    Northern Ireland Likely to Hold New Election After Failing to Form a Government

    Britain’s Northern Ireland secretary is expected to announce on Friday that a new election would be held in December after six months of fruitless efforts to convene Parliament.LONDON — Voters in Northern Ireland made history in May when they turned the Irish nationalist party, Sinn Fein, into the largest in the North. Now, they are likely to have to go back to the polls after the main pro-unionist party paralyzed the power-sharing government by refusing to take part in it.Britain’s Northern Ireland secretary, Chris Heaton-Harris, is expected to announce on Friday that a new election would be held, possibly on Dec. 15, following six months of fruitless efforts to convene the assembly at the Stormont Parliament in Belfast. The deadline for forming a government expired at 12:01 a.m. Friday.It is not the first time that Northern Ireland’s experiment in power sharing has broken down. The assembly was suspended from 2002 to 2007, and again from 2017 to 2020. This time, the prospects for a swift resolution seem bleak, with Northern Ireland caught up in a larger standoff over trade between Britain and the European Union.Sinn Fein’s victory in May was a watershed in Northern Ireland’s politics, elevating a nationalist party that many still associate with paramilitary violence to leadership in the territory. It entitled Sinn Fein to name Michelle O’Neill, its leader, to the post of first minister in the government, reflecting its status as the party with the most seats in the assembly.But on Thursday, the parties failed in a last-gasp effort to elect a speaker of the assembly, which would have cleared the way to appoint ministers to run the government. The British government said it was not considering “joint authority” over the North, though it is wary of a return to direct rule.While the D.U.P. is unlikely to overtake Sinn Fein, analysts said, it may shore up what had been an eroding position. It might as well have been setting on the pro-unionist dreams of the residents.“It’s changed times now,” said Brian Gow, 69, as he contemplated the growing odds that the Irish nationalist party, Sinn Fein, would win the most seats in parliamentary elections on Thursday.That would represent an extraordinary coming-of-age for a political party that many outside Ireland still associate with years of paramilitary violence. In polls this past week, they held a lead of two to six percentage points over the D.U.P., running a campaign that emphasizes kitchen-table concerns like the high cost of living and the need for better health care — and that plays down the party’s ideological commitment to Irish unification, a legacy of its ties to the Irish Republican Army.Irish unification, party leaders say, is an over-the-horizon issue, over which Sinn Fein has limited control. It is up to the British government to call a referendum on whether Northern Ireland should stay part of the United Kingdom or join the Republic of Ireland.The only immediate effect of a Sinn Fein victory would be the right to name the first minister in the next government. In the United States, where many in the Irish diaspora embrace the nationalist cause, the party’s supporters frame the stakes more dramatically.Before St. Patrick’s Day, they took out ads in The New York Times and other newspapers that promised “Irish unity in our time” and called on the Irish government to “plan, prepare and advocate for Irish unity, as provided for in the Good Friday Agreement,” the 1998 peace accord that ended sectarian violence in the North.“If Sinn Fein are the largest party, the focus will immediately turn to their calls for a border poll” to determine whether a majority of people favor Irish unity, said Gordon Lyons, a Democratic Unionist who represents Carrickfergus. “What people want to avoid is the division, the arguments, and the rancor that would come from that.”But it is the Democratic Unionists who are laying the groundwork for the rancor. They have warned they will refuse to take part in a government with a Sinn Fein first minister. His government is readying legislation, which could be introduced days after the election, that would throw out parts of the protocol. Critics warn it could prompt a clash with Brussels and jeopardize the hard-won peace of the Good Friday Agreement.But public opinion polls suggest the protocol is not a high priority for most voters in Northern Ireland, even many unionists. Some economists contend that the North’s hybrid trade status is an advantage, giving it dual access to markets in mainland Britain and the European Union.The issue did not come up much on a recent evening of canvassing by two candidates for the Alliance Party, which presents itself as a centrist alternative to Sinn Fein and the D.U.P. “People see it as the parties fighting over flags and the border, not the bread-and-butter issues that affect people’s everyday lives,” said one of them, Danny Donnelly.The D.U.P., opponents say, is exploiting the protocol — despite its numbingly complicated details — particularly in loyalist strongholds, where posters warn that residents will “NEVER accept a border in the Irish Sea!”“There’s no way you can tell me that a kid with a petrol bomb in his hand is aggrieved at the finer points of an international trade agreement between the E.U. and the British government,” Mr. Finucane said, referring to fiery clashes last year between young protesters and the police in Belfast.Still, even if the protocol has little tangible effect on daily lives, it does carry symbolic weight for those who have felt cast adrift from Britain since Brexit. The party signed off on the deal that Mr. Johnson struck with Brussels and now wants to unravel.     It is time for Northern Ireland’s secretary of state, Brandon Lewis, to ensure that reproductive rights in the north are safe, legal and accessible to all who need them. The complicated politics of Northern Ireland have led to this dilemma of jurisdiction. The House of Commons was able to decriminalize abortion services in the north specifically because there was no sitting Northern Ireland executive in Stormont. However, now that there has been a sitting government in Stormont for over a year, many are calling for an end to the executive’s stall tactics.

    How Did We Get Here?

    Abortion services in the United Kingdom were legalized by the 1967 Abortion Act. Despite the fact that Unionists in the north of Ireland repeatedly call for increased recognition as part of the UK, the Democratic Unionist Party (DUP) has refused to allow this to extend to reproductive rights. Northern Ireland remains home to one of the most restrictive abortion regimes in the world, forcing pregnant people to travel across the Irish Sea to access services.

    UN committees and the Human Rights Council have released numerous reports stating that the UK has been breaching the rights of pregnant people in the north by limiting their access to abortion services. These same reports were a driving force behind the 2018 referendum on abortion in the Republic of Ireland, which passed affirmatively with nearly 70% of civilians supporting wide-reaching abortion reform. Pregnant people in the north have been forced to travel either to the republic or to mainland UK, which presents an enormous barrier to access.

    Despite the majority of Northern Ireland’s citizens saying that they would like abortion to be legalized, consistent vetoes by the DUP have blocked the power-sharing government from passing abortion reform.

    Lack of Government: An Opportunity

    The legacy of the 1998 Good Friday Agreement in Northern Ireland requires a power-sharing government between the nationalist and unionist communities. This means that neither party can be in position without the other. While this has been the reality for the past two decades, the issue rose to prominence in January 2017, with the resignation of the nationalist Sinn Fein’s Martin McGuinness as deputy first minister. This led to the collapse of the executive in Stormont, which continued until January 11, 2020.

    During this period of three years, the country had no power-sharing assembly to carry it through Brexit negotiations with the European Union, deal with rising turmoil in the north over the impact of these talks, and no opportunity to potentially build on momentum around abortion rights coming from the Republic of Ireland.

    The collapse of the executive allowed the British Parliament to pass legislation legalizing gay marriage and abortion in the north, bringing it in line with mainland UK laws, the Republic of Ireland’s laws since 2018 and international human rights norms. The move — which is only possible due to the legacy of The Troubles and the Good Friday Agreement, which allows for direct rule from London — was cause for enormous celebration by abortion rights activists.

    The proposal from Labour MP Stella Creasy was supported by 332 votes to 99, which forced decriminalization on October 21, 2019, if the Northern Ireland government was not restored. Despite attempts by the DUP to form a government in order to avoid the decriminalization, Michelle O’Neill and Sinn Fein resisted efforts, allowing the laws to be passed. Notwithstanding arguments against direct intervention from Westminster, the decision was applauded by pro-choice activists across the island.

    The new directive requires the Department of Health to take “concrete steps” to ensure full abortion services in Northern Ireland before the summer. This comes after pressure from within and without, with the Northern Ireland Human Rights Commission recently issuing legal action against the Stormont executive over the delay in commissioning services.

    What Does the Decision Mean?

    Over a year and a half after the British Parliament decriminalized abortion, the UK government has formally reprimanded the Northern Ireland executive for “dragging its feet.” Parliament has formally approved regulations that enable Secretary Lewis to roll out abortion services across the north. This move is long overdue and is a response to stall tactics by the DUP government over the past year.

    The delays have meant that the burden has fallen on health trusts to carry out interim services for abortions up to 10 weeks, forcing pregnant people seeking terminations beyond 10 weeks to travel to mainland UK for services. Without adequate funding or resources from the Department of Health, these trusts have been had to either provide limited services or suspend them altogether.

    The Northern Irish executive must move, without delay, to create an abortion regime that adheres to international human rights norms and that is accessible to all those who need to access care. However, it appears unlikely that the two majority parties, the DUP and Sinn Fein, will be able to reach an agreement on the services after the resignation of First Minister Arlene Foster. Her successor, Edwin Poots, caters toward the hyper-Christian base of the DUP, publicly opposing adoption by gay couples, supporting conversion practices and restrictions on abortion.

    Through the rules that govern the Northern Ireland executive and power-sharing agreement, Lewis has both the legal authority and the financial abilities to “compel Stormont to commission full abortion services if there is no movement by the summer.” However, in the absence of clear decisions from Lewis, coupled with a Stormont executive that refuses to move forward with their own directives, the responsibility has fallen on community organizations such as the Alliance for Choice to provide access to abortion services across the north.

    The COVID-19 pandemic has exacerbated the fact that health professionals are already stretched thin throughout the north. Many of them do not have the financial or staffing resources to continue to provide services for those seeking an abortion. While a truly free, safe and legal abortion regime will look different everywhere, it is clear that the current model in the north is not working. In the absence of appropriate action from the Northern Ireland executive, and to assume the burden from already-stretched-thin community organizations, Secretary Lewis must act now to create a government-financed and government-run centralized model for abortions without restrictions in the north.

    How Democracy Faces a Rising Threat Splitting Republicans and Democrats

    The country is increasingly split into camps that don’t just disagree on policy and politics — they see the other as alien, immoral, a threat. Such political sectarianism is now on the march.American democracy faces many challenges: New limits on voting rights. The corrosive effect of misinformation. The rise of domestic terrorism. Foreign interference in elections. Efforts to subvert the peaceful transition of power. And making matters worse on all of these issues is a fundamental truth: The two political parties see the other as an enemy.It’s an outlook that makes compromise impossible and encourages elected officials to violate norms in pursuit of an agenda or an electoral victory. It turns debates over changing voting laws into existential showdowns. And it undermines the willingness of the loser to accept defeat — an essential requirement of a democracy.This threat to democracy has a name: sectarianism. It’s not a term usually used in discussions about American politics. It’s better known in the context of religious sectarianism — like the hostility between Sunnis and Shia in Iraq. Yet a growing number of eminent political scientists contend that political sectarianism is on the rise in America.That contention helps make sense of a lot of what’s been going on in American politics in recent years, including Donald J. Trump’s successful presidential bid, President Biden’s tortured effort to reconcile his inaugural call for “unity” with his partisan legislative agenda, and the plan by far-right House members to create a congressional group that would push some views associated with white supremacy. Most of all, it re-centers the threat to American democracy on the dangers of a hostile and divided citizenry.In recent years, many analysts and commentators have told a now-familiar story of how democracies die at the hands of authoritarianism: A demagogic populist exploits dissatisfaction with the prevailing liberal order, wins power through legitimate means, and usurps constitutional power to cement his or her own rule. It’s the story of Putin’s Russia, Chavez’s Venezuela and even Hitler’s Germany.Sectarianism, in turn, instantly evokes an additional set of very different cautionary tales: Ireland, the Middle East and South Asia, regions where religious sectarianism led to dysfunctional government, violence, insurgency, civil war and even disunion or partition.These aren’t always stories of authoritarian takeover, though sectarianism can yield that outcome as well. As often, it’s the story of a minority that can’t accept being ruled by its enemy.One-third of Americans believe violence could be justified to achieve political objectives. Rioters stormed the Capitol on Jan. 6, a sign that the risks of sustained political violence can’t be discounted.Erin Schaff/The New York TimesIn many ways, that’s the story playing out in America today.Whether religious or political, sectarianism is about two hostile identity groups who not only clash over policy and ideology, but see the other side as alien and immoral. It’s the antagonistic feelings between the groups, more than differences over ideas, that drive sectarian conflict.Any casual observer of American politics would agree that there’s plenty of hostility between Democrats and Republicans. Many don’t just disagree, they dislike each other. They hold discriminatory attitudes in job hiring as they do on the Implicit Association Test. They tell pollsters they wouldn’t want their child to marry an opposing partisan. In a paper published in Science in October by 16 prominent political scientists, the authors argue that by some measures the hatred between the two parties “exceeds longstanding antipathies around race and religion.”More than half of Republicans and more than 40 percent of Democrats tend to think of the other party as “enemies,” rather than “political opponents,” according to a CBS News poll conducted in January. A majority of Americans said that other Americans were the greatest threat to America.On one level, partisan animosity just reflects the persistent differences between the two parties over policy issues. Over the past two decades, they have fought bruising battles over the Iraq war, gun rights, health care, taxes and more. Perhaps hard feelings wouldn’t necessarily be sectarian in nature.But the two parties have not only become more ideologically polarized — they have simultaneously sorted along racial, religious, educational, generational and geographic lines. Partisanship has become a “mega-identity,” in the words of the political scientist Lilliana Mason, representing both a division over policy and a broader clash between white, Christian conservatives and a liberal, multiracial, secular elite.And as mass sectarianism has grown in America, some of the loudest partisan voices in Congress or on Fox News, Twitter, MSNBC and other platforms have determined that it’s in their interest to lean into cultural warfare and inflammatory rhetoric to energize their side against the other. As political sectarianism has grown in America, some of the loudest partisan voices in Congress or on Fox News, Twitter, MSNBC and other platforms have determined that it’s in their interest to lean into cultural warfare.Dina Litovsky for The New York TimesThe conservative outrage over the purported canceling of Dr. Seuss is a telling marker of how intergroup conflict has supplanted old-fashioned policy debate. Culture war politics used to be synonymous with a fight over “social issues,” like abortion or gun policy, where government played a central role. The Dr. Seuss controversy had no policy implications. What was at stake was the security of one sect, which saw itself as under attack by the other. It’s the kind of issue that would arouse passions in an era of sectarianism.A Morning Consult/Politico poll conducted in March found that Republicans had heard more about the Dr. Seuss issue than they had heard about the $1.9 trillion stimulus package. A decade earlier, a far smaller stimulus package helped launch the Tea Party movement.The Dr. Seuss episode is hardly the only example of Republicans de-emphasizing policy goals in favor of stoking sectarianism. Last month, Senator Marco Rubio, Republican of Florida, penned an op-ed in support of unionization at Amazon as retribution for the Seattle company’s cultural liberalism. At its 2020 national convention, the Republican Party didn’t even update its policy platform.And perhaps most significant, Republicans made the choice in 2016 to abandon laissez-faire economics and neoconservative foreign policy and embrace sectarianism all at once and in one package: Donald J. Trump. The G.O.P. primaries that year were a referendum on whether it was easier to appeal to conservatives with conservative policy or by stoking sectarian animosity. Sectarianism won.Sectarianism has been so powerful among Republicans in part because they believe they’re at risk of being consigned to minority status. The party has lost the popular vote in seven of the last eight presidential elections, and conservatives fear that demographic changes promise to further erode their support. And while defeat is part of the game in democracy, it is a lot harder to accept in a sectarian society.It is not easy to accept being ruled by a hostile, alien rival. It can make “political losses feel like existential threats,” as the authors of the study published in Science put it.As a result, the minority often poses a challenge to democracy in a sectarian society. It’s the minority who bears the costs, whether material or psychological, of accepting majority rule in a democracy. Otherwise, the most alienated segments of the minority might resort to violence and insurgency in hopes of achieving independence.Republicans are not consigned to permanent minority status like the typical sectarian minority, of course. The Irish had no chance to become the majority in the United Kingdom. Neither did the Muslims of the British Raj or the Sunnis in Iraq today. Democrats just went from the minority to the majority in all three branches of elected government in four years; Republicans could do the same.But changes in the racial and cultural makeup of the country leave conservatives feeling far more vulnerable than Republican electoral competitiveness alone would suggest. Demographic projections suggest that non-Hispanic whites will become a minority sometime in the middle of the century. People with a four-year college degree could become a majority of voters even sooner. Religiosity is declining.The sense that the country is changing heightens Republican concerns. In recent days, the Fox News host Tucker Carlson embraced the conspiracy theory that the Democratic Party was “trying to replace the current electorate” with new voters from “the third world.” Far-right extremists in the House are looking to create an “America First Caucus” that calls for “common respect for uniquely Anglo-Saxon political traditions” and an infrastructure that “befits the progeny of European architecture.”It is not easy to pin down where political sectarianism in America fits on a scale from zero to “The Troubles.” But nearly every protection that sectarian minorities pursue is either supported or under consideration by some element of the American right.That includes the more ominous steps. In December, Rush Limbaugh said he thought conservatives were “trending toward secession,” as there cannot be a “peaceful coexistence” between liberals and conservatives. One-third of Republicans say they would support secession in a recent poll, along with one-fifth of Democrats.One-third of Americans believe that violence could be justified to achieve political objectives. In a survey conducted in January, a majority of Republican voters agreed with the statement that the “traditional American way of life is disappearing so fast that we may have to use force to save it.” The violence at the Capitol on Jan. 6 suggests that the risks of sustained political violence or even insurgency can’t be discounted.Whatever risk of imminent and widespread violence might have existed in January appears to have passed for now.Mr. Biden speaks the day after Election Day in the Chase Center in Wilmington, Del. Erin Schaff/The New York TimesInstead, Joe Biden was sworn in as president — a person who did not attempt to arouse the passions of one sect against the other during his campaign. His nomination and election demonstrates that sectarianism, while on the rise, may still have limits in America: The median voter prefers bipartisanship and a de-escalation of political conflict, creating an incentive to run nonsectarian campaigns.Yet whether Mr. Biden’s presidency will de-escalate sectarian tensions is an open question.Mr. Biden is pursuing an ambitious policy agenda, which may eventually refocus partisan debate on the issues or just further alienate one side on matters like immigration or the filibuster. Still, the authors of the Science paper write that “emphasis on political ideas rather than political adversaries” would quite likely be “a major step in the right direction.”And Mr. Biden himself does not seem to elicit much outrage from the conservative news media or rank-and-file — perhaps because of his welcoming message or his identity as a 78-year-old white man from Scranton, Pa.But sectarianism is not just about the conduct of the leader of a party — it’s about the conflict between two groups. Nearly anyone’s conduct can worsen hostility between the two sides, even if it is not endorsed by the leadership of a national political party. Mr. Carlson and the congresswoman Marjorie Taylor Greene are only the latest examples.It leaves America at an uncertain juncture. Mr. Biden may dampen sectarian tensions compared with Mr. Trump, but it is not clear whether festering grievances and resentments will fade into the background with so many others acting to stoke division.Sectarianism, after all, can last for decades or even centuries after the initial cause for hostility has passed. Speaking to reporters in Wilmington, Delaware, Biden said “We do not want a guarded border. We want to make sure – we’ve worked too long to get Ireland worked out, and I talked with the British prime minister, I talked with the Taoiseach, I talked with others, I talked to the French. The idea of having a border north and south once again being closed is just not right, we’ve just got to keep the border open.”

    The Irish question has played havoc with the best-laid plans of hardline Brexiters. Since 2016, successive Conservative governments have struggled to square the circle of keeping the United Kingdom intact, while avoiding the reimposition of a hard border on the island of Ireland. The border issue has been the achilles heel of Brexit, the thorn in the side of true believers in a “clean break” with the EU. So the prospect of an Irish-American politician on his way to the White House, just as Boris Johnson attempts to finagle his way round the problem, is an 11th-hour plot twist to savour.
    Joe Biden’s views on Brexit are well known. The president-elect judges it to be a damaging act of self-isolation; strategically unwise for Britain and unhelpful to American interests in Europe. But it is the impact of the UK’s departure from the EU on Ireland that concerns Mr Biden most. This autumn, he was forthright on the subject of the government’s controversial internal market bill, which was again debated on Monday in the House of Lords. The proposed legislation effectively reneges on a legally binding protocol signed with the EU, which would impose customs checks on goods travelling between Britain and Northern Ireland. In doing so, it summons up the spectre of a hard border on the island of Ireland, undermining the Good Friday agreement. Mr Biden is adamant that the GFA must not “become a casualty of Brexit”. He is expected to convey that message, in forceful terms, when his first telephone conversation with Mr Johnson eventually takes place.
    This is somewhat awkward for the prime minister. Mr Johnson badly needs to establish good relations with the new regime in Washington, ahead of crucial trade negotiations. In light of that, Mr Johnson may choose not to insist on the clauses relating to Northern Ireland when the bill goes back to the Commons. That would certainly be the wise move, although the noises coming from the government remain defiant. But the prime minister’s challenges in dealing with the coming regime change in Washington go well beyond Brexit.
    The personal dynamics between Mr Johnson and Mr Biden and his team are, to put it mildly, unpromising. The prime minister’s insulting remarks four years ago, about Barack Obama’s Kenyan ancestry, have not been forgotten. Mr Johnson seems to be viewed by many senior Democrats as a kind of pound-shop Donald Trump. There is also little regard for the consistency or sincerity with which Mr Johnson holds his views. At the weekend, when the prime minister instagrammed his congratulations to Mr Biden on his victory, a Biden ally witheringly referred to Mr Johnson as “this shape-shifting creep”.
    So in the race to make friends and influence people in the new Washington, Britain has the very opposite of a head start. The smart money is on Paris becoming the first European capital to receive President Biden. That reflects both good relations with Emmanuel Macron and a concern to rebuild diplomatic bridges, after four years in which Mr Trump rarely ceased to disparage and seek to undermine the EU. Mr Biden means to bring back a sense of diplomatic propriety and integrity to America’s relations with European friends and allies.
    Britain, having left the EU, cannot be a central player in this restoration project. But it can avoid making unforced errors. The government should urgently start to read the runes of new, more internationalist times. The politics of disruptive confrontation, as exemplified by the internal market bill, suddenly looks dangerously dated. When the Northern Ireland minister, Brandon Lewis, confirmed in September that the bill would break international law, senior Conservatives such as Sir Michael Howard and Theresa May expressed their dismay at the damage to Britain’s reputation that would result. They were ignored.
    But faced with an Irish-American president who is determined to rehabilitate relations with the EU, and is deeply suspicious of Mr Johnson’s Trumpian tendencies, to continue with the bill as it stands would be folly. With Mr Trump on his way out, Mr Johnson needs to sober up and start shifting some shapes on this and other matters. More
