    Suzanne Scott’s Vision for Fox News Gets Tested in Court

    Suzanne Scott remade Fox News Media into a lucrative consumer brand. But a $1.6 billion defamation suit against the company is testing her strategy and leadership.Before the committee investigating the Jan. 6 insurrection held its first prime-time hearing in June, Suzanne Scott, the chief executive of Fox News Media, called Lachlan Murdoch, her boss, to tell him how her network planned to broadcast the event.They wouldn’t, she said. The channel would stick with its usual prime-time lineup of Tucker Carlson, Sean Hannity and Laura Ingraham. Mr. Murdoch, the executive chairman of Fox Corporation, was fine with Ms. Scott’s decision, according to an executive with knowledge of their conversation.As a business move, Ms. Scott’s call was the right one for Fox News in the end. As many viewers tuned in as they would on a regular night. And Fox still managed to best CNN in the ratings.The decision was true to form, according to interviews with more than a dozen current and former colleagues. Since Ms. Scott took over the top job at Fox News in 2018, her colleagues said, she has managed from behind the scenes with a simple mantra: Respect Fox’s audience. Often, that involves sparing conservative viewers what they don’t want to hear — even when that means ignoring one of the biggest stories of the year.That strategy has helped Fox News succeed not just as the most-watched cable news network in the country but also as a multibillion-dollar consumer brand with a suite of businesses that, according to a recent company promo for one product, offers fans “The World According to Fox.” In addition to the Fox News and Fox Business cable channels, Ms. Scott has introduced Fox News Books, a publisher of meditations on Christianity; Fox Nation, a $5.99-per-month streaming service that produces a reboot of “Cops” and an original special from Mr. Carlson, “The End of Men,” that purports to explore a nationwide decline in testosterone rates; and Fox Weather, a new app and cable channel.Ms. Scott told her boss, Lachlan Murdoch, right, that the network wouldn’t broadcast the first Jan. 6 prime-time hearing in June. Trump.According to several people closely involved in the case, lawyers for Dominion are expected to depose her soon. A judge has granted Dominion access to her emails and text messages from the period after the 2020 election when Fox anchors and guests amplified some of the most outrageous falsehoods about Dominion and its supposed role in a plot to steal the election.So far, those messages contained at least one instance in which Ms. Scott expressed skepticism about the dubious claims of voter fraud that her network had been promoting, a recent court proceeding revealed.     Groups Saturate TV With Negative Ads About Warnock and Walker

    ATLANTA — Democratic and Republican groups in Georgia are spending millions of dollars on highly personal negative advertising in the final weeks of the race between Senator Raphael Warnock and his challenger, Herschel Walker, disparaging the candidates by drawing more attention to their pasts.Days before the candidates are set to meet on a debate stage, groups aligned with each party are flooding the airwaves with a pair of ads that underline accusations of domestic violence against Mr. Walker, a Republican, and marital disputes involving Mr. Warnock, a Democrat. Their messages are shaping the final few weeks of campaigning in one of the country’s most closely watched races that could determine control of the Senate, and at times one of the most hostile.The advertising back-and-forth follows more than a week of negative headlines focused largely on Mr. Walker. After The Daily Beast first reported that Mr. Walker paid for a woman’s abortion, The New York Times confirmed the report and learned that the woman had ended their relationship after she refused to have a second abortion despite Mr. Walker’s urging.Now, as Democrats spend big to elevate those claims, Republicans are hitting back to paint Mr. Warnock as a candidate also plagued by scandal.A PAC supporting Mr. Walker, 34N22, is spending $1.5 million on an advertisement that shows footage from a police body camera after a 2020 incident between Mr. Warnock and his ex-wife, Ouleye Ndoye, who claims in the video and ensuing police report that he ran over her foot. Paramedics on the scene were unable to locate evidence of physical injury to Ms. Ndoye’s foot. Mr. Warnock was not charged with a crime.“I just can’t believe he would run me over,” she says through tears. “I’ve tried to keep the way that he acts under wraps for a long time, and today he crossed the line. So that is what is going on here, and he is a great actor. He is phenomenal at putting on a really good show.”The Democratic-aligned groups Georgia Honor and Senate Majority PAC are spending a combined $36 million to dominate the airwaves with anti-Walker advertising, including an advertisement that takes lines from a tweet that Mr. Walker’s son Christian Walker posted after the initial reports about his father’s paying for the abortion. In it, he accused Mr. Walker of domestic abuse against him and his mother, Cindy Grossman.A voice-over on the ad repeats the accusation as similar text flashes on the screen: “He threatened to kill us and had us move six times in six months running from his violence.” The ad also shows pictures of a police report that outlines an episode in which Mr. Walker arrived at Ms. Grossman’s home with a gun.“Six moves in six months running from Herschel Walker’s violence,” the voice-over says again against footage of an empty apartment and moving boxes.Mr. Walker and Mr. Warnock will debate in Savannah, Ga., on Friday.     TikTok Bans Political Fund-Raising Ahead of Midterms

    Less than two months before the midterm elections, TikTok is blocking politicians and political parties from fund-raising on its platform.In a blog post on Wednesday, the social media platform said it would prohibit solicitations for money by political campaigns. The company said political accounts would immediately lose access to advertising features and monetization services, such as gift giving, tipping and e-commerce capabilities.Over the next few weeks, TikTok will clamp down on politicians’ posting videos asking for donations, or political parties’ directing users to online donation pages, the company said.Accounts run by government offices will be slightly less restricted. TikTok said such accounts would be allowed to advertise in limited circumstances, such as when running educational campaigns about Covid-19 booster shots. But the people operating those accounts must work with someone from the company to run that kind of campaign.The new rules will help enforce a ban on political advertising that TikTok, known for its short videos and younger-skewing audience, first put in place in 2019.The company, which has more than a billion monthly users globally, continues to describe itself as “first and foremost an entertainment platform,” but the platform is increasingly drawing political content. Researchers who track online falsehoods say TikTok is on its way to becoming a major hub of political misinformation, fueled by the same qualities that make consumer products and dance videos go viral on the platform.In a campaign season already marked by conspiracy theories and aggressive rhetoric, TikTok has announced several steps to try to civilize and secure its platform. In August, the company debuted an “Elections Center,” a hub on the app with information about voting curated from authoritative sources and presented in more than 45 languages.     How a Storied Phrase Became a Partisan Battleground

    A touchstone of political and social discourse, the nearly 100-year-old phrase “the American dream,” is being repurposed — critics say distorted — particularly by Republicans of color.Juan Ciscomani, a Republican who washed cars to help his Mexican immigrant father pay the bills and is now running for Congress in Arizona, has been leaning on a simple three-word phrase throughout his campaign — “the American dream.”To him, the American dream, a nearly 100-year-old idea weighted with meaning and memory, has become something not so much to aspire to but to defend from attack.President Biden and House Speaker Nancy Pelosi are, he says in one ad, “destroying the American dream” with “a border crisis, soaring inflation and schools that don’t teach the good things about America.”For decades, politicians have used the phrase “the American dream” to describe a promise of economic opportunity and upward mobility, of prosperity through hard work. It has been a promise so powerful that it drew immigrants from around the world, who went on to fulfill it generation after generation. Political figures in both parties employed the phrase to promote both their own policies and their own biographies.Now, a new crop of Republican candidates and elected officials are using the phrase in a different way, invoking the same promise but arguing in speeches, ads and mailings that the American dream is dying or in danger, threatened by what they see as rampant crime, unchecked illegal immigration, burdensome government regulations and liberal social policies. Many of these Republicans are people of color — including immigrants and the children of immigrants, for whom the phrase first popularized in 1931 has a deep resonance.To politicians of old, “the American dream” was a supremely optimistic rhetorical device, albeit one that often obscured the economic and racial barriers that made achieving it impossible for many. To the Republican candidates embracing it today, the phrase has taken on an ominous and more pessimistic tone, echoing the party’s leader, former President Donald J. But historians and other scholars warn that some Republicans are distorting a defining American idea and turning it into an exclusionary political message.“The Republican Party is using it as a dog whistle,” said Christina Greer, an associate professor of political science at Fordham University. “They are saying here is the potential of what you can have, if we can exclude others from ‘stealing it’ from you.”Republicans dispute that their references to “the American dream” promote exclusion and say they are using the phrase the same way politicians have used it for decades — to signal hope and opportunity. “I think the left is far more pessimistic than Republicans are about the American dream,” said Representative Yvette Herrell, a New Mexico Republican who is Cherokee and the third Native American woman ever elected to Congress.But this latest iteration of the dream has become a rhetorical catchall for Republicans’ policy positions.Barbara Kirkmeyer, a Republican state lawmaker in Colorado running in a heated House race, embraces the American dream as the theme of her personal story. Ms. Kirkmeyer grew up on a dairy farm, the sixth of seven children in a family that often struggled. She paid her way through college by raising and selling a herd of eight milk cows, yearlings and heifer calves.The American dream, Ms. Kirkmeyer said, was not only about economic opportunity but freedom, connecting the words with Republican opposition to Covid-related mask mandates. “I don’t see the mandates as part of the American dream,” she said. “People felt that was an infringement on their rights and personal dreams.”The earliest mention in print of the words “American dream” appears to have been in a 1930 ad for a $13.50 marked-down bed spring from an American mattress company.Historians and economists, however, credit the writer James Truslow Adams with popularizing the phrase in his best seller published a year later in 1931, “The Epic of America.” His Depression-era definition was a “dream of a land in which life should be better and richer and fuller for everyone.” To Mr. Adams, it was part of a liberal vision in which government was seen as a force to fight big business. His symbol of the American dream at the time was the Library of Congress.For decades, politicians have used the phrase the American dream to describe a promise of economic opportunity and upward mobility, of prosperity through hard work. But with the chances of owning a home diminishing after the 2008 economic crash, Democrats and Republicans once more sought to redefine it. Now, much of the phrase’s progressive history has been lost, as Republicans argue that big government is the enemy.“That has been the real shift,” said Sarah Churchwell, the author of a 2018 book, “Behold, America: The Entangled History of ‘America First’ and ‘the American Dream.’”The roots of this more conservative vision of the American dream can be traced to Ronald Reagan, who often invoked the phrase and also used it in his appeals to Latino voters, extolling family, religion and an opposition to government handouts. It was a strategy later followed by George W. Bush.“It married conservative values with economic opportunity: ‘We recognize you for your contribution to America and we will give you the opportunity to get ahead if you are willing to do the work,’” said Lionel Sosa, a retired media consultant in San Antonio who is a Republican and who created ads for Mr. Reagan and Mr. Bush.Republicans still use the American dream in the way Mr. Reagan and Mr. Bush did, underscoring a strong work ethic, Christian values and entrepreneurialism. But many Hispanic Republicans now add a harder edge — stressing that they came to the country legally, decrying “open borders” and calling for the completion of the U.S.-Mexico border wall.“In all the time we worked on it, we didn’t say anything having to do with building a wall,” Mr. Sosa said of the past messaging aimed at Hispanic Republicans. “There was no message that you have to be here legally or that if you are not here legally, we don’t want you here.”The politicization of the phrase comes as studies show the American public has become more pessimistic about achieving the American dream. Historians say that in recent years Republicans have been using the phrase far more frequently than Democrats in ads and speeches. While more than a dozen Republican candidates across the country cite the phrase in their TV ads this midterm season, only four Democrats have done so, according to AdImpact.One of the Democratic candidates who has relied on the theme in his ads is Shri Thanedar, an Indian American state lawmaker in Michigan and the Democratic nominee for a House seat. “We have ceded that ground to Republicans and other corporate politicians,” Mr. Thanedar said, referring to areluctance by some Democrats to emphasize the phrase.To Gabe Vasquez, a Democratic congressional candidate in Albuquerque, N.M., the American dream is about ensuring that the economic ladder “is there for everybody and that everyone can climb with you.”Ramsay de Give for The New York TimesGabe Vasquez, a Democrat who is facing Ms. Herrell in New Mexico in the fall, has also embraced the phrase. He tells supporters that his late grandfather — Javier Bañuelos, who taught himself to fix broken televisions with an old manual and eventually opened his own repair shop — made it possible for him to run for Congress. The American dream is not about buying a house, but ensuring that the economic ladder “is there for everybody and that everyone can climb with you,” he said.Yet even Democrats find themselves speaking of the dream as pessimistically as Republicans. Just as Republicans blame Democrats for destroying the American dream, Democrats believe the fault lies with Republicans. They say Republicans are making it harder to obtain by attacking the social safety net and blocking efforts to raise the minimum wage, and that they have co-opted the symbols of patriotism — including words like patriot — and turned them into partisan weapons.“That American dream,” Mr. Vasquez said, “is becoming a hallucination.” More

    Swiss Approve Ban on Tobacco Ads

    Health advocates have said that the legislation, which was approved in a referendum, was a significant step toward tightening the country’s loose tobacco regulations.ZURICH — Advertisements glamorizing cigarettes will soon be a thing of the past in Switzerland, after voters on Sunday overwhelmingly approved legislation forbidding tobacco companies from displaying them in public spaces.Health advocates have said that the legislation, which was approved in a referendum, was a significant step toward tightening the country’s loose tobacco regulations.“Many organizations have stepped up to the plate and advocated for a solution that prioritizes youth protection,” said Flavia Wasserfallen, a member of the Swiss National Council and a proponent of the initiative.Across much of the West, tobacco advertisements long ago fell out of favor, but they have lived on in this Alpine nation, with displays for cigarettes and e-cigarettes showing up on billboards, in movie theaters and at events like music festivals.But voters made it clear on Sunday that they were no longer interested in seeing them, and despite strong opposition from the tobacco industry and the government, the tougher regulations were approved by 56.6 percent of voters and received strong support from the country’s French- and Italian-speaking regions, despite having the country’s highest smoking rates.Steps have been taken in recent years to try to introduce tougher regulations on tobacco-related products in Switzerland. In 2015, the Federal Council, the country’s executive branch, proposed a Tobacco Products Act that would ban the sale of tobacco and related goods to minors as well as restrict advertising.Parliament eventually approved a weakened version of the bill, which forbade the sale of tobacco to those under 18 but let advertising continue mostly unimpeded.The most recent initiative was started by a group of more than 40 health organizations that formed in response to the weakening of the tobacco legislation. The revamped Tobacco Products Act, which includes the advertising-related provisions that voters approved on Sunday, is expected to come into effect in 2023.“The majority of our country has decided to correct Parliament’s decision on the Tobacco Products Act,” Hans Stöckli, who serves as the president of the committee behind the initiative, said on Sunday. Mr. Stöckli described the result as “a historic milestone” and as “a necessary step” toward improved tobacco regulation.Opponents of the measure called the tighter restrictions extreme. And while they agreed that tobacco should be age-restricted, they said that the new rules amounted to a de facto ban on a legal product because children could potentially be exposed to advertisements anywhere.Switzerland has long had a close relationship with the tobacco industry. Philip Morris and Japan Tobacco International have their international headquarters in the country, and British American Tobacco also has a strong presence.The industry employs about 4,500 people in Switzerland, according to the government, including in the production of high-tar cigarettes that are illegal to produce or sell in the European Union. Cigarettes rank with chocolate and cheese as some of the country’s leading exports.Even after the new rules take effect, Switzerland will continue to have more liberal tobacco regulations than many other countries. And it will also still not fulfill all of the requirements needed to ratify the World Health Organization’s Framework Convention on Tobacco Control, an international response to combating the tobacco epidemic, despite signing it in 2004. The United States has also not ratified the convention.Alain Berset, Switzerland’s vice president, who also serves as the country’s health minister, had opposed the initiative before the vote. But at a news conference on Sunday, he acknowledged that Swiss voters had spoken, and said that the government would move forward with the new regulations.“The Federal Council will now tackle the implementation of the initiative,” Mr. Berset said.The Tobacco Products Act was not the only issue on the ballot on Sunday. In a move that people feared could have cut Switzerland off from global medical progress, voters shot down a proposed ban on all human and animal experiments in the country.Voters also decided against providing Swiss media outlets with increased financial support, by rejecting a government proposal to extend subsidies to online media as well as to regional radio and television stations.A government-approved amendment to the federal stamp duties act that would have made it cheaper for companies to raise new capital was also rejected, with opponents saying it would have mainly benefited large companies.     Toyota to Stop Donating to Republicans Who Contested 2020 Results

    Toyota said on Thursday that it would stop donating to Republicans who disputed the 2020 presidential vote after being the focus of an ad campaign by the Lincoln Project, a group that was founded to antagonize President Donald J. Trump with viral video criticisms.The automaker said in a statement that its support of the politicians had “troubled some stakeholders.”“At this time, we have decided to stop contributing to those members of Congress who contested the certification of certain states in the 2020 election,” the company said. It added that it was “committed to supporting and promoting actions that further our democracy” through its PAC and “has longstanding relationships with members of Congress across the political spectrum.”The Lincoln Project had released an ad directed at Toyota, which it accused of donating $55,000 to 37 Republicans in Congress who pushed back against President Biden’s victory.The Lincoln Project, known for its scathing anti-Trump videos and memes during the 2020 campaign, said the ad was part of a broader project aimed at decreasing funding for Republicans who resisted the results of the vote and played down the attack on the U.S. Capitol on Jan. 6. The group said it planned to release more ads in the following weeks naming companies that “have broken their pledges to withhold campaign funds to members of Congress who enabled, empowered and emboldened former President Trump and the insurrectionists.”A report last month from the watchdog group Citizens for Responsibility and Ethics in Washington listed many other companies who continued donating to the 147 Republicans who voted to overturn the election results, including Boeing, Walmart and PNC Bank.The Lincoln Project’s spot about Toyota includes footage of a vehicle crash test interspersed with images of the Jan. 6 riot. A narrator warns Toyota executives that “if they don’t reconsider where they send their money, Americans will reconsider where we send ours.”The Lincoln Project said the ad would no longer run after Thursday. It was set to appear online in the same markets as Toyota’s top 20 dealerships and locally on Fox Business and CNBC in New York and in Plano, Texas, where Toyota’s American operations are based. The Lincoln Project said Comcast had refused to air the commercial in Washington; Comcast did not immediately provide a comment.“Toyota made the right choice today,” the Lincoln Project said in a statement. “They put democracy ahead of transactional politics. We hope that the rest of corporate America will follow their lead — we’ll be there to make sure of it.”Founded by Republican consultants opposed to Mr. Trump, the group started as a super PAC in 2019. Later, the founders sought to parlay the Lincoln Project’s popularity into a broader media enterprise, setting off internal disputes as it experimented with a new tone for the Biden administration.The campaign targeting Toyota and other companies could offer the group a way to rebrand itself.     Legislation increasing sentences for pedophiles was changed to include restrictions on portrayals of homosexuality and transgender people that young people might see.BUDAPEST — Hungary’s Parliament voted on Tuesday to adopt legislation that would increase sentences for sex crimes against children, but critics say the law is being used to target the country’s L.G.B.T. community ahead of crunch elections for Prime Minister Viktor Orban next year.Last-minute changes to the bill, which was prompted by public outrage after a series of sex scandals involving governing party and government officials, included restrictions against showing or “popularizing” homosexuality and content that promotes a gender that diverges from the one assigned at birth.Mr. Orban’s critics say the changes were made to target the country’s L.G.B.T. community in an effort to rally support from his conservative base and shift the focus away from the failures of his administration ahead of elections in 2022.The new rules, unexpectedly added to the bill by government-aligned lawmakers last week, require the labeling of all content that might fall into that category of “not recommended for those under 18 years of age.” Such content would be restricted for media like television to the hours between 10 p.m. and 5 a.m. The restrictions extend to advertisements and even sexual education, which the law would restrict to teachers and organizations approved by the government. The bill would also create a public database of sex offenders.Mr. Orban has increasingly presented himself as a protector of traditional Christian values, although that image has been undermined somewhat by the sex scandals involving officials and allies of his Fidesz party over the past few years.Last year, a Hungarian diplomat in Peru was convicted of possession of child pornography and handed an $1,800 fine and a suspended prison sentence after being brought home and charged in Hungary. That case, which sparked the public pressure on the legislature to enact stricter sentencing for pedophilia crimes, was just one in a series of scandals that has undermined public faith in Mr. Orban’s government.Prime Minister Viktor Orban of Hungary, center, at a Parliament session in Budapest last year.Tibor Illyes/Agence France-Presse — Getty ImagesBefore Hungary’s 2019 municipal elections, a series of video clips released online by an anonymous source showed a prominent Fidesz mayor participating in an orgy on a yacht.The following year a Fidesz lawmaker in Brussels was detained after trying to escape out of a window and down a drainpipe when the police raided a party being held in violation of Covid restrictions that Belgian news media described as an all-male orgy.The last-minute additions to the legislation were criticized by human rights groups, including the Foundation for Rainbow Families, which promotes legal equality for all Hungarian families with children.“Fidesz does this to take the public conversation away from major happenings in the country,” said Krisztian Rozsa, a psychologist and board member with the foundation, citing corruption and the government’s responses to the pedophilia scandal and the coronavirus pandemic.Content providers such as RTL Klub, Hungary’s largest commercial television station, and the Hungarian Advertising Association have come out against the new law, saying the rules restrict them from depicting the diversity of society.“Children don’t need protection from exposure to diversity,” said Lydia Gall, a senior researcher with Human Rights Watch. “On the contrary, L.G.B.T. children and families need protection from discrimination and violence.”Linking the L.G.B.T. community to pedophilia is a tactic that may score Mr. Orban and his party points with conservative rural voters, many of whom, spurred on by a steady stream of government propaganda, see the government as a bulwark against the cosmopolitan liberalism symbolized by opposition political figures in the capital.Last year, the Fidesz-controlled Parliament enacted legislation that effectively bars gay couples from adopting children in Hungary through a narrow definition of the family as having to include a man as the father and a woman as the mother.Shaken by a bungled response to the coronavirus pandemic, a foreign policy pivot toward China and Russia that has angered his partners within the European Union, and increasing international isolation, Mr. Orban is facing a tough election campaign against a six-party opposition alliance.Balint Ruff, a political strategist, said the move to target the L.G.B.T. community was a “cynical and evil trap.” He added: “It’s a method used in authoritarian regimes to turn their citizens against each other for their own political gain.”It is not uncommon for someone who has spent their whole life in rural Hungary to have never met an openly gay person, Mr. Ruff said, adding that by inundating rural voters with conspiracies about gay propaganda taking over the world, Mr. Orban has found an effective tool for mobilizing voters.“The theme of the campaign will be liberal homosexual Budapest versus the normal people,” he said.By not supporting the new law, the opposition would be branded supporters of pedophilia for the duration of the campaign, Mr. Ruff said. But supporting the bill would betray more liberal voters who find linking pedophilia and the L.G.B.T. community deplorable.For those whose families are directly impacted by such laws, the effects hit closer to home.Mr. Rozsa, from the Foundation for Rainbow Families, said he was worried that bullying and exclusion among Hungarian teenagers would increase against those not seen as heterosexual — and also feared the implications of the governing party’s move for the children of same-sex couples who attend public schools.“Our kids are also going to be targeted,” Mr. Rozsa said. “Our kids have same-sex parents.” More
