    A New Law Would Remove Many Architectural Protections in Miami Beach

The battle pits the pressures of development and climate change against the benefits of historical preservation, in a city that has long paved over its past and prizes the new, shiny, and glitzy.Supporters say the law addresses environmental and safety challenges of aging properties after the deadly 2021 collapse of the Champlain Towers South condo.     In Erdogan’s Turkey, a Building System Fatally Weakened by Corruption

    The building began convulsing at 4:17 a.m. Firat Yayla was awake in bed, scrolling through videos on his phone. His mother was asleep down the hall.The region along Turkey’s border with Syria was known for earthquakes, but this apartment complex was new, built to withstand disaster. It was called Guclu Bahce, or Mighty Garden. Mr. Yayla’s own cousin had helped build it. He and his business partner had boasted that the complex could withstand even the most powerful tremor.So, as the earth heaved for more than a minute, Mr. Yayla, 21, and his 62-year-old mother, Sohret Guclu, a retired schoolteacher, remained inside.At that very moment, though, Mr. Yayla’s cousin, the developer, was leaping for safety from a second-story balcony.Sohret Guclu, a retired schoolteacher, was asleep in her home in Antakya, Turkey, when the quake hit.via Firat YaylaWhat Mr. Yayla and his mother had not known was that the system to ensure that buildings were safely constructed to code had been tainted by money and politics. That system prioritized speed over rules and technical expertise.A New York Times investigation found that a developer won zoning approval for the project after donating more than $200,000 to a local soccer club, where the mayor is an honorary president. Then, when residents raised alarms that the blueprints did not match what had been built, they received no satisfying reply from the local government. The building inspector said that, even after the project had failed its inspection, the developers used political influence to get the doors open.The apartment complex, in the southern Turkish city of Antakya, was a concrete and stone representation of a patronage system that has flourished under President Recep Tayyip Erdogan as he has propelled a construction boom across Turkey for the past two decades.Undeterred by warnings that the breakneck development lacked sufficient engineering oversight, officials in the capital, Ankara, gave local politicians more power to issue construction licenses for large projects without scrutiny from independent professionals.Basic suggestions never took off — that civil engineers should have to pass a certification exam, for instance.Rescue workers at the site of the collapsed Guclu Bahce building. Mr. Erdogan, who will stand for re-election on May 14, used construction as a vessel for economic growth and a symbol of Turkey’s progress. Local politicians from all parties benefited from the jobs, housing and off-the-books payments that commonly flowed from it all.Mr. Erdogan’s office referred questions to the environmental ministry, which did not respond to requests for comment.The Feb. 6 earthquake revealed the shaky foundation on which so much growth was built. More than 50,000 people died as buildings toppled, crumbled or pancaked. Guclu Bahce, the mighty earthquake-proof complex, was among them. An estimated 65 people died there.“So many died because they were told that the safest place was inside, and they should not try to leave during an earthquake,” said Fatma Oguz, whose sister died in the collapse.For the Guclu family, several of whom lived in the building, the collapse created a fatal rift. Survivors have turned on each other amid a lawsuit, a criminal investigation and a bitter search for answers:Were the buildings doomed to fall by nature of a powerful earthquake? Or did someone cut corners? Who can be held accountable in a system in which blueprints cannot be trusted and nobody agrees on whether the building passed inspection? The inspector says somebody forged his signature. It is unclear if the final project was up to code, and the developers cannot agree on who actually built anything.As the building shook in February, Mr. Yayla called out to his mother to stay in her room and get on the floor next to her bed. He did the same. They would ride this out safely.Then came a fierce thud, and the columns holding up the bedroom ceiling snapped.‘Money From Our Friends’Family members say the land, covered in fig trees, had been theirs for three generations.By 2015, buildings were popping up all around, a testament to a Turkish economy that had been growing about 7 percent a year.Mehmet Guclu, a young developer with a civil engineering degree, approached his relatives with a plan. Look around, he told them. Somebody’s going to develop this parcel. Better to keep it in the family, to be landlords, to make money.“He convinced us that he’d build the most magnificent project in our family name,” said Yusuf Guclu, another cousin who lived in the complex. He said that Mehmet had promised to protect against the earthquakes everyone in the region knew to expect.Mehmet Guclu, then in his 30s, was a charismatic striver with a luxe aesthetic, known for incorporating sleek finishes and expensive materials like marble. He had already built some of the tallest buildings in Antakya.The extended family had dreamed of exactly this opportunity for years.The complex was to be a centerpiece of the community — five towers, complete with luxury apartments, retail shops, a pool and a high-end gym.Mehmet’s career had taken off quickly, in part because of Turkey’s low barriers to entry for civil engineering graduates. Unlike in the United States and United Kingdom, graduates in Turkey do not need to pass certification exams or complete on-the-job training to become an engineer. Architectural trade groups have called for such requirements for years.The Guclu Bahce complex in May 2020, before residents moved in. The development attracted doctors, teachers, judges and politicians, some of whom bought multiple properties as investments.Google Maps“University educates you. It doesn’t train you,” said Mustafa Erdik, an earthquake engineering professor at Bogazici University in Istanbul. “We have to bring in professional engineering.”Getting a project started often hinges on unwritten rules that can be as important as technical expertise. In this part of southern Turkey, for example, contractors have known for years that a donation to the local soccer club can move a project along, said Hikmet Cincin, the former head of the soccer club. Antakya’s mayor at the time, Lutfu Savas, serves as the club’s honorary president.After discussions with that mayor, Mehmet Guclu gave the club more than half a million lira, more than $200,000 at the time, according to a person involved in the construction process who spoke on condition of anonymity because of an ongoing investigation.Mr. Savas denied profiting from Guclu Bahce’s construction and said the donation had not been tied to the project. “If we ask for money from our friends,” he said of gifts to the soccer club, “it’s for the benefit of everyone.”He called himself an honest politician in a corrupt system. He said developers commonly made payments to circumvent bureaucratic approvals. Most build whatever they want and assume it will be approved, he said. He blamed Mr. Erdogan and his political party for fostering this culture.But Mr. Savas, himself a former member of Mr. Erdogan’s party, was adamant that was not the case with Guclu Bahce.Mr. Savas says he has little memory of the particulars. What is clear is that the project rolled along in the following years, and the foundation was laid in summer 2017.But the earth in that part of Turkey is not ideal for building, particularly in an earthquake zone, said Serkan Koc, a member of the Union of Chambers of Turkish Engineers and Architects.“These areas shouldn’t have been turned into construction zones,” he said. Soft soil, for example, will amplify an earthquake. Mr. Koc said Turkish environmental officials should have assessed the whole area before the building boom.“Although the ministry had the authority to inspect, they didn’t” he said. The environmental ministry did not respond to requests for comment.As Mr. Guclu’s new project moved forward, the only limitations seemed to be financial. Soon after the foundation was poured, his money dried up. He turned to a prominent developer, Servet Altas, to help see it through.Mr. Altas became the public face of the project. His initials, in red and blue, would later adorn the low wall ringing the complex.Sales PitchSohret Guclu had been eager for a steady income to supplement her modest state pension. So she swapped her land deeds for ownership of six apartments and a retail storefront.She had raised two boys in an old, crumbling apartment building. Her new home was to be a four-bedroom unit with an airy living room and kitchen — one of the largest in the complex.Guclu Bahce’s apartments were among the region’s most expensive, costing as much as $160,000. But Mr. Altas promised upscale amenities and unparalleled safety, former residents said.“If there were an earthquake right now, I would run inside,” Mr. Altas repeatedly said, recalled Ertugrul Sahbaz, a building manager for the complex.Guclu Bahce attracted doctors, teachers, judges and politicians. Songul Oguz and her husband bought a $117,000 apartment after a sales agent said that the building’s strong foundation and reinforced steel bars could withstand even a 10-magnitude earthquake, Ms. Oguz’s sister recalled. It would take 10 days for Ms. Oguz’s body to be pulled from the wreckage.Mr. Altas, wearing a plaid jacket and bow tie, joined government officials for a jubilant opening ceremony in late 2019. They smiled and posed with a pair of 10-foot gold scissors that were later recorded by Guinness World Records as the world’s largest. Mr. Guclu’s own family lived there, after all, as did Mr. Altas’s son. Turkey deemed Mr. Guclu a qualified engineer, and the local government — measured by the number of officials at the grand opening — supported the project.But the chest-thumping and fanfare were premature. The buildings failed a final inspection, according to court testimony. The nature of the violations is murky, but Ismail Ozturk, a building inspector, testified this year that his company had raised concerns with the local authorities.Mr. Ozturk testified that the contractors had leveraged “close connections” in the city government to overcome the failed inspection. The city mayor at the time, Ismail Kimyeci, who belongs to Mr. Erdogan’s party, denied any special treatment. He said the government’s final approval had been a formality. “The inspection firm plays the most important role here,” Mr. Kimyeci said.Mr. Ozturk’s signature does appear on a certification document. Through his lawyer, he said it had been forged.In a functioning system, there would be no ambiguity about who had approved a project. But Turkey’s system is built on ambiguity. The Erdogan government has, for decades, weakened independent, expert construction oversight and fought proposals to toughen standards.Turkey’s chamber of civil engineers, for example, has argued for years that experienced engineers are stretched too thin to adequately supervise construction projects. The group has called for every project to get a dedicated engineer. That idea, which could have slowed down construction, went nowhere. The Erdogan government sued the group in 2015, blocking it from issuing its own, stricter certifications for engineers.Lawmakers also privatized the building inspection process, sidelining Turkey’s engineering and architectural union. And while the government in 2019 eliminated a rule allowing contractors to pick their inspectors, mayors still hold power to push past potential issues.Guclu Bahce’s opening was delayed. Discrepancies existed between the blueprints and what was built, Mr. Ozturk said in testimony after the earthquake. Some former residents, too, said that they had picked up on such differences and sent a letter to the city raising concerns.One resident said the dispute centered on the very building in which Mr. Yayla slept the night of the earthquake — the first to collapse. The resident said that the building had featured an extra floor, a penthouse with a terrace that had not appeared in the plans.The resident, who spoke on condition of anonymity to avoid being dragged into a criminal and civil dispute, said he had helped broker a meeting between Mr. Altas and the city’s current mayor, Izzettin Yilmaz, to find a solution.Mr. Yilmaz, a member of Mr. Erdogan’s party, acknowledged in an interview that he had met with Mr. Altas. But he said the purpose was to tell the contractor that he was not interested in taking bribes. Gossip was swirling, he said, and he wanted to make things clear: “I told him: ‘No one requested a payment from you.’”Through his lawyer, though, Mr. Altas, denied meeting with the mayor. What’s more, Mr. Altas — who took credit at the opening ceremony for building the complex — now denies involvement with the construction or the planning. That was Mehmet Guclu’s responsibility, he said.Despite claiming no involvement, Mr. Altas said he was certain that the complex matched the blueprints.There is no indication in Mr. Ozturk’s testimony that anything was done to assess the design changes. Residents said the city promised to investigate, but they never heard back.Whether this discrepancy played any role in Guclu Bahce’s collapse and whether the inspection was adequate are among many questions being asked in the government’s criminal investigation and a family lawsuit.But the city ultimately awarded occupancy permits and residents finally moved into their apartments in 2021. Guclu Bahce sprang to life, with a health club, a home goods store and a chicken shop.For almost two years, nobody looked back or gave further thought to the construction process.Cries in the DarknessLying on the floor next to his bed, Firat Yayla thought immediately of his cousin’s assurances about the building’s sturdiness. His confidence lasted less than a minute, though, until he heard the sound of crumbling concrete.The wall next to him was caving in.As the 7.8-magnitude earthquake continued for about 90 seconds, the building fell sideways. Steel bars knifed out from the concrete, and he began slipping toward them.The lights went out, and Mr. Yayla was sure he was going to die.The next thing he registered was the sound of car alarms. His foot was wedged in a crack and he couldn’t move under the weight of a giant wall. He could barely breathe but managed to call into the darkness.“Mom!” he shouted. “Are you OK?”She called back. “Firat! Firat! Firat!”But her cries weakened, and then went quiet.“Please help me!” he shouted over and over.A resident helped free Mr. Yayla from the rubble. He survived without serious injuries. Mehmet Guclu survived his jump from the balcony with little more than an injured finger.Firat Yayla, 21, was rescued without serious injuries from the ruins of Guclu Bahce. His mother did not make it.Emin Ozmen for The New York TimesSohret Guclu died, along with more than five dozen other residents.Members of the Guclu family have sued the contractors and the inspection company, alleging construction flaws. Among those they accuse of wrongdoing is Mehmet Guclu, the cousin on whom they had pinned so many hopes.Sohret’s brother, Yusuf Guclu, said family members were angry at a system of back-scratching and favor-trading that had papered over potential problems.That system had worked in his family’s favor. The Guclus had lived the Turkish dream, converting their land into a cash cow thanks to a relative’s expertise and connections. Now, Yusuf’s sister was dead and his family was accepting donated clothing.“We’ve lost everything,” he said.Mr. Altas was arrested and jailed pending the outcome of the investigation. He has not been charged with a crime. Through his lawyer, he said he had only bankrolled the project.Mr. Ozturk, the inspector, has also been arrested but not charged. He denies signing off on the project.And, in a meeting with The Times, Mr. Guclu appeared shellshocked. He said he would consider speaking publicly about the building, the lawsuit and his family.But with a warrant out for his arrest, Mr. Guclu soon stopped returning messages.The last time he was in contact, he was working on a government construction project — part of Mr. Erdogan’s well-publicized plan to rebuild the region swiftly.The Guclu Bahce complex, which fell sideways, after the quake.     The New York Times’s Interview With Carlina Rivera

    Carlina Rivera has served as a Manhattan councilwoman since 2018.This interview with Ms. Rivera was conducted by the editorial board of The New York Times on July 27.Read the board’s endorsement for the Democratic congressional primary for New York’s 10th District here.Kathleen Kingsbury: We’re just going to jump in. I hoped we could talk a little bit about — and I understand you have to reject the premise of this question — what you would be able to accomplish in a Republican-controlled Congress. And it’s good to be as specific as possible. But also, if there’s one big idea that you have that you’d pursue on a bipartisan basis.I would love to focus on what we would actually get done, absolutely. I think I’m the type of person that’s been very effective and very collaborative. I think you are going to have many of us who want to end the Jim Crow relic of the filibuster. Are we walking into a Congress that’s going to allow that? Maybe not.So, being rooted in realism, one of the things that I’m actually going to focus on: as tangible results as possible. So that will be serving on a great committee. I realize I’ll also be a junior congressperson, so I’ll have to serve sort of, you know, where they think my service would be best needed.But I also know that we are going to be losing leadership just in N.Y.12 alone. Our chairship will be lost. And I feel the delegation is at its strongest when we have leadership amongst many committees. So I would love to have my New York congressional delegation help advocate for me to get a good committee. I’d love something like transportation and infrastructure.We have the biggest subway system in the world that floods even with a little bit of rain. And we have a B.Q.E. that’s falling down. Again, energy and commerce would also be nice, because in there, there are discussions on climate and health care. And I do feel like, even though discussions over what we can do to address the effects of climate change haven’t been particularly successful, it’s going to be an important conversation going forward.I also think, going in, something that I could focus on are earmarks, $9 billion recently for earmarks, about approximately 4,900, 5,000 earmarks, having someone — there’s no pun intended — with their ear to the ground I think is something that I’m especially good at. I know this district very, very well. I know the issues facing every neighborhood, and that is something that I will go in and fight for, to bring those resources back to my district.And then the last thing I’ll say is, in terms of the infrastructure bill, I know that many people might say that money is already at the city and state level. My relationships and how I’ve come up through the community and through the ranks, they’re very strong. So working with people at every level of government to ensure that we know where those dollars and resources are going is something that I think I’ll be very effective at.Mara Gay: Councilwoman, inflation is hitting Americans hard. But as you know, in this district, the primary driving factor for cost of living is housing. What would you do as a member of Congress to address the cost of housing in New York?Well, housing is one of my signature issues. I am someone who I feel has maybe taken unpopular stances on housing, because I feel a few things are incredibly important. Stable housing is what has brought me right before you here today, growing up in Section 8 and having a roof over my head — again, something stable.I think there are good pieces of legislation to explore in Congress. The Home[s] Act, looking at linking federal dollars to maybe how we can change some zoning laws that have been quite restrictive. I took a local position on that that I thought was important. And trying to bring housing to a transit-rich area, which hadn’t really been done in rezonings before. But bringing those federal dollars in building housing — because right now, our supply does not meet our demand — to me is one of the most important things that we should be doing as representatives.And I’ll add to that something like the Green New Deal for public housing is something I’m also very passionate about, because just in the council, I represent the third highest concentration of public housing families. But there will also be even more developments and more families in N.Y.10 who will need representation — good, strong representation. And my story of my mom growing up in Farragut Houses and my dad growing up in Seward Park Extension, this is where I’ve spent the majority of my time. And this is certainly something that I’ll be looking to do.Mara Gay: And what tough vote that you took on housing — could you name one for us, since you said it was something that you could get tough votes on?Well, I’ll tell you, the SoHo, NoHo rezoning maybe didn’t make me the most popular, but I think it was the right thing to do. I’m glad that we saw it through. I’m someone that digs in deep, fights, negotiates and comes to a compromise. And I thought that ultimately, that was the right decision to make.Mara Gay: You voted for it?Absolutely.Mara Gay: For the record. Thanks.Jyoti Thottam: Hi, Councilwoman. So, just moving big picture for a minute to the threats to our democracy, what do you think Democrats in Congress could do, should be doing, to protect democracy and secure voting rights, et cetera?I think for many people — people are losing faith in their government. I think that that is maybe at an all-time high right now. I think how we restore people’s faith or trust in government is to deliver on the things that we’re fighting for.And so that is, again, those tangible things that you can see. I also think — well, we must try to expand voting rights in every which way possible, clearly making sure that, again, those people that have been historically disenfranchised, whether it’s same-day registration, automatic registration, being engaged, civically engaged, with people and starting that very, very young. Civics and education, I think, is also really important. So fighting for that, while also understanding that I think we should be looking to achieve progress wherever and however possible. And that’s something that I’m looking forward to doing and working with my colleagues.Patrick Healy: Councilwoman, do you think that Democratic elected officials are out of step at all with Democratic voters on immigration, on L.G.B.T.Q. rights, on any issue out there? As you talk to voters and hear the conversation, how does that compare with how elected officials talk about some of these things?I do feel there are almost two schools of Democrats. And there are very ideological representatives. And then there are sort of these individuals that are more kind of like old school, let’s not let the perfect be the enemy of the good.I would say that what I think would make me a successful congresswoman is that I feel like I have my foot in both. I’m going to go for the big fights, the Green New Deal and the Medicare for All. But I’m also going to do my best to deliver as much as I can. I don’t think “incremental” is a bad word, but however and wherever possible we can achieve progress. And I’m excited because I’ll be going into the delegation with relationships with some of the reps that will be there. And I’ll be working hard to deliver.Eleanor Randolph: So we have a couple of yes-or-no questions. And you’ve touched on one. But if you don’t mind, we’ll just go through them. One, would you favor expanding the Supreme Court?Yes, I can expand it —Mara Gay: One-word answers would be great.Yes!Eleanor Randolph: What about ending the filibuster?Yes.Eleanor Randolph: What about term limits for members of Congress?Yes. Oh, wait a minute. Hold on. You said term limits for members of Congress?Eleanor Randolph: Yes.No.Eleanor Randolph: No. OK, what about an age limit for members of Congress?No.Eleanor Randolph: And should President Biden run again?Yes.Eleanor Randolph: OK. Thank you.I was thinking about it. I just answer [inaudible].Alex Kingsbury: I’d like to ask you about Ukraine. I’m wondering if there should be an upper limit on the amount of taxpayer dollars that we spend on that conflict, and if we should attach any sort of conditions to the money that we’re sending to Ukraine.I have been unapologetic about my support for Ukraine. I represent Little Ukraine in the East Village. And that situation is felt abroad and here at home. I have tried in my capacity in the city to ensure that people understand that they have someone who knows this is a very comprehensive issue in terms of what people’s needs are and how we are open to accepting refugees and families that will be coming here because of that relationship between Ukrainians and New York City and in Ukraine. We are providing the appropriate amount of funding right now, and I do not see any conditions at the moment to attach to that.Nick Fox: What do you think are the specific climate policies and plans that the Democrats should prioritize now?[The Senate passed the climate, health and tax bill on Aug. 7 and the House on Aug. 12, both after this interview took place.]Specific climate policies and plans. Before I ever decided to run for public office, I was in New York City for Hurricane Sandy. That was eight feet of water on Avenue C, where I have spent my life. This is an issue not for tomorrow. It is for today.And I’m going to — hopefully, as the next congresswoman for New York 10 — represent low-lying communities that are the majority disproportionately Black, brown families that live in public housing. I feel we need a full-court press on climate. I realize that it is going to be incredibly difficult when environmental policies and protections are pulled from legislation, and there was an actual weakening of the E.P.A. I realize the challenges that are in front of us.I do feel that where we should focus our federal resources is on resilient infrastructure and the creation of very good green jobs. That is something I think can be a bipartisan effort and that I can be effective in advocating for, because of the nature of the district that I’ll be representing and because of my personal and professional experience in addressing this issue.Mara Gay: Thank you. What further action can Congress take on gun violence?Gun violence is clearly — I think it’s a public health crisis. What we have seen happen in my district and even in my own community where I grew up, even previous to the SCOTUS decision, some of the strongest gun control laws in the country in New York State, still these guns were reaching our communities, and people are dying.What I think we can do is a few things. One is try to move forward, even on some of what was just accomplished very, very recently by Congress. And utmost respect to how we were able to move that. But right now it is such an urgent crisis that I felt that it was overdue. But I’m glad that it happened.What I’m seeing in my own district and in my time in the city is being able to identify what is working. So we have to invest: mental health programs, housing, education, work force development, ensuring that young people know that we are supporting them. And we also should be investing in programs that I’ve seen as the chair of the Committee on Hospitals in my last term, in programs like Stand Up to Violence, at Jacobi and Lincoln Hospital, that are using credible messengers and people from the community to go meet gun violence victims where they’re at in the emergency rooms and have really tough conversations about what is transpiring locally.I think that is a successful program. It should be expanded, as well as comprehensive and complementary strategies to law enforcement, and trying to ensure that we are establishing what should be a mutually respectful relationship between community and police.Mara Gay: And could you just name one action that you would take as a member of Congress on abortion rights, to protect abortion rights?As a member of Congress to protect abortion rights. Well, we have to end the filibuster to codify Roe. I would say we should work to expand access to medication abortion. I’ve passed that bill. I think it could be an example, a model, for other places across the country, and we should be providing funding to provide those services.Especially, we’ve done that here in New York, establishing the nation’s first abortion access fund, which has become a model already for other cities. I think that that should continue in terms of funding to places, especially those states that are adjacent to and nearby the states with outright restrictions or bans.[Abortion activists believe that New York’s abortion access fund marked the first time cities directed money to abortions specifically.]Mara Gay: Thank you.Kathleen Kingsbury: What should Congress do to address the increasing threat of domestic terrorism?Well, I feel we have a very sort of unique opportunity right now to put members of Congress in who understand that domestic terrorism, white supremacy, are issues right now that are destroying our communities. And we have to have a very, very serious conversation at every level of government, explore legislation, and really try to address that there are many things that I think are fueling domestic terrorism and white supremacy, antisemitism, gun violence, hateful and bigoted rhetoric, and using our platforms to really also speak out against a lot of the things that are transpiring in our communities that are divisive and that are violent.Mara Gay: We have a lightning round, a little pop quiz for you.OK.Mara Gay: How does Plan B work?Plan B is, you could actually buy it over the counter when you walk into the CVS.Mara Gay: How does the medication work in the body?The Plan B?Mara Gay: Mm-hmm.Orally? I want to be the candidate for the people that love New York City.Mara Gay: Your objection is noted.Kathleen Kingsbury: In the council, you’ve pushed hard for deep cuts to the N.Y.P.D. Do you support the defund movement? And what do you say to voters who are concerned about public safety right now?Public safety is actually a topic that does come up very, very frequently on the streets when I’m talking to voters. I believe that we need to have these sort of complementary strategies to law enforcement. And what I mean by that is I do believe that the safest communities are the ones that are invested in.And so I can tell you, as someone who is from New York — though I want to build a future for anyone coming to this city, a future that people can see themselves in — but being from New York, I can tell you that the East Village is very different from the West Village and that Park Slope is very different from Sunset Park.The resources there, the presence of police, and I feel that sort of relationship can sometimes fall a little different. And so for me, I believe that we need equitable funding to all of our agencies and that we really have to fund what I call the four basics, first and foremost, which are housing, education, health care and food. That is what I convey over and over again to people.And as an elected official, I do my very best to have good relationships with my local precincts and try to work as respectfully and as collaboratively as possible.Kathleen Kingsbury: Jyoti?Nick Fox: Yeah, you’ve spoken out —Jyoti Thottam: Nick, yeah, go ahead.Nick Fox: Spoken out extensively on the need to support public housing. The region doesn’t have enough housing supply in general. What can Congress do to help? And do you think, like others in this race, that the residential tower at 130 Liberty Street in Lower Manhattan should be 100 percent affordable?Some call that 5 World Trade Center. So, all right, so there’s two questions there. One is, what do we think Congress can do? Yes, I’ve spoken extensively on public housing, because I feel it is that important. Just in New York City, it is a $40 billion challenge that is not even looking at the rest of the public housing across the country. I’m speaking exclusively to New York City.I also know that, again, we do not have enough supply to meet the demand. And right now, when you need 5,000 there — the average median rent is $5,000 — you need a six-figure job to keep up with monthly expenses. That is becoming increasingly difficult for people to be able to see their future in New York City.What we can do, I mentioned a few pieces of legislation that I thought were important. I mentioned the Green New Deal for public housing. I mentioned the Home Act. There is also another piece of legislation called Yes in My Backyard.There are a few pieces there that I feel, in terms of linking — some things that we should explore — linking federal resources to perhaps looking at how we make zoning less restrictive. In the case of 5 World Trade or Liberty Street, what they’re describing right now is that everyone wants 100 percent affordable housing everywhere. I feel mixed-income housing — and again, affordable housing has different levels, and so we need low and moderate and middle.I think that is really, really important to have that integration, and it’s also had proven outcomes for people who live in these mixed communities. To put $500 million into one tower for 900 — for lottery units that we’re not even sure how deep the [area median income] will be, to me, could be a decision that is not reflective of being equitable at where we’re putting resources to build affordable housing.Mara Gay: Thank you. Let’s talk about your path to victory a little bit. It’s obviously an exceptionally crowded race. The two-part question was, what is your path to victory? And the second part of the question is, what will be the determining factor in who emerges victorious in this primary? Is it a union? Is it a ground game? Is it how much money you have in the bank? What is it?I think to win this race — and I feel like I am uniquely positioned to do it because of my roots, because of the relationships that I have, and that people know me in the community, and they know me in this district — to win, you certainly need to be funded, and you need a good ground game. So you need a combination.For me, having the validators that I do have is the coalition I’m building in terms of supporters, including an early endorsement from Nydia Velázquez, was really important. Over 45 percent of her old district is in the new N.Y.10. And people know her. She’s a fighter. And so having that was critical.Having good support, whether it’s council members, labor, I think just for me, I have community leaders, P.T.A. presidents, disability advocates, and NYCHA tenant association leaders, district leaders, state committee people. I think that group of people — who understand the issues, who know who I am, who know my drive — that is what’s going to get me to the finish line. Ultimately, I would say it is having a fully funded campaign and a good ground game. And I think I’m the only candidate that has both.Mara Gay: Thank you.Patrick Healy: You live in Manhattan, but the majority of voters in the district live in Brooklyn. Why are you the best person to represent this district?Well, I’ve had all my most, I would say, my most important memories and milestones in this district. So my mom grew up in Brooklyn. My dad grew up in the L.E.S. And I like to say I’m the best of both boroughs.And I grew up going to the matinee at Cobble Hill. It was $2 on Sunday. It was like the best memory with me, my mom and my sister. I grew up bowling at Melody Lanes in Sunset Park, and I am the kid that grew up swimming in Carmine Pool and Ham Fish and playing ball at the Cage.So, for me, this district was built for me. It was made for me. And I think the responses that I’m getting from the people that live there are a testament to that.Kathleen Kingsbury: Great. So one of the first bills I passed was to regulate illegal hotels, which were taking on Airbnb when they were — it’s pretty much removing units from the affordable housing stock. That has actually been enforced, and the mayor just did a press conference just a couple of weeks ago on how the Office of Special Enforcement was actually putting it into action, and it was working. One other bill I’d like to mention is my first bill, which is actually to codify sexual harassment as a form of discrimination. That was incredibly important.And the last bill I’ll mention was the most recent, which was to make medication abortion available at city-run health clinics. And just one bonus is bicycle — to actually provide a detour when there is on-site street work or construction — to provide a detour for bicycle lanes.     California’s Housing Crisis Looms Large for Gavin Newsom

    Having survived a recall vote, the governor is free to focus on the state’s homeless population and housing shortage. He has more room to maneuver than he did when he first took office.The median home price in California has eclipsed $800,000. Tenants in the state are among the most cost-burdened in the country. Each night more than 100,000 residents sleep outside or in their cars. A crisis, a disaster, the religion of sorrow, a disgrace — whatever journalists and politicians call it, people across the state, including all the major candidates for governor in the recall vote this week, agree that the situation is untenable.The question is what, if anything, the governor can do about it. It’s something that Gov. Gavin Newsom has spent the past three years talking about. And now that he has won a decisive victory in the recall election, which cost close to $300 million and consumed the state’s and governor’s attention for several months, Mr. Newsom is turning his attention back to problems like housing.In many ways the answer there is different from what it was when he took office in 2019.Right now the focus is Senate Bill 9, which would allow duplexes in neighborhoods throughout the state and is one of the hundreds of unsigned bills that piled up on Mr. Newsom’s desk during the recall campaign. But even if Mr. Newsom signs it, which he is widely expected to do in the coming days, his legacy on housing is likely to be less about laws passed on his watch than his administration’s ability to enforce them. That’s because the executive branch has gained much more power over state housing policy than it had even a few years ago, after years of state frustration with how difficult the local governments make it to build housing in California.Mr. Newsom’s administration has come to embrace the role, taking action like suing cities for not building enough to keep up with population growth and creating a team to ensure that cities approve new housing. The moves are part of a nationwide shift in power — away from city councils and toward statehouses — over the $1 trillion annual residential construction market.“It used to be that housing was run by the local planning departments and California governors didn’t really pay attention,” said Ben Metcalf, managing director of the Terner Center for Housing Innovation at the University of California, Berkeley. “That has changed.”Mr. Newsom, a Democrat, has tried to get through the pandemic emergency by extending the state’s eviction moratorium even as the federal one lapsed, and pouring money from the state’s budget surplus and various coronavirus relief packages into homeless funding and programs like an effort to turn hotels into supportive housing.But California remains one of the most difficult places in America to build housing, causing a supply-and-demand imbalance. It is the leading edge of a nationwide problem that is pricing middle-income families out of ownership and has one in four rental households paying more than half its pretax income on rent.A polling site in El Centro, Calif., on Tuesday, when a statewide vote kept Gov. Gavin Newsom in office.John Francis Peters for The New York TimesPlanners, economists and both political parties have long called for states to use their power to ease the housing shortage by breaking local logjams. They point out that suburban governments have little incentive to fix the problem since they are accountable to homeowners who prefer that prices only go up. That conundrum has vexed would-be housing reformers since at least the 1970s, and emerged during California’s recall campaign in the Republican debates, where candidates talked a lot about adding more housing but shied away from discussions of where that housing would go.These often contradictory comments were a perfect encapsulation of Californians’ mood: They are universally unhappy with the state’s cost of living and the tent cities that have appeared along freeways, in parks and on beaches. But homeowners remain fiercely protective of their power to say what gets built near them. Kevin Faulconer, a former San Diego mayor and a Republican candidate in the recall election, all but ran away from his own pro-density policies in California’s second-largest city by saying, “When we see some of these pieces of legislation that want to eliminate single-family zoning in California, that’s wrong.”Mr. Newsom has tried to walk this same line. In 2018, he campaigned on a “Marshall Plan for housing” that had a goal of delivering 3.5 million new housing units by 2025. He came to regret the figure once he was in the governor’s chair, and it became fodder for his leading recall opponent, the talk show host Larry Elder, who seized on it as an example of broken promises. Mr. Elder did not need sophisticated research to find fault with the number: In a state that permits around 100,000 housing units a year, delivering 3.5 million — 35 years of housing at the current pace — is close to a physical impossibility.Mr. Newsom has been mostly quiet about big zoning legislation ever since. He did not take a position on Senate Bill 50, a contentious measure that would have allowed apartment buildings in neighborhoods across the state. And he was largely quiet about Senate Bill 9 as it passed through both houses of the State Legislature and lingered on his desk.Mr. Newsom, at a rally on Monday in Long Beach, Calif., has emphasized enforcement of existing housing laws.Doug Mills/The New York TimesWhat he has done instead is enforce existing laws more aggressively than his predecessors did. Two weeks after Mr. Newsom assumed office, California’s attorney general sued Huntington Beach for failing to plan for sufficient new housing. Since then, the state’s Department of Housing and Community Development has sent hundreds of letters telling cities to change or simplify their planning codes to comply with state law.The governor’s most recent budget allocated $4.3 million to staff a “housing accountability unit” made up of planners and lawyers who will monitor local governments’ housing decisions and intervene when they’re not following state law.Zoning defines a neighborhood’s physical character and who might be living next door, so it has captured most of the attention in California’s housing debate. But over the past few years, the Legislature quietly passed a slew of smaller measures that when strung together have radically changed the relationship between state and local government. The new rules change how much housing cities have to plan for, make it harder for them to stop developers from building and ultimately deprive them of funding and local control if they drift too far from state mandates.Because they transfer more oversight of housing from localities to Sacramento, the question of how aggressively those laws are enforced has fallen to the executive branch. It’s one thing for the state to pass laws to desegregate neighborhoods, set aside more land for subsidized housing and require cities to permit backyard cottages. If enforcing them isn’t a priority — which has long been the case with housing laws — they are bound to be ignored.In an interview after the recall vote, Jason Elliott, a senior counselor to Mr. Newsom who works on housing policy, rattled off a series of bill numbers and the esoteric text of planning codes to point out dozens of housing regulations that remain mostly unused. Environmental measures that support increasing density to reduce car trips. Various laws allowing backyard units. A way for developers to sue cities that don’t follow their own zoning rules. These are the types of statutes the new housing accountability unit will try to enforce.“I’m never going to say we’re done passing laws and we can’t do more,” Mr. Elliott said. “But what we really need to do if we want to see units spring up is get several dozen people thinking about this and only this, and empower them to reach out to cities.”Will Mr. Newsom ever get anywhere near 3.5 million new units? No. Even if it were politically possible, it would strain lumber and labor supplies.It took California several decades to get into a housing crisis this bad. Lofty rhetoric and promises for millions of units make do for a campaign slogan, but the reality looks more like a process of slowly digging out. More

    Should Biden Emphasize Race or Class or Both or None of the Above?

    Should the Democratic Party focus on race or class when trying to build support for new initiatives and — perhaps equally important — when seeking to achieve a durable Election Day majority?The publication on April 26 of a scholarly paper, “Racial Equality Frames and Public Policy Support,” has stirred up a hornet’s nest among Democratic strategists and analysts.The authors, Micah English and Joshua L. Kalla, who are both political scientists at Yale, warned proponents of liberal legislative proposals thatDespite increasing awareness of racial inequities and a greater use of progressive race framing by Democratic elites, linking public policies to race is detrimental for support of those policies.The English-Kalla paper infuriated critics who are involved in the Race-Class Narrative Project.The founder of the project, Ian Haney López, a law professor at Berkeley and one of the chairmen of the AFL-CIO’s Advisory Council on Racial and Economic Justice, vigorously disputes the English-Kalla thesis. In his view, “Powerful elites exploit social divisions, so no matter what our race, color or ethnicity, our best future requires building cross-racial solidarity.”In an email, López wrote me that the English and Kalla studyseems to confirm a conclusion common among Democratic strategists since at least 1970: Democrats can maximize support among whites, without losing too much enthusiasm from voters of color, by running silent on racial justice while emphasizing class issues of concern to all racial groups. Since at least 2017, this conclusion is demonstrably wrong.English and Kalla, for their part, surveyed 5,081 adults and asked them about six policies: increasing the minimum wage to $15; forgiving $50,000 in student loan debt; affordable housing; the Green New Deal; Medicare for All; decriminalizing marijuana and erasing prior convictions.Participants in the survey were randomly assigned to read about these policies in a “race, class, or a class plus race frame,” English and Kalla write.Those given information about housing policy in a “race frame” read:A century of housing and land use policies denied Black households access to homeownership and neighborhood opportunities offered to white households. These racially discriminatory housing policies have combined to profoundly disadvantage Black households, with lasting, intergenerational impact. These intergenerational impacts go a long way toward explaining the racial disparities we see today in wealth, income and educational outcomes for Black Americans.Those assigned to read about housing policy in a “class frame” were shown this:Housing is the largest single expense for the average American, accounting for a third of their income. Many working-class, middle-class, and working poor Americans spend over half their pay on shelter. Twenty-one million American families — over a sixth of the United States — are considered cost-burdened, paying more for rent than they can afford. These families are paying so much in rent that they are considered at elevated risk of homelessness.The “race and class group” read a version combining both race and class themes.English and Kalla found thatWhile among Democrats both the class and the class plus race frames cause statistically significant increases in policy support, statistically indistinguishable from each other — among Republicans the class plus race frame causes a statistically significant decrease in policy support. While the race frame also has a negative effect among Republicans, it is not statistically significant.Among independents — a key swing group both in elections and in determining the levels of support for public policies — English and Kalla found “positive effects from the class frame and negative effects from both the race and class plus race frames.”A late February survey of 1,551 likely voters by Vox and Data for Progress produced similar results. Half the sample was asked whether it would support or oppose zoning for multiple-family housing based on the argument thatIt’s a matter of racial justice. Single-family zoning requirements lock in America’s system of racial segregation, blocking Black Americans from pursuing economic opportunity and the American dream of homeownership.The other half of the sample read that supporters of multiple-family zoningsay that this will drive economic growth as more people will be able to move to high opportunity regions with good jobs and will allow more Americans the opportunity to get affordable housing on their own, making it easier to start families.The voters to whom the racial justice message was given were split, 44 in support, 43 in opposition, while those who were given the economic growth argument supported multiple-family zoning 47-36.After being exposed to the economic growth message, Democrats were supportive 63-25, but less so after the racial justice message, 56-28. Republicans were opposed after hearing either message, but less so in the case of economic growth, 35-50, compared to racial justice 31-60.López founded the Race-Class Narrative Project along with Anat Shenker-Osorio, a California-based communications consultant, and Heather McGhee, a former president of Demos, a liberal think tank and author of the recent book, “The Sum of Us: What Racism Costs Everyone and How We Can Prosper Together.”I asked López about the English-Kalla paper. He was forthright in his emailed reply:As my work and that of others demonstrates, the most potent political message today is one that foregrounds combating intentional divide-and-conquer racial politics by building a multiracial coalition among all racial groups. This frame performs more strongly than a class-only frame as well as a racial justice frame. It is also the sole liberal frame that consistently beats Republican dog whistling.Shenker-Osorio faulted English and Kalla’s work for being “unsurprising”:If you tell someone to support a policy because it will benefit a group they’re not part of, and that doesn’t work as well as telling them to support a policy they perceive will help them — this isn’t exactly shocking.Testing the effectiveness of messages on controversial issues, Shenker-Osorio continued, has to be done in the context of dealing with the claims of the opposition:Politics isn’t solitaire and so in order for our attempts to persuade conflicted voters to work, they must also act as a rebuttal to what these voters hear — incessantly — from our opposition. A class-only message about, say, minimum wage, held up against a drumbeat of “immigrants are taking your jobs” or racially-coded caricatures of who is in minimum wage jobs doesn’t cut through. Neither does a message about affordable housing credits or food stamps when the opposition will just keep hammering home the notion of “lazy people” wanting “handouts.”Unless Democrats explicitly address race, Shenker-Osorio wrote, millions of whites, flooded with Republican messages demonizing minorities, will continue to beprimed to view government as taking from “hard working people” (coded as white) and handing it to “undeserving people” (coded as Black and brown). If we do not contend with this basic fact — and today’s unrelenting race baiting from the right — then Nixon’s “Southern Strategy” will simply continue to haunt us. In other words, if the left chooses to say nothing about race, the race conversation doesn’t simply end. The only thing voters hear about the topic are the lies the right peddles to keep us from joining together to demand true progressive solutions.The Race-Class Narrative Project, which has conducted extensive surveys and focus groups, came to the conclusion that race could effectively be addressed in carefully worded messages.For instance:No matter where we come from or what our color, most of us work hard for our families. But today, certain politicians and their greedy lobbyists hurt everyone by handing kickbacks to the rich, defunding our schools, and threatening our seniors with cuts to Medicare and Social Security. Then they turn around and point the finger for our hard times at poor families, Black people, and new immigrants. We need to join together with people from all walks of life to fight for our future, just like we won better wages, safer workplaces, and civil rights in our past.The race-class project also tested the efficacy of a class only message — “We need elected leaders who will reject the divide and conquer tactics of their opponents and put the interests of working people first” — versus a race and class message that simply added the phrase “whether we are white, Black or brown” to read:We need elected leaders who will reject the divide and conquer tactics of their opponents and put the interests of working people first, whether we are white, Black or brown.The result? The race and class message did substantially better than the class alone message among both base Democratic voters and persuadable voters. Base Democrats approved of the class message 79-16 and approved of the race and class message 86-11. Fewer persuadable voters approved of the class message than disapproved, 42-45, while more approved than disapproved of the race and class message, 48-41.I asked Shenker-Osorio how well she thinks Biden is doing when he talks about race:It’s definitely hit or miss. Sometimes he uses what I shorthand as “dependent clause” messaging where you name race after you’ve laid out an economic problem or offered an economic solution — e.g. “It’s getting harder for people to make ends meet, and this impacts [X Group] in particular.” This doesn’t work. For many people of color, this feels like race is an afterthought. For many whites, it feels like a non sequitur.At other times, Shenker-Osorio continued, Bidendoes what we’ve seen work: begin by naming a shared value with deliberate reference to race, describe the problem as one of deliberate division or racial scapegoating, and then close with how the policy he is pushing will mean better well-being or justice or freedom for all working people.In partial support of the Shenker-Osorio critique, Jake Grumbach, a political scientist at the University of Washington, emailed me to say:The English and Kalla survey experiment was done in a particular context that did not include Republican messaging, media coverage and imagery, and other content that “real-world” politics cannot escape. If Republicans use race, whether through dog whistles or more overt racism, then it might be the case that Democratic “class only” appeals will fall flat as voters infer racial content even when Democrats don’t mention race.Another “important piece of context,” Grumbach wrote, “is that Biden is an older white man, which, research suggests, makes his policy appeals sound more moderate to voters than the actually more moderate Obama proposals.” More

    If you care about social justice, you have to care about zoning.Housing segregation by race and class is a fountainhead of inequality in America, yet for generations, politicians have been terrified to address the issue. That is why it is so significant that President Biden has proposed, as part of his American Jobs Act, a $5 billion race-to-the-top competitive grants program to spur jurisdictions to “eliminate exclusionary zoning and harmful land use policies.”Mr. Biden would reward localities that voluntarily agree to jettison “minimum lot sizes, mandatory parking requirements and prohibitions on multifamily housing.” The Biden administration is off to an important start, but over the course of his term, Mr. Biden should add sticks to the carrots he has already proposed.Although zoning may seem like a technical, bureaucratic and decidedly local question, in reality the issue relates directly to three grand themes that Joe Biden ran on in the 2020 campaign: racial justice, respect for working-class people and national unity. Perhaps no single step would do more to advance those goals than tearing down the government-sponsored walls that keep Americans of different races and classes from living in the same communities, sharing the same public schools and getting a chance to know one another across racial, economic and political lines.Economically discriminatory zoning policies — which say that you are not welcome in a community unless you can afford a single-family home, sometimes on a large plot of land — are not part of a distant, disgraceful past. In most American cities, zoning laws prohibit the construction of relatively affordable homes — duplexes, triplexes, quads and larger multifamily units — on three-quarters of residential land.In the 2020 race, Mr. Biden said he was running to “restore the soul of our nation,” which had been damaged by President Donald Trump’s embrace of racism. Removing exclusionary barriers that keep millions of Black and Hispanic people out of safe neighborhoods with strong schools is central to the goal of advancing racial justice. Over the past several decades, as the sociologist Orlando Patterson has noted, Black people have been integrated into the nation’s political life and the military, “but the civil-rights movement failed to integrate Black Americans into the private domain of American life.”Single-family exclusive zoning, which was adopted by communities shortly after the Supreme Court struck down explicit racial zoning in 1917, is what activists call the “new redlining.” Racial discrimination has created an enormous wealth gap between white and Black people, and single-family-only zoning perpetuates that inequality.While exclusionary zoning laws are especially harmful to Black people, the discrimination is more broadly rooted in class snobbery — a second problem Mr. Biden highlighted in his campaign. As a proud product of Scranton, Pa., Mr. Biden said he would value the dignity of working people and not look down on anyone. The elitism Mr. Biden promised to reject helps explain why in virtually all-white communities like La Crosse, Wis., efforts to remedy economic segregation have received strong pushback from upper-income whites, and why middle-class Black communities have sometimes shown fierce resistance to low-income housing.If race were the only factor driving exclusionary zoning, one would expect to see such policies most extensively promoted in communities where racial intolerance is highest, but in fact the most restrictive zoning is found in politically liberal cities, where racial views are more progressive. As Harvard’s Michael Sandel has noted, social psychologists have found that highly-educated elites “may denounce racism and sexism but are unapologetic about their negative attitudes toward the less educated.” Class discrimination helps explain why, despite a 25 percent decline in Black-white residential segregation since 1970, income segregation has more than doubled.By addressing a problem common to America’s multiracial working class, reducing exclusionary barriers could also help promote Mr. Biden’s third big goal: national unity. Today, no two groups are more politically divided from each other than working-class whites and working-class people of color. For centuries, going back to Bacon’s Rebellion in 1676, right-wing politicians have successfully pitted these two groups against each other, but every once in a while, America breaks free of this grip, and lower-income and working-class people of all races come together and engage in what the Rev. William Barber II calls “fusion politics.”It happened in 1968, when Mr. Biden’s hero Robert Kennedy brought together working-class Black, Latino and white constituencies in a presidential campaign that championed a liberalism without elitism and a populism without racism. It happened again in 1997 and 2009 in Texas, when Republican legislators representing white working-class voters and Democrats representing Black and Hispanic constituencies came together to support (and then to defend) the Texas top 10 percent plan to admit the strongest students in every high school to the University of Texas at Austin, despite the opposition of legislators representing wealthy white suburban districts that had dominated admissions for decades. And a similar coalition appears to be coming together in California, over the issue of exclusionary zoning. State Senator Scott Wiener, who has been trying to legalize multifamily living spaces, told me that Republican and Democratic legislators representing working-class communities have supported reform, while the opponents have one thing in common: They represent wealthier constituents who “wanted to keep certain people out of their community.” More

Economists from across the political spectrum agree that zoning laws that ban anything but single-family homes artificially drive up prices by limiting the supply of housing that can be built in a region. At a time when the Covid-19 pandemic has left many Americans jobless and people are struggling to make rent or pay their mortgages, it is incomprehensible that ubiquitous government zoning policies would be permitted to make the housing affordability crisis worse by driving prices unnaturally higher.
