    Trump Is Nothing Without Republican Accomplices

    During the first Republican debate of the 2024 presidential primary campaign last month, Donald Trump’s rivals were asked to raise their hands if they would support his candidacy, even if he were “convicted in a court of law.” Mr. Trump’s effort to overturn the 2020 election wasn’t just a potential criminal offense. It also violated the cardinal rule of democracy: Politicians must accept the results of elections, win or lose.But that seemed to matter little on the debate stage. Vivek Ramaswamy’s hand shot up first, and all the other leading candidates followed suit — some eagerly, some more hesitantly and one after casting furtive glances to his right and his left.Behavior like this might seem relatively harmless — a small act of political cowardice aimed at avoiding the wrath of the base. But such banal acquiescence is very dangerous. Individual autocrats, even popular demagogues, are never enough to wreck a democracy. Democracy’s assassins always have accomplices among mainstream politicians in the halls of power. The greatest threat to our democracy comes not from demagogues like Mr. Trump or even from extremist followers like those who stormed the Capitol on Jan. 6, but rather from the ordinary politicians, many of them inside the Capitol that day, who protect and enable him.The problem facing Republican leaders today — the emergence of a popular authoritarian threat in their own ideological camp — is hardly new. It has confronted political leaders across the world for generations. In Europe in the 1920s and 1930s, mainstream center-left and center-right parties had to navigate a political world in which antidemocratic extremists on the communist left and the fascist right enjoyed mass appeal. And in much of South America in the polarized 1960s and 1970s, mainstream parties found that many of their members sympathized with either leftist guerrillas seeking armed revolution or rightist paramilitary groups pushing for military rule.The Spanish political scientist Juan Linz wrote that when mainstream politicians face this sort of predicament, they can proceed in one of two ways.On the one hand, politicians may act as loyal democrats, prioritizing democracy over their short-term ambitions. Loyal democrats publicly condemn authoritarian behavior and work to hold its perpetrators accountable, even when they are ideological allies. Loyal democrats expel antidemocratic extremists from their ranks, refuse to endorse their candidacies, eschew all collaboration with them, and when necessary, join forces with ideological rivals to isolate and defeat them. And they do this even when extremists are popular among the party base. The result, history tells us, is a political firewall that can help a democracy survive periods of intense polarization and crisis.On the other hand, too often, politicians become what Mr. Linz called semi-loyal democrats. At first glance, semi-loyalists look like loyal democrats. They are respectable political insiders and part of the establishment. They dress in suits rather than military camouflage, profess a commitment to democracy and ostensibly play by its rules. We see them in Congress and in governor’s mansions — and on the debate stage. So when democracies die, semi-loyalists’ fingerprints may not be found on the murder weapon.But when we look closely at the histories of democratic breakdowns, from Europe in the interwar period to Argentina, Brazil and Chile in the 1960s and 1970s to Venezuela in the early 2000s, we see a clear pattern: Semi-loyal politicians play a pivotal role in enabling authoritarians.Rather than severing ties to antidemocratic extremists, semi-loyalists tolerate and accommodate them. Rather than condemn and seek accountability for antidemocratic acts committed by ideological allies, semi-loyalists turn a blind eye, denying, downplaying and even justifying those acts — often via what is today called whataboutism. Or they simply remain silent. And when they are faced with a choice between joining forces with partisan rivals to defend democracy or preserving their relationship with antidemocratic allies, semi-loyalists opt for the latter.It is semi-loyalists’ very respectability that makes them so dangerous. As members of the establishment, semi-loyalists can use their positions of authority to normalize antidemocratic extremists, protect them against efforts to hold them legally accountable and empower them by opening doors to the mainstream media, campaign donors and other resources. It is this subtle enabling of extremist forces that can fatally weaken democracies.Consider the example of France. On Feb. 6, 1934, in the center of Paris, thousands of disaffected and angry men — veterans and members of right-wing militia groups — gathered near the national Parliament as its members were inside preparing to vote for a new government. They threw chairs, metal grates and rocks and used poles with razor blades on one end to try breach the doors of Parliament. Members of Parliament, frightened for their lives, had to sneak out of the building. Seventeen people were killed, and thousands were injured. Although the rioters failed to seize the Parliament building, they achieved one of their objectives: The centrist prime minister resigned the next day and was replaced by a right-leaning prime minister.Although French democracy survived the Feb. 6 attack on Parliament, the response of some prominent politicians weakened its defenses. Many centrist and center-left politicians responded as loyal democrats, publicly and unequivocally condemning the violence. But many conservative politicians did not. Key members of France’s main conservative party, the Republican Federation, many of whom were inside the Parliament building that day, sympathized publicly with the rioters. Some praised the insurrectionists as heroes and patriots. Others dismissed the importance of the attack, denying that there had been an organized plot to overthrow the government.When a parliamentary commission was established to investigate the events of Feb. 6, Republican Federation leaders sabotaged the investigation at each step, blocking even modest efforts to hold the rioters to account. Protected from prosecution, many of the insurrection’s organizers were able to continue their political careers. Some of the rioters went on to form the Victims of Feb. 6, a fraternity-like organization that later served as a recruitment channel for the Nazi-sympathizing Vichy government established in the wake of the 1940 German invasion.The failure to hold the Feb. 6 insurrectionists to account also helped legitimize their ideas. Mainstream French conservatives began to embrace the view — once confined to extremist circles — that their democracy was hopelessly corrupt, dysfunctional and infiltrated by Communists and Jews. Historically, French conservatives had been nationalist and staunchly anti-German. But by 1936, many of them so despised the Socialist prime minister, Léon Blum, that they embraced the slogan “Better Hitler than Blum.” Four years later, they acquiesced to Nazi rule.The semi-loyalty of leading conservative politicians fatally weakened the immune system of French democracy. The Nazis, of course, finished it off.A half-century later, Spanish politicians responded very differently to a violent assault on Parliament. After four decades of dictatorship, Spain’s democracy was finally restored in the late 1970s, but its early years were marked by economic crisis and separatist terrorism. And on Feb. 23, 1981, as the Parliament was electing a new prime minister, 200 civil guardsmen entered the building and seized control at gunpoint, holding the 350 members of Parliament hostage. The coup leaders hoped to install a conservative general — a kind of Spanish Charles de Gaulle — as prime minister.The coup attempt failed, thanks to the quick and decisive intervention of the king, Juan Carlos I. Nearly as important, though, was the reaction of Spanish politicians. Leaders across the ideological spectrum — from communists to conservatives who had long embraced the Franco dictatorship — forcefully denounced the coup. Four days later, more than a million people marched in the streets of Madrid to defend democracy. At the head of the rally, Communist, Socialist, centrist and conservative franquista politicians marched side by side, setting aside their partisan rivalries to jointly defend democracy. The coup leaders were arrested, tried and sentenced to long prison terms. Coups became virtually unthinkable in Spain, and democracy took root.That is how democracy is defended. Loyal democrats join forces to condemn attacks on democracy, isolate those responsible for such attacks and hold them accountable.Unfortunately, today’s Republican Party more closely resembles the French right of the 1930s than the Spanish right of the early 1980s. Since the 2020 election, Republican leaders have enabled authoritarianism at four decisive moments. First, rather than adhering to the cardinal rule of accepting election results after Joe Biden won in November, many Republican leaders either questioned the results or remained silent, refusing to publicly recognize Mr. Biden’s victory. Vice President Mike Pence did not congratulate his successor, Kamala Harris, until the middle of January 2021. The Republican Accountability Project, a Republican pro-democracy watchdog group, evaluated the public statements of 261 Republican members of the 117th Congress after the election. They found that 221 of them had publicly expressed doubt about its legitimacy or did not publicly recognize that Biden won. That’s 85 percent. And in the aftermath of the Jan. 6 riot, nearly two-thirds of House Republicans voted against certification of the results. Had Republican leaders not encouraged election denialism, the “stop the steal” movement might have stalled, and thousands of Trump supporters might not have violently stormed the Capitol in an effort to overturn the election.Second, after Mr. Trump was impeached by the House of Representatives for the Jan. 6, 2021, insurrection, Senate Republicans overwhelmingly voted to acquit him, even though many conceded that, in Senator Mitch McConnell’s words, the president was “practically and morally responsible” for the attack. The acquittal allowed Mr. Trump to continue his political career despite having tried to block the peaceful transfer of power. Had he been convicted in the Senate, he would have been legally barred from running again for president. In other words, Republican senators had a clear opportunity to ensure that an openly antidemocratic figure would never again occupy the White House — and 43 of them, including Mr. McConnell, declined to take it.Third, Republican leaders could have worked with Democrats to create an independent commission to investigate the Jan. 6 uprising. Had both parties joined forces to seek accountability for the insurrection, the day’s events would have gone down in U.S. history (and would likely have been accepted by a larger majority of Americans) as a criminal assault on our democracy that should never again be allowed to occur, much like Spain’s 1981 coup attempt. Republican leaders’ refusal to support an independent investigation shattered any possible consensus around Jan. 6, making it far less likely that Americans will develop a shared belief that such events are beyond the pale.Finally, with remarkably few exceptions, Republican leaders say they will still support Mr. Trump even if he is convicted of plotting to overturn an election. Alternatives exist. The Republican National Committee could declare that the party will not nominate an individual who poses a threat to democracy or has been indicted on serious criminal charges. Or Republican leaders could jointly declare that, for the sake of democracy, they will endorse Mr. Biden if Mr. Trump is the Republican nominee. Such a move would, of course, destroy the party’s chances in 2024. But by keeping Mr. Trump out of the White House, it would help protect our democracy.If Republican leaders continue to endorse Mr. Trump, they will normalize him yet again, telling Americans that he is, at the end of the day, an acceptable choice. The 2024 race will become another ordinary red vs. blue election, much like 2016. And as in 2016, Mr. Trump could win.Republican leaders’ acquiescence to Mr. Trump’s authoritarianism is neither inevitable nor unavoidable. It is a choice.Less than a year ago in Brazil, right-wing politicians chose a different path. President Jair Bolsonaro, who was elected in 2018, was an extreme-right politician who had praised torture, death squads and political assassination. Like Mr. Trump in 2020, Mr. Bolsonaro faced an uphill re-election battle in 2022. And like Mr. Trump, he tried to undermine public trust in the electoral system, attacking it as rigged and seeking to replace the country’s sophisticated electronic voting system with a paper ballot system that was more prone to fraud. And despite some dirty tricks on Election Day (police roadblocks impeded voter access to the polls in opposition strongholds in the northeast), Mr. Bolsonaro, like Mr. Trump, narrowly lost.But the similarities end there. Whereas most Republican leaders refused to recognize Mr. Biden’s victory, most of Mr. Bolsonaro’s major political allies, including the president of Congress and the newly elected governors of powerful states like São Paulo and Minas Gerais, unambiguously accepted his defeat at the hands of Lula da Silva, the winner on election night. Although Mr. Bolsonaro himself remained silent, almost no major Brazilian politician questioned the election results.Likewise, on Jan. 8, 2023, when angry Bolsonaro supporters, seeking to provoke a coup, stormed Congress, the office of the presidency and the Supreme Court building in Brasília, conservative politicians forcefully condemned the violence. In fact, several of them led the push for a congressional investigation into the insurrection. And when the Superior Electoral Court barred Mr. Bolsonaro from seeking public office until 2030 (for abusing his political power, spreading disinformation and making baseless accusations of fraud), the response among right-wing politicians was muted. Although the electoral court’s ruling was controversial, few Brazilian politicians have attacked the legitimacy of the court or defended Mr. Bolsonaro as a victim of political persecution.Not only is Mr. Bolsonaro barred from running for president in the next election, he is politically isolated. For U.S. Republicans, then, Brazil offers a model.Many mainstream politicians who preside over a democracy’s collapse are not authoritarians committed to overthrowing the system; they are careerists who are simply trying to get ahead. They are less opposed to democracy than indifferent to it. Careerism is a normal part of politics. But when democracy is at stake, choosing political ambition over its defense can be lethal.Mr. McConnell, House Speaker Kevin McCarthy and other top Republican leaders are not trying to kill democracy, but they have subordinated its defense to their own personal and partisan interests. Such reckless indifference could make them indispensable partners in democracy’s demise. They risk joining the long line of semi-loyal politicians littering the histories of interwar Europe and Cold War Latin America who sacrificed democracy on the altar of political expediency.     McConnell, Dismissing Health Concerns, Says He Will Finish His Senate Term

    The Kentucky Republican said he would finish his term as leader, which runs through 2024, and in the Senate, where he was elected to serve through 2026.Senator Mitch McConnell of Kentucky, the longtime Republican leader whose recent medical episodes have raised questions about his ability to continue steering his party in the Senate, declared on Wednesday that he had no intention of relinquishing his top post or leaving Congress ahead of schedule.“I’m going to finish my term as leader and I’m going to finish my Senate term,” Mr. McConnell, wan in appearance and defiant in tone, told reporters at the Capitol as he took questions outside the Senate chamber.In a crowded news conference, Mr. McConnell’s first at the Capitol since two alarming episodes in which he froze midsentence on camera while addressing the media, the 81-year-old minority leader refused to engage with questions about his health or his political future, even as he appeared to leave the door open to giving up his leadership post after 2024.Still, Mr. McConnell, whose seventh term in the Senate lasts through 2026, would say nothing about the spells he experienced on camera in recent weeks that left him staring vacantly into space without speaking, appearing temporarily paralyzed.“Dr. Monahan covered the subject fully,” Mr. McConnell said Wednesday, referring to a letter his office released from Dr. Brian P. Monahan, the attending physician of Congress. Mr. McConnell, who appeared notably thinner since leaving Washington six weeks ago for the summer recess, said the brief statement from Dr. Monahan, which said there was no evidence the senator had a seizure disorder or had experienced a stroke, adequately put to bed any “reasonable questions.”Several medical professionals who watched video of Mr. McConnell’s episodes suggested he had been experiencing focal seizures or mini strokes. They cast doubt on Dr. Monahan’s assessment that the incidents were merely part of a normal recovery from a concussion Mr. McConnell had sustained in March after falling at a Washington hotel.But on Wednesday, after three consecutive questions about his health, Mr. McConnell abruptly ended the news conference.Famously tight-lipped and difficult to read even in his prime, Mr. McConnell offered his colleagues little more detail in the semi-privacy of the weekly Senate Republican lunch, the first time G.O.P. senators had gathered since returning to Washington amid rumblings about a potential change at the top of the leadership ladder.There, he gave his colleagues a rundown of his medical evaluations and said he had been given a clean bill of health, according to Senator John Kennedy, Republican of Louisiana, as well as others who attended. Mr. McConnell told them that he had only frozen up twice, and simply had the misfortune of doing it both times on camera.The update was enough to reassure most of his colleagues that he was healthy enough to continue leading the conference and that it was time to move on, at least for the moment. They asked him no follow-up questions during the private lunch and later lauded him publicly for what they called a high level of transparency about his condition.“For him, this is unusual,” Senator John Cornyn of Texas, one of Mr. McConnell’s potential successors, said after the lunch. “Senator McConnell is famous for keeping his cards close to the vest; he’s very good at it. Usually it serves him well, but not in this case. I think transparency does serve him well.”“I think transparency does serve him well,” said Senator John Cornyn, Republican of Texas, praising Mr. McConnell for updating his colleagues.Kent Nishimura for The New York TimesSenator Lindsey Graham, Republican of South Carolina, described his comments during the lunch as a detailed report of his doctor’s evaluation, and said that Mr. McConnell had his full support. Mr. Graham was one of 10 G.O.P. senators who voted last fall for a change at the top of party leadership, supporting an unsuccessful challenge to Mr. McConnell by Senator Rick Scott of Florida.Senator Todd Young of Indiana said the doctor’s note had reassured him that Mr. McConnell was in “decent health,” though he signaled some uncertainty about how long that would continue.“I trust Senator McConnell will continue to lead our conference in the coming weeks, months, perhaps even years,” Mr. Young said. “But should Republicans have to choose a different leader, I’m confident we’ll settle on positive leadership that places a great emphasis on issues of national security.”Others were more skeptical of the idea that Mr. McConnell would go anywhere anytime soon.“It’ll happen when you see donkeys fly,” Mr. Kennedy said.Senator Rand Paul of Kentucky, an ophthalmologist, was one of the few Republicans on Capitol Hill to raise an eyebrow about Dr. Monahan’s brief and carefully worded statements regarding the minority leader’s health, both of which have suggested dehydration might have played a role.“I’m not questioning his ability to be in the Senate,” Mr. Paul said of Mr. McConnell. “My question is with the diagnosis.     What Happens if Mitch McConnell Resigns Before His Senate Term Ends?

    The longtime Republican leader froze up during a news conference on Wednesday in Kentucky. The second such episode in recent weeks, it stirred speculation about his future in the Senate.For the second time in a little over a month, Senator Mitch McConnell of Kentucky, the longtime Republican leader, froze up during a news conference on Wednesday, elevating concerns about his health and his ability to complete his term that ends in January 2027.At an event hosted by the Northern Kentucky Chamber of Commerce, Mr. McConnell, 81, who was elected to his seventh term in 2020, paused for about 30 seconds while responding to a reporter’s question about his re-election plans.The abrupt spell — like one at the U.S. Capitol in July — happened in front of the cameras. In March, a fall left him with a concussion. He suffered at least two other falls that were not disclosed by his office.Mr. McConnell has brushed off past questions about his health, but speculation is swirling again about what would happen in the unlikely event that he retired in the middle of his term.How would the vacancy be filled?For decades in Kentucky, the power to fill a vacancy in the U.S. Senate was reserved exclusively for the governor, regardless of whether an incumbent stepped down, died in office or was expelled from Congress.But with Gov. Andy Beshear, a Democrat, in the state’s highest office, Republican lawmakers used their legislative supermajorities to change the state law in 2021.Under the new law, a state executive committee consisting of members of the same political party as the departing incumbent senator will name three candidates the governor can choose from to fill the vacancy on a temporary basis. Then a special election would be set, and its timing would depend on when the vacancy occurs.At the time that G.O.P. lawmakers introduced the change, Mr. McConnell supported the measure. She is married to a coal-industry billionaire, who spent millions on advertising for her primary campaign.And then there is Representative Andy Barr, who has drawn comparisons to Mr. McConnell and who described Mr. Trump’s conduct as “regrettable and irresponsible,” but voted against impeachment after the riot at the Capitol.What have McConnell and his aides said about his health?Both times that Mr. McConnell froze up in front of the cameras, his aides have said that he felt lightheaded.But his office has shared few details about what caused the episodes or about his overall health. He missed several weeks from the Senate this year while recovering from the concussion in March, which required his hospitalization.Mr. McConnell, who had polio as a child, has repeatedly played down concerns about his health and at-times frail appearance.“I’m not going anywhere,” he told reporters earlier this year.How is Congress dealing with other lawmakers’ health issues?For the current Congress, the average age in the Senate is 64 years, the second oldest in history, according to the Congressional Research Service.Senator Dianne Feinstein, a Democrat from California who is the chamber’s oldest member at 90, has faced health problems this year that have prompted growing calls for her to step down.In February, she was hospitalized with a severe case of shingles, causing encephalitis and other complications that were not publicly disclosed. She did not return to the Senate until May, when she appeared frailer than ever and disoriented.This month, she was hospitalized after a fall in her San Francisco home.Longtime senators are not the only ones in the chamber grappling with health concerns.John Fetterman, a Democrat who was Pennsylvania’s lieutenant governor, suffered a near-fatal stroke last May and went on to win one of the most competitive Senate seats in November’s midterm elections.Nick Corasaniti More

    Why Jack Smith Had to Bring This Indictment Against Trump

    Donald Trump has now been indicted three times, accused of crimes occurring before, during and after his presidency. The latest indictment alleges facts from all quarters to prove his criminality: from the vice president to the White House counsel and the heads of the Justice Department, the Department of Homeland Security and the Office of National Intelligence, as well as many others. All are Republican loyalists.But the indictment does more: It skillfully avoids breathing air into a Trump claim of selective prosecution. To not have brought this case against Mr. Trump would have been an act of selective nonprosecution. The Justice Department has already charged and obtained convictions for myriad foot soldiers related to the attack on the Capitol on Jan. 6, 2021, including charging well over 300 people for obstructing the congressional proceedings. In this indictment, the special counsel Jack Smith wisely brings that same charge, but now against the alleged leader of the effort to thwart the transfer of power.That charge of obstruction and conspiracy to defraud the United States in the administration of elections are entirely fitting for the conduct alleged in the indictment. In a civil case last year, the Federal District Court judge David Carter held that Mr. Trump and John Eastman likely engaged in a criminal conspiracy under both those statutes in their schemes to organize false electors and pressure the vice president. Mr. Smith has now said he can prove the same conduct beyond a reasonable doubt.Although the Jan. 6 select committee referred Mr. Trump for investigation for inciting an insurrection, Mr. Smith wisely demurred. The Justice Department has not charged that offense in any other case involving the attack on the Capitol, and insurrection has not been charged since the 19th century. Of course, no president has engaged in it since then — but since no one else has been charged with that crime relating to Jan. 6, it likely would have been an issue. And since the penalty for the insurrection offense is that the defendant would not be eligible to hold federal office, it would have fueled a claim of weaponizing the Justice Department to defeat a political rival.Mr. Trump and others like him will of course continue to assert that the Justice Department has been politically weaponized. That claim has it exactly backward.To not charge Mr. Trump for trying to criminally interfere with the transfer of power to a duly elected president would be to politicize the matter. It would mean external political considerations had infected the Justice Department’s decision-making and steered the institution away from its commitment to holding everyone equally accountable under the law.What those circling their wagons around Mr. Trump are in effect asking for is a two-tiered system, in which the people who were stirred by lies to interrupt the congressional certification are held to account but not the chief instigator. That injustice has not been lost on judges overseeing cases related to Jan. 6. In the 2021 sentencing of John Lolos — a 48-year-old man with no criminal record who traveled from Seattle to hear Mr. Trump’s speech at the Ellipse before being convinced to “storm” the Capitol — Judge Amit Mehta commented on the incongruity in the D.C. courtroom.“People like Mr. Lolos were told lies, fed falsehoods, and told that our election was stolen when it clearly was not,” the judge said. He went on to add that those “who created the conditions that led to Mr. Lolos’s conduct” and the events of Jan. 6 have “in no meaningful sense” been held “to account for their actions and their words.”We are now on the doorstep of the sort of accountability that Judge Mehta found lacking.That is what also makes this indictment of the former president different. Where both the Manhattan hush money case and classified documents case have been, in some part, mired in discussions of whataboutism, the 2020 election interference indictment is where whataboutism goes to die.In this case, the Trump stratagem is unmasked. Given the record of robust prosecutions of Jan. 6 foot soldiers and Mr. Trump’s responsibility for their actions, he has had to resort to saying the Capitol attack was good, and he and his enablers have lauded convicted felons as heroes and “political prisoners.” Mr. Trump’s continued statements in favor of the Jan. 6 defendants can and likely will be used against him in any trial.As the narrative of the indictment lays out, Mr. Trump’s schemes — to sell the big lie and promote election fraud even when he privately conceded to advisers the claims were “unsupported” and “crazy” — are what contributed to the attack of Jan. 6. And it is a relief that the indictment includes Mr. Trump’s role and responsibility in that violence. Many Americans would not understand the Justice Department focusing only on bureaucratic and procedural efforts to affect the congressional certification.As Senator Mitch McConnell said at the close of Mr. Trump’s second impeachment trial, “There is no question — none — that President Trump is practically and morally responsible for provoking the events of the day.”He added: “We have a criminal justice system in this country. We have civil litigation. And former presidents are not immune from being accountable by either one.”What is also clear from the indictment is that Mr. Trump will most likely not be the last white-collar defendant charged for the set of crimes it sets out. Mr. Smith clearly, and properly, considers that the six co-conspirators — parts of the indictment describe actions by co-conspirators that correspond with those taken by, for example, Mr. Eastman and Rudy Giuliani — committed federal offenses that threatened the core of our democracy. The rule of law cannot tolerate those actors facing charges with the main protagonist going scot free.The main task ahead for Mr. Smith is getting his cases to trial before the general election. But the true test ahead will not be for Mr. Smith. It will be for us: Will Americans care about the rule of law enough to vote for it?     Two troubling moments involving Senators Dianne Feinstein and Mitch McConnell thrust questions about aging in office out of Congress and into the national conversation.After a series of troubling moments this week, an uncomfortable question has become unavoidable, leaving voters, strategists and even politicians themselves wondering: Just how old is too old to serve in public office?For years, like so many children of aging parents across America, politicians and their advisers in Washington tried to skirt that difficult conversation, wrapping concerns about their octogenarian leaders in a cone of silence. The omertà was enabled by the traditions of a city that arms public figures with a battalion of aides, who manage nearly all of their professional and personal lives.“I don’t know what the magic number is, but I do think that as a general rule, my goodness, when you get into the 80s, it’s time to think about a little relaxation,” said Trent Lott, 81, a former Senate majority leader who retired at the spry age of 67 to start his own lobbying firm. “The problem is, you get elected to a six-year term, you’re in pretty good shape, but four years later you may not be so good.”Two closely scrutinized episodes this week thrust questions about aging with dignity in public office out of the halls of Congress and into the national conversation.On Wednesday, video of Senator Mitch McConnell, 81, freezing for 20 seconds in front of television cameras reverberated across the internet and newscasts. Less than 24 hours later, another clip surfaced of Senator Dianne Feinstein, 90, appearing confused when asked to vote in committee.A political discussion on the issue of age has been building for months, as the country faces the possibility of a presidential contest between the oldest candidates in American history. President Biden, 80, already the oldest president to sit in the White House, is vying for a second term, and Donald J. Trump, 77, is leading the Republican primary race.“When I say we need to pass the baton to younger generations, I’m not talking about youthful generations,” said Representative Dean Phillips of Minnesota, 54, the only Democrat in Congress to say that Ms. Feinstein should step down and that Mr. Biden should not seek re-election. “I’m talking about simply a reasonably less aged generation.”Mr. McConnell’s stumble created a fresh opening for younger contenders to raise the issue more aggressively. On Friday, Gov. Ron DeSantis of Florida, 44, a top Republican presidential candidate, took a jab at the country’s political gerontocracy.“You used to serve in your prime and then pass the baton to the next generation, and I think this generation has not really been as willing to do that,” Mr. DeSantis told the right-leaning commentator Megyn Kelly, noting that Mr. Biden became a senator in 1973 — five years before Mr. DeSantis was born.Notably, Mr. Trump, who would be 82 at the end of a second term, has defended Mr. Biden, saying that the president should not be discounted because of his age. “He is not an old man,” Mr. Trump posted this month on Truth Social, his social media platform. “In actuality, life begins at 80!”Doctors for Mr. Biden have said he is in good health. Less is known about Mr. Trump’s health since he left the White House.After Mr. Biden was captured tripping over a sandbag in June, White House aides have grown increasingly sensitive to any insinuation that he is physically diminished.He now regularly uses a shorter set of stairs to board Air Force One, an observation noted in a report by Politico that prompted aides to circulate 13 photos of his predecessors using stairs that appear to be of a similar length. He has not gone out to get his beloved ice cream, or dropped into any other business for an impromptu visit with voters, since early May. The White House says Mr. Biden’s crowded travel schedule has not allowed for such stops this summer.Some top advisers to Mr. Biden argue that his campaign should directly embrace his age as a political asset — and undeniable reality — rather than avoid the issue.“Age is in fact a superpower,” said Jeffrey Katzenberg, 72, the Hollywood mogul whom Mr. Biden named as a co-chairman of his campaign. “You can’t run from it because you’re 80 years old, right? There’s no denying it. I’ve been of the camp that believes strongly this is one of his greatest assets.”Surveys indicate that voters disagree, with many Democratic voters worrying about Mr. Biden’s age amid Republican attacks. In polling conducted by YouGov last year, a majority of Americans supported age limits for elected officials but were split over the precise cutoff. A cap at age 60 would bar 71 percent of the Senate from holding office, while a limit of 70 would render 30 percent ineligible, an analysis by the firm found.In North Dakota, a conservative activist this week began circulating petitions to force a statewide referendum next year that would prohibit anyone who would turn 81 by the end of their term from being elected or appointed to congressional seats.When asked, Mr. Biden dismisses worries about his age with jokes and boasts about his political experience. Mr. McConnell took a similar approach, telling reporters that he joked with the president about his health scare by saying that he had been “sandbagged” — a reference to how Mr. Biden laughed off his fall.Of course, even a good quip can’t stop the realities of growing older. After Mr. McConnell’s freeze, reports raised additional questions about his health since he missed weeks of work for a concussion in March.For her part, Ms. Feinstein, who has struggled with memory problems and a long absence from the Senate while she recovered from shingles, has appeared at times unable to respond to questions about her condition.Part of the problem, former aides say, is the interdependent relationship between politicians and their staffs. If a senator retires, his or her entire office — several dozen employees — can be suddenly out of work.And who wants to tell the boss that they are, perhaps, past their prime? It can be smoother to simply paper over the challenges by having aides craft policy, limit access to reporters and try to avoid unscripted moments.“The Senate is such a warm, comforting place that you can live inside that bubble,” said Jim Manley, 62, who worked for Senators Ted Kennedy and Harry Reid. “You have staff at beck and call, people opening doors for you all the time.”While other industries have mandatory retirement ages, including some publicly traded companies and airlines, members of Congress have shown little desire for policies that would amount to voting themselves out of a job. Even voters can’t seem to agree on when enough is enough, remaining divided when asked to back a specific age limit.The decision to leave a defining and powerful post is difficult, but the alternative — aging in the public eye — might be worse, former senators warned.“It’s heartbreaking, embarrassing, but it’s up to the individual to come to grips with reality,” said Chuck Hagel, 77, a former Nebraska senator who left office in 2009. “The reality is we are not going backwards; we’re all getting old.     Donald Trump’s Quest to Break America’s Democracy

    What if Mitch McConnell, at the close of his scalding speech on the Senate floor blaming Donald Trump for the riot that occurred at the Capitol on Jan. 6, had promised to use his every last breath to ensure that Trump was convicted on impeachment charges and could never, ever become president again?What if Melania Trump, after the porn star Stormy Daniels said Trump had unprotected sex with her less than four months after Melania gave birth to their son, had thrown all of Trump’s clothes, golf clubs, MAGA hats and hair spray onto the White House lawn with this note, “Never come back, you despicable creep!”What if the influential evangelical leader Robert Jeffress, after Trump was caught on tape explaining that as a TV star he felt entitled to “grab” women in the most intimate places — or after Trump was found liable by a Manhattan jury of having done pretty much just that to E. Jean Carroll — declared that he would lead a campaign to ensure that anyone but Trump was elected in 2024 because Trump was a moral deviant whom Jeffress would not let babysit his two daughters, let alone the country?Where would statements and actions like those have left Kevin McCarthy, his knuckleheads in the House G.O.P. caucus, and other Republicans who now are defending Trump against the Justice Department indictment? Would they be so eager to proclaim Trump’s innocence? Would they be raging against Tuesday’s hearing in Miami? Would they be claiming, falsely, that President Biden was indicting Trump, when they know full well that the president doesn’t have the power to indict anyone?I doubt it. But I know that all of these questions are rhetorical. None of those people have the character to rise to these ethical challenges and take on Trump and what he has done to break our political system. Trump is like a drug dealer who thrives in a broken neighborhood, getting everyone hooked on his warped values. That is why he is doing everything he can to break our national neighborhood in two fundamental ways.For starters, Trump has consistently tried to denigrate people who have demonstrated character and courage, by labeling them losers and weaklings. This comes easy to Trump because he is a man utterly without character — devoid of any sense of ethics or loyalty to any value system or person other than himself. And for him, politics is a blood sport in which you bludgeon the other guys and gals — whether they are in your party or not — with smears and nicknames and lies until they get out of your way.Trump debuted this strategy early on with John McCain — a veteran, a man who never broke in five-plus years as a prisoner of war in North Vietnam, a man of real character. Do you remember what Trump said about McCain at a family leadership summit in Ames, Iowa, on July 18, 2015?When McCain ran for president, “I supported him,” Trump told the audience. “He lost. He let us down. But he lost. So I never liked him much after that, because I don’t like losers.” When the audience laughed, the moderator, the pollster Frank Luntz, interjected, “But he’s a war hero!”Trump — who wangled a dubious medical deferment to avoid the Vietnam War draft — then responded: “He’s not a war hero. He’s a war hero because he was captured. I like people that weren’t captured.” Later that day, Trump retweeted a web post headlined, “Donald Trump: John McCain Is ‘A Loser.’”So part of the way Trump tries to break our system is to redefine the qualities of a leader — at least in the G.O.P. A leader is not someone like Liz Cheney or Mitt Romney, people prepared to risk their careers to defend the truth, serve the country and uphold the Constitution. No, a leader is someone like him, someone who is ready to win at any cost — to the country, to the Constitution and to the example we set for our children and our allies.And when that is your definition of leadership, of winning, people of character like McCain, Cheney and Romney are in your way. You need to strip everyone around you of character, and make everything about securing power and money. That is why so many people who entered Trump’s orbit since 2015 have walked away muddied. And that’s why I knew that all the questions I asked earlier were rhetorical.The second way that Trump is trying to break our system was on display on Tuesday in Miami, where he followed his appearance as a federal criminal defendant with a political meet-and-greet at a Cuban restaurant. There, once again, Trump tried to discredit the rules of the game that would restrain him and his limitless appetite for power for power’s sake.How does he do that? First, he gets everyone around him — and, eventually, the vast majority of those in his party — to stop insisting that Trump abide by ethical norms. His family members and party colleagues have grown adept at running away from reporters’ microphones after every Trump outrage.But precisely because key political allies, church leaders and close family members will not call out Trump for his moral and legal transgressions — which would make his 2024 re-election bid unthinkable and hasten his departure from the political scene — we have to rely solely on the courts to defend the rules of the game.And when that happens, it puts tremendous stress on our judicial system and our democracy itself, because the decision to prosecute or not is always a judgment call. And when those judgment calls have to be rendered at times by judges or prosecutors appointed by Democrats — which is how our system works — it gives Trump and his flock the perfect opening to denounce the whole process as a “witch hunt.”And when such behavior happens over and over across a broad front — because Trump won’t stop at red lights anywhere and just keeps daring us to ignore his transgressions or indict him so he can cry bias — we end up eroding the two most important pillars of our democratic system: the belief in the independence of our judiciary that ensures no one is above the law, and the belief in our ability to transfer power peacefully and legitimately.Just consider one scene in Trump’s indictment. It’s after a federal grand jury subpoenaed him in May 2022, to produce all classified material in his possession. Notes written by his own lawyer, M. Evan Corcoran, quote Trump as saying: “I don’t want anybody looking through my boxes, I really don’t. … What happens if we just don’t respond at all or don’t play ball with them? Wouldn’t it be better if we just told them we don’t have anything here?”“Wouldn’t it be better if we just told them we don’t have anything here?”Better for whom? Only one man. And that’s why I repeat: Trump has not put us here by accident. He actually wants to break our system, because he and people like him only thrive in a broken system.So he keeps pushing and pushing our system to its breaking point — where rules are for suckers, norms are for fools, basic truths are malleable and men and women of high character are banished.This is exactly what would-be dictators try to do: Flood the zone with lies so the people trust only them and the truth is only what they say it is.It is impossible to exaggerate what a dangerous moment this is for our country.The Times is committed to publishing a diversity of letters to the editor.     Daines Endorsement Reflects Uneasy Senate G.O.P. Alliance With Trump

    Senate Republicans, even those who have broken with the former president, say their campaign chief’s decision to back him could boost their push for the majority.WASHINGTON — When Senator Steve Daines, the leader of the Senate Republican campaign arm, quietly informed Senator Mitch McConnell, the minority leader, that he intended to endorse former President Donald J. Trump, Mr. McConnell was fine with the idea.Mr. McConnell, the Kentucky Republican, is not on speaking terms with the former president, having abruptly turned against him after the Jan. 6, 2021, attack on the Capitol. Mr. Trump has publicly savaged the senator and repeatedly demeaned his wife with racist statements.But the minority leader, according to a person familiar with his thinking, believed that somebody in the Senate G.O.P. leadership ranks should have a working relationship with the party’s leading presidential contender — and it might as well be the man charged with winning back the Senate majority.Mr. Daines’s endorsement of Mr. Trump this week — and Mr. McConnell’s private blessing of it — highlighted how top Senate Republicans have quietly decided to join forces with their party’s leading presidential candidate, putting aside the toxic relationship that some of them have with him to focus on what they hope will be a mutually advantageous political union.Mr. Daines of Montana, the chairman of the National Republican Senatorial Committee, is the first and so far only member of the Senate G.O.P. leadership team to endorse Mr. Trump. Mr. McConnell, who enabled Mr. Trump and his agenda during much of his presidency before the Capitol riot, has not spoken to the former president since December 2020. His No. 2, Senator John Thune of South Dakota, also has been mercilessly attacked by Mr. Trump.Mr. Thune portrayed Mr. Daines’s embrace of the former president as the cost of doing business — what’s necessary to win.“He’s got a tough job to do,” Mr. Thune told reporters at the Capitol. “He’s got a lot of races around the country that we need to win. And I think he wants as many allies as possible.”Asked about the fact that Mr. Daines has endorsed someone who has attacked both him and Mr. McConnell, the senator was temporarily at a loss for words.“Well,” Mr. Thune said with a pause, “what can I tell you?”Many Senate Republicans, in contrast to their counterparts in the House, view Mr. Trump as a political anchor who cost them the majority in 2020 with baseless claims of voter fraud in Georgia that damaged their runoff chances. Many believe Mr. Trump cost them again in 2022 by endorsing Senate contenders who struggled in the general election. He has ignored Mr. Trump’s attacks against him and his wife, and he has refused to follow the approach of former Representative Liz Cheney, Republican of Wyoming, who has said she plans to do whatever she can to stop Mr. Trump from becoming president again.Instead, Mr. McConnell has said he is focused on winning back the Senate, and in service of that goal he is already making accommodations for the former president. He has said he will support Mr. Trump if he wins the 2024 Republican nomination.Like many of his colleagues, Senator John Cornyn of Texas, a former chairman of the Republican campaign arm himself, is staying out of Mr. Trump’s way. He said he did not plan to endorse in the primary, but “will support the nominee” in the general election.Mr. Daines, he said, was “entitled to some latitude given the complexity of the political environment that we’re entering into.”Republicans’ goal, Mr. Cornyn added, was to win back the majority.“And I don’t really care what the tactics are,” he said.
