    The Two Candidates for House Speaker Are Even Worse Than Kevin McCarthy

    The crisis of terror in Israel has made it even more urgent that the House of Representatives move past its schoolyard infighting, elect itself a speaker and demonstrate that the United States still has a functional government, one that can play a significant role in supporting democratic allies around the globe. So far, however, the Republican House majority has shown no indication it is up to the job.Only two candidates, Representatives Steve Scalise of Louisiana and Jim Jordan of Ohio, are officially running for speaker. Neither seems to have a majority of Republicans locked up yet, and both are trying to appeal to the party’s worst instincts — making it clear they would perpetuate the chaos that was unleashed during the reign of Kevin McCarthy, who was overthrown by a group of far-right rebels on Oct. 3. In several ways, Mr. Scalise and Mr. Jordan would probably be worse.Both express opposition to the Biden administration’s request for additional military aid to Ukraine. Like Mr. McCarthy, both have cast doubt on the outcome of the 2020 presidential race, and voted against certifying the election results, a permanent stain on their reputations. But for anyone who cares about basic governmental function, the most worrisome part is that they also seem to be repudiating the two moments when Mr. McCarthy defused a fiscal crisis in recent months — over the debt ceiling and the threatened government shutdown. They want the House to use more “leverage” in its battles against President Biden.“Leverage,” in case you missed the constant reference in the battle over Mr. McCarthy, is a Washington euphemism for blackmail. By holding the country’s credit hostage, or shutting down government functions, a small band of wrecking-ball ideologues can try to get a win on some unrelated matter. The anti-McCarthyites said he failed to use his speakership to rewrite the rules of government in Washington.“Many of us had begged the speaker, pleaded with the speaker repeatedly, to utilize the debt ceiling to leverage spending cuts and reforms,” Bob Good, Republican of Virginia, told the House before the big vote. “Instead, he negotiated an unlimited increase to the debt ceiling.”Of the two ways to achieve political success in a divided government, leverage is the poisoned choice. The more effective path, the one that used to be employed regularly in Washington, is to cut deals and make compromises with your opponents, even if they are occasionally painful and at odds with your principles. That’s how Lincoln operated, that’s how Lyndon Johnson pushed through his Great Society and civil rights bills, and it’s how Obamacare was created.But ever since Newt Gingrich’s era, the idea of compromising with the Democratic Party, of putting bills on the House floor that both sides can support, has been anathema to Republicans. Speakers from that party who do so tend to lose their jobs or quit under pressure, as John Boehner and Mr. McCarthy learned. The preferred method of dealing with Democrats now is to extort them, and though that usually fails, the mere act of trying brings great cheer to extremists who view centrists from both sides as the rotten core of the “uniparty.” (An exception occurred in 2011, when Barack Obama was forced to make massive spending cuts to prevent a default caused by Republicans.)Mr. McCarthy abandoned leverage to keep the government open through mid-November, and earlier to prevent a ruinous default. But both candidates to replace him have made it clear to their restive caucus that they intend to use the leverage he discarded.“If we stay united, we can preserve leverage for the House to secure tangible wins in our impending policy fights,” Mr. Scalise, the current majority leader, said in announcing his candidacy for speaker last week. Mr. Scalise, as a member of the leadership team, voted for the recent deal to prevent a shutdown, but the signal he sent to the rebels was unmistakable.Representative Steve Scalise of LouisianaMark Peterson for The New York TimesAnd Mr. Jordan didn’t even need to send a signal. He was one of a minority of House Republicans who voted against the shutdown deal, against the wishes of his putative ally, Mr. McCarthy, and his credentials as a legislative bomb-thrower are already impeccable. He has helped lead Republican shutdown efforts at least three times: over defunding the Affordable Care Act, over cutting money to Planned Parenthood and (during the Trump administration) over building a border wall. He told Punchbowl News a few days ago that he would insist on refusing to spend any additional money on processing new migrants, though that would violate U.S. asylum law.Donald Trump’s “Complete & Total Endorsement!” of Mr. Jordan — and his debasement of the Presidential Medal of Freedom, which he presented to Mr. Jordan in 2021 as a reward for feverishly defending him in his impeachments and during the Russia investigation — tell you pretty much all you need to know about what kind of leader Mr. Jordan would be.Mr. Scalise is less incendiary than Mr. Jordan, but is no more likely to end his chamber’s chaos and bring any degree of bipartisanship to the House than was Mr. McCarthy. He blamed “Soros-backed elements of the Democratic Party” for committing acts of violence against Republicans. Long after the 2020 election was over, he continued to suggest the outcome was stolen, relying on a theory about the primacy of state legislatures that was shot down by the Supreme Court. He had to apologize for speaking in 2002 at a white nationalist group headed by David Duke, but also described himself, according to a columnist, as like “David Duke without the baggage,” and opposed a holiday honoring the Rev. Dr. Martin Luther King Jr.Republicans will spend the next few days trying to determine whether they have the votes to elect any speaker, and it’s possible their internal discord could go on for weeks.     From the Fringe to the Center of the G.O.P., Jordan Remains a Hard-Liner

    Once a tormentor of the Republican Party’s speakers, the Ohio congressman and unapologetic right-wing pugilist has become a potential speaker himself.As a co-founder of the conservative House Freedom Caucus, Representative Jim Jordan, Republican of Ohio, once antagonized his party’s leadership so mercilessly that former Speaker John A. Boehner, whom he helped chase from his position, branded him a “legislative terrorist.”Less than a decade later, Mr. Jordan — a fast-talking Republican often seen sans jacket, known for his hard-line stances and aggressive tactics — is now one of two leading candidates to claim the very speakership whose occupants he once tormented.Mr. Jordan’s journey from the fringe of Republican politics to its epicenter on Capitol Hill is a testament to how sharply his party has veered to the right in recent years, and how thoroughly it has adopted his pugilistic style.Those forces played a pivotal role in the downfall of former Speaker Kevin McCarthy last week, though Mr. Jordan, once a thorn in his side, had since allied himself with Mr. McCarthy, a California Republican. Now, the same dynamics have placed Mr. Jordan in contention for the post that is second in line to the presidency, a notion that is mind-blowing to many establishment Republicans who have tracked his career.“That notion that he could go from ‘legislative terrorist’ to speaker of the House is just insane,” said Mike Ricci, a former aide to both Mr. Boehner and Speaker Paul D. Ryan, Republican of Wisconsin. “Jordan is an outsider, but he’s very much done the work of an insider to get to this moment. Keeping that balance is what will determine whether he will win, and what kind of speaker he will be.”The race between Mr. Jordan, a populist who questions federal law enforcement and America’s funding of overseas wars, and Representative Steve Scalise, a staunch conservative and the No. 2 House Republican from Louisiana, continued to heat up on Friday. Both men worked the phones relentlessly seeking support, including making calls with freshman lawmakers, the Congressional Western Caucus and the Main Street Caucus, a group of business-oriented Republicans.On Friday, as they were vying for support, a bloc of Republicans were quietly requesting a change to party rules that would raise the vote threshold for nominating a candidate for speaker, which would make it more difficult for Mr. Scalise to prevail.While Mr. Scalise is amassing dozens of commitments of support, so is Mr. Jordan, which could lead to a bitter and potentially prolonged battle when Republicans meet behind closed doors next week to choose their nominee — or spill into public disarray on the House floor.Mr. Jordan’s rise in Congress to a position where he can credibly challenge Mr. Scalise, who has served in leadership for years, stems from a number of important alliances he has formed over the years. His strongest base of power is his colleagues in the House Freedom Caucus, many of whom consider him a mentor. He has built a solid relationship with Mr. McCarthy, for whom Mr. Jordan proved a reliable supporter and important validator on the right. And he has forged close ties with former President Donald J. Trump, perhaps his most important ally.In a Republican House that has defined itself in large part by its determination to protect Mr. Trump and attack President Biden, Mr. Jordan has been a leader of both efforts. He leads a special subcommittee on the “weaponization of government” against conservatives. He has started investigations into federal and state prosecutors who indicted Mr. Trump, and he is a co-leader of the impeachment inquiry into Mr. Biden that Mr. McCarthy formally announced last month as he worked to appease the right and cling to his post.Mr. Trump endorsed Mr. Jordan for the top House job early on Friday, ending speculation, however unrealistic, that the former president might seek the job himself. (A speaker is not required to be an elected lawmaker.)“Congressman Jim Jordan has been a STAR long before making his very successful journey to Washington, D.C.,” Mr. Trump wrote in a post on his social media platform, Truth Social. “He will be a GREAT Speaker of the House, & has my Complete & Total Endorsement!”Mr. Trump’s endorsement could help Mr. Jordan garner support from his other fellow House Republicans, among whom Mr. Trump is popular. But it is not expected to seal a victory.Representative Warren Davidson, an Ohio Republican who is the whip of the House Freedom Caucus and a supporter of Mr. Jordan, said Mr. Trump’s endorsement was a “positive” for Mr. Jordan because “Trump is widely viewed as the leader of our party.”But, he said, some more mainstream Republicans aren’t thrilled about aligning themselves with Mr. Trump.“There are some folks in moderate districts that are like, ‘Well, that might actually complicate things for me,’” Mr. Davidson said.Mr. Jordan helped undermine faith in the 2020 presidential election results as Mr. Trump spread the lie that the election had been stolen through widespread fraud. Mr. Jordan strategized with Mr. Trump about how to use Congress’s official count of electoral votes on Jan. 6, 2021, to reject the results, voting to object even after a mob of Mr. Trump’s supporters attacked the Capitol. His candidacy for speaker has drawn a stark warning from former Representative Liz Cheney of Wyoming, who was the No. 3 Republican and vice chair of the Jan. 6 committee, who said that if he prevailed, “there would no longer be any possible way to argue that a group of elected Republicans could be counted on to defend the Constitution.”In a speech at the University of Minnesota this week, Ms. Cheney told the audience that “Jim Jordan was involved, was part of the conspiracy in which Donald Trump was engaged as he attempted to overturn the election.”Mr. Jordan has defended his actions in challenging the results of the 2020 election, saying he had a “duty” to object given the way some states changed voting procedures during the coronavirus pandemic.His quick rise in the Republican ranks was nearly derailed in 2018, when a sexual abuse scandal in Ohio State University’s athletics program came to light, leading to accusations that Mr. Jordan, who had been an assistant wrestling coach at the time, knew about the abuse and did nothing. Mr. Jordan has said that he was not aware of any wrongdoing.On Capitol Hill, Mr. Jordan initially worked to build some relationships with Democrats early in his career. He and Representative Jamie Raskin, Democrat of Maryland, once teamed up on bipartisan legislation to protect press freedom. He counts former Representative Dennis Kucinich, a Democrat from Ohio who is now running Robert F. Kennedy Jr.’s presidential campaign, as a friend. Even as Mr. Jordan and Representative Elijah Cummings, the Maryland Democrat who died in 2019, sparred over investigations of Mr. Trump, the two men occasionally found common ground on other Oversight Committee issues.But as Mr. Jordan formed an alliance with Mr. Trump and then became one of his most vocal defenders on Capitol Hill, his relationships with Democrats disintegrated. When Mr. Raskin introduced his press freedom bill this year, Mr. Jordan was no longer listed as a sponsor.Representative Jim Banks, Republican of Indiana, said that Mr. Jordan’s true power lay in the love he commands from base voters, built up through years of defending Mr. Trump and advocating conservative policies on Fox News and in combative congressional hearings. Mr. Jordan is known to fly to districts around the country to help raise money for candidates who are aligned with the House Freedom Caucus — and even for Republicans who are not.Mr. Banks suggested that Mr. Jordan’s credibility with the right would make it easier for the party to unify behind any spending deal he were to cut with Democrats and the White House should he become speaker. Such a deal would be a tall order. Mr. Jordan voted last week against a measure to avoid a government shutdown — an agreement with Democrats that ultimately drove Mr. McCarthy from the speakership.“Jim Jordan is a trusted conservative; he’s well-respected by the base of the Republican Party,” Mr. Banks said. “So when we get to some of these tough spending fights and Speaker Jim Jordan is negotiating with the White House and the Senate, that’s going to help Republicans rally behind him and get to a place where they can vote for those deals.”“This is a different Republican Party today than what it was a decade ago,” he added. “And the Republican Party today is a lot more like Jim Jordan.     House Speaker, Ukraine War, Border Wall: Trump’s Influence Reaches a Post-Presidency Peak

    A Republican leadership vacuum has allowed the former president to exert power over his party — and in the country — in a way that lacks much historical precedent.From a House leadership contest to the southwestern border and a foreign war, Donald J. Trump’s influence this week seemed to pervade the nation’s politics more than it has since the first weeks after his exit from the White House.Not since Jan. 27, 2021, when Representative Kevin McCarthy flew to Mar-a-Lago to mend the rift with Mr. Trump, has the former president’s sway been as widespread or as palpable.Mr. Trump’s successor, President Biden, resumed construction of a border wall that will always be stamped with Mr. Trump’s name and restarted deporting Venezuelan migrants, following a hiatus when the Biden administration extended protective status for those fleeing that devastated nation.The House Republican Conference launched its search for a new speaker following the historic vanquishing of the last one, Mr. McCarthy, and again, Mr. Trump was calling the shots. Some House Republicans even suggested handing the gavel to their unofficial leader, Mr. Trump, before he stepped in to try to anoint Representative Jim Jordan, Republican of Ohio, with an effusive endorsement that dwelt heavily on the congressman’s high school and college wrestling records.Lurking next is mid-November, when funding for the federal government expires and Mr. Trump’s policy demands will overtake the debate in Congress: halting U.S. military assistance to Ukraine, stiffening border controls and neutering the Justice Department as it pursues felony prosecutions that threaten Mr. Trump’s grip on the reins of his party — and also his freedom.U.S. Border Patrol agents patrolling for migrants in La Grulla, Texas, in 2017. David Blight, a professor at Yale University who specializes in the dissolution of American unity before the Civil War, struggled for a precedent.“Let’s think of Nixon: What influence did he really have in Washington? He got on TV, did the Frost interviews, but real influence on the Republican Party? No. They tried to become something other than the Nixon Party,” Mr. Blight said.“I don’t know of another analogy except in authoritarian regimes elsewhere,” he concluded, pointing to on-again, off-again dictatorships in Africa and South America and to the attempted returns of Oliver Cromwell and Napoleon Bonaparte.But an extraordinary vacuum of leadership has given the former president an in, and he has taken it with zeal. The Republican speaker’s chair is vacant, swept clean by internecine conflict. The Senate Republican leader, Mitch McConnell of Kentucky, is diminished by age, health issues and a Senate Republican Conference increasingly willing to challenge his authority.And the Democrats, led by an aging and soft-spoken president who is temperamentally Mr. Trump’s opposite, are facing issues they cannot solve on their own but without partners across the aisle to help address, including a broken immigration system, the stalled war in Ukraine, crime, labor unrest and economic uncertainty.The White House has struggled to control the narrative on recent events — Mr. Biden insisted, for instance, that his administration’s decision to waive more than 20 federal laws and regulations and resume construction of a border wall was merely the fulfillment of a legally binding appropriation signed into law in 2019 — even as his secretary of Homeland Security, Alejandro Mayorkas, attested in writing to “an acute and immediate need to construct physical barriers and roads in the vicinity of the border of the United States in order to prevent unlawful entries into the United States.”President Joe Biden resumed construction of a border wall that will always be stamped with Mr. Trump’s name and restarted deporting Venezuelan migrants, leading to a struggle to control the narrative on recent events.Doug Mills/The New York TimesBut Mr. Trump’s presence looms undeniably large. A chorus on the right embraced the border decision, claiming “Trump was right” as it still sank in among Democrats. Representative Alexandria Ocasio-Cortez of New York, a leading voice on the Democratic left, dismissed the excuse that the administration was somehow “required to expand construction of the border wall.”“The president needs to take responsibility for this decision and reverse course,” she wrote Thursday evening.Immigrant rights groups are beginning to speak out, using the same accusations of cruelty and callousness toward Mr. Biden that they routinely used against Mr. Trump.Mr. Trump’s endorsement of Mr. Jordan may have given the combative Ohio Republican an edge over the House majority leader, Representative Steve Scalise of Louisiana, in his quest for the speakership, but Mr. Jordan still found himself on Fox News praising Mr. Trump as the best president of his lifetime and the likely next president, to head off suggestions from colleagues that the former president would be a better leader for the House.All of this was extraordinary for a man who is, at this very moment, on civil trial in New York for business fraud, whose co-defendants go on trial in Fulton County, Ga., within weeks on charges that they conspired with him to overturn a presidential election, and whose lawyers are maneuvering to delay or dismiss three felony trials, any of which could put him behind bars.His own former lawyer, Ty Cobb, told a panel at the University of Chicago’s Institute of Politics this week that Mr. Trump has no legal defense in the federal cases he faces. And, Mr. Cobb added, given federal sentencing guidelines, “a judge is going to have to depart pretty aggressively, under difficult circumstances, if Trump’s convicted, to keep him out of jail.”Yet turmoil has always been an asset to Mr. Trump, a cauldron into which he has always been more than willing to plunge.He did nothing to save Mr. McCarthy, showing no appreciation for the man he once called “my Kevin,” and who rescued him at perhaps his darkest political moment, when even Mr. McConnell was suggesting Mr. Trump face criminal charges for a Capitol riot he was “practically and morally responsible for provoking.” The former president basked briefly in the accolades of his House Republican acolytes who floated his name for speaker before ending such talk with his endorsement of Mr. Jordan.Kevin McCarthy addressed reporters after being ousted as speaker on Tuesday.Tom Brenner for The New York TimesFor now, much of this is only theater. But when a stopgap spending bill expires in mid-November, fealty to Mr. Trump will have real consequences. The next speaker will still be facing a Democratic Senate and president, but will also face the impossible demands dictated by Mr. Trump to his loyal troops in the House.As the migrant crisis worsens in Democratic cities, Mr. Biden could well be pushed further in Mr. Trump’s direction on new border controls. New York Mayor Eric Adams traveled to Mexico this week with a message to deter migrants from coming to the United States. Chicago’s young and liberal mayor, Brandon Johnson, said Wednesday he would also travel to see the porous frontier with Mexico “firsthand,” as migrant buses reach his city by the dozen each day.Mr. Trump’s influence could also imperil Ukraine in its defensive war against Russia.The 45-day measure to keep the government open dropped additional military aid to Ukraine, and supporters of such aid will be hard-pressed to resume the flow through the next spending measures. Mr. Trump’s “America First” mantra was long dismissed by critics as an isolationism that leaned the country toward Vladimir V. Putin’s Russia.Ending American assistance to a Ukraine battling an invading army from Moscow would be the apotheosis of Trumpist foreign policy — and could be brought about even without Mr. Trump in the White House.But for all those possible Republican victories, Mr. Trump’s most pressing personal demand — defunding the prosecutions of him — almost certainly cannot be met, raising once again the prospect of a pointless government shutdown.At some point, Republicans in Washington may have to choose between Mr. Trump and governance.     Scalise and Jordan Seek House Speaker Backing as Trump Hangs Over Race

    The two lawmakers sought support from members of their fractured party as the former president threatened to get involved in a potentially fierce struggle over who will lead the House.The two leading candidates to become the next Republican speaker of the House worked the phones and the halls of the Capitol on Thursday, vying for support from within their party’s fractured ranks as the chamber remained in a state of paralysis after the ouster of Representative Kevin McCarthy of California.Representatives Steve Scalise, the majority leader, and Jim Jordan, the Judiciary Committee chairman, had each landed more than a dozen endorsements by the afternoon as they raced toward a vote of Republicans tentatively scheduled for Tuesday. An election on the House floor could follow the next day, though the process could stretch much longer if no consensus can be reached.Far from the Capitol, former President Donald J. Trump, whose far-right acolytes in Congress helped lead the rebellion that has plunged the House into chaos, weighed in on what could become an epic struggle.Representative Troy Nehls of Texas wrote Thursday evening on X, formerly Twitter, that he had spoken with Mr. Trump, and that he had said he was endorsing Mr. Jordan. “I believe Congress should listen to the leader of our party,” Mr. Nehls said. “I fully support Jim Jordan for Speaker of the House.”Mr. Jordan picked up an important G.O.P. backer and cleared a potential challenger from the field with the endorsement of Representative Byron Donalds of Florida, who had previously been exploring his own run for speaker, according to a person familiar with his calls to lawmakers. Mr. Donalds said on the social media site X that Mr. Jordan “has my full support to become the next Speaker of the House!”Both Mr. Scalise and Mr. Jordan are faced with the difficult challenge of attempting to unite a fractious Republican conference that is reeling after Mr. McCarthy’s removal from the speakership.For Mr. Jordan, an Ohioan and co-founder of the ultraconservative House Freedom Caucus, the task will be to convince more mainstream Republicans that he can govern and not simply tear things down. He met on Thursday with members of the Main Street Caucus, a group of business-minded Republicans.For Mr. Scalise, a Louisianian who has won conference elections before as majority leader, the challenge will be to stay one step ahead of Mr. Jordan, and make better inroads with the right wing of the party.Both men are considered further to the right than Mr. McCarthy, a point Representative Matt Gaetz of Florida, who led the drive to oust Mr. McCarthy, has noted with a sense of satisfaction.“If it’s Speaker Jim Jordan or Speaker Steve Scalise, there will be very few conservatives in the country who don’t see that as a monumental upgrade over Speaker McCarthy,” Mr. Gaetz said on Newsmax.Casting a long shadow over the race is Mr. Trump, the G.O.P. presidential front-runner who holds heavy sway among congressional Republicans because of his strong standing with the party base, including many of their constituents.Some right-wing Republicans had been encouraging Mr. Trump to make a run for speaker himself, though the party’s current conference rules would block him from doing so because he is under multiple felony indictments and facing the possibility of significant prison time. Speaking Wednesday outside a Manhattan courthouse where he is facing a civil fraud case, Mr. Trump seemed to enjoy dangling the possibility of a run for speaker, telling reporters: “Lot of people have been calling me about speaker. All I can say is we’ll do whatever is best for the country and for the Republican Party.”“If I can help them during the process,” he added, “I’ll do it.”Back in the halls of the Congress, a serious race was taking shape.Mr. Scalise, who has been in leadership since 2014, has built relationships across the Republican conference. He has been quietly securing commitments through one-on-one calls with members.On such calls seeking support, Mr. Scalise has emphasized that he is second only to Mr. McCarthy in fund-raising prowess, and he has locked up a string of commitments from the south and the Midwest, according to a person familiar with his private calls, who described them on the condition of anonymity.“Not only is Steve a principled conservative, he has overcome adversity far beyond the infighting in our conference right now,” said Representative Ashley Hinson of Iowa, who endorsed Mr. Scalise after speaking with him.One clear point of contrast between Mr. Scalise and Mr. Jordan is their dueling positions on continued aid to Ukraine for its war against Russian aggression, which has become increasingly politicized and is now regarded by many Republicans as toxic.Mr. Jordan was one of 117 Republicans who voted last week against continuing a program to train and equip Ukrainian troops, while Mr. Scalise sided with 101 Republicans in supporting it.“Why should we be sending American tax dollars to Ukraine when we don’t even know what the goal is?” Mr. Jordan said Thursday on Fox News. “No one can tell me what the objective is.”Several Republicans said they were waiting to hear more from the candidates before deciding whom to support.Representative Marc Molinaro of New York said he had spoken with both Mr. Scalise and Mr. Jordan by phone.“There really wasn’t any one person in Congress who worked harder to help me get to Congress or to earn my support than Kevin McCarthy,” Mr. Molinaro said.“We now have individuals who have a week,” he added. “And so I’m going to observe, I’m going to listen, and I’m going to demand that members like me and the people we represent have a seat at the table, and then make a decision.”Robert Jimison More

Trump and his allies in Georgia accused Representative Jim Jordan of Ohio of trying to obstruct her prosecution of the case in a sharply worded letter she sent on Thursday.Soon after the district attorney, Fani T. Willis, a Democrat, announced last month that she was bringing a racketeering case against Mr. Trump and 18 other defendants for their efforts to overturn the results of the 2020 presidential election in Georgia, Mr. Jordan, a Republican and chairman of the House Judiciary Committee, said that he was going to investigate Ms. Willis over whether her prosecution of Mr. Trump was politically motivated.In her letter, Ms. Willis accused Mr. Jordan of trying “to obstruct a Georgia criminal proceeding and to advance outrageous partisan misrepresentations,” and of not understanding how the state’s racketeering law works.“Your attempt to invoke congressional authority to intrude upon and interfere with an active criminal case in Georgia is flagrantly at odds with the Constitution,” she added. “The defendants in this case have been charged under state law with committing state crimes. There is absolutely no support for Congress purporting to second guess or somehow supervise an ongoing Georgia criminal investigation and prosecution.”The letter came as the defendants and the prosecution continued sparring in legal filings over where and when the trial would take place. In a new filing, Mark Meadows, a defendant, who served as the White House chief of staff under Mr. Trump, was seeking a stay of the proceedings in state court until a judge ruled on his motion to move his case to federal court.The Georgia case is one of four criminal indictments that have been brought against Mr. Trump this year; Mr. Jordan’s investigation of Ms. Willis is the latest example of House Republicans using their power in Congress to try to derail efforts to prosecute the former president.When he announced his inquiry last month, Mr. Jordan, a close Trump ally, said it would look for any evidence of communication between Ms. Willis and the Biden administration and examine her office’s use of federal grant money.While Mr. Jordan expressed concerns that former federal officials were being unfairly targeted in a state prosecution, some of the issues he raised had little to do with the underlying facts of the investigation. For example, in a letter to Ms. Willis, he said her new campaign website had included a reference to a New York Times article that mentioned the Trump investigation.Ms. Willis’s response is the latest sign that she will not take attacks on her office and the investigation quietly — a striking difference in style from that of Jack Smith, the more reserved and laconic special prosecutor handling the two federal criminal cases against Mr. Trump.She has a track record as a pugnacious, law-and-order prosecutor, and is pursuing racketeering cases not only against the former president and his allies, but a number of high-profile Atlanta rappers accused of operating a criminal gang.In a heated email exchange in July over the terms of Gov. Brian Kemp, a Republican, providing testimony in her investigation, Ms. Willis called the governor’s lawyer, Brian McEvoy, “wrong and confused” and “rude,” after Mr. McEvoy expressed frustration over mixed signals he said he had received from her office, and asserted that there had been “leaks” associated with her investigation.“You have taken my kindness as weakness,” she wrote, adding: “Despite your disdain this investigation continues and will not be derailed by anyone’s antics.”On Thursday, scores of Trump supporters gathered near the State Capitol for a news conference and rally, demanding that the state legislature call a special session to defund Ms. Willis’s office. The effort, led by Colton Moore, a freshman state senator, has little support among Mr. Moore’s fellow lawmakers and is almost certain to fail.Mr. Moore, who has drawn attention and praise in recent weeks from news outlets supportive of Mr. Trump, said that Ms. Willis was engaged in “politicization” of the justice system. His constituents, he said, “don’t want their tax dollars funding this type of corrupt government power.”In her letter to Mr. Jordan, Ms. Willis invited him to purchase a book about racketeering statutes written by one her fellow prosecutors on the Trump case, John Floyd, titled “RICO State by State.”“As a non-member of the bar,” she wrote, “you can purchase a copy for two hundred forty-nine dollars.” More

    Behold the Free Speech Chutzpah of the Republican Party

    A solid majority of Republicans continues to believe that Donald Trump won the 2020 election — evidence to the contrary notwithstanding. Virtually all Democrats believe that Trump did, in fact, lose the 2020 election and that Biden won fair and square.Now in an extraordinary display of chutzpah, Representative Jim Jordan, Republican of Ohio, and fellow Republicans on the House Judiciary Committee have accused Democrats of violating the First Amendment rights of election deniers.In a June 26, 2023, interim staff report, Jordan and his colleagues charged that the Biden administration “colluded with big tech and ‘disinformation’ partners to censor” those who claimed that Trump won in 2020.The report, “The Weaponization of CISA: How a ‘Cybersecurity’ Agency Colluded With Big Tech and ‘Disinformation’ Partners to Censor Americans,” makes the argument thatThe First Amendment recognizes that no person or entity has a monopoly on the truth, and that the “truth” of today can quickly become the “misinformation” of tomorrow. Labeling speech “misinformation” or “disinformation” does not strip it of its First Amendment protection. As such, under the Constitution, the federal government is strictly prohibited from censoring Americans’ political speech.These civil libertarian claims of unconstitutional suppression of speech come from the same Republican Party that is leading the charge to censor the teaching of what it calls “divisive concepts” about race; the same party that expelled two Democratic members of the Tennessee state legislature who loudly called for more gun control after a school shooting; the same party that threatens to impeach a liberal judge in North Carolina for speaking out about racial bias; the same party that has aided and abetted book banning in red states across the country.In other words, it is Republicans who have become the driving force in deploying censorship to silence the opposition, simultaneously claiming that their own First Amendment rights are threatened by Democrats.One of the most egregious examples of Republican censorship is taking place in North Carolina, where a state judicial commission has initiated an investigation of Anita Earls, a Black State Supreme Court justice, because she publicly called for increased diversity in the court system.A June 2 Law360 piece examined the racial and gender composition of the North Carolina judiciary and found “that out of 22 appellate jurists — seven state Supreme Court justices and 15 Court of Appeals judges — 64 percent are male and 86 percent are white.”The article then quoted Earls: “It has been shown by social scientists that diverse decision-making bodies do a better job. … I really feel like everyone’s voice needs to be heard, and if you don’t have a diverse judicial system, perspectives and views are not being heard, you’re not making decisions that are in the interests of the entire society. And I feel like that’s wrong.”On Aug. 15, the North Carolina Judicial Standards Commission notified Earls that it was opening an investigation “based on an interview you since gave to the media in which you appear to allege that your Supreme Court colleagues are acting out of racial, gender, and/or political bias in some of their decision-making.”Earls’s interview, the notification letter continued, “potentially violates Canon 2A of the Code of Judicial Conduct which requires a judge to conduct herself ‘at all times in a manner which promotes public confidence in the integrity and impartiality of the judiciary.’”On Aug. 29, Earls filed suit in federal court charging that there is “an ongoing campaign on the part of the North Carolina Judicial Standards Commission to stifle” her First Amendment free-speech rights “and expose her to punishment that ranges from a letter of caution that becomes part of a permanent file available to any entity conducting a background check to removal from the bench.”At the center of Republican efforts to censor ideological adversaries is an extensive drive to regulate what is taught in public schools and colleges.In an Education Week article published last year, “Here’s the Long List of Topics Republicans Want Banned From the Classroom,” Sarah Schwartz and Eesha Pendharkar provided a laundry list of Republican state laws regulating education:Since January 2021, 14 states have passed into law what’s popularly referred to as “anti-critical race theory” legislation. These laws and orders, combined with local actions to restrict certain types of instruction, now impact more than one out of every three children in the country, according to a recent study from UCLA.Schwartz and Pendharkar also noted that “many of these new bills propose withholding funding from school districts that don’t comply with these regulations. Some, though, would allow parents to sue individual educators who provide banned material to students, potentially collecting thousands of dollars.”What’s more, “Most prohibited teaching a list of ‘divisive concepts,’ which originally appeared in an executive order signed by then-President Donald Trump in fall 2020.”The Trump order, “Combating Race and Sex Stereotyping,” included prohibitions on the following “divisive concepts”:That an individual, by virtue of his or her race or sex, bears responsibility for actions committed in the past by other members of the same race or sex; that any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of his or her race or sex; or that meritocracy or traits such as a hard work ethic are racist or sexist, or were created by a particular race to oppress another race.The censorship effort has been quite successful.In a February 2022 article, “New Critical Race Theory Laws Have Teachers Scared, Confused and Self-censoring,” The Washington Post reported that “in 13 states, new laws or directives govern how race can be taught in schools, in some cases creating reporting systems for complaints. The result, teachers and principals say, is a climate of fear around how to comply with rules they often do not understand.”Larry Summers, a former president of Harvard who is a professor of economics there, argued in an email that issues of free speech are not easily resolved.The problem, Summers wrote, “comes from both sides. Ron DeSantis’s efforts to limit what he regards as critical race theory is deplorable as are efforts on Ivy League campuses to discredit and devalue those with unfashionable beliefs about diversity or the role of genes or things military.”But, Summers continued,It’s sometimes a bit harder than the good guys make out. What about cultures of intolerance where those who, for example, believe in genetic determinism are shunned, and graduate students all exhibit their academic freedom rights to not be the teaching fellows of faculty with those beliefs. Does ideological diversity mean philosophy departments need to treat Ayn Rand with dignity or biology departments need to hear out creationism?“What about professional schools where professional ethics are part of what is being instilled?” Summers asked:Could a law school consider hiring a lawyer who, while in government, defended coercive interrogation practices? Under what circumstances should one accept, perhaps insist on university leaders criticizing speech? I have been fond of saying academic freedom does not include freedom from criticism but when should leaders speak out? Was I right to condemn calls for divesting in Israel as antisemitic in effect, if not intent? When should speech be attacked?There is, at this moment, a nascent mobilization on many campuses of organizations determined to defend free speech rights, to reject the sanctioning of professors and students, and to ensure the safety of controversial speakers.Graduates of 22 colleges and universities have formed branches of the Alumni Free Speech Alliance “to support free speech, academic freedom, and viewpoint diversity.”At Harvard, 133 members of the faculty have joined the Council on Academic Freedom at Harvard, dedicated to upholding the free speech guidelines adopted by the university in 1990:Free speech is uniquely important to the university because we are a community committed to reason and rational discourse. Free interchange of ideas is vital for our primary function of discovering and disseminating ideas through research, teaching, and learning.Steven Pinker, a psychology professor at the school and a founder of the group, wrote in an email that achieving this goal is much tougher than generally believed:To understand the recent assaults on free speech, we need to flip the question: Not why diverse opinions are being suppressed, but why they are tolerated. Freedom of speech is an exotic, counterintuitive concept. What’s intuitive is that the people who disagree with me are spreading dangerous falsehoods and must be stifled for the greater good. The realization that everyone feels this way, that all humans are fallible, that however confident I am in my beliefs, I may be wrong, and that the only way we can collectively approach the truth is to allow opinions to be expressed and then evaluate them, requires feats of abstraction and self-control.The example I cited at the beginning of this column — the charge that the Biden administration “colluded with big tech and ‘disinformation’ partners to censor” the claims of election deniers — has proved to be a case study of a successful Republican tactic on several fronts.Republicans claimed the moral high ground as the victims of censorship, throwing their adversaries on the defensive and quieting their opponents.On June 6, The Washington Post reported, in “These Academics Studied Falsehoods Spread by Trump. Now the G.O.P. Wants Answers,” thatThe pressure has forced some researchers to change their approach or step back, even as disinformation is rising ahead of the 2024 election. As artificial intelligence makes deception easier and platforms relax their rules on political hoaxes, industry veterans say they fear that young scholars will avoid studying disinformation.One of the underlying issues in the free speech debate is the unequal distribution of power. Paul Frymer, a political scientist at Princeton, raised a question in reply to my email: “I wonder if the century-long standard for why we defend free speech — that we need a fairly absolute marketplace of ideas to allow all ideas to be heard (with a few exceptions), deliberated upon, and that the truth will ultimately win out — is a bit dated in this modern era of social media, algorithms and most importantly profound corporate power.”While there has always been a corporate skew to speech, Frymer argued,in the modern era, technology enables such an overwhelming drowning out of different ideas. How long are we hanging on to the protection of a hypothetical — that someone will find the truth on the 40th page of a Google search or a podcast with no corporate backing? How long do we defend a hypothetical when the reality is so strongly skewed toward the suppression of the meaningful exercise of free speech?Frymer contended thatWe do seem to need regulation of speech, in some form, more than ever. I’m not convinced we can’t find a way to do it that would enable our society to be more just and informed. The stakes — the fragility of democracy, the increasing hatred and violence on the basis of demographic categories, and the health of our planet — are extremely high to defend a single idea with no compromise.Frymer suggested that ultimatelyWe can’t consider free speech without at least some understanding of power. We can’t assume in all contexts that the truth will ever come out; unregulated speech does not mean free speech.From a different vantage point, Robert C. Post, a law professor at Yale, argued in an email that the censorship/free speech debate has run amok:It certainly has gone haywire. The way I understand it is that freedom of speech has not been a principled commitment, but has been used instrumentally to attain other political ends. The very folks who were so active in demanding freedom of speech in universities have turned around and imposed unconscionable censorship on schools and libraries. The very folks who have demanded a freedom of speech for minority groups have sought to suppress offensive and racist speech.The framing in the current debate over free speech and the First Amendment, Post contends, is dangerously off-kilter. He sent me an article he wrote that will be published shortly by the scholarly journal Daedalus, “The Unfortunate Consequences of a Misguided Free Speech Principle.” In it, he notes that the issues are not just more complex than generally recognized, but in fact distorted by false assumptions.Post makes the case that there is “a widespread tendency to conceptualize the problem as one of free speech. We imagine that the crisis would be resolved if only we could speak more freely.” In fact, he writes, “the difficulty we face is not one of free speech, but of politics. Our capacity to speak has been disrupted because our politics has become diseased.”He specifically faults a widely read March 2022 Times editorial, “America Has a Free Speech Problem,” that warnedAmericans are losing hold of a fundamental right as citizens of a free country: the right to speak their minds and voice their opinions in public without fear of being shamed or shunned.Post observes thatNo such right exists in any well-ordered society. If I walk into a room shouting outrageous slurs, I should expect to be shamed and shunned. Only a demoralized community would passively accept irresponsibly hurtful speech.People constantly “balance self-restraint against the need for candor.”Arguments that the protection of free speech is crucial to the preservation of democracy, Post maintains, “encourage us to forget that the fundamental point of public discourse is the political legitimation of the state. Our public discourse is successful when it produces a healthy public opinion capable of making state power answerable to politics.”In Post’s view, polarization “is not a simple question of speech. It is the corrosive dissolution of the political commitments by which Americans have forged themselves into a single nation. If we conceptualize public discourse as a social practice, we can see that its failures stem from this fundamental problem.”In this context, Post concludes,Politics is possible only when diverse persons agree to be bound by a common fate. Lacking that fundamental commitment, politics can easily slide into an existential struggle for survival that is the equivalent of war. We can too easily come to imagine our opponents as enemies, whose victory would mean the collapse of the nation.In such circumstances, Post continues,Political debate can no longer produce a healthy and legitimate democratic will. However inclusive we may make our public discourse, however tolerant of the infinite realms of potential diversity we may become, the social practice of public discourse will fail to achieve its purpose so long as we no longer experience ourselves as tied to a common destiny.“We cannot now speak to each other because something has already gone violently wrong with our political community,” Post writes. “The underlying issue is not our speech, but our politics. So long as we insist on allegiance to a mythical free speech principle that exists immaculately distinct from the concrete social practices, we shall look for solutions in all the wrong places.”The Times is committed to publishing a diversity of letters to the editor.     Do You Know a Politically Motived Prosecution When You See One?

    As the criminal indictments of Donald Trump continue to pile up like boxes in a Mar-a-Lago bathroom, the former president’s defenders have settled on a response: They don’t claim their man is innocent of the scores of federal and state charges against him — a tough case to make under the circumstances. Instead they accuse the Biden administration and Democratic prosecutors of politicizing law enforcement and cooking up an insurance policy to protect President Biden, who trails Mr. Trump in some polls about a very possible 2024 rematch.“So what do they do now?” House Speaker Kevin McCarthy asked last week, after Mr. Trump announced that he had received a second target letter from the special counsel Jack Smith, this time over his role in the Jan. 6 attack. “Weaponize government to go after their No. 1 opponent.”Gov. Ron DeSantis, one of the few plausible Republican nominees besides Mr. Trump, warned that the government is “criminalizing political differences.”It’s not only about Mr. Trump; griping about politicized law enforcement has become a cottage industry on the right these days. No sooner did Republicans take back the House of Representatives than they formed a Select Subcommittee on the Weaponization of the Federal Government, which meets regularly to air grievances and grill witnesses about their supposed anti-conservative animus, including Christopher Wray, the (Trump-nominated) F.B.I. director.If you’re feeling bewildered by all the claims and counterclaims of politicization, you’re not alone. Take the F.B.I.’s probe of ties between Russia and the 2016 Trump campaign, which is still being hashed out in the halls of Congress seven years later: In February, Democratic lawmakers demanded an investigation of the investigators who investigated the investigators who were previously investigated for their investigation of a transnational plot to interfere in a presidential election. Got that?But even if the charge of politicized justice is levied by a bad-faith buffoon like Representative Jim Jordan of Ohio, the chairman of the weaponization subcommittee, it is a profoundly important one. There is no simple way to separate politics completely from law enforcement. The Justice Department will always be led by a political appointee, and most state and local prosecutors are elected. If Americans are going to have faith in the fairness of their justice system, every effort must be taken to assure the public that political motives are not infecting prosecutors’ charging decisions. That means extremely clear rules for investigators and prosecutors and eternal vigilance for the rest of us.At the same time, politically powerful people must be held to the same rules as everyone else, even if they happen to be of a different party from those investigating them. So how to distinguish an investigation or prosecution based solely on the facts from one motivated improperly by politics?Sometimes the investigators make it easy by just coming out and admitting that it’s really political. Mr. McCarthy did that in 2015, when he bragged on Fox News that the House Benghazi hearings had knocked a seemingly “unbeatable” Hillary Clinton down in the polls. More recently, James Comer of Kentucky, who heads the House committee that is relentlessly investigating Hunter Biden, made a similar argument about the effect of the committee’s work on President Biden’s political fortunes. (Mr. Comer tried to walk back his comment a day later.)More often, though, it takes some work to determine whether an investigation or prosecution is on the level.The key thing to remember is that even if the subject is a politically powerful person or the outcome of a trial could have a political impact, that doesn’t necessarily mean the action itself is political. To assume otherwise is to “immunize all high-ranking powerful political people from ever being held accountable for the wrongful things they do,” said Kristy Parker, a lawyer with the advocacy group Protect Democracy. “And if you do that, you subvert the idea that this is a rule-of-law society where everybody is subject to equal justice, and at the same time you remove from the public the ability to impose any accountability for misconduct, which enables it to happen again.”In May, Protect Democracy published a very useful report, co-written by Ms. Parker, laying out several factors that help the public assess whether a prosecution is political.First, what is the case about? Is there straightforward evidence of criminal behavior by a politician? Have people who are not powerful politicians been prosecuted in the past for similar behavior?Second, what are top law-enforcement officials saying? Is the president respecting due process, or is he demanding investigations or prosecutions of specific people? Is he keeping his distance from the case, or is he publicly attacking prosecutors, judges and jurors? Is the attorney general staying quiet, or is he offering public opinions on the guilt of the accused?Third, is the Justice Department following its internal procedures and guidelines for walling off political interference? Most of these guidelines arose in the aftermath of the Watergate scandal, during which President Richard Nixon ordered the department to go after his political enemies and later obstructed the investigation into his own behavior. Until recently, the guidelines were observed by presidents and attorneys general of both parties.Finally, how have other institutions responded? Did judges and juries follow proper procedure in the case, and did they agree that the defendant was guilty? Did an agency’s inspector general find any wrongdoing by investigators or prosecutors?None of these factors are decisive by themselves. An investigation might take a novel legal approach; an honest case may still lose in court. But considering them together makes it easier to identify when law enforcement has been weaponized for political ends.To see how it works in practice, let’s take a closer look at two recent examples: first, the federal investigations into Mr. Trump’s withholding of classified documents and his attempts to overturn the 2020 election and, second, the investigation by John Durham into the F.B.I.’s Russia probe.In the first example, the Justice Department and the F.B.I., under Attorney General Merrick Garland, waited more than a year to pursue an investigation of Mr. Trump’s role in the Jan. 6 attack with any urgency — largely out of the fear that they would be seen as politically motivated.With a punctiliousness that has exasperated many liberals, Mr. Garland has kept his mouth shut about Mr. Smith’s prosecutions, except to say that the department would pursue anyone responsible for the Jan. 6 attack. Mr. Garland almost never mentions Mr. Trump by name. And Mr. Smith has been silent outside of the news conference he held last month to announce the charges in the documents case.In that case, Mr. Smith presented a tower of evidence that Mr. Trump violated multiple federal laws. There are also many examples of nonpowerful people — say, Reality Winner — who were prosecuted, convicted and sentenced to years in prison for leaking a single classified document. Mr. Trump kept dozens. Even a federal judge who was earlier accused of being too accommodating to Mr. Trump has effectively signaled the documents case is legitimate, setting a trial date for May and refusing the Trump team’s demand to delay it until after the 2024 election.In the Jan. 6 case, the government has already won convictions against hundreds of people for their roles in the Capitol attack, many involving some of the same laws identified in Mr. Smith’s latest target letter to Mr. Trump.“Prosecutors will hear all sorts of allegations that it’s all political, that it will damage the republic for all of history,” Ms. Parker, who previously worked as a federal prosecutor, told me. “But they have to charge through that if what they’ve got is a case that on the facts and law would be brought against anybody else.”President Biden’s behavior has been more of a mixed bag. He and his advisers are keen to advertise his disciplined silence about Mr. Trump’s legal travails. “I have never once — not one single time — suggested to the Justice Department what they should do or not do,” he said in June. Yet he has commented publicly and inappropriately on both investigations over the years.It’s impossible to justify these remarks, but it is possible to consider them in light of the other factors above and to decide that Mr. Smith’s investigations are not infected with a political motive.Contrast that with the investigation by John Durham, the federal prosecutor appointed by Mr. Trump’s attorney general Bill Barr in 2019 to investigate the origins of the F.B.I.’s Trump-Russia probe.Even before it began, the Durham investigation was suffused with clear political bias. Mr. Trump had repeatedly attacked the F.B.I. over its handling of the Russia probe and called for an investigation, breaching the traditional separation between the White House and the Justice Department. Mr. Barr had also spoken publicly in ways that seemed to prejudge the outcome of any investigation and inserted himself into an investigation focused on absolving Mr. Trump of wrongdoing.Not every investigation or prosecution will offer such clear-cut evidence of the presence or absence of political motivations. But as with everything relating to Mr. Trump, one generally doesn’t have to look far to find his pursuit of vengeance; he has taken to describing himself as the “retribution” of his followers. If he wins, he has promised to obliterate the Justice Department’s independence from the presidency and “go after” Mr. Biden and “the entire Biden crime family.”For the moment, at least, Mr. Trump is not the prosecutor but the prosecuted. And there should be no fear of pursuing the cases against him — especially those pertaining to his attempts to overturn his loss in 2020 — wherever they lead.“If we can’t bring those kinds of cases just because the person is politically powerful, how do we say we have a democracy?” asked Ms. Parker. “Because in that case we have people who are above the law, and they are so far above the law that they can destroy the central feature of democracy, which is elections, in which the people choose their leaders.”Source photograph by pepifoto, via Getty Images.The Times is committed to publishing a diversity of letters to the editor.     What to Watch for as FBI Director Christopher Wray Testifies Before Congress

    Stoked by former President Donald J. Trump, congressional Republicans have been trying to undermine the F.B.I.’s legitimacy with the public.Christopher A. Wray, the F.B.I. director, confronted an extraordinary political storm on Wednesday in testifying before Congress, with Republicans who once defended the bureau now denouncing it as a weapon wielded against former President Donald J. Trump and his supporters.Mr. Wray, who is appearing for the first time before the House Judiciary Committee since Republicans won the House, is most likely girding for the worst. The committee, led by Representative Jim Jordan, Republican of Ohio, has said it “will examine the politicization” of the F.B.I. under Mr. Wray and Attorney General Merrick B. Garland.In his opening statement, Mr. Jordan accused the bureau of a litany of abuses. He urged Democratic lawmakers to join Republicans in blocking the reauthorization of a warrantless surveillance program known as Section 702 and raised questions about funding for the bureau’s new headquarters.“I hope they will work with us in the appropriations process to stop the weaponization of the government against the American people and end this double standard that exists now in our justice system,” he said.Anticipating the questioning to come, the top Democrat on the committee, Representative Jerrold Nadler of New York, described the hearing as “little more than performance art.” He countered that Republicans had initiated an array of “baseless investigations” in a bid to “protect Donald Trump from the consequences of his actions.”Stoked by the former president, congressional Republicans have adopted an increasingly caustic tone in their criticism of the country’s premier law enforcement agency, trying to damage its legitimacy and to undermine its standing with the public.That criticism was once trained on the bureau’s investigation into the Trump campaign’s ties to Russia during the 2016 election. It is now focused on other flash points: Mr. Trump’s indictment in an inquiry into his handling of classified documents; the F.B.I.’s role in the search of his estate in Florida in August, as part of that inquiry; unfounded claims of a “two-tiered” system of justice favoring Democrats; and the Justice Department’s plea agreement with President Biden’s son, Hunter Biden.So far, Republicans have not provided evidence that the F.B.I. and Mr. Wray are partisan, but they will try to catch him off balance and seed doubt about his motives.Here is what to look for:How will Mr. Wray respond?Mr. Wray infuriated Mr. Trump, who viewed the director’s declaration of independence as disloyalty. But Mr. Wray has previously testified before Congress, steadfastly defending the F.B.I. as nonpartisan and taking fire on Twitter from Mr. Trump, while he was president.Mr. Trump appointed Mr. Wray in 2017 after he fired James B. Comey, who as F.B.I. director had opened the Russia investigation. Since then, Mr. Wray has been under constant pressure from Republicans, who have simultaneously decried lawlessness in cities run by Democrats while attacking the F.B.I.’s role in political investigations.In the past, Mr. Wray has responded to attacks by parsing his words carefully. In his opening statement, he forcibly defended the F.B.I. and declined to discuss open investigations, which is the policy of the Justice Department.“I want to talk about the sheer breadth and impact of the work the F.B.I.’s 38,000 employees are doing, each and every day,” he said, citing the bureau’s work in addressing violent crime, fentanyl trafficking and efforts by China to steal trade secrets. “Because the work the men and women of the F.B.I. do to protect the American people goes way beyond the one or two investigations that seem to capture all the headlines.”Republicans are going to war.Mr. Trump and his supporters — as well as a vocal group of former F.B.I. officials who have aligned themselves with Republicans in Congress — believe the government is trying to silence and punish conservatives and see the bureau as a dangerous extension of that effort.Case in point: In January, House Republicans voted to investigate law enforcement, creating the Select Subcommittee on the Weaponization of the Federal Government.Republicans have claimed that the F.B.I. prodded Twitter to discriminate against their party as well as conservative or right-wing protesters at school board meetings and abortion clinics. Those issues have proved to be powerful drivers of voter turnout in the party’s pro-Trump base.The subcommittee is led by Mr. Jordan, a close ally of Mr. Trump’s.Last month, House Republicans on the Oversight Committee moved to hold Mr. Wray in contempt of Congress. But they called off a planned vote days later after the bureau said it would make available a document at the center of their dispute, involving an unverified allegation of bribery against Mr. Biden when he was vice president.Mr. Trump and his supporters have promoted the idea that the Mar-a-Lago search was intended to neutralize his electoral chances.Mr. Trump and his allies have raged at his indictment and the search of Mar-a-Lago in August, when F.B.I. agents descended on his residence and uncovered hundreds of classified documents.The former president and his supporters have said that Mr. Trump declassified the records, meaning there was no misconduct to start, and that the search was an example of an uneven application of justice.But so far no evidence has emerged that the documents were declassified or that the search, which was approved by a federal judge, was improper or politically motivated. In fact, the search unfolded after Mr. Trump repeatedly resisted the government’s requests that he return the material.In recent weeks, Steven D’Antuono, the former top F.B.I. agent overseeing the documents case, testified behind closed doors before Mr. Jordan.Asked if “anyone was motivated by animus” in the documents investigation, Mr. D’Antuono said no, according to a transcript of his testimony.Mr. Trump appointed Mr. Wray in 2017 after he fired James B. Republicans hate it.Under the deal with the Justice Department, Mr. Biden agreed to plead guilty to misdemeanor counts of failing to pay his 2017 and 2018 taxes on time and to be sentenced to probation. The department also said it would not prosecute him for buying a handgun in 2018 during a period when he was using drugs.Republicans have assailed the deal, calling it too lenient, even though years of investigation by a Trump-appointed U.S. attorney found evidence to charge Mr. Biden only on the narrow tax and gun issues, rather than the wide-ranging international conspiracies peddled by Mr. Trump and his allies.That U.S. attorney, David C. Weiss, who signed off on the agreement, has also come under fire. On Monday, Mr. Weiss rebutted a key element of testimony to Congress by an Internal Revenue Service official who said that Mr. Weiss had complained about being blocked from pursuing more serious charges.Republicans will claim the Durham investigation showed that the F.B.I. was politically motivated in pursuing its Russia inquiry.A final report by John H. Durham, the Trump-era special counsel, looked at the origins of the F.B.I.’s investigation into any ties Mr. Trump’s campaign had with Russia but found no evidence of politically motivated misconduct.Still, Mr. Durham’s report has continued to fuel Republican claims of bias, with some accusing the F.B.I. of making moves motivated by political favoritism.That charge almost immediately resurfaced during Mr. Wray’s hearing. Mr. Durham’s “ lengthy report reluctantly concluded that the F.B.I. quote, failed uphold its mission of strict fidelity to the law,” Representative Mike Johnson, Republican of Louisiana, said shortly after Mr. Wray’s testimony began.Even as Mr. Trump and his loyalists had long insisted that Mr. Durham’s investigation would unearth a “deep state” conspiracy intended to damage him politically, Mr. Durham never charged high-level government officials.Instead, Mr. Durham developed only two peripheral cases involving accusations of making false statements, both of which ended in acquittals, while using his report to cite flaws in the F.B.I.’s early investigative steps that he attributed to confirmation bias.Will Americans trust the F.B.I.?Republicans have claimed the Justice Department is “weaponized” against conservatives, but the allegations that were brought forth by aggrieved former F.B.I. officials have foundered.Instead, Democratic investigators have uncovered that those former F.B.I. officials have trafficked in right-wing conspiracy theories, including about the Jan. 6, 2021, attack at the Capitol, and have received financial support from a top ally of Mr. Trump’s.In a heated exchange, Representative Matt Gaetz, Republican of Florida, said the American public trusted the F.B.I. more under J. Edgar Hoover, the bureau’s first director, than under the leadership of Mr. Wray. Mr. Wray countered that the number of F.B.I. applicants had surged in Mr. Gaetz’s home state. Mr. Gaetz said he was “deeply proud” of these people and “they deserve better than you.”Still, the back-and-forth is having an impact. Mr. D’Antuono, in his testimony, rebuffed allegations of political bias and rejected calls to defund the bureau — but expressed concern about the future.“In my opinion,” he said, “the more the American people hear about not trusting the F.B.I., it’s not a good day for this country.” More
