leadership in the state has loosened voting access so any resident can vote in person or by mail from Sept. 17 to Oct. 30.Win Mcnamee/Getty ImagesA pro-business Democrat with an unparalleled donor network, Mr. McAuliffe was seen by state Democrats as their safest choice. But with his decades of political experience as a fund-raiser and party leader, he’s not exactly a fresh face who will rally a new generation of voters to the polls.In recent weeks, he has made no effort to hide his frustration that his party’s warring factions in Congress have held up a bipartisan infrastructure bill. And his aides fear that without some good news from Washington, the race could slip away.While Mr. Biden carried the state by 10 points last year, public and private polling indicates the president’s approval rating has fallen to or below 50 percent in Virginia. Those same surveys suggest that Mr. McAuliffe and Mr. Youngkin are locked in a close race but that more of Mr. Youngkin’s voters are enthusiastic about voting compared with Mr. McAuliffe’s voters.Tellingly, though, the greater the turnout projections, the wider Mr. McAuliffe’s lead grows in the polls.That’s because of Virginia’s significant transformation from a Republican redoubt and hotbed of social rest to a multiracial archipelago of cities and suburbs that are as progressive as the rest of the country’s metropolitan areas. However, if voters in these population hubs, which are filled with immigrants and transplants, do not show up to the polls, Virginia may return a Republican to the governor’s mansion for the first time since 2009.That was also the last time Virginians went to the polls in the first year under a new Democratic president, Mr. Obama, whose approval ratings, like Mr. Biden’s today, had sagged since he was sworn in. Turnout in Virginia collapsed to the lowest level for a governor’s race in four decades.Unlike today, though, the previous unpopular Republican president, George W. Bush, had moved happily into retirement and ceded the spotlight fully to his successor.The question now is if the accelerating demographic shift in Virginia — no Republican has won a statewide race since 2009 — and Mr. Trump’s continued presence on the political scene are enough to lift Democrats even in a less than favorable environment.There are signs that those two factors could prove sufficient for Mr. McAuliffe, so long as he can galvanize Democrats in the same fashion as Mr. Newsom did.While Virginia Democrats may in some ways be victims of their own success, having claimed every major office and taken control of the legislature, their dominance has also allowed them to loosen voting laws. While other Southern states have been tightening voting access, Virginia enacted expansive early voting this year. Residents can vote in person or by mail between Sept. 17 and Oct. 30.What’s more, Northern Virginia has become increasingly hostile to Republicans. Fairfax County, the state’s most populous, split about evenly between Mr. Bush and Al Gore in 2000. Last year, Mr. Trump won just 28 percent of the vote there.Mr. Youngkin, who, like Mr. McAuliffe, lives in Fairfax, is positioned to perform far better there. But the threat of Mr. Trump’s return to the White House has clearly alarmed voters in the affluent and well-educated county.In interviews outside Fairfax’s early-voting site, every McAuliffe voter cited Mr. Trump as a reason for supporting the Democrat. Transportation, education and taxes — longtime core issues of Virginia governor’s races — were scarcely mentioned.Paul Erickson, an architect from Vienna, Va., summoned a reporter back after revealing his concerns about Mr. Trump and said in an urgent tone that he had more to share.“What I didn’t say is, for the first time in my adult life I fear for our nation,” Mr. Erickson said. “We’re tearing ourselves apart from within.”Others were less expansive but equally to the point.“I don’t like Trump, and I believe Youngkin is equal to Trump,” said Carol Myers, a retiree who, with her husband, was voting before playing a round of golf at the Army Navy Country Club in Arlington.Democrats are portraying Glenn Youngkin as a Trump clone.Jason Andrew for The New York TimesMr. Youngkin’s aides are skeptical that their candidate, whom they’ve spent tens of millions of dollars painting as an inoffensive suburban dad, can be MAGA-fied.On Thursday, though, the Republican received a reminder that Mr. Trump and his supporters are determined to make him take sides between them and Virginia’s broader, anti-Trump electorate.Mr. Youngkin had so far avoided inviting Mr. Trump to the state — and avoided a Trumpian attack for the stiff arm. But the former president called into a Virginia political rally on Wednesday night and said, “I hope Glenn gets in there.” More problematic for Mr. Youngkin, event organizers pledged allegiance to a flag that had been present at the Jan. 6 rally after which supporters of Mr. Trump attacked the Capitol.By the end of the day Thursday, Mr. Youngkin — who had skipped the rally to deny Democrats an opening to link him to Mr. Trump — issued a statement calling the use of the flag “weird and wrong.”To Mr. McAuliffe it was something else: a political gift.Mr. McAuliffe has tried to lash Mr. Youngkin to Mr. Trump, noting that he had gladly accepted the former president’s endorsement, and derides him as “a Trump wannabe,.”If that Trumpification strategy works for Mr. McAuliffe, it will most likely be replicated by other Democrats running in blue and purple states next year.In Virginia, it’s easy to understand why Democrats have gone back to the same well: Mr. Trump was a one-man turnout machine for them. In 2019, when only state House and Senate races were on the ballot, turnout reached almost the same level as in 2013, when Mr. McAuliffe won the governorship. During the 2018 congressional midterms, when Virginia Democrats picked up two House seats, turnout was at nearly 60 percent. Four years earlier, in a pre-Trump midterm, turnout here was less than 42 percent.In Richmond’s Black community, Mr. Trump is still on the minds of some voters.“It’s crazy to think that a president that lost still has such a hold on a certain group of people,” said Herman Baskerville, who owns Big Herm’s restaurant in the city’s historic Jackson Ward.Standing outside his restaurant as dusk fell on quiet streets, however, Mr. Baskerville was more focused on the slowdown in foot traffic around Richmond during the coronavirus pandemic. Fewer people working in their offices has meant fewer customers.“Many of us feel like we’re near normal, but there are a lot of folks who are still suffering,” said Mayor Levar Stoney of Richmond. Then Mr. Stoney, a protégé of Mr. McAuliffe’s, got back on message.“My fear is, the policies you see in Florida and Texas, that could take Virginia backwards,” he said. More

    Jan. 6 Panel Moves to Recommend Criminal Charges Against Bannon

    The House select committee investigating the Capitol riot will vote next week to recommend a criminal contempt of Congress charge against Stephen K. Bannon after he defied a subpoena.WASHINGTON — The chairman of the House inquiry into the Jan. 6 attack on the Capitol said the committee would move next week to recommend that Stephen K. Bannon, a former top adviser to President Donald J. Trump, face criminal contempt charges for refusing to cooperate with its investigation.The move would escalate what is shaping up to be a major legal battle between the select committee and the former president over access to crucial witnesses and documents that could shed light on what precipitated the assault, when a pro-Trump mob stormed the Capitol and disrupted Congress’s formal count of the votes that confirmed President Biden’s election.The fight will test how far Congress will be able to go in pressing forward on the investigation in the face of stonewalling by the former president. Should the House ultimately approve the referral, as expected, the Justice Department would decide whether to accept it and pursue a criminal case.So far, the Biden administration has taken the unusual step of refusing to honor Mr. Trump’s claims of executive privilege, which can shield White House deliberations or documents involving the president from disclosure.Mr. Bannon informed the panel last week that he would defy a subpoena, in accordance with a directive from Mr. Trump, who has told former aides and advisers that they should not cooperate because the information requested is privileged.“Mr. Bannon has declined to cooperate with the select committee and is instead hiding behind the former president’s insufficient, blanket and vague statements regarding privileges he has purported to invoke,” Representative Bennie Thompson, Democrat of Mississippi and the chairman of the committee, said in a statement.The committee, which is controlled by Democrats, will consider the referral on Tuesday and is all but certain to agree to it. That would send the criminal contempt citation to the full House, where Democrats have the votes to approve it. The matter would then be sent to the Justice Department with a recommendation that officials pursue a legal case against Mr. Bannon.The cumbersome procedure reflects a challenging reality that Democrats are grappling with as they delve deeper into the Jan. 6 inquiry. Congress is a legislative body, not a law enforcement entity, and its ability to compel cooperation and punish wrongdoing on its own is inherently limited. Its investigative tools are only as powerful as the courts decide, and the process of waging legal fights to secure crucial information and witnesses is likely to be a prolonged one.Robert J. Costello, a lawyer for Mr. Bannon, said in a letter to the committee on Wednesday that his client would not produce documents or testimony “until such time as you reach an agreement with President Trump” on claims of executive privilege “or receive a court ruling.”The case of Mr. Bannon is particularly tricky because he has not been an executive branch official since he left the White House in 2017, and any conversations he may have had with Mr. Trump pertaining to Jan. 6 are likely to have fallen outside the former president’s official duties.No court has definitively said whether conversations with private citizens are covered by executive privilege, which is generally extended in relation to conversations or documents that pertain to presidential duties.“Privilege for a private citizen, who was potentially talking about things outside of the president’s official duties, has never been tested in court,” said Jonathan D. Shaub, a law professor at the University of Kentucky who worked at the Justice Department’s Office of Legal Counsel.Even as it moves aggressively against Mr. Bannon, the panel has taken a different approach to two other advisers to Mr. Trump who have so far declined to comply with its subpoenas but have not stonewalled the inquiry entirely.Mark Meadows, the former White House chief of staff, and Kash Patel, a former Pentagon chief of staff, were also summoned to sit for depositions this week, but they are not yet facing contempt citations for failing to do so.The committee said it was in communication with Mr. Meadows and Mr. Patel, and a person with knowledge of those talks said that lawmakers were likely to grant them a delay before testifying. Dan Scavino Jr., a former White House deputy chief of staff under Mr. Trump, was served with his subpoena last week.For years while Mr. Trump was president, administration officials refused to comply with congressional subpoenas, thumbing their noses at Democratic lawmakers on matters from election interference to census questions. Democrats, in turn, opted not to try to press their claims in court, concluding that the process would be too time-consuming to be effective, particularly in the case of Mr. Trump’s impeachment.Now that he has left office, Democrats and Mr. Biden’s Justice Department must decide how aggressive they want to be in waging legal battles to insist on congressional prerogatives. That includes the question of whether to try to compel cooperation in the investigation from Mr. Trump himself, which Mr. Thompson has repeatedly said was possible, but which raises legal and logistical challenges that many Democrats privately say make it unlikely.Under federal law, any person summoned as a congressional witness who refuses to comply can face a misdemeanor charge that carries a fine of $100 to $100,000 and a jail sentence of one month to one year.But the Justice Department has generally refrained from prosecuting executive branch officials when they have refused to comply with subpoenas, and Congress has voted to hold them in contempt, according to a 2019 Congressional Research Service report.Justice Department legal opinions from 1984 and 2008 say that the department will not prosecute officials for complying with a president’s formal assertion of privilege over conversations or documents.In 2015, the Justice Department under President Barack Obama said it would not seek criminal contempt charges against Lois Lerner, a former I.R.S. official; and in 2019, the department under Mr. Trump made a similar decision, rebuffing Congress on behalf of Attorney General William P. Barr and Commerce Secretary Wilbur Ross.The last person charged with criminal contempt of Congress, Rita M. Lavelle, a former federal environmental official under President Ronald Reagan, was found not guilty in 1983 of failing to appear at a congressional subcommittee hearing. She was later sentenced to jail for lying to Congress.Jeffrey S. Robbins, a former federal prosecutor and a partner at the law firm Saul Ewing Arnstein & Lehr, said under different circumstances, the committee might face an uphill battle enforcing the subpoena: if the Justice Department were still under Mr. Trump, Congress were in Republican hands, or there were a reasonable argument — such as protecting national security — for invoking executive privilege. In this case, Mr. Robbins said, none of those circumstances existed.“It’s open contempt of a subpoena without an apparent basis,” said Mr. Robbins, who teaches a course on congressional investigations at Brown University. He called the invocation of executive privilege “patently bogus,” adding, “It’s difficult to imagine it will not be referred for prosecution.”Once Congress votes to hold Mr. Bannon in contempt, the next step would be to refer the matter to the U.S. attorney in Washington. If the White House determines that no claim of executive privilege applies, the U.S. attorney’s office would then decide whether to bring the case before a grand jury, in consultation with top Justice Department officials.But if Mr. Bannon were to sue over the issue, the Justice Department would most likely follow past practice and wait for the courts to resolve the lawsuit before bringing the contempt charge before a grand jury, Mr. Shaub said.In letters transmitting its subpoenas to Mr. Bannon and the three former Trump administration officials, the committee said it was seeking information about the president’s actions in the run-up to and during the riot.Mr. Bannon reportedly communicated with Mr. Trump on Dec. 30 and urged him to focus his efforts on Jan. 6, the committee said. He was also present at a meeting at the Willard Hotel in Washington the day before the violence, when plans were discussed to try to overturn the results of the election the next day, the committee stated. Mr. Bannon was quoted as saying, “All hell is going to break loose tomorrow.”On Wednesday, the committee also issued a subpoena to Jeffrey Clark, a former Justice Department official who was involved in Mr. Trump’s efforts to overturn the election. The committee’s action came the same day it heard lengthy closed-door testimony from Jeffrey A. Rosen, the former acting attorney general, who has testified publicly and privately about the final days of the Trump administration, when the former president was pressing top officials to use the Justice Department to advance false claims of election fraud.In private testimony before the Senate Judiciary Committee, Mr. Rosen said that Mr. Clark had told him that Mr. Trump was getting ready to fire Mr. Rosen and endorse Mr. Clark’s strategy of pursuing conspiracy theories about the hacking of voting booths and fraud.“Well, I don’t get to be fired by someone who works for me,” Mr. Rosen said he told Mr. Clark.     F.B.I. Official Fired Under Trump Wins Back His Pension

    Andrew G. McCabe, the former F.B.I. deputy director, will receive his pension and other benefits after settling his lawsuit with the Justice Department.WASHINGTON — Hours before he was scheduled to retire in 2018, Andrew G. McCabe, then the F.B.I.’s deputy director, was fired by the Justice Department, depriving him of his pension and prompting cheers from President Donald J. Trump, who had been hounding him over his role in the Russia investigation.On Thursday, the department reversed Mr. McCabe’s firing, settling a lawsuit he filed asserting that he was dismissed for political reasons. Under the settlement, Mr. McCabe, 53, will be able to officially retire, receive his pension and other benefits, and get about $200,000 in missed pension payments.In addition, the department agreed to expunge any mention of his firing from F.B.I. personnel records. The agreement even made clear that he would receive the cuff links given to senior executives and a plaque with his mounted F.B.I. credentials and badge.The Justice Department did not admit any wrongdoing. But the settlement amounted to a rejection by the Biden administration of how Mr. McCabe’s case had been handled under Mr. Trump, who perceived Mr. McCabe as one of his so-called deep-state enemies and repeatedly attacked him. A notice of the lawsuit’s dismissal was also filed in federal court.“Politics should never play a role in the fair administration of justice and Civil Service personnel decisions,” Mr. McCabe said in a statement. “I hope that this result encourages the men and women of the F.B.I. to continue to protect the American people by standing up for the truth and doing their jobs without fear of political retaliation.”Mr. McCabe thanked his lawyers at the firm of Arnold & Porter, who will receive more than $500,000 in legal fees paid by the government. The firm intends to donate the money to its foundation, which provides scholarships to minority law students, among other things.“What happened to Andrew was a travesty, not just for him and his family, but the rule of law,” said Murad Hussain, one of Mr. McCabe’s lawyers. “We filed this suit to restore his retirement benefits, restore his reputation and take a stand for the rights of all civil servants, and that’s exactly what this settlement does.”The Justice Department did not immediately respond to a request for comment.Jeff Sessions, the attorney general at the time, fired Mr. McCabe on March 16, 2018, after the department’s inspector general said Mr. McCabe had lied repeatedly about a leak to a newspaper about Hillary Clinton’s use of a private email server. The case was referred to prosecutors, who ultimately decided not to charge Mr. McCabe with making false statements to a law enforcement officer.Mr. Sessions acted a day before Mr. McCabe’s retirement was set to take effect, and after months of public criticism of Mr. McCabe by Mr. Trump.With the lawsuit resolved, the Justice Department and F.B.I. avoid the risk that moving toward a trial could produce embarrassing information through the discovery process and depositions. In September 2020, a federal judge rejected the department’s efforts to dismiss the case, allowing the litigation to move forward.Mr. McCabe’s lawyers had planned to question the F.B.I. director, Christopher A. Wray, and his former deputy, David L. Bowdich. The lawyers would have also grilled Mr. Sessions and his deputy at the time, Rod J. Rosenstein, as well as others, including the department’s inspector general, Michael E. Horowitz.Mr. McCabe and his lawyers had argued that he was fired because he refused to swear loyalty to the president at the time. He also had been part of F.B.I. leadership that opened an investigation into whether any Trump campaign associates had conspired with Russia in the 2016 presidential election. Mr. Trump repeatedly called the inquiry a witch hunt and fired the F.B.I. director at the time, James B. Comey, after expressing his fury about the investigation.Mr. Trump had urged the Justice Department to get rid of Mr. McCabe. After the news media reported in December 2017 that Mr. McCabe planned to retire, Mr. Trump said on Twitter that “FBI Deputy Director Andrew McCabe is racing the clock to retire with full benefits. 90 days to go?!!!”Mr. McCabe, a graduate of Duke University and of Washington University School of Law in St. Louis, joined the F.B.I. in 1996 as an agent in the New York office and quickly climbed the bureau’s ranks. Mr. Comey appointed Mr. McCabe deputy director in 2016, putting him in charge of operations as the bureau’s senior most agent.Mr. McCabe’s rise in the bureau took a vertiginous turn in January 2018 when Mr. Wray demoted Mr. McCabe without telling him why. Mr. McCabe then elected to take leave until March, when he was eligible for retirement.Nearly a month after he was fired, the inspector general released his findings, issuing a report on Mr. McCabe’s conduct, saying he had failed to be completely honest in answering questions about his role in the news media leak about the Clinton case.Mr. McCabe sued over his dismissal, saying he was a victim of political retaliation. In the suit, he said that Mr. Sessions, Mr. Wray and others “served as Trump’s personal enforcers rather than the nation’s highest law enforcement officials, catering to Trump’s unlawful whims instead of honoring their oaths to uphold the Constitution.”Firing Mr. McCabe “was a critical element of Trump’s plan and scheme” to rid the F.B.I. and Justice Department of those deemed not loyal to the president, his lawsuit said. Mr. McCabe accused the department of retaliation and terminating him for political reasons, which violated agency policies. Mr. McCabe’s lawyer also argued that as a career civil servant, Mr. McCabe should have been given 30 days’ notice before he was fired.Indeed, a series of emails raised questions about whether Mr. McCabe’s firing was fast tracked by the F.B.I. or Justice Department. The emails were obtained by Citizens for Responsibility and Ethics in Washington, or CREW.Just after noon on March 5, 2018, Candice M. Will, who oversaw the termination effort for the F.B.I.’s Office of Professional Responsibility, emailed Mr. Rosenstein to let him know that her office had completed its review and was preparing a recommendation.Later that same day, Ms. Will then emailed Mr. Bowdich: “I let the Dept know that we are doing what should be done, not slow walking — we are following the established procedures.”He responded that they would be “second guessed by some every step of the way however this ends up.”Why Ms. Will made the comment about “slow walking” is not publicly known, but Mr. McCabe’s lawyers intended to find out and depose her if the case had moved forward.On March 7, Ms. Will recommended that Mr. McCabe be fired over the inspector general’s report. In a handwritten note accompanying the recommendation, she advised Mr. Wray and Mr. Bowdich: “It seems unlikely that this will reach final resolution before Mr. McCabe’s March 18 retirement date.” But, she said, it was up to the deputy attorney general.She spoke later that day to a top aide of Mr. Rosenstein, which seemed to set off a flurry of activity — including meetings and sensitive calls — among senior department officials scrambling to make sure Mr. McCabe was fired before his planned retirement date. In one instance, Steven A. Engel, the head of the department’s office of legal counsel, emailed one of Mr. Rosenstein’s aides with the F.B.I. guidelines for removing a senior bureau official.After Mr. McCabe was fired, Mr. Trump celebrated on Twitter, calling it “a great day for the hard working men and women of the FBI — A great day for Democracy.” More

    Jan. 6 Panel Subpoenas Jeffrey Clark, Former Justice Dept. Official

    The committee asked for testimony and documents from the little-known former official who pressed his colleagues to pursue Donald J. Trump’s election fraud claims.WASHINGTON — The House committee investigating the Jan. 6 Capitol riot issued a subpoena on Wednesday to Jeffrey Clark, a former Justice Department official under President Donald J. Trump who was involved in Mr. Trump’s frenzied efforts to overturn the 2020 presidential election.The subpoena seeks testimony and records from Mr. Clark, a little-known official who repeatedly pushed his colleagues at the Justice Department to help Mr. Trump undo his loss. The panel’s focus on him indicates that it is deepening its scrutiny of the root causes of the attack, which disrupted a congressional session called to count the electoral votes formalizing President Biden’s victory.“The select committee needs to understand all the details about efforts inside the previous administration to delay the certification of the 2020 election and amplify misinformation about the election results,” Representative Bennie Thompson, Democrat of Mississippi and the committee chairman, said in a statement. “We need to understand Mr. Clark’s role in these efforts at the Justice Department and learn who was involved across the administration.”The subpoena was the 19th issued in the House inquiry, and it came as the panel braced for a potential legal battle with at least one prospective witness, Stephen K. Bannon, a former adviser to Mr. Trump who has refused to cooperate. The leaders of the committee threatened last week to seek criminal charges against Mr. Bannon in response.Robert J. Costello, a lawyer for Mr. Bannon, did not back down in a letter to the committee on Wednesday, reiterating that his client would not produce documents or testimony “until such time as you reach an agreement with President Trump” on claims of executive privilege “or receive a court ruling.”On Wednesday, Mr. Thompson said the panel “expects Mr. Clark to cooperate fully with our investigation.”The Senate Judiciary Committee said last week that there was credible evidence that Mr. Clark was involved in efforts to interrupt the peaceful transfer of power, citing his proposal to deliver a letter to state legislators in Georgia and others encouraging them to delay certification of election results.The Senate committee also said Mr. Clark recommended holding a news conference announcing that the Justice Department was investigating allegations of voter fraud, in line with Mr. Trump’s repeated demands, despite a lack of evidence of any fraud. Both proposals were rejected by senior leaders in the department.The New York Times reported in January that Mr. Clark also discussed with Mr. Trump a plan to oust the acting attorney general, Jeffrey A. Rosen, and wield the department’s power to force state lawmakers in Georgia to overturn its presidential election results. Mr. Clark denied the account, which was based on the accounts of four former Trump administration officials who asked not to be named because of fear of retaliation.The House panel’s subpoena requires Mr. Clark to produce records and testify at a deposition on Oct. 29.Last week, the committee issued subpoenas to organizers of the “Stop the Steal” rally that took place on the grounds of the Capitol before the violence.     Democrats Can’t Just Give the People What They Want

    Over the 20-year period from 1970 to 1990, whites, especially those without college degrees, defected en masse from the Democratic Party. In those years, the percentage of white working class voters who identified with the Democratic Party fell to 40 percent from 60, Lane Kenworthy, a sociologist at the University of California-San Diego, wrote in “The Democrats and Working-Class Whites.”Now, three decades later, the Democratic Party continues to struggle to maintain not just a biracial but a multiracial and multiethnic coalition — keeping in mind that Democrats have not won a majority of white voters in a presidential election since Lyndon Johnson’s landslide victory in 1964.There have been seven Democratic and seven Republican presidents since the end of World War II. Obstacles notwithstanding, the Democratic coalition has adapted from its former incarnation as an overwhelmingly white party with a powerful southern segregationist wing to its current incarnation: roughly 59 percent white, 19 percent Black, 13 percent Hispanic, and 8 percent Asian American and other groups.William Julius Wilson, a sociologist at Harvard, put the liberal case for the importance of a such a political alliance eloquently in “Rising Inequality and the Case for Coalition Politics”:An organized national multiracial political constituency is needed for the development and implementation of policies that will help reverse the trends of the rising inequality and ease the burdens of ordinary families.Biden won with a multiracial coalition, but even in victory, there were signs of stress.In their May 21 analysis, “What Happened in 2020,” Yair Ghitza, chief scientist at Catalist, a liberal voter data analysis firm, and Jonathan Robinson, its director of research, found that Black support for the Democratic presidential nominee fell by 3 percentage points from 2016 to 2020, and Latino support fell by eight points over the same period, from 71 to 63 percent.At the same time, whites with college degrees continued their march into the Democratic Party: “The trends all point in the same direction, i.e., a substantial portion of this constituency moving solidly toward Democrats in the Trump era.” Among these well-educated whites, the percentage voting for the Democratic nominee rose from 46 percent in 2012 to 50 percent in 2016 to 54 percent in 2020. These gains were especially strong among women, according to Catalist: “White college-educated women in particular have shifted against Trump, moving from 50 percent Democratic support in 2012 to 58 percent in 2020.”In a separate June 2021 study, “Behind Biden’s 2020 Victory,” by Ruth Igielnik, Scott Keeter and Hannah Hartig, Pew Research found thatEven as Biden held on to a majority of Hispanic voters in 2020, Trump made gains among this group overall. There was a wide educational divide among Hispanic voters: Trump did substantially better with those without a college degree than college-educated Hispanic voters (41 percent vs. 30 percent).Biden, according to Pew, made significant gains both among all suburban voters and among white suburban voters: “In 2020, Biden improved upon Clinton’s vote share with suburban voters: 45 percent supported Clinton in 2016 vs. 54 percent for Biden in 2020. This shift was also seen among White voters: Trump narrowly won White suburban voters by 4 points in 2020 (51-47); he carried this group by 16 points in 2016 (54-38).”Crucially. all these shifts reflect the continuing realignment of the electorate by level of educational attainment or so-called “learning skills,” with one big difference: Before 2020, education polarization was found almost exclusively among whites; last year it began to emerge among Hispanics and African Americans.Two Democratic strategists, Ruy Teixeira and John Halpin, both of whom publish their analyses at the Liberal Patriot website, have addressed this predicament.On Sept. 30 in “There Just Aren’t Enough College-Educated Voters!” Teixeira wrote:The perception that nonwhite working class voters are a lock for the Democrats is no longer tenable. In the 2020 election, working class nonwhites moved sharply toward Trump by 12 margin points, despite Democratic messaging that focused relentlessly on Trump’s animus toward nonwhites. According to Pew, Trump actually got 41 percent of the Hispanic working class vote in 2016. Since 2012, running against Trump twice, Democrats have lost 18 points off of their margin among nonwhite working class voters.In an effort to bring the argument down to earth, I asked Teixeira and Halpin three questions:1. Should Democrats support and defend gender and race-based affirmative action policies?2. If asked in a debate, what should a Democrat say about Ibram X. Kendi’s claim that “Standardized tests have become the most effective racist weapon ever devised to objectively degrade Black and Brown minds and legally exclude their bodies from prestigious schools?”3. How should a Democrat respond to questions concerning intergenerational poverty, nonmarital births and the issue of fatherlessness?In an email, Teixeira addressed affirmative action:Affirmative action in the sense of, say, racial preferences has always been unpopular and continues to be so. The latest evidence comes from the deep blue state of California which defeated an effort to reinstate race and gender preferences in public education, employment and contracting by an overwhelming 57-43 margin. As President Obama once put it: ‘We have to think about affirmative action and craft it in such a way where some of our children who are advantaged aren’t getting more favorable treatment than a poor white kid who has struggled more,’ There has always been a strong case for class-based affirmative action which is perhaps worth revisiting rather than doubling down on race-based affirmative action.Teixeira on Kendi’s arguments:It is remarkable how willing liberal elites have been to countenance Kendi’s extreme views which ascribe all racial disparities in American society to racism and a system of untrammeled white supremacy (and only that), insist that all policies/actions can only be racist or anti-racist in any context and advocate for a Department of Anti-Racism staffed by anti-racist “experts” who would have the power to nullify any and all local, state and federal legislation deemed not truly anti-racist (and therefore, by Kendi’s logic, racist). These ideas are dubious empirically, massively simplistic and completely impractical in real world terms. And to observe they are politically toxic is an understatement.The left, in Teixeira’s view,has paid a considerable price for abandoning universalism and for its increasingly strong linkage to Kendi-style views and militant identity politics in general. This has resulted in branding the party as focused on, or at least distracted by, issues of little relevance to most voters’ lives. Worse, the focus has led many working-class voters to believe that, unless they subscribe to this emerging worldview and are willing to speak its language, they will be condemned as reactionary, intolerant, and racist by those who purport to represent their interests. To some extent these voters are right: They really are looked down upon by elements of the left — typically younger, well-educated, and metropolitan — who embrace identity politics and the intersectional approach.In March, Halpin wrote an essay, “The Rise of the Neo-Universalists,” in which he argued thatthere is an emerging pool of political leaders, thinkers and citizens without an ideological home. They come from the left, right, and center but all share a common aversion to the sectarian, identity-based politics that dominates modern political discourse and the partisan and media institutions that set the public agenda.He calls this constituency “neo-universalists,” and says that they are united by “a vision of American citizenship based on the core belief in the equal dignity and rights of all people.” This means, he continued,not treating people differently based on their gender or their skin color, or where they were born or what they believe. This means employing collective resources to help provide for the ‘general welfare’ of all people in terms of jobs, housing, education, and health care. This means giving people a chance and not assuming the worst of them.How, then, would neo-universalism deal with gender and race-based affirmative action policies?“In terms of affirmative action, neo-universalism would agree with the original need and purpose of affirmative action following the legal dismantling of racial and gender discrimination,” Halpin wrote in an email:America needed a series of steps to overcome the legal and institutional hurdles to their advancement in education, the workplace, and wider life. Fifty years later, there has been tremendous progress on this front and we now face a situation where ongoing discrimination in favor of historically discriminated groups is hard to defend constitutionally and will likely hit a wall very soon. In order to continue ensuring that all people are integrated into society and life, neo-universalists would favor steps to offer additional assistance to people based on class- or place-based measures such as parental income or school profiles and disparities, in the case of education.What did Halpin think about Kendi’s views?A belief in equal dignity and rights for all, as expressed in neo-universalism and traditional liberalism, rejects the race-focused theories of Kendi and others, and particularly the concept that present discrimination based on race is required to overcome past discrimination based on race. There is no constitutional defense of this approach since you clearly cannot deprive people of due process and rights based on their race.In addition, theories like these, in Halpin’s view, foster “sectarian racial divisions and encourage people to view one another solely through the lens of race and perceptions of who is oppressed and who is privileged.” Liberals, Halpin continued, “spent the bulk of the 20th century trying to get society not to view people this way, so these contemporary critical theories are a huge step backward in terms of building wider coalitions and solidarity across racial, gender, and ethnic lines.”On the problem of intergenerational poverty, Halpin argued thatReducing and eradicating poverty is a critical focus for neo-universalists in the liberal tradition. Personal rights and freedom mean little if a person or family does not have a basic foundation of solid income and work, housing, education, and health care. Good jobs, safe neighborhoods, and stable two-parent families are proven to be critical components of building solid middle class life. Although the government cannot tell people how to organize their lives, and it must deal with the reality that not everyone lives or wants to live in a traditional family, the government can take steps to make family life more affordable and stable for everyone, particularly for those with children and low household income.Although the issue of racial and cultural tension within the Democratic coalition has been the subject of debate for decades, the current focus among Democratic strategists is on the well-educated party elite.David Shor, a Democratic data analyst, has emerged as a central figure on these matters. Shor’s approach was described by my colleague Ezra Klein last week. First, leaders need to recognize that “the party has become too unrepresentative at its elite levels to continue being representative at the mass level” and then “Democrats should do a lot of polling to figure out which of their views are popular and which are not popular, and then they should talk about the popular stuff and shut up about the unpopular stuff.”How can Democrats defuse inevitable Republican attacks on contemporary liberalism’s “unpopular stuff” — to use Klein’s phrase — much of which involves issues related to race and immigration along with the disputes raised by identity politics on the left?Shor observes that “We’ve ended up in a situation where white liberals are more left wing than Black and Hispanic Democrats on pretty much every issue: taxes, health care, policing, and even on racial issues or various measures of ‘racial resentment’, ” before adding, “So as white liberals increasingly define the party’s image and messaging, that’s going to turn off nonwhite conservative Democrats and push them against us.”The result?“The joke is that the G.O.P. is really assembling the multiracial working-class coalition that the left has always dreamed of,” Shor told Politico in an interview after the election in November.On Oct. 9, another of my colleagues, Jamelle Bouie, weighed in:My problem is that I don’t think Shor or his allies are being forthright about what it would actually take to stem the tide and reverse the trend. If anti-Black prejudice is as strong as this analysis implies, then it seems ludicrous to say that Democrats can solve their problem with a simple shift in rhetoric toward their most popular agenda items. The countermessage is easy enough to imagine — some version of ‘Democrats are not actually going to help you, they are going to help them’.Bouie’s larger point is thatThis debate needs clarity, and I want Shor and his allies to be much more forthright about the specific tactics they would use and what their strategy would look like in practice. To me, it seems as if they are talking around the issue rather than being upfront about the path they want to take.Shor’s critique of the contemporary Democratic Party and the disproportionate influence of its young, well-educated white liberal elite has provoked a network of counter-critiques. For example, Ian Hanley-Lopez, a law professor at Berkeley, recently posted “Shor is mainly wrong about racism (which is to say, about electoral politics)” on Medium, an essay in which Lopez argues thatThe core problem for the Democratic Party is not too many young, liberal activists. The fundamental challenge for Democrats is to develop a unified, effective response to the intense polarization around race intentionally driven by Trump and boosted by the interlocking elements of the right-wing propaganda machine.Haney-Lopez agrees thatDemocratic messages alienate voters when they are predicated on a sense of identity that voters do not share. For instance, “defund the police” and “abolish ICE” are deeply connected to a story of the police and ICE as white supremacist institutions that oppress communities of color. In turn, this story depicts the country as locked into a historic conflict between white people and people of color. It thus asks white voters to see themselves as members of an oppressive group they must help to disempower; and it asks voters of color to see themselves as members of widely hated groups they must rally to defend. This framing is acceptable to many who are college educated, white and of color alike, but not to majorities of voters.But, in Lopez’s view,Shor weds himself to the wrong conclusion. As the Ezra Klein piece reports, Shor “and those who agree with him argue that Democrats need to try to avoid talking about race and immigration.’” This is Shor’s most dangerous piece of advice to Democrats. For Shor, this has become an article of faith.Lopez argues that the best way to defuse divisive racial issues is to explicitly portray such tactics as “a divide-and-conquer strategy.”The basic idea, Lopez wrote,is to shift the basic political conflict in the United States from one between racial groups (the right’s preferred frame) to one between the 0.1 percent and the rest of us, with racism as their principal weapon. In our research, this race-class fusion politics is the most promising route forward for Democrats.Steve Phillips, the founder of Democracy in Color (and, like Haney-Lopez, a frequent contributor to The Times), goes a giant step further. In an email, Phillips argued that for over 50 years, “Democrats have NEVER won the white vote. All of it is dancing around the real issue, which is that the majority of white voters never back Democrats.” Even white college-educated voters “are very, very fickle. There’s some potential to up that share, but at what cost?” The bottom line? “I don’t think they’re movable; certainly, to any appreciable sense.”Phillips wrote that hisbiggest point is that it’s not necessary or cost-efficient to try to woo these voters. A meaningful minority of them are already with us and have always been with us. There are now so many people of color in the country (the majority of young people), that that minority of whites can ally with people of color and win elections from the White House to the Georgia Senate runoffs,” noting, “plus, you don’t have to sell your soul and compromise your principles to woo their support.In his email, Phillips acknowledged that “it does look like there has been a small decline in that Clinton got 76 percent of the working class vote among minorities and Biden 72 percent. But I still come back to the big picture points mentioned above.”On this point, Phillips may underestimate the significance of the four-point drop, and of the larger decline among working class Hispanics. If this is a trend — a big if because we don’t yet know how much of this is about Donald Trump and whether these trends will persist without him — it has the hallmarks of a new and significant problem for Democrats in future elections. In that light, it is all the more important for Democratic strategists of all ideological stripes to spell out what specific approaches they contend are most effective in addressing, if not countering, the divisive racial and cultural issues that have weakened the party in recent elections, even when they’re won.Saying the party’s candidates should simply downplay the tough ones may not be adequate.The Times is committed to publishing a diversity of letters to the editor.     As Lev Parnas' Trial Begins, Trump’s Shadow Looms

    Though Mr. Parnas played a key role in the events that led to the former president’s impeachment, the charges he faces involve accusations of campaign finance violations.For Lev Parnas, a Ukrainian American businessman living in Florida, 2018 was a busy year.Sometime around March, he began showing up at Republican fund-raisers. Then, in late April, he dined on cheeseburgers and wedge salads with President Donald J. Trump.By May, a fledgling energy company that Mr. Parnas started with a partner, Igor Fruman, was listed as giving $325,000 to a pro-Trump super PAC. Soon, Mr. Parnas was assisting President Trump’s personal lawyer, Rudolph W. Giuliani, as he oversaw a shadow diplomacy campaign to investigate Joseph R. Biden Jr., then a leading Democratic presidential candidate.Within a year, Mr. Parnas was under investigation, and in late 2019 he was arrested with Mr. Fruman at Dulles International Airport, where both held one-way tickets on a Lufthansa Airlines flight to Frankfurt.Now, Mr. Parnas is facing a trial on campaign finance charges that include contributions to the super PAC and a state candidate in Nevada, where he wanted to operate a cannabis business. And though the case has little to do with his dealings with the former president — who was not accused of wrongdoing in the matter — Mr. Trump’s shadow hangs over Mr. Parnas’s trial, which begins Tuesday in federal court in Manhattan.The trial is expected to fill in gaps in the story of Mr. Parnas’s improbable ascent and downfall, from humble beginnings in Brooklyn to playing a key role in a sequence of events connected to the impeachment of Mr. Trump over accusations that he had asked Ukraine to investigate unfounded allegations about Mr. Biden and a conspiracy theory that Ukraine, rather than Russia, had meddled in the 2016 election.“Parnas is an interesting figure because in many respects he was in the underbelly of the Ukraine story,” said Daniel S. Goldman, the House Intelligence Committee lawyer who led the Ukraine inquiry. “We understood that Parnas in particular was Giuliani’s liaison to a lot of the significant officials in Ukraine.”According to an indictment unsealed after the airport arrests, Mr. Parnas, along with Mr. Fruman and two other co-defendants, conspired to circumvent the federal laws against foreign influence “by engaging in a scheme to funnel foreign money to candidates for federal and state office.”Mr. Fruman pleaded guilty last month to soliciting a campaign contribution from a foreign national. He is described in court papers as a partner in the planned cannabis business and a participant in a conspiracy to make political donations using money from a rich Russian businessman, Andrey Muraviev.A prosecutor, Hagan Cordell Scotten, suggested during a recent court hearing that Mr. Parnas could be viewed as “something of a genius serial fraudster.”One man who lost money by investing in a company led by Mr. Parnas remembered him wearing diamonds and driving a Rolls-Royce. But behind the trappings of affluence was a history of debts and aborted businesses.As he entered the world of political donors, Mr. Parnas seemed to see it in purely transactional terms, using money to gain access to Republican influencers, then apparently hoping to use those connections to further various moneymaking efforts.While working with Mr. Giuliani in late 2018 and 2019, Mr. Parnas traveled to Kyiv to press officials there to investigate Mr. Biden’s son Hunter, who had served as a board member of a Ukrainian energy company.Records released by Mr. Parnas show that he maintained regular communication with Yuriy Lutsenko, then Ukraine’s chief prosecutor, who was urging the removal of the United States ambassador in Kyiv and promising to help obtain information about both Bidens.Mr. Parnas also exchanged text messages with a Trump ally, Robert F. Hyde, that appeared to include references to people conducting surveillance on the ambassador, who Mr. Trump eventually recalled from her post. Mr. Giuliani later said in an interview with The New Yorker that he wanted that ambassador, Marie Yovanovitch, “out of the way” because he feared she would complicate his attempts to dig up dirt on Joe Biden.After Mr. Parnas’s arrest, Mr. Trump denied knowing him. Before long, Mr. Parnas reversed his loyalties, saying he regretted trusting Mr. Giuliani and Mr. Trump and providing documents, including some related to Ms. Yovanovitch, to the House Intelligence Committee as part of its impeachment inquiry.Federal prosecutors in Manhattan are investigating Mr. Giuliani’s pre-election activities in Ukraine. He has denied wrongdoing.The schemes that prosecutors are planning to outline during the upcoming trial seem more brash than sophisticated.The $325,000 donation to the super PAC, America First Action, was made using money that an indictment said Mr. Fruman and others obtained through a private loan, prosecutors have said. Court papers said that the donation was falsely listed in the name of Global Energy Producers, the company Mr. Parnas and Mr. Fruman were starting, because they were eager to “make it appear that GEP was a successful business.”Mr. Parnas is also accused of making a maximum contribution of $2,700 to the re-election campaign of Pete Sessions, a Republican congressman from Texas and a critic of Ms. Yovanovitch, using a credit card registered to an account belonging to Mr. Fruman and another person.And, according to an indictment, Mr. Parnas was part of a conspiracy to make political contributions by a foreign national. As part of that, the indictment said, a businessman — identified by prosecutors in a separate document as Mr. Muraviev — sent $1 million to a bank account controlled by Mr. Fruman “for purposes of making political donations and contributions.”Among candidates who prosecutors said Mr. Parnas promised to support was Adam Laxalt, who in 2018 was running for governor of Nevada and after the presidential election spoke at a news conference announcing a lawsuit by the Trump campaign seeking to overturn Mr. Biden’s victory in the state. (That suit was dismissed by a state court judge for lack of evidence.)Prosecutors said in a recent court filing that Mr. Laxalt became suspicious about the origins of a $10,000 donation to his campaign identified as being from Mr. Fruman, and sent a check for that amount to the U.S. Treasury “in order to avoid continued possession of the illegal donation without returning it to a potential wrongdoer.”In court filings and during a recent hearing, prosecutors and defense lawyers offered some indications of what arguments they might advance and what evidence they could introduce during the trial.Prosecutors wrote that they intended to offer out-of-court statements made by both defendants, as well as Mr. Correia, Mr. Fruman and Mr. Muraviev. Most of those, they added, “were made in electronic communications, such as emails, text messages, and chats using WhatsApp.”Likely witnesses, they wrote, included Deanna Van Rensburg, who served as Mr. Parnas’s personal assistant from about April 2018 until his arrest, and Mr. Laxalt, now vying for the Republican nomination for a U.S. Senate seat.Mr. Parnas’s lawyer, Joseph A. Bondy, suggested during the hearing, on Oct. 5, that he might portray his client as someone with a “relative lack of education” in the area of election law.And a lawyer for Mr. Kukushkin signaled that he planned to portray his client as a victim of Mr. Parnas rather than as his co-conspirator.The lawyer, Gerald B. Lefcourt, described Mr. Parnas in a recent court filing as the perpetrator of a “con” who, along with Mr. Fruman and Mr. Correia, used a “dog and pony show” to dupe Mr. Kukushkin and many others.“They portrayed themselves as well-connected, powerful political power brokers, who could speak directly to the president of the United States, his children, his inner circle,” Mr. Lefcourt wrote. “Of course, it was all a ruse, one big fraud or Ponzi scheme.” More

    How Democrats Can Save Themselves

    Normally the political party that loses an election goes through a period of soul-searching and vigorous internal debate, while the winning party embraces a smug certainty about its own inevitable multigenerational dominance. In 2021, though, the roles are reversed.The widespread belief that Donald Trump was, in some sense, the real winner of an election that he lost has succeeded in pre-empting a Republican debate about why the Democrats captured the White House last year. Meanwhile, the Democrats, despite their control of the Congress and the presidency, are increasingly the ones arguing as though they’re already in the wilderness.The Democrats’ angst strikes me as a healthy development for liberalism. One problem with the emergency thinking that Trump inspires in his opponents — and one reason to resist it — is that it occludes real understanding of the political conditions that put him in power, and that might do so again. This is what you saw happen to the Democrats after 2016: The sense of being lightning-struck sent the center-left wandering into a maze of conspiracies, a haunted wood where villains like Vladimir Putin and Mark Zuckerberg loomed larger than the swing voters they had lost and savior figures like Robert Mueller were supposed to unmake Trump’s power for them.Only the party’s left, its Bernie Sanders wing, fully developed a more normal theory of the 2016 defeat, trying to understand Obama-Trump voters in the context of globalization and deindustrialization as well as racism, fascism and Putinist dirty tricks. But this created a fundamental imbalance in the party’s conversation: With the Sanders faction trying to pull the party toward social democracy and the establishment acting as if its major challenges were Russian bots and nefarious Facebook memes, there was hardly anyone left to point out the ways that Democrats might be in danger of moving too far left — and the writers who did so were generally dismissed as dinosaurs.So it was up to Democratic voters to exert a rightward tug on their party — first by saving the party from the likely disaster of nominating the intelligentsia’s candidate, Elizabeth Warren, and ultimately by putting up a nominee, Joe Biden, whose long career as a moderate gave him some distance from the “Great Awokening” that swept liberal institutions in 2020.Now, though, with the increasing awareness that Bidenism is probably not a long-term strategy, we’re finally getting the fuller argument that should have broken out after 2016 — over what the Democrats can do, and whether they can do anything, to win over the working-class and rural voters alienated by the party’s increasingly rigorous progressive litmus tests.A key player in this argument is the pollster and analyst David Shor, whom my colleague Ezra Klein interviewed for a long essay last week, and who has emerged — after a temporary 2020 cancellation — as the leading spokesman for the pragmatic liberal critique of progressive zeal.This critique starts with a diagnosis: Democrats misread the meaning of Barack Obama’s 2012 victory, imagining that it proved that their multiracial coalition could win without downscale and rural white voters, when in fact Obama had beaten Mitt Romney precisely because of his relatively resilient support from those demographics, especially across the industrial Midwest. And this misreading was particularly disastrous because these voters have outsize influence in Senate races and the Electoral College, so losing them — and then beginning to lose culturally conservative minority voters as well — has left the Democrats with a structural disadvantage that will cost them dearly across the next decade absent some kind of clear strategic adjustment.From this diagnosis comes the prescription, so-called popularism, glossed by Klein as follows: “Democrats should do a lot of polling to figure out which of their views are popular and which are not popular, and then they should talk about the popular stuff and shut up about the unpopular stuff.”You will note that this banal-seeming wisdom is not an ideological litmus test: Where left-wing ideas are popular, Shor Thought would have Democrats talk about them more. But where they are unpopular, especially with the kind of voters who hold the key to contested Senate races, Democrats need a way to defuse them or hold them at a distance.Thus a “popularist” candidate might be a thoroughgoing centrist in some cases, and in others a candidate running the way Bernie Sanders did in 2016, stressing the most popular ideas in the social-democratic tool kit. But in both cases such candidates would do everything in their power not to be associated with ideas like, say, police abolition or the suspension of immigration enforcement. Instead they would imitate the way Obama himself, in his first term, tried to finesse issues like immigration and same-sex marriage, sometimes using objectively conservative rhetoric and never getting way out ahead of public opinion.Which is easier said than done. For one thing, the Democratic Party’s activists have a different scale of power in the world of 2021 than the world of 2011, and the hypothetical “popularist” politician can’t make their influence and expectations just go away. For another, as my colleague Nate Cohn points out, Obama in 2011 was trying to keep white working-class voters in the Democratic fold, while the popularist politician in 2022 or 2024 would be trying to win them back from the G.O.P. — a much harder thing to achieve just by soft-pedaling vexatious issues.At the very least a Democratic strategy along these lines would probably need to go further along two dimensions. First, it would need to overtly attack the new progressivism — not on every front but on certain points where the language and ideas of the progressive clerisy are particularly alienated from ordinary life.For instance, popularist Democrats would not merely avoid a term like “Latinx,” which is ubiquitous in official progressive discourse and alien to most U.S. Hispanics; they would need to attack and even mock its use. (Obviously this is somewhat easier for the ideal popularist candidate: an unwoke minority politician in the style of Eric Adams.)Likewise, a popularist candidate — ideally a female candidate — on the stump in a swing state might say something like: I want this to be a party for normal people, and normal people say mother, not “birthing person.”Instead of reducing the salience of progressive jargon, the goal would be to raise its salience in order to be seen to reject it — much as Donald Trump in 2016 brazenly rejected unpopular G.O.P. positions on entitlements that other Republican rivals were trying to merely soft-pedal.But then along with this rhetorical fire directed leftward, popularists would also need go further in addressing the actual policy concerns surrounding the issues they’re trying to defuse. Immigration is a major political problem for Democrats right now, for instance, not just because their activists have taken extreme positions on the issue, but because the border is a major policy problem: The effects of globalized travel and communication make it ever-easier for sudden migrant surges to overwhelm the system, and liberalism’s shift away from tough enforcement — or at least its professed desire to make that shift — creates extra incentives for those surges to happen under Democratic presidents.So in the long run — especially given climate change’s likely effect on mass migration — there is no way for Democrats to have a stable policy that’s pro-immigration under the law without first having a strategy to make the American border much more secure than it’s been under the Biden administration to date. How to do that humanely is a policy challenge, but if you really want to court voters for whom the issue matters, you have to take the challenge seriously — because the problem makes itself salient, and it isn’t going away.It’s worth nothing that even this combination — attack progressive excess, show Obama-Trump voters that you take their issues seriously — is still a somewhat defensive one. As Cohn notes, when Trump reoriented the Republican Party to win more working-class votes, he made a sweeping and dramatic — and yes, demagogic — case that he would be better than Hillary Clinton for their interests and their values. Democrats have specific ideas that poll well with these voters, but it’s not clear that even a sweeping “heartland revival” message could actually reverse the post-Trump shift.But even a strictly defensive strategy, one that just prevents more Hispanic voters from shifting to the Republicans and holds on to some of Biden’s modest Rust Belt gains, would buy crucial time for Democrats — time for a generational turnover that still favors them, and time to seize the opportunities that are always offered, in ways no data scientist can foretell, by unexpected events.The Times is committed to publishing a diversity of letters to the editor.
