    G.O.P. Targets Researchers Who Study Disinformation Ahead of 2024 Election

    A legal campaign against universities and think tanks seeks to undermine the fight against false claims about elections, vaccines and other hot political topics.On Capitol Hill and in the courts, Republican lawmakers and activists are mounting a sweeping legal campaign against universities, think tanks and private companies that study the spread of disinformation, accusing them of colluding with the government to suppress conservative speech online.The effort has encumbered its targets with expansive requests for information and, in some cases, subpoenas — demanding notes, emails and other information related to social media companies and the government dating back to 2015. Complying has consumed time and resources and already affected the groups’ ability to do research and raise money, according to several people involved.They and others warned that the campaign undermined the fight against disinformation in American society when the problem is, by most accounts, on the rise — and when another presidential election is around the corner. Many of those behind the Republican effort had also joined former President Donald J. Trump in falsely challenging the outcome of the 2020 presidential election.“I think it’s quite obviously a cynical — and I would say wildly partisan — attempt to chill research,” said Jameel Jaffer, the executive director of Columbia University’s Knight First Amendment Institute, an organization that works to safeguard freedom of speech and the press.The House Judiciary Committee, which in January came under Republican majority control, has sent scores of letters and subpoenas to the researchers — only some of which have been made public. It has threatened legal action against those who have not responded quickly or fully enough.A conservative advocacy group led by Stephen Miller, the former adviser to Mr. Trump, filed a class-action lawsuit last month in U.S. District Court in Louisiana that echoes many of the committee’s accusations and focuses on some of the same defendants.Targets include Stanford, Clemson and New York Universities and the University of Washington; the Atlantic Council, the German Marshall Fund and the National Conference on Citizenship, all nonpartisan, nongovernmental organizations in Washington; the Wikimedia Foundation in San Francisco; and Graphika, a company that researches disinformation online.In a related line of inquiry, the committee has also issued a subpoena to the World Federation of Advertisers, a trade association, and the Global Alliance for Responsible Media it created. The committee’s Republican leaders have accused the groups of violating antitrust laws by conspiring to cut off advertising revenue for content researchers and tech companies found to be harmful.A House subcommittee was created to scrutinize what Republicans have charged is a government effort to silence conservatives. Kenny Holston/The New York TimesThe committee’s chairman, Representative Jim Jordan of Ohio, a close ally of Mr. Trump, has accused the organizations of “censorship of disfavored speech” involving issues that have galvanized the Republican Party: the policies around the Covid-19 pandemic and the integrity of the American political system, including the outcome of the 2020 election.Much of the disinformation surrounding both issues has come from the right. Many Republicans are convinced that researchers who study disinformation have pressed social media platforms to discriminate against conservative voices.Those complaints have been fueled by Twitter’s decision under its new owner, Elon Musk, to release selected internal communications between government officials and Twitter employees. The communications show government officials urging Twitter to take action against accounts spreading disinformation but stopping short of ordering them to do, as some critics claimed.Patrick L. Warren, an associate professor at Clemson University, said researchers at the school have provided documents to the committee, and given some staff members a short presentation. “I think most of this has been spurred by our appearance in the Twitter files, which left people with a pretty distorted sense of our mission and work,” he said.Last year, the Republican attorneys general of Missouri and Louisiana sued the Biden administration in U.S. District Court in Louisiana, arguing that government officials effectively cajoled or coerced Twitter, Facebook and other social media platforms by threatening legislative changes. The judge, Terry A. Doughty, rejected a defense motion to dismiss the lawsuit in March.The current campaign’s focus is not government officials but rather private individuals working for universities or nongovernmental organizations. They have their own First Amendment guarantees of free speech, including their interactions with the social medial companies.The group behind the class action, America First Legal, named as defendants two researchers at the Stanford Internet Observatory, Alex Stamos and Renée DiResta; a professor at the University of Washington, Kate Starbird; an executive of Graphika, Camille François; and the senior director of the Atlantic Council’s Digital Forensic Research Lab, Graham Brookie.Renée DiResta, a researcher at the Stanford Internet Observatory, is among the defendants named in a lawsuit filed by America First Legal, a conservative group. Kevin Dietsch/Getty ImagesThe researchers, who have been asked by the House committee to submit emails and other records, are also defendants in the lawsuit brought by the attorneys general of Missouri and Louisiana. The plaintiffs include Jill Hines, a director of Health Freedom Louisiana, an organization that has been accused of disinformation, and Jim Hoft, the founder of the Gateway Pundit, a right-wing news site. The court in the Western District of Louisiana has, under Judge Doughty, become a favored venue for legal challenges against the Biden administration.The attacks use “the same argument that starts with some false premises,” said Jeff Hancock, the founding director of the Stanford Social Media Lab, which is not a party to any of the legal action. “We see it in the media, in the congressional committees and in lawsuits, and it is the same core argument, with a false premise about the government giving some type of direction to the research we do.”The House Judiciary Committee has focused much of its questioning on two collaborative projects. One was the Election Integrity Partnership, which Stanford and the University of Washington formed before the 2020 election to identify attempts “to suppress voting, reduce participation, confuse voters or delegitimize election results without evidence.” The other, also organized by Stanford, was called the Virality Project and focused on the spread of disinformation about Covid-19 vaccines.Both subjects have become political lightning rods, exposing the researchers to partisan attacks online that have become ominously personal at times.In the case of the Stanford Internet Observatory, the requests for information — including all emails — have even extended to students who volunteered to work as interns for the Election Integrity Partnership.A central premise of the committee’s investigation — and the other complaints about censorship — is that the researchers or government officials had the power or ability to shut down accounts on social media. They did not, according to former employees at Twitter and Meta, which owns Facebook and Instagram, who said the decision to punish users who violated platform rules belonged solely to the companies.No evidence has emerged that government officials coerced the companies to take action against accounts, even when the groups flagged problematic content.“We have not only academic freedom as researchers to conduct this research but freedom of speech to tell Twitter or any other company to look at tweets we might think violate rules,” Mr. Hancock said.The universities and research organizations have sought to comply with the committee’s requests, though the collection of years of emails has been a time-consuming task complicated by issues of privacy. They face mounting legal costs and questions from directors and donors about the risks raised by studying disinformation. Online attacks have also taken a toll on morale and, in some cases, scared away students.In May, Mr. Jordan, the committee’s chairman, threatened Stanford with unspecified legal action for not complying with a previously issued subpoena, even though the university’s lawyers have been negotiating with the committee’s lawyers over how to shield students’ privacy. (Several of the students who volunteered are identified in the America First Legal lawsuit.)The committee declined to discuss details of the investigation, including how many requests or subpoenas it has filed in total. Nor has it disclosed how it expects the inquiry to unfold — whether it would prepare a final report or make criminal referrals and, if so, when. In its statements, though, it appears to have already reached a broad conclusion.“The Twitter files and information from private litigation show how the federal government worked with social media companies and other entities to silence disfavored speech online,” a spokesman, Russell Dye, said in a statement. “The committee is working hard to get to the bottom of this censorship to protect First Amendment rights for all Americans.”The partisan controversy is having an effect on not only the researchers but also the social media giants.Twitter, under Mr. Musk, has made a point of lifting restrictions and restoring accounts that had been suspended, including the Gateway Pundit’s. YouTube recently announced that it would no longer ban videos that advanced “false claims that widespread fraud, errors or glitches occurred in the 2020 and other past U.S. presidential elections.” More

    Trump’s Indictment Puts Us Into Uncharted Waters

    Former President Donald Trump finds himself once again facing indictment, this time in federal court, after an investigation into his handling of classified documents after departing the White House. The prospect of putting Mr. Trump on trial for serious crimes and sending him to prison has many Americans feeling giddy: Finally, justice might be done.Such reactions are understandable, but news of Mr. Trump’s legal jeopardy shouldn’t blind us to the political jeopardy that now confronts the nation.Other countries have tried, convicted and imprisoned former presidents, but the United States never has. We’ve been fortunate in this regard. Legal processes establish and maintain legitimacy by the appearance of impartiality. But when a public figure associated with one political party is prosecuted by officials associated with another, such appearances can become impossible to uphold. This is especially so when the public figure is a populist adept at exposing (and accusing opponents of concealing) base and self-interested motives behind righteous rhetoric about the rule of law.This corrosive dynamic is even more pronounced when the public figure is not only a former official but also a potential future one. Mr. Trump is running for president against President Biden, whose attorney general, Merrick Garland, appointed the special counsel Jack Smith. That’s a scenario seemingly tailor-made to confirm and vindicate Mr. Trump’s longstanding claim that he’s the victim of a politically motivated witch hunt.We don’t have to speculate about the immediate political consequences. Public-spirited and law-abiding Americans believe the appropriate response of voters to news that their favored candidate faces indictment is to turn on him and run the other way. But the populist politics that are Mr. Trump’s specialty operate according to an inverse logic. Before the end of March, polls of the Republican primary electorate showed him hovering in the mid-40s and leading his nearest rival, Gov. Ron DeSantis of Florida, by about 15 points. By the end of May, Mr. Trump was in the mid-50s and leading Mr. DeSantis by roughly 30 points.What happened at the end of March to elevate Mr. Trump’s standing? He was indicted by the Manhattan district attorney, Alvin Bragg.Hard as it may be for some of us to believe, Mr. Trump’s indictment by the special counsel on federal charges could well boost him further, placing him in a position of even greater advantage against his rivals for the Republican nomination.That possibility typically prompts one of two responses from Democrats: one narrowly political (not to say cynical), the other more high-minded and focused on the law and public morals.The political response sees Mr. Trump benefiting in the G.O.P. primaries from indictment as a good thing, because the former president appears to be the most beatable alternative for Mr. Biden to face in the fall of 2024, and that will be even truer when Mr. Trump is embroiled in a federal trial on major charges and facing possible prison time. What’s good for Mr. Trump in the primaries, in other words, will be terrible for him in the general election.This may well be true, but not necessarily. Anyone who becomes one of two major party nominees has a shot at winning the White House. That’s especially true in our era of stark partisan polarization and intense negative partisanship. That Mr. Trump would be running against an opponent with persistently low approval ratings who will be 81 years old on Election Day 2024 only makes a Biden-Trump matchup more uncertain.The other response dismisses such concerns entirely. Let justice be done, we are told, though the heavens fall. To weigh political considerations in determining whether someone, even a former and possibly future president, should be prosecuted is to supposedly commit a grievous offense against the rule of law, because no one is above the law and the consequences of holding him or her to account shouldn’t matter.This is a powerful argument and one seemingly vindicated in the case of Mr. Trump, who has now managed to get himself ensnared in legal trouble in multiple jurisdictions dealing with a wide range of possible crimes. At a certain point, the logic of the law applying to everyone equally demands that the process be seen through.But that doesn’t mean we should deny the gravity of the potential consequences. Mr. Trump is not a standard-issue politician who happened to run afoul of corruption statutes. He’s a man who rose once to the presidency and seeks to return to it by mobilizing and enhancing mass suspicion of public institutions and officials. That’s why one of the first things he said after announcing the indictment on Thursday night was to proclaim it was “a DARK DAY for the United States of America.” It’s why die-hard supporters like Representative Jim Jordan of Ohio tweeted: “Sad day for America. God Bless President Trump.” It’s likely that tens of millions of our fellow citizens agree with the sentiment.To most Americans, such a reaction to news of Mr. Trump’s indictment seems unimaginable. But it’s clearly something sincerely felt by many. Our country has a history of lionizing outlaws — folk heroes who defy authority, especially when they claim to speak for, channel and champion the grievances and resentments of ordinary people against those in positions of power and influence. From the beginning of his 2016 campaign, Mr. Trump has portrayed himself as just such a man of defiance, eager to serve as a tribune for those who feel left behind, denigrated and humiliated by members of the establishment.That’s why the more concerted opposition Mr. Trump has faced from law enforcement, the mainstream media, Congress and other prominent people in our country and culture, the more popular he has become within his party. Efforts to rein him in — to defeat him politically and legally — have often backfired, vindicating him and his struggle in the eyes of his supporters.There’s no reason at all to suppose the prospect of Mr. Trump’s ending up a convicted criminal would disrupt this dynamic. On the contrary, it’s far more likely to transform him into something resembling a martyr to millions of Americans — and in the process to wrest those devoted supporters free from attachment to the rule of law altogether.How politically radical could the base of the Republican Party become over the 17 months between now and the 2024 presidential election? There’s really no way to know.     House Republicans Target Bragg Ahead of Expected Trump Indictment

    Three Republican committee chairmen sought to use their investigative power to involve themselves in the Manhattan district attorney’s criminal inquiry into the former president.ORLANDO, Fla. — House Republicans rallied around former President Donald J. Trump on Monday ahead of his expected indictment by a Manhattan grand jury, using their investigative power to scrutinize active criminal inquiries targeting him as at least one other G.O.P. lawmaker endorsed his 2024 presidential campaign.Three Republican committee chairmen demanded on Monday morning that Alvin Bragg, the Manhattan district attorney who is said to be close to indicting Mr. Trump, provide communications, documents and testimony about his investigation, an extraordinary move by Congress to involve itself in an active criminal inquiry.“You are reportedly about to engage in an unprecedented abuse of prosecutorial authority.” wrote Representatives Jim Jordan of Ohio of the Judiciary Committee, James R. Comer of Kentucky of the Oversight and Accountability Committee and Bryan Steil of Wisconsin of the Administration Committee. “If these reports are accurate, your actions will erode the confidence in the evenhanded application of justice and unalterably interfere in the course of the 2024 presidential election.”They demanded “all documents and communications referring or relating to the New York County District Attorney Office’s receipt and use of federal funds.”That office receives very little funding from the federal government, according to its most recent budget, but the letter also served as a warning to the F.B.I. and the Justice Department, which is also considering prosecutions of Mr. Trump.The letter was House Republicans’ latest effort to use their investigatory powers to defend Mr. Trump. They have authorized a new subcommittee to scrutinize criminal investigations into Mr. Trump’s conduct and quietly wound down a congressional inquiry into his finances and conflicts of interest as president.The Justice Department has so far resisted what federal prosecutors view as unnecessary intrusions into their work, citing longstanding department policy. Mr. Bragg was anticipated to be unlikely to allow Republicans access to materials related to an active case.“We will not be intimidated by attempts to undermine the justice process,” Danielle Filson, a spokeswoman for Mr. Bragg’s office, said on Monday, adding: “In every prosecution, we follow the law without fear or favor to uncover the truth. Our skilled, honest and dedicated lawyers remain hard at work.”Still, Mr. Trump’s lawyers have quietly urged the Republican-led House to interfere. Last month, Mr. Trump’s lawyer Joseph Tacopina wrote to Mr. Jordan calling on Congress to investigate the “egregious abuse of power” by what he called a “rogue local district attorney,” according to a copy of the letter obtained by The New York Times.But Representative Jamie Raskin of Maryland, the top Democrat on the Oversight and Accountability Committee, said it was Republicans who were abusing their power. “These committee chairs have acted totally outside their proper powers to try to influence a pending criminal investigation at the state level,” he said in a statement.The news of the Republicans’ letter came as House G.O.P. lawmakers, who have gathered for a retreat in Orlando to plot out their policy agenda, were facing fresh political calculations about how to position themselves as Mr. Trump confronts new challenges and a potentially divisive presidential primary looms.Representative Anna Paulina Luna of Florida, who has been loyal to both Mr. Trump and Gov. Ron DeSantis of Florida, announced her official endorsement of Mr. Trump’s presidential campaign on Monday, indicating that the expected indictment had pushed her to unequivocally choose sides.“I support President Trump,” Ms. Luna said in a statement to The New York Times. But her full-throated endorsement underscored the forces pulling at Republicans as Mr. Trump riles up his base to support him in what he is framing as a politically motivated indictment.Mr. Trump, until now, has been more ignored than embraced by House Republicans who have preferred not to choose sides in the still-developing 2024 presidential primary.Ms. Luna, 33, was elected in November after being endorsed by both Mr. Trump and Mr. DeSantis, who also campaigned with her in the general election and called her a “principled fighter.” In the past, while trying to stay out of the brewing dogfight between the two Republican leaders, she has noted that “it’s not uncommon now to see Trump-DeSantis 2024 flags.”But with Mr. Trump claiming he would be arrested on Tuesday and agitating for people to “protest,” and Republican leaders rushing to defend him, Ms. Luna came off the sidelines.“I’m sick of the press trying to create an enemy out of someone who actually had our country in a good place from an economic and policy perspective,” she said. “Save me the virtue signaling. Trump 2024.”At the retreat here on Monday, Republicans across the board denounced Mr. Bragg and defended Mr. Trump.Representative Mario Díaz-Balart of Florida said on Monday that Mr. Bragg was a “rogue, left-wing, radical prosecutor who now has decided for political reasons to go after a former president.” He said he condoned peaceful protests in response and added of the expected indictment: “We’re used to seeing that in third-world countries. That’s something that doesn’t happen in this country.”Speaker Kevin McCarthy of California also said on Sunday that Mr. Bragg was politically motivated but argued against protests. “It’s interesting to me that he spent his whole time as a D.A. lowering felonies not to prosecute,” Mr. McCarthy said of Mr. Bragg. “Republicans and Democrats alike hate this kind of justice.” (Ms. Filson said homicides and shootings had declined under Mr. Bragg.)In an interview, Representative Elise Stefanik of New York, one of Mr. Trump’s most fervent defenders and the only party leader to endorse him, said the expected indictment “only strengthens President Trump moving forward.” And she did not discourage people from protesting, as he has urged them to do. “I do believe people have a constitutional right of freedom of speech to speak up when they disagree,” she said.Ms. Luna, a member of the House Freedom Caucus, was one of the few freshman lawmakers to join a group of rebels who voted against Mr. McCarthy during his protracted fight to win the gavel in January. She did not attend the retreat in her home state.But in a lengthy statement, Ms. Luna accused President Biden of overseeing a “botched withdrawal from Afghanistan” and pursuing a “soft-on-China approach” and charged that his family corruptly profited from the Chinese government. “And yet people are clutching their pearls and still parroting the ‘orange man bad’ mentality?” she said.Most House Republicans have remained neutral in the 2024 presidential race. Last week, Representative Chip Roy of Texas pre-emptively endorsed Mr. DeSantis, even though he has yet to officially start a presidential campaign. And Representative Ralph Norman, Republican of South Carolina, endorsed Nikki Haley, the state’s former governor.A handful of Trump loyalists, including Ms. Stefanik and Representative Marjorie Taylor Greene of Georgia, have endorsed the former president. But most have seen little benefit to expressing a preference in the race at this early stage.That decision has been that much harder for members of the Florida delegation — until the expected indictment prompted at least one of them to intensify their defense of Mr. Trump.“DeSantis is a great leader for Florida,” Ms. Luna said, “and I will continue to support him as my governor.”Annie Karni More

    House Committee Budgets Swell as G.O.P. Plans Road Shows Across U.S.

    Republican leaders have told their colleagues to get out of Washington for field hearings that allow the party to take their message straight to voters, a costly pursuit that can be a boon to big donors.WASHINGTON — When the House Ways and Means Committee traveled to Petersburg, W.Va., last month for its inaugural field hearing on “the state of the economy in Appalachia,” it met at the headquarters of a hardwood lumber manufacturer whose chief executive has donated the maximum campaign contribution allowed to a Republican member of the panel.The logo of his company was on prominent display during the event.When the committee descends on Yukon, Okla., this week for its second field hearing, this one on “the state of the economy in the heartland,” it will convene at Express Clydesdales, a restored barn and event space owned by a major donor to the super PAC aligned with Speaker Kevin McCarthy, the Republican National Committee, Senate Republicans’ campaign committee and former President Donald J. Trump.The owner, the business magnate Robert Funk, has also given the maximum campaign donation allowable to another member of the panel, Representative Kevin Hern, Republican of Oklahoma, for the past three cycles.Determined to take their message directly to voters at a time when they are hard-pressed to get anything concrete done on Capitol Hill, House Republicans are increasing the budgets of their congressional committees and going out on the road, planning a busy schedule of field hearings in all corners of the country aimed at promoting their agenda outside the Beltway.The Judiciary Committee, for example, which has held one field hearing at the U.S. border with Mexico to criticize the Biden administration’s immigration policies and is planning more, requested a travel budget of $262,000 for this year. That is more than 30 times what the panel spent on travel last year. (In 2019, before the coronavirus pandemic significantly curtailed travel, the Judiciary Committee spent about $85,000 on travel costs, according to a public disclosure form, one-third of what Republicans are planning this year.)It is part of a well-worn political strategy to reach voters where they live and generate local media attention for activity that would most likely draw little notice in Washington.Representative Jason Smith of Missouri, the chairman of the Ways and Means Committee, said last week that he had “made it a priority” to take the committee’s work “outside the halls of Congress, away from the politically connected voices of Washington lobbyists and into the communities of the American people whose voices have for too long been ignored.”But it also has a direct payoff for Republicans, allowing them to reward major donors with publicity and exposure for their businesses.In West Virginia, the chief executive of Allegheny Wood Products, John Crites, whose company hosted the first Ways and Means field hearing, gave the maximum contribution allowed to Representative Carol Miller, Republican of West Virginia and a member of the panel, for the past two cycles.A spokesman for the committee declined to comment on the choice of venues. Instead, they feuded in a disorderly display over who among them should be speaker as the most extreme elements of the new majority repeatedly rejected Representative Kevin McCarthy of California.Despite Mr. McCarthy’s prominent role in fund-raising and delivering the House to Republicans and his backing among most in the party ranks, about 20 Republicans refused to support him and for the first time in a century forced repeated rounds of voting for the speakership. After three flailing attempts at electing a speaker, Republicans abruptly called for the House to be adjourned until noon Wednesday as they scrambled for a way out of their leadership morass. The stalemate meant the usually routine organization of the new House did not occur and its members were not sworn in, nor could any legislation be considered.The paralysis underscored the dilemma facing House Republicans: No matter the concessions made to some of those on the far right, they simply will not relent and join their colleagues even if it is for the greater good of their party, and perhaps the nation. They consider themselves conservative purists who cannot be placated unless all their demands are met — and maybe not even then. Their agenda is mostly to defund, disrupt and dismantle government, not to participate in it.It means that whoever emerges from the messy leadership fight will face deep-seated resistance when trying to shepherd spending bills and other measures that are fundamental to governance. Trump on Monday of inciting insurrection, conspiracy to defraud the United States, obstruction of an act of Congress and one other federal crime as it referred him to the Justice Department for potential prosecution.The action, the first time in American history that Congress has referred a former president for criminal prosecution, is the coda to the committee’s 18-month investigation into Mr. Trump’s effort to overturn the 2020 election that culminated in a violent mob of the former president’s supporters laying siege to the Capitol.The criminal referrals were a major escalation for a congressional investigation that is the most significant in a generation. President Biden has indicated his intent to run in 2024, and Mr. Trump announced his re-election campaign last month.The summary laid out step by step how Mr. Trump sought to cling to power, much as the committee did during its televised hearings in the summer. First, the summary said, Mr. Trump lied about widespread fraud, despite being told his claims were false. He then organized false slates of electors in states won by Mr. Biden as he pressured state officials, the Justice Department and Vice President Mike Pence to overturn the election. Finally, he amassed a mob of his supporters to march on the Capitol, where they engaged in hours of bloody violence while Mr. Trump did nothing to call them off.“Even key individuals who worked closely with President Trump to try to overturn the 2020 election on Jan. 6 ultimately admitted that they lacked actual evidence sufficient to change the election result, and they admitted that what they were attempting was unlawful,” the committee wrote.“Every president in our history has defended this orderly transfer of authority, except one,” said Representative Liz Cheney, Republican of Wyoming.Haiyun Jiang/The New York TimesThe panel also referred four Republican members of Congress to the House Ethics Committee — including the man seeking to become the next speaker, Representative Kevin McCarthy of California — because of their refusal to comply with the panel’s subpoenas.Mr. McCarthy’s office did not respond to a request for comment.The other Republicans referred were Representatives Jim Jordan of Ohio, Scott Perry of Pennsylvania and Andy Biggs of Arizona.A spokesman for Mr. Jordan, Russell Dye, said in a statement that the referral was “just another partisan and political stunt.” A spokesman for Mr. Perry, Jay Ostrich, said the committee was engaged in “more games from a petulant and soon-to-be kangaroo court.’’Mr. Biggs said in a tweet that the referral was the committee’s “final political stunt” and that he looked forward to “reviewing their documents, publishing their lies and setting the record straight” in the next Congress.In its summary, the committee did not entirely resolve disputed accounts of what happened inside the presidential S.U.V. when Mr. Trump was told by his Secret Service agents that they could not take him to the Capitol to join the crowd on Jan. 6. Cassidy Hutchinson, a former White House aide, testified under oath to the committee in public last summer that Anthony M. Ornato, a White House deputy chief of staff, told her that Mr. Trump grew so angry that he lunged at his Secret Service agent and tried to grab the steering wheel. The Secret Service denied that account anonymously.The summary said only that the “committee has now obtained evidence from several sources about a ‘furious interaction’” that occurred in the S.U.V. “The vast majority of witnesses who have testified to the select committee about this topic, including multiple members of the Secret Service, a member of the Metropolitan Police and national security officials in the White House, described President Trump’s behavior as ‘irate,’ ‘furious,’ ‘insistent,’ ‘profane’ and ‘heated.’”The committee’s summary also concluded that there was no nefarious reason for why the National Guard was delayed for hours in responding to violence of Jan. 6.“Although evidence identifies a likely miscommunication between members of the civilian leadership in the Department of Defense impacting the timing of deployment, the committee has found no evidence that the Department of Defense intentionally delayed deployment of the National Guard,” the committee wrote. “The select committee recognizes that some at the department had genuine concerns, counseling caution, that President Trump might give an illegal order to use the military in support of his efforts to overturn the election.”In its summary, the panel asked the Justice Department to investigate whether anyone had interfered with or obstructed the panel’s investigation, including whether any lawyers paid for by groups connected to Mr. Trump “may have advised clients to provide false or misleading testimony to the committee.”Among the committee’s findings, revealed at its meeting on Monday, was that lawmakers became concerned that lawyers who were paid by Trump associates may have tried to interfere with the panel’s investigation. The panel also learned that a client was offered potential employment that would make her “financially very comfortable” as the date of her testimony approached. But then offers were withdrawn or did not materialize as reports of the content of her testimony circulated, the committee said.The committee also chastised certain witnesses that it said had not been forthright with investigators. It said it had “significant concerns about the credibility” of the testimony of Mr. Ornato.The committee also said Kayleigh McEnany, one of Mr. Trump’s former press secretaries, and Ivanka Trump, the president’s elder daughter, had been less than forthcoming.The summary demonstrated, as the committee’s hearings did, how despite being told repeatedly that his claims of election fraud were false, Mr. Trump kept up the lies.Bill Stepien, a former White House political director, told the committee how he and others would investigate the claims, find them to be false, and report back to the president. “It’s an easier job to be telling the president about, you know, wild allegations,” Mr. Stepien said. “It’s a harder job to be telling him on the back end that, yeah, that wasn’t true.”The summary also contained evidence that certain White House aides had grown concerned about the potential for violence on Jan. 6 and urged Mr. Trump to make a pre-emptive statement calling for peace. No such statement was made.Hope Hicks, a former White House communications director, said she suggested “several times” on Jan. 4 and 5 that Mr. Trump “publicly state that Jan. 6 must remain peaceful, and that he had refused her advice to do so,” the panel wrote.The panel played new video from Ms. Hicks, who described a conversation with Mr. Trump.“I was becoming increasingly concerned that we were damaging his legacy,” Ms. Hicks said she told the president.Mr. Trump’s response? “Nobody will care about my legacy if I lose, so that won’t matter. Staffed with more than a dozen former federal prosecutors, the panel set a new production standard for how to hold a congressional hearing. It also got significantly ahead of a parallel Justice Department investigation into the events of Jan. 6, with federal prosecutors later interviewing many of the same witnesses Congress had spoken to.In recent weeks, federal prosecutors under the supervision of a special counsel have issued subpoenas to officials in seven states in which the Trump campaign organized electors to falsely certify the election for Mr. Trump despite the voters choosing Mr. Biden.Lawmakers on the panel also believe they played a significant role in elevating the issue of threats to democracy to voters, who rejected many election deniers in the November midterms.In terms of legislative recommendations, the panel has already endorsed overhauling the Electoral Count Act, the law that Mr. Trump and his allies tried to exploit on Jan. 6 in an attempt to cling to power. Lawmakers have also discussed changes to the Insurrection Act and legislation to enforce the 14th Amendment’s prohibition on insurrectionists holding office.     With Majority in Sight, Republicans Hush Talk of Impeaching Biden

    WASHINGTON — Since the day President Biden took office, Republicans have publicly called for his impeachment, introducing more than a dozen resolutions accusing him and his top officials of high crimes and misdemeanors and running campaign ads and fund-raising appeals vowing to remove the president from office at the first opportunity.But in the homestretch of a campaign that has brought the party tantalizingly close to winning control of Congress, top Republicans are seeking to downplay the chances that they will impeach Mr. Biden, distancing themselves from a polarizing issue that could alienate voters just as polls show the midterm elections breaking their way.“I think the country doesn’t like impeachment used for political purposes at all,” Representative Kevin McCarthy, Republican of California and the minority leader, told Punchbowl News earlier this month. While he didn’t rule out moving forward on impeachment hearings if something rose “to that occasion,” Mr. McCarthy said the country needed to “heal” and that voters wanted to “start to see the system that actually works.”Still, should he become House speaker, Mr. McCarthy would be under immense pressure from hard-right members of his rank and file — and from core Republican voters who swept his party into the majority in part based on promises to take down Mr. Biden — to impeach. The pressure will only increase if former President Donald J. Back then, she and other leading Democrats toiled to avoid publicly talking about the subject, wary of distractions from their message that could alienate independent voters and cost them their chance at winning control of the House.The task grew more difficult after they won; immediately after she was sworn in to Congress in 2019, for instance, Representative Rashida Tlaib, Democrat of Michigan, told supporters “we’re going to impeach” Mr. Trump, using an expletive to refer to him.Even after Robert S. Mueller III, the special counsel investigating Russian interference in the 2016 election, documented multiple instances of obstruction of justice by Mr. Trump, House Democrats were cautious about pursuing impeachment. It took nine months to get Ms. Pelosi on board.“People can be very critical of Biden on political or policy grounds,” said Norman L. Eisen, who served as a lawyer for Democrats during the first impeachment of Mr. Trump. “But those are not high crimes and misdemeanors — not even close. If it’s politically difficult to do impeachment when you have compelling proof of multiple high crimes, how much more so when there’s no evidence of constitutional crimes?”It can also be politically risky, if past impeachments are any guide.
