    Owner and Manager of Grimaldi’s Pizzeria Are Charged With Wage Theft

Workers sent desperate text messages.The owner of Grimaldi’s Pizzeria and the manager of its Manhattan branch were arrested on Thursday and charged with stealing more than $20,000 in wages from at least seven employees.Over the course of at least four years, the owner, Anthony Piscina, 63, and the manager, Frank Santora, 71, lied to and exploited pizza makers, salad preppers, busboys and dishwashers, the Manhattan district attorney, Alvin L. Bragg, said at a news conference.The seven workers are each owed between $500 and $8,000, according to court documents.“What may appear to some as a relatively low dollar amount can have life-changing consequences when someone is making minimum wage,” Mr. Bragg said.Both men pleaded not guilty to one felony charge of scheme to defraud and seven misdemeanor counts of wage theft.     New Havana Syndrome Studies Find No Evidence of Brain Injuries

    The findings from the National Institutes of Health are at odds with previous research that looked into the mysterious health incidents experienced by U.S. diplomats and spies.New studies by the National Institutes of Health failed to find evidence of brain injury in scans or blood markers of the diplomats and spies who suffered symptoms of Havana syndrome, bolstering the conclusions of U.S. intelligence agencies about the strange health incidents.Spy agencies have concluded that the debilitating symptoms associated with Havana syndrome, including dizziness and migraines, are not the work of a hostile foreign power. They have not identified a weapon or device that caused the injuries, and intelligence analysts now believe the symptoms are most likely explained by environmental factors, existing medical conditions or stress.The lead scientist on one of the two new studies said that while the study was not designed to find a cause, the findings were consistent with those determinations.The authors said the studies are at odds with findings from researchers at the University of Pennsylvania, who found differences in brain scans of people with Havana syndrome symptoms and a control groupDr. David Relman, a prominent scientist who has had access to the classified files involving the cases and representatives of people suffering from Havana syndrome, said the new studies were flawed. Many brain injuries are difficult to detect with scans or blood markers, he said.     Starbucks and Union Agree to Work Out Framework for Contract Talks

    In an initial move, the coffeehouse chain said Workers United members would get improved benefits that other employees received in 2022.Starbucks and the union that represents employees in roughly 400 of its U.S. stores announced Tuesday that they were beginning discussions on a “foundational framework” that would help the company reach labor agreements with unionized workers and resolve litigation between the two sides.The union greeted the development as a major shift in strategy for Starbucks, which has taken steps to resist union organizing at the company since the campaign began in 2021, moves that federal labor regulators have said violated labor law hundreds of times.Starbucks, which has denied the accusations, said in a statement that it hoped to have contracts negotiated and ratified by the end of the year and would agree to a “fair process for organizing” — something the union has demanded for years. It said that, as a gesture of good faith, it was providing unionized workers with benefits it introduced in 2022 but withheld from union stores, like an option for customers to tip via credit card.Representatives of both Starbucks and the union, Workers United, said that while details must be worked out, they hoped to be back at the bargaining table in the coming weeks.     Company Hired 24 Minors to Clean Slaughterhouses, Labor Department Says

    Fayette Janitorial employed at least 24 children between the ages of 13 and 17 to work overnight shifts cleaning dangerous equipment at plants in Virginia and Iowa, federal regulators said.A Tennessee-based company employed at least two dozen children as young as 13 to work overnight shifts cleaning dangerous equipment in slaughterhouses, including a 14-year-old whose arm was mangled in a piece of machinery, the Labor Department said on Wednesday.The department filed a request on Wednesday for a temporary restraining order and injunction in U.S. District Court for the Northern District of Iowa against the company, Fayette Janitorial Service LLC. It provides cleaning services at slaughterhouses in several states, including Iowa and Virginia, where the department said an investigation had found that the company had hired children to clean plants.The Labor Department opened its investigation after an article in The New York Times Magazine reported that Fayette had hired migrant children to work the overnight cleaning shift at a Perdue Farms plant on the Eastern Shore of Virginia.Fayette did not immediately respond to requests for comment. A spokesman told The Times in September that the company was unaware of any minors on its staff and learned of the 14-year-old’s true age only after he was injured.Meat processing is among the nation’s most dangerous industries, and minors are barred under federal law from working in slaughterhouses because of the high risk of injury. But that has not stopped thousands of destitute migrant children from coming to the United States from Mexico and Central America to work dangerous jobs, including in meatpacking plants.The Labor Department found that Fayette had hired at least 24 children between the ages of 13 and 17 to work the overnight shift cleaning dangerous power-driven equipment at a Perdue plant in Accomack County, Va., and at a plant operated by Seaboard Triumph Foods in Sioux City, Iowa.     New York Asks Realty Company to Investigate Sexual Assault Allegations

    The state comptroller wants eXp Realty to look into allegations that female real estate agents were drugged and assaulted during company events.The New York state comptroller has asked the real estate brokerage eXp Realty to open an independent investigation into sexual harassment and assault allegations exposed in a New York Times article last month.As New York’s chief fiscal officer, the comptroller, Thomas DiNapoli, is the trustee of the New York State Common Retirement Fund. According to the most recent SEC filing, the pension fund held nearly 27,000 shares of eXp World Holdings, the publicly-held parent company of eXp Realty.In two separate lawsuits, five current and former agents at eXp Realty said that two top agents at the brokerage drugged and them assaulted them at separate eXp recruiting events. Four of them said they were subsequently sexually assaulted, and The Times investigation uncovered a pattern of eXp leadership silencing those who tried to make reports.“The New York Times report raised a huge red flag for us as an investor in that company,” Mr. DiNapoli said in an interview. “We found the allegations very concerning and as a shareholder, we are asking questions.     Norfolk Southern Agrees to Try Out Federal Safety Reporting Program

    The company, which operated the train that derailed in East Palestine, Ohio, is the first major freight railroad to join a federal program that allows workers to report safety issues.Norfolk Southern, the operator of the freight train carrying toxic chemicals that derailed in East Palestine, Ohio, nearly a year ago, has agreed to participate in a federal program that allows employees to report safety issues confidentially, the company and federal officials announced on Monday.In the aftermath of the derailment, Transportation Secretary Pete Buttigieg called on Norfolk Southern and the nation’s other major freight railroads to join the program, one of a series of steps he urged them to take to improve safety.The railroads committed in March to participating, but in the months that followed, they pushed for changes to the program to address concerns about how it functions. None of the largest freight rail companies, known as Class I railroads, had officially agreed to join until the announcement on Monday.Norfolk Southern’s participation in the program, known as the Confidential Close Call Reporting System, or C3RS, will be limited in scope. The railroad will carry out a one-year pilot program that will apply to about 1,000 employees in Atlanta; Elkhart, Ind.; and Roanoke, Va., who are members of two unions, a small fraction of the company’s work force of roughly 20,000 people.“Norfolk Southern has taken a good first step, and it’s time for the other Class I railroads to back up their talk with action and make good on their promises to join this close call reporting system and keep America’s rail network safe,” Mr. Buttigieg said in a statement.Alan H. Shaw, the chief executive of Norfolk Southern, said in a statement that the company was “committed to setting the gold standard for rail safety, and we are proud to be the first Class I railroad to deliver on our promise to co-develop and launch a C3RS program.”The federal program, which is modeled after a similar one for pilots and other aviation personnel, allows railroad employees to report safety issues without worrying about potential discipline. But the freight rail companies raised concerns that workers might be able to take advantage of the program as a way to shield themselves from punishment after making dangerous mistakes.The Association of American Railroads, an industry group, said on Monday that the other major freight rail companies were still committed to joining the program.“This commitment remains unchanged,” said Jessica Kahanek, a spokeswoman for the group.     For Election Workers, Fentanyl-Laced Letters Signal a Challenging Year

    As overheated rhetoric and threats rise, people are leaving election jobs in record numbers.For the people who run elections at thousands of local offices nationwide, 2024 was never going to be an easy year. But the recent anonymous mailing of powder-filled envelopes to election offices in five states offers new hints of how hard it could be.The letters, sent to offices in Washington State, Oregon, Nevada, California and Georgia this month, are under investigation by the U.S. Postal Inspection Service and the F.B.I. Several of them appear to have been laced with fentanyl; at least two contained a vague message calling to “end elections now.” The letters are a public indicator of what some election officials say is a fresh rise in threats to their safety and the functioning of the election system. And they presage the pressure-cooker environment that election officials will face next year in a contest for the White House that could chart the future course of American democracy.“The system is going to be tested in every possible way, whether it’s voter registration, applications for ballots, poll workers, the mail, drop boxes, election results websites,” said Tammy Patrick, chief executive for programs at the National Association of Election Officials. “Every way in which our elections are administered is going to be tested somewhere, at some time, during 2024.”Ms. Patrick and other experts said they were confident that those staffing the next election would weather those stresses, just as poll workers soldiered through a 2020 vote at the height of a global pandemic that all but rewrote the playbook for national elections.But they did not minimize the challenges. Instead, they said, in some crucial ways — such as the escalation of violent political rhetoric, and the increasing number of seasoned election officials who are throwing in the towel — the coming election year will impose greater strains than in any of the past.Temporary employees at the Maricopa County Tabulation and Election Center in Phoenix processed mail-in ballots last year.Ilana Panich-Linsman for The New York TimesBy several measures, an unprecedented number of top election officials have retired or quit since 2020, many in response to rising threats and partisan interference in their jobs.Turnover in election jobs doubled over the past year, according to an annual survey released last week by the Elections & Voting Information Center at Reed College in Portland, Ore. Nearly one-third of election officials said that they knew someone who had left an election post, at least in part because of fears over safety.Another recent report by Issue One, a pro-democracy advocacy group, said that 40 percent of chief election administrators in 11 Western states — in all, more than 160 officials, typically in county positions — had retired or quit since 2020.“They feel unsafe,” said Aaron Ockerman, executive director of the Ohio Association of Elections Officials. “They have great amounts of stress. They don’t feel respected by the state or the public. So they find other employment.”A certain number of departures is normal, and in many cases, experienced subordinates can take over the tasks.But departures can create collateral damage: Promoting an insider to a top elections job leaves a vacancy to be filled at a time when it is increasingly difficult to recruit newcomers to a profession that is only becoming more stressful. Experts also worry that the aura of nastiness and even danger attached to election work will drive away volunteers, many of them older Americans, who are essential to elections in all states except the handful in which residents largely vote by mail.Each election requires many hundreds of thousands of volunteers to staff polls. At a recent meeting of election administrators, roughly half were “really worried” about recruiting enough help for next year’s elections, said David J. Becker, executive director of the Center for Election Innovation and Research, a nonprofit in Washington, D.C.Experts worry that threats to election workers could drive away volunteers, many of whom are older Americans.Anna Watts for The New York TimesLike Ms. Patrick, of the election officials association, Mr. Becker said he expected that any election-season staffing problems next year would be localized, not widespread. He noted, for example, that groups that are new to recruiting poll workers, such as sports teams, universities and private businesses, are helping to find volunteers.One wild card is the extent to which threats to election workers and other attempts to disrupt the vote will ramp up as the presidential-year political atmosphere kicks in.Harassment and threats against election officials were widely reported in the months after former President Donald J. Trump began to claim falsely that fraud had cost him a victory in the 2020 election. But election officials say that the threats have not stopped since then.In June, the downtown office of Paul López, the Denver clerk and recorder, was attacked overnight with a fusillade of bullets, pockmarking the building’s facade and a ballot drop box and bursting through a window into an office cubicle. And from mid-July to mid-August, the Maricopa County elections office in Phoenix recorded 140 violent threats, including one warning that officials would be “tied and dragged by a car,” Reuters reported.The challenges go beyond threats to demands that can make the requirements of the job feel limitless.In the last year, for example, election offices nationwide have been bombarded with requests, usually from election skeptics and allies of Mr. Trump, for millions of pages of public records relating to voter rolls and internal election operations. Similarly, offices in some states were hit this year with challenges to the legitimacy of thousands of voter registrations.In both cases, the ostensible purpose was to serve as a check on the integrity of the ballot. The practical effect — and sometimes the intent, experts say — has been to disrupt election preparations and, in some cases, to make it harder for some people to vote.“It’s impacting thousands of election officers,” Ms. Patrick said. “It isn’t the case that those who are driving the narrative are numerous. But we know there are large numbers of people listening to them and reiterating what they hear.”Election offices nationwide have been bombarded with requests for millions of pages of public records relating to voter rolls and internal election operations.Rebecca Noble for The New York TimesSome of the language is beyond the bounds of normal political discourse.Mr. Trump, in a speech in New Hampshire this month used language more in keeping with fascism than democracy when he threatened to “root out the communists, Marxists, fascists and the radical left thugs that live like vermin within the confines of our country, that lie and steal and cheat on elections.”Such toxic language has an effect, said Rachel Kleinfeld, an expert on political violence and the rule of law at the Carnegie Endowment for International Peace in Washington, D.C.“There is a very clear link between the rhetoric of politicians and other leaders who both dehumanize and posit another group as a threat to incidents of political violence,” she said. “Trump himself seems to have a particular knack for this.”“What’s distressing,” Ms. Kleinfeld added, “is not just that election officials are quite worried by these threats, but that they’re not dissipating” in what should have been a quiet period between national elections.Ms. Patrick said she was distressed as well. “I feel like we’re in a very tenuous time, but there are bright lights to see,” she said. “In 2022, we had candidates who lost and conceded admirably and civilly. This month, we saw people continuing to serve as poll workers and people raising their hands to run for office on platforms of truth and legitimacy. As long as we have people who are willing to believe in facts, we’ll get through this.” More
