    How Jack Smith Structured the Trump Election Indictment to Reduce Risks

    The special counsel layered varied charges atop the same facts, while sidestepping a free-speech question by not charging incitement.In accusing former President Donald J. Trump of conspiring to subvert American democracy, the special counsel, Jack Smith, charged the same story three different ways. The charges are novel applications of criminal laws to unprecedented circumstances, heightening legal risks, but Mr. Smith’s tactic gives him multiple paths in obtaining and upholding a guilty verdict.“Especially in a case like this, you want to have multiple charges that are applicable or provable with the same evidence, so that if on appeal you lose one, you still have the conviction,” said Julie O’Sullivan, a Georgetown University law professor and former federal prosecutor.That structure in the indictment is only one of several strategic choices by Mr. Smith — including what facts and potential charges he chose to include or omit — that may foreshadow and shape how an eventual trial of Mr. Trump will play out.The four charges rely on three criminal statutes: a count of conspiring to defraud the government, another of conspiring to disenfranchise voters, and two counts related to corruptly obstructing a congressional proceeding. Applying each to Mr. Trump’s actions raises various complexities, according to a range of criminal law experts.At the same time, the indictment hints at how Mr. Smith is trying to sidestep legal pitfalls and potential defenses. He began with an unusual preamble that reads like an opening statement at trial, acknowledging that Mr. Trump had a right to challenge the election results in court and even to lie about them, but drawing a distinction with the defendant’s pursuit of “unlawful means of discounting legitimate votes and subverting the election results.”While the indictment is sprawling in laying out a case against Mr. Trump, it brings a selective lens on the multifaceted efforts by the former president and his associates to overturn the 2020 election.“The strength of the indictment is that it is very narrowly written,” said Ronald S. Sullivan Jr., a Harvard Law School professor and former public defender. “The government is not attempting to prove too much, but rather it went for low-hanging fruit.”For one, Mr. Smith said little about the violent events of Jan. 6, leaving out vast amounts of evidence in the report by a House committee that separately investigated the matter. He focused more on a brazen plan to recruit false slates of electors from swing states and a pressure campaign on Vice President Mike Pence to block the congressional certification of Joseph R. Biden Jr.’s victory.That choice dovetails with Mr. Smith’s decision not to charge Mr. Trump with inciting an insurrection or seditious conspiracy — potential charges the House committee recommended. By eschewing them, he avoided having the case focus on the inflammatory but occasionally ambiguous remarks Mr. Trump made to his supporters as they morphed into a mob, avoiding tough First Amendment objections that defense lawyers could raise.For another, while Mr. Smith described six of Mr. Trump’s associates as co-conspirators, none were charged. It remains unclear whether some of them will eventually be indicted if they do not cooperate, or whether he intends to target only Mr. Trump so the case will move faster.Mr. Smith chose to say very little about the violent events of Jan. 6 and instead focused on the scheme to recruit slates of fake electors and the pressure Mr. Trump brought upon Vice President Pence.Jason Andrew for The New York TimesAmong the charges Mr. Smith did bring against Mr. Trump, corrupt obstruction of an official proceeding is the most familiar in how it applies to the aftermath of the 2020 election. Already, hundreds of ordinary Jan. 6 rioters have been charged with it.To date, most judges in Jan. 6 cases, at the district court and appeals court level, have upheld the use of the statute. But a few Trump-appointed judges have favored a more narrow interpretation, like limiting the law to situations in which people destroyed evidence or sought a benefit more concrete than having their preferred candidate win an election.Mr. Trump, of course, would have personally benefited from staying in office, making that charge stronger against him than against the rioters. Still, a possible risk is if the Supreme Court soon takes up one of the rioter cases and then narrows the scope of the law in a way that would affect the case against Mr. Trump.Proving IntentSome commentators have argued in recent days that prosecutors must persuade the jury that Mr. Trump knew his voter fraud claims were false to prove corrupt intent. But that is oversimplified, several experts said.To be sure, experts broadly agree that Mr. Smith will have an easier time winning a conviction if jurors are persuaded that Mr. Trump knew he was lying about everything. To that end, the indictment details how he “was notified repeatedly that his claims were untrue” and “deliberately disregarded the truth.”“What you see in Trump — a guy who seems to inhabit his own fictional universe — is something you see in other fraud defendants,” said David Alan Sklansky, a Stanford University law professor. “It’s a common challenge in a fraud case to prove that at some level the defendant knew what he was telling people wasn’t true. The way you prove it is, in part, by showing that lots of people made clear to the defendant that what he was saying was baseless.”Moreover, the indictment emphasizes several episodes in which Mr. Trump had firsthand knowledge that his statements were false. Prosecutors can use those instances of demonstrably knowing lies to urge jurors to infer that Mr. Trump knew he was lying about everything else, too.The indictment, for example, recounts a taped call on Jan. 2 with Georgia’s secretary of state, Brad Raffensperger, in which Mr. Trump shared a series of conspiracy theories that he systematically debunked in detail. But on Twitter the next day, Mr. Trump “falsely claimed that the Georgia secretary of state had not addressed” the allegations.And on Jan. 5, Mr. Pence told Mr. Trump that he had no lawful authority to alter or delay the counting of Mr. Biden’s electoral votes, but “hours later” Mr. Trump issued a statement through his campaign saying the opposite: “The vice president and I are in total agreement that the vice president has the power to act.”Vice President Pence appears during House committee hearings investigating Jan. 6. The indictment suggests Mr. Trump knew he was lying about what Mr. Pence had told him on January 5.Doug Mills/The New York TimesIn any case, several rioters have already argued that they did not have “corrupt intent” because they sincerely believed the election had been stolen. That has not worked: Judges have said that corrupt intent can be shown by engaging in other unlawful actions like trespassing, assaulting the police and destroying property.“Belief that your actions are serving a greater good does not negate consciousness of wrongdoing,” Judge Royce C. Lamberth wrote last month.Mr. Trump, of course, did not rampage through the Capitol. But the indictment accuses him of committing other crimes — the fraud and voter disenfranchisement conspiracies — based on wrongful conduct. It cites Mr. Trump’s bid to use fake electors in violation of the Electoral Count Act and his solicitation of fraud at the Justice Department and in Georgia, where he pressured Mr. Raffensperger to help him “find” 11,780 votes, enough to overcome Mr. Biden’s margin of victory.“Whether he thinks he won or lost is relevant but not determinative,” said Paul Rosenzweig, a former prosecutor who worked on the independent counsel investigation into President Bill Clinton. “Trump could try to achieve vindicating his beliefs legally. The conspiracy is tied to the illegal means. So he has to say that he thought ‘finding’ 11,000 votes was legal, or that fake electors were legal. That is much harder to say with a straight face.”Proving Mr. Trump’s intent will also be key to the charges of defrauding the government and disenfranchising voters. But it may be easier because those laws do not have the heightened standard of “corrupt” intent as the obstruction statute does.Court rulings interpreting the statute that criminalizes defrauding the United States, for example, have established that evidence of deception or dishonesty is sufficient. In a 1924 Supreme Court ruling, Chief Justice William H. Taft wrote that it covers interference with a government function “by deceit, craft or trickery, or at least by means that are dishonest.” A 1989 appeals courts ruling said the dishonest actions need not be crimes in and of themselves.This factor may help explain the indictment’s emphasis on the fake electors schemes in one state after another, a repetitive narrative that risks dullness: It would be hard to credibly argue that Mr. Trump and his co-conspirators thought the fake slates they submitted were real, and the indictment accuses them of other forms of trickery as well.The opening of the Michigan Electoral College session at the State Capitol in 2020. Unlike the other charges, it had not been a major part of the public discussion of the investigation — for example, it was not among the charges recommended by the House Jan. 6 committee.Congress enacted the law after the Civil War to provide a tool for federal prosecutors to go after Southern white people, including Ku Klux Klan members, who used terrorism to prevent formerly enslaved Black people from voting. But in the 20th century, the Supreme Court upheld a broadened use of the law to address election-fraud conspiracies. The idea is that any conspiracy to engineer dishonest election results victimizes all voters in an election.“It was a good move to charge that statute, partly because that is really what this case really is about — depriving the people of the right to choose their president,” said Robert S. Litt, a former federal prosecutor and a top intelligence lawyer in the Obama administration.That statute has mostly been used to address misconduct leading up to and during election, like bribing voters or stuffing ballot boxes, rather than misconduct after an election. Still, in 1933, an appeals court upheld its use in a case involving people who reported false totals from a voter tabulation machine.It has never been used before in a conspiracy to use fake slates of Electoral College voters from multiple states to keep legitimate electors from being counted and thereby subvert the results of a presidential election — a situation that itself was unprecedented.Mr. Trump’s lawyers have signaled they will argue that he had a First Amendment right to say whatever he wanted. Indeed, the indictment acknowledged that it was not illegal in and of itself for Mr. Trump to lie.But in portraying Mr. Trump’s falsehoods as “integral to his criminal plans,” Mr. Smith suggested he would frame those public statements as contributing to unlawful actions and as evidence they were undertaken with bad intentions, not as crimes in and of themselves.Mr. Trump at Reagan National Airport Thursday following his court appearance. Mr. Trump’s legal team has signaled they will argue that he had a First Amendment right to say whatever he wanted.Doug Mills/The New York TimesA related defense Mr. Trump may raise is the issue of “advice of counsel.” If a defendant relied in good faith on a lawyer who incorrectly informed him that doing something would be legal, a jury may decide he lacked criminal intent. But there are limits. Among them, the defendant must have told the lawyer all the relevant facts and the theory must be “reasonable.”The indictment discusses how even though White House lawyers told Mr. Trump that Mr. Pence had no lawful authority to overturn Mr. Biden’s victory, an outside lawyer — John Eastman, described in the indictment as Co-Conspirator 2 and who separately faces disbarment proceedings — advised him that Mr. Pence could.Several legal specialists agreed that Mr. Trump has an advice-of-counsel argument to make. But Samuel W. Buell, a Duke University law professor, said Mr. Smith was likely to try to rebut it by pointing to the repeated instances in which Mr. Trump’s White House legal advisers told him that Mr. Eastman was wrong.“You have to have a genuine good-faith belief that the legal advice is legitimate and valid, not just ‘I’m going to keep running through as many lawyers as I can until one tells me something I want to hear, no matter how crazy and implausible it is,’” Mr. Buell said.     This Is One Republican Strategy That Isn’t Paying Off

    In 2011, determined to push back the ascendant Democratic coalition that elected America’s first Black president, Republicans capitalized on their control of legislatures and governor’s mansions in 20 states to enact measures designed to suppress minority Democratic voters.Barack Obama’s successful campaign for the presidency in 2008 had provoked fear in Republican ranks that the conservative coalition could no longer maintain its dominance. Getting 52.9 percent of the popular vote, Obama was the first Democratic presidential nominee to break 50 percent in the 32 years since Jimmy Carter won with 50.1 percent, in 1976.Republicans counterattacked, mounting a concerted drive to disenfranchise Democrats, a drive that gained momentum with the June 2013 Supreme Court decision Shelby County v. Holder. The court ruled that Section 5 of the 1965 Voting Rights Act, which required states and jurisdictions with a history of discrimination to obtain preclearance for any change in election law, procedure or regulation, was unconstitutional.Within hours of the Shelby decision, Republicans announced plans both to enforce laws that had been blocked by the federal government and to pass laws designed to prevent Democrats from casting ballots.Greg Abbott, then the attorney general of Texas, was first out of the gate, immediately declaring that the state would revive a voter identification law that had been barred under Section 5: “With today’s decision, the state’s voter ID law will take effect immediately. Photo identification will now be required when voting in elections in Texas.”In a 2019 report, the liberal Brennan Center for Justice found:Overall, 25 states have put in place new restrictions since 2010 — 15 states have more restrictive voter ID laws in place (including six states with strict photo ID requirements), 12 have laws making it harder for citizens to register (and stay registered), 10 made it more difficult to vote early or absentee, and three took action to make it harder to restore voting rights for people with past criminal convictions.All of which raises the question: How effective has the onslaught of state-level legislation been at raising the odds for Republican candidates?The apparent answer: not very.“Contemporary election reforms that are purported to increase or decrease turnout tend to have negligible effects on election outcomes,” Justin Grimmer and Eitan Hersh, political scientists at Stanford and Tufts, write in their June paper, “How Election Rules Affect Who Wins.”“Contrary to heated political rhetoric,” Grimmer and Hersh write, “election policies have small effects on outcomes because they tend to target small shares of the electorate, have a small effect on turnout, and/or affect voters who are relatively balanced in their partisanship.”How about partisan gerrymandering? Did the Shelby decision open the door to disenfranchising political opponents by allowing Republican legislatures to reduce the number of “minority opportunity” congressional and state legislative districts likely to elect Black or Hispanic Democrats — a process known as retrogression?Again: apparently not.Nicholas Stephanopolous of Harvard Law School, Eric McGhee of the Public Policy Institute of California and Christopher Warshaw of George Washington University compared every congressional, State Senate and State House district before and after the lines were redrawn to accommodate population shifts in the 2020 census in their paper “Non-Retrogression Without Law.”“Our primary finding,” they write,is that there was little retrogression in formerly covered states. In sum, the number of minority opportunity districts in these states actually rose slightly. We also show that formerly covered states were largely indistinguishable from formerly uncovered states in terms of retrogression. If anything, states unaffected by Shelby County retrogressed marginally more than did states impacted by the ruling.These two papers raise some intriguing questions.If changes in election laws, especially those affecting voter turnout, have little influence on partisan outcomes, why should the average citizen care about these developments?Conversely, even if the laws have only marginal influence on election outcomes, couldn’t that marginal difference become crucial in very close elections? The contest for attorney general in Arizona in 2022, for example, was won by just over 500 votes out of more than 2.5 million cast.The authors of the two papers cited above, along with other experts in election law, reject out of hand the notion that the often minimal partisan effect of regressive legislation should dampen the continuing effort to make voting easier and more accessible.Richard Hasen, a specialist in election law at U.C.L.A., emailed in response to my inquiry asking for his view of the two papers:Even if it turns out that laws intended to suppress the vote do not have that effect overall and in the aggregate, that would not justify such laws. A state should not have the right to put stumbling blocks in front of eligible voters. Such laws violate the rights and dignity of each voter, and such laws should have to be justified by real, empirically verifiable interests in preserving the integrity of the vote or serving some other key state purpose.Grimmer and Hersh argued in an email that their work should prompt increased public interest in election law:First, there are a lot of reasons legislators, activists, or political parties might want to reform laws that have nothing to do with the change in laws affecting outcomes. For instance, changing laws might improve the functioning of elections and increase trust in the electoral process. We might think some changes to election laws are simply the right thing to do based on our ethical values.In addition, Grimmer and Hersh argue, the minimal effects of changes in the law on election outcomes means that partisans on both sides “will have to win on the merits of their arguments rather than through changing the rules of the game. We think that’s a pretty optimistic story for democratic governance.”Marc Elias, a founding partner of Elias Law Group and a longtime Democratic election lawyer, raised the point that even very small shifts can determine the outcome in extremely close races.Grimmer and Hersh’s reply:In our paper, we concede that on the very rare occasions that an election is decided with a razor thin margin, nearly everything that happened could explain a candidate’s victory — a seasonal flu, a rainstorm, a “hanging chad,” etc. That said, even some of the most hotly contested policies have effects smaller than the margin Mr. Elias quotes from Arizona. For example, in our paper we estimate that the ban on out-of-precinct voting in Arizona only yielded Republicans 177 votes, even though this policy was a major source of dispute in the Brnovich Supreme Court decision. So even if a policy such as that had been implemented in 2022 and everything else remained the same, the Arizona attorney general result would have remained unchanged.In support of their argument, Grimmer and Hersh create a hypothetical case study: “Suppose a state recently held a close election in which 51 percent of voters supported the Democratic candidate and 49 percent of voters supported the Republican candidate.” In response, the Republican legislature enacts a law that “imposes additional requirements to vote” on 4 percent of the electorate containing voters who are 60-40 Democratic. The law will produce a “a 3-percentage point decline in turnout in this group.”If the 51-49 election is run again with this new voter suppression regulation, they continue, “the policy would cause a 0.12 percentage point decline in the overall turnout. And it would cause a 0.011 percentage point decline in the two-party vote share for the Democratic candidate.”The result?50.989 percent of voters would support the Democratic candidate while 49.011 percent of voters would support the Republican candidate. If the state had one million eligible voters, the policy would deter 720 Democratic voters and 480 Republican voters, netting the Republicans a 240-vote shift.Interestingly, if this hypothetical is applied to the Arizona attorney general race I mentioned, the voter suppression law would have changed the Democratic victory into a Republican one by adding a net of 600+ Republican votes.In addition to Hasen, I asked a number of scholars and voting rights proponents to comment on the two papers.There was general agreement, with some caveats, in the case of the Stephanopolous, McGhee and Warshaw paper. The Grimmer-Hersh paper provoked a wider range of reactions.Kevin Morris, a researcher in the democracy program at the Brennan Center, did not fault the Grimmer-Hersh paper, but stressed that “As the authors do not dispute, the impact of partisan outcomes in statewide races is not the only or even primary reason to be concerned about those restrictions.”Grimmer and Hersh are careful to note, Morris continued, that “restrictive voting laws usually disproportionately harm voters of color. Whether or not this has a partisan impact on statewide results, this is a significant harm in and of itself.”Kareem Crayton, senior director for voting and representation at the Brennan Center, argued in an email that the elimination of the preclearance requirements under Section 5 of the Voting Rights Act has placed cumbersome and time-consuming burdens on private lawyers bringing voting rights cases.Preclearance, Crayton wrote, required “a submission outlining the state’s intentions, its underlying data, and supporting documentation,” all of which provided “major sources of foundational evidence for any such lawsuit.”The lack of this crucial information, Crayton continued,has meant that Section 2 plaintiffs must gather much of this material through discovery, a litigation tool that involves far more time and resources than when Section 5 was operational. Alabama’s current illegal congressional map has stood for almost a full election cycle, denying Black voters an equal opportunity to elect candidates of choice. At least part of this unjust delay is due to the extra time needed to build the factual case showing the Section 2 violation.Guy-Uriel Charles, a law professor at Harvard who directs its Charles Hamilton Houston Institute for Race and Justice, argued in an email that “from a democracy perspective,” partisan outcomes are “the wrong way to think about voting rights.”What matters most, in Charles’s view, “is whether voter suppression laws prevent eligible voters — whether those voters are Republicans or Democrats; Black, White, Asian, Native, or Latino; live in the South or the North; poor or rich, college educated or not — from exercising what ought to be a fundamental right.”In addition to Elias, there are others who challenge Grimmer and Hersh’s portrayal of minimal effects on election outcomes resulting from new legislation.Thad Kousser, a political scientist at U.C. San Diego, wrote by email that he sees “two possible caveats to Grimmer and Hersh’s overall message that voter participation reforms have ‘essentially no effect on partisan advantage.’”First, Kousser wrote, “even marginal partisan effects can be consequential in a nail-bitingly close election.” He pointed to an “illustrative example” that Grimmer and Hersh use:a reform that increased turnout by 1.25 percentage points overall — a size similar to the impact of many real-world reforms — would yield a decrease in the Republican candidate’s vote margin of 7,500 votes, out of 487,500 votes cast. Because the authors assume in their example that the state overall is strongly Republican, this would only reduce “the two-party share for the Republican candidate from 78.46 percent to 77.00 percent.” In that example, it would not be large enough to swing the election. But of course, if the state were much more closely contested, those 7,500 votes could change the winner. And if the votes were concentrated in a few legislative districts, they could also play an important role in those outcomes.Second, Kousser wrote:There are some recent reforms that may have significantly larger impacts than those reviewed by Grimmer and Hersh. California’s recent law that shifts most off-cycle local elections onto the same schedule as even-year presidential and gubernatorial elections is proving to have major impacts on the size and composition of the electorates voting for mayors, county supervisors, and school boards.Kousser pointed to a 2022 paper, “Who votes: City election timing and voter composition” — by Zoltan L. Hajnal, Vladimir Kogan and G. Agustin Markarian, political scientists at U.C. San Diego, Ohio State and Loyola University-Chicago — which examined the changed composition of the electorate in California as cities shifted from holding local elections on days separate from federal contests to holding them on the same day, known as “on cycle elections.”When cities shift to on-cycle elections, Hajnal and his two colleagues write, the non-Hispanic white share, previously two-thirds of the vote, “decreases by nearly 10 percentage points” in presidential election years and “by 5.7 points when they are concurrent with midterm elections.”The Latino share increases “from about 18 percent in off-cycle elections to just under 25 percent when these elections are consolidated with presidential contests.” The Asian American “share of the electorate increases by 2.3 percentage points when cities move to the same date as presidential elections,” which may not seem like much “but it’s important to keep in mind that Asian Americans account for only 7.7 percent of the electorate in off-cycle elections, so this represents an increase of 30 percent.”The changed composition of the electorate in on- and off-cycle elections is equally remarkable for young and old voters. The authors found that older voters “account for nearly half of off-cycle voters. But the share of older voters drops almost 22 points in local elections that coincide with presidential elections and 13 points for midterm elections.” The share cast by younger voters, in turn, “almost doubles during presidential elections.”In the case of all these factors — race, ethnicity and age — Hajnal, Kogan and Markarian conclude that “on-cycle elections produce a more representative electorate.”Along similar lines, four political scientists, Michael P. McDonald, Juliana K. Mucci and Daniel A. Smith, all of the University of Florida, and Enrijeta Shino of the University of Alabama, found significant turnout increase in states adopting mail voting.In their June 2023 paper, “Mail Voting and Voter Turnout,” the four write thateven before the 2020 election, we show voter turnout across the states is consistently higher in every general election over the past decade in states with greater shares of overall ballots cast by mail. Drawing on turnout data from the 2012-2020 Current Population Survey and the Cooperative Election Study, we find states with greater usage of mail voting experience higher overall voter turnout.During the 2018 governor’s race in Georgia, between Brian Kemp, the Republican secretary of state, and Stacey Abrams, the Democratic candidate, Kemp gave voice to the precise anxiety of Republicans generally: that they might be swamped by a growing Democratic electorate.An audio recording leaked from an October 2018 fund-raising event caught Kemp as he was warning his supporters:As we were going into the start of early voting with the literally tens of millions of dollars that they are putting behind the get out and vote efforts for their base, a lot of that was absentee ballot requests that had just an unprecedented number of that, which is something that continues to concern us especially if everybody uses and exercises their right to vote, which they absolutely can, and mails those ballots in.Kemp went on to win, but two years later, despite the flood of voting restrictions since 2010, turnout in the 2020 presidential election was the highest in 30 years, according to the U.S. census.What this suggests is that the American electorate is determined to exercise the franchise and is resistant to legislated hindrances — more so than many would expect. This does not bode well for a Republican Party that for the moment has applied its money, energy and strategic skill to reducing Democratic turnout and suppressing Democratic votes.The Times is committed to publishing a diversity of letters to the editor.     In North Carolina, a Voting Rights Clash Ahead of 2024

    Republicans, whose edge in the state has narrowed in recent years, have gone on offense politically, leading to clashes over voting access and control over elections.A closely watched political fight is developing in North Carolina over voting rights and control of elections, as Democrats aim to recapture a presidential battleground and Republicans look to win back the governor’s office.Much as Georgia, Florida and Texas drew an outpouring of national attention and political cash as Republicans moved to restrict voting in the heated months after the 2020 election, North Carolina is poised for headline-grabbing confrontations over nearly every lever of the electoral apparatus.In the Republican-led legislature, the State House is considering two bills passed by the Senate that would sharply alter how elections are run, adding voting restrictions and effectively neutering the state elections board, which is now controlled by Gov. Roy Cooper, a Democrat. And in a looming redistricting clash, the newly conservative State Supreme Court has ordered lawmakers to redraw the state’s congressional and state legislative maps, which will most likely be far friendlier to Republicans.In North Carolina, every little edge could matter: The state, despite a long string of Republican presidential victories interrupted by Barack Obama’s 2008 triumph, has grown increasingly close. Donald J. Trump squeezed by in 2020 by just over a percentage point, and President Biden’s allies have signaled that they plan to invest in the state in 2024, seeing it as potentially winnable. Mr. Trump, Gov. Ron DeSantis of Florida and other Republican candidates have already held events in North Carolina as they contend for their party’s nomination.“North Carolina is one of the states that have both of the factors that exacerbate this,” said Wendy Weiser, the vice president for democracy at the Brennan Center for Justice, referring to Republican attempts to wield more power over voting and elections. “It is a battleground state and a state that has a history of discrimination in voting.”She added, “It is definitely one of the most critical states to be worried about.”Seismic shifts in North Carolina politics cleared the runway for Republicans to go on offense. They now have veto-proof legislative majorities after a Democratic representative defected to the G.O.P. in April, limiting what Mr. Cooper can halt. And conservatives captured the State Supreme Court in last year’s elections, upending it from a 4-to-3 liberal lean to a 5-to-2 conservative advantage.Republicans gained veto-proof majorities in the North Carolina General Assembly this spring, and last year they won control of the State Supreme Court. Travis Dove for The New York TimesBehind the scenes, a network of right-wing activists and election deniers led by Cleta Mitchell, a lawyer who played a key role in efforts by Mr. Trump and his allies to overturn the 2020 election, has been meeting with North Carolina lawmakers, pushing its priorities and helping shape certain provisions.Across the country, Republicans continue to try to tighten voting laws, arguing that they are needed to protect “election integrity” and pointing to voters’ Trump-fueled worries about election fraud.So far this year, at least 11 states have passed 13 laws adding such restrictions, according to the Brennan Center. That is a slightly slower clip than in 2021, when Republican-led legislatures passed a flurry of voting laws, often in response to election lies spread by Mr. Trump and his supporters.North Carolina has a particularly tortured past on voting rights. Under the Voting Rights Act, parts of the state were forced to obtain federal clearance to change voting laws because of their history of racially discriminatory election rules. More recently, in 2016, a federal court struck down a Republican-led voter identification law, saying it had targeted “African Americans with almost surgical precision.”Republicans have defended the latest measures. State Senator Warren Daniel, one of the primary sponsors of the bill to change voting laws, said on the chamber floor that the measure “increases confidence and transparency in our elections.” He added that certain changes, including a provision requiring that all absentee ballots be received by the time polls close on Election Day, would bring North Carolina in line with many other states.Democrats, however, have denounced the voting proposals, with one state senator, Natasha Marcus, going so far as to call them a “jumbo jet of voter suppression.” During final debate on the bill, she said it “includes a lot of problematic things that are going to dissuade people from voting, throw out ballots, and suppress the votes of certain people in a way that I think is discriminatory and anti-democratic.”A key provision would effectively eliminate same-day voter registration and replace it with a system in which voters would cast provisional ballots, then be required to follow up and verify their identities. Only some forms of identification would be acceptable: Data from the State Board of Elections found that in the four general elections since 2016, over 36 percent of voters who used same-day registration had provided IDs that the new law would not allow.Gov. Black voters, the court found, made up 35 percent of same-day registrants in the 2012 election, while representing only 22 percent of the electorate.The new legislation also makes mail voting more complicated, adding a requirement that voters’ signatures be verified and a “two-factor” authentication process that would be unique to North Carolina and has left voting experts confused as to how it would work. As in other states, far more Democrats in North Carolina now vote by mail, with Mr. Trump and his allies instilling a widespread Republican distrust of the practice. In the 2022 midterm elections, more than 157,000 people in the state voted by mail. Forty-five percent were Democrats, and 35 percent were independents.As Republican lawmakers wrote the legislation, they received outside help.Three G.O.P. lawmakers, including Mr. Daniel, met in May with Ms. Mitchell, the Trump-allied lawyer, and Jim Womack, a leader of the North Carolina Election Integrity Teams. That organization is part of a national network of right-wing election activists coordinated in part by Ms. Mitchell, who declined to comment.The two activists pressed the lawmakers on their laundry list of changes to election laws, including measures on same-day registration, absentee ballots and maintenance of voter lists, according to a video in which Mr. Womack summarized the meeting. The video was obtained by Documented, a liberal investigative group, and shared with The New York Times.“Same-day registration, we’re all in agreement, violent agreement, that same-day registration will now be a provisional ballot,” Mr. Womack said in the video of the meeting. “So if you’re going to same-day register, it’s going to give you at least a little bit of time, maybe 7 to 10 days, to have a chance at researching and challenging that voter under the law as opposed to where it is now, where it’s less than 24 hours’ opportunity to do that.”Mr. Daniel declined to answer questions about the role Ms. Mitchell and Mr. Womack played in drafting the bills.Republicans have defended their proposed voting measures, saying that they will increase confidence in elections.Kate Medley for The New York TimesA 2017 law aiming to restructure the state election board was struck down by the State Supreme Court. Now that the court is more conservative, Republicans have resurrected the effort.Currently, Mr. Cooper appoints all five members of the board, but only three can be Democrats. Under the Republican proposal, the board would have eight members, all appointed by state lawmakers — four by Democratic leaders and four by Republican ones.State Senator Paul Newton, the bill’s Republican sponsor, introduced it as a measure “intended to take partisan advantage out of elections administration entirely.”The bill would all but certainly cause deadlock on many major election issues — a prospect that has alarmed election officials and democracy experts.The current election board, after reports of harassment of election officials in 2022, stepped in with rules limiting access for poll watchers, a move that angered conservatives.And there is one big unknown: What would happen if the new election board deadlocked over the certification of an election?That possibility is unaddressed in the bill. Phil Berger, the Republican leader of the State Senate, told The News and Observer that any such deadlock would probably send the matter to the courts, where decisions could depend on the partisan lean of the judge or court in question.“That’s a tell right there,” said Robyn Sanders, a counsel at the Brennan Center. “It seems pretty clear to me that it was deliberately designed so that there would be those kinds of situations.” More

    The Supreme Court Rejects a Once-Fringe Elections Theory

Here’s the latest at the end of Tuesday.Justices on the country’s highest court rejected a legal theory that would have radically reshaped how elections are conducted by giving state legislatures largely unchecked power to set rules for federal elections and to draw congressional maps warped by partisan gerrymandering. The 6-to-3 decision was cheered by voting rights advocates who feared an undemocratic fallout if the Supreme Court had ruled the other way.“If the theory had been upheld, it would have been chaotic,” my colleague Michael Wines said. “In states like Wisconsin and Ohio, it basically would have allowed legislators to enshrine themselves in power all but permanently. They could’ve done whatever they wanted pertaining to redistricting or, for that matter, ordinary election law.”Proponents of the “independent state legislature” theory argued that — based on a reading of the Constitution’s Elections Clause — no court or organ of state government, like election administrators or independent commissions, could alter a legislature’s actions on federal elections. Chief Justice John Roberts, writing the majority opinion, rejected that position. He said that the Constitution “does not exempt state legislatures from the ordinary constraints imposed by state law.”The case, however, will have no practical impact on the dispute that gave rise to it, involving North Carolina’s congressional voting map. A recent ruling by that state’s Supreme Court authorized the legislature, which is controlled by Republicans, to draw maps as it sees fit, ensuring that the resulting districts will be warped by politics.The Supreme Court will announce its next rulings on Thursday.     The Supreme Court Finally Strikes the Right Balance on Voting Rights

    One of the most important realities of American life is this: No nation can fully undo the effects of 345 years of state-sanctioned bigotry — from slavery to Jim Crow — in 59 years. The time period between the arrival of the first slaves on colonial shores in 1619 and the abolition of legalized discrimination with the passage of the Civil Rights Act in 1964 is simply too long, the discrimination too ingrained and the distortion of society too great to wave the wand of legal and cultural reform and quickly realize the dream of American equality.At the same time, there’s another vital American reality: Through grit, determination and immense courage, Black Americans and other marginalized communities have made immense gains, the hearts of countless white Americans have indeed changed and America is a far better and fairer place than it was in even the recent past.And now, at last, in the vital area of voting rights, Supreme Court authority reflects both these truths.Earlier this month, the Supreme Court issued a ruling in a case called Allen v. Milligan that surprised many legal observers by striking down an Alabama redistricting map that would have preserved the state’s recent tradition of maintaining only one majority Black district out of seven in a state with a 27 percent Black population.Voting in Alabama is extremely racially polarized. For example, in the 2020 presidential election, 91 percent of Black voters in the state voted for Joe Biden, while only 20 percent of white voters did so. In practice, this persistent polarization, combined with GOP-drawn district maps, has meant that Black voters were able to elect only one of Alabama’s seven congressional representatives.Voting rights jurisprudence is extremely complicated, but I’ll do my best to be succinct and accurate in describing both the issues and one key reason for the surprise: The author of the majority opinion in Allen — which, again, generally cheered liberals and disappointed conservatives — was Chief Justice John Roberts. Ten years ago, he had written one of the most contentious Supreme Court opinions of the 21st century, Shelby County v. Holder.In Shelby County, a sharply divided 5-to-4 court gutted key provisions of the Voting Rights Act of 1965 by striking down elements of Section 4 that required the federal government to “preclear” or preapprove changes to the voting laws of a limited number of American states, counties and townships, essentially placing these jurisdictions under federal supervision to prevent them from enacting (or, more precisely, re-enacting) discriminatory voting laws. Each of the jurisdictions had an especially pernicious history of racial discrimination in voting.The states included seven of the old Confederacy, plus Alaska and Arizona, as well as a handful of counties and towns in other states (including the counties of New York, Bronx and Kings, or Brooklyn, in New York City, each of which had extraordinarily low Hispanic voter registration rates as well as a legacy of English literacy tests). In 1966, the Supreme Court had upheld the Voting Rights Act in an 8-to-1 decision, holding that “exceptional conditions can justify legislative measures not otherwise appropriate.”In 2013, however, the Roberts court decided that some of those “exceptional conditions” no longer pertained. As Chief Justice Roberts wrote, “Census Bureau data indicate that African American voter turnout has come to exceed white voter turnout in five of the six States originally covered by §5, with a gap in the sixth State of less than one half of one percent.”The decision didn’t gut the entire act. Section 2, which prohibits “denial or abridgment of the right of any citizen of the United States to vote” on the basis of race, remained in force. But the meaning of Section 2 has been a subject of intense debate. Gerrymandering has been at the heart of that debate.If a state “cracks” a Black community (i.e., splits it apart into multiple districts) or “packs” one (i.e., concentrates its voters into supermajority districts) in a manner that leaves Black voters with diminished voting power, does that violate the act? It certainly does if it’s done with an explicit racial motive.But what if the state claims that the motive isn’t racial, but partisan? The Supreme Court has long granted states greater leeway to tilt the partisan playing field, and in a 2019 case, Rucho v. Common Cause, it seemed to throw up its hands entirely, holding that complaints against partisan gerrymandering weren’t “justiciable.” In other words, the solution to partisan gerrymandering abuses should be located in the political branches of government, not the courts.This ruling potentially created an immense opening for disguised racial gerrymanders, especially in heavily racially polarized states. Even worse, Alabama wanted the Supreme Court to modify existing precedent to give states even greater leeway in the face of claims of race discrimination. If Alabama prevailed, a Republican-dominated state could crack or pack Black communities and say that it was done not because the communities were Black, but because they were Democratic. Though the result — less Black representation in Congress — would be the same, the motive would be legal.Or would it? In Allen, Chief Justice Roberts, Justice Brett Kavanaugh and the three Democratic-appointed justices said no, not always. Under highly racially polarized voting conditions, Supreme Court authority will require the creation of majority-minority districts when, to quote Justice Kavanaugh’s concurrence, “(i) a State’s redistricting map cracks or packs a large and ‘geographically compact’ minority population and (ii) a plaintiff’s proposed alternative map and proposed majority-minority district are ‘reasonably configured.’”To translate the legalese: States and regions that are highly racially polarized can’t fracture or compress minority voting districts when reasonably drawn alternative maps would more closely maintain the relative power of minority voters. If anything, by reaffirming and clarifying existing precedents in the face of substantial legal doubt, the Court strengthened Section 2.I know that’s a lot to take in, but here’s where things get interesting. If you peruse recent exit polls, you’ll quickly observe that many of the old preclearance states retain exactly the kind of racially polarized voting patterns that, thanks to the Allen ruling, can trigger judicial skepticism. I quoted Alabama’s voting stats above. But what about other old preclearance states? In 2020, 77 percent of white Louisiana voters voted for Donald Trump, and 88 percent of Black voters voted for Joe Biden. In Mississippi, 81 percent of white voters voted for Trump and 94 percent of Black voters voted for Biden. In South Carolina, 69 percent of white voters voted for Trump and 92 percent of Black voters voted for Biden.While I certainly won’t argue that most white voters in those states are racist (indeed, a supermajority of voters in South Carolina supported Tim Scott, a Black Republican, for Senate), those numbers are not the American norm. Racial polarization exists more broadly, but not to the same extent. Nationally, for example, 55 percent of white voters voted for Trump, while 92 percent of Black voters voted for Biden. In some states, such as California and New York, Joe Biden received a majority of white and Black votes.Racially polarized voting isn’t proof of racism in any given voter’s heart. But it is part of the legacy of American bigotry and racial divisions. By preserving and clarifying the core of Section 2 of the Voting Rights Act — especially when voting is highly racially polarized — and by rejecting Alabama’s effort to limit Section 2, Chief Justice Roberts has subtly limited the reach of his own precedent. Now, thanks to Allen, many preclearance states will face greater scrutiny — unless and until their own cultural and political changes bring them closer to broader American partisan norms.That’s the legal impact, but there’s a cultural impact as well. In a tangible way, Chief Justice Roberts, along with Justices Sonia Sotomayor, Elena Kagan, Kavanaugh and Ketanji Brown Jackson brought the court’s precedent closer in line with the nation’s reality. Our country has made real progress in addressing racist violations of voting rights. The ruling in Shelby County reflected that encouraging truth. At the same time, our nation still hasn’t cleansed itself of racism or fully addressed the legacy of bigotry. The court’s holding in Allen acknowledged that sad fact.The law does not always align with the facts of American life, but in this case, the Supreme Court has brought it closer to proper balance. The Court is an embattled institution, yet it still retains some bipartisan wisdom. America has come so very far, so we must not despair as if all is lost.     Republicans Are No Longer Calling This Election Program a ‘Godsend’

    To hear many Republicans tell it, American elections are awash in incompetence and fraud: shady precinct workers, dead people voting, unverifiable mail-in ballots and so on — and that was even before the Jan. 6 insurrection. Virtually all of the stories are exaggerated, misleading or simply false. And genuine voter fraud is extraordinarily rare. Still, Republican officials have for a long time rightly insisted on the importance of election integrity. So why are so many of them rejecting what was, until a few months ago, widely agreed to be the single best program for shoring up that integrity?Over the past 18 months, eight Republican-led states (with more likely to follow) have resigned their membership in the Electronic Registration Information Center, or ERIC, a nonprofit, nonpartisan data clearinghouse that helps states keep their voter rolls accurate and up-to-date.Before we get into the groundless conspiracy theories that led to this mass exodus, consider the sheer logistical challenge of maintaining voter rolls in a country of more than 330 million people. Americans have a tendency to move, within a state or between states, often forgetting to update their voter registration along the way. Sooner or later, they die. The result is that the rolls of many states are littered with errors: People who are unintentionally registered in more than one place or who remain on the books after they’ve departed a state or this world. In 2012 as many as one in eight voter registrations nationwide was invalid or highly inaccurate, according to the Pew Charitable Trusts, which helped form ERIC that year as part of its data-based approach to public policy debates.Because of our decentralized election system, the responsibility to sort out this mess falls to the states. Federal and state laws require states to maintain accurate voter rolls, but the states have no established way to communicate and coordinate with one another. The existence of searchable voter data itself is relatively new: As recently as 2000, only seven states had computerized statewide voter databases.In short, it’s easy to proclaim that free, fair and well-run elections are the lifeblood of democracy; it’s a lot harder to put that ideal into practice. One early effort, like the Interstate Crosscheck program, failed miserably because of inadequate data analysis and poor security practices. ERIC has succeeded by devoting the time, money and expertise necessary to build a comprehensive, secure and useful database of voter information. That information — drawn from voter rolls, D.M.V. records, Social Security death records and change-of-address data — gets analyzed, matched and compiled into reports that are provided to the states to help them clean up their rolls.The work has paid off: Through April 2023, ERIC has identified nearly 12 million voters who moved across state lines, more than 24 million whose in-state registrations required updates, more than 1 million in-state duplicates and nearly 600,000 dead people who had not been removed from the rolls. In addition, ERIC requires that member states reach out to eligible but unregistered voters, although it is difficult to determine just how many new voters have signed up as a result.ERIC did all of this in a true example of bipartisanship. “It’s a place where red and blue states were able to come together, have this really boring but really effective data system for keeping the right people on the rolls and removing the wrong people from the rolls,” said Danielle Lang, the senior director of the voting-rights program at the Campaign Legal Center.The reviews, especially from Republicans, were glowing. When Florida joined ERIC in 2019, Gov. Ron DeSantis said it was “the right thing to do for our state, as it will ensure our voter rolls are up-to-date and it will increase voter participation in our elections.” This year, Iowa’s Republican secretary of state called ERIC a “godsend”; his counterpart in Ohio said it was “one of the best fraud-fighting tools that we have.” By 2022, 31 states and the District of Columbia had signed up to pay the organization’s $25,000 membership fee. (States also pay annual dues based on their voting-age population.)Given the level of baseless hysteria surrounding voting, maybe it was too much to expect it all to last. In January 2022, the extreme right-wing website Gateway Pundit published a series of articles accusing ERIC of being “essentially a left-wing voter registration drive disguised as voter roll cleanup.” It claimed that the program was funded by George Soros — eternally the dark mastermind of every liberal corruption in the right-wing mind-set — and described one of its founders, David Becker, as a “hard-core leftist.” (Mr. Soros has given money to Pew but not to ERIC, not that it really matters.) Gateway Pundit also strongly suggested, without the slightest proof, that ERIC was somehow connected to Democratic Party databases.None of this should have been too surprising for a website that continually traffics in the most outlandish election conspiracies and is every so often labeled false or “pants on fire” by fact-checking organizations like PolitiFact.But the misinformation worked. One week later, Louisiana dropped out of the program and didn’t give a clear reason.Other states, all Republican-led, began to follow, each with dubious rationales. Some said they didn’t like being required to spend money to reach out to unregistered voters, who they believed (wrongly) are more likely to vote for Democrats. Others cited the Soros conspiracy theory. Florida officials cited undefined “partisan tendencies” and concerns about data security (though ERIC has never had a data breach). The basic theme of all the complaints was distilled in a social-media post by Donald Trump, who claimed in March that ERIC “pumps the rolls” for Democrats.If so, it’s doing a poor job, Mr. Becker pointed out. “I hate to tell Democrats this, but ERIC is not delivering them elections,” he said. “Florida joined just before 2020 and then had the greatest Republican rout in history.”Mr. Becker, who served as a nonvoting member of ERIC’s board until his term expired this year, flagged a deeper flaw in the departing states’ reasoning: They control ERIC, along with the other member states. All the states were fully aware of the terms and costs of the agreement when they joined. If they want to change the way ERIC functions, it’s entirely within their power to offer a proposal and hold a vote, as they have done many times.There is, of course, a far simpler explanation for the Republican desertion of ERIC: politics. Many of the officials who have pulled their states out of ERIC are running for higher office, and that means appealing to the Republican base, which is still addled by the toxic fumes of Mr. Trump’s “stop the steal” movement. (Cleta Mitchell, an election lawyer who was central to Mr. Trump’s efforts to overturn his 2020 loss, has been a leading advocate of the ERIC exodus.) Under the persistent influence of the former president, most Republican voters have been conditioned to view all electoral outcomes that don’t go their way as de facto illegitimate.Republicans who are not running for higher office, on the other hand, seem to have no trouble defending ERIC. “Making policy choices based on misinformation is the worst,” said Gabe Sterling, a top election official in Georgia, which joined ERIC in 2019 and is happy to stick with it. “We’re already under pressure, but our calculus is what’s best for the voters of Georgia, because that’s our job.”The problem is that, as the only game in town, ERIC works best when more states join. States that have resigned no longer have a good way to analyze or share their voter data, and states that remain will receive less useful reports (and will pay more money) because the pool of participants is smaller. In short, everyone loses.“The very actors who said they care about list maintenance the most are now abandoning the only tool they had available,” said Ms. Lang. “It seems like the goal is to create chaos — to lead to bloated rolls so they can point at them and say, ‘Look at the problem we have,’ even though it’s a problem entirely of their own making.”That would seem to be a paradox, but it turns out it’s the whole point.The Times is committed to publishing a diversity of letters to the editor.     Texas Passes Bills Targeting Elections in Democratic Stronghold

    The bills’ passage was the culmination of a Republican effort to increase oversight of voting in Harris County, which includes Houston.The LatestThe Texas Legislature gave final approval on Sunday to a new round of voting bills to increase penalties for illegal voting and expand state oversight of local elections specifically in Harris County, which includes Houston, where Democrats have become dominant.The measures, which now head to Gov. Greg Abbott to sign, include a bill that would upend elections in Houston a few months before the city’s mayoral race in November by forcing the county to change how it runs elections and return to a previous system.That bill, known as Senate Bill 1750, was crafted so that it applies only to Harris County. They highlighted Election Day problems last November in Harris County as justification for challenging results that favored Democrats and call into question the way the Democratic-led county runs its elections.“It was a stated intention of some of the folks in the Legislature to take action against Harris County election administration,” said Daniel Griffith, the senior policy director at Secure Democracy USA, a nonpartisan organization focused on elections and voter access.Senate Bill 1750 eliminates the appointed position of elections administrator, which has been in place in Harris County only since late 2020. If the bill becomes law with the governor’s signature, the county must return to its previous system of running elections, in which the county clerk and the county tax collector-assessor split responsibilities. Both positions are currently occupied by elected Democrats.“The Legislature’s support for S.B. 1750 and S.B. 1933 is because Harris County is not too big to fail, but too big to ignore,” State Senator Paul Bettencourt, a Houston Republican and sponsor of several election bills, said in a statement. “The public’s trust in elections in Harris County must be restored.”Another bill, Senate Bill 1070, removes Texas from an interstate system for crosschecking voter registration information run by a nonprofit, the Electronic Registration Information Center, or ERIC. The system has been the target of conservative attacks in several states in part because it requires states using it to also conduct voter outreach when new voters move in from out of state. The Texas measure bars the state from entering into any crosschecking system that requires voter outreach.Yet another bill, House Bill 1243, increases the penalty for illegal voting from a misdemeanor to a felony.The measures that passed were opposed by Democratic representatives and voting rights groups. But advocates of greater access to the polls were relieved that other, more restrictive measures put forward and passed in the State Senate — including one that would have required voters to use their assigned polling place instead of being able to vote anywhere in the county, and another that would have created a system for the state to order new elections under certain circumstances in Harris County — failed in the Texas House.“Those haven’t moved and that’s definitely a good thing,” Mr. Griffith said.What’s Next: a lawsuit and a microscope on upcoming elections.The bills invite new scrutiny of elections, especially in Harris County, where officials would be expected to revamp their system just months before important elections.Under the new legislation, future complaints about the functioning of elections in the Democratic-run county could create the real possibility that the secretary of state, a former Republican state senator, could step in and oversee elections as early as next year, as the county votes for president.The bills, said Mayor Sylvester Turner of Houston, “create more problems than they allegedly solve.”Top officials in Harris County have vowed to go to court to challenge both measures aimed at the county once the laws go into effect (Sept. 1, if the governor signs), meaning the fight over elections in the county remains far from over.     Texas Republicans Push New Voting Restrictions Aimed at Houston

    The bills propose limits on polling places, tougher penalties for illegal voting and a way for the Republican-led state to order new elections in its largest city.HOUSTON — Across Harris County, an emerging Democratic stronghold in reliably red Texas, roadside signs posted last November urged harried drivers to vote Republican. A celebrity furniture salesman, beloved by many Houstonians, cut ads with the Republican candidate for the top county administrator’s post.The 2022 races for local judges and county leaders were among the hardest fought and most expensive yet seen in the sprawling county of 4.8 million, which includes Houston, as Republicans looked to capitalize on crime concerns to make headway in the state’s largest urban area.But they fell short.Now, the county is in the cross hairs of the Republican-dominated state Legislature, which is trying to exert more control over voting there. Lawmakers are pushing dozens of new election bills, including limits on polling places, felony penalties for illegal voting and a mechanism for the state to order new elections when voting problems occur in Texas counties with more than 2.7 million people, a category that includes only Harris County.At the same time, more than a dozen election challenges have been filed by losing Republican candidates in the county who have argued that significant problems at a limited number of polling places on Election Day, including insufficient supplies of ballot paper, were enough change the outcomes of races. While local leaders acknowledge issues, evidence has not been presented that they affected the results.Still, the two-front fight, both in the courts and in the State Capitol, highlighted just how important it is for Republicans to keep Harris County in play and not let it become another strongly blue urban center along the lines of Austin or Dallas. As recently as 2014, the party controlled the county, whose Republican top official was re-elected in a landslide. But it has been moving left ever since.“I tell people, we could be the reason we lose Texas, just because of our size,” said Cindy Siegel, the chair of the county Republican Party, sitting in her office under a painting of George W. Bush with smoke rising from Lower Manhattan after Sept. 11, 2001.“We’re the wall,” she added. “And they say, so goes Texas, so goes the country. They include bills prohibiting local governments from adopting certain local ordinances, including over worker pay or hours, and allowing for the removal of elected local prosecutors who refuse to enforce certain laws, such as those banning abortion. The approach mirrors those in other red states with large blue cities, such as Tennessee and Florida.Republican lawmakers in Texas passed an overhaul of election rules just two years ago in a bitter fight with Democrats. They returned to the subject this session in large part to address the results in Harris County in November.The election there provided a contentious backdrop because there were real issues during the vote. Some polling places opened late, while others struggled with enough paper to accommodate the two-sheet ballot printouts needed for the county’s huge list of races. The local district attorney, a Democrat, opened an investigation last year.“The legislative push is to make sure that this never happens in any county in Texas,” said Senator Paul Bettencourt, a Houston Republican and the sponsor of several of the bills. “I believe the lack of ballot paper is voter suppression.”But county officials said the election bills do not address the issues that arose in Harris County. Instead, they said, the proposed laws could dampen turnout by limiting voting options and would give a partisan secretary of state, an official appointed by the governor, the power to overturn results and order a new vote if ballot paper issues arose again.Christian Menefee, the Harris County attorney, said the election challenges appeared to try to lay the groundwork for giving Republicans more control over the elections in a Democratic county. “It is a solution in search of a problem that’s not widespread,” he said.“As a Black man whose grandfather paid a poll tax, this whole ordeal is infuriating,” said Mr. Menefee, a Democrat. “It’s a complete misuse of the word disenfranchisement from people who, by the way, are still working to disenfranchise folks.”The scale of the problems on Election Day — which featured new voting machines and a lengthy ballot that required two pages of paper per voter — remain a matter of dispute, both in court and before the Legislature. But they do not appear to have affected the vast majority of the county’s 782 polling locations.Election workers organized ballot machines and results at NRG Arena in Houston on Election Day in 2022.Annie Mulligan for The New York TimesAt a hearing before a State House committee in March, the head of the secretary of state’s elections division said that despite logistical problems, the 2022 election “was one of the best elections we’ve seen” in several years in Harris County, though he acknowledged it was a low bar given the roundly criticized primary election earlier in the year.Republicans have said the November results were indeed affected because, they have argued, the ballot issues arose in precincts where their voters turn out in large numbers. Democratic county officials have said the problems occurred in other areas as well and were limited in scope: A postelection report by the election administrator, Clifford Tatum, found that 68 polling places reported running out of paper on Election Day, and 61 said they later received additional paper.County officials have resisted releasing documents and other information about the handling of voting issues on Election Day in response to public information requests, citing the ongoing litigation. Among Senator Bettencourt’s election bills is one that would remove the “litigation exception” for requests for certain election records.With that backdrop, the State Senate has advanced more than a dozen election bills, explicitly or implicitly aimed at Harris County, an area larger than the state of Rhode Island that includes not only the reliably Democratic city of Houston but also some of its more moderate suburbs.The county since 2016 has shifted ever more firmly into the Democratic column in presidential races and local ones as well, as formerly conservative neighborhoods and growing Houston suburbs have grown more diverse and trended blue. The political make-up of the five-member commissioners court, which administers the county, has gone from a three-two Republican majority in 2014 to a four-one Democratic majority now.Republicans are hoping, if not to reverse that trend, then at least to keep the contests close and, sometimes, winnable.“The Texas Legislature will ensure that there are consequences for Harris County’s failure to run elections,” said Senator Mayes Middleton, a Houston-area Republican and the sponsor of the bill to allow the secretary of state to order new elections in certain cases of ballot paper problems. “Disenfranchising voters is unacceptable,” Mr. Middletown said, in a statement.Also of concern to Democrats and advocates of expanding access to the polls is another bill, which passed the State Senate last month, that would limit voters to their assigned polling place. Some counties, including Harris County, currently allow voters to cast a ballot anywhere in the county.“It’s definitely one of the most damaging,” said Katya Ehresman, the voting rights program manager at the advocacy group Common Cause Texas, because by limiting voters’ options it could decrease turnout. The bill, like others that have made it through the Senate, must still pass the more moderate, Republican-controlled State House.In the last election, voters whose polling places ran out of paper were able to go to another location in the county, though some gave up without voting.Twenty-one Republican candidates have filed election challenges, including Alexandra del Moral Mealer, who lost the Harris County judge race by 18,000 votes.Annie Mulligan for The New York TimesMany of the legal challenges to the November election in Harris County involve voters who were unable to cast ballots.Leila Perrin said she had gone to vote in a more conservative section of West Houston shortly before the polls closed on Election Day and encountered a chaotic scene. “I went to get out of my car, and these people were leaving and they said, ‘Don’t bother,’” she recalled. “I said ‘Why?’ And they said, ‘They don’t have any paper ballots.’”Ms. Perrin, 72, had planned to vote against the top county official, the Democratic county judge Lina Hidalgo. So she drove to another polling site nearby and found the same situation. By then it was 10 minutes before the polls closed. “So I just went home. I was furious,” she said.Twenty-one Republican candidates have filed election challenges including Ms. Perrin’s favored candidate, Alexandra del Moral Mealer, who lost to Ms. Hidalgo by 18,000 votes. The first trial is set to begin in June.Some voters also found themselves unable to vote in predominantly Democratic precincts temporarily on Election Day, though no Democratic candidates have filed challenges. For example, voters were turned away from one such location that did not open for hours. All polls in the county were ordered to stay open an extra hour under an emergency court order, but then voting was halted by the Texas Supreme Court after an appeal from the Republican attorney general.“Issues don’t mean conspiracies,” said Representative John Bucy, a Democratic member of the Texas House elections committee. “Our elections are run effectively in the state of Texas. Nothing is perfect, but they’re effective.”At a hearing of the elections committee last month, an election judge in Harris County said he had run out of paper by 6 p.m. on Election Day despite flagging the issue several times during the day.“We had about 40 people in line, most of whom left to find another polling place,” said the judge, Christopher Russo. Those who stayed would be able to vote, he said he told them, but he could not guarantee how long it would take to get the paper.“I finally received ballot paper at 9:05 p.m.,” he said.
