    Kyrsten Sinema Brings Bad Tidings for Democrats in 2024

    Arizona was on the cusp of seating a Democratic governor alongside two Democratic senators for the first time since 1951 when Senator Kyrsten Sinema abruptly announced last week she is leaving the Democratic Party to become an independent.The move was met with harsh criticism from the left, which saw it as another in a series of self-aggrandizing acts that risk sacrificing the Democratic Party’s power and President Biden’s legislative agenda for her personal benefit.Polls make it clear that Ms. Sinema is reviled by a large segment of her now-former party. In a recent Civiqs poll of likely voters, she was at a meager 7 percent approval among Arizona Democrats. Her switch to declare herself an independent may seem like a desperate act to hold on to the Senate seat she won in 2018 by fewer than three percentage points.It may be that. But for Democrats looking ahead to 2024, her move compounds the difficulties of what is promising to be a brutal Senate map and suggests some hard truths about the party’s chances in Arizona and places like it.The Donald Trump era may have given Democrats in Arizona a bit of a blue mirage. They were very successful in the midterms: Senator Mark Kelly won re-election, Secretary of State Katie Hobbs will be the new governor, and Adrian Fontes will become the secretary of state.But it seems that the Democrats’ success is not simply the result of permanent shifts in Arizona’s demographics. Before Mr. Trump’s 2020 defeat, Arizona voted for five consecutive Republican presidential candidates and, before Ms. Sinema’s win in 2018, had not elected a single Democratic senator since 1976. Arizona’s electorate has certainly grown, urbanized and diversified, but registration percentages haven’t changed much since 2012. Today, 35 percent of Arizona registered voters are registered Republicans; 34 percent are Independents; and 31 percent are Democrats.Democrats’ recent victories were presaged by overtly moderate Democratic candidates running against opponents endorsed by Mr. Trump. Ms. Sinema’s path to the Senate was buoyed by her opponent’s irreparably damaging association with Mr. Trump.In announcing her departure from the Democratic Party, Ms. Sinema argued that representing Arizona as an independent will “provide a place of belonging for many folks across the state and the country who also are tired of the partisanship.” She is not wrong on that point: Over a quarter of Americans say they dislike both parties according to Pew Research Center. Only 6 percent said so in 1994.For independent voters, it is disdain for partisanship — not moderate ideology — that drives most of them to buck the party label. A vast majority of independents, 75 to 90 percent, have no trouble identifying their preferred party, and they nearly always vote for it. It is the rancor and incivility associated with partisanship that dissuades independents from publicly showing their true colors.Independent voters are hardly a uniform voting bloc: Generally, they just about evenly divide between those who hold liberal views and usually vote for Democrats and those who are conservative and usually vote for Republicans.The bad news for Ms. Sinema — and perhaps for Democrats — is that independent candidates rarely succeed. Without a sizable Republican or Democratic base, an independent will struggle to cobble together ideologically incompatible voters who are bonded primarily by their reluctance to publicly identify with the party they secretly support.This is one area where the Trump effect has come into play. In recent Arizona elections, the state’s independents have shown that they appear to be more favorable to Democrats than Republicans. In the state’s Senate race, exit polls suggest that independents backed Mr. Kelly over his Trump-endorsed opponent, Blake Masters, by 16 percentage points, and self-identified moderates favored Mr. Kelly by 30 percentage points. Ms. Hobbs similarly won the independent vote against her Trump-endorsed opponent, Kari Lake, by seven percentage points, and she won self-identified moderates by 20 percentage points.Indeed, recent survey data I collected across Arizona shows that independents look much more like Democrats than Republicans when it comes to their disdain for Mr. Trump. Even among those Arizona independents who say they lean toward the Republican Party, 40 percent see the state G.O.P. as “too conservative.”Given repeated Republican losses, it seems that Arizona Republicans — and independents, who have a large say in Arizona’s electoral outcomes — have rejected Mr. Trump as well as his chosen nominees, and this has helped usher in a wave of Democratic candidates, Ms. Sinema included.When a state’s status shifts to swing, it is often attributed to demographic change in the electorate. But in Arizona, that is not likely the case, or at least that isn’t the full story. And this is why the outlook for Democrats might be troubling.Sure, Arizona boasts high population growth in urban areas like Maricopa County. But voter data does not support theories that a transforming electorate is shifting electoral tides. Over time, voter registration percentages have shown Republicans declining slightly but maintaining their numerical advantage.That shift is probably better attributed to changes in the politicians who are running rather than to the people deciding whether to vote for them.If she had remained a Democrat, Ms. Sinema would not be the first politician who faced harsh criticism for frustrating her party, and many of them prevailed in subsequent elections. Senators Joe Manchin of West Virginia and Lisa Murkowski of Alaska are examples.If nothing changes and Ms. Sinema runs for re-election, her former party will be left in a pickle. She probably can’t win as an independent, especially if her popularity doesn’t improve quickly, but a Democrat (like Representative Ruben Gallego, who has hinted at a Senate bid) running against Ms. Sinema and a Republican is also unlikely to win.So for Democrats, Ms. Sinema has made a daunting Senate map in 2024 even worse. There will be 33 Senate seats up for re-election, and Democrats will defend 23 (including Ms. Sinema’s). Three of those seats are in states that Mr. Trump won by at least eight percentage points in 2020: Montana, Ohio and West Virginia.When Republicans in Arizona and other states leave Mr. Trump behind, Democrats will lose this electorally useful foil.     Sununu on Trump: ‘He’s Not Scaring Anyone Out of the Race’

    In a wide-ranging interview, Chris Sununu, the New Hampshire governor, called the Republican presidential primary a tossup. As for Trump? “He’s not clearing the field.”Confident and even brash, Chris Sununu is one of the most popular governors in America. In a year when many Republicans struggled, he was re-elected in New Hampshire by more than 15 percentage points. The way to win, he says, is not “ranting and raving” about cultural topics but the old-fashioned way: listening carefully to voters and talking about solutions to their most pressing problems.Sununu thinks Republicans need to relearn the “basic tenets of politics.” He’s no fan of Donald Trump, and he thinks the former president will be eminently beatable in the Republican primary. He also says it’s “insulting” of Democrats to demand that New Hampshire give up its traditional place in the presidential calendar to suit the “personal whims” of President Biden, who he predicts will eventually be pushed aside by Democratic power brokers in Washington or bow out on his own.The New Hampshire governor, who is often discussed as a possible presidential contender in 2024, had a lot to say over the course of a 40-minute interview. Here’s a transcript of our conversation, lightly edited for length and clarity:Let’s talk about what happened in the midterm elections. A lot of people are blaming Donald Trump for choosing candidates in primaries who struggled in November. Is it that simple?No, no, no, no. Look, there’s a lot of different pieces here. It’s not just about former President Trump. It’s about the candidates themselves. They were bad candidates because they had a bad message, right? Often they made Trump a part of their message. And that just isn’t what voters wanted.A lot of candidates forgot the most basic tenets of politics: I need more votes than the other side. And it isn’t just about catering to a base or firing up your base. You need to listen to independents. You need to listen to all of the voting constituencies to see what the issues are for voters.There was also a little bit of manipulation of the primary process by Democrats. We saw it right here in New Hampshire with our U.S. Senate race. You effectively had the opposing party trying to pick your party’s candidate. Democrats were good at defining our candidates for us.Some Republicans say that candidates were too focused on hot-button cultural topics like transgender athletes competing in women’s sports, or books in school libraries. Do you agree with that critique?Yes. I agree that candidates focused on the wrong issues. I don’t mind addressing cultural issues; of course we need to. But it’s how you as a candidate stand up for it — not just ranting and raving, but hopefully inspiring folks to really believe in you as the person who can be a positive agent of change for those issues.Democrats talk about how abortion was a really powerful issue for them. You supported a 24-week ban, right?Yeah, I signed that. The Legislature put it in the budget. I’m pro-choice, but it’s a provision that I think most Americans would support.     Is the Supreme Court About to Upend American Election Laws?

    Here’s what to know about a court case that could change the way Americans vote — and who decides how they do.For months, my inbox has been bombarded by anxious Democrats and election experts wanting to talk about a once-obscure legal theory that could fundamentally alter the way Americans vote.Known as the independent state legislature doctrine, it holds, in its purest form, that state constitutions have little to no ability to constrain state legislatures. The doctrine emerged from a novel interpretation of the U.S. Constitution’s Elections Clause, which grants states the authority to set the “time, places and manner” of federal elections.At the core of the dispute is whether the framers intended the word “legislature” in the document to be understood strictly, or whether they meant that other institutions — like state courts, governors and secretaries of state — also had important roles to play in setting and interpreting the rules around elections and voting.A fringe version of the doctrine entered the public discussion last year when it emerged that one of Donald Trump’s lawyers, John Eastman, had written a memo arguing that it even allowed state lawmakers to send their own slate of presidential electors to Washington.The Supreme Court has traditionally been gun-shy about encroaching on state courts, especially when they are interpreting their own constitutions.But a more mainstream conservative position, embraced by the Republican Party and rejected by Democrats, started gaining support on the right amid legal battles over the accommodations some states made for voters during the pandemic, like the expansion of mail voting.If adopted, the doctrine would, among other things, bar state courts from ensuring that state laws comply with a requirement, common in many state constitutions, that elections be “free and fair” — with potentially vast implications for rules on redistricting, citizen-led commissions and voting.     For Sunak, Like Biden, Dullness Could Be a Secret Weapon

    For all their differences, President Biden and Prime Minister Rishi Sunak of Britain share a challenge: operating in the wake of a larger-than-life predecessor. They have tactics in common, too.LONDON — For years, Boris Johnson and Donald J. Trump were viewed as populist twins — flamboyant, scandal-scarred, norm-busting figures, acting in a trans-Atlantic political drama. With both out of office, at least for now, a more timely and intriguing comparison is between Prime Minister Rishi Sunak and President Biden.Though they differ by obvious metrics — young vs. old, conservative vs. liberal — Mr. Sunak and Mr. Biden are using strikingly similar methods to govern in the wake of their larger-than-life predecessors. Both have tried to let the steam out of their countries’ hothouse politics by making a virtue of being, well, a little boring.The similarities are more than stylistic: Both lead parties that are divided between centrist and more extreme forces, whether to the right, for Mr. Sunak, or the left, for the American president. And both are dogged by poor poll numbers, in part because of economic ills but also because their pragmatic, undramatic style can seem ill-suited to the polarized politics of post-Brexit Britain and post-Trump America.For Mr. Sunak, who took office in October amid an economic crisis and after months of political upheaval that left his Conservative Party exhausted and unpopular, Mr. Biden might offer a blueprint for political rehabilitation.Two years into his term, Mr. Biden has confounded the skeptics, with the Democratic Party performing unexpectedly well in the midterm elections, in defiance of historical trends that typically punish the party in power.“Boris and Trump were generalists, short on details and ideologically flexible, but the sheer force of their personality brought them to the top, and eventually led to their downfalls,” said Frank Luntz, an American political strategist and pollster who was a classmate of Mr. Johnson’s at Oxford University.“Rishi and Biden are the exact opposite,” Mr. Luntz continued. “Not particularly great communicators, quite often trapped in the weeds of details, but able to move their governments forward because of their detailed knowledge and experience.”President Biden and Jill Biden after returning from Camp David on Sunday.Pete Marovich for The New York TimesCircumstances forced both leaders to press for emergency legislation right off the bat: Mr. Biden, to cushion the damage caused by the coronavirus pandemic; Mr. Sunak, to counter the disastrous foray into trickle-down tax policy engineered by his immediate predecessor, Liz Truss. That spooked financial markets, sent the British pound into a tailspin and drove up interest rates.After passing his Covid relief bill, Mr. Biden managed to push through ambitious legislation to combat climate change. Here’s what we found.Mr. Sunak, who has a more than 70-seat majority in Parliament, may not face as much legislative needle-threading in passing his package of tax increases and spending cuts. But he does have to contend with an increasingly unruly Tory Party, which is making it difficult for him to settle a trade dispute with the European Union over Northern Ireland, overhaul Britain’s cumbersome planning rules for home building, or even construct onshore windmills.“He’s being pushed around by various factions in the Tory Party,” said Kim Darroch, a former British ambassador to the United States. “Biden, by contrast, is quite resolute about his moderate, centrist principles.”While Mr. Sunak’s allies make no explicit comparisons between him and Mr. Biden, several have claimed his quiet, unflashy competence is restoring stability after the political roller-coaster of the last three months. On returning to the cabinet as a senior minister, Michael Gove declared “boring is back,” and joked that it was the government’s “utter determination to try to be as dull as possible.”Asked in an interview whether the motif of Mr. Sunak’s leadership was that “boring is the new sexy,” Mark Harper, the transport secretary, smiled and replied: “What he’s about is a government that’s grown up, that grips the issues that people are concerned about and gets on with governing.”Mr. Sunak and his wife, Akshata Murty, returning to 10 Downing Street last month after visiting a food and drinks market promoting British small businesses.Pool photo by Toby MelvilleUnlike Mr. Biden, 80, whose aides still periodically find themselves having to clean up unguarded statements, Mr. Sunak, 42, rarely commits a gaffe. His cautious persona and stilted speaking style have drawn comparisons to John Major, who in 1990 succeeded a more forceful prime minister, Margaret Thatcher.Mr. Major’s electoral record was mixed: He surprised many by winning a modest majority of 21 in the general election in 1992. But that victory was followed swiftly by a financial crisis that sapped his reputation and paved the way for a landslide victory five years later by the Labour Party leader, Tony Blair.This time, the crisis struck before Mr. Sunak took office. But it leaves him with no more than two years to rescue his party before the next election, and he faces the headwinds of soaring inflation, rising interest rates, labor unrest and a recession. Depending on when Mr. Sunak chooses to call that vote, there is a chance that American voters could be electing a president around the same time.Will Mr. Biden be in that race? The chances of his running again rose after the midterms, not to mention the president’s proposal to rearrange the Democratic Party’s primary calendar, so that South Carolina, which resurrected his presidential fortunes in 2020, will now vote first, ahead of the Iowa caucus.There is no evidence that Mr. Biden and Mr. Sunak talked politics in their first face-to-face meeting as leaders at a summit in Indonesia last month. Indeed, given their disparity in age, background and politics, there is little indication they will develop the kind of rapport enjoyed by, say, Mr. Blair and President Bill Clinton. When the Tories elected Mr. Sunak as leader, Mr. Biden hailed it as a “groundbreaking milestone,” though he added, “As my brother would say, ‘Go figure.’”At the moment, the oddsmakers are betting against Mr. Sunak. There is even speculation that if the Conservatives get thrashed in local elections next May, his enemies might move against him and try to reinstall Mr. Johnson. But Mr. Sunak’s allies hope for a Biden-like surprise, which could give him a solid base for the next general election (it must take place by January 2025).Given Labour’s formidable lead in opinion polls — and a Labour leader, Keir Starmer, who rivals Mr. Sunak in competence over charisma — few analysts see a path for Mr. Sunak to a convincing victory. But some think the outcome could be much closer than some of Labour’s supporters now expect. For one thing, Mr. Sunak’s poll ratings exceed those of his battered party, which is the reverse of Mr. Biden and the Democrats before the midterm elections.“There is a big difference between what voters think of the Conservative Party and what voters think of Sunak,” said Peter Kellner, a polling expert. “The big question now is whether the Tory Party drags Sunak’s ratings down, or Sunak drags the Tory Party’s ratings up.”Those are the same questions handicappers were asking about Mr. Biden in the anxious days leading up to the midterms.     There’s Been a Massive Change in Where American Policy Gets Made

    Since 2021, Democrats have controlled the House, the Senate and the presidency, and they’ve used that power to pass consequential legislation, from the American Rescue Plan to the Inflation Reduction Act. That state of affairs was exceptional: In the 50 years between 1970 and 2020, the U.S. House, Senate and presidency were only under unified party control for 14 years. Divided government has become the norm in American politics. And since Republicans won back the House in November, it is about to become the reality once again.But that doesn’t mean policymaking is going to stop — far from it. As America’s national politics have become more and more gridlocked in recent decades, many consequential policy decisions have been increasingly pushed down to the state level.     North Carolina’s Governor Says a Fringe Claim Before the Supreme Court Would Upend Democracy

    Over the past six months, the United States Supreme Court has handed down one misguided ruling after another, stripping Americans of the constitutional right to an abortion, curtailing the regulation of guns and industrial emissions, and muddying the divide between church and state. The people have protested. They’ve organized. And in 2022, they voted.In Dobbs v. Jackson Women’s Health Organization, the June decision on abortion, the majority wrote that “women are not without electoral or political power.” That’s one thing they got right, and Republicans found that out the hard way in the November midterm elections that they expected to win big. Now, however, the very ability to exercise electoral and political power at the ballot box is hanging in the balance in a case the court is scheduled to hear on Wednesday.Moore v. Harper is a case from North Carolina that state and national Republicans are using to push an extreme legal premise known as the “independent state legislature theory.” While the United States Constitution delegates the authority to administer federal elections to the states, with Congress able to supersede those state decisions, proponents of this theory argue that state legislatures are vested with the exclusive power to run those elections. This view would leave no room for oversight by state courts and put the ability of governors to veto election-related legislation in doubt.The court’s decision on this alarming argument could fundamentally reshape American democracy. Four justices have suggested that they are sympathetic to the theory. If the court endorses this doctrine, it would give state legislatures sole power over voting laws, congressional redistricting, and potentially even the selection of presidential electors and the proper certification of election winners.Indeed, the North Carolina Supreme Court, in a decision earlier this year, said the theory that state courts are barred from reviewing a congressional redistricting plan was “repugnant to the sovereignty of states, the authority of state constitutions and the independence of state courts, and would produce absurd and dangerous consequences.”You can look to North Carolina to see the potential for dire consequences. In 2010, Republicans took over the state legislature in a midterm election. Since then, North Carolina has been ground zero for Republican attempts to manipulate elections. As the state’s attorney general and now governor since 2017, I’ve dealt with Republican legislative leaders as they advanced one scheme after another to manipulate elections while making it harder for populations they have targeted to vote.These schemes robbed voters from the start to the end of an election: a voter ID requirement so strict that a college ID from the University of North Carolina isn’t good enough. No same-day registration during early voting. No provisional ballots for voters who show up at the wrong precinct. Shorter early voting periods eliminated voting the Sunday before Election Day, a day when African American churches hold popular “souls to the polls” events.Fortunately, these measures were stopped in 2016 by the U.S. Court of Appeals for the Fourth Circuit, which described them as targeting African Americans “with almost surgical precision.”Republicans in the legislature have also gerrymandered districts in diabolical ways. In 2016, state Republicans drew a congressional redistricting map that favored Republicans 10-3. They did so, the Republican chairman of a legislative redistricting committee explained, “because I do not believe it’s possible to draw a map with 11 Republicans and two Democrats.”North Carolinians have relied on courts and my veto power as governor to foil many of these schemes. In 2022 a successful lawsuit in state court challenging a 2021 gerrymandered congressional map resulted in fair districts, splitting the state’s 14 districts (the state gained a district after the 2020 census) so that Democrats and Republicans each won seven seats in November’s elections. It seemed only right, given the nearly even divide between Democratic and Republican votes statewide. Republican efforts to avoid this result led to the Moore v. Harper appeal now before the Supreme Court.As recently as 2019, Chief Justice John Roberts wrote in a majority opinion on partisan gerrymandering claims in Maryland and North Carolina that state courts were an appropriate venue to hear such cases but that those claims were political issues beyond the jurisdiction of the federal courts. Retreating from that position on the role of state courts would be a shocking leap backward that would undermine the checks and balances established in state constitutions across the country.Republican leaders in the North Carolina state legislature have shown us how the elections process can be manipulated for partisan gain. And that’s what you can expect to see from state legislatures across the country if the court reverses course in this case.Our democracy is a fragile ecosystem that requires checks and balances to survive. Giving state legislatures unfettered control over federal elections is not only a bad idea but also a blatant misreading of the Constitution. The defiance is a test of Xi Jinping’s leadership.At the Foxconn iPhone factory in Zhengzhou, thousands of workers clashed with riot police. The workers were lashing out about a delay in the payment of bonuses as well as the company’s failure to properly isolate new workers from those who had tested positive. The new hires were recruited after thousands of workers fled the Foxconn plant last month because of a Covid outbreak.Unrest is spreading elsewhere. In Guangzhou, migrant workers broke out of locked-down buildings to confront health workers and ransack food provisions. Online, many raged after a 4-month-old died. Her father said restrictions had delayed access to treatment.Political fallout: Xi has used heavy censorship and severe punishment to silence critics, which makes the public airing of grievances particularly striking. Many Chinese have questioned the need for lockdowns at all.     Is Donald Trump Ineligible to Be President?

    How does a democracy protect itself against a political leader who is openly hostile to democratic self-rule? This is the dilemma the nation faces once again as it confronts a third presidential run by Donald Trump, even as he still refuses to admit he lost his second.Of course, we shouldn’t be in this situation to begin with. The facts are well known but necessary to repeat, if only because we must never become inured to them: Abetted by a posse of low-rent lawyers, craven lawmakers and associated crackpots, Mr. Trump schemed to overturn the 2020 election by illegal and unconstitutional means. When those efforts failed, he incited a violent insurrection at the United States Capitol, causing widespread destruction, leading to multiple deaths and — for the first time in American history — interfering with the peaceful transfer of power. Almost two years later, he continues to claim, without any evidence, that he was cheated out of victory, and millions of Americans continue to believe him.The best solution to behavior like this is the one that’s been available from the start: impeachment. The founders put it in the Constitution because they were well acquainted with the risks of corruption and abuse that come with vesting great power in a single person. Congress rightly used this tool, impeaching Mr. Trump in 2021 to hold him accountable for his central role in the Jan. 6 siege. Had the Senate convicted him as it should have, he could have been disqualified from holding public office again. But nearly all Senate Republicans came to his defense, leaving him free to run another day.There is another, less-known solution in our Constitution to protect the country from Mr. Trump: Section 3 of the 14th Amendment, which bars from public office anyone who, “having previously taken an oath” to support the Constitution, “engaged in insurrection or rebellion” or gave “aid or comfort” to America’s enemies.On its face, this seems like an eminently sensible rule to put in a nation’s governing document. That’s how Representative David Cicilline of Rhode Island, who has drafted a resolution in Congress enabling the use of Section 3 against Mr. Trump, framed it. “This is America. We basically allow anyone to be president,” Mr. Cicilline told me. “We set limited disqualifications. One is, you can’t incite an insurrection against the United States. You shouldn’t get to lead a government that you tried to destroy.”This was also the reasoning of the 14th Amendment’s framers, who intended it to serve as an aggressive response to the existential threat to the Republic posed by the losing side of the Civil War. Section 3 was Congress’s way of ensuring that unrepentant former Confederate officials — “enemies to the Union” — were not allowed to hold federal or state office again. As Representative John Bingham, one of the amendment’s lead drafters, put it in 1866, rebel leaders “surely have no right to complain if this is all the punishment the American people shall see fit to impose upon them.”And yet despite its clarity and good sense, the provision has rarely been invoked. The first time, in the aftermath of the Civil War, it was used to disqualify thousands of Southern rebels, but within four years, Congress voted to extend amnesty to most of them. It was used again in 1919 when the House refused to seat a socialist member accused of giving aid and comfort to Germany in World War I.In September, for the first time in more than a century, a New Mexico judge invoked Section 3, to remove from office a county commissioner, Couy Griffin, who had been convicted of entering the Capitol grounds as part of the Jan. 6 mob. This raised hopes among those looking for a way to bulletproof the White House against Mr. Trump that Section 3 might be the answer.I count myself among this crowd. As Jan. 6 showed the world, Mr. Trump poses a unique and profound threat to the Republic: He is an authoritarian who disregards the Constitution and the rule of law and who delights in abusing his power to harm his perceived opponents and benefit himself, his family and his friends. For that reason, I am open to using any constitutional means of preventing him from even attempting to return to the White House.At the same time, I’m torn about using this specific tool. Section 3 is extraordinarily strong medicine. Like an impeachment followed by conviction, it denies the voters their free choice of those who seek to represent them. That’s not the way democracy is designed to work.And yet it is true, as certain conservatives never tire of reminding us, that democracy in the United States is not absolute. There are multiple checks built into our system that interfere with the expression of direct majority rule: the Senate, the Supreme Court and the Electoral College, for example. The 14th Amendment’s disqualification clause is another example — in this case, a peaceful and transparent mechanism to neutralize an existential threat to the Republic.Nor is it antidemocratic to impose conditions of eligibility for public office. For instance, Article II of the Constitution puts the presidency off limits to anyone younger than 35. If we have decided that a 34-year-old is, by definition, not mature or reliable enough to hold such immense power, then surely we can decide the same about a 76-year-old who incited an insurrection in an attempt to keep that power.So could Section 3 really be used to prevent Mr. Trump from running for or becoming president again? As a legal matter, it seems beyond doubt. The Capitol attack was an insurrection by any meaningful definition — a concerted, violent attempt to block Congress from performing its constitutionally mandated job of counting electoral votes. He engaged in that insurrection, even if he did not physically join the crowd as he promised he would. As top Democrats and Republicans in Congress said during and after his impeachment trial, the former president was practically and morally responsible for provoking the events of Jan. 6. The overwhelming evidence gathered and presented by the House’s Jan. 6 committee has only made clearer the extent of the plot by Mr. Trump and his associates to overturn the election — and how his actions and his failures to act led directly to the assault and allowed it to continue as long as it did. In the words of Representative Liz Cheney, the committee’s vice chair, Mr. Trump “summoned the mob, assembled the mob and lit the flame of this attack.”A few legal scholars have argued that Section 3 does not apply to the presidency because it does not explicitly list that position. It is hard to square that claim with the provision’s fundamental purpose, which is to prevent insurrectionists from participating in American government. It would be bizarre in the extreme if Mr. Griffin’s behavior can disqualify him from serving as a county commissioner but not from serving as president.It’s not the legal questions that give me pause, though; it’s the political ones.First is the matter of how Republicans would react to Mr. Trump’s disqualification. An alarmingly large faction of the party is unwilling to accept the legitimacy of an election that its candidate didn’t win. Imagine the reaction if their standard-bearer were kept off the ballot altogether. They would thunder about a “rigged election” — and unlike all the times Mr. Trump has baselessly invoked that phrase, it would carry a measure of truth. Combine this with the increasingly violent rhetoric coming from right-wing media figures and politicians, including top Republicans, and you have the recipe for something far worse than Jan. 6. On the other hand, if partisan outrage were a barrier to invoking the law, many laws would be dead letters.The more serious problem with Section 3 is that it is easy to see how it could morph into a caricature of what it is trying to prevent. Keeping specific candidates off the ballot is a classic move of autocrats, from Nicolas Maduro in Venezuela to Aleksandr Lukashenko in Belarus to Vladimir Putin. It sends the message that voters cannot be trusted to choose their leaders wisely — if at all. And didn’t we just witness Americans around the country using their voting power to repudiate Mr. Trump’s Big Lie and reject the most dangerous election deniers? Shouldn’t we let elections take their course and give the people the chance to (again) reject Mr. Trump at the ballot box?To help me resolve my ambivalence, I called Representative Jamie Raskin of Maryland, who sits on the Jan. 6 committee and taught constitutional law before joining Congress. He acknowledged what he called an understandable “queasiness” about invoking Section 3 to keep Mr. Trump off the ballot. But Mr. Raskin argued that this queasiness is built into the provision. “What was the constitutional bargain struck in Section 3?” he asked. “There would be a very minor incursion into the right of the people to elect exactly who they want, in order to obtain much greater security for the constitutional order against those who have demonstrated a propensity to want to overthrow it when it is to their advantage.”The contours of the case for Mr. Trump’s disqualification might get stronger yet, as the Justice Department and state prosecutors continue to pursue multiple criminal investigations into him and his associates and as the Jan. 6 committee prepares to release its final report. While he would not be prohibited from running for office even if he was under criminal indictment, it would be more politically palatable to invoke Section 3 in that case and even more so if he was convicted.I still believe that the ideal way for Mr. Trump to be banished for good would be via the voters. This scenario is democracy’s happy ending. After all, self-government is not a place; it is a choice, and an ongoing one. If Americans are going to keep making that choice — in favor of fair and equal representation, in favor of institutions that venerate the rule of law and against the threats of authoritarian strongmen — they do it best by themselves. That is why electoral victory is the ultimate political solution to the ultimate political problem. It worked that way in 2020, when an outright majority of voters rejected Mr. Trump and replaced him with Joe Biden.But it’s essential to remember that not all democracies have happy endings. Which brings us to the most unsettling answer to the question I began with: Sometimes a democracy doesn’t protect itself. There is no rule that says democracies will perpetuate themselves indefinitely. Many countries, notably Hungary and Turkey, have democratically undone themselves by electing leaders who then dismantled most of the rights and privileges people tend to expect from democratic government. Section 3 is in the Constitution precisely to help ensure that America does not fall into that trap.Whether or not invoking Section 3 succeeds, the best argument for it is to take the Constitution at its word. “We undermine the importance of the Constitution if we pick and choose what rules apply,” Mr. Cicilline told me. “One of the ways we rebuild confidence in American democracy is to remind people we have a Constitution and that it has in it provisions that say who can run for public office. You don’t get to apply the Constitution sometimes or only if you feel like it. We take an oath. We swear to uphold it. We don’t swear to uphold most of it. If Donald Trump has taught us anything, it’s about protecting the Constitution of the United States.”Surely the remedy of Section 3 is worth pursuing only in the most extraordinary circumstances. Just as surely, the events surrounding Jan. 6 clear that bar. If inciting a violent insurrection to keep oneself in office against the will of the voters isn’t such a circumstance, what is?The Times is committed to publishing a diversity of letters to the editor.
