    The United States and India Can Be Better Partners

    Idealism and pragmatism have long made rival claims on American foreign policy, forcing hard choices and sometimes leading to disappointment. There was a moment in the 1990s when the collapse of the Soviet Union looked to clear the way for a universal political and economic order, but that chimera soon gave way to the more complex world we inhabit today, in which the ideals of liberal democracy — often in otherwise well-functioning democracies — sometimes seem to be in conflict with the popularity of strongmen leaders, the desire for security or the forces of xenophobia or grievance.For American presidents and policymakers, this poses a challenge; it is no longer enough to champion the ideals of liberal democracy and count on the rest of the world to follow. Lecturing any country, be it global powers like Russia or China or regional powers like Turkey and Saudi Arabia, can embolden autocratic tendencies; engagement can, at least sometimes, lead to further dialogue and space for diplomacy. Advancing American ideals requires being pragmatic and even accommodating when our democratic partners fall short of the mark — and humility about where the United States falls short, too.Take India, and the quandary it poses for Washington, which is on display as Prime Minister Narendra Modi makes a state visit this week.India is a democracy in which the world’s biggest electorate openly and freely exercises the fundamental right to choose its leader. Its population is the largest in the world, and its economy is now the fifth largest in the world; its vast diaspora wields huge influence, especially in American business. With its history of close relations with Moscow, long and sometimes contested border with China and strategic location in a highly volatile neighborhood, India is destined to be a critical player in geopolitics for decades to come. Mr. Modi, the prime minister since 2014, commands sky-high popularity ratings and a secure majority in his Parliament, and is in the enviable position of leading a country with a relatively young, growing population.While India has a long history of wariness toward America — most of its military equipment comes from the Soviet Union and Russia, and it would prefer to steer clear of direct involvement in the U.S.-China rivalry — senior American officials believe that India’s views of the United States have fundamentally improved in recent years.This is partly through the work of the dynamic Indian diaspora, partly through greater strategic partnership, and partly because of the growing interest by American companies in India as an alternative to China for expansion in Asia. India has joined the United States, Japan and Australia in the “Quad,” an informal grouping that seeks to counter China’s increasingly assertive behavior in the Indo-Pacific region. And hundreds of American business and industry leaders will gather to meet with Mr. Modi this week. The visit is expected to include major deals to build American jet engines in India and to sell American drones.So it is not hard to fathom why India’s leader is getting rock-star treatment in Washington, from a state dinner at the White House to an address on Capitol Hill. President Biden is right to acknowledge the potential of America’s partnership with India using all the symbolism and diplomatic tools at his disposal.But Mr. Biden cannot ignore the other, equally significant, changes in India during the last nine years: Under Mr. Modi and his right-wing, Hindu nationalist Bharatiya Janata Party, India has witnessed a serious erosion of the civil and political rights and democratic freedoms guaranteed by the Indian Constitution. Mr. Modi and his allies have been accused of policies that target and discriminate against religious minorities, especially India’s 200 million Muslims, and of using the power of the state to punish rivals and silence critics. Raids on political opponents and dissenting voices have become frequent; the mainstream news media has been diminished; the independence of courts and other democratic institutions has been eroded — all to a chorus of avowals from the B.J.P. that it is acting strictly within the law.In March, a court in Mr. Modi’s home state sentenced the opposition leader, Rahul Gandhi, to a two-year prison term for defaming the prime minister; though Mr. Gandhi has not been jailed, the sentence led to his expulsion from Parliament, and will most likely prevent him from running again. Before that, in January, the Modi government used emergency laws to limit access to a BBC documentary that reexamined damning allegations that Mr. Modi played a role in murderous sectarian violence in Gujarat State 20 years ago, when he was chief minister there. As this editorial board warned, “When populist leaders invoke emergency laws to block dissent, democracy is in peril.”This remains true, and it behooves Mr. Biden and every other elected official and business leader who meet with the Indian delegation this week to make sure that a discussion of shared democratic values is on the agenda.That may be a tall order. Mr. Modi has demonstrated a prickly intolerance for criticism and may still harbor resentment from the nearly 10 years he was effectively barred from traveling to the United States for allegations of “severe violations of religious freedom” over the Gujarat violence. (He has repeatedly denied involvement, and the visa ban was lifted by the Obama administration when Mr. Modi became prime minister.) A public scolding from the White House, especially when the United States is wrestling with its own threats to democracy, would serve little purpose except to anger the Indian public.Nevertheless, Mr. Biden and other American officials should be willing to have a forthright, if sometimes uncomfortable, discussion with their Indian counterparts. America’s own struggles are humbling proof that even the most established democracies are not immune to problems. As Human Rights Watch notes in a letter to Mr. Biden: “U.S. officials can point to how the U.S. political system has itself struggled with toxic rhetoric, while working to maintain an open and free media. These topics can be discussed openly and diplomatically in both directions.”The quandary is not limited to India. How the United States manages its relationships with “elected autocracies,” from Poland’s Law and Justice government to Benjamin Netanyahu’s far-right coalition in Israel to Recep Tayyip Erdogan’s government in Turkey, is one of the most important strategic questions of American foreign policy. The leaders of these countries and others will be watching closely to see how the Biden administration deals with this indispensable but increasingly autocratic Asian democracy.The administration also faces the problem that the United States’ democratic credentials have been tarnished by Donald Trump and the possibility that he may be back in the White House before long. Mr. Trump’s politics have been openly hailed as inspiration by many an elected autocrat — including Mr. Modi, whose magnetism Mr. Trump likened to Elvis Presley’s at a rally in Houston on an official visit in 2019.President Biden knows, from his many years in public service, that there will always be points of friction even in the closest partnerships between nations, let alone in relationships with leaders who have a very different view of the world. And senior U.S. government officials say that the administration is keenly aware of the flaws of the Modi government. Yet they believe that India’s vital role on the global stage supersedes concerns about one leader. Far better, they say, to raise concerns in private; and they insist they have raised them in many difficult conversations, and said they would raise them in this week’s meetings with Mr. Modi.It is essential that they are raised. India has shaped a great and complex democracy out of a rich panoply of people, languages and religious traditions, and it is reaching for a more prominent role in global affairs.But it is also critical to make clear that intolerance and repression run counter to everything that Americans admire in India, and threaten the partnership with the United States that its prime minister is actively seeking to strengthen and deepen. America wants and needs to embrace India; but Mr. Modi should be left with no illusion about how dangerous his autocratic leanings are, to the people of India and for the health of democracy in the world.The Times is committed to publishing a diversity of letters to the editor.     Mailbag: Does Trump Represent Half the Country?

    Settling a marital dispute, and a question that gets at a tension within today’s conservatism — in this month’s reader mailbag.Mary Altaffer/Associated PressHelp settle a disputeNate, help me settle a marital dispute. My wife contends that 50 percent of the country are Trump supporters, while I believe the number is closer to 35-40 percent. Knowing that there is not a definitive answer — are we talking about all people, registered voters, etc. — who do you think is closer to being right? — Phil StevensonWhenever possible, it’s important for both partners to feel good with the settlement of a marital dispute. So let me suggest that the answer depends on your preferred definition of a “Trump supporter.”If a Trump supporter is someone who voted for Donald J. Trump or, alternately, someone who will vote for him over President Biden in the next election, I think the answer is closer to your wife’s 50 percent tally. After all, Mr. Trump won 47 percent of voters in 2020 and 46 percent in 2016. I’m open-minded about what he could win in 2024, but if the election were held today it’s reasonable to think he’d win something closer to 50 percent than 37.5 percent, the midway point of your 35-40 percent range.But if being a Trump supporter requires something more than merely preferring him over Mr. Biden, the number of Trump supporters is probably closer to your 35-40 percent range. To take one simple measure: Mr. Trump has around a 40 percent national favorability rating. Another option: Only 35 percent said they wanted him to run for president in an NBC poll taken in April.A.I. and pollingI am curious to know if you think A.I. has a place in the future of polling. — Brian BakerAt the moment, I’m more concerned that A.I. might claim an unintended place in the present of polling: by making it even easier for bots to contaminate online panels. Of course, someone is unlikely to read a book by a candidate unless they are somewhat interested in that person. — Angie BoyterWhen I wrote that I don’t read a presidential candidate’s book, I was mainly thinking about the genre of political books written by someone just about to run for president. These books often weave biographical detail, policy proposals and a political message into a preview of a coming campaign. They largely go unread, but they offer an excuse for TV producers to book a presidential hopeful on their shows. Mr. Obama’s 2006 book, “The Audacity of Hope,” falls into this category.Why don’t I want to read a book like this? I want to know the message a candidate emphasizes in speeches, advertisements and interviews, not the one that makes it into a 100,000-word book.Your experience with “Dreams From My Father” — a literary autobiography — is quite different. The book was widely read, and the content was distinct from what Mr. Obama talked about on the campaign trail. This is pretty unusual; J.D. Vance’s “Hillbilly Elegy” is the only recent example that comes to mind of something like it. Perhaps that’s a case where there’s a better argument for reading the book.On DeSantis and freedomThis isn’t really a question, but it’s an interesting observation that gets at a tension within conservatism nowadays:He’s been popular with Democrats and Republicans alike in Florida for his freedoms, not restrictions. Limiting people’s freedoms, regardless of the topic, will definitely harm him. — John FahrenwaldMr. DeSantis rose to prominence by fighting for freedom from coronavirus restrictions, and this remains an important part of his brand. His budget is branded as a “Framework for Freedom.” His book — which by now you may have guessed I have not read — is titled “The Courage to Be Free.”But as Mr. DeSantis’s fight for freedom has transitioned to a fight against “woke,” his orientation toward “freedom” has become a bit more complicated. He signed a six-week abortion ban. He’s used his authority as governor to crack down on “woke” corporations, and he’s expressed skepticism about giving tax breaks to companies who go on to advance the left’s values. This is emblematic of a broader turn on the intellectual right in which many want to use the power of the government to defend what they say are traditional values and fight the influence of the left in academia, the media and corporate America.This is sometimes called “post-liberal” conservatism. Here, liberal is meant in the classical sense of supporting liberty, free markets and limited government (as it is still used in Europe), not the American sense of liberal: a regulated market economy with a welfare state. In this context, the Republican Party has represented a liberal conservatism for most of the last half-century. The post-liberal conservatives prioritize conserving traditional values over conserving liberty.This post-liberal turn among a segment of conservative intellectual elites may reflect genuine fears of the threat posed by the left to traditional values, but it’s hard to see a political winner here. America is fundamentally a liberal country — again, in the classical, lower-case-l sense. It’s hard to think of anything more deeply embedded in traditional American values than individual liberty and freedom. It is not Hungary. I would guess that the constituency for an explicitly post-liberal conservatism is pretty small; perhaps that’s why Mr. DeSantis continues to brand himself as someone fighting for freedom, even as he increasingly supports measures that arguably restrict it.     Germany’s Far Right AfD Party Stages a Comeback

    With Germans facing an era of political and economic turbulence, the Alternative for Germany is resurgent. Mainstream politicians are struggling to respond.The tables were packed at the Waldhaus, a restaurant on the wooded outskirts of an east German town, as the regulars — workers shaking calloused hands, retirees clutching purses in their lap — settled in for a pub gathering of the far-right Alternative for Germany.But the die-hards worry Germany’s political leadership less than people like Ina Radzheit. An insurance agent in a flowered blouse, she squeezed in among platters of schnitzel and frothy beers for her first visit to the AfD, the German initials by which the party is known.“What’s wrong?” she said. “Where do I start?” She feels unsafe with migration rising. She is uncomfortable with Germany providing weapons to Ukraine. She is exasperated by government squabbling over climate plans she fears will cost citizens like her their modest but comfortable way of life.“I can’t say now if I would ever vote for the AfD,” she said. “But I am listening.”As anxieties over Germany’s future rise, so too, it seems, does the AfD.The AfD has reached a polling high in Germany’s formerly Communist eastern states, where it is now the leading party, drawing around a third of voters. It is edging up in the wealthier west. Nationally, it is polling neck and neck with Chancellor Olaf Scholz’s Social Democrats.If the trend lasts, the AfD could present its most serious threat to Germany’s political establishment since 2017, when it became the first far-right party to enter Parliament since World War II.The turnabout is surprising for a party whose political obituaries filled the German media a year ago, after it had sunk in national elections. That’s no longer to be expected.”When it was elected in 2021, Mr. Scholz’s three-party coalition vowed to lead Germany through a painful but necessary transformation. Instead, the country was plunged into deeper uncertainty by Russia’s invasion of Ukraine.At first, the coalition seemed to beat the odds: Allies praised its pledge to overwrite postwar pacifism with military revitalization. It found alternatives to cheap Russian gas — nearly 50 percent of its supply — with unexpected speed.But then the country dipped into recession. Migration numbers reached all-time highs, mostly driven by Ukrainian refugees. Its branch in Thuringia, where the Waldhaus gathering was held, is classified as “confirmed” extremist.A month earlier, its national youth wing was also classified confirmed extremist, though that label was recently lifted as a case regarding its status is settled in the courts.In April, the domestic intelligence agency head, Thomas Haldenwang, said in the agency’s yearly report that of 28,500 AfD members, around 10,000 are believed to be extremists.Yet a full third of Germans now view it as a “normal democratic party,” Mr. Hillje said. “The paradox is that, at the same time, it has become more and more clear that this is really a radical party, if not an extremist party.”In previous years, the party seemed ready to sideline extreme figures. No longer. This April, co-leader Alice Weidel spoke alongside Björn Höcke, party leader in Thuringia and seen as one of the AfD’s most radical politicians.Mr. Höcke was recently charged by state prosecutors for using the phrase “everything for Germany” at a rally — a Nazi Storm Trooper slogan.None of that dampened the enthusiasm at the Waldhaus in Gera, a town of about 93,000 in eastern Thuringia, where the AfD is the most popular party.Anke Wettengel, a schoolteacher, called such labels the equivalent of focusing on hooligan fans of a soccer team — not a reflection of normal supporters, like her.Nor did she see a problem with Mr. Höcke’s language.“That was a very normal sentence,” she said. “We should be allowed to be proud of our country today without immediately being accused of being extremists.”From the stage, Mr. Springer railed against not only immigrant labor reforms, calling them a “traitorous system against native citizens,” but also criticized new climate measures.The audience thumped their tables in approval.A question-and-answer session for AfD supporters and locals at the Waldhaus in Gera. (The federal government wrote in a document providing statistics to the AfD that the data was not substantial enough for such conclusions.)Political analysts say Germany’s main parties share the blame for the AfD’s rise. Mr. Scholz’s coalition failed to convincingly communicate its transformation plans — and instead appeared locked in internal battles over how to carry them out.Their mainstream conservative opponents, including the Christian Democrats of former Chancellor Angela Merkel, are edging closer to AfD positions, hoping to regain voters themselves.They are adopting the AfD’s antagonism to gender-neutral language, as well as tougher stances on migration. Martin Schutt/Picture Alliance, via Getty ImagesLast week, the German Institute for Human Rights, a state-funded organization, released a study arguing that the language and tactics used by the AfD “to achieve its racist and right-wing extremist goals” could meet conditions for banning the party as a “danger to the free democratic order.”Yet such proposals create another dilemma for democratic society: The tools Germany has for fighting the party it sees as a threat are the same that reinforce sentiments among AfD supporters that their country is not actually democratic.“How can it be that an organization funded by the state can stand up and try to stigmatize a significant part of its voters?” Mr. Springer asked in an interview.It is a question to which those in the crowd, like Ms. Wettengel, have found unsettling answers.“Mainstream politics are against the people,” she said. “Not for the people.”The real test of AfD support won’t come until next year, when several east German states hold elections and it has a chance at taking the largest share of the vote.In the meantime, every week, AfD politicians fan out across the country, hosting information booths, pub nights and citizen dialogues, as if it already were campaign season.Outside the train station of Hennigsdorf, a Berlin suburb, the state AfD lawmaker Andreas Galau handed out pamphlets to visitors with an unwavering smile. Some passers-by shouted insults. Others were curious.“Many come here just to get their frustrations off their chest,” he said with a chuckle. “They come and tell us what is on their minds — we’re a bit of a therapy group.”More and more people, he said, no longer feel ashamed to show interest in the AfD. It is this sense that the political establishment is not listening to ordinary people that may be helping fill out the AfD’s ranks.In Gera, Mr. Springer’s address to the crowd seemed an exercise in catharsis and validation.“They think we are stupid,” he said. “They’ll think again when the next elections come.” More

    Once Scorned, Far Right Secures Foothold in Spanish Cities

    Local alliances between the center-right Popular Party and the far-right Vox may foreshadow a broader coalition agreement at the national level.Spain’s far right took office in a string of Spanish cities and in a powerful region over the weekend by forging coalition agreements with the moderate right, in a move that may foreshadow a broader alliance to govern the country after next month’s general elections.The agreements came about three weeks after the center-right Popular Party crushed Prime Minister Pedro Sánchez’s left-wing coalition in regional and local elections. To secure control of dozens of cities, the Popular Party struck coalition deals with the far-right Vox, which also performed well, embracing part of the party’s nationalist, anti-migrant agenda.Both parties will now govern together in some 25 cities of more than 30,000 residents, including five regional capitals, giving Vox, a party once considered anathema by most voters, crucial political leverage. They have also teamed up to run the wealthy Valencia region, which accounts for 10 percent of Spain’s population.“It’s something completely new, both in terms of extent and depth,” Sandra León, a political analyst at Carlos III University in Madrid, said of the alliances. “It opens up a new path, a new period in the right-wing bloc.”The growing popularity of Vox, which is already the third-largest political force in the Spanish Parliament, has coincided with the rise of the far right in Europe, at a time when the continent is grappling with fierce identity debates, the economic fallout of a pandemic and Russia’s war in Ukraine.Hard-right forces already govern Italy, and on Friday, Finland’s main conservative party announced a new coalition government with a nationalist party. But she added that the most important outcome of the agreements is that they “have paved the way” for an alliance at the national level.Most polls show the Popular Party, also known by its initials PP, winning most votes in the early general elections that Mr. Sánchez has called for next month. The agreement also makes no mention of climate change, a phenomenon that some Vox leaders have denied is linked to human activity.Ms. León said that the agreement showed that the Popular Party “is willing to compromise on some issues on which it has different views from Vox” in order to govern.The left was quick to use the Valencia agreement as proof that a Popular Party governing in alliance with Vox would be a step backward.“There is something much more dangerous than Vox, and that is a PP that assumes the postulates and policies of Vox,” Mr. Sánchez said in an interview with El País on Sunday. “And this is what we are seeing: the negation of political, social and scientific consensus.”Under pressure, the Popular Party has tried to distance itself from the most controversial positions of the far-right party. After a top Vox leader in Valencia said on Friday that “gender violence does not exist” — an issue that parties from across the political spectrum have long acknowledged and combated — Mr. Feijóo rushed to denounce his remarks.“Gender violence exists,” Mr. Feijóo wrote on Twitter. “We will not take a step back in the fight against this scourge.     The Supreme Court Finally Strikes the Right Balance on Voting Rights

    One of the most important realities of American life is this: No nation can fully undo the effects of 345 years of state-sanctioned bigotry — from slavery to Jim Crow — in 59 years. The time period between the arrival of the first slaves on colonial shores in 1619 and the abolition of legalized discrimination with the passage of the Civil Rights Act in 1964 is simply too long, the discrimination too ingrained and the distortion of society too great to wave the wand of legal and cultural reform and quickly realize the dream of American equality.At the same time, there’s another vital American reality: Through grit, determination and immense courage, Black Americans and other marginalized communities have made immense gains, the hearts of countless white Americans have indeed changed and America is a far better and fairer place than it was in even the recent past.And now, at last, in the vital area of voting rights, Supreme Court authority reflects both these truths.Earlier this month, the Supreme Court issued a ruling in a case called Allen v. Milligan that surprised many legal observers by striking down an Alabama redistricting map that would have preserved the state’s recent tradition of maintaining only one majority Black district out of seven in a state with a 27 percent Black population.Voting in Alabama is extremely racially polarized. For example, in the 2020 presidential election, 91 percent of Black voters in the state voted for Joe Biden, while only 20 percent of white voters did so. In practice, this persistent polarization, combined with GOP-drawn district maps, has meant that Black voters were able to elect only one of Alabama’s seven congressional representatives.Voting rights jurisprudence is extremely complicated, but I’ll do my best to be succinct and accurate in describing both the issues and one key reason for the surprise: The author of the majority opinion in Allen — which, again, generally cheered liberals and disappointed conservatives — was Chief Justice John Roberts. Ten years ago, he had written one of the most contentious Supreme Court opinions of the 21st century, Shelby County v. Holder.In Shelby County, a sharply divided 5-to-4 court gutted key provisions of the Voting Rights Act of 1965 by striking down elements of Section 4 that required the federal government to “preclear” or preapprove changes to the voting laws of a limited number of American states, counties and townships, essentially placing these jurisdictions under federal supervision to prevent them from enacting (or, more precisely, re-enacting) discriminatory voting laws. Each of the jurisdictions had an especially pernicious history of racial discrimination in voting.The states included seven of the old Confederacy, plus Alaska and Arizona, as well as a handful of counties and towns in other states (including the counties of New York, Bronx and Kings, or Brooklyn, in New York City, each of which had extraordinarily low Hispanic voter registration rates as well as a legacy of English literacy tests). In 1966, the Supreme Court had upheld the Voting Rights Act in an 8-to-1 decision, holding that “exceptional conditions can justify legislative measures not otherwise appropriate.”In 2013, however, the Roberts court decided that some of those “exceptional conditions” no longer pertained. As Chief Justice Roberts wrote, “Census Bureau data indicate that African American voter turnout has come to exceed white voter turnout in five of the six States originally covered by §5, with a gap in the sixth State of less than one half of one percent.”The decision didn’t gut the entire act. Section 2, which prohibits “denial or abridgment of the right of any citizen of the United States to vote” on the basis of race, remained in force. But the meaning of Section 2 has been a subject of intense debate. Gerrymandering has been at the heart of that debate.If a state “cracks” a Black community (i.e., splits it apart into multiple districts) or “packs” one (i.e., concentrates its voters into supermajority districts) in a manner that leaves Black voters with diminished voting power, does that violate the act? It certainly does if it’s done with an explicit racial motive.But what if the state claims that the motive isn’t racial, but partisan? The Supreme Court has long granted states greater leeway to tilt the partisan playing field, and in a 2019 case, Rucho v. Common Cause, it seemed to throw up its hands entirely, holding that complaints against partisan gerrymandering weren’t “justiciable.” In other words, the solution to partisan gerrymandering abuses should be located in the political branches of government, not the courts.This ruling potentially created an immense opening for disguised racial gerrymanders, especially in heavily racially polarized states. Even worse, Alabama wanted the Supreme Court to modify existing precedent to give states even greater leeway in the face of claims of race discrimination. If Alabama prevailed, a Republican-dominated state could crack or pack Black communities and say that it was done not because the communities were Black, but because they were Democratic. Though the result — less Black representation in Congress — would be the same, the motive would be legal.Or would it? In Allen, Chief Justice Roberts, Justice Brett Kavanaugh and the three Democratic-appointed justices said no, not always. Under highly racially polarized voting conditions, Supreme Court authority will require the creation of majority-minority districts when, to quote Justice Kavanaugh’s concurrence, “(i) a State’s redistricting map cracks or packs a large and ‘geographically compact’ minority population and (ii) a plaintiff’s proposed alternative map and proposed majority-minority district are ‘reasonably configured.’”To translate the legalese: States and regions that are highly racially polarized can’t fracture or compress minority voting districts when reasonably drawn alternative maps would more closely maintain the relative power of minority voters. If anything, by reaffirming and clarifying existing precedents in the face of substantial legal doubt, the Court strengthened Section 2.I know that’s a lot to take in, but here’s where things get interesting. If you peruse recent exit polls, you’ll quickly observe that many of the old preclearance states retain exactly the kind of racially polarized voting patterns that, thanks to the Allen ruling, can trigger judicial skepticism. I quoted Alabama’s voting stats above. But what about other old preclearance states? In 2020, 77 percent of white Louisiana voters voted for Donald Trump, and 88 percent of Black voters voted for Joe Biden. In Mississippi, 81 percent of white voters voted for Trump and 94 percent of Black voters voted for Biden. In South Carolina, 69 percent of white voters voted for Trump and 92 percent of Black voters voted for Biden.While I certainly won’t argue that most white voters in those states are racist (indeed, a supermajority of voters in South Carolina supported Tim Scott, a Black Republican, for Senate), those numbers are not the American norm. Racial polarization exists more broadly, but not to the same extent. Nationally, for example, 55 percent of white voters voted for Trump, while 92 percent of Black voters voted for Biden. In some states, such as California and New York, Joe Biden received a majority of white and Black votes.Racially polarized voting isn’t proof of racism in any given voter’s heart. But it is part of the legacy of American bigotry and racial divisions. By preserving and clarifying the core of Section 2 of the Voting Rights Act — especially when voting is highly racially polarized — and by rejecting Alabama’s effort to limit Section 2, Chief Justice Roberts has subtly limited the reach of his own precedent. Now, thanks to Allen, many preclearance states will face greater scrutiny — unless and until their own cultural and political changes bring them closer to broader American partisan norms.That’s the legal impact, but there’s a cultural impact as well. In a tangible way, Chief Justice Roberts, along with Justices Sonia Sotomayor, Elena Kagan, Kavanaugh and Ketanji Brown Jackson brought the court’s precedent closer in line with the nation’s reality. Our country has made real progress in addressing racist violations of voting rights. The ruling in Shelby County reflected that encouraging truth. At the same time, our nation still hasn’t cleansed itself of racism or fully addressed the legacy of bigotry. The court’s holding in Allen acknowledged that sad fact.The law does not always align with the facts of American life, but in this case, the Supreme Court has brought it closer to proper balance. The Court is an embattled institution, yet it still retains some bipartisan wisdom. America has come so very far, so we must not despair as if all is lost.     Fact-Checking Nikki Haley on the Campaign Trail

    The Republican presidential candidate has made inaccurate or misleading claims about abortion, trans youth, foreign policy and domestic issues.Nikki Haley, the former governor of South Carolina, was the first prominent candidate to announce a challenge to former President Donald J. Trump’s bid for the Republican presidential nomination.Since entering the race in February, Ms. Haley has weighed in on social issues and tapped into her experience as a former United Nations ambassador under Mr. Trump to criticize current U.S. foreign policy.Here’s a fact check of her recent remarks on the campaign trial.Sex and gender issuesWhat Ms. Haley SAID“Roe v. Wade came in and threw out 46 state laws and suddenly said abortion any time, anywhere, for any reason.”— in a CNN town hall in JuneThis is exaggerated. Ms. Haley is overstating the scope of the landmark ruling Roe v. Wade, which established a constitutional right to abortion. The 1973 decision also ensured that states could not bar abortions before fetal viability, or when a fetus cannot survive outside the womb. That is not the same as “any time,” as Ms. Haley said. That moment was around 28 weeks after conception at the time of the decision and now, because of advances in medicine, stands at around 23 or 24 weeks.Before the Supreme Court overturned Roe in June 2022, most states had laws banning the procedure at some point, with 22 banning abortions between 13 and 24 weeks and 20 states barring abortion at viability. A spokesman for Ms. Haley noted that six states and Washington, D.C., had no restrictions when Roe was overturned.What Ms. Haley SAID“How are we supposed to get our girls used to the fact that biological boys are in their locker rooms? And then we wonder why a third of our teenage girls seriously contemplated suicide last year.”— in the CNN town hallThis lacks evidence. In February, the Centers for Disease Control and Prevention reported record levels of sadness and suicidal ideation among teen girls. And depression among teenagers, particularly girls, has been increasing for over a decade. The causes are debated, but experts said no research points to the presence of trans youth athletes in locker rooms, or increased awareness of L.G.B.T.Q. issues in general, as a causal or even contributing factor.“I can say unequivocally that there is absolutely no research evidence to support that statement,” said Dr. Kimberly Hoagwood, a child psychologist and professor at New York University. “The reasons for the increased prevalence of depression and suicide among teenage girls are complex, but have been researched extensively.”Dr. David Brent, a professor of psychiatry at the University of Pittsburgh, noted that teen depression rates have been increasing since the 2000s while widespread discussion and awareness of gender issues are a more recent development.“It could be stressful for some people, for the trans kids as well,” he said. “But to try to say that this is the cause, well, it just can’t be because this is a public health crisis has been going on for 15 years.”Possible factors in rising rates of teen depression include economic stress, the rise of social media, lower age of puberty, increased rates of opioid use and depression among adult caretakers, Dr. Brent said. There is also the general decrease in play and peer-related time, decreases in social skills, and other social problems, Dr. Elizabeth Englander, a child psychologist and professor at Bridgewater State University, wrote in an email. L.G.B.T.Q. youth also have a higher risk for mental health issues, according to the C.D.C.“Even if someone has found an association between being around trans or L.G.B.T.Q. youth and increased depression in heterosexual youth (which, to my knowledge, no one has), it seems incredibly unlikely that such contact is an important cause of the current crisis in mental health that we see in youth,” Dr. Englander added, calling Ms. Haley’s theory “outrageous.”Ms. Haley has weighed in issues of identity and abortion and tapped into her experience as former United Nations ambassador.John Tully for The New York TimesForeign policyWhat Ms. Haley SAID“If we want to really fix the environment, then let’s start having serious conversations with India and China. Ms. Haley has a point that China is the top emitter of greenhouse gasses and India is the third-largest emitter, according to the latest data from the European Commission. But the United States is the second-largest emitting country.Moreover, India and China are the most populous countries in the world and release less emissions per capita than many wealthier nations. In 2021, China emitted 8.7 metric tons of carbon dioxide per capita and India 1.9 metric tons, compared to the 14.24 metric tons of the United States.Ms. Haley’s spokesman noted that emissions from China and India have increased in recent years, compared with the United States’ downward trend, and are the top two producers of coal.Still, the two developing countries bear less historical responsibility than wealthier nations. The United States is responsible for about 24.6 percent of historical emissions, China 13.9 percent and India 3.2 percent.What Ms. Haley SAID“Last year, we gave over $50 billion in foreign aid. Do you know who we gave it to? We gave it to Pakistan that harbored terrorists that try to kill our soldiers. We gave it to Iraq that has Iranian influence, that says ‘death to America.’ We gave it to Zimbabwe that’s the most anti-American African country out there. We gave it to Belarus who’s holding hands with Russia as they invade Ukraine. We gave money to communist Cuba, who we named a state sponsor of terrorism. And yes, the most unthinkable, we give money to China.”— in a June fund-raiser in IowaThis is misleading. In the 2022 fiscal year, which ended in September, the United States gave out $50 billion in foreign aid. But the six countries Ms. Haley singled out received about $835 million total in aid or 1.7 percent of the total. Moreover, most foreign aid — about 77 percent, according to the nonpartisan Congressional Research Service — is channeled through an American company or nonprofit, international charity or federal agency to carry out projects, and not handed directly to foreign governments.Zimbabwe received $399 million, Iraq $248 million, Pakistan $147 million, Belarus $32.8 million, Cuba $6.8 million and China $1.7 million.The biggest single contracts to aid Zimbabwe and Pakistan were $30 million and $16.5 million to the World Food Program to provide meals and alleviate hunger. In Iraq, the largest contract of $29 million was awarded to a United Nations agency. And in Cuba, the third-largest contract was carried out by the International Republican Institute — a pro-democracy nonprofit whose board includes Senator Joni Ernst of Iowa, the host of the fund-raiser Ms. Haley was speaking at.In comparison, the country that received the most foreign aid, at about $10.5 billion or a fifth of the total amount, was Ukraine, followed by Ethiopia ($2.1 billion), Yemen ($1.4 billion), Afghanistan ($1.3 billion) and Nigeria ($1.1 billion).Another $12 billion was spent on global aid efforts in general, including about $4 billion in grants to the Global Fund, an international group that finances campaigns against H.I.V., tuberculosis and malaria.Domestic policyWhat Ms. Haley SAID“We will stop giving the hundreds of billions of dollars of handouts to illegal immigrants.”— in the CNN town hallThis is disputed. But the spokesman for Ms. Haley gave examples of recent payments made by local governments that allowed unauthorized immigrants to participate in benefit programs: $2.1 billion worth of one-time payments of up to $15,600 to immigrants in New York who lost work during Covid-19 pandemic, totaling $2.1 billion; $1 million for payments to families in Boston during the pandemic; permitting unauthorized immigrants to participate in California’s health care program for low-income residents, which could cost $2.2 billion annually.These, however, do not add up to “hundreds of billions.” That figure is in line with an estimate from an anti-immigration group that other researchers have heavily criticized for its methodological flaws.The group, the Federation for American Immigration Reform, estimated in March that illegal immigration costs the United States and local governments $135.2 billion each year in spending on education, health care and welfare, as well as another $46.9 billion in law enforcement.But the Cato Institute, a libertarian think tank, has found that an earlier but similar version of the estimate overcounted welfare benefits that undocumented immigrants receive, and undercounted the taxes that they pay.
