Sanger and Dec. 19, 2020Updated 3:54 p.m. ETHours after Secretary of State Mike Pompeo told a conservative radio show host that “we can say pretty clearly that it was the Russians” behind the vast hack of the federal government and American industry, he was contradicted on Saturday by President Trump, who sought to muddy the intelligence findings by raising the possibility that China was responsible.Defying the conclusions of experts inside and outside the government who say the attack was a cybersecurity breach on a scale Washington has never experienced, Mr. Trump also played down the severity of the hack, saying “everything is well under control,” insisting that the news media has exaggerated the damage and suggesting, with no evidence, that the real issue was whether the election results had been compromised.“There could also have been a hit on our ridiculous voting machines during the election,” he wrote on Twitter in his latest iteration of that unfounded conspiracy theory. He tagged Mr. Pompeo, the latest cabinet member to anger him, in his Twitter post. With 30 days left in office, Mr. Trump’s dismissive statements made clear there would be no serious effort by his administration to punish Russia for the hack, and national security officials say they are all but certain to hand off the fallout and response to President-elect Joseph R. Biden Jr.So in the midst of a global pandemic, Mr. Biden will inherit a government so laced with electronic tunnels bored by Russian intelligence that it may be months, years even, before he can trust the systems that run much of Washington. And in his first days in office, even as he has to deal with Russia on arms control and other issues, he will have to confront a quandary that has confounded his predecessors for a quarter of a century: Retaliation for cyber intrusions often results in escalation.As Michael Sulmeyer, now a senior adviser to United States Cyber Command, put it before he entered government, America “lives in the glassiest of glass houses.” The United States is more reliant than almost any other nation on fragile computer networks that make the government and economy hum, making it an especially ripe target for short-of-war attacks like the one executed by the Kremlin.In contrast to Mr. Trump, who has always been reluctant to confront Moscow and President Vladimir V. Putin, Mr. Biden has signaled that he will not let the intrusion, whose full extent is not yet known, go unanswered.“A good defense isn’t enough,’’ Mr. Biden said Thursday, vowing to impose “substantial costs on those responsible for such malicious attacks.”He will not find that easy.Mr. Trump’s tweet was his first comment on the hack, which came to light a week ago. Privately, the president has called the hack a “hoax” and pressured associates to downplay its significance and push alternate theories for who is responsible, two people familiar with the exchanges said. Larry Kudlow, his economic adviser, told reporters on Friday, “People are saying Russia. I don’t know that. It could be other countries.”The president’s unexplained reluctance to blame Russia — which through its embassy in Washington has denied complicity in the attack — has only complicated the response, investigators say. The government only learned of the hack from FireEye, a cybersecurity company, after the firm was itself breached. And Microsoft’s president, Brad Smith, said Thursday that government agencies are approaching Microsoft — not the national security establishment — to understand the extent of the Russian breach.“This is the most consequential cyberespionage campaign in history and the fact that the government is absent is a huge problem for the nation,” said Dmitri Alperovitch, a co-founder of CrowdStrike, a security firm, who is now chairman of Silverado Policy Accelerator, a think tank.“The response has been a total disaster, not just because of the president, but because whoever is left is just polishing up their resumes,” he said. “There’s no coordination and every agency is just doing whatever they can to help themselves.”Mr. Trump’s comments on Saturday had echoes of his stance toward the hacks during 2016 presidential campaign, when he contradicted intelligence findings to claim it was China, or a “400 pound” person “sitting on his bed,” not Russia, who interfered in that election. Two years later, Mr. Trump’s own Justice Department indicted 12 Russian intelligence officers.“Never has there been a President work so hard to provide cover for Russia,” said Clint Watts, a former F.B.I. special agent and Russian information warfare expert at the Foreign Policy Research Institute. All countries spy on each other, of course, and — for now — that appears to have been the first objective of the Russian campaign, one that researchers said on Friday appears to date back to October 2019, six months earlier than initially believed.That was when hackers, presumed to be working for the SVR, one of the most elite and talented of the Russian spy agencies, first broke into the SolarWinds network management software, which is used across the federal government and by three-quarters of the nation’s Fortune 500 companies.The theory is that the Russians were trying to figure out whether they could get into the “supply chain” of software that would give them broad access to the array of systems that make America tick.What no one in the Trump administration wants to address, at least publicly, is how the Russians managed to evade billions of dollars in American-built defenses designed to alert agencies to foreign intrusions. That question, too, now seems certain to be left to Mr. Biden to answer.From their new cyber command center in Fort Meade, Md., the NSA and Cyber Command monitor incoming attacks, the way generations of American military officials jammed underground command centers to look for incoming missile attacks. In this case, the sensors never went off, and the commander of those cyber forces, Gen. Paul M. Nakasone, one of the nation’s most experienced cyber warriors, has said not one word in public about what went wrong.The private sector will face hard questions as well. The majority of infections, Microsoft said, were of private firms, many of them cybersecurity companies. FireEye only detected the attack after Russians cleaned it out too, taking the “Red Team” tools the firm uses to probe corporate and government systems for vulnerabilities.The Russian attack was carefully calibrated to avoid cybersecurity defenses. It gained access to the updates of the SolarWinds software — akin to the updates Apple and other phone makers push onto cellphones as they charge overnight — betting that small changes in code would not be noticed.By compromising the updates, they gained access to 18,000 government agencies and companies. From there they planted “back doors” into the networks of some 40 companies, government agencies and think tanks, according to Microsoft, that allowed them to come and go, steal data and — though it apparently has not happened yet — alter data or conduct destructive attacks.“This was a cybersecurity superspreading event,’’ Mr. Smith said in an interview on Thursday evening, calling it “a moment of reckoning.” While Mr. Trump began his time in office with a strong cybersecurity team in the White House, his third national security adviser, John R. Bolton, ousted them and eliminated the post of a cyber czar with direct access to the president.The new National Defense Authorization Act, which Mr. Trump is threatening to veto for other reasons, would recreate such a post. Yet until Mr. Pompeo, who ran the C.I.A. for the first two years of the Trump administration, made his assessment in an interview on “The Mark Levin Show,” the administration had all but ignored the attack in public — perhaps realizing that an administration that came into office on the heels of Russian interference in the 2016 election was leaving as the victim of one of Russia’s most well-executed cyberattacks.“This was a very significant effort,” Mr. Pompeo said, adding that “we’re still unpacking precisely what it is.” He said he expected most of the details would remain classified.“Given the gravity of this breach, it’s concerning that President Trump is paying so little attention to it,” said Senator Martin Heinrich, the Democrat from New Mexico, home to the Los Alamos nuclear lab that Russians breached in the attack.He and other Democrats have pushed for an aggressive response. “We have failed to deter the Russians,” Senator Chris Coons of Delaware, a Democrat who is close to Mr. Biden, said on Thursday. “We are only going to see Putin stop this action when we stop him.” But if history is any guide, finding the right way to retaliate will be difficult. The United States conducts its own spying missions. America has carried out supply chain attacks, too, including against Iran’s nuclear centrifuges and its missile program. It has been running them against North Korea for years.“The U.S. government has no principled basis to complain about the Russia hack, much less retaliate for it with military means, since the U.S. government hacks foreign government networks on a huge scale every day,” Jack Goldsmith, a Harvard Law School professor who worked in the Bush administration.“Indeed, a military response to the Russian hack would violate international law.” he added. “The United States does have options, but none are terribly attractive.”That is the core of Mr. Biden’s problem. In the first 16 days of his presidency he will have to deal with Mr. Putin to address the renewal of New START, the nuclear arms control treaty that expires on Feb. 5. Until Friday, Mr. Pompeo had played down the episode as one of the many daily attacks on the federal government.But intelligence agencies have told Congress that they believe it was carried out by the S.V.R., an elite Russian intelligence agency. As evidence of the attack’s scope piled up this week, the Cybersecurity and Infrastructure Security Agency sent out an urgent warning on Thursday that the hackers had “demonstrated an ability to exploit software supply chains and shown significant knowledge of Windows networks.”The agency added that it was likely that some of the attackers’ tactics, techniques and procedures had “not yet been discovered.” Investigators say it could take months to unravel the extent to which American networks and the technology supply chain have been compromised.Microsoft said it had identified 40 companies, government agencies and think tanks that the hackers had infiltrated. Nearly half are private technology firms, Microsoft said, many of them cybersecurity firms, like FireEye, that are charged with securing vast sections of the public and private sector.“There are more nongovernmental victims than there are governmental victims, with a big focus on I.T. companies, especially in the security industry,” Brad Smith, Microsoft’s president, said in an interview on Thursday.FireEye was the first to inform the government that the hackers had infected the periodic software updates issued by a company called SolarWinds since at least March. SolarWinds makes critical network monitoring software used by the government, hundreds of Fortune 500 companies and firms that oversee critical infrastructure, including the power grid.The national security adviser, Robert C. O’Brien, cut short a trip to the Middle East and Europe on Tuesday and returned to Washington to run crisis meetings to assess the situation. The F.B.I., the Cybersecurity and Infrastructure Security Agency and the Office of the Director of National Intelligence formed an urgent response group, the Cyber Unified Coordination Group, to coordinate the government’s responses to what the agencies called a “significant and ongoing cybersecurity campaign.”The Russians have denied any involvement. The Russian ambassador to the United States, Anatoly I. Antonov, said Wednesday that there were “unfounded attempts by the U.S. media to blame Russia” for the recent cyberattacks.According to a person briefed on the attack, the S.V.R. hackers sought to hide their tracks by using American internet addresses that allowed them to conduct attacks from computers in the very city — or appearing so — in which their victims were based. They created special bits of code intended to avoid detection by American warning systems and timed their intrusions not to raise suspicions.The attacks, said the person briefed on the matter, shows that the weak point for the American government computer networks remains administrative systems, particularly ones that have a number of private companies working under contract.President-elect Joseph R. Biden Jr. said Thursday that his administration would impose “substantial costs” on those responsible.“A good defense isn’t enough; we need to disrupt and deter our adversaries from undertaking significant cyberattacks in the first place,” Mr. Biden said, adding, “I will not stand idly by in the face of cyberassaults on our nation.”Investigators and other officials say they believe the goal of the Russian attack was traditional espionage, the sort the National Security Agency and other agencies regularly conduct on foreign networks. But the extent and depth of the hacking raise concerns that hackers could ultimately use their access to shutter American systems, corrupt or destroy data, or take command of computer systems that run industrial processes. So far, though, there has been no evidence of that happening.Across federal agencies, the private sector and the utility companies that oversee the power grid, forensic investigators were still trying to unravel the extent of the compromise. But security teams say the relief some felt that they did not use the compromised systems turned to panic on Thursday, as they learned other third-party applications may have been compromised.Inside federal agencies and the private sector, investigators say they have been stymied by classifications and a siloed approach to information sharing.“We have forgotten the lessons of 9/11,” Mr. Smith said. “It has not been a great week for information sharing and it turns companies like Microsoft into a sheep dog trying to get these federal agencies to come together into a single place and share what they know.”Reporting was contributed by David E. They are the authors of “After Trump: Reconstructing the Presidency.”Dec. 18, 2020, 5:00 a.m. ETCredit…Damon Winter/The New York TimesNow that Donald Trump’s time in the White House is ending, an urgent task is the reform of the presidency that for four years he sought to shape in his image and to run in his personal and political self-interest. What the those years have shown is that the array of laws and norms that arose after Watergate and Vietnam requires an overhaul.Any program for reform of the presidency must give precedence to our health and economic crises. It must also acknowledge political realities. Some reforms can be carried out by the executive branch, but others require legislation. Those must attract at least modest bipartisan support in the Senate.With these constraints in mind, an agenda for reform of the presidency could realistically reflect the following priorities:Executive Branch ReformsThese reforms should focus on restoring the integrity of the rule of law, especially to check presidential interventions in law enforcement for self-protection or to harm political enemies. The Constitution vests executive law enforcement power in the president, so the executive branch must institute most of these reforms. Internal branch reforms lack legal enforceability but can establish or reinforce guardrails that constrain even norm-breaking presidencies, especially by influencing presidential subordinates.Because President Trump defied them regularly, and sometimes his Justice Department did, too, there’s a lot of skepticism about norms. But actually norms succeeded more in checking him than has been appreciated — for example, in ensuring that Robert Mueller, despite Mr. Trump’s opposition, could complete his inquiry; in protecting federal prosecutors in New York in any investigation of matters related to Mr. Trump; and in preventing the Justice Department from carrying out the president’s desire to prosecute his enemies.Reforms should include sharpening Justice Department regulations against political bias in law enforcement; extending to the attorney general the department norms against interfering in investigations; clarifying the rules for investigations of presidents and presidential campaigns to protect against the political impact of investigative steps or announcements, like actions taken close to an election; and changing the regulations so that a special counsel possesses enhanced independence from the attorney general and can report to Congress and American people the facts of any credible allegations of criminal conduct against a president or senior executive branch official.Congressional ReformsCongress should by statute supplement the executive reforms. Three should have broad public support and should be easier for Republican legislators to vote for once Mr. Trump is out of office.First, Congress should transform into law the anti-corruption norms of presidential behavior that have long been accepted by both parties but were flouted by Mr. Trump. That would include requiring presidents and presidential candidates to make a timely disclosure of their tax returns. It should also bar the president, under threat of criminal penalty, from any role in the oversight of any business; ban presidential blind trusts, which in this context are inconsistent with core concepts of transparency and accountability; and establish procedures for Congress to police the “emoluments” the president would receive from foreign states.Second, Congress should expressly bar presidents from obstructing justice for self-protection, protection of family members and to interfere in elections. It should also make it a crime for a president to offer a pardon in exchange for bribes, including clemency granted for silence or corrupt action in a legal proceeding.Third, Congress must upgrade legal protections against foreign electoral interference, a concern for both the American people and the U.S. intelligence community. Congress should require campaigns to report to the F.B.I. any contacts from foreign states offering campaign support or assistance. And to clarify that foreign governments cannot offer, and presidential campaigns cannot solicit or receive, anything of value to a campaign, like opposition research, it must criminalize any mutual aid agreements between presidential campaigns and foreign governments.One sharp conflict between the executive and legislative branches needs an urgent fix and is ripe for a deal: the regulation of executive branch vacancies. Many presidential administrations — the Trump administration more aggressively than others — have circumvented the Senate confirmation process for top executive branch appointments by making unilateral temporary appointments.These tactics exploited loopholes in federal vacancies law. Compounding this problem is that the number of Senate-confirmed executive branch positions has grown (it is now around 1,200), and the Senate in recent decades has become more aggressive in using holds and filibusters to block or delay confirmation. Congress should significantly reduce the number of executive positions requiring confirmation in exchange for substantially narrowed presidential discretion to make temporary appointments.The strength of a presidency is measured by its capacity for effective executive leadership. Mr. Trump’s record of feckless leadership was closely related to his unrelenting efforts to defy or destroy constraining institutions. The reforms proposed here would enhance the institutional constraints that legitimate the president’s vast powers.They would thus serve the twin aims of ensuring that the “energy in the executive” that Alexander Hamilton defined as “a leading character in the definition of good government” is nonetheless embedded, as the historian Arthur Schlesinger Jr. rightly insisted, in a “system of accountability that checks the abuse of executive power.”Bob Bauer, a senior adviser for the Biden campaign and a professor of practice and distinguished scholar in residence at New York University School of Law, and Jack Goldsmith (@jacklgoldsmith), a law professor at Harvard, a senior fellow at the Hoover Institution and a former assistant attorney general in the George W. Dr. Saunders is a political scientist in the Walsh School of Foreign Service at Georgetown.Dec. 15, 2020, 7:04 p.m. ETCredit…Doug Mills/The New York TimesAfter the Electoral College vote on Monday affirming his election, Joe Biden declared that “nothing, not even a pandemic or an abuse of power, can extinguish” the “flame of democracy.” Mr. Biden’s speech and the vote capped a series of victories for democratic institutions, including the Supreme Court’s dismissal of a Texas lawsuit that sought to overturn the election results — just the latest turn in the extended refusal of President Trump and his Republican enablers to accept the outcome.Political scientists like us are trying to assess the damage from Mr. Trump’s baseless, inept and ultimately doomed attacks on democracy. Do the sharp rebukes from our courts and other institutions mean that democracy “survived,” and we can simply move on? Or does all the talk about what “saved” American democracy really show that it’s in deep trouble?After all, that Texas lawsuit had the public support of more than half of the Republican House members. And it looks like even Vladimir Putin beat Mitch McConnell to congratulate Mr. Biden.The problem is we’ve been treating Mr. Trump’s attacks on democracy as if they are a pass-fail test. We should instead think of democracy as both damaged and resilient, like a forest after a powerful windstorm.In our research, we argue that though all democracies are imperfect, one of their central virtues is that they are built to be resilient — to bend without breaking, even when elected leaders pull institutions in an authoritarian direction. But just because they’re more flexible doesn’t mean democracies can’t break. Resilience — the ability to adapt and keep functioning under strain — is a resource that needs replenishing, not a guarantee of safe passage.It’s normal for institutions to face challenges from events or from politicians who try to use them for their own purposes. When institutions survive a stress test, they may come out stronger or weaker. Ambiguous laws can be clarified to withstand abuse; regulations can be updated; and public officials gain experience in how to prevent or defend against future tests. But it can take time for the strengthening to occur.The 2020 election provides a clear example of democratic resilience to authoritarian pressure. Election officials and judges fielding legal challenges had to adapt not only to the enormous logistical challenges of the pandemic but also to Mr. Trump’s rhetoric. His attacks — and those from elected officials in his party and from the conservative media — put additional pressure on election officials and poll workers, who faced threats, intimidation efforts and overt pressure to ignore the will of the voters.Yet in most of the more than 10,000 electoral jurisdictions across the country, voters cast ballots without incident and Election Day was peaceful. International election observers praised the election as orderly and organized.Both democracy optimists and pessimists can draw the conclusions they want to see from this example. Optimists can say that our election system faced the 2020 test admirably, and those who run it will be better prepared for future efforts to undermine their work. Pessimists can say that Mr. Trump’s attacks will leave lasting scars. Next time, election officials might give in to political pressure. Or the damage might be invisible, like a tree’s weakened root system, deterring people from running for office or working at the polls.Right now, there’s no way to know if the damage will be permanent. But we do know that democracies are better able to recover from such assaults because they allow for routine, peaceful replacement of leaders or parties. Dictators are more likely to be replaced through rebellion, military coup or civil war than through constitutional processes like elections and impeachment.This is what democracy optimists get right. Mr. Trump’s abuse of foreign policy got him impeached. His spectacular failure to govern during a pandemic got him voted out of office.But eventually, if stretched too far, democratic institutions will reach a limit. There may not be a dramatic break, like a coup, but democracy will be twisted and warped and cannot return to its original shape.Take the example of Nicaragua. President Daniel Ortega, after losing several elections, conspired to change the voting rules such that he was able to win the presidency in 2006 with just 38 percent of the vote. He has since moved Nicaragua further toward authoritarianism.Here at home, Mr. Trump’s refusal to accept his defeat is his most blatant threat to democracy. He has generated worrisome precedents and undermined shared assumptions about what happens after an incumbent loses. His bizarre legal strategy has failed, but he has turned the base of the Republican Party and many congressional Republicans against valuing democracy for its own sake. And those values are the ultimate source of democratic resilience.But has Mr. Trump stretched democratic institutions beyond recognition, or, provided that they survive their near-term vulnerability, could U.S. democratic institutions grow back stronger?There are already many reform proposals that could help rebuild democratic resilience. Many are focused on what can be reformed: institutions and the rules that govern them. For example, the nonpartisan Election Reformers Network’s proposal to reduce conflicts of interest among secretaries of state, based on successful models in other countries, and other proposals to rectify Mr. Trump’s attacks on checks and balances across the government.But a healthy, resilient democracy also requires sufficient citizen support for democracy across the political spectrum. And that, in turn, depends on both parties embracing a commitment to democratic principles — a tall order given the Republican Party’s recent behavior.The trouble for those wanting to put this period behind them is that it’s hard to assess whether the damage is lasting until it’s too late. Our democracy has survived for now, but we don’t yet know whether some crucial democratic institutions bent so far that faced with the next test, they’ll break.Susan D.     AdvertisementContinue reading the main storyOpinionSupported byContinue reading the main storyDid the Resistance Defeat Donald Trump?Some reasons to doubt a theory that’s shared by liberals and Trump supporters alike.Opinion ColumnistDec. 15, 2020, 5:00 a.m. ETMedia members watching Joe Biden onscreen and the White House in front of them in November. Credit…Oliver Contreras for The New York TimesTwo of the most intense factions in our politics, the anti-Trump Resistance with its claim to be standing against fascism and the conservatives trying to delegitimize Joe Biden’s victory with claims of widespread voter fraud, agree on almost nothing, but they do agree on one point: The Trump administration was successfully undermined — the Trump agenda thwarted and Donald Trump himself defeated — by liberal institutions that refused to normalize him, maintained a persistent alarm about his presidency and took every opportunity to obstruct, investigate, protest and impeach.The liberals urging constant vigilance and outrage against Trump’s challenge to the 2020 outcome are trying to see this project of resistance through to its Biden-inauguration end. Meanwhile, the Trumpian side is trying to imitate it, since lurking below the right’s fantasy politics is a more cynical assumption that it’s a great idea, a highly effective political counterpunch, for Republicans to act like Biden is an anti-president, a Great Pretender — because that’s what liberals did to Trump and it obviously worked.I think both of these groups are mostly wrong — that what defeated Trump was Trump himself, that the “fascism” discourse around his presidency was often a distraction, and that the most successful strategies pursued by the Democrats were strategies of normalcy rather than alarm. But now that the Electoral College has voted and a Biden presidency seems essentially assured, let’s consider the best arguments for how and why the Resistance undid Trump.From the Resisters themselves, those arguments accuse anyone who was skeptical of their alarmism of ignoring the importance of passion, organization and mobilization in American politics. To eye-roll at the would-be defenders of liberalism and democracy, Laura K. Field of the Niskanen Center asserted just before the election, is to engage in an “implicit denial of the work that has gone into attempting to defeat Trump.” If his authoritarianism has fizzled out in fantasy and hopeless lawsuits, it still could have been much, much worse if people hadn’t felt a world-historical incentive to resist — an effort that merits “gratitude and respect, not dismissive call-outs and belittling tweets.”Rather than emphasizing mobilization, meanwhile, the Trumpist version of Field’s argument emphasizes elite power — the way that the media and the judiciary and the bureaucracy joined with congressional Democrats in denying Trump any of the normal space of action that his predecessors enjoyed. This newspaper’s famous Op-Ed by “Anonymous” (later revealed to be Miles Taylor, the homeland security secretary’s chief of staff) claiming to represent the Resistance inside the Trump White House offers a condensed symbol of what these Trump supporters have in mind — a kind of inside-outside game of obstruction, with media entities and government officials cooperating to keep the agenda that Trump actually campaigned on from taking shape.To these arguments I would offer a concession and a rejoinder.The concession first: There’s no question that the anti-authoritarian, America-imperiled narrative of the last four years had some benefits for Trump’s opponents. It helped pressure the disparate factions of the American elite, from Silicon Valley to Wall Street, to close ranks against the president. It created an ideological home and a compelling self-understanding for anti-Trump Republicans. It contributed to the mobilization of suburban and minority voters in crucial states like Georgia and to the general sense of purpose that a successful political movement needs. And in its inside-game form, elite resistance definitely obstructed at least some of Trump’s expressed desires, from Gary Cohn and John Bolton maneuvering deceptively on NAFTA or NATO to the generals who repeatedly slow-walked orders to withdraw forces from the Middle East or Afghanistan.My rejoinder, though, is that it’s not clear whether the Resistance mentality was more effective than more politically normal modes of fighting Trump, and whether the inside-the-system obstruction of the president actually derailed a real agenda rather than just adding extra layers of chaos to a presidency that never had a vision or a plan.On the first point, one might observe that the Trump-era controversies most dominated by Resistance theatrics were conflicts that the Resistance didn’t win — the long Russiagate investigation and imbroglio, the Brett Kavanaugh confirmation battle, the impeachment fight.At the same time, Trump’s actual defeats were the work of very conventional political campaigning: a midterm campaign in which the Democrats organized around health care and other kitchen-table issues and a presidential election in which they nominated their most moderate candidate and ran on normalcy and decency, casting Trump as a terrible person and a bad president but not a Mussolini in the making.Then, too, the gains from the Resistance mentality came with a political price. The anti-Trump closing-of-ranks within elite institutions helped shore up the president’s populist bona fides, his claim to represent outsiders and non-elites, even when his actual policies favored insiders and the rich. The tendency to see an authoritarian depredation behind every policy move, however banal, weakened the credibility of the media, especially putatively neutral outlets like CNN. The pitch of anti-Trumpism bound once-dubious Republicans to his cause, almost matching the mobilization on the Democratic side.And the liberal belief that Trump was obviously, self-evidently a white supremacist and semi-fascist left liberalism somewhat blindsided by the voters who disagreed: not just the white shy-Trumpers of the suburbs but also the Trump-voting Latinos and African-Americans who helped keep the 2020 race competitive, denying Biden his blowout and the Resistance the full repudiation of Trumpism that it sought.On the right, meanwhile, the Trumpist conceit that the Mueller investigation or MSNBC hysteria were the main forces preventing a more successful Trump agenda gives that opposition way too much credit — and Trump himself way too little blame. It was not the Resistance but his own indifference that induced Trump to outsource policymaking to Paul Ryan and Mitch McConnell during the two years when his party actually controlled the government. It was not the Mueller investigation but the attempted Obamacare repeal and a not-very-populist tax plan that drove his polling numbers to their notable lows.When Kayleigh McEnany complained recently that her boss “was never given an orderly transition of power,” she had a point — but the major source of disorder was not Crossfire Hurricane or the Steele dossier but just the Trump team’s own incompetence, notably Jared Kushner’s decision to ditch Chris Christie’s transition plan without having a replacement.The Resistance may have induced Democrats to take a lot of party-line votes against the president, but if Trump actually pursued his promised infrastructure bill he would have found Democratic takers. In areas where he had competent people working for him (judicial nominations, above all), the political and media opposition was impotent to stop him. Impeachment was just a segue into his presidency’s peak, a triumphant State of the Union address just before the coronavirus came calling. Even late in 2020, Nancy Pelosi was willing to make a deal with him on a big new round of coronavirus relief, which might have helped save his re-election bid — yet Trump preferred instead to go down tweeting.So treating Biden the way Trump was treated, opposing him as Trump was opposed, is only a devastating strategy if you assume that Biden and his White House will miss as many opportunities and perform as many face-plants as Trump’s administration did.And that’s without even getting into the fact that the Republican campaign to delegitimize Biden can’t really emulate the Resistance, since the whole point of the anti-Trump effort was to mobilize a political and cultural establishment from which the populist right is notably excluded. At most a refusal to recognize Biden’s legitimacy could keep congressional Republicans voting in lock step against whatever the new president supports. But most would vote in lock step anyway, and the Republican senators most likely to break ranks, a Mitt Romney or a Susan Collins, are the least likely to be swayed by appeals to Biden’s supposed illegitimacy.Which means the attempt to build a right-wing Resistance narrative should probably be understood less as an effort to actually impede Biden’s administration and much more as a project to maintain Donald Trump’s position as his party’s leader, a president in exile — because, after all under its theory, he never really lost.If the idea of Trump 2024 appeals to you, as it currently does to many Republicans, then this kind of Resistancing may sound like a good way to keep anybody else from claiming any kind of real position in the party. But the primary claim being made for it — that it will obstruct and defeat Biden the way Resistance liberals took down Trump — is a twofold error: They didn’t, and it won’t.The Times is committed to publishing a diversity of letters to the editor.     Trump Has Never Believed in Democracy

(It is also worth noting that many of the jurisdictions being disputed are heavily Black.)But a stinging defeat in the Supreme Court, packed with three justices of Trump’s own choosing, seems to have slammed the door on any legal path Trump might have had in his outrageous endeavor. The members of the Electoral College will meet on Monday and choose the next president. Barring any extraordinary and unprecedented developments, they will select Joe Biden, as the people already have.And yet, on Saturday Trump continued to insist on Twitter that “I WON THE ELECTION IN A LANDSLIDE,” and that the Supreme Court ruling was incorrect: “This is a great and disgraceful miscarriage of justice. The people of the United States were cheated, and our Country disgraced. Never even given our day in Court!”That same day, Trump flew over a “Stop the Steal” rally at Washington’s Freedom Plaza, where the Proud Boys were a prominent presence.He keeps lying to his supporters, telling them — partly out of pride, partly out of a craven quest for power — that he was cheated and that he actually won the election. Many of them believe him. Right-wing media have aided him in his deception, as have Republican officials, either through their public pronouncements or through their silence.On Sunday, the House minority whip, Steve Scalise of Louisiana, appeared on “Fox News Sunday” and said:“If you want to restore trust by millions of people who are still very frustrated and angry about what happened, that’s why you got to have this whole system play out.”But of course this isn’t about restoring faith in our elections; rather, it is about allowing Trump to further degrade that faith. Scalise and many other Republicans are accomplices in this crime against our democracy. Trump is still trying to steal this election, and they are outside revving the engine of the getaway car.That a majority of all Republicans in the House of Representatives expressed support for the frivolous Texas lawsuit signals to me that the difference between liberals and conservatives is no longer about values; it is now about a fundamental belief in democracy. Republicans appear to be saying that not all votes matter or should be counted. This is voter suppression on the grandest of scales, because it is an attempt at voter erasure, at eliminating votes that have already been cast and counted.All the while, Trump has continued to use the division and deception he has created to raise money. He has now collected more than $200 million in donations in support of his bogus election recounts.But, as The New York Times reported earlier this month:“Mr. Trump’s campaign apparatus has continued to aggressively solicit donations under the guise of supporting his various legal challenges to the election of Joseph R. Biden Jr., but as of now 75 percent of donations goes to a new political action committee that Mr. Trump formed in mid-November, up to the PAC’s legal limit of $5,000. The other 25 percent goes to the Republican National Committee. Only if a donor gives more than $6,000 do any funds go to Mr. Trump’s formal ‘recount’ account.”Trump has realized that trying to steal the presidency is more lucrative than actually being president, so he won’t stop. We are witnessing one of the greatest grifts in the history of the presidency.The presidency gave Trump something he always craved but never possessed: constant attention and real, legitimate power. And, once tasted, power is craved forever.Trump has never believed in American democracy. He was never a student of history. He was never really a patriot.When he foreshadowed his current behavior in 2016 by refusing to say that he would accept the results of that election as legitimate if he didn’t win, we knew. When he cozied up to the world’s dictators and spurned our allies, we knew. When he winked at hate groups by refusing to immediately and fulsomely condemn them, we knew.Trump wants to operate a dictatorship behind a veil of democracy. He wants to wield power without winning it legitimately. He wants to manipulate his mob and prioritize it above the masses who oppose him.Yes, Trump is attempting a coup, whether or not you want to call it that.     The Electoral College Shouldn't Matter More Than the Majority's Votes

We came within a hairbreadth of re-electing a man who finished more than seven million votes behind his opponent — and we nearly repeated the shock of 2016, when Donald Trump took office after coming in a distant second in the balloting.No other election in the country is run like this. But why not? That question has been nagging at me for the past few years, particularly in the weeks since Election Day, as I’ve watched with morbid fascination the ludicrous effort by Mr. Trump and his allies to use the Electoral College to subvert the will of the majority of American voters and overturn an election that he lost.The obvious answer is that, for the most part, we abide by the principle of majority rule. From the time we are old enough to count, we are taught that the bigger number beats the smaller number. It is the essence of fairness. It dictates outcomes in all areas of life, from politics to sports to cattle auctions. It’s decisive even in institutions whose purpose is to serve as a buffer against the majority.“Take the Supreme Court,” said Akhil Amar, a constitutional scholar at Yale Law School. “No one thinks that when it’s 5 to 4, the four win and the five lose. Everyone understands that five beats four. It goes without saying.”But the principle is especially important in elections. Why? Boil it down to three pillars of democratic self-governance: equality, legitimacy and accountability. We ignore them at our peril. And yet they are being ignored right now by millions of Americans, not to mention hundreds of high-ranking elected officials of one of our two major political parties.It occurred to me that in this moment, a defense of the concept of majority rule can no longer go without saying.First, and most fundamental: Majority rule is the only rule that treats all people as political equals. “That’s actually enormously important,” said Richard Primus, a professor at the University of Michigan law school. Any other rule inevitably treats certain votes as worth more than others. Sometimes that’s what we want, as when we require criminal juries to be unanimous in voting to convict. In that case, “there is one error that we prefer to the other error,” Mr. Primus said. “We want to make false convictions very difficult, much more rare than false acquittals.”But in an election for the president, he said, there is no “morally relevant criterion” for departing from majority rule. Voters in one part of the country are no wiser or more worthy than voters in another. And yet the votes of those in certain states always matter more. “What could possibly justify that?” Mr. Primus asked.This is not just an abstract numerical concern. When people’s votes are treated as unequal, it’s a short jump to treating people as unequal. Put another way, it’s not enough to say that we’re all equal before the law; we also must be able to have an equal say in the choice of the representatives who make and enforce the laws.There is a second reason majority rule is critical: It bestows legitimacy on the system. A representative government only works when its citizens see the electoral process as fair. When that legitimacy is absent, when people perceive — often accurately — that their vote doesn’t matter, they will eventually reject the system.“If we’re going to rule ourselves, we’re going to be ruled by majorities,” said Astra Taylor, an author and democracy activist. “There’s a stability in that idea. There’s a sense of the people deciding for themselves and buying in. That stability is incredibly valuable. The alternative is one in which we’re being ruled by something which is outside of us, whether a dictator or a technocracy or an algorithm.”Finally, majority rule ensures electoral accountability. As the economist Amartya Sen put it, democracies don’t have famines. A government that doesn’t have to earn the support of a majority of its citizens, or at least a plurality, is not truly accountable to them, and has no incentive to represent their interests or provide for their needs. This opens the door to neglect, corruption and abuse of power. (Talk to the millions of Californians ignored by President Trump during wildfire season.) “If someone has to run for re-election, they have to put attention into running things well,” Mr. Amar said. “If they don’t, they will lose elections.”The benefits of majority rule aren’t just a preoccupation for liberals like me, still stewing over the elections of 2000 and 2016. On election night 2012, when it appeared briefly that Mitt Romney might win the national popular vote but not the Electoral College, Donald Trump tweeted, “The electoral college is a disaster for a democracy.” A little while later, he tweeted, “More votes equals a loss … revolution!”He deleted that second one, but he needn’t have. He was only expressing a gut feeling everyone can recognize: The person who gets the most votes should win. If you doubt that, consider that the essence of the case Mr. Trump and his backers are making in every state where they are challenging the result is that the president won more votes than Mr. Biden.Mr. Trump made the same argument in 2016, when he lost the popular vote by nearly three million, yet insisted that he had actually won it “if you deduct the millions of people who voted illegally.”That both claims are laughably false is beside the point. Mr. Trump knows that in a democracy, real legitimacy comes from winning more votes than the other guy (or woman).Of course, everyone is a fan of majority rule until they realize they can win without it. In the last 20 years, Republicans have been gifted the White House while losing the popular vote twice, and it came distressingly close to happening for a third time this year. So it’s no surprise that in that period, the commitment of Republicans to majority rule, along with other democratic norms, has plummeted. A report by an international team of political scientists found a steep drop in Republican support for things like free and fair elections, and the respectful treatment of political opponents. The party’s rhetoric “is closer to authoritarian parties” in Eastern Europe, the report found.For modern Republicans, democracy has become a foreign language. “We’re not a democracy,” Senator Mike Lee of Utah tweeted in October, in what has become a disturbingly common refrain among conservatives. “Democracy isn’t the objective; liberty, peace, and prospefity are. We want the human condition to flourish. Rank democracy can thwart that.”Notice how, in Mr. Lee’s telling, “democracy” morphs into “rank democracy.” What does he mean by “rank democracy”? Presumably, what James Madison referred to as direct or “pure” democracy, the form of self-rule in which people vote directly on the laws that govern them. But there is no such thing as “rank democracy” when it comes to elections. The term is nothing more than a modern Republican euphemism for majority rule.Speaking of the founders, Republicans love to invoke them in support of their stiff-arming of democracy. Perhaps they forgot what those founders actually said.“The fundamental maxim of republican government,” Alexander Hamilton wrote in the Federalist No. 22, “requires that the sense of the majority should prevail.”James Madison, who is often cited for his warnings about the threats of popular majorities, changed his tune after spending several decades watching the American system of government he designed play out in practice. “No government of human device and human administration can be perfect,” Madison wrote in 1834. But republican government is “the best of all governments, because the least imperfect,” and “the vital principle of republican government is … the will of the majority.”Thomas Jefferson, in his first Inaugural Address, said the “sacred principle” is that “the will of the majority is in all cases to prevail.” In the same breath he emphasized that political minorities also have rights that require protection. Those protections exist in the design of our government and in the guarantees of the Constitution, as applied by the courts. The point is that minorities can be protected at the same time that majorities elect leaders to represent us in the first place.Joe Biden will be the next president because he won the Electoral College.     Al Gore: I Have Hope on the Climate Crisis. America Must Lead.

Twenty years ago, I ended my presidential campaign after the Supreme Court abruptly decided the 2000 election. As the incumbent vice president, my duty then turned to presiding over the tallying of Electoral College votes in Congress to elect my opponent. This process will unfold again on Monday as the college’s electors ratify America’s choice of Joe Biden as the next president, ending a long and fraught campaign and reaffirming the continuity of our democracy.The second anniversary is universal and hopeful. This weekend also marks the fifth anniversary of the adoption of the Paris Agreement. One of President Trump’s first orders of business nearly four years ago was to pull the United States out of the accord, signed by 194 other nations to reduce the emissions of greenhouse gases threatening the planet. With Mr. Trump heading for the exit, President-elect Biden plans to rejoin the agreement on his Inauguration Day, Jan. 20.Now, with Mr. Biden about to take up residence in the White House, the United States has the chance to reclaim America’s leadership position in the world after four years in the back seat.Mr. Biden’s challenges will be monumental. Most immediately, he assumes office in the midst of the chaos from the colossal failure to respond effectively to the coronavirus pandemic and the economic devastation that has resulted.And though the pandemic fills our field of vision at the moment, it is only the most urgent of the multiple crises facing the country and planet, including 40 years of economic stagnation for middle-income families; hyper-inequality of incomes and wealth, with high levels of poverty; horrific structural racism; toxic partisanship; the impending collapse of nuclear arms control agreements; an epistemological crisis undermining the authority of knowledge; recklessly unprincipled behavior by social media companies; and, most dangerous of all, the climate crisis.What lies before us is the opportunity to build a more just and equitable way of life for all humankind. This potential new beginning comes at a rare moment when it may be possible to break the stranglehold of the past over the future, when the trajectory of history might be altered by what we choose to do with a new vision.With the coronavirus death toll rising rapidly, the battle against the pandemic is desperate, but it will be won. Yet we will still be in the midst of an even more life-threatening battle — to protect the Earth’s climate balance — with consequences measured not only in months and years, but also in centuries and millenniums. Winning will require us to re-establish our compact with nature and our place within the planet’s ecological systems, for the sake not only of civilization’s survival but also of the preservation of the rich web of biodiversity on which human life depends.The daunting prospect of successfully confronting such large challenges at a time after bitter divisions were exposed and weaponized in the presidential campaign has caused many people to despair. Yet these problems, however profound, are all solvable.Look at the pandemic. Despite the policy failures and human tragedies, at least one success now burns bright: Scientists have harnessed incredible breakthroughs in biotechnology to produce several vaccines in record time. With medical trials demonstrating their safety and efficacy, these new vaccines prefigure an end to the pandemic in the new year. This triumph alone should put an end to the concerted challenges to facts and science that have threatened to undermine reason as the basis for decision-making.Similarly, even as the climate crisis rapidly worsens, scientists, engineers and business leaders are making use of stunning advances in technology to end the world’s dependence on fossil fuels far sooner than was hoped possible.Mr. Biden will take office at a time when humankind faces the choice of life over death. Two years ago, the Intergovernmental Panel on Climate Change warned of severe consequences — coastal inundations and worsening droughts, among other catastrophes — if greenhouse gas emissions are not reduced by 45 percent from 2010 levels by 2030 and 100 percent by 2050.Slowing the rapid warming of the planet will require a unified global effort. Mr. Biden can lead by strengthening the country’s commitment to reduce emissions under the Paris Agreement — something the country is poised to do thanks to the work of cities, states, businesses and investors, which have continued to make progress despite resistance from the Trump administration.Solar energy is one example. The cost of solar panels has fallen 89 percent in the past decade, and the cost of wind turbines has dropped 59 percent. The International Energy Agency projects that 90 percent of all new electricity capacity worldwide in 2020 will be from clean energy — up from 80 percent in 2019, when total global investment in wind and solar was already more than three times as large as investments in gas and coal.Over the next five years, the I.E.A. projects that clean energy will constitute 95 percent of all new power generation globally. The agency recently called solar power “the new king” in global energy markets and “the cheapest source of electricity in history.”As renewable energy costs continue to drop, many utilities are speeding up the retirement of existing fossil fuel plants well before their projected lifetimes expire and replacing them with solar and wind, plus batteries. In a study this summer, the Rocky Mountain Institute, the Carbon Tracker Initiative and the Sierra Club reported that clean energy is now cheaper than 79 percent of U.S. coal plants and 39 percent of coal plants in the rest of the world — a number projected to increase rapidly. Other analyses show that clean energy combined with batteries is already cheaper than most new natural gas plants.As a former oil minister in Saudi Arabia put it 20 years ago, “the Stone Age came to an end, not because we had a lack of stones, and the oil age will come to an end not because we have a lack of oil.” Many global investors have reached the same conclusion and are beginning to shift capital away from climate-destroying businesses to sustainable solutions. The pressure is no longer coming from only a small group of pioneers, endowments, family foundations and church-based pension funds; some of the world’s largest investment firms are now joining this movement, too, having belatedly recognized that fossil fuels have been extremely poor investments for a long while. Thirty asset managers overseeing $9 trillion announced on Friday an agreement to align their portfolios with net-zero emissions by 2050.Exxon Mobil, long a major source of funding for grossly unethical climate denial propaganda, just wrote down the value of its fossil fuel reserves by as much as $20 billion, adding to the unbelievable $170 billion in oil and gas assets written down by the industry in just the first half of this year. Last year, a BP executive said that some of the company’s reserves “won’t see the light of day,” and this summer it committed to a 10-fold increase in low-carbon investments this decade as part of its commitment to net-zero emissions.The world has finally begun to cross a political tipping point, too. Grass-roots climate activists, often led by young people of Greta Thunberg’s generation, are marching every week now (even virtually during the pandemic). In the United States, this movement crosses party lines. More than 50 college conservative and Republican organizations have petitioned the Republican National Committee to change its position on climate, lest the party lose younger voters.Significantly, in just the past three months, several of the world’s most important political leaders have introduced important initiatives. Thanks to the leadership of Ursula von der Leyen, the president of the European Commission, the E.U. just announced that it will reduce greenhouse gas emissions by 55 percent in the next nine years. President Xi Jinping has pledged that China will achieve net-zero carbon emissions in 2060. Leaders in Japan and South Korea said a few weeks ago said that their countries will reach net-zero emissions in 2050.Denmark, the E.U.’s largest producer of gas and oil, has announced a ban on further exploration for fossil fuels. Britain has pledged a 68 percent reduction by 2030, along with a ban on sales of vehicles equipped with only gasoline-powered internal-combustion engines.The cost of batteries for electric vehicles has dropped by 89 percent over the past decade, and according to Bloomberg New Energy Finance, these vehicles will reach price parity with internal-combustion vehicles within two years in key segments of vehicle markets in the United States, Europe and Australia, followed quickly by China and much of the rest of the world. Sales of internal-combustion passenger vehicles worldwide peaked in 2017. It is in this new global context that President-elect Biden has made the decarbonization of the U.S. electricity grid by 2035 a centerpiece of his economic plan. Coupled with an accelerated conversion to electric vehicles and an end to government subsidies for fossil fuels, among other initiatives, these efforts can help put the nation on a path toward net-zero emissions by 2050.As the United States moves forward, it must put frontline communities — often poor, Black, brown or Indigenous — at the center of the climate agenda. They have suffered disproportionate harm from climate pollution. This is reinforced by recent evidence that air pollution from the burning of fossil fuels — to which these communities bear outsize exposure — makes them more vulnerable to Covid-19.With millions of new jobs needed to recover from the economic ravages of the pandemic, sustainable businesses are among the best bets. A recent study in the Oxford Review of Economic Policy noted that investments in those enterprises result in three times as many new jobs as investments in fossil fuels. Between 2014 and 2019, solar jobs grew five times as fast in the United States as average job growth.Still, all of these positive developments fall far short of the emissions reductions required. The climate crisis is getting worse faster than we are deploying solutions.In November of next year, all of the signatories to the Paris Agreement will meet in Glasgow with a mandate to reduce greenhouse gas emissions much faster than they pledged to do in 2015. What will be new in Glasgow is transparency: By the time the delegates arrive, a new monitoring effort made possible by an array of advanced technologies will have precisely measured the emissions from every major source of greenhouse gases in the world, with most of that data updated every six hours.With this radical transparency, a result of efforts of a broad coalition of corporations and nonprofits I helped to start called Climate Trace (for tracking real-time atmospheric carbon emissions), countries will have no place to hide when failing to meet their emissions commitments. This precision tracking will replace the erratic, self-reported and often inaccurate data on which past climate agreements were based.Even then, a speedy phaseout of carbon pollution will require functional democracies. With the casting of a majority of the Electoral College votes on Monday for Mr. Biden, and then his inauguration, we will make a start in restoring America as the country best positioned to lead the world’s struggle to solve the climate crisis.To do that, we need to deal forthrightly with our shortcomings instead of touting our strengths. That, and that alone, can position the United States to recover the respect of other nations and restore their confidence in America as a reliable partner in the great challenges humankind faces.
